[0:02:02] rosani Marie kensaw Jesse White Esther wed and Triston Smith and if y'all will join us while they lead us in the pledge to the flag of the United States of America and to the Republic for it stands one nation under God indivisible with liberty and justice for all the Texas flag I pledge aliance to the Texas state under God one and indivisible thank youall so very much excellent God and I'll say one more time I don't know who it was that came up with the idea to have children come in and lead us with the pledge but it was an excellent idea and I'm so very proud of our children uh we have a proclamation is there anyone here from Mosaic Amy there you are good morning Amy Flynn how are you I'm good fine thank you we have a proclamation here to read about Mosaic uh the month of March 215 has been designated as National intellectual and developmental disabilities Awareness Month in order to celebrate and recognize people with disabilities disability is a natural part of the human experience and in no way diminishes the ride of people with disabilities to make choices contribute to society and experience and full the many blessings of American society family members friends and the community at large all play a role in supporting people with disabilities as they pursue their dreams the goal of this city property include helping people with disabilities realize full access to housing employment and the recreation activities which they create productive and satisfying lives and to live as independently as possible therefore I Dwayne Morrison the mayor of the city of s Angelo on behalf of the city council do hereby proclaim the month of March 215 as intellectual and developmental

[0:04:06] disabilities Awareness Month in St Angelo Texas and call upon the citizens of the city of St Angelo to observe the month with appropriate programs and activities furthermore I encourage the citizens of San Angelo to seek information from those organizations with the expertise in matters concerning professionals who support individuals intellectual and developmental disabilities and Amy I'm going to let you make your speech now perfect thank you so much hello my name is Amy Melle Flint I'm the community relations manager for St Angelo Tech or for Mosaic in St Angelo and uh for those of you who don't know Mosaic is an organization that provides services to people with disabilities we do this through a group homes that we have throughout St Angelo and then we also provide support to foster parents who have who have U people in their homes that have special needs and then we also and then we also provide um other services to people with special needs um Mosaic and S Angelo is unique in that we have um therapeutic horseback riding for not just the people we serve but anybody who has physical and intellectual disabilities and then we're also the only child care service we have the only child care um service in town that um provides spe um care to children with special needs so while there while we always strive to share the needs of the people in our community that have intellectual disabilities and other special needs um intellectual uh intellectual and and developmental disabilities awareness month is the perfect opportunity for us to um share with the community of s Angelo that there are people in our community that that are that have special needs and give um and have the same goals and dreams that all of us have so I invite all of you to come to um we have free lunches twice a month that are called discover the possibilities and um it's a 1-hour lunch we have this month there onch March the 4th and March the 17th and if you'd like to come please just give me a call at mosaic and I'll set you up thank you very much thank [Applause]

[0:06:16] you I didn't get a picture with these with my thank you all very much and this next Proclamation is very very close to me because this is this involves a very very good friend of mine and I would like to recognize rod and Denise Bridgeman if y'all would come forward I remember in 2003 when Rod came to the city council and asked for money for the Downtown Association it's where I first met him and I'm going to tell you what there is no one in this world that has done more for downtown s Angelo than Rod Bridgeman and we've got a lot of them that have done a lot but Rod was instrumental in working and bringing downtown s Angelo back so now we have nightlife in San Angelo downtown after dark we're used to we didn't hear anything but gunfire so let me read this Proclamation rod and Denise Bridgeman have been an invaluable impact on the growth of s Angelo Arts and Music and downtown business development since moving here in 1998 they have nurtured local artists and musicians and have hosted International musicians in s Angelo through their Blues in and venue known as the cely flats leading the way for a rebirth of nightlife and the revitalization of overall downtown business they Rod Denise and sey flats were Catalyst for putting s Angelo on the national Blues

[0:08:20] map with the implementation of the S Angelo Blues Society and the simply Texas Blues Festival they have given back unselfishly to the community by founding downtown s Angelo Inc implementing the rooc program at black Shure Elementary hosting Christmas for local troops and their families Toys for Tots as well as serving on various nonprofit boards they have made our city and our people richer therefore I Dwayne morson mayor of the city of St Angelo Texas on behalf of the city council do hereby Proclaim March 14 to5 as rod and Denise Bridgeman day oh [Applause] [Laughter] [Applause] we weren't expecting this I'll tell you we love this city so much this is will always be home to us we've made so many good friends here and just thank you so much thank you let's get [Applause] a thank you so much oh my and we also have a lot of the members of the Blues Club here today that that showed up and we've got a big shindig going on at cely Flats it's the 14th isn't it Rod yes okay so that's going to be a lot of lot of different bands coming in to play it'll be a fun day uh we had one more recognition I had the S Angelo Central High School Bobcats boys and girls swim team uh they were unable to be here today so we have rescheduled them for the first meeting in April so we'll get to them that we'll get to them at that time

[0:10:33] well it came up all righty this is the time at our Council meetings when we allow the public to make public comment if there is anything that you want to address the council about whether it be good or whether it be bad this is your opportunity to speak I will let me read the legalities and then I'll open up the floor to public comment the council takes public comment on all items in the regular agenda public input on the regular agenda item will be taken at its appropriate discussion public input on an item not on the agenda or consent agenda may be identified and requested for consideration by the council at this time the council May request an item to be placed on a future agenda or for a consent agenda item to be moved to the regular agenda for public comment on public hearing items public input will be received on each item immediately following the council discussion and prior to any action on the item each member of the public shall make the remarks from the podium Begin by stating your name remarks by each citizen will be limited to 3 minutes unless W by Council meter for all speaking on that matter no individual will will be allowed to speak more than once on any one subject until every citizen wishing to speak has done so line forms at the front good morning good morning and if you would state your name and you have the floor my name my name is Becky Bray and I'm a member of a single member district one and I just have some concerns and really this is is kind of preaching of the choir with the group that's here that as constituents we all need to stay on top of our local politics and I learned that lesson we got a good reminder from Miss gr staff at a meeting about a month ago I guess about reading the minutes and reading the agenda and staying on top of these things and while we don't all always have time to do that it's important to try to check on that but that's what we rely on you guys for and that's what we put you in office for and we thank you for your service and I know often it is

[0:12:35] a thankless job so I want to thank you for your service and uh but I I would do want to ask a question of council and that is um what is the best form of communication with you guys I know sometimes uh phones can be flooded emails can be flooded um not everyone has a a group a Facebook group not everybody has Town Halls on a frequent basis so what is the best way to stay in touch with our council members and the group as an as a whole speaking personally for myself on the city web page I have three telephone numbers and I have two of my emails and my phone and my address and my number is in the phone book and call me anytime anywhere about anything anybody else how do y'all feel about it well on the same way I've got two email addresses and the one phone number and it's easiest for me if someone will send me an email at either address so that I could address it I do want to caution as a reminder if any of you send an email a mass email to all of us at one time on the same subject we are not allowed to respond to it because of a walk-in Quorum law that's in there at the state so if if you want something that you wish a response to if you've got all of our names on there that it's forwarded out to you you won't receive a response and that's the reason not because we don't want to it's against the law so if you send it to me individually uh I'm more than happy to respond or you may call are you really more interested though in how information gets out to you I think that is a concern accessing us but you're really more interested okay both um because I you know we don't I've got small kids at home and so it's you know they're at school now but it's it's sometimes difficult I can't come to every meeting this morning I woke up I didn't feel good I thought I don't want to go but you know I I feel like it's my responsibility to stay on on top of

[0:14:37] things and well I personally in process of setting up similar to miss grindstaff but not every month I want to do a quarterly uh meeting and says let's talk very informal inviting my constituents to come and talk to me about maybe what they don't understand or would like to understand and I plan to put the notifications out on in Faceook Facebook and just a let's talk and I want to do that about once every 3 months more if necessary depending on the subject matter at the time and I appreciate and I think that's what a lot of the city would appreciate too is just an opportunity to know what's going on for people that work that can't sneak off and come to the meetings too so that they would know be more informed and have a voice we know we we we elected so we wanted we want to be a part of that process the city also has a Facebook page uh you can get information on that on our website Accord we have our cable access Channel as well and uh we're always putting out new information we have these City Council meetings recorded uh so in case you did miss it you weren't feeling well by all means watch us on on TV as well okay okay all right thank you answer anybody else down here got anything dad go ahead Johnny Mr I was going to add also that we are on the on the city's website but I would reach out to even Mo'Nique here with standard times because often times they list the names and numbers of the elect officials on the state level maybe the national level but I don't think we we've ever they they've ever done one for the council so maybe that's something they have maybe they need to to do it periodically but uh you know my number is 2121 1452 I've got an open book policy and anyone that wants to reach out email cell phone doesn't matter but but maybe that's something that Standard Time needs to run again to answer you know give you a way to connecting with us also okay and just for clarification Monique is the standard times employee of the year just so that everyone knows who we're talking about thank you man answer my question

