[0:00:00] good morning it is 9:02 and time to get this meeting on the way is everybody on my right wing ready to begin yes sir how about my left wing y'all ready to go sir let's get this started Mr Josh Romo not ninth in Main Street Church of Christ would you come for dur invocation please sir good morning sir microphone is yours would you pray with me most high holy Heavenly Father Lord we are so thankful for this day that thou has blessed us with Lord we're so thankful for uh the opportunity to be able to gather this morning Lord we pray for uh the leaders of our our great City father we pray that uh th will grant them wisdom father in in the decisions that they make and father we pray that they will listen with a tent of ears to the things that will be presented this morning uh that the right decisions may be made father Lord we we are so thankful for uh all that you have blessed us with to uh to Father be able to um make decisions such as these to be able to come together and father to uh be able to approach thy throne in prayer and knowing father that our prayers will be heard and and that father you will continue to look over us and and father we pray that we may always look to you and to your word for guidance and for strength and that we may be governed by by what you have given us father in all that we do it's in your son's holy name we pray amen amen amen thank you Josh and if Mr Jonathan Thompson would step to the front Jonathan is the fifth grade at for kjo and he will be assisting Us in the pledge today you

[0:02:02] ready to go buddy let's go to the flag of the United States of America and to the Republic for which it stands one nation under God indivisible with liberty and justice for all honor the Texas flag I pledge allegiance to the Texas St under God one and indivisible thank [Applause] you I love it when they stand up and speak up good job son I thank you very much and now we have some proclamations and these are very important proclamations and first I'm going to ask uh Mr Jose suire to come forward Jose is the ethon plant manager and I want to read this beautiful plaque that we that will be placed at the Eton let me read this on July the 18th 2014 the eacon S Angelo plant will celebrate its 50th anniversary and this company has been of great benefit and advancement to the medical community across the United States and locally the plant has been of tremendous impact to the S Angelo and to the Tom Green County communities and that impact has felt not only by way of Economics but also through Community involvement and participation of the many employees of ethicon Angelo and today we gather at this celebration to make public our appreciation and continued support for the ethon S Angelo plant now therefore let it be proclaimed that I Dwayne Morrison mayor of the city of St Angelo Texas on behalf of the city council do officially declare the 18th of July 2014 as ethon day and extend my best wishes on the 50th anniversary of the ethicon of St Angelo plant together we can work toward a brighter future for our great city thank you so much so glad say a few words

[0:04:06] sure first of all good morning City Council Members mayor and and fellow citizens ER I I feel very honored and privileged to be representing here and accepting this award on behalf of the over 500 employees that we currently have in the St Angelo facility and over the 4,000 employees that have worked at the San Angelo facility for the past 50 years as a J&J site ER we are Guided by one principle and that principle is our J&J creto and it focuses first on our employees ER on our customers on our employees and our community service ER obviously in which we live in and I do have to say that for the past year that I've been here in San Angelo H you could see that Pride the passion and commitment that each one of the San Angelo employees feel with their community so once again thank you I know this means a lot to all past and to all past and present H ethicon San Angelo employees thank you very much thank you very much let's get a picture with hold that thank you very much our next Proclamation will be for Americans with disability acts Awareness Day July 214 Mary poos the assistant center coordinated and do you have attendees that you can bring up come forward please good morning how are you now fine sir y' come over here so they can get a look at you hi good morning good morning good morning sir good morning let me read this proc clation on July the 26th 1990 President George H bush signed into law the Americans with Disabilities acts Ada to

[0:06:09] ensure the civil rights of people with disabilities establishing a clear and comprehensive National mandate for the elimination of discrimination against individuals disabilities and the Ada has expanded opportunities for Americans with Disabilities by reducing barriers and changing perceptions increasing full participation in community life however the full promise of the Ada will only be reached if public entities remain committed in their efforts to fully implement the Ada and on the 24th anniversary of the Americans with Disabilities acts we the city of Stan Angelo celebrate and recognize the progress that has been made by reaffirming the principles of equality and inclusion and recommitting our efforts to reach full ADA compliance now therefore I Dwayne Morrison the mayor of the city of St Angelo Texas on behalf of the city council to hereby reaffirm our commitment to work toward full Aba compl iance in the city of St Angelo and proclaimed July the 24th 2014 as Ada Awareness Day in St Angelo Texas and urge all citizens to support this committed effort thank you thank you ma'am would you like to make a speech well be you everyone like to say thank you and I would like to introduce my young staff that we've had the pleasure of working with through the summer we have Sarah Lewis Caitlyn ornellas Gab Gabriela Torres Anthony Jones and Sarah would actually would like to say a couple of words the Americans with Disabilities Act um guarantees equal opportunity for individuals with disabilities in employment public accommodations transportation state and local government services and Telecommunications disability connections is a Center for Independent Living providing aging and disability services that are designed directed and in most cases delivered by individuals with disabilities themselves but it's hard to find them jobs because people

[0:08:12] judge too quickly for example if people see someone in a wheelchair most just immediately assume that they are incapable of doing things people offer help without asking them if they need it but how do you think that makes them feel most people don't want to feel incapable they want to be able to do the things themselves and provide for themselves but most people think that just because a person has a disability it means that they can't do things as well as one person without one can but that's not true if people set their mind to it they can be just as successful as anyone else we should never judge a book by its cover don't discriminate and try to prevent Prejudice remember the words from the Declaration of Independence all men are created equal if that is true we need to treat men equally just because some disabil abilities are more noticeable than others does it mean that we should think any differently of one person with the disability the Americans with Disabilities Act helps people to be their best selves and live their best lives what do you want BR okay thank you very did you want a picture with this background Jose he'd asked for a picture so let's let's do another one with the background I'm sorry sir got this next Proclamation gives me a lot of Pride and Joy because I went out

[0:10:15] there last week and I watched the bandits our San Angelo Indoor Football League I watched them win and I'm going to tell you if you've not watched the Bandit game these guys this is a tough rough game this is not for sissies and we have got some tremendous athletes on our Bandit team and we won and we won big and uh if you guys will come forward I would like to read this Proclamation and we also have the trophy yes sir that the bandits won right here on the front for all to see these guys are these guys are tremendous they're excellent athletes I tell you about brown but Brown is my MVP that's the offensive lineman I watched him at the amarella game they gave him the ball and said SC when he got to that end zone maybe 5 minutes later he's not fast but when he got to the end zone every member on that amarella team was on his back I think there were three cheerleaders and maybe one of the opposing coaches and he marched right on through they're a tremendous ball team they're great they're fun to watch let me read this please the sanangelo bandits are a professional indoor football team based in San Angelo Texas and they were proud members of the Lone Star Football League and the sanangelo bandits have been active for only two seasons in their second season they are tied for first place and last season the bandits won only one game and this year they have eight great wins as predicted by coach Jay Brandon the San Angelo Bandits went from worst to First and the sanangelo bandits will be hosting the lsfl Texas Shootout the 2014 championship game against the New Mexico stars on July the 5th of 2014 now therefore I Dwayne Morrison mayor of the city of St Angela on behalf of the city council do hereby Proclaim July 5th 2014 is the S Angelo Bandits day in support of the hardworking s Angelo Bandits teams and all their strong dedicated fans thank you so much C now the picture sorry yeah here's the guys who did it this is for the city we

