[0:09:04] let's recognize these ball players this is a wonderful brother kid and let me Rodney Fleming has a little presentation he wants to make I've never been so proud of a football team this is this is our my kids go to the school and this school has more team spirit than any school I've ever seen and it is a team effort with the football players the cheerleaders the band and the parents I was just talking to a parent out there and if it weren't for the parents putting these boys in the YMCA football early on and teaching them we probably would never would be to this point the city of San Angelo wants to declare that Thursday December the 19th is going to be one hot day we want everybody from the city of San Angelo to go and support this team because it's been years and years since any team has ever gone to this level this is the first time the one Hawks has ever have ever gone this far and we want to cheer him on and and bring home the championship and we also have another very important
[0:12:26] group of people with us here today and this is from Central High our Central High girls volleyball team and I would like if you would please come forward and we want to recognize and honor y'all for tremendous season for doing more doing it better exceeding our expectations your high standards inspire us all and come forward Connie you start and identify yourself in your position and lineup and we want to honor and recognize you thank you so much for having us here today what an honor these girls represent the very best at central high school they don't only except excel on the volleyball court there are multiple sport athletes there stellar in the classroom they are involved in student government and student organizations they're active in their church youth groups and it's just a great bunch of girls we did have a fantastic season we had our second 30 win season we finished 31 and 10 district runner-up by district champion unfortunately we lost in the area around to a very good team from Arlington we won the need of an oi champion volleyball tournament for the second year in a row and we placed in our Duncanville and Smithson Valley tournaments and probably one of our most important accomplishments this year is that we helped raise $15,000 in our rally for a Cure of match this year and I don't know that they're in any particular order but I'm going to introduce these girls in numerical order number one Alyssa Rios she's a junior Alyssa is a defensive specialist and she was named Academic all-district this season number 2 Hannah McEntire Hannah's a freshman she was named honorable mention all district in Academic all-district number 3 Junior Ally Holdrege Ally was named Academic all-district we have a lot of Smarties on this team a lot of Smarties to be named Academic all-district you have to have a 90 or above and all of your core class all of your classes we also have some girls that were named academic all-state they have to be seniors in heaven 94 average or higher number 5 hailey thompson she's a senior she was a
[0:14:30] horrible mention all district Academic all-district and academic all-state number six senior Lauren pause Lauren was first team all-district Academic all-district academic all-state and all West Texas number seven freshman bailey Waddington bailey was second team all-district Academic all-district number eight junior Alexia Oliver number ten junior McHale Russell McHale was 1st team all-district Academic all-district in all West Texas number 11 senior Sophia Flores 2nd team all-district Academic all-district academic all-state I told you they were smart number 13 junior Ali standard she's back there in the back she's hard to see second team all-district number 14 senior Jordan Cole Jordan was named the district to 5a outstanding hitter she was all West Texas MVP she's been named the Texas girls Coaches Association all-state and she's also an all-star alternate this year and number 16 junior Amanda Torres Amanda as honorable mention all district Academic all-district and our most valuable assistant coach is David Millsaps thank you so much for having us here you know I guess I just stand here and say it is that okay coach both mozart congratulations to you and the girls as a former Central High School graduate I'm very proud to have gone there and been a part you know I feel like you know I'm there again but again congratulations to all of you but there is a there's a gentleman the audience that they're just near and dear to my heart in the only and I've known him since I says probably oh three when I first served on the school board and I made some notes because my heart was talking to me this morning I wanted to make sure I hit everything but you know I believe that this man is a he has a passion for the youth and education he's willing to go the extra mile he's always been there for me his I I know that much

[0:20:42] I appreciate the opportunity to talk to you I just wanted to bring up a concern of mine as a citizen of San Angelo regarding night lighting night skies preservation of night skies in in light pollution much attention on preserving natural resources not the least of which around here is focused on water and rightfully so however I'd like to address the council regarding a nuts another natural resource that rarely gets a second thought and that's our night sky on the increasing light pollution that dim is diminishes the grandeur of a beautiful dark West Texas sky let me first say that I'm not here because I'm against the lighting I understand the need for safety and security at night the good news is they're not mutually exclusive as you'll see in the handout that I've given on the top page front and back it points out that there are essentially three main types of light pollution glare light trespass and sky glow the second point is really what got me to take action in coming here today about three months ago a quiet large and bright light went up across from my home and it's quite disturbing before I knew it three more three more joined that one there much higher in the sky than regular street lights and each pole has one dozen floodlights on them all the way around this is when you come into San Angelo from the south or from the east after dark you can see these lights from 15 or 20 miles away I understand the intent of why those lights went up there lighting up a oil and gas field services yard but ironically because of the poor selection of the fixtures used and the manner in which they were installed much of the light is not illuminating the intended area and a tremendous amount of light and energy is being wasted by lighting up the sky and
[0:22:46] my living room and bedroom often when trying to correct ineffective and inefficient lighting night lighting an existing light fixture can be modified by simply adding a shield or tilting it downward and the problem is resolved new fixtures aren't always necessary sometimes simply switching the light on or off or having a timer on as the solution and once to resolve the impact is immediate so this isn't have to do with difficult things like climate change and what not that the impacts take a long time to make a correction this you fix it and it's done and you have an immediate impact it's I had a little demonstration and it's terribly effective but it's I think a little bit disruptive for the presentation today so if there's another interest in another time it's a simple little mini flag flashlights and a cap a cover but I'll save that for another day continue on just a couple of more thoughts it's worth mentioning that this is a matter important enough from at least a safety standpoint alone in that $19.99 the set the 76 Texas Legislature enacted a law chapter 425 in the Texas Health and Safety Code which requires any new or replacement light fixtures to be properly shielded affectingly making them a safe and and nightfright night sky friendly fixture for all funded outdoor lighting fixtures and that includes all txdot lighting so anything along the highways streets rest areas or otherwise must fit the definition of properly night proper night lights today counsel you'll be spending time thinking and talking about how San Angelo grows and and our path forward and I would argue that lighting and the impacts of lighting also be considered as a part of that process in addition to the documents that I've provided here today there are many more resources available I'd be happy to facilitate the council
[0:24:50] and staff and becoming better aware of and educated on the issues related to effective and efficient night's lighting for this community when driving around after dark around town I did this last night myself take notice of the glare and these are simple concepts if you just take two seconds to look at this you'll know what we're talking about but take a notice of the glare that you notice when you can see the actual bulb shining that light and how obtrusive it is and then notice how much more pleasing it is to look at a building or in an area that has soft soft shielded lights lighting around here living around here looking up at the night sky and seeing the Milky Way is something we take for granted doing that however is something that most people who live within a hundred and eighty miles to our east the i-35 corridor all the way to the Atlantic Ocean can't do any more it's a piece of our heritage that we're slowly losing and something worth protecting by putting a little effort into we sing a song about the bright stars deep in the heart of Texas and folks that's where we call home and it's our obligation to pass that on to our children in theirs so appreciate you taking time to consider this and like I said I'd be happy to provide any other further information as may be warranty thank you for your time and service Thank You mr. matter yes sir Daniel is there anything is there code violations as are there rules that have to be met for this maybe maybe we need to look into this well take a look at it I know that as far as our ordinances in Lycia correct me if I'm wrong here as far as the ordinances we do have established as far as lighting we inside the city limits we could amend our ordinances to have a specific light nuisance abatement ordinance but we do have some zoning requirements M&A emanating lighting on in residential areas so we would if anything would have to take a look at the right mending that
[0:26:52] if people want to go any further that so do we need getting in with James sure I mean we can weaken me with him in no we'll get with James floors who is our code enforcement director one thing cut planning get the planning Emily James and planning and I have looked into this correct mr. Valenzuela and we just need direction to proceed further okay does this it doesn't have any teeth in that in the ordinance does it I mean because I think I think you're probably talk talked about though my situation in my district with a person that's out at the lake yes absolutely and we can't stop that person right now right under the current regulations we don't we're not able to remedy that that situation that's what I've been tone we need them we need to look at getting a light ordinance because this is I haven't seen your situation but I have seen the situation out at the lake and if I was next door to the person out the lake I'd be furious because how probably looks like that say it looks just like that you cannot sleep it's and this person was asked the neighbors I even asked them if they could pay for putting shades over the lights and they said no so I think we're gonna have to go to the next step where we're gonna have to I'm involved in a hill country group that is looking at this and and and I know a lot of folks that that work on ordinances that are doing them as this second document points out there are dripping springs bernie blanco helotes have all pasts outdoor lighting ordinances recently we've got sample ordinances there are wonderful resources on there's a website yes so there's a lot of stuff out there it's not recreating the wheel at all it's just finding something that or tweaking it to suit our situation in San Angelo lion I think what do you live at I live just off of South Jackson in the Thruway in the central part center over the river and out towards the east and south to