[0:16:39] thank you who else needs to approach the council that one was easy no further comment from the public okay I'll will open it up to the council members now is there anything that the council members and I'll start with you Elizabeth is is there anything that y'all need to state are there any items on the consent that you want to pull to regular no sir Don no sir Charlotte yes sir uh had the occasion to have lunch downtown uh yesterday and uh uh as the group that has just left uh honoring the Brigman and the efforts and stuff that they've done we we have brought a lot of businesses down town and I think I recall a few years ago stating on a Sunday or Monday if I had to Wade through beer hands to get to my vehicle that I was going to be back very loud and very ugly about it and it has happened on yesterday and it wasn't on the morning uh this was noon and uh they're on chadburn the the new business in the center of chadburn but waiting through the beer cans and the paper cups and the water bottles was not a pleasant experience and on my visit there I had numerous of the business people come out and point out to me where they were from and they were were quite aggravated so I would like City enforcement to look into that I'll have James look into that no problem and then I would also like to pull item number five five from the agend uh consent agenda five or six or five and six both both five and six five and six is is that ma'am John I don't have anything Marty I'd like to pull item number two number two Rodney none at this time okay all right then uh I am going to entertain I move that we approve the consent agenda

[0:18:42] uh minus items 2 five and six as presented that's what I was looking for anybody want to second that Marty do have a motion to approve the consent item a consent agenda items that will be what do we have on here we had nine of them so this would be all of the items with the exception of two five and six Marty has seconded any further comment from Council before we take the vote do I have public comment on this item then I will call for the vote all in favor please say I I oppose Nay put a 70 on it Brian let's start now then with number two this is Marty's deal this is consideration of selecting midex of Midland to provide Construction Services for the Fairmont Cemetery columbarium c114 project and also authorizing the city manager of it designed to negotiate said contract Mr NP uh what get us started Morty I have very simple question what why do we think we're not getting local bids all of a sudden on some of these projects uh uh that's a good question it this was a small very small project mainly masonry concrete work uh no electrical Mechanical plumbing um I I don't know they were the only bidder um we tried to reach out to Masons and you know we talked to Langford and hoping that they would take it specifically but they're they're acting as a sub in this case um and other a couple other people are doing postings and all that kind of stuff we're doing it as we've always done sending it out correct all that yeah I I just noticed you know the other one that's coming up in a little while it's the same way and but that was my main question I just wanted to point it out I think midex is very reputable company they do good work but I just we did go through a period a few years back when we had a we weren't getting a lot of bids I think it had a lot to do with the economy and then things changed and we went through another phase where we got quite a few bids and we swung the other way again

[0:20:45] all right I move approval second okay John do you have I was going say David just on this one off the top of your head how many bids did go out oh uh invitations yes invitations um I I'd have to confirm with uh Roger a dozen is it it would even though we just got one I think we usually send out to multiple Rogers coming for you know know we sent it out to the whole list I think you know like even the big guys would get it we knew knowing that they wouldn't accept you know look at we're reaching out to the local folks anyway so we're at just doing that you know as much as they have you know showing that they want to do public work and and uh not everybody wants to work you know cuz there's insurance and things that they have to deal with so that's right um and that may be why some prefer to be a sub as opposed to the general that's exactly right um you know we only had one one General pull together a group to do it so yeah y Roger still looking he's still digging you just thought you were about to retire we're still working end of the month uh I don't have the exact list with me but it's normally about 12 and we had four that attended the uh pre-bid meeting thank you Roger that answer your question John yes satisfied Marty yeah somebody somebody move somebody seconded who was it me you okay we do have a motion to accept item number two it has been seged any further comment from Council on this do I have public comment all in favor please say I I oppose Nay put a 70 on that one please item number five consideration of approving the economic development B performance agreement between Costa DC and D Cody Coffee Company Incorporated in the amount of 98,2 188.50 and economic incentives incentives in substantially the same form as he attached in ratifying the the

[0:22:49] authorizing for execution by the cadc board Mr Pia start us off Charlotte well I would like if I could ask legal counsel if we could move these two items into executive session to talk about some items uh before we talk about them publicly they are they are posted and so they could be moved into executive session I would like to discuss them an executive with reference to this and then come out and visit about it anybody else need to talk about an executive I don't have any problem with it I understand what he's doing and I would be perfectly satisfied moving forward Ward but if put in a form of a motion Charlotte that we move it to executive and let see where it goes I would like to move that these two items be moved to Executive session to discuss our recent audit and the effects of and what has transpired that has to do uh with how this will be set up and monitored I'll second it okay we do have a motion we do have a second any comments public comment the motion has been made that we move number five which is a Coosa DC with Cody coffee and number six which is COA DC with mhab to the executive for discussion and then we'll bring this back after the executive and vote on it all in favor please yes John yes sir can uh we should be stating what exception that we're going to place this into executive session whether it's consultation with attorney um if there are some legal issues that you know you're concerned about of that is one of the exceptions that it could come under but we do need to identify the exception that's applicable uh for moving it into executive session I didn't hear word he said so are you we have to give the reason that can be discussed in executive session would that be to consult with the

[0:24:51] attorney yes I think that's the 55107 5 55171 okay 5510 my memory is not that good Brian you got to give it to her 51072 yes to consult with Section 551 712 that will be added that will be add to my motion and you will add to your second yes okay any public comment on this before we vote All In favor of moving please say I I any oppose nay all right put a 70 on that one we'll move five and six and we'll deal with those and executive after a while was that motion made for five and six yes okay yes it was five and six and then adding the appropriate numbers to it as well okay now when we get to when I read the executive do I need to read that what was that number again 551 0712 it's under the same the same number you'll be reading you can just add the item to it it's on there and consult with the attorney all righty let's move on in number 10 second public hearing and consideration of adopting an ordinance amending chapter 10 entitled traffic control article 10.03 entitled operation of Motor Vehicles of the code of ordinances city of St Angelo Texas altering the maximum speed limit on Sherwood Bay beginning at the intersection of Clark Street and extending West to 300 ft west of the intersection of Southland Boulevard with such street being located in the city of St Angelo Texas providing for severability providing for a penalty and providing for an effective date Patrick frich good morning mayor council uh we're here this morning for a second reading of the ordinance to amend the traffic or second reading to amend the

[0:26:54] Traffic Control Ordinance to allow the speed limit along sh would way from Clark Street to 300t past Southland Boulevard to be placed at 40 mph um as we said at the last meeting Tex doot performed a study along this stretch of roadway and they recommend that the speed limit be placed at that point um a change of our ordinance is necessary to enact this recommendation Tex dos recommendation well I was asked the one that asked that this be put on the regular agenda instead of the consent agenda because I'm against changing the speed limit uh I think there was a survey done and 87% of the automobiles was driving at 47 mph on this stretch the 8 yes sir at the speed limit is already 45 which is where the traffic is driving that's the natural flow and by us dropping this down to 40 I remember a I got I was honored and privileged to take a driver's driver's course here several years ago thanks to our Police Department and I remember one of the things that they told us in this course was that more accidents are caused statistically by slow drivers than by fast drivers and I just think if we change the speed limit from 45 to 40 when they're already already driving 47 we can either one create a speed trap where we can ride a bunch of tickets and I don't think that's the intent of this I think people are still going to drive 47 and I think some are going to be driving 25 and 30 and I think we're going to create more problems than what we are than what we're solving I am very much against this and uh that's where I'll start it and I'll move for charotte you're first it's it is my district and uh I do Drive the area live out in the area uh shop in the area um I personally think the traffic out there is way too fast um then I'm older but at the request of a dozen business owners who

[0:29:00] are trying to operate their businesses through there and their complaint being the traffic is too fast for the number of cuts that go out onto Sherwood Way the various little centers or shops or businesses and the confusion of a three-way stoplight that is out there so I assured them since I was their representative I would ask the city and the state to do a study about the speed of the traffic and would work off of that recommendation State's recommendation uh is that it does need to be lowered there are considerable cuts into the street which makes it hazardous uh that's the reason it is here at the request of the citizens and I have not with all the publicity that has been on it I've not received one phone call from any the business owners to go back to or Roll It Forward they do want it lowered I have had one continuous call a complaint from a gentleman who is doesn't live in the area that feels he is an expert and does more knows more than the state does and does not want to do this so I will support it because of the constituents and their wishes and the safety if it will help prevent one serious accident you were next Ry okay I drove this road and I and I looked at it at just past Oxford or just to the east of where Oxford hits Right There It Is 40 m an hour all the way down surewood way on that side so it's not like we're lowering it down to a speed that it's not at so it goes from 40 to 45 all the way out past the Sam or out to Sams out there so I I don't see this as a problem I also talked to two business owners like Charlotte and one property owner on that that stretch and all three of them wanted the the speed to be lowered when I when the State comes to us and gives us their advice I think that they they do these studies more than any of us and