[0:16:30] who's our senior patrol leader Joshua Davenport Herpst who is our assistant patrol leader and Joshua Hill who just passed two boards of review at one time and is going to go two ranks up in the next couple of weeks so we are here working on citizenship in the community and just very delighted to be with you they've been learning the last two weeks about things like rfps and we've learned a little about that as well yes and so we're looking forward to hearing the discussion thank you very much thank you so much and congratulations gentlemen y'all hang in there good to meet each one of [Applause] you at this time I will now open the floor to anyone from the public that wishes to comment on anything that is not already on the agenda if there's something you need to speak about or talk about or have considered by councel this is your opportunity to come forward I'd ask you to come forward stay your name you do have three minutes come forward at this time I can't believe nobody wants to talk let go last opportunity going once twice so all right that ends our public comment section we will now go to the council and I will ask anyone on the council if there is anything that you want to state if there's anything you want to talk about is there any item on the consent that you wish to pull to the to the regular this is the opportunity I'll start with you miss grst I'd like to pull item eight off the consent agenda and I'd like to make a couple of comments on um other subjects uh first of all I'm hosting a neighborhood chat tonight um hopefully we'll get we'll get some rain it'll cool us off at 111 North Park it's uh Tim's Church St Paul Presbyterian we'll be on the site somewhere looking for shade and I invite all residents of the area to come out and just talk about what they want to see for the future of their city and how we're going to work together to

[0:18:33] accomplish that also I have a concern I have a constituent at 2200 Douglas Drive that has been complaining about a neighbor it's a code uh Code Enforcement issue and he has worked with staff um he's had uh staff onsite mayor I believe you've been to the location and um and I think to truthfully he has not um seen the uh remedy that he needs and he deserves but I don't think that's the fault of the city I think it's when it moves into the county court Arena and we need to see how we can work better with the county to dispose of issues uh that are very important to our citizens so I would just ask the city manager that we look into uh some sort of meeting um to address that problem I'm I'm sure it's it's other than just at Mr Harrison's address and the county has instituted some nuisance ordinances and they're they're using this tool so that might work on this so thank you Mr bman nothing Miss former well I have a question on item number one I didn't find the minutes to read to look at to approve so if they're not there need to pull this off the agenda if we may thank you could no minutes on one that all ma'am that everything silus Mr silus Mayor the only thing I have I do have a also a constituent who lives on hul street and I've shared it with Robert Martinez but just so the gentleman knows that I am bringing it up again uh there is a speeding problem from from about 14th all the way going back to the loop and according to Robert Martinez they're looking into it and just to let him know that the uh constituent know that we uh are addressing it and uh hope to stop that that action around that road thank you Mr s uh yes I'd like to pull item

[0:20:36] number two okay and and also probably against better judgment i' i' I'd like to make a comment myself uh um yesterday in one of our media sources there was an article about one of our councilman are um and uh I I just thought you know a year ago I was sitting in the same seat under different circumstance and and uh you know we when we run for this job we basically decide to put ourselves in glass houses and and uh we do so knowing that from any time from any from different times we we can be attacked but uh you know our character is one thing that that uh uh we have was there poor judgment possibly but when when a person's passionate about uh some of the boards they set on and and passionate about bettering the city uh you know before before you're attacked um uh before you attack somebody you you need to make sure of of exactly what's happening and and you know I uh to to support the boys and girls club and and and to try to really make them uh a better organization and through a fundraiser and and then be attacked I I thought it showed very poor taste uh and uh I know by making these comments uh and living in the glass house I may be next but but I I went through mine and and uh my My article was published without even trying to contact me till after the fact uh and and uh so uh gu guys y'all y'all may want to try to stay on this side like I said we we ask for it because we have a passion for the

[0:22:38] city uh we have a passion to better the city and and we love the city and and that's what we try to do and and are we always right no but uh we we try our hardest and and uh I think U um you know I just want to stand up for Johnny because I everything I've ever had to do with him has been has been very uh above board so I guess with that I'll shut up well let me say that I'm going to say Amen to every word you said so when they start shooting at you they can shoot at me as well and I personally am ashamed and appalled at one of the statements in the article yesterday and I think that there needs to be some public apologies for that but that ends that Miss warmer no I have a comment uh it's very difficult to serve on the council and uh um recuse yourself from everything that goes on in the city all of the various fundraisers and actions and uh things that are out there in the city that council members are invited to attend as a guest uh because they want a public official or a public Leader's presence in that capacity uh to criticize or not know the full facts of that attendance that you're V you're being there and your attendance maybe is paid for not paid for to be there but their appreciation in wanting you there it's difficult to say no oh I can't do that because it might make me look bad or I can't do that or it might make it look like I'm doing something illegal when really and truly you don't sometimes consider all of the work and the efforts put into by council members and I too am going to defend councilman silvas I know of the numerous uh activities and volunteer work that he does to assist groups in this town and it it's difficult to read uh things about yourself and others uh whenever all you're trying to do is promote and to help other

[0:24:40] organizations in town and that's all I'll say all right Don well I'd just like to also say I was in support of of Marty when he uh went through his his uh uh problems which wouldn't really a problem come to find out but I I'm behind Johnny 100% and and uh want to assure him that uh you know I think that that he's doing a great job on the council and a great job in the community thank you for your service all right let's move on okay the Senate consent agenda we will pull item number one because there were no minutes for us to read Marty has pulled item number two Elizabeth has pulled item item number eight so I will entertain a motion at this time to approve agenda items consent agenda items 3 4 5 6 7 nine and 10 move to approve I'll second that I do have a motion to accept these items I do have a mo I do have a second do I have any further Council comment on these items do I have public comment on the items that uh we're about to vote on I'll call for the vote all of those in favor please say I I any oppose nay drop a 60 on that one please ma'am item number two this is pulled by Marty this is consideration of authorization for the city manager to execute change order number five and all related documents between the city of St Angelo and timilon construction LP AP 0411 associated with the terminal building Renovations project in the amount of 273 throughout $273,700 at the S Angelo Regional Airport Mr s uh I just u based on what transpired you're go I I I just need to recuse myself of this okay sir come back when we call