Madison we will we will we'll attend to this thank you very much for brains at our attention is there anyone else in the public that would like to approach the council with anything on the agenda consent agenda or just want to address or redress the council this is your opportunity it or not mirror by me yes sir our water utilities director Ricky Dixon we just got awarded his mother passed away her condolences go out to him and I ask that if you have an opportunity please pray for his family for Ricky and again it's always I know what it feels I can lose a mother so it's a very painful moment for him so please pray for him is there anybody is there anyone on the council that wishes to pull anything from consent to regular anyone on the council care to make a statement is there anything needs to be said I move that we accept the items that are on the consent agenda I do have a motion in a second to accept the consent agenda as presented I do have one thing that I want to address quickly and this was I was Ricky I talked to Ricky Dixon about this the other day I got a report the other night that a that an oilfield truck or water truck was seen at a fire hydrant illegally loading and I called Ricky and I asked him about it and I said is there any is there any authority for any oilfield truck to be loading water at a fire hydrant and he said absolutely not this is the third time in the last couple of months that I've dealt with this there is no authority these wall companies have zero legal rights to fill up at these fire hydrants it is off it is off lid off-limits it cannot be done it is illegal and any oilfield truck that any of the citizens see that are loading water from a fire hydrant they are doing this illegally it is a they are stealing water so I
[0:31:00] understand that the the individual that called me had confronted them and they said they had the authority they have no authority they have Noah so in the future and I plan on talking to our Police Department about this and putting this on some of the regular patrols this one was out in the industrial park but I want to add these to our to our to our areas of patrol and if you need the citizens see any of these big oil trucks filling up with water and a fire hydrant they're doing it illegally and they are stealing our water so I want that very very plain the city is not allowing this that's all I had to say and I did confirm this with Ricky Dixon is there any public comment on the consent agenda and approval number five the appointment commission it just looks at water I hate this answer but it's how we do it in the past but we can't always move it into the boards and commissions basically it's confirming the parks commission selection versus the Council of pointing or making that number okay little different there thank you and Johnny that's a self-perpetuating and just for the record Johnny I asked that exact same question okay I do have a motion to approve consent as as listed I do have a second all in favor say aye aye any opposed say nay so put a 600 on the consent agenda this has passed and now we will move to item number 9 which is under the public hearing and the comments section and this will be a presentation of the third and the fourth quarter 213 reports from the Chamber of Commerce economic development council and the convention in Visitors Bureau vice president Pamela Miller vice president John dig brother Duncan you are on sir good morning mr. mayor council I've got kind of a two-pronged approach to the report this morning you
[0:33:05] should have about ten pages in your packet that kind of outline a lot of different things what I'd like to do today is you like as I say two things talk specifically about the program that we're running in how we're running it and then we can talk specifically about the day to day activity the last part of the report that you have is the day to day activity will report that on a weekly basis to our board and that's just a compilation of all of those things but before we get started what I wanted to do is talk a little bit about the program and how we're doing things in San Angelo you know it's interesting and I agree with you mr. mayor what you said earlier we're kind of going downhill from when we started in the meeting this morning because what we were looking at is the future of our community and you know you you remember that we and our economic development partners are all doing what we do to preserve and bring the community forward for those kids that we saw standing here so because of that it's a very important concept at least for me as we go forward but what I wanted to do is talk to you a little bit about what we're doing how we're doing it and what we see as not only the the things that that we need to move forward with but also some changes that we think probably are going to need to be made to address as you are today some of the situations that we're seeing because what's going on in the economy in San Angelo just to give you a very brief overview the Chamber of Commerce has worked with the city of San Angelo and has developed a marketing program for economic development within the community my current budget comes from a contract with custody C it also comes from Tom Green County we have cornerstone funding which is a group of investors who invest in the council or in the chamber for us on an annual basis and help with our budgets to help do specifically economic development and to move the the city forward from a standpoint of preserving
[0:35:10] what we have and trying to look and add to what we have and that can go either through my department through the convincin Visitors Bureau and we've got a couple of other things that we can can move through with that historically the city of San Angelo has been part of that program all of that has been moved over and I think there was some question on the the dollars in the budgeting it passed pass council meetings all of the contract funding has moved from the city itself to cosa DC and that's that's what funds the program from our standpoint on our duties we develop all the marketing materials for the community we do direct mail outs we represent a national trade shows we work public relations we do web-based marketing we have a lot of personal contacts that we have all around the country as well as within the state and we also and this is a piece that a lot of people don't realize is we do a lot of research we store a lot of the demographics and we answer a lot of questions from not only our companies who are trying to do reporting to their corporate offices but also to anyone who's looking at the community we try to keep all the information on the community through my department and move forward with that we have a lot of partners in San Angelo and as you know we have moved forward in the last couple of years to the Business Resource Center and in that Resource Center we have offices for the city of San Angelo we have offices for us for workforce for downtown for SBDC and of course the group upstairs which is our business incubator moved into that building as well we've got everybody working very diligently with that the other piece that we have with that is that goes very directly with workforce is the educational piece we work very closely with ASU and Howard college to try to support those efforts as well we're always looking for additional pieces
[0:37:15] that we can get to including grants including some creative financing those types of things as well and try to move forward the community put together a strategic plan in 2012 it was adopted by the council and especially Union Council members if you haven't had the opportunity to really go through that strategic plan I think you will find that it pinpoints a lot of the things we as a community need to be moving forward with we have some very high goals within that there is no dust on that particular report we work on that on a daily basis we are not only working on the marketing piece to try to get companies into the community and working at those target industries which are listed in the report that you have in front of you but we also are working with the governmental entities we are supporting Goodfellow through our efforts and doing all of those things one of the ways that we do that is is of course through the representation in some of the memberships that we have we work very diligently with the city to make sure that porcelains is moving in the right direction I know that there have been some discussions about some of our other memberships with Texas Midwest Community Network and also with high ground in Texas what I want to remind the council of as I remind cut the custody see board those memberships are the city's memberships those are not my memberships I simply represent the city in those efforts and we'll be more than happy to continue to do that but it would be very preferable for not only me but also whoever walks into and becomes the person in charge of economic development for the city to be part of that as well historically there's never been a lot of involvement from the city staff and we would like to see more of that I think it could be very beneficial to the community as we move forward one of the other things that we work through is the chamber of course is the Military Affairs piece cornerstone that I'd mentioned earlier supports a lot of that it pays for an annual trip that gets us to Washington we continue to work with good fellow and it's just kind of an
[0:39:16] added value with the the chamber contract in the city and the partnerships that are going forward we also are very diligently working to be a resource for local businesses and right now we think it's extremely important that we not only look outside the community but we also are very diligently and directly involved with the local businesses within the community this is probably one of the first things that that from from a discussion of our contract that's going to be a little bit different this year we've never been we we've been more involved in the marketing outside the community we have always worked with local businesses because that's what the chamber does but that really has not been our direct line and what we would like to do is look at that a little more internally and I think that needs to be part of those discussions as we move forward with the new contracts we have been working with the custody seaboard to move forward with that what you'll see in the later report is I'm working with a lot of local businesses right now we are seeing everything from expansions to reorganizations to other opportunities that we feel are going to be viable for a lot of our businesses we must as a community maintain the diversity that we have we've got some wonderful opportunities as well as challenges right now with the oil field and we can use those to leverage opportunities for our local businesses to become suppliers to expand but it is imperative that we continue to diversify our community if we don't in a few years as we all know as West Texans this thing will bust and then we are going to be so energy centric that it is going to have a huge impact on those kids that were standing up here earlier and I don't want to see that happening so we've got to move forward with that I was was in banking when everything busted back in the late 80s and was living in Abilene Texas we were so energy dependent that it almost destroyed our whole community