[0:31:02] even more than our own staff does this is what they're paid to do and when they're giving us a recommendation of lowering it I I think this will not harm anybody I think uh unfortunately what most people do and I'm probably one of those people is if the speed limit is 45 I do Drive probably 47 I hate to say that with Tim in the room but so I I'm thinking if you lower it down to 40 you're probably going to drive about 43 with traffic and that's what happens a lot of the time but it would still lower it by 5 miles an hour that's the way I'm looking at it so I am for this also Elizabeth uh I agree with everything that both uh councilwoman farmer and and uh councilwoman Fleming have said I think that it's always smart when we follow uh adopted guidelines and I believe Patrick in your last presentation you uh quoted the mutcd which is what uh you your office would use as well as the state district engineers um when when we go to the state and ask them for assistance or their advice I think it would be ridiculous for us to to do something that we kind of want to say is from our gut rather than from sound engineering principles so um I'm in favor of this and I would make a motion to approve the second time okay do have a motion to approve going from 45 to 40 I do have a second this is second reading further comment from Council John I just wanted to add you know with with all due respect to everyone voting for it I I am against it and that's just me personally I I find myself and I would ask Tim to cover his ears but I find myself also you know I'm doing 45 and or a little bit higher sometimes to till I get the elbow from the wife hey slow down but I I just don't see that it's going to make such an impact you know just changing the five miles so that that's I find it hard to believe that it's really going to make make that much difference than it does already so I'm going to vote against it and just just for that reason further comment council do I have public comment on this item call for the mo call for the vote

[0:33:07] motion has been made we drop it from 45 to 40 all in favor please say I I any oppos Nay n nay so I got three Nays and I've got four eyes I believe that's exactly where it was last time your up again vote let's has the eyes raise your hand eyes I think you no yeah we lost yeah you lost oh it did change we have three eyes now let's have Nays that would be four Nays so the speed limit will stay at 45 miles hour thank you very much let's move on to number 11 which is a presentation on the spay neuter Initiative Program a new partnership between the city and conu Valley's Pauls presentation by Anthony Wilson our public information officer thank you mayor you have the floor sir as you mentioned I'm here to talk about a new initiative uh that is actually a partnership between between uh the city of St Angelo and our friends with a cono Valley paw which is uh pets are worth saving and there's no denying that St Angelo has a pet overpopulation problem we took in more than 6,800 uh unwanted animals at the animal shelter this past year the problem is is that there's no way that we can adopt out that many animals and so uh Bob Solace and myself and Jenny Wilson with cono Valley Paws engag in some discussions about how we might that problem from the opposite end and what we came up with was this initiative uh the spay neuter Initiative Program uh acronym snip you can imagine why that is uh and you see this logo right here this was actually designed by Jenny's husband uh Michael Wilson who happens to work for uh mlin advertising which is the city's uh advertising agency and um what snip is as I mentioned is the spay neuter Initiative Program and basically we have two aims one is we're trying to raise awareness and to educate our citizens about the need to alter their pets because that's the the best way to ensure that we don't end up with unwanted litters uh in our community the second thing that we're

[0:35:09] doing is we're trying to raise awareness of pauses uh voucher programs uh for people who feel that uh cost is a barrier to spaying or neutering their pet uh pause does offer uh an extensive lineup of uh of assistant programs so here's what we uh are doing and and this approach is based on Research that the Humane Society has conducted of what works and what doesn't work in encouraging people to to alter their pets and in some ways it's really counterintuitive because you would think you would want to feature lots of animals in this and actually that distracts from the message because people become so engaged with how cute the kitten or the puppy is that they lose sight of the message and so this is a straightforward Joe Friday just the facts approach and it's this that last year we had more than 6,000 unwanted animals uh enter the shelter in fact that's true almost every year and approximately 75% of those have to be destroyed uh because again we can't care for all those animals and we can't adopt all of them out and that the best way to prevent unwanted animals is simply to to alter your pet and so this is the the tagline courtesy of uh Steven mlin it's the snip that saves money time and lives I mean obviously we expend a great amount of money uh caring for Animals uh out at the animal shelter that does take time and and as I mentioned you know 75% of the animals that end up at the animal shelter end up being put down and so in delivering this message we're using some spokespeople with uh credibility on the issue and you may have already seen some of these spots running on satv we're using local veterinarians including two members uh of our animal shelter advisory committee who are uh vetenarian and we're using uh some of the people uh with Paws uh Jenny and Christ Stanley from the ASU cat Coalition people who have credibility on the issue and we will soon be actually filming some spots with Bishop CE because uh he obviously has credibility in our community and the interesting thing about Bishop CE is his

[0:37:10] father was a veterinarian so he can speak very knowledgeably uh about the need to alter your pet these are our Target audiences uh people you know the the research that the Humane Society presented says that the lwh hanging fruit in this initiative is simply people have not considered uh the need to uh spay or neuter their pets so that's one of the audiences that we're trying to reach uh those who believe the procedure is too expensive uh and it's really not especially when you consider uh the total expense of caring for a pet over its lifetime you know feeding Veterinary Care kindling grooming the cost of uh altering your pet is just minuscule compared to that overall cost and if you you do believe it's too expensive then you know pet ownership may not be for you and it's not for everybody uh and then also the owners of pit bulls and chihuahua and the reason for that is those two breeds are the most predominant breeds by far in our animal shelter and so uh paw has a voucher program that will free of any cost whatsoever you can have your pitbull or your Chihuahua spayed or neutered uh and I don't know that a lot of owners of those breeds are aware of that we are communicating this through the mass media our friends at the uh TV stations in the newspaper in fact we are soon going to begin running a Sunday graphic in uh the standard times that shows how many animals that we've um collected in the animal shelter uh to date uh year-over-year and how many have been destroyed and we're also going to be comparing those numbers with uh what happens in uh Midland and in abene as well we are of course uh communicating this via social media and uh if you've seen our Facebook page this morning you'll see one of the messages that we've already already conveyed we're open to doing community presentations for any Civic groups that would like to know more uh about uh the snip program we've done the spots on satv you see Brian over here he's filming this presentation so that we can do a story uh on satv uh about this presentation

[0:39:13] and we're going to be filming it uh very soon for the city our interview show and we've created a uh a web page specifically for snip at cox. us snip it's found on our Animal Services page that provides a lot of information about altering your pet including the information about the uh the vouchers and also some of the benefits of altering your pet and the myths uh involved with that now essentially what we're trying to do is we're trying to change a culture here in St Angelo so that people spay and new their their pets uh on a more frequent basis and we believe that we can do this because we've already been effective uh in this regard on a very serious issue and that is uh water consumption uh in 2012 you see here uh on this slide one the average person was using over the course of a day 1177 gallons per of water per day and of course you guys know we have sounded the drum beat on this a constant drum beat of conserve water we need to conserve water be careful with your water usage and by 2014 that number had dropped from 177 gallons per person per day down to 127 gallons per person per day and and you know I think that's pretty remarkable and there's no reason that we can't have this sort of significant gain when it comes to reducing the number of animals that are entering our animal shelter and that eventually have to be uh put down so with that I just wanted to to make the uh Council aware of this we'll answer your questions and Jenny is here as well and she can she can answer any questions or make any comments that she'd like as well you know I think this is a wonderful program I mean what we're doing now is not working so I think it's great that we're trying something else Charlotte do you have a comment I have a question I think it's a great program and I do believe that's the way to get a hold of this U overpopulation that we're experiencing and your advertising must be doing a great job um is this intended for Tom Green County residents only the

[0:41:18] snip program well understand that snip is actually just a a awareness and education program uh 's no real cost behind it uh are the vouchers that are given in relation to is that just Tom Green County and the reason I asked is I happen to know of an animal that would came up from Horseshoe Bay and got a voucher at our department and another animal that came over from Eden and got a voucher uh to be spayed or neutered in in through this program and I'm wondering what the fee is the collection is when they're not Tom Green County I'm gonna let Jenny answer that question she's right behind you Anthony hi Jenny good morning good morning thank you all so much for allowing me the opportunity to youl that's right Jenny Wilson with kcho Valley Paws um and we've had just um we really enjoyed working with Bob Salis and Anthony Wilson on this project but to answer your question um our vouchers are available to anyone in the koncho valley where we find some restrictions are the veterinarians that participate so you may live out in in the county or uh between Robert Lee and Ballinger um you're going to have to travel to Ballinger to find a veterinarian to accept the voucher so it is for the Concho Valley all of our vouchers are but that's what I'm telling you is these two individuals chose an address of a relative in town but they live one in Horseshoe Bay one in Eden to take advantage what do we do to verify that that that animal is actually on the voucher it's just whatever they say that is she said they're taking advantage of us well you know sadly I'd like to say that there was some way that we could foolproof this this program the fact of the matter is the vouchers are the lowcost vouchers let me let me take a minute and tell you we have three we have three programs right now we have our lowcost span neuter vouchers um those sell to

[0:43:20] anyone in the kcha valley for $25 for a cat sterilization or $50 for a dog sterilization that's open to anyone that program is and that's the way that the grant that funds the program is written we do provide free vouchers to people that report low income and the standards for that low income is a family that has an income of less than $24,000 annually so we do have a way to to verify that within the grant structure that funded that program um I don't have a problem with spade and neutering pets I'm all for it I just don't want people to feel like they have to lie or they have to cheat I just want us to say we'll take any animal from anywhere to get it spad or neuter councilwoman I think it's important to note that that pauses Voucher Program doesn't involve any City funds whatsoever I mean it's it's Grant funded for grants that they go out and apply for so there are no public dollars involved with what uh pause is doing now you know it is true that if uh if I were to bring uh a dog from outside the county uh into the County and it gets loose and the animal shelter picks it up then before they will release it to me it has to be spayed or neutered uh and there is a fee associated with that but uh but what pause does is uh free and clear of any City money whatsoever I just want to cover all of them and and make it legal to cover all of them so to me if we just try to take care of our little niche you know animals stray they tend to stray they don't know where county lines are yeah well like like I said our programs we are um kcho Valley so everything that we do targets the koncha valley and again where we do run into restrictions and and um is is in the the delivery of the services by the veterinarian if we can get more veterinarians out in the surrounding counties involved um then we'll definitely go after the funding to provide more okay thank you any F any further comments from Council on this I I would just like to say that I really appreciate all the teamwork between your organization City staff public