[0:26:44] you do not if we don't call do not leave the building Lou would you like to start on this sir and kind of give an overview of what it is I think everyone is aware of it but just kind of an idea of what we're doing good morning Council and uh mayor this is change order number five to the renovation of the terminal project that involves several things uh there are federal approved items and those are being sponsored or paid by the FAA and there are some non-federal items which should be paid by the city by the airport I'll be happy to answer any questions I'd like to just make one comment and these are Airport inovations which have been going on for several years yes sir and there's been some problems yes sir and I have talked with you and I have also spoken with temple to construction and I have come to the conclusion that some of the problems we're having belong to us you and some of the problems belong to Templeton construction I don't think there's I don't think there's any Perfection on either side correct I would ask you Lou as a friend just like I asked Mr McClure as a friend you boys get together work on this shake hands start over and let's make this deal work uh you're angry with them and he's angry with us and we're not getting anywhere so I'm asking you as a personal friend y'all get together start over and let's make this deal work fair enough sir we'll do sir thank you I will ask for a motion on this anyone wish to make it motion to approve second I do have a motion to approve I do have a second do I have further Council discussion on this item do I have public comment the motion has been made that we accept change order number five between Temple construction and the S Angelo airport for renovations it has been seconded all in favor please say I I any oppose Nay put a 5 on that one please ma'am come back [Applause]

[0:28:49] Marty there I heard I heard a car engine start up out there I thought you were gone we now will work with number eight this is the item that Elizabeth has pulled you realize this is about 10 minutes of reading for me don't you I I it wouldn't hurt my feelings if you didn't read it it's Neary then here we go second hearing consideration of adopting an ordinance uh an ordinance regarding appendix a utility related fees an ordinance amending appendix a fee schedule article 800 utility related fees of the code of ordinance city of St Angelo Texas amending section 81500 charge for collection of garbage and trash more particularly to amend section 8.15 A1 residents service charges by deleting in its entirety the fee scheduled there there under entitled resident service charges adopted September 27th 2012 and replacing said fee schedule with a new fee schedule and table entitled residential service charges said new fee schedu sched and table to be effective on the effective date here in to amend section 815 0082 automatic fuel adjustments by deleting in its entirety the fee scheduled there under entitled automatic fuel adjust is adopted on March 2106 and December 506 to amend section 81 1583 other charges by deleting its entirety said Section 8 1 1583 and thereby deleting in their entirety the fee schedules there under entitled a inspection charge reports b sir City Landfill surcharge fee and C State landfill surcharge fee adopted March 2126 26 and December 5 206 to amend section 81500 B2 commercial service charges by deleting and its entirety the fee scheduled there under entitled commercial service charges and by leeting and under entirety the tables there under entitled 2012 commercial

[0:30:53] rates affected November 1 2012 and 2013 commercial rates effective October 1 2013 adopted September 27 20112 and to further amend section 81500 B2 by replacing said fee schedule and tables with a new fee schedule entitled non-residential service charges and new tables entitled non-residential collection trash non-residential container movement fee rolloff Collections and deliquent account fees and amended section 8.15 B2 and new fee schedule and labels added thereunder to be effective on the effective date therein to amend section 81500 B3 other charges by deleting in their entirety the fee schedules there under entitled a inspection charges reports B City Landfill surcharge fee and C State landfill sarch charge fee and by deleting in its entirety the table there under entitled diesel fuel adjustment fee adopted March 21 2006 and December 5 2006 and to further section 8.15 by adding a new section 8.15 c there under entitle residential and non-residential diesel fuel search charges and by adding a new fee schedule and table under said new section 8.15 c entitled residential and non-residential diesel fuel s charges set amended section 8.15 c new fee schedule and table thereunder to be effective on the effective dates herein to amend section 8.17 Landfield charges adopted October 6 1998 and December 5 2006 and September 27 to 12 by deleting said section 8.17 in its entirety and thereby deleting all Fe schedules and tables thereunder and further to adopt a new section 8.17 entitled landfill charges and thereby adopting new fee schedules and tables under said new section

[0:32:56] 8.17 entitled Landfield tipping fees Tire tipping fees other tipping fees and host fees for other tipping fees to be effective on the effective date herein provided for severe ability and providing for an effective date Miss grinstaff would you like to take a break now mayor I need to drink water um I I think many of you know that I voted against an award of contract at our last regular council meeting and that was because I was concerned about the business Community being reimbursed appropriately for the the overcharge on the recovery fee uh since then that has made me I think a lightning rod for criticism of this contract award and I recognize that people might be talking more to me than to the rest of you but I think a a resounding concern is if we know we're not going to have all services particularly with regard to some of the recycling services that uh were mentioned in the proposal they don't understand why the fee begins at at a higher rate before all the services are available to them um they also recognize that this is uh the only leverage that we have now in order to make good on the repayments which I understand even though I have not seen a letter to any of the businesses I have been contacted by business owners that says that they have been promised by Republic to be repaid but not with any sort of interest that uh that they might have expected so so uh be I those are my questions and comments on that item do I have further Council comment on this I have received two phone calls from the commercial customers who have received their letter they're pleased with the way the letter was written and what it stated and they were very comfortable with it they just wanted to let me know that they did get a letter further comment I'll open it up to public comment I'm going to limit you to three minutes introduce yourself Harry and you got three minutes sir Harry Thomas

[0:34:59] Community volunteer but I'm also president of the local Boys and Girls Club and I will also say thanks to Johnny Silas for taking the lead on putting together the the the golf tournament that we had back on May 31st uh without his leadership and some of the other leaders in the community we would not have had a successful event that will be the groundwork for future golf tournaments that we have so I appreciate all the work that Johnny has done but I will have to say this and I said it at the last council meeting I want this Council to consider putting a six-month extending the contract for republic for six months until we get all of this information out to the public so that they understand what's going on and for Republic to have the opportunity to get the third party auditor results out to the public so that they understand where that is uh as somebody that's on fixed income I will tell you that I'm a little concerned when we look at the automatic 2.5 2.9% increases every year over a 10 year period of time that's 99 that's 29% already on top of an increase and I know that we're going to recycling and I think that's a great deal but I'm going to tell you it's going to take a few months for people in West Texas to understand Recycling and what we do because we' all been used to dumping all the trash in one basket and taking it so thank you for your consideration thank you Harry you know the drill sir yes sir you got three minutes mayor city manager staff my name is Jerry C and um I too agree that we should go six months before we uh sign an indefinite contract it seems like to me that that contract could go forever but uh I've had people ask me a lot of questions uh first of all first question why are you going to reduce the the pickups to one pickup a

[0:37:03] one pickup a week and uh uh and the rates going up I you know this I'm not getting into any particulars with nobody you know uh that's your job and I'm not going to comment on it one way or the other other than the city's handling the contract but I do agree that it should be a six-month contract so uh giving them an opportunity to pay the pay the citizens back that they that uh uh that they owe and a caution and a lot of people that talked to me about this what about our local vendors or those that's handling uh hazardous material and stuff like that are they going to lose their job cuz it's a multi-billion dollar company and they could take over uh uh fance that guy last what was it last uh council meeting he'd only been in business about about a year and he was worried about being put out by this larger group that's coming in that's taking over some of the the uh business that he was uh originally got his license for so this is a very important issue and uh I wish you guys I I compliment you on uh most of what you do but uh please think about this because see the little people are hurting because I comments like they're wasting garbage all over my front yard and stuff like the winds blowing garbage everywhere and those guys don't come back and they don't pick it up and they turn the cans upside down in the street and bang them and when they do it leaves a print of uh garbage that's stuck some people don't use bags so you can imagine the mess that that leaves on the street and those are the complaints that I've had from just common Ordinary People Ordinary People okay thank you very much for your time anyone else yes ma'am good morning Lindsay flakey executive officer of the Home Builders