[0:41:18] and that's what Texas learned at that time because it was so bad is what you need to continue to diversify and we still want to continue to do that so what I would would ask from from your standpoint is the input that we need on on how we need to move forward as a community you are addressing that in so many ways with the ordinances with the you know light being brought into you today we're going to continue to see those things as we move forward and we're going to continue to see those challenges and please be supportive of that and and move forward with with those things the other thing is I know mr. Seamon stood before you a couple of meetings ago talked to you about our contract if anyone wants to be involved in those discussions we would love to have that input you know we're here serving at your pleasure and I want to make sure that what we're doing and our programs are in line with what the council wants we feel like we're having good communication with the board at this point we just want to make sure everybody is on the same pages we move forward because there's a lot going on and there's going to continue to be a lot going on over the next few years that being said if you'll look at the weekly activity just just to kind of give you an idea over the last few months and what we've been doing we have met with 21 commercial developers we've met with 11 energy companies we've worked with 5 companies considering it moved to San Angelo and most importantly to me because it really does emphasize the change that we're saying is 14 meetings with local businesses those businesses we've got some that are looking at the opportunities and moving forward with them some that are having real difficulties right now they're having difficulties with workforce they're having difficulty with pricing all of those things we need to be working with those companies what we would like to see is possibly custody see looking at some changes and that's one of the conversations we're having with that board looking at some changes that will maybe lower some thresholds for our local companies to help them
[0:43:24] with some type of incentive program are there other programs that we can look at that will help them are there educational programs that we can help through that half cent sales tax funding to support some of the things that are going on when I was in Abilene we put together a program that supported a welding program for the area because we had a lot of still going on and we had a huge shortage those are the things that we can be creative and look toward but I think there will be some opportunities there I think that we should give some favoritism to our local businesses they have already chosen to be here and I think it's very important that we are taking care of their needs as well as anyone else coming in yes sorry what page are we on I don't I don't see it oh I'm sorry very good job if you go to the weekly activity Johnny and I'm sorry I didn't I didn't know you could go into I mean what what's become of those meetings you're singing all over town we're talking about look you look at the number of new hotels that are moving in look at the new commercial space that that people are looking at length look at the new building that's going on we're looking at everything from housing to hotels to restaurants to you know pretty much anything that's going on that's going to support the economy and the community as we grow over the next few years I was in Big Spring last week or week before I guess and of course annuals there as well listening to what UTSA came in there are some some rosy numbers coming through that study that we think is going to have a huge impact not only in West Texas but on San Angelo having a talk with dr. Tuttle after his presentation and talking to him about what we're saying he feels like San Angeles specifically we may see some changes in those numbers because there had not been they had not really taken into account much drilling in Tom Green County and we are actually seeing drilling in Tom Green County we
[0:45:27] think that's going to have an impact on us we're still working through those processes to try to do those projections but we think that we will have some some major opportunities there that we can leverage for our local businesses as well I've been talking of course a lot of you know I have a background in banking I've been talking to a lot of the bankers in town because they're going to be our first line of defense with our new companies but also with our existing companies to expand into those opportunities that we're seeing because of what's going on in the oilfield that financing is going to make a huge difference for our local companies as well and we want to make sure that we're working with them and being creative in the financing piece as well excuse me yes mr. mayor I guess the question I was leading to is the the 21 developers 11 energy five companies considering moving to San Angel what do we what what do we do to get them passed to consider and get them here well what are we doing what can we do we're developing relationships with a lot of them and just give you an example one of the last things there we've got of course case whole solutions who has ball Tony Akers in the business park the first first ground we sold in that Business Park in a number of years we met with them and over the course of about 14 to 18 months I mean it literally started with a conversation with me and their representative we brought people in the other thing I guess I need to probably remind you guys is from and especially from an incentive standpoint I have to bring them to you but I I don't have any authority to give them anything so you know we have to bring in all the partnerships to make sure that that works you worked with us and with the city staff to set the pricing on that land and let's just say it took a lot of negotiation back and forth and that's why it took so long but the majority of these projects we're talking about years sometimes in the making it's there is there's no such
[0:47:31] thing as a fast economic development project unfortunately so you continue to work you continue to build those relationships you continue to have business but I'm very fortunate because I can also bring in all of the partners and have done that with a lot of them I'm working with a company right now that I worked with for almost 18 months it's a manufacturing company out of from out of the country and they have been in we have I have set up meetings for them with local accountants I've set up meetings with them with local contractors and engineers for buildings I have set them up with workforce we basically try to give them everything that we as a community can to convince them this is the place to be and these are the things that we can do to help you so we work with them we work with city staff we work with the workforce board we work with Howard College for for training we offer all of those things and we bring those people into those meetings as they're needing needed and we and I'll tell you San Angelo has a lot to be proud of from a standpoint what their resources are if we can we can put on a good show it's a matter of getting them to pull the trigger and that's that's where it always ends I'm not going to go in through through the whole thing basically that's that's a synopsis of that activity that's the synopsis of what our program looks like again we always welcome input we always want you guys to be involved we want to be doing what you want us to be doing and so from that standpoint I'll leave it there are there any other questions that I can cover today other questions John I'll be meeting with Phil on the there's there was a concern there's brought up as far as some of the businesses we've had a couple of few of them that have closed their doors and just wanted to make sure that we could do what we can to assist those companies
[0:49:34] those businesses also and I definitely left to have you in that meeting too I would love to be part of that and and I will tell you we are working with a lot of those businesses we go through I've got a real concern about one right now that I've been working with for about four months and sometimes it works sometimes it doesn't but the good thing is is is we were in a lot of different backgrounds to those meetings and we are able to to think very creatively sometimes especially when it comes to the financing piece and I and I think that we have three of the kosice board members who have been working with us so very diligently on that particular case and they're looking with that same creativity what can we do to make this thing work how can we make it work and how can we be creative to get it done because sometimes that's what it requires on some of these very good look for to meet with you thank you thank you John thank you is there anyone from the public they'd like to comment on anything mr. Dougan you spoke about if not Pamela now Pamela if you can handle this in 10 minutes or so we go ahead and do it now if you can't them call for a break and get you after so it's your call I think I can get through it pretty quickly okay I'm reporting today for the third and fourth quarter so our period from July through December I've given you all you actually have to package your third quarter in your fourth quarter which is all of the detail report the economic impact of all of the events that we've assisted with during the third and fourth quarter we assisted with 30 conventions meetings sporting events or more to motor coach tours with a projected attendance of fifty three thousand three hundred and fifteen beat ball room nights five thousand three hundred and twenty-four and I'm pleased to say that at the end of the year we have been at an average stay of three and a half days up last year from two and a half days so we've stayed there like to just highlight a couple of things for you first of all our
[0:51:36] occupancy report the most recent one I have received is as of the end of October our year-to-date occupancy is up 2.4% our average daily rate is up thirty point one percent going back to July one of the items I wanted to highlight was our West Texas Little League tournament we hosted that the first year that was huge for us thirty eight teams five hundred players plus their families we used all the hotels we could get in town and ASU for all of the referees the umpires and even three teams that we couldn't find hotel rooms for also the teachers of young children came in July there were 700 people in that group and I'm pleased to say they gave us a two-year commitment so they're going to be back again next year they loved us here Christmas at Fort Concho on Monday before we sent the third fourth quarter report over to you we had to go pull some numbers again I talked with Bob blue tart that was right after Christmas at Fort Concho we reduced our visitation down to 2,500 and did a projection on the out of town so what you have is after we reduced it I did talk to Bob yesterday afternoon and I think from his numbers were right on with the attendance I am going to need to adjust that out-of-town attendance just a little worried about 20% of that was from out of town cameras can I ask you some the numbers you just get how many of those booked rooms how many whether it's Little League or anybody come in how many of those numbers actually called in reserve booked on your detail report you have a column that says room nights and those would be that what we have that's provable rooms and as we have to always say provable because a lot of the hotels do not give us a report I send a report every Monday they don't all send it back