[0:45:22] information it looks like a great initiative and I'm sure will be very successful because for all that we do it it makes no difference if the public does not hear the message so good job everyone go ahead and move approval in does it need an approval it's just presentation doesn't need an approval then we approve it anyway very well let's move on now to number 12 which is the first public hearing and consideration of approving an ordinance of the city of St Angelo Texas amending the code of ordinances of the city of St Angelo chapter 12 exhibit to a zoning ordinance by number one amending article 3 use regulation section 310 use table industrial use categories adding a use designation is frack sand propin transloading and warehousing operations to permitted only in the heavy manufacturing zoning district with a conditional use number two amending article three use regulations section 316 industrial use categories by redesignating some parts a through f as subp Parts B through G respectively and adopting a new subpart a Frack sand Pro propun transloading and warehousing operations providing characteristics accessory uses and exceptions amending Article 4 specific use standards by redesignating sections numbered 410 through 426 the sections 411 through 427 respectively and adopting a new section 410 entitled fraan proant how do you say that is that prop Propet proant that's a brand new one proant transloading and warehousing operations establishing General and operational standards conditional use application procedures and conditional use application requirements for Frack sand propit transloading and warehousing operations amending article 8 definition section 804 Define terms to create definitions for flocculent fla Frack sand Frack sand proant related waste materials Frack sand Propet transloading

[0:47:27] and warehousing operations operator and proant providing a severe ability clause and providing an effective date it is 9 minutes till 10 do y'all want to get into this right now you want to take 15 and come back 15 let's take 15 and come back and then we'll get you and well said in the caption what is that Peter Piper pick I thank you sir Rebecca gar planning manager as the mayor um so eloquently introduced before the break um this is a textt Amendment to the zoning ordinance that is exhibit a um and it is intended to create or to do the following which I'm going to read to you in a very shorten format um it adds a use category called Frack sand propen transloading and warehousing operations now this use category mimics the way that Freight and warehouse warehouse and Freight movement is worded currently in the zoning ordinance so to the greatest extent possible when we wrote this text Amendment we tried to mimic the exact language that's in the zoning ordinance today but I want to assure you that given the direction that city council has given staff in the past we are in the process of amending the zoning ordinance um for uh industrial uses and heavy commercial uses and so we are taking a very thorough look an examination and you can see you will see um those proposed amendments before you fairly soon and certainly before the end of the fiscal year that being said as part of the text amendments that we're proposing proposing today we are creating use regulations to go with this new use category characteristics accessory uses and exceptions this mimics how every use is presented within the zoning ordinance today in addition we've created some specific use standards within section 410 a new section 410 which um outlines General and operational standards conditional use application procedures and conditional use application requirements what we've also done is we've created definitions we've created um six new definitions um which again

[0:49:30] the mayor has so eloquently read before the break um and I will go through them as well they're also contained within the U memo that we sent out to you so let's get into it the staff the U the text Amendment use category as I said previously is called fraan proant transloading and warehousing operations the zoning District which it will be allowed in is heavy manufacturing district and it will be that District alone what we are we we are proposing is that a conditional use approval be required from the Planning Commission in order for that use to be allowed within the heavy manufacturing District now the reason why we do that is that this is the only means in which staff can for all intents and purposes enforce any conditions or any promises that a developer or a operator uh would like to have um and he may he agrees to we have no other way of memorializing this other than cc&rs and we are not party to a ccnr so the city cannot enforce it should for some reason it go away or it never happen this is the least um invasive way that a municipality can do so this municipality in particular because the the conditional use only goes to the Planning Commission it doesn't have to have two readings before city council so at City count at Planning Commission the condition of approval can be um placed the Planning Commission can approve it and if anyone is AG reeved it still affords the public and more importantly um anyone who may be AG grieved by anything that has happened as part of that public hearing to still appeal to this city council and it gives the city council the opportunity if someone is AG grieved to hear that um to hear those statements or to hear those concerns and take any actions which may be necessary now they may not be necessary they may not even be conditions of approval associated with it but it still affords the public the opportunity to do so and to come before this Council to have themselves heard so what are the characteristics fraan prop and transloading and

[0:51:34] warehousing operations deal in the warehousing transloading Andor transport of industrial silic sand processed fra sand or propin to and from any site accessory uses include may include offices truck Fleet parking and maintenance areas loading areas and way stations there are exceptions that are listed manufacturing and production uses so if um any of these operators intend to process the Frack sand if they intend to do any sort of chemical changes or production um that is the um including of Aggregates with that industrial grad fra silica fra sand um that is going to be termed as a manufacturing production use and so it will not fall under this category manufacturing production which has all those nuisances that um were talked about so much with a previous case which will not bring up um it will fall within that use and those characteristics those exceptions those specific use standards and more importantly the nuisances which cannot be produced as a result of those um operations will be addressed as that part of that use category this use category only deals with transloading transportation and warehousing of fraan andits another exception is waste related uses if the fra sand or the proin is a byproduct of the fra sand process if it has any waste related solid or liquid it will be considered a waste related use and it will not fall within this use category there are use standards specific use standards associated with waste related uses as well as specific use standards related with it that also have nuisance standards associated with it and finally warehousing transloading and transportation of construction grade sand Stone gravel and other Aggregates is not included so that is that operator who is just transporting plain old sand or gravel or any of those construction type of um materials will not fall within this particular use category some general and operational

[0:53:37] standards which have been included um The Operators will be required to um have some sort of control of surface water runoff consistent with our city codes they will not be permitted within 300 ft of resid of a residence or residential zoning that is consistent with how the tce Q currently handles the permits that are required for the operation of these type of facilities there shall be no outdoor sand piles there will be no truck hauling on um roads classified as local roads per our major Thorofare plan and again I'll reiterate there's a conditional use approval will be required by the Planning Commission lighting and noise shall not create nuisances all Warehouse Frack sand and proper structure stres shall be roofed and enclosed on all sides this includes and the language um actually covers the silos that you often see associated with these type of operations all vehicular maneuvering parking loading and transloading areas shall be paved with concrete or asphalt this is something that this Council particularly had concerns with on the previous um case which shall not be mentioned and finally um they must be compliant with all literacity codes so the conditional use application procedures are fairly consistent with the conditional use application procedures that exist for any other conditional use which may be required within the city of St Angelo you have the application itself the fee the review of the application the review before the Planning Commission and if you want to amend it the conditional use that you've received previously you go through the exact same process that any other conditional use would have had go through the requirements are the same as any other facility that has to submit for conditional use application basically staff is verifying who is the owner who are you leasing it to who is going to be operating this in addition we want we need some aerial photos some topographic maps um and we would like to see a location of

[0:55:40] where all the structures and parking areas and storage are going to be an operation plan will be required this gives us the opportunity to know when it is that the operation intends to be um begun or started um and if there's an end date um we'd like to know where your access points are where your truck routes are going to be it's very important for us to determine if you're going to be accessing any local roads um how many um the truck the traffic frequency we um require a water budget and runoff control measures as we would per city code today listing of all hazardous materials and measures for securing them and a listing of all flocculence and their usage and Disposal and I'll get to later what a flocculent is and here it is a flocculent is a substance that promotes the aggregation or clumping of particles what is a flocculent flocculent with an a flocculent with an a is most people use water you take the sand you want a clump and it's usually for lower grade um for silica sand which has been mixed with other Aggregates it's so it doesn't become airborne so that's what a flocculent is flocculent with an e By the way means having the texture of the TFT of wool so don't let anybody tell you it's a flul it with a needs it's a flul it with an a Frack sand is a hydraulic fracture grade industrial silica sand used in the production and recovery of oil and gas it going to be a test on this sir I have done months of research on this that's awesome Let Me Shine fra sand propit related waste material is basically what we talked about before if it's a waste Rel has it has any kind of byproducts as a result of being used has liquid or solid waste it would be considered a waste related uh Pro material and therefore would not fall within this Ed category that's a really long definition for basically everything I just told you it's also in your staff reports but what it says most importantly is it says what it doesn't apply to so it's one of those exceptions