[0:39:05] Association I have a question regarding the fee schedule um it does include rolloff collections as well as um different cubic yard dumpsters a lot of construction and debris is currently being collected in temporary frontload canisters um I'm just curious if that service it will continue through Public Services offering the um smaller cubic yard dumpsters as well and at the price stated in the fee schedule for non-residential collections I have contacted Republic Service twice with this question but have not yet been answered on that Shane the service for uh construction debris in frontload uh smaller containers is not going to be offered any longer that's not an industry standard I don't know how that actually got started in St Angelo but um Republic as well as all companies uh agree that that's that's not a good practice it causes a lot of damage to their vehicles and their equipment and uh was something that we uh uh negotiated out of this contract that U and and again that was something that was kind of unique to the city of s Angelo actually having construction debris being placed in an 8 yard front Lo or a six-yard front load uh canister as it goes up it gets into their compactors it tears up their equipment quite quite extensively so that's something that uh has been negotiated out and will no longer be offered mayor Shane while you're still up there and while Lindsay's close to the microphone can you explain the legal issue that was brought up at the last meeting regarding uh construction debris um I I'm I'm a little confused is there a lot that requires competition for that service I can let uh the City attorney maybe explain that a little better there is uh there is a law in in uh the state

[0:41:10] statute that's um underneath the County Section again I'm I'm not legal counsel so I don't feel real comfortable uh talking about that but there is a law that that talks about it that uh um seems to be rather ambiguous and and people across the the state uh do seem to have disagree from place to place industry to Industry as to how that how that's to be applied but we can allow um the City attorney to address that if you want to right and this statute to which you refer does uh allow an exclusive contract with regard to those services within the city limits should the law be changed or clarified in the future we'll we've indicated that we will uh comply and uh amend the contract as required if necessary so you just said it it allows exclusivity yes okay can Lindsay respond to that please yes you've all probably been contacted by the Home Builders that's why I'm asking these question I would respectfully disagree that it does it does um allow for private entities to contract with um construction to remove construction degree um and it does allow as a public agency which is defined as a municipality so there are different communities and um providers that use this law to open up um an open market for construction um removal so we would of course like to be able to provide an open market for construction and demolation with uh waste under this statute I can provide more information as well as a copy of the health and safety um law if you like a copy as for the frontload um containers again we were not aware that this is not going to be a service

[0:43:11] offered it is a current service offered and one that the builders and contractors use and use extensively on their construction site um it is more affordable which and if you know every penny um that we can save on a house house makes it more affordable for a homeowner um but it is also an issue of space and um how quickly something can be dumped we try to be very um considerate of the Neighbors in an area and um as we almost every contractor up to the sheetrock stage will use a big roll off because it has very large debris to put in it at that time as the house gets larger and the space dimin fines a smaller front load um works and better for everyone as it gets um emptied on a regular basis and it has the room to be able to work on the site so again this is a service we have enjoyed and it is a service we would like to request that we continue to have available so I can just let me know what I can do to help on both issues but I have a question the law that referring to state law that is an option that it's not required it is an option is that not correct it is an exception within the law um the law has says that there can be exclusivity and then this is used as an exception and by Shane's uh clarification that this is not offered in the contract that settles what the home builders need um the contract does specifically say that um you're asking for exclusivity for construction and um and demolition we believe that the state law does provide for exception as a private individual to contract with um another company if they so choose and so the choice was is within the contractor's

[0:45:15] hands and again that's um an item that on our part as far as the city we have a different interpretation and that's something that at this point that interpretation will have to be probably reviewed at a future date but our interpretation is that we do have exclusivity and that's something that we've stuck with during our negotiations as well uh again without going into too much detail uh because this is a legal matter that that more more than likely we will get into probably in the future uh we will tell you that right now at this point we do believe that our our interpretation is correct okay and we believe ours is thank you ma'am noted thank you further public comment good morning Council and mayor I am uh Paul Alexander former city councilman for smd1 and I am here to represent currently the count is at 695 residents people around St Angelo that uh have signed a petition opposing any further progress with Republic at this time now to give you a perspective for some people that don't know we we this has been this has been presented to us before through change.org back in uh November 2012 when we had 518 signatures come to us via email uh wanting to investigate the water department that was over a 45-day period we hit 500 in under 24 hours we're at 695 in 48 hours not even 49 it's 48 hours since the time we posted this asking for people to sign it so this is a very strong response very strong and I've been saying this all all along that the citizens of St Angelo see a problem and you say well you know they can't see what we see well principles uh Define themselves they

[0:47:18] they're self-evident they are truths that they're not written law but they are they you don't you know Line's going to get you in trouble that's a principle for example uh you know there are some things that have been brought up here that in business if you violate them enough you'll you'll go under as a business so businessmen don't do these things uh they had seven points to sign on okay they signed off on all seven so there's a lot of reasons not to sign this petition I'm sure some people passed it up but these nearly 700 people signed it and reason number one is that when you w a contract for $400 million and the people responding to the RFP have something to say about it like why are you carrying over liabilities from a previous contract into our contract where we have to pay for it and they want to tell you about it but the RFP doesn't allow for that so they have to go ahead and turn in figures anyway and they want to tell you about it but you don't ask them a question and there's a uh anti- lobbying effect and they can't even call you then you don't know cuz y'all didn't ask to many questions y'all don't know what they're thinking and I don't see that as good business I don't see any of that as good business 29 seconds so I don't have that much time I'm going to go through here listen in my opinion in the situation we're in right now Republic would not have that contract they'd be get sued by the city of St Angelo um because if they owe money to our citizens this is not the time to enter into a contract with them at least wait 6 months when I say that I say go back and do it the right way there is no time like right now to do the right thing that is always true and Now's the Time to do the right thing slow this thing down I would start the RFP process all over and I really think Republic could win but make it a fair and square deal and if somebody says this was fair no way you're violating principles you're violating principles if you think this is fair thank you all

[0:49:21] very much thank you Paul anyone else just so the public understands this contract that we've had with Republic for the last however many years ends on July the 31st of 2014 the contract that was signed 10 to 12 years ago ends on July the 31st now whether Republic would extend it to us or whether they would not is their option but the contract ends in less than two weeks August 1 we had three choices no trash pickup Republic or TDS and we voted last meeting that we would go with Republic any other further comment from the public I'm going to call for the vote I have one yes ma'am how many months have we been working on this since last August so almost 12 months uh and had 12 months I know that uh Mr Valenzuela has been working on this ever since he's been here which is longer than almost 12 months so that has been the window of opportunity and time for citizens to sign petitions and come forward and know all of the details and this Rush at the last minute after it voted on is a little too late further comment from Council what's the motion the motion let's have a motion we haven't got one let's have a motion I I have a comment after the motion okay uh move to approve as presented to adopt the ordinance to adopt the ordinance I'm sorry I can't hear you motion is to adopt the ordinance yes okay sorry motion to adopt the ordinance I'll second the I'll second the motion thank Don um I voted against it last time I'm going to vote against it again I think Republic is a is uh would would get the contract IR irregardless uh the reason that I voted against it last time is for transparency I think Shane and and the staff has has