[0:53:41] but between the meeting planner and the reports we get from the hotels that is what we're able to prove so that's provable room we always know that we get a lot more for instance Fort Concho Christmas we did not get a very big room got from the hotels but again unless that person walked in and said I'm here to attend Fort Concho the hotel did not necessarily even know that so big festivals are the hardest to track so it's hard for their hotel people to share the information with you just won't and some really don't have the tracking mechanism to do so the next one I wanted to highlight was concha Christmas and here's a good example though of how we can prove in some cases the numbers that you have for concho Christmas right now are projections those are based on last year because it's not over yet but Lee pflueger's office gives me all of those surveys for everybody out of town that we take when they go through the lights and I calculate all of those and we say did you stay did you stay with people your friends your family did you stay in a hotel how many nights did you stay so in that case we have pretty good idea of what our room nights were because we have a really good survey so in that one we have a lot more provable numbers so those numbers will change a little bit once that has completed and I have to ask and you know with the the room rates being so high around here nowadays I wonder how they can afford those rooms you know just I hear outrageous numbers I mean 300 well one of the things actually had on my report today is we are spending a lot more time in our office helping people find rooms normally we deal with groups of twenty or more which is a group booking but we're spending a lot of time on people with three to twelve rooms that say I
[0:55:44] just can't find something to fit my budget can you help me and so we spend a lot of time doing that and maybe we don't get them in their first choice hotel but we'll find them something and sometimes you know some more people are camping lots of others things too the third quarter we were a featured community at the Texas Welcome Center in Langtry that means we had backlit photography additional brochures etc we brought in sky jaws Lev president the Texas lodging association to give a seminar on occupancy tax and legal usage and the next day we gave him a lily at our lily fest we had to site tours one was from the Texas Film Commission in September they were scouting for a film and the hardin-simmons marketing class they're putting together a marketing program for the Texas fort's trail and we're visiting the major communities along the trail we were on the organizing committee for both Lily fest and River fest and collar run color run was our first race with race Texas we had approximately 2300 people with the on-site registration and about 22% of them were from out of town this one is a perfect example of a piece of business that happens much quicker than they ever do this is somebody with race Texas we had met at nasc and even the same year they have booked an event so like John was saying it's usually something that takes two years but this one was a quick when the fourth quarter we had a site inspection for a new half marathon race at Lake Nazz worthy that looks like it's going to happen in the spring of 2014 trade shows an events that we attended in September as part of a co-op with team Texas we participated in consumer show AARP and also the Albuquerque Balloon Festival in October we attended the Texas Municipal League the team's
[0:57:48] sporting conference and along with the tradeshow part of teams we also had 40 appointments with planners of sports events Texas Country reporter festival because we are a top Texas town we were invited there were 54,000 people there and I think we got to talk to 50,000 of them it was just talking about San Angelo all day long very crowded we in November went to a new religious conference Management Association trade show called emerge and meeting planner International which was held in San Antonio we had two hotel groundbreakings one in August at the Baymont Inn and in November the Residence Inn we have just scheduled one for January 6th for the Courtyard by Marriott if all the hotels that we are currently working with go to and through permitting as anticipated there will be ten starting sometime in the first quarter counting everything that will be going our advertising included ride Texas Midwest living Triple A southern traveler convention South Sports Destination Management Texas highways Texas Monthly Texas Events Calendar Tour Texas and we now have a featured video on tour Texas the TMC and visitor guide travel hosts and billboards were up in Abilene Brady Midland Odessa Lubbock and Llano County Thanksgiving through the end of December advertising holiday Facebook Google search and also Texas Country reporter here on channel 12 can I answer any questions for any of you counsel any questions for Pamela a the the ten hotels that youment is it an additional ten no that ten counts what's already started and it also does include the renovation of the Pearl of the contract so it's a total of ten and we have heard rumors of one or two more but we we cannot confirm those
[0:59:53] other two is Pearl the concho did they did they get everything together are they working oh they're still working with the bank okay any other questions to Pamela if not thank you very much ma'am thank you anything from the public anyone from public want to comment on on the report if not let's call yes ma'am come forward state your name and you've got three to five min okay my name is Sally Anne and just with what was stated I wanted to ask the question if there were any full-service hotels in the plans for the future also that's all I wanted to ask Pamela the Courtyard by Marriott which I talked about is pretty much full service they will have food and they will have meeting space and they will have rooms there's also another one coming that is kind of a new concept it's one lobby that's two different hotels so a lobby and part of it'll be a Homewood Suites and the other party Hilton Garden and they're going to have meeting space and they say full food service however that one has not yet gone to permit thank you anything else need to be said on this then I'm going to call for a about 10 15 minute break in a wait everybody cycle the dice now let's go ahead and read and reconvene our meeting it is 10 27 and we are now to number 10 on our public hearing which is discussion and possible acceptance of downtown master development strategies document prepared by catalyst urban development as part of PL o 1:1 to AJ your own man thank you
[1:01:59] American morning mayor councilmembers this morning we are as the mayor read looking for possible acceptance of a document we have Paris Rutherford in attendance with us from catalyst urban development I'll ask him to come forward here in just a moment he's going to run through the document with you which was part of your background packet I know it's a rather lengthy document but we're going to just try to hit the main points for you and of course are open to hearing your suggestions and questions that you might have on the document this document was prepared as part of phase one of the master developer contract we're ready to kind of wrap up that first phase and this is sort of the last remaining item to check off before we can do that this document was sort of the deliverable for this first phase which gives us the baseline if you will for moving forward with development in a strategic way of the Downtown Development District you all have aboard the Downtown Development Commission who is essentially in charge of this effort as an extension of the council and so we did meet with him at their meeting yesterday afternoon and went through the same presentation with that board they were rather very receptive to the document and they did provide us with a recommendation to pass on to you all they did unanimously recommend to approve the acceptance of this document and so the desired outcome today is that we reached some decision on the acceptance with any possible modifications or changes that you feel are necessary so with that I'm going to ask mr. Rutherford to come forward and launch into a short presentation covering the basis of the document welcome sir I will I will add that I am committed to having us out of here by noon I am so take that for what it's worth I am too I am too as appreciated Paris rather for principle catalyst urban development as AJ mentioned before we're at the
[1:04:03] completion of that effort to basically put a table of contents together if you will or a guiding principle together for how we think you all and the community can best achieve private reinvestment in a strategic manner in downtown that gets additional momentum going around it and that's not to usurp or replace traditional market forces that would happen it's to improve on that so I'm not actually going to run through that whole document you've seen that presentation before what I'd like to do is hit some high pone yeah two times I'd like to hit some high points there and then give you some updates as to what to expect moving forward and the timeline related to that you know there were a series of tests that we went through we've completed those tasks but essentially that was to prepare as I mentioned before the strategy that your economic development partners and other individuals can use in moving things forward so we have done that and that's a document that you have before you the milestones that have completed is we the the analytical part of that work was done basically at the end of the summer we had a discussion with you at that time went through that with you we deliver that document and and and since then we've been doing some private underwriting on some potential opportunities that are in there we can talk more about that later if you choose so and then we've worked through staff comments and revisions and you have the document here before you as you recall there were some additional steps moving forward that were that you did not authorize as a body but we think some of the strategic efforts in there will require some additional work not necessarily by us but certain but could be by us but probably by the framework that you already have in place the sooner it gets into that framework we think the better actually so that you all own the strategies in your work in it but there were three other phases of effort and that really gets into going deep on particular projects which I'll
[1:06:07] talk to briefly you'll recall and that summary recommendations you will call that we identified the drivers of economy as the energy sector education health care and good fellow and we arrived at targeted programming over the next 10 years which allowed for six restaurants this is specifically in downtown they would be targeted around areas of void that exists today in terms of concept and food type and experience that's being offered we saw a demand specifically for downtown for around 600 housing units to bring a nighttime population into downtown and about 400,000 square feet of various scales of employment uses from small business up to light industrial we think all that is very doable by following the right path you'll recall we had a bunch of analyses that looked at the footprint of downtown looked at infrastructure ownership land assembly other real estate issues that affect development and investment and arrived at a series of opportunity sites therein so the three opportunities that we landed on after looking at the market in the land uses was not necessarily a potpourri of all the available land uses we think it happened over lot over the next 10 years but it was to look specifically at those efforts that would get momentum happening additional momentum in downtown so the first of that was a restaurant infill primarily on the couple blocks around Chadbourne from generally from Harris down to the river in that zone again those six restaurants over the next 10 years are focused in there there are specific efforts moving forward which to identify supply in terms of existing properties whether for sale or for lease that could be leveraged and where these new restaurants could locate there needs to be an inventory of that that's done so that somebody working that has something that they can take out to market so from an implementation time table standpoint