[0:57:42] that I talked about earlier operator means any person or entity who is engaged in or applied for or been granted permission to engage in the use that we've discussed today Propet means any solid material typically treated sand or man-made ceramic materials designed to keep an induced hydraulic fracture open during or following a fracturing treatment on February the 16th the Planning Commission recommended approval of proposed text amendment to chapter 12 exhibit a with no changes so the action requested today is to approve the proposed text amendment to chapter 12 exhibit a zoning ordinance and adopt the ordinance on first reading this concludes staff's presentation we're available for any questions you may have thank you I think it's a wonderful presentation I think it's something that's needed Rebecca thank you thank you sir uh let's start with Council questions anywhere I have I have multiple um if you go back to the conditional use you know that I have been a Critic of a conditional use permit I have a feeling that something should be allowed by right and be well defined as to what the conditions are the criteria for the the ACT AC ity within heavy industrial so um is there why does staff believe that a conditional use permit is necessary if the if the industry fits all the other criteria that you've explained there are three major reasons why we're leaning towards receiving an additional um approval um in addition to having the correct zoning the first is if you look in the zoning ordinance today under heavy manufacturing there are three distinct uses under heavy manufacturing District that require conditional uses I I'm not interested in perpetuating something I want to know why you think a conditional use is necessary yes ma'am um so those uses those reason why those were required to have conditional uses because the traffic volume this type of use has the type of traffic volume which is consistent with retail sales and

[0:59:45] service which also requires a conditional use in the heavy manufacturing zoning District the second reason why staff recommends this conditional use for this particular um use category is that there is no other way for the city to be able to enforce any conditions of approval which the operator may wish to put on it or which the public which W may wish to have on the use being operated on today if you have straight zoning that is heavy manufacturing zoning district there is no way for the Planning Commission or this Council to place any condition of approval on the use of this facility um other than having either conditional use or specific use and the third reason is that Upon Our research of other municipalities that have done similar ordinances every single one not a few but every single one of them have either required a specific use uh approval or a conditional use approval to be placed upon this type of use being operated so is that more about like site uh site design I mean where where again what is other than the fact that we use conditional use here which again I don't like I think that someone from out of town ought to be able to read the zoning ordinance and understand that they either fit within a certain classification or they don't and a conditional use is yet another layer of approval that has some potential for subjectivity in my view so is it the site plan what is it that you think that is most helpful about the conditional use as you've described this process or recommended this process is on a caseby Case basis for a condition for extra conditions to be placed if say the proposed use is next to an area where there where there is assembly a church a daycare um any of those facilities which may very well be located either next to or across from these type of facilities there's no way of placing extra buffering extra distances any condition that this Council or Planning Commission

[1:01:48] would wish to place on these facilities there's no other way to do it and moreover there's no way to memorialize should an operator wish in good faith to put in extra conditions on there other than a ccnr which we are not party to there's no way that we can enforce those extra conditions that an operator may wish voluntarily to do see I also have a problem with heavy industrial or heavy manufacturing as we call it to not be able to be free free to have a heavy manufacturing classification um I know people don't want to live by that and I'm very respectful of the distance that you've mentioned um and we've had a lot of discussion at different uh different committees here about distance requirements from this kind of activity to a residential neighborhood or a residence but at the same time just as a neighborhood should be protected from the encroachment of heavy manufacturing or heavy industrial use to me so should heavy industrial be somewhat protected from the encroachment of activities that see them as nuisance I think that every use has a place in our city if the city is well organized um when you mentioned uh light or noise um these can be activities like a lot of industrial uses that are going 24/7 depending on what they're making and doing I'm interested in what you believe you know is that I can see the light bulb from the public rideway kind of a lighting issue is that a noise that um where we can say well it's it's offensive to me because I want to go to bed at 9:00 how do you how do you view that with regard to the standards that are accepted through other classifications around the city it is the same because the nuisances are defined um or the nuisances are consistent with state requirements um Code Compliance when they receive a complaint because that's

[1:03:51] really the only way that you can tell if something has created a nuisance is until it actually operates Prim fascia three our zoning ordinance I think says three so it it is consistent we do exactly what because the nuisances aren't aren't minutely stated within our code of ordinances they simply mimic the language that the state has put forward for basic nuisances that's what's utilized we deliberately use the same language which effectively says thou shall not violate the city ordinance's standards for nuisance again and that's why it's imperative that we not have encroachment from residential into industrial vice versa that way we that activity can get along quite nicely without the fear of someone saying that bothers me even though we might find that noise or that lighting acceptable for that kind of activity hi good morning Patrick Howard planning director I think I wanted to share a little bit as well about some of the staff's opinion about the the need for a conditional use I think one of the things that you find when you put in zoning ordinances together is that some of them are more prescriptive which specifies very specifically some standards and and so you have to kind of figure out where the community is in terms of how specific you want to be in terms of regulations and requirements or how liberal you want to be in terms of being more proscriptive where you have sort of a framework and you allow for certain cases where you want to maybe a look more specifically at a c circumstance or a situation that might be concerning the folks and I think in this case we felt like because of the the significant nature of what the potential may be in terms of the effects of this type of use it may warrant considering a conditional use which doesn't is not a requirement necessarily in terms of imposing conditions but certainly having the opportunity to do that I'll tell you also this as well is

[1:05:53] that we've got a comprehensive plan and we have Lane uses around the city they're not consistent with what the underlying zoning is so in an ideal situation we wouldn't have these kind of Hodge poda uses or having industrial properties that are adjacent to residential areas but we do and so we as an organization or as a city may need to think about how we sort of Rectify that in the meantime we do have a situation where we have uses that are ideally not are adjacent to areas that we probably don't want to see developed for that purpose so I think that it's it was staff's attempt to sort of try to figure out how to balance that and this may or may not be the the appropriate way to approach that but that was our rational basis for why we would thought that we at least bring it to your attention consider that as a possibility if you wanted those additional protections however I think the the ordinance as it stands is fairly solid and has a fair number of Protections in it based on the feedback that you all gave us I think this is just one option for you all in terms of you feel like that's a relatively uh necessary thing to do or it may not be but that was at least you having the opportunity to discuss this in this forum and saying well I think this is good but maybe it's it takes a step too far in the direction that we don't want to move in so that that was really our basis for uh at least allowing for that opportunity to exist if we thought if you thought that was AO well if if Michael or Roland came to us with a prospect that was a heavy manufacturing heavy industrial use I would not want this type activity to be treated any differently and I'm not sure that we would be trying to put the same conditions on that again I think in our community we need to uh be very careful but I think we need to see growth in industrial uses I think that's very important for our tax base so I don't want any industry or particular industry

[1:07:56] to get the feeling that we are trying to make it very difficult for them to operate within the city limits again if they're in the appropriate District right I don't want everything we do to be in reaction to something that happened a few months ago that was in itself a unique situation but going forward I hope that we are um again not as we as we Court industry that we're giving them a place to locate and be successful without pushing them again outside of the city limits that does us no good and that's our intent as well and again I think the the notion that there is the there are cases because all of the land uses aren't necessarily consistent in cases with the zoning that we have to figure out how we transition into a situation where maybe there is that uses that are all clustered in their appropriate location however that's not the case in in this as it as you all know so again this was a forum for you to sort of figure out in that in that case as you've been talking what you believe is appropriate how far you want to go as it relates to having these having standards in place um but certainly this this is one attempt to provide those additional protections if you felt like it was appropriate thank you further comment from councel Don you know I I uh I think we have an adequate number of ordinances I think we have an adequate number of checks and balances within those ordinances I think as long as as Elizabeth so eloquently said uh you know you you put the the the square peg in the square hole it it's it's all good it's whenever those things fall outside those parameters that judgment comes into play and I think think that that's all well and good we're all human um I do not want to have a

[1:10:02] a tax generating facility to look at Stan Angelo Texas and say oh my gosh there's no way we're going to going to operate there be able to operate and so you know consequently I am not for this at all Charlotte no questions John and re I was just going to add that I I truly appreciate the the homework that you've done the presentation you made it all makes sense to to this council member I'm okay with it I know you guys are looking at the effects that facilities like these might have on the city as a whole and you're trying to protect us Pro protect not only uh the business owners but also the citizens that may live around these type of uh uh industry so I'm okay with it and mayor I I I move that we approve uh this item just as you presented it whether I have the votes I don't know but again I appreciate some of the verbiage that I've learned for the first time but I have a bigger understanding of how it should be and it how it will work and and I'm okay with it so I'm I'm move that we approve this item as presented mayor I'll second that okay do have a motion in a second to approve Marty do you hear a comment sir n Rodney I I agree first of all I want to thank Rebecca and Patrick for putting a lot of work I know that Rebecca's done a whole lot of work on this and I I I'm thankful that she has I just don't want to see this come up again is the biggest thing and and this this industry I don't I feel like this ordinance is going to Target it is targeting this industry and so I think this is going to protect us from because I've looked at the plans on the railroad tracks going through town and the amount of property there is and there are other areas that this could go inside of our city limits a lot of people don't realize that but there are other areas that it could have gone without this ordinance and I think this ordinance is going to help protect that I'm I'm I'm with Don I don't like adding more ordinances I think that we have a hard enough time keeping track of the