[0:51:24] done a a great job in negotiating meeting on the city's behalf I would just like to to kick it open until we're sure that Republic is going to to uh pay what they're supposed to pay and have it so that it's transparent as possible I agree with Don I mean I think everyone knows that and again it has nothing to do with staff it has nothing um again with no Prejudice toward any of the other companies but to protect our business Community who essentially are working within the findes of a franchise that the city awarded I would like to see all all the remedies taken care of before the contract is awarded so how would that work I would ask that Republic operating in good faith allow us to extend it I don't want to make a bad decision because we're at a deadline I would much rather just make a good decision use a few more months have this taken care of and as Don said the end result will most likely be the very same result that's been presented to us so what if they decide not to offer to go month to month TDs is offered to go month to month I haven't heard that TS it month to month TDS has already been eliminated because we chose last meeting to go with Republic that was a 4-3 vote that we chose last meeting to go with Republic that vote is moot it it's over Paul no no no you don't understand that's not what I'm saying the contract expires at the end of this month you have nobody you don't even have Republic if you don't approve this today right you have Republic or s or any other company come in and run month to month TDS has offered to go month to month so I haven't heard that I'm letting you guys know they've offered a way out and I think Republic would do the same thing I think they'd want to I think you have a month-to-month option if you ask for it I don't think it's the end and thank you after that I'm giving my opinion after that logistically that'd be a the um this vote today is strictly on the ordinance fee schedule changing the fee schedule this is nothing to do do with the contracts

[0:53:28] themselves and if you'll remember last time y'all voted unan unanimously to approve to approve the fee schedule this is just the fee schedule this this doesn't have anything to do with the contracts that's what I thought and every one of y'all voted last meeting to approve the fee schedule on the first reading this is a second reading of something that every one of us voted for last meeting the 43 vote was to accept Republic and that was done last meeting that one is over we have accepted Republic this is for the fee schedule that each and every one of you voted for including myself last meeting right and I explain to you that the fee schedule is I believe related to the services and if the services are not all provided on the day that the contract commences that that's the reason that I also hesitate so very well Point made and just with comment to all of the people who signed a petition um I I respect their efforts I I respect what they're doing um if they had been on board for the last 12 months to be fully advised and fully knowledgeable as what all is involved and our rate that we were able to get for our citizens residential or commercial and it's all based on the bulk that was requested in the RFP to begin with is that correct I mean that's it it's all based on that and tied to and uh I understand that the order of new automation the new trucks uh everything that they have got to order and put in place to get started is hinging on this they they've got to get started in order to get the services to the people and and we've had this long enough I'm going to call for the vote the vote is the motion has been made that we accept the F the sir charges as a second reading as presented it has been seconded all in favor please say I I raise your hand all

[0:55:31] opposed passes with a 42 vote fee charges have been approved let's move on now to the regular agenda and Shane before you leave I need to visit with you about a couple of things related to trash so don't take off thank you yeah it's 10:00 let's take let's take a little break before we go into the regular agenda 10:19 let's get this meeting started again please do want to make a note item number 18 the first public hearing consideration of an ordinance Z1 1413 Mike Carter has been pulled we will not be dealing with item number 18 so if anyone in the audience is here for that we're not going to deal with it what is it what is it all right we are now to item number 11 presentation of the first quarter downtown s Angelo Incorporated report Dale Vasquez and uh Brenda gunar will not be here uh she has she has her own problems to tend to and I'm sorry for her so Dale your own sir thank you can somebody thank you thank you thank you Council I'm going to be pretty quick and short to the point um if you've looked at our report I'm sure you already have I'm going to skip down to the central business district I just went too far um I just wanted to bring this to your attention um what we've noticed there's a trend that's been happening actually the third and fourth quarter along with the first quarter there's been a change in the uh the Gen Revenue that's being generated

[0:57:35] uh it's we've seen a decline uh as far as the central business district uh while the rest of the city has is really doing very very well financially in terms of uh creating uh sales tax um we've seen a decline and believe that uh we're not seeing the profitability that's uh coming to downtown St Angelo um that the rest of the communities or the rest of the city is has experienced and uh predominantly we believe that uh the change that we're seeing is being drawn through the oil and gas industry and so downtown is kind of not on their radar map if you will uh in terms of coming to spend money and and and uh uh participating in the business district downtown and so one of things that we're doing and we've been blessed that ASU has uh has internships that they've they're working with us to develop a marketing plan uh to bring more attention make our our new citizens and and uh people who are visiting our city more cognizant of what's going on downtown uh and then to help subsidize some of that uh marketing campaign that we would uh we were implementing is we're creating a merchandising uh strategy if you will creating uh a logo for downtown creating slogan creating uh t-shirts and things like that that we can sell that we can merchandise to help offset some of the cost that we would have to undertake as far as creating a marketing campaign so uh that's that's a more current uh vision of what's going on um I want to just talk a little bit about the reinvestment that we've seen in the first quarter downtown uh the west Texas Dominion Properties spent 5,000 and here's a gift that keeps giving the s Angelo area foundation hey Matt thank you for your support uh couple of uh large Investments that have taken place in the first quarter this one we're obviously we're very part uh proud of

[0:59:37] the $112,000 reinvested by the uh 30 West Loft uh apartment units that are and have been developed in downtown that's again one of our major initiatives for us is to get downtown living and uh some other properties that have spent a considerable amount of money uh some property sales uh in the first quarter we had uh three businesses that uh start expanded or relocated we had one new business start up and we've seen 24 new jobs created uh in the downtown area uh the three businesses that relocated or started are Casa deor uh Bentwood by the river uh and cely flats all those are have been significant uh additions even though silly fats has been around it shut down for a little while and came back uh uh under new uh management so in the first quarter uh we saw a m176 reinvested in downtown for a cumulative and again this cumulative number of 81 m 699,000 report I did want to say one thing um in light of everything that's taking place and some of the comments that have been made about city council uh last city council meeting uh I proposed made a a recommendation that we not vote for a particular uh uh development piece but I don't take that personal I I see that is you taking your wisdom and knowledge and understanding of uh what the city needs and we respect that and uh and I continue to hope and pray that other people will do the same in whatever issues they do when at city council you guys have a really really tough job I I know it from working with you on on various issues so uh thank you very much