[1:08:12] we think over the next six months to a year that's the time that you put the void analysis together for the restaurants themselves to determine the type of use and inventory the supply both lease and for sale with the owners that are out there understand what's on the market what you have to work with and then go out and identify regional successes here locally as well as an Abilene and other cities in the region look at concepts that aren't in st. Angelo or look at second store opportunities and then put a marketing package together and then start hitting the phones and work through your normal economic development effort and Chamber related efforts so forth and so on two to four years is construction period and of course you do the same thing over the next five to ten years to arrive at those six restaurants residential infill we were looking at the area around the river as well as lower density areas around the museum and the and the fort and it probably would begin with the medium density development around the river again the goal for that is to generate nighttime activity within downtown that isn't just restaurant based so you have people living there there's activity out on the streets people see that that generally drives more restaurants for then generally drives office that's our experience in them that is something that we have interest in actually as master developer going to vertical we've talked to you about that before we have done private underwriting we've we're at a point now where we're willing to commit our own capital to move forward into more detail on that and we can talk further about if you if you so choose from an implementation standpoint we would like to get into further discussion with you here over the next few months there's a construction period obviously that happens from two to four years of initial phase and then long term would be the second phase that in fills in that project that you all have seen before in terms of workplace in
[1:10:18] employment we saw various areas in downtown on the north east and west side of the downtown area where there were zones that had that were underutilized potentially where there are some areas of larger footprint of land where some of the uses that I heard the chamber talking about could be funneled in and channeled in to to come into downtown that area is in need of new construction realistically it's a visual thing as well as just getting additional density of employment in there you know we like looking at a basic anchoring diagram we have employment housing restaurants in between it's a lot of throughput a lot of things happening in there similar to the restaurant effort over the next six to six months to a year that is really targeting specific businesses that's looking at small business assistance and the footprint of downtown itself we've got some recommendations in the port to that regard and you've got development economic development partners obviously that are in place that can make that happen two to four year time frame would be construction period looking at the infrastructure that might support those facilities in long term is doing the same thing that is the high level snapshot of where we are and I'd be happy to take comments and in discussion but I think what's before you is the document the end result of that effort and what's before you is an acceptance of that essentially those concepts this isn't changing your comprehensive plan it's it's basically providing a roadmap that your partners can utilize in advancing forward so you get the market involved in this and move forward so this is actually the end of phase one that's correct sir okay and anything else that we do would be would have to be submitted and we would have to approve that's correct this is phase one that we have already proved we've already paid for so we are completion you are correct sir Rodney Counsel Johnny anyone could speak to this you have any questions I think this is this kind of goes back to the master plan that we had for like
[1:12:19] Nazareth where we have in order for us to move forward as a city we have to set forth a plan and work towards that plan so I'm I'm in favor of this and I actually I'd like to move on to the next phases on this thing I don't want to spend the amount of money that we spent out at the lake but I think this is reasonable in these doing these phases so I'm definitely in favor of doing this we need to get a have a plan moving forward what we're going to do and I think this would be a positive thing for the downtown area Johnny and I'm rowdy but you know like any me business has to have a business plan but Paris that last statement you made on the infrastructure that might support the idea elaborate on the what it is you're coming across you know as the infrastructure who well I also it reminds me of a question you had earlier with the chamber as well there's two types of infrastructure as I see it one is just physical infrastructure if you've got office facilities or housing or retail whatever it may be do you have the infrastructure utilities in the ground that could support the density that's being proposed whether that's true in the downtown area to the north for some more intense employment uses that needs to be looked at and I'm assuming just driving around there's certainly some Street reconstruction and things like that that would be required that would be infrastructure and whether those private companies would be able to do that as part of their site cost would need to be negotiated realistically the other side of it is getting employment more employment in downtown so it's seen regionally as a place to conduct business to continue to conduct measures to move your facilities I heard about the expansion and relocation opportunities that your chambers identify what in thinking about downtown the question becomes we've identified those that potential but how do we direct them in to downtown and that becomes kind of a social infrastructure restaurants things to do lunchtime activities meeting facilities like this we've talked before
[1:14:24] and some of the ideas in the in the plan were to look at small businesses in San Angelo and identified downtown as a place a special place for small businesses to occur and thrive so you might have a collected insurance program or you can buy through group rates some better pricing on insurance things like that it's in a sense it's a an urban design analogy to an executive suites where if folks come in and congregate they have more services that they have available to them it makes it easier and reduces their operating expenses if they come into downtown the benefit to the community is obvious you've got more people in an area that drives more restaurants you've got the potential for housing and other things to all come together and ultimately as I've said ng all before the more st. Angelo's downtown can be recognized regionally as a very active in entertaining engaging place which I think it is today can only get better the more Economic Development you're going to drive in the entire city I firmly believe that you see that all over the country and certainly has been our experience so you know to and I was talking to AJ yesterday and and I'd really do appreciate the job that you've done on this report because like I asked her could somebody on staff had been able to do this and the answer is yes and then but it would have taken them dropping everything that we're doing and they might have taken a number of years to get this done so I appreciate what you've done I've seen firsthand even my family in Plano I've seen that legacy North Area up there I've seen the 15th Street that that's come up so I think it's a it's a wonderful thing that you know if it all comes to fruition maybe we see it one of these days but I'm certainly on board with the idea you know sure we're at phase 1 and where it goes from there you know only all of us will will be able to tell but again I appreciate everything you've done very good information Thank You Marty I just like to say I think it's I think Paige was great and I'm I'm in favor of moving forward to

Wardlow no particular comment I'm ready to vote very well all right somebody want somebody want to move that we accept this as presented I move that we accept this as presented I'll take your second I'll second that yeah okay we do have a motion to accept the phase one that we've already paid for we're not authorizing any more expenditures but this is accepting the design as it has been presented it has been seconded any further comment from counsel do I have anything from the public anyone from the public wish to to weigh in on this pro-war con mr. mayor yes sir I just have to say that you've been looking at this photo here I know that you know we've got the contour River right flowing right through the middle of our you know that that is our blood line right there I think that's our attraction that a lot of other cities out and West Texas don't have and I think it's about time that we took advantage you know you've seen the little bit we've been able to do on our own as far as ideas but the bank stabilization and the River Trails and you know soon to be maybe a miniature state-of-the-art golf course in all but it takes these guys that have done it in time and time again to bring ideas to the table and so I you know again looking at that that's that's a dream come true if we could ever get there so just wanted to throw that in okay Marin it does go to the quality of life of courses Paris is alluding to a while ago quality of life definitely does assist with economic development anybody could tell you that and this is definitely what we're seeing here so again I know staff is very you know supportive of this well I also feel that we would be going backwards if we didn't approve something we've already bought and paid for so we
[1:18:30] do have a motion we do have a second I will call for the vote on this all in favor say aye any opposed signify by saying nay put a 600 on that one please ma'am thank you sir all right I guess we are now moving on to number 11 which is discussion and possible action regarding strategies for obtaining compliance with zoning ordinance for existing parks around San Angelo containing recreational vehicles manufactured housing and mobile homes miss father thank you well as we all know the subject of RVs and manufactured in front of us for several months now we've had a lot of different discussions about it and we currently have the the moratorium that was enacted on it so as staff is moving forward and looking at number one trying to bring you something back to address your concerns which led to that moratorium we're also looking at the existing parks that we have around the city and so what we're bringing to you today is more of an FYI we want you to understand the issues that we're dealing with we have had several conversations amongst staff we've met with our City Attorney's office we've met with our city manager's office we've talked about this with the different Housing Committee representatives and as we move forward with trying to come up with a solution for future placement we also would be remiss if we didn't look at how we work enforcement and manage the existing parks that we have around the city so this is just kind of a brief summary of what was in your background report and we'll certainly be happy to entertain any questions that you might have I'll try to move through this rather quickly staff of course and looking at the sort of new direction to really focus on this issue obviously enforcement's one of the things that many people have brought up how are we enforcing existing park standards to make sure that they're held to a standard which is consistent with our community standards so our current regulations outlined in the zoning