[1:12:04] ordinances that we have in place now but I think this is a very important one that U could solve a problem that I don't want to ever go through what we went through the last six months on that thing again and I certainly agree with the conditional use because we need to protect our neighborhoods we need to protect our citizens and this this gives us a tool to do so do I have further comment from Council before open up to public discussion open it up to public comment anyone wishes to comment on this you're Jim Turner aren't you uh last I checked I think that's what it still says on my underwear uh but yes I am Jim Turner and I have a lot of concerns with this some of which has been brought up by other Council by the council members like M gr staff and so on I was on the zoning board still am and there were so many different issues with the facility that was proposed and this really is only targeting one of them this would not have prevented uses that were inappropriate for that area but didn't have one element it doesn't address traffic issues it doesn't address TCEQ in general issues it doesn't address a lot of the things that came out and were presented that in themselves probably wouldn't have prevented a facility completely inappropriate from Hill Street from actually operating there this ordinance is targeted way too narrowly on last year's problem the second problem is it is not targeted out a lot of the other issues that came up with that Hill Street

[1:14:09] facility that would have still made it a bad facility there but it would be going today and we're just one breakthrough away from having this same problem come up with different material in a different part of town or maybe even in the same facility because this is targeted way too narrowly way too specifically and it doesn't really fundamentally address how we limit the nuisances and the adverse impact of one use to another and until you actually do that this this is at best to stock Gap and it's not going to prevent the zoning board from having to deal with a similar issue in by possibly the not too distant future we can't predict that when this zoning was originally done when zoning in general that of the type that we're using was initiated a lot of these these New Uses couldn't even been anticipated SC they weren't even science fiction yet and we're in a world that changes processes Industries businesses how we do things dramatically we have no idea what's going to be the impact of Texas because of the space industry but that's starting to grow if you take a look at some of the other cities in our region and that is going to impact where businesses that could come here should be located within the city and this doesn't help us with that at all and quite frankly I'd rather that the zoning board didn't have to deal with stuff like this again uh we put in an awful lot of work to make up for the fact that

[1:16:13] the zoning ordinance the way it is right now and the way it's understood doesn't really do a lot of what people expect it to do and until you attack that problem this is just a Band-Aid on a very large wound thank you thank you Jim Marshall thank you hello I'm Marshall Hing uh spoke to the Planning Commission said let's not put the conditional use on it understand why it's there understand the uh retaliatory wording from the last event that occurred um my only plea is don't put this off don't delay it don't try to reward it and rework it um if you're going to do it do it if not don't do it um from the developers side the guy who's going to looking at putting in the next sand facility a delay is is bad you know uh we don't want it put off um again do it or not do it to Elizabeth or some point we talking about the the conditional use the uh noise and the lighting it's got to meet City nuisance issues you won't know that till it's built it won't after it's built it might have be a problem but it'll already have the permit so I don't know that that is an aspect of it a lot of these facilities are not going to have control of know where all the trucks are going to go we can give you Ingress and egress and the property but as far as controlling the trucks that doesn't happen but you know working with the city staff working with the Planning Commission and the city council it's it's been reasonable uh and I think the uh conditional although it's again retaliatory um it's workable just don't put it off don't anything

[1:20:20] and a lot of that nuisance then is the build up of trucks or the movement of trucks on a site and if it's on a kichi site that can be again very difficult for neighboring activity so I think the paving that you've said in the truck route is is very important in again mitigating the the nuisance that arises from this so those are the kind of things that I think we need to put in an in an ordinance or specifically call for I just don't want this to be as targeting as perhaps it is and then us missed the opportunity for industrial growth in our community Mayor Don one of the things number one I I've been where you stand don't take this personal uh you know the the uh the way that I look at this is the pendulum went from left to right it needs to stop in the middle um much of this that's in here I agree with I just uh like Elizabeth said I don't want to Target anything like this uh there needs to be specific regulations I guess so to speak on on specific items and whenever you are doing the the broad overview of our of our new plan I think much of this needs to be included in it Chief I definitely want to make sure we get direction is U one of the items that was discussed with the conditional use it's it sounds to me like as far as moving forward and amending this ordinance we're looking at specifically um disallowing or not are not really looking at conditional use as a as an option for us is that correct I just want to make sure that would be my recommendation but I completely understand what Patrick and Rebecca are dealing with it's very easy to write a comprehensive plan or do a comprehensive Plan update and and get approval but when you start looking at a zoning

[1:22:23] ordinance where you are specifically talking about specific Parcels of land that's where the rubber meets the road and that's what this community has avoided for many many years because it's a very uncomfortable and difficult task but that's where the true protection is and we have um we have inherited a an accumulation of all sorts of uses that are neighboring one another that are not necessarily compa compatible so going forward they're going to need a lot of help in us working through that issue and uh it's it is it's that's where to me the really the real tough issues are and so ma'am what we are doing as part of our comprehensive look at both the comprehensive plan and the zoning ordinance as part of what I talked about earlier um we will be looking at the heavier uses currently permitted within the city and amending the zoning ordinance and the comprehensive plan to address those uses but what is crucial is following that text Amendment if and when it's approved by city council is for city council ultimately to um work with staff to do um administrative rezonings of sites which have been um given these zoning designations um perhaps in some cases inappropriately um whether they be heavy manufacturing or light manufacturing when in fact the comprehensive plan designates them as commercial as it was the case for the Hill Street property um and so that La Second Step as you know speaking for me personally as as a planner as an urban planner um is the most crucial step because we can write all the text amendments that we like but until the zoning designations are consistent with the actual future Lan use designations and more appropriately and more importantly the existing uses that surround these sites um there will never be a true um change or fix for these situations which have been zoned inappropriately so that being the case there is an opportunity before you today um to still be able to approve the text

[1:24:25] Amendment and the reason why I've worded it and I've created the slide this way is that that third bullet where the C the specific use standards is being proposed your motion can include everything except for the conditional use and the specific use standards associated with that conditional use so you may still approve the text Amendment which has the definitions which has the oper which has the exceptions and the accessory uses and the characteristics um it will not have the general and operational standards if you wish to move those General and operational standards you can still keep them under specific use standards and only get rid of essentially so I'm going to boil this down for you those last two bullets at the end of the slide which says conditional use application procedures and conditional use application requirements you can do away with those two that is the conditional use requirement altogether keep the general and operational standards if you all agree with them and approve the text as it's been written minus the conditional use application procedures and the conditional use application requirements which are contingent on conditional use approval I would be happy to make a motion to that effect because I also think at some point when when they get further into looking at the the heaviest uses there can be a consistency of how you approach heavy industrial heavy manufacturing and this not perhaps look unique amongst the various uses Absolutely I'll second okay okay we have further com Council comment on this so what we're doing is taking it as written except we're taking out conditional use application procedures and conditional use application requirements taking out those two phrases and not making a conditional use required for the approval of this category comment from the public we call for the vote all in favor of this ordinance as stated except taking out conditional use application procedures conditional use application requirements please say I I

[1:26:28] I oppose nay nay I think I'm on to Nay it as well I think we need those conditional use so we've got a 52 vote to accept it that give you what you need ma'am yes sir yes sir all right uh and let me show you the second reading will have the amended wording in it for your review very good very well number 13's consideration of authorizing the chief of police or is designate to negotiate a contract with with a sold B in response to RF CSP PD 0214 t4c cross country for the construction of a boat housee lift to be located at 2022 ctail Lane Lake nasworthy to be used storing Police Department boats and authorize the expenditure of $1,327 18 for professional architect and our Engineering Services Chief Fant you have the floor sir all right thank you very much uh first of all I'd like to apologize for the lengthy delay in getting this back to you it's been almost a year since we came to you the first time on the boat house I was going to say it's it's been keeping us he he's been keeping notes on this rney kep it alive I think he has um unfortunately we had a few unexpected delays we initially believe that the um the uh build drawings that were presented or uh given to us by the uh nasworthy homeowners association could be utilized with a little bit of minor tweaking and things like that to meet city codes and city ordinances and Etc uh unfortunately as we got deeper into it and we started looking at um the state laws and things like that um we found that we needed a few more things to in order to meet the the the requirements of state laws regardless even though it's it's it's it's a very simple structure um essentially a tin barn with an electric boat lift in it um it is a uh it's still considered a a public facility so therefore it has to fall under those same guidelines engineering studies Etc so those took a considerable amount of time and that's that's where the estimated cost for the architectural engineering Services comes from um what we did we finally got the um the RFP put out um based on those

[1:28:33] requirements um we sent it to 21 contractors that was a question earlier how many we sent it to we sent it to 21 contractors um only one elected to um participate in the bidding process and hence we came back with a a uh a cost that was significant ly higher than what we had originally anticipated we were originally anticipating somewhere in a neighborhood of 70 to $80,000 for this project um it it come in almost double that or approximately double that as you can see um so basically what we're here to do today is first of all what we would like to do is um is we would like the um the authority to go in there and try to negotiate a little bit better deal um so that we can stay within um I've talked with the uh um Michael DNE and and Tina vanell um over in finance about the a availability of um nasworthy investment funds um that were available for this and theyve given me an amount that we must stay under you know and that's that's there there's really not any other choice in the matter is that's all the money we have um for this project so we would like to be able to go in and negotiate that and and authorize the use of those nasworthy trust funds by Council to to to continue this project Rodney you've been carrying the ball on this thank you Jeff for working also on this very hard I know it's taking a long time this this is a very very important project to me and I think actually to the citizens of the city because of how vital this is most people don't understand is that our police force does not have a presence on the lake they have to actually go out to the airport get a boat load up the trailer go and drop it in if we had an emergency out there or somebody was drowning or something like that it's a long process and this was this is why this project came to me early on and and why I think it's so so important on this the cost I know has gotten high but now you know when I look at a 500t concession stand down on the river that cost 500 something dollars a square foot I look