[1:01:41] for your support thank you dale dale I do Dale I do have a quick question yes sir uh excuse me mayor the the property sell at 801 and 819 South Oaks is that I guess that's the same property uh there's there two lots there yes sir there's two lots now those have been sold or they're for sale they they sold they sold yes sir okay but as of right now we have no knowledge of what the intent is to to do with those lots but they have been sold okay thank you yes sir further questions from Council for Dale just that I I'm always so impressed with the numbers that you're able to put up we're all seeing and experiencing the reinvestment and it's wonderful it certainly makes St Angelo a stand out in the state whether it's you know to the benefit of our own residents or or tourists U thank you for what you do thank you Elizabeth and um also to Brenda and Ken gunar for what they've done thank you we're sorry she's not here yeah uh I just want to another make another comment I forgot to mention that uh just last earlier this month I've lost track of time uh we did receive National recognition from the Main Street uh accreditation program which is another indication of the fact that we're doing the best we can to to deal with uh what we deal with every day in downtown St Angela so again thank you all for your support I think you've done a wonderful job and it's I'm impressed by by what has been done and I'm always reminded back in 2004 when this first brought to me I voted against downtown s Angelo I have been a dues paying member ever since and I regret my vot so y'all are doing great I appreciate it that everything thank you Dale let's move on to number 12 first public hearing consideration introducing an ordinance amending the water conservation ordinance and ordinance of the city of s Angelo takes this amending chapter 11 entitled utilities and solid waste article 11200 entitled water conservation and

[1:03:43] drought contingency plan more particularly by meting section 11202 entitled water conservation measures and section 11203 entitled drought stages and Water Management measures in order to provide for additional excessive useage fees for water usage for single family residential accounts providing for a penalty for the violation of this ordinance providing for severe ability providing for an effective date Mr Dixon good morning Council mayor uh before you this morning for the first reading is the introduction of the ordinance to uh enact the uh excessive use rates that we have been discussing now for a couple of months we talked about it uh even before the retreat that we had U was going to enact as for Drought level three and then it's Retreat it was y'all's desire that uh we just enact these excessive use fees across the board at all conservation levels and before you U this is exactly what we are bringing for the first reading um if this is approved and adopted the second reading will be in u the first meeting in August and these rates would not go in effect until the September willing so we give the public plenty of time for adjustments to this so I entertain any questions at this time I do have one question for the council since Rodney is not here and he is a major a major proponent do we want to go ahead and listen to it to go through this today do we want to wait for Rodney I'd prefer that councilman Fleming was here I really would as well since he carried the ball on he he's been very strong proponent of this and I really I really want his input well since I've been against it I don't mind waiting on him okay how the rest of you guys feel about it I think you should share it in the um two weeks or so that we might have I mean not that I don't want to hear from you Ricky um is it possible though to

[1:05:46] schedule a a public meeting and and and talk to citizens in a in an arena that's not here in this room between 9:00 a.m and 3 pm we can definitely do that I don't have a problem with it sound it does sound like a good idea aren't you having a town meeting tonight well it's not on water it's on everything we can do that that's but I I always feel better when you give people another opportunity to speak I think I think it's an excellent idea U somewhere that's U convenient for citizens in a time frame okay well Elizabeth I think you can add this topic to your everything meeting get I would imagine the everything meeting will come up but um everyone is welcome to join but I I don't want to take any of the spotlight away from Ricky this evening oh thank and Ricky I I was looking at your uh background on this and then I had to go back to the old contract where the lines were struck through to see what were changing it from I'd like to see a a graft you know what it is now and what the proposal is you know side by side if that's possible at this meeting with people okay we can do that okay thank you all right since Council seems to all agree by consensus that it would be best to wait for Rodney thank you Mr Dixon I apologize to you no problem chrisy I apologize to you but we would rather wait on this until we can have a full counsel let's move on uh number 13 we will postpone until after the executive decision and whatever is decided in executive then we'll go back and pick up 13 number 14 is consideration of approving construction of a new boat ramp at Lake nasworthy to assist with San Angelo boat races and to provide better Lake access for recreational users and authorization to expand up to 11,000 $110,000 from the lake nasworthy operations capital account with 35,000 of this amount having been previously

[1:07:49] committed to construct a new boat wrap and Associated infrastructure and access Mr White you own sir yes sir this is actually a revisit of an earlier item that Council saw back in January of 2012 just a quick look at the location uh this is uh Lake nasworthy here's Nic racher Road uh Fisherman's Road leads into Spring Creek Park Spring Creek Park at the lake is the most popular park at Lake nasworthy the proposed location of the boat ramp is here at this uh point on the lake zooming in it's this location here uh where there's an existing boat ramp single Lane boat ramp in not very ideal condition and Spring Creek Marina opposite this is Middle Contra Park which has two boat ramps there are there is one other boat ramp at Spring Creek Park is was put in by the proponents of The Showdown in St Angelo as basically an out a ramp to pull boat boats out for the the the drag booat races quick look at what we're proposing to do in terms of the project here's the existing ramp the pipe rail fence runs along this way we're proposing to build a two-lane new ramp adjust the pipe rail fencing reclaim some of this property here for Turf there's a large island here we would adjust the size of that Island to be a little bit a little bit smaller and pave portion of that so uh boats trucks trailers and boats can get in much more easily back up and then Park we would uh build the boat ramp adjust some of the pipe rail fencing and uh put in Asphalt on portions of the property primarily the organizers of The Showdown St Angelo and the Chamber of Commerce are requesting this uh council did talk about this item back in January uh 17th 2012 at that time Council committed $35,000 along with $15,000 from the chamber to do this project at that time

[1:09:52] we were looking at doing the project with volunteer labor that volun labor is not no longer available so to do the project we would have to contract it out quick look at the budget and the estimated cost the ramp estimated 100,000 the new asphalt work 17,500 the pipe rail fencing and signage 5,000 designed 2500 for a total of 125,000 funds currently available 50,000 as previously mentioned we would need $75,000 additional to do this project those funds are already available in the capital account account we wouldn't have to tap into the lake nasworthy um trust interest income account and uh staff recommends proceeding with these improvements now if it is approved we wouldn't be able to have it all done before the drag booat races this coming September so it would be the following and of course if we bid this out we'd have to bring it back to council I have two questions will the ramp construction be uh of a make that so when we l lose water level the lower water levels that a low water uh launch will be possible meaning are you going to go further down in the water than it is now uh I definitely want us to do that and the other question and request is the road the Spring Creek road that goes there it's U overgrown with grass uh it's kept mowed it's nice but you know a resurface of that road or a widening of that road is is definitely needed from the gate all the way to the Spring Creek is that a possibility and a consideration while we're out there working it it does need to be done we've not made improvements at the lake nasworthy area in so long and I'm I'm all for this I support it I'm just asking for a little more to be considered while we're out there and disrupting uh recreational traffic if we can do this if it's possible we'll definitely look at the cost of that we'll have to get with the