[1:20:32] ordinance do you provide us with some guidance what's important to understand that that guidance and the zoning ordinance doesn't necessarily at this time apply to all of the existing parks in the city and we'll explain why the current regulations of course allow RVs with in very limited areas one of those areas is the use category can't ground RV parks we've had a lot of discussion about that so I won't belabor the point but that is one area in which those are allowed we also have a specific zoning district for manufactured housing it's called our MHP manufactured housing park zoning district little known fact about that particular district is it does allow some RVs with limitations in the zoning ordinance and outlines that up to 30% of the total units in that park regardless of number are allowed to be RVs but no more than that 30% theoretically I'm sure the approach and riding that ordinance was to ensure that it became and maintained that was maintained as primarily a manufactured housing park not primarily an RV park we've also talked about some planned development districts we have a couple of those on the book again planned development district 2 zoning is when an ordinance is crafted specifically for a certain site and so we do have a couple of those in the city that do allow some placement of RVs what's important to understand is the regulations of the past even though those regulations have been replaced over time there are some legalities involved in applying those we do have on the books at what are called special permits that's not a mechanism that the city currently has in place but in the past there was a special permit process through which an applicant could come to the City Commission or Planning Commission and then the City Council and ask for permission for a specific type of use there are several of these on the books that allow primarily labels that read mobile home park and we've had to really dig into the details on trying to
[1:22:34] work enforcement of those special permits and so after visiting extensively with our City Attorney's Office we've learned that essentially it is what it is if the special permit was written as a mobile home park then mobile homes are what is allowed RVs do not fall under Briella and so since many of these special permits have existed for decades it has created some problems for enforcement these special permits also do not expire there's something that the City Council always has the authority to remove because you are given the express authority to grant it in the first place however outside of that process these special permits do remain and they do carry with the land so as property changes hands the ability to still place RVs or mobile homes however it's designated in the special permit carries with it another thing that is interesting and sometimes difficult about enforcing special permits as they were conditional meaning that the either the Commission or the council could add conditions and every special permit is unique in its own way so as we're looking at enforcement right now we're having to look at and ascertain how the park was established what rules were in place when it was established and enforced those rules no two parks seem to have the same type of authority in this case so the results of the meshing of these past regulations that we have these past approvals combined with the current regulations we have is a lot of inconsistencies we've gotten consistencies in the requirements for each Park which is not isolated as a staff difficulty and enforcement although it is it also creates problems for the owners of the parks and cells as they look at other parks around the city and see discrepancies and what's allowed and what's not it makes it very difficult there's of course inconsistencies in the terminology today we have recreational vehicles and we have a defined limit for those things we have mobile homes which were put
[1:24:38] together and issued as structures for living until 1976 and then we have the manufactured home in place the terms are very difficult and are very important at the same time and enforcement and in some cases we have been unable to find information as to how a park was put in place it's a problem we've inherited and we of course need to be sensitive to the people that are both living in the park and then own the park but having a consistent set of rules which all existing parks would have to follow and standards that they would have to meet of course is the easier approach it's food for thought for you you have written into the caption the ability to give us Direction today if you're not comfortable with that and would like more information we can get that for you as well I'm going to skip through the characteristics of the MHP zoning district those were in your background packet I can answer questions if you have those but to give you an idea of what we're dealing with here we've got a total of 14 parts within the city limits two of those have the current MHP zoning meaning the standards that are in place today and our zoning ordinance are enforced in those two parks so that's pretty straightforward we do have two planned development districts as I mentioned earlier that's a customized ordinance so they also have standards covered under the current zoning ordinance then it gets a little dicey you've got one park that actually existed prior to the implementation of a zoning district for the city they fall under what is called a legal nonconformity they are allowed to continue operations but we cannot pass an ordinance today and make the middle of the standards there are legal rights that come with that existing prior to the ordinance we've got two that were in existence prior to their being annexed into the city so they also fall in that category we have four that were authorized by special permit and each special permit is worded just a little differently just enough to make it a little confusing and then we have three
[1:26:41] parks which we've been unable to find any authorizing document or ordinance allowing them to be placed it is somewhat difficult to establish when a park started we have some strategies that we use they're not bulletproof however short of us having somebody on staff that's been here that long it makes it a little difficult to do so we've got a total again of 14 parks roughly 10 of those parks are the ones that are really a little more difficult to enforce the regulations for from a staff perspective and as I mentioned as an owner or a resident of those parks also confusing so from the realization of this issue the next question of course is what do we do about it what can our council do about this and sitting down and looking through the current ordinances on the books realizing that amendments may be made in the future is we emerge from a moratorium into a newly newly minted regulation we do have one mechanism on the books I mentioned it earlier the manufactured housing park zoning and the zoning ordinance in Section 212 does give to City Council or the Planning Commission the ability to initiate an amendment to zoning meaning essentially initiate an application for rezoning of a property the resolution to do so is the sort of authorizing document that gives staff the ability to move forward and the ordinance does outline that the minutes for that body must outline that the decision was reached and what the directive was to note just in case there's a question although the City Council can initiate a rezoning of property of course the requirements and state law for notification and legal notices those are all still in existence and we must follow those so in terms of options we like to bring you options when we can sometimes we have more than you'd like to hear and sometimes we don't have as many as you like but in this case it really seems that the only
[1:28:43] options are twofold one leaving the existing parks as they are with the realization that there are sort of different regulations for each part and then enforcement may be a little trickier than we would like it's not just the simple right of citation work through the process it may involve some more nuanced processes moving forward or you always have the option to initiate that rezoning if you are comfortable with doing so for existing parks to the MHP manufactured housing park zoning there are some difficulties in doing so this isn't a black-and-white solution unfortunately some of the parts that are in existence don't meet all of the requirements for MHP zoning we do have mechanisms in place within our city organization to deal with those things it just makes it a little more difficult three of those parks have less than the required acreage for an MHP zoning three acres is the minimum we have five of those parks that appear to have exceeded the 30% what we call the 30% rule again that 30% of all of the units are RVs we have a few that have gone over that and then we have three that are over the maximum density the fixes to those complications are twofold some of those are by definition going to be covered by a legal non-conforming protection and others we do have a variance process in place it's really all we have for you today we just wanted to make you aware of some of the issues we know enforcement is a important aspect of what we do although you are largely a body that helps us write and create and put into place the rules if we don't enforce those rules we have other problems and so with that I see mr. Dane moving to his microphone so let him step in way out there yes sir
[1:30:46] Ajay don't some of those parks have issues which would be considered public safety type issues also improved surfaces for fire trucks that I don't know for certain we we suspect that there may be an issue on that but I have yet to get information on that mr. Wardlow let's start with you sir thank you sir I would be agreeable to taking up this issue and examining it but only in connection with the work we're going to be doing on RV parks and that the Housing Committee is working on at this time I think it would be timely to do both those at the same time and it would be less likely to overlook anything we need to address and also we would be looking at the big picture on this and try to make get as much conformity as we can among the new and the old and and also try not to be unfair to anybody that's already got one there but try to bring everything up to code currently as we can and and see what we can do up to up to the rights they have under their non-conforming uses so I'll be willing to look at this further thank you done one one of these is in my district and Michael and I've been working for six months on it my thought is I don't want to put a business out of business by the same token I understand that it's being 30 years in enforcement how hard it is to do that sometime but my thought is these people went in under an agreement so to speak with the city and I don't want to change horses in the middle of the stream to where we wind up putting somebody out of business or our costing
[1:32:49] them a tremendous amount of money just to stay in business I think there has to be a happy medium almost a break-even point here with the ordinance that we have have no problem going in with the new ordinance and and saying okay if you want to go in here and have this type of business yours here's what you have to do but these existing ones I just have a real problem with going in and and making them be brought up to new standards I think whatever was agreeable at the time that those were set up should still be agreeable for us as long as it doesn't involve a severe hazard for Public Safety I if we can't get a fire truck through the back to to fight a fire in one of these areas that's something I think we need to be be addressing but as far as as numbers and and a you know a manufactured home versus a recreational vehicle and some of those things I think we need to let those things stand as he is per their requirements and agreements at the time that those things were put in thank you sir mr. dillis AJ I guess the only comments I have is go back to a couple more slides where you had the breakdown right there all those numbers they told the 14 that you're talking about now our Bart packet says 18 so it's at 18 there's at 14 I'm sorry it's actually 17 total three of which are outside the city limits and it did say 18 apologize for that so so we shouldn't even be wearing the one about the ones that are outside the city limit right should we're not bringing that to you now we wanted to know and really this conversation is one part of the conversation is to let you know it's not that we're not enforcing the regulations but we wanted you to know that there are practical difficulties in doing so so