[1:30:36] at this project built over the water I'm thinking well this is a lot better deal than we're getting on the concession stand so I think this is a very big deal I know that when we first started out on the plans we had it was totally different than what the plans are now and I see you know and I age with the plan changes that we have to have to do out there because this is different this is like having a police station over water and it's got to be secure it's got to have a lot of extra thing this is not a boat dock or even you know if I compare it to the concession stand it's not the same yeah it's not the same thing might lose support this this is so important and has has uh equipment that are that's inside of this building that you know we don't want to lose and that's why it's gonna be that's why it's so so expensive on there I I I definitely want this to move forward I hope that we vote to have it move forward what is the price that we have to get it under um I believe that the uh the total amount available is is about $155,000 but I think Tina has got some exact numbers on those it's a one $155,200 is what's left of those funds and how much are how much is the total on this right now it's more than that right now um it depends on what we add we did it in a line item the uh Base building was was $37,000 um and then there's an exterior walkway pullup dock so that the guys could get in and out quickly rather than having to dock their boats inside um that we would like to add and that was another $119,000 so um plus the architectural fees that we going to be on top of that um so we're we're looking at $160 $170,000 uh overall that's why I want to be able to go in there and line item a few items out and maybe we can work on a few things there and Shay you're talking with Shay right on this yes sir uh we just need to sit down with Shay and see what we can do on this and I bet he I bet he can help us out a little bit on this I think that's exactly what we're we're going to be able to do um um Gary Donson the architect that we've been visiting with on this deal he he

[1:32:39] provided the estimate of his charges of what what they will be um he he said look I'd be more than happy to sit down with you and t4c and we'll discuss things that can be changed things that can be simplified um to where we can get this down to a price that's more reasonable for us is there something that we could also push to next year and possibly use some of the funds for next year it's going to be about eight months before he can get started on it anyway even if we signed a contract today so I I don't know kind of depends on the economy and how much his business grows over the year okay that's all I have short what percentage chief of the monies that you've got do you have set aside for the future maintenance of this boat doc I think we can easily absorbed that into our regular budget there should be minimal maintenance required for that I don't want to easily I want to know what percentage of money that we're going to set aside for maintenance things get broken or people run into our dock you know and that it's got to be fixed and I also would like to see us go for the fundraisers or whatever needs to be done that go strictly into the maintenance of the little police station on the water I don't have that number for a but I can certainly get it for you that's a good we can work on a way to do that Tina that any monies that go in and line items specified for the maintenance of that percentage of the boat races that come each year that goes to maintain the police station well I think that would be a bigger question for Council to consider but it's certainly something we could do Council we have to consider M maintaining those buildings we have to yeah we do we're throwing money away if we don't but you have to have the building mhm but we're throwing it away if we right now we pay for a we pay for a rental space out at the airport right now which we'll do away with the rental space correct we we actually have we we rent two uh enclosed boat stalls um actually in different locations cuz we couldn't get them at the same location um their their public boat facilities um they're less than optimally secure for

[1:34:44] we've got $50 $60,000 in each boat that are sitting in a a stall that we've actually had some stuff stolen off of them you know $5,000 uh um side sonar um is sitting on that boat luckily those people didn't steal that they stole some rope um so you know we're we need him in a more secure facility and and maintenance wise um I look for every dollar that I can save um in maintenance for all of our buildings and grounds um I think I can absorb that with really no additional cost to the city I mean as far as what we've got but you instead of filling the boot but fill the W donations I would certainly love to have you know more influx of money I'm always wanting more money that's just that's just the nature of the Beast I think Police Department Challenge fire department to a canoe race or you know entry fees Marty um I I think you can start with the uh whatever you're paying for the rent of those two you can put in the maintenance put in for the yeah for maintenance um where did the money actually come from I know it's a trust fund but where where did those dollars come from it did come uh from the lake nasworthy trust fund back in 2009 there was about $873,000 transferred over to the water Fund in 260 um and so we've been slowly working through using the remainder of those monies I think at that point those were earnings right yes invest investment income I'm sorry yes investment earnings that uh there's a portion that we can move over from the trust fund to use for capital or other items that Council sees fit okay I I received a phone call last night are do do is t4c going to fall under uh way scale determination they will okay cuz it was in the it was in The Proposal but it wasn't in the

[1:36:46] specifications I think is what I was told but Roger they will fall under the can you explain that to us Davis bacon I never heard of it yeah can you explain that to I'm not sure what you're talking about well it it it sets the basically wage scale determination sets what the minimum wage is for different trades and what they have to be paid okay uh and and those get relatively high that they're they're done on survey so that they get Sometimes some trades can get relatively High and but they we need to make sure that is negotiated out oh you don't want it to go below for them what funding source in this requires that n that's why I was asking where the dollars came from for sure yeah the uh wage and benefits which was what you're refering to the Davis Bing are applicable to City projects and those are required by state law so okay we don't that's not something we can negotiate on okay okay very good okay what Johnny can I yeah say something on what he was saying out of that Lake nosworthy fun what a lot of people don't realize and Tina has kind of educated me on this in the last year is we can only pull out so much money per year out of that fund for our projects and it's is it 10% Tina off the interest 90% of the interest % of the interest supped toay I know it's a 90 I I want to let me make sure before I say I have the charter here 90% of the I believe it's 90% of the interest but I just wanted to Michael's saying that's correct to from the previous year for for each year for each year yeah but in 2009 I think it hadn't been moved in quite some time and so that's why there was such a big so it built up amount yes okay so the general public doesn't understand a lot of that how that's we're just using interest money we're not taking off the that's right you're correct council member okay

[1:38:50] I'd like the princip must remain unless I think it has to go to a voter right Johnny this will be for just a police use only this boat house so heaven forbid a boat runs into that boat house it's going to be a police boat is that correct that would be would be correct if it was a private boat then the private owner would have to pay for any maintenance of or repair of that boat house so you catch them right right so if boat runs into it it would have to be Tim behind the wheel or somebody with that would be correct more than likely it would be one of our own boats damaging our own property there um but that that's not to say that you know you couldn't have a have a reckless boat driver out there that actually hit our our dock part of one of the plans in here is also is to have this thing alarmed um and monitored of and I know that there's monitoring available as far as being able to catch them perhaps we you know we might even consider you know um video alarm systems um that way that our Dispatch Center could actually kind of keep an eye on it like they do some of the other facilities that we have most of our other facilities actually have uh video cameras and things like that monitoring the SES so this may not be something that would be out of the ordinary for us to add that added level of protection as far as knowing what's going on there at all times do you want to allow them to authorize to negotiate Rodney yes I I move for approval second okay I do have a motion to allow them to negotiate I do have a second any further comment from Council before I move on I have to go back to something tangential yes I'm not sure why we're mentioning Davis bacon if it's not federal funds is there some new law that requires this we just use their rates for for City projects we don't have our own rates our uh labor rates and benefits it would require us to do our own labor studies and uh since I've been in purchasing we've always used their rates for All City projects um it's not you're

[1:40:54] right it's not federal funds uh but the state says you either do your own survey or you use theirs and so we've traditionally used theirs so I think as the other end was alluding to when we ask you or David nap why projects are expensive more expensive than we believe they should be yes ma'am I mean that's that is one that's one of the fact contributing factor I I think it's very admirable of us as a city I didn't realize that was our policy but it does it certainly impacts the bottom line so thank you for the clarification I didn't know that just as an example uh electrician rates this year were like up 30% over what they were last year matter of fact they are but they're still lower than what we're paying on our individual contracts for our own building uh facilities so but they do increase based upon as Mr self said based upon their Serv surveys and studies okay is is this an ordinance or is this a state it's state okay so it's a state law that we're we don't have to if we had the staff I would think to gohe and do our own uh labor studies and benefits we could use our own for non-federal projects and non-state projects but we don't so we use and relap on the Davis bacon which is our option by state law I'll be glad to send that to you if you're interested okay do I have public comment on this item mayor yes I believe Tina needs specific wording yes I do before we vote on it um we need to say that we're going to use the late nasworthy fund trust proceeds in the motion and also if you'd like interest yeah yes that is the proceeds proed the interest is the proceeds correct um and then if you would like to include an amount not to exceed which would be that 15500 will you amend your motion Rodney as stated second John yes okay and then I'm sorry I just want to make sure we