[1:11:54] city engineer in Shane Kelton to see what the cost of that would be but you're you're talking about Fisherman's Road in the interior of the park is from the gate in in the Interior right there all the way to where you're building this new ramp can that road be widened and and improved and I'm not talking with this approval I I stand this stand alone I'm for it and I'll move to approve as requested right now but also daring that I would like for you to consider and see if we can't do some more improvements through there okay we'll look at the the ility of that and look at what the cost would be and get it back to Youk M farmer I'd also on the ramp I'd like to point out yes it does go farther but I I do want it clear that this is not the deepest part of the lake understand so that doesn't mean that we're going to be way way way down so when the lake levels drop like they did in the past you know this area certainly could be one of those that that isn't move to approve I'll second that motion for the comment Don where does this leave our our Capital uh budget for for this particular item after this particular item in terms of what's in the lake nazworthy trust account I think there's about 650,000 if Tina can correct me um and then in the capital account that currently exists there's about 500,000 yeah and correct me if I'm wrong here Carl but I think you're talking about the money that was transferred over in 2009 the initial lump sum that was moved over from the lake nasworthy trust fund okay okay so right now with all known expenditures and commitments there's about 229,000 left of that amount the original it was about almost 900,000 in the capital right right that's right in 260 it's been transferred over so we have 290 after this no no before this we had 229 okay and you're needing 75 more of that okay so is is the previous amount that 35,000 encumbered that was a known

[1:13:57] commitment that I had already kind of restricted out of the original amount so yes that was already committed out of the original lump suum okay thank you further comment from Council do I have public comment on this if not I have a motion to approve I do have a second I'll call for the vote all in favor please say I I any oppose Nay put a 60 on it please ma'am number 15 consideration of adopting a resolution approving the selection made by the S Angelo Performing Arts Coalition saac of killis alond Architects PC as Architects for design plans and specifications for reconstruction and restoration of the City Auditorium and approval of the architectural service contract price between saac and said archit Architects Mr whis thank you I have two this is 16 and 17 they kind of go hand or 15 and 16 whichever it was kind of go hand in hand this is concerning the architect the next one's concerning the construction manager risk process for the auditorium this particular one uh if you'll recall Council approved an agreement with sapac uh recently and during that we agreed that sapac would actually hire our architect for the auditorium project and then the city would hire the construction manager of risk um saac is recommending that we hire killis almond uh as our architect as you know he's the one who did our prior work uh with City Hall and also the the work that was done concerning the auditorium so he has a lot of experience and expertise in this area one thing I do want to point out is that in this particular agreement what we did uh was put a maximum not to exceed price so a lot of times you'll see a percentage those kind of things we wanted to really lock it in on what our fee was going to be what we did and if you look at the the dollar amounts currently we have 4.6 million confirmed for the uh project we have uh the sapac

[1:16:03] and the area foundation uh in a great sort of scenario here have a a potential donor who's going to be looking at some naming right potentials there you'll see that potential added as potential income as well as uh the possibility of some uh New Market tax credits that could go so what we did was base uh the fee on a potential project cost of 7.5 to $8.5 million what I will say is that this this says that kill's contract will not exceed the 73730 but if those dollars don't come to fruition for instance if we're only at the 4.6 then this dollar amount is going to decrease from what uh is presented here this is just a maximum not to exceed based on that dollar amount of a project the 7.5 to 8.5 if we're at the 4.6 we go down so um I'm here to answer any other questions you may have but staff recommends kill us he's he's very well versed in the project and knows what he's doing Council questions move to approve second all I can say is giddy up let's get this thing done I agree do I have public comment on this I know Matt Lewis is here you've done a tremendous job getting this this far appreciate you buddy if there is no further comment I'm going to call for the motion all in favor please say I I oppose Nay put a 60 on that one and number 16 you said was the same going consideration adopting a resolution authorizing the use of the construction manager at risk method of procurement for construction relating to the restoration reconstruction and possible addition of an Annex to the City Auditorium project and directing the purchasing department manager to prepare and publish a request for proposals for contract manager atress contract for the project right and and this one same thing what this is is just authorizing us to start the process to select someone so once we get those proposals back in that'll come back to you for

[1:20:07] zoning the zoning is currently single family residents which is rs1 and they would like to rezone the property to a more dense use of rs2 zoning and that is in single member district number five which is in the Santa Rita neighborhood um uh sir there was notifications sent out to Property Owners within 200 ft of the subject property 22 notifications were sent out of those 22 that were sent out four returned in favor and one opposed uh at the Planning Commission uh the the the uh the case was heard and Planning Commission did recommend approval of such staff did also recommend approval as such and it was based on the the idea that it was consistent with the vision plan map which uh is included within the city's comprehensive plan that outlines the the uh long range plan for the city and how it should develop uh the it speaks to the idea of what the area and the development patterns in the area and the highest and best use of the properties in the vicinity of the area being looked to be res zoned and so we will be showing following are some diagrams that outline the subject property and the proposed rezoning action outlin in red is the subject property it is currently zon rs1 the properties to the north immediate north east and south of the subject property are also zoned rs1 the prop the area to the immediate east of the subject property is Zone rs2 and that is what the applicant is asking for uh again the Planning Commission and the staff did uh believe based on the language in the vision in the comprehensive plan and the vision plan map that resoning to rs2 would be appropriate so this is an AI that shows

[1:22:13] the same area uh the subject property outlined in red and again the applicant is requesting a change in the zoning which would allow for a denser development that would not be allowed in the rs1 zoning as it currently stands the vision M plan map which speaks to that the highest and best future land use or future development for the area would suggest that the area be uh remain residential as it currently stands uh and this is what this map depicts this shows the notifications uh that were sent out and those that are actually were resp that responded the number 17 uh was the sole uh opposition uh that was returned in um regarding the the case and then those that are outlined in green were those that responded favorably for the resoning and then following are some uh pictures that show uh from the subject property looking North now looking South East and lastly west of the subject property then there's Aly so in summary again the uh we believe that the change in the use of the zoning is consistent we believe that there um it is consistent with the vision plan map and the comprehensive plan um and it did get approval from Planning Commission and staff also recommends approval Elizabeth this is your area so I'll let you take the lead on this one ma'am clearly there are a lot of Apartments um in the Santa Rita area if I didn't have to touch it it is and and maybe more so than any other part of the community um but when you look at the area as you say immediately to the east is that why that area was uh zoned to to family residential was that to

[1:24:20] legitimize those is there anyone who remembers that action sorry go back to the areial do you know the history of that I do not because everything to the east of that is essentially single family residential as well so I think what you're proposing is not changing in any way the character of the neighborhood it's simply legitimizing what has been a long-term use of that apartment which was always for a person not related to the family in some form or fashion uh I would uh vote to approve I'll second but I have one question yes um I wasn't clear in in the text that we had are you are they going to have to put two additional parking spots or is the parking adequate for what's what's there already they there may be additional requirement depends on ultimately what they developed that there may be a requirement for additional parking okay so they don't have it now but that again that would be part at at the building permit stage the ultimate development May render a requirement for additional spaces okay thank you I I read where staff said that they felt that the street parking was sufficient to handle additional right based on what was the originally proposed however again and until we know the the actual ultimate plan there may be a potential but based on what was what was articulated we believe that it it it should be sufficient and at this time I I I have a gripe and that is the date that you send out your notifications uh to the surrounding area we are still not doing any better those notifications are being received by the people on Fridays and Saturdays before the commission meets on Mondays and that that's not acceptable they don't have time to mail them back or uh to schedule their calendar where they can come to the a commission