[1:34:52] that you're not seeing inaction and thinking that means that we're ignoring the issue and I'm in total agreement with what a Winky said and what Don said as far as letting the groups that we've got there in place the housing and all kind of you know just run with it and in in other words not rush into this you know right and then what Don says about us maybe those folks that are you know I don't know grandfathered or whatever you want to how're you want to label them maybe not you know put a kink in their way of doing business and the last thing that tell me getting with a number three where the question marks who are those are three parks for which we cannot find any zoning action or approval for those parks but they do exist and we are unable to pinpoint precisely when they were established which ones are those I'd have to I'm sorry I'd have to go back and look at carry mine I can get it later that's all I had but I will say that they tend to be centralized in the city and within the original city limits which encompasses most of the downtown area and sort of the just south of what we would call the Lakeview area maybe shoot me an email later with those names I can certainly do that sure you Marty share wisdom with us well I guess I got a question well what happens if someone sets one sets a mobile home or a manufactured home outside one of the parks right now in a non attract that's not encompassed by art well that's not an easy answer as theoretically to obtain all of their permitting we would catch it through the permitting process however if you chose to not come to the city and obtain your permits properly we would have to catch that and work that through the enforcement process you'd be surprised sometimes that some of the things that that we see and we we wonder why that would ever happen but theoretically the process would catch
[1:36:55] the lion's share of those because people will need water facilities and they will need electricity and so we do have a clearance process for those in which the zoning is checked on each tract before the clearance is authorized so eventually possibly we catch and then if they've got everything already set up without going through the permitting process and it's a problem it's a problem there is an enforcement approach and I think mr. Vardhan said it well when he said you know trying to enforce 30 30 years worth of action that that is where it becomes difficult if we have a special permit on a lot that specifically says mobile homes and they've actually put a couple of our fees out you know it's it's clear that there's a violation there but because they're already in existence the execution of that violation becomes far more complicated because then you're dealing with people that are in their home and you know it really complicates the situation okay well I definitely think we need to move forward and in getting using the avenues we have to get everybody kind of under the same umbrella so I you know I'm an agreement of a pool mr. Flemming can you go back to the options option one and option two sure I'm I'm definitely in favor of option one one of the things I wanted to ask to you is if I think you had mentioned this if the property sells can we put it in the ordinance where they would have to bring it up to the standards at that time no as far as being protected as a legal non-conforming use there are thresholds which if you do not trigger those thresholds you can continue using them in perpetuity so that's where it gets complicated for example if we took one of these particular RV parks which is currently authorized by a special permit
[1:38:59] and we decided as a counter you decided as a council at some point that you wanted to rezone that Park the rezoning to that park would carry the current requirements of the ordinance with it but any activity or any placement of mobile homes which is at odds with those rules if it was there the day the change went into place could continue so to try to simplify how that sounded let's say that we allowed 8 units per acre under the special permit and then later we change the ordinance and we say no you only get four units per acre they don't have to go out and call out certain homes and have those leave the park as long as they don't add to that they're allowed to let those remain in place so it does start to get a little complicated at some point and I'm looking for that slide I apologize here we go well the may see the main thing that I I think we do need to move forward I don't like not option number two I think we do need to move forward on some rules and getting everything in place and try our best at getting it it's never going to be a level playing field and everything Sharon because so many of these I can't believe that there's three parts that we don't even know how they came into being it's it's tough that's crazy well then to to go down your line of thought there if we did just so you know what it would look like let's say that we did go with option one and we did start an initiation of the rezoning of all of those parks certain things would happen for example someone that has a special permit like in the case you mentioned mr. vardaman that has a special permit for a mobile home park doesn't mention RVs that they have some RVs already there under the new rules they would be allowed up to the 30% so they would actually have a little more leeway that they would inherent anything that became stricter we would look at a legal non-conforming use and they'd have some protections from that if by some stretch of the imagination you were able to get
[1:41:02] that rezoning then today and the Housing Committee comes back to you and says here's the rules that we think should now govern MHP zoning those rules once put into place would then again apply to those parks well we're gonna we're gonna vote on those final rules aren't we as a body absolutely absolutely and we've realized that it may be a little bit longer down the road and so we wanted to give you some option if you wanted to act today this is essentially what we were able to come up with for you I don't think we can act today but I think we can give the guidance like you were asking for at the beginning and I think we're all kind of in agreement are we how much you mayor we need these parks and I think that's one thing that I need to make that that is we've got to have these parks Buzzy's provide some necessary housings for people that couldn't go anywhere else Donn's absolutely right on the public safety and that's that's the very first thing we need to consider okay but we've got to have these parks as long as they meet public safety I don't have a problem with them I also can't I'm considering maybe this 30% RV maybe a little low maybe we need to go to 50 percent on this because this this is a reality these RVs are coming in here these people have to have a place to live and we also need the revenue and if we turned it out into the county then the city is losing the revenue and we're still gonna have the same we still have to deal with them so maybe we need to tweak it a little bit to allow some of these things in as long as we can still enforce it also and I'm I'm bringing this I'm just throwing this out Daniel and I have been in meetings with some people and we think we're looking at this more in a regional view now in big in Big Lake and Barnhart and Murchison in these areas were the activity they need these man camps there they're there but San Angelo could be hub become the hub maybe for some family camps and I think that our industrial park out east of town is the absolute perfect place to put these
[1:43:05] family camps maybe with some type of a public-private partnership have them come in and develop this the infrastructure is there put the houses in and when the bus does come which it will then they're responsible to get them out and leave what's there but I don't know that that's that's kind of the the direction I'm going if San Angelo could be come the hub for family camps and let these other communities have the man camps and then maybe up to percentages on the on the bubble home parks that's okay it's just my thoughts on that Don I've let me piggyback on that I think you're exactly right on the 50% the way that I look at that also is existing is totally a totally different animal than you with the existing you know the people the neighbors everything around there they knew what they were getting when they got it and so I I think that 50 percent would be very feasible and and something that would work well well I've got two of Mount my area that's been there longer than I have it we don't have any problems with anybody else care to comment on anything so I'm sorry place the same air we are moving for of course with as far as the housing committee's and this could be an item of course it could be addressed this what were the direction that you've given at this point and to come back with a recommendation from the housing a kit committee you know to address what they felt would be priorities and I think we already have years at this point moving forward but we could do with that matter well I know our moratorium is what another 60 days we also be able to have a law on the books by the time this moratorium expires does everybody think do you think it's gonna really depend on all the people that are involved in the conversation I can't predict what I think we ought to have a goal of having an ordinance on the books by the time the moratorium expires and if we need to extend it a little bit we can but I'm
[1:45:08] getting calls and I'm getting emails probably from these camps that you're talking about and they've got questions sure in fact I spoke to Daniel about it and we're probably gonna have some some meetings set up just to address their problems but I'd like to get some I'd like to get some clarification on them let's get these people in answer hey just for the benefit of the viewing audience can you elaborate more on the 30% limitation or even the proposed 50% just just so don't know just be clear on it it's basically that you would take the total number of units in the park at any given time and of that total number 30% of that could be RV park I'm sorry RVs the others the other 70% of course would have to be a combination of mobile homes and manufactured homes so the RVs would be the minority within the park essentially any other council discussion on this just want to guess thanks mr. mayor I'm glad you're getting to where you're knowledgeable on the little business that's been my complaint all along the man camps need to be where the oil drilling is and that's what you just stays the man camps need to be out there and Barnhardt big like Ozona and points west Pecos the oil business is moving that way and so the man camps need to be out there it defeats the purpose of a man camp to have it 70 miles or 100 miles from where you're working every day and so you're right I agree with you 100% on that and I like your idea of an increase in the number of percentage of RVs that could could exist in the current parks and that that's why we need to have a new new ordinance that that the Housing Committee recommends and that we we finalize and get this thing right I agree well it's time if there's no further public if there's no further