[1:45:00] authorization uh to incur architect or Engineering Services in the sum of not to exceed 12,327 which is part of the 55,000 correct okay you got that Rod as stated okay you you got that John yes and we and we didn't and Jeff didn't pick the homeowner association came to us with this this drawing and they had the architect and that's why but it is under the cap of what we'd have to go out and get another one for so that's correct you satisfied Dan yes you satisfied Tina yes sir I've had public comment we've had Council comment I'm going to call for the vote all in favor of the amended motion please say I I oppose n thank you very much Je thank you all right number 14 is the first public hearing introduction of an ordinance amending the 214 215 budget for new projects incomplete projects and grants Miss Che W you are own ma'am good morning I've got a a quick housekeeping item here for y'all I'm just going to hit the high points on the additional information in your background I'll go item by item but certainly uh grab me with any questions the first item before you is traffic operations equipment repair a revenue of $40,000 and expense of $440,000 this is for reimbursement reimbursed expenses subreg insurance claims when we have our own equipment um injured or damaged and we have to to to replace that so that's just a housekeeping item the next item is H keeping the warmth Grant through atmas Grant and so this is an additional amount above what we had originally planned of $756 in revenue and expense the next item is West Texas water partnership reimbursement this is just a change in our accounting process that we traditionally get those reimbursements uh for any expenditures related to that program uh from the

[1:47:02] Development Corporation uh type B sales tax into the uh water Capital fund so we just need a budget for that revenue and budget for that expense it's Revenue neutral to the fund the next item is a public health emergency preparedness program Grant uh the the the fep the fep grant is 12,3 $45 uh with a local match of $1,234 for a total uh program expense of $3,579 but then you also have that expense in the general fund of $1,200 so uh the general fund will contribute the local match for that program and the last item there before you is an additional Grant from the Texas Healthy Communities Grant uh for health supplies that's a variety of things from six bike racks for trails and also 12 lead ECGs for one of the ambulances for a total of uh $ 22,37 somebody help me out here motion to approve second do have a motion to approve is presented with a second Council comments Rodney how many bik racks was that six six yeah anybody else do I have comments from the public all in favor please say I I oppose Nay put a 70 on that one Brian uh item number 15 is discussion of a 215 through 220 Capital Improvement plan preparation Miss Morgan wanted to give you an update on as we're uh making progress on the capital Improvement plan to let you know where we are in our on our calendar we started uh preparation with project managers uh back in January um have had the the committee convene to rank those projects as required by Charter uh we also uh proceeded with uh public forums which I'll talk a little bit about certainly you have the formal minutes in your background but wanted to let you know the the results of those uh the public forums were February 19th at the convention center here in this room and uh a second one at February 23rd at Lincoln Middle School

[1:49:05] uh the meetings were promoted with a variety of of media Outlets we had a a ground swell of support from Radio TV print uh media had a lot of uh cover and exposure that way um certainly Facebook was a huge um as Anthony likes to say we're a Facebook we had a huge influx of support uh as people routed through that way um and to give you really uh quickly St the public for the first public forum here at the convention center had um I would say poor attendance for in the past but I do have some more information on that that uh we tried to mitigate um that and still get citizen input we had five citizens attend and certainly you can see uh the the projects that they spoke uh in favor of and in support of and um then the second public Forum at Lincoln middle school we were fighting the weather we had a skeleton crew of staff and we expected that that one would be um probably poorly attended as well that was a bad weather day and so um we had those occur however the CIP online submissions are still pouring in we've had a huge um support um Mr sylvus last year you asked me how many people filled out the online form I believe it was six when I spoke to at this time last year uh at this point we're approaching over a hundred as of um background that was submitted to the council we had uh 91 citizens that had spoke um in behalf uh through the online form and so we're definitely seeing that that Outreach that if there is an easier process than coming to a public forum fighting the weather fighting you know evening other other obligations we certainly are seeing folks take advantage of that and so uh we're going to have uh additional information out there uh for the additional items that are coming in um all of this information has been shared uh with staff because certainly there's lots of information on each of those forms that came in um I believe Mr Kelton was the the winner in the popularity contest almost everyone related to some of his projects excuse me so uh I did have several individuals and uh one special interest group contact my office uh specifically by phone and by coming by and so we routed them through the online

[1:51:07] submission so that that information could come to you as well and so we're we are seeing more support we just didn't see it at the public forum so I I just wanted to point that out Morgan question yes sir so even of these public comments that are being you know the the 91 not the 91 but the ones that are being on submitted online are they still ongoing or do yes that's going to be live it's going to be open we're just going to leave that open year round cuz certainly we have um uh that desire to hear back from our citizens um as we were doing the the pushes um on Facebook and through local media we were getting tons I mean we would come in on Monday morning and have 30 40 and 50 submissions and so um we we expect to leave that open and have that opportunity to Route folks through that and so we can be continuously gathering this information because um it's it's always good and valid information to have um I do have each I just wanted to hit the high point certainly you know streets is we heard a ground swell of support for as well water police station uh Dog Park animal shelter adoption center Park improvements those are projects that we had the most response with the rest of the information is in your background um listed here we had a few uh in support of each of these projects and with that I have each of the projects listed but you you have a draft of the the CIP and in your background and so unless it's the council's pleasure we can skip ahead to upcoming events on the calendar which would be the next meeting we would talk about a continued discussion of the the capital Improvement plan and adoption by resolution um we are required by the city Charter to bring that to you 5 months before the budget is considered and so we're well within that time timeline uh by the March 17th deadline we do have a couple of projects that came out of this dialogue with with citizens and so we're going to add those projects uh to your to the proposed plan uh for your March 17th uh consideration and that's all I have for you and this was just presentation this

[1:57:15] agendas uh I understand that there is going to be a special meeting on 311 what is your time on that 9:00 at this location is that what is that what yall won't because I will not be here this is the item I've recused myself on yes yeah okay 3:11 9:00 right here special meeting for consideration okay uh the 317 meeting some of us can be here some of us may not do we want to continue the 317 meeting as scheduled or do we want to postpone it or put it off I'm in favor of staying with it but what do you Elizabeth what do you think well mayor being the mother of two teenagers who have an expectation that they will get to do something special and potentially away from this lovely Hometown um I would be in favor of of moving the meeting date to accommodate spring break but want to do what the what the will of is of the council is okay we got one no what you say Don I can go any doesn't matter I do either one I can do either one you'll be here there's four Marty I can do either way you can do either way Rodney I'm not going to be here okay that's 5 to two let's have the meeting on the 17th if we've got five members and we can still have a have a quorum we can still have the meeting and we don't have to repost all the planning things okay next meeting as scheduled 317 okay Elizabeth I'll start with you for consideration to Future agenda items or announcements uh I'm going to I will have a neighborhood chat in March but with spring break I haven't set the date yet but I would imagine that we'll do that and I'll have it in advance of the March 17th meeting so that we can talk a little bit about CIP and that is open to uh residents of single member district 5 as well as friends of single member district 5 and I would say that probably half of my attendees are from other districts also um you may know that Chief Vasquez and I uh along with

[1:59:21] Garland free spoke at an event last week sponsored by uh the WT at St Mark Presbyterian St no it was a very cold night but it was very interesting and it was um kind of centered around race relations in our community and how far we believe we've come but also a reminder that there's still much left to do here and so so um it was it was actually fun to uh sit with the chief and kind of talk about some of the disagreements we had had over time and how uh We've progressed and how the community has progressed as a result of maybe groups that had not always been aligned aligning and and accomplishing something so I would imagine that the WT will want to have uh more of that but it was a it was a very positive very positive meeting and unfortunately didn't have more attendees but as I said it was again one of those weather nights other than that I think I've let staff know what I'm interested in in the future Don nothing Charlotte yes so once again I'm going to bring up trash from behind the lows the Walmart store all the way along the loop till you get to McDonald's it is bad real bad and I would like some attention and getting that cleaned up you know the March winds are here and some of them are just really caught in branches and stuff but it is unsightly that said as I said earlier I'm starting hopefully it'll be a quarterly let's talk and I do know the first meeting is going to be in April don't have the exact date but I believe it will be at TLC the plan topics that I plan to talk about is uh things in district 6 the roads the streets and any development that I'm allowed to talk about uh just to be able to answer constituents questions of what's going

[2:01:23] on and where we're going and possibly um what we plan with reference to streets and some work I hope to have some finalized reports and information and am going to invite the mayor if he's brave enough to come again but I'd love to have him there and uh anyone running for mayor but city manager as well and we'll try to plan it but it will be an early meeting it will be 6:00 o and uh few staff people if I may and that's what in the morning Charlotte or is that just make I don't do mornings no okay you want me at 6:00 in the morning I better not have gone to bed the night before funny Daniel six in the evening but I do plan to have a town hall meeting called let's talk and it is for folks in my district but that's a lot of shopping so naturally um if you shop in the area and you don't live in the district you're more than welcome to come and listen to what we have to talk about and I would like to ask U our streets and Bridge folks to be on hand and the planning to be on hand that it that's it Johnny just a a reminder that I did ask for an update on the Avenue P and I think and I assume is going to be on the next it will be on the next agenda yes sir that's that's all I have Marty uh I was really glad to see that uh we're going to have our zoning ordinances done our new ones done by the end of the year we're shooting for um and then the U we have a meeting scheduled here Thursday uh it's 6 o' right I believe yeah yeah um for single member district 2 for the uh proposed apartment complex so invite everyone out that mayor that's all yes ma'am well since he said that after this round