[1:49:19] years and I've also worked for one of the largest mobile home manufacturing companies really in the United States and wherever they had new home installation or a service call wherever it was I would go you know I can rebuild a mobile home from the frame I live in a home that was well it was an insurance right off they had a fire unit I bought it i remodeled it from the inside and I would invite anybody here to come to my house anytime and I would fight anybody here to come to my come to my area that I live in and into you know and I believe that there should be regulations because I've gone to different you call mobile home parks I call them communities some are communities some are parks depending on how you know how their upkeep periods you need some kind of regulations because for the health and safety of the people of the citizens because if you don't have I've been in some that I wouldn't even work in and there's no regulations to to govern how these people are keeping these areas you know and you need some kind of regulations that's not like I said I live in one of the better ones and I've seen them from Junction to wherever that wherever this new homes were were delivered from San Angelo I've been there and I helped set him up I've helped trim them out and I've been in a lot of these areas and some of you need regulations
[1:51:22] because that's how the mobile home industry get the black eye you know trailer park trash I don't consider myself a trailer park trash I have a very nice place it's in there in ice place my area that I live in is very nice and it's kept up very well but some of them I wouldn't even sometimes when I go out was sent out to look at a circuit I would not even go in the house I wouldn't work in them because from the gate to wherever you could see all types of litter you could see all types people were just it's terrible it could be terrible and you could smell the homes before you get to not those things need to be regulated now where I live is self regulated the the company that had it before took care of it and it's very well manicured it very well land and it's maintained and like I said our challenge any of you to come by and look at my house I'm rather proud of it I live there 20 years you know and I wouldn't even consider moving nowhere else unless you're gonna put me out there on the hill then in southwest you know something that I can't afford I can afford where I live and I can afford to improve on where I live somewhere else might be out of my range but do you have to be able to adjust to a person's income if their income puts them in that situation they don't have to be trailer park trash I'm not you know and I challenge interview to challenge me on that so regulations you do need and even more stricter regulations on up
[1:53:27] keep and care of these things because the mobile home industry I called mobile home industry not trailer house industry there's a difference and mom one minute you're by the one that's better but I've said enough and I think some of you might know these areas around here go check them out thank you please do put some kind of strict regulations on the upkeep and care and the public safety thank you Ajay's back there riding as you speak anyone else care to address this that sounded like a dinner invitation to us all well I'm waiting I'm waiting for the barbecue yeah you give AJ your address okay do we have any further comment on the NC the council our public I feel we've pretty well covered this one AJ do you have what you need alright bring you something back and I would say the quicker the better so we can put this get some ordinances and laws in effect so the weekend take care of this all right let's move on now and you're still up AJ number 12 discussion and consideration of petition seeking annexation to San Angelo city limits of certain property situated directly north south east and west of San Angelo in compassing a vacant four acre tract extending south west from Southland Boulevard located directly east of an eight point nine nine five acre tract and next to the city limits on March 5 2013 that comprised prestonwood addition section two and Johnny you're gonna have to take over a minute because I'm gonna go powder my nose be right back all I'm actually going to skip right to the end of the presentation and to kind of get us back on track you might remember in March of this year some of you were on the council that time and some of you were not but there was an annexation approved at that time on the slide that I have here that property is to the immediate west of the side it's part of the prestonwood
[1:55:28] addition you see a lot of new home and street construction activity out there now to the north this tract and the community of faith addition was previously a next several years ago and the properties too the East again you have the elementary school into the South you have another section of the prestonwood addition all of these areas on all four boundaries with this property tract are within the city limits however the subject property that's cross-hatched is not within the city limits when the prestonwood annexation to the West was done the council at that time asked staff to contact this property owner and see if they would have an interest in being annexed so as not to create a hole if you will in the existing city limits that property has since changed hands and the current property owner has brought to us a petition for annexation which would remedy that issue I don't know that there's anything very controversial about it but we can talk about it if you'd like again it's in far southwest San Angelo we have worked up what the proposed table table would be based on the public hearing requirements outlined in state law we would have the two required public hearings one in January one in February and then we would be bringing you an ordinance for first introduction first reading in February and the second and final reading in March which would make that annexation official essentially all we're asking you to do is to accept or deny the petition you're not taking any action that would actually annex the property today you're just giving the staff either the authorization to proceed with the investigation and bring you recommendations at future meetings on this tract or to deny the petition and stop the action at this point so that's essentially the the gist of the issue but I can answer any questions you might have any questions mr. Rodney I'd like to move that we accept the petitioners written second are there any downside to possible annexation or any extraordinary expenses

[2:16:12] and I think we need to do everything we can to keep the downtown area going I think we're on the right track but we need to not stop when you keep moving forward Marty do you have feelings only sir I'm very much in support of it and and I I think we can work the ground lease out and and we can see some very nice and provements down there and I suppose that you move to approve Johnny that you are in favor of this very much I mean it is in my district but you know it's really the hardest thing Angelo and what they're bringing the table is just long long overdue and then in conjunction with what we're doing along the river the upgrades the bank stabilization the miniature golf we want to bring the bocce ball and all that game area and we want to I think it'll all tie in together with a new restaurant coming up down the road in foot traffic it's it's the name of the game right now I think we that's what it's going to trigger and for all the downtown area to benefit so Donna I know you have a few doubts you won't address them well I you know I hate to look a gift horse in the mouth but what's the downsize side to this what's the negative we don't we don't do anything else we we disapprove the second portion of this what's the downside the only downside there be no economic downside the only downside would be that you have someone taking a hard run from a market perspective in your community and it's and it's a negative we come up negative that's the only downside but in terms of what you all have talked about thus far in terms of spending money right now there's not a downside okay as far as local businesses banking entities builders whatever will there be
[2:18:17] any inclusion for them absolutely yeah across the board I mean from a financing standpoint we generally work with partners that we have that are regional and national that said if there are some local banks that have interest you know our doors are open it comes down to terms and things in terms of the trades and in the construction industry we're hoping to draw from local trades down here you know we've we've heard that there's about a 12 it's actually 12 to 15% ad and doing construction in San Angelo versus what we're used to for instance in Dallas we've kind of ferreted through that because of the oil fields and folks that are out working out there there's just a little bit of a labor gap that's in there so you know all that needs to be ferreted through but if there's opportunity folks want to come in and their subs will be working with a GC that we you know do a lot of work with probably out of how to Dallas and of course there will be for canvassing the market here for for sub trades I have no problem with us looking into it I just want to make sure that that everything's aboveboard and our local people get every opportunity that we can possibly give them to to keep that money right here in San Angelo I'm with you on that sir mr. Warlow do you have any thoughts on this sir yeah just a couple of I'm a free-market capitalist and I believe in people investing in risking their hard-earned capital and I don't have any problem with this project I do have some concerns about the viability of it and I've told them it's just based on the status of the oil and gas industry right now my family's been in the oil business since nineteen twenties and I have a lot of current information and I'm just afraid that that the boom is sort of leveled off and it's not gonna increase any and so that's going to increase the risk of this project but if they're risking their money and not the city's
[2:20:19] money that's alright with me understand that all right I think we've talked to say one more thing I think there might be a little bit of confusion about Paris's dealings with us of where we had a study that he did and put forth a marketing plan that had phase one and phase two and we paid for phase one where we may go in phase two we may not we haven't decided yet but this is a total he's taking his hat off and this is dealing where that has nothing to do with the plane would kind of has something to do with the planning because it's what he was planning on but he's bringing a group together that wants to do this so I don't want it to be confused that this was part of the phase one that he was gonna be that phase one and it was that was two different things he now he's bringing a group together it's gonna possibly build and this doesn't have to do with the study you put together and what could be you know I'm saying I think this has been kind of confusing when you were asking about phase two down there or whether we're gonna pay for it well this is not phase two it's really it's phase one of a different thing on the other side yeah and our view the only phase two if you all elected to go down that route with us or with one of your economic development partners frankly would be in the non-residential side of things to be in the restaurant or the employment that's where additional work needs to be done we'd be doing that on this residential karate yeah it's almost better for us to let you do that for us for free I mean you'll you'll end up doing it I mean that's my opinion on that but I think you guys would do and we know that you do a good job so well we're at a point now where when you release the RFP for master development now we're at the point where we can do that right but up to this point we didn't have a sense of what that could be right well my questions have been answered and I had some I had some negative feelings as dawn but you've answered them this is for 180 days and this is an exclusive we're holding this prop this is this property is yours to do with for 180 days until you make up your mind okay everybody understands that everybody I'm standing not gonna cost us anything