[1:26:23] meeting and I again suggest that we look real strong at how we're bailing those out and if the time work time frame doesn't work maybe we are to be changing the commission meetings to Thursdays to give sufficient time for the objections or for to come back in and that's my complaint you you have a you have a strict schedule can you remind us what that is on your notification I can't articulate that specifically at this point however let me let me do offer uh what we uh a recommendation that we are considering um the the charter right now has the the Planning Commission meeting once a month we would like to opt to change that to twice a month which would get allow the staff the ability to have more time to develop the staff reports and provide beyond the 72-hour notice for for cases to be able to notify um the surrounding neighbors um prior to prior to when they've been currently notifying them so we are within the requirement for notification however it you know obviously as you mentioned it would be great to have that uh have a longer period of time for there to be notifications now we are posting it to the neighborhoods page as well to provide another forum for there to be information regarding the case so we are working toward that end and would like to see improvements in that in that effort so we we would like to make that an option that we potentially have meetings more frequently to frequently to allow for there to be um you can bring that back at another time then but it's register but I think I think uh by ordinance you're required to mail those notifications 10 I believe it's state law oh yes state law 10 days prior to the meeting date so unless the mail system is that slow and I don't believe it is we shouldn't have a problem even though we we should

[1:28:26] check it we will we will need to look into that that's a legal issue yes Johnny no Patrick and I I think Charlotte touched on what I was going to ask it I I would have assumed that you sent out 22 notifications and you got four in favor one in opposition I I would assume that the rest don't even care so but maybe it is the male the mail l i I don't know if you're sing about 10 days ahead that's fine but maybe those folks just is it is it fair to say that they don't care either way if you don't reply I saying the 20 years I've been doing this most cases people don't respond um when there's active neighborhood associations or if there's an item that may be contentious you will get more of a response however I mean we are doing our due diligence by requiring and sending out the required notices um but it's generally just folks are not just inclined to to respond I mean I think that's just typically what you'll find not just here but but I mean I think all over the country but where there is neighborhoods that are very active and items may be brought up toward you know with the neighborhood association potentially you may get more more uh active participants but that's not been my experience well I don't have a neighborhood association but I do have uh neighbors who bring me me the envelope they received it in and it's postmark on Thursday before they receive it on Friday and the Monday meeting is the following Monday the meetings on the following Monday which that is their complaint it's mine too uh or it's postmarked on Friday they get it on Saturday or they get it on Monday when the meeting is on Monday so I don't think it's the mail service it's um I I just think it's something that we seriously need to look at and we and we and we will okay possibly there's room for improvement there room for improvement Marty the only question I've got is what was the opposition that the

[1:30:29] one had there wasn't any comments uh there weren't any really comments associated with it just opposition very well do have a motion to approve I do have a second I'll now take public comment on this if there's anyone in the public that wishes to speak this is your opportunity if not I'm going to call for the vote the motion has been made that we approve this as presented it has been all in favor please say I I any oppos Nay put a 60 on it thank you Patrick let's see where are we now number 19 number 19 consideration of approving an amendment to Vision plan component of the S Angelo comprehensive Plan update adopted in 2009 specifically an approximately 84 acre track located immediately west of the intersection of Sherwood Way in Appaloosa Trail outside of the city limits in San Angelo Texas Mr Howard your own again okay uh I'm sorry I thought what happened at 18 we pulled 18 oh thank you thank goodness has been stated the applicant is requesting a change in the vision plan lap which is a component of the comprehensive plan um to uh to a a change in in the recommended L use which we will show in the following Maps uh Planning Commission did approve the requested change in the vision plan map and will it'll be displayed in the following slides okay so outline and reg is the subject property it is outside the city limits the city does not have um land use jurisdiction in the etj or in the county I should say um however the vision plan map does cover areas outside of the vision outside of the city's corporate limits um and the applicant uh with their potential proposed development um ask staff to review the vision plan map and to consider a change

[1:32:34] in the Lan use in in which is why we're here today so the area is outlined in red as you can see there is um single family multif family uh in the rm2 area that's to the mediate North Northeast of the subject property um the area to the South and to the West is primarily just undeveloped and you'll see that on the aial as well um so again the area to the to the north Northeast is a multif family residential that that's um actually the Boulevard and um most of the areas undeveloped and again the the vision plan map request is to change that to um allow for commercial uses that would be serving the residential potential residential that would be abing the subject property and in the re in the region so again this is what the current Vision plan map outlines and this is the proposed recommendation for um the change in div Vision plan map is this yours Charlotte your area or is this Rodney's well no it's uh it's fine take the lead ma'am it's out of the I'm sorry what um hold my comments to later is this out of the city limits yes it is okay so so extra territorial division I'm sorry go ahead while we don't have zoning jurisdiction ideally we have uh we do the vision plan map can or a comprehensive plan can cover the areas outside of the city and then that's which it does so uh potentially if the area would be annexed in the future uh there would be uh an ideal recommendation for what the ultimate

[1:34:37] zoning potentially would be of course you know that uh when you immediately Annex areas into the city it becomes Ranch in States but the ultimate recommendation would be that it would be commercial and that's what this depicts I think doing it ahead of annexation is interesting and I think it helps the area kind of Define itself as it moves forward my only concern with what's proposed here is and I can't I'm sorry I can't see what the street is to the South um I would tend to think of commercial being um developed at Key intersections rather than kind of mid block and I know we're talking about an owner's specific parcel but I think I think for the purpose of the vision plan you have the ability to move somewhat outside of the boundaries of this owner and kind of clean that up maybe for the future yes and and we can look we can do a a more detailed review of that obviously you're correct that we have the ability to look closer there is uh the applicant who is here and can speak to some of what maybe Envision had asked that the the that the the area be uh looked at for such uh and may be able to give more insight on specifically what might be envisioned for the area if he would can you flip back to the other map please you see what I'm saying you where you see the yellow you wouldn't really want residential or or commercial behind necessarily residential if residential are on the the major street so but I think conceptually allowing a more of a commercial hub not right is good here's my hesitation and my problem and I know this hasn't happened yet but with commercial I'm going to use um uh the area where Trend Furniture is and you go toward Southwest Boulevard and

[1:36:42] the the area of the commercial that's behind there and the residential that's in between all of the traffic and the cut throughs that jump because they don't want to go out the commercial around you know the road to tr I'm worried about the development the planning of putting commercial and residential right there and I think one of the things you might want to consider is the fact that there may be a plan development where there is there is the idea of providing the necessary buffers and such and so really at the vision plan map stage really you you're just ID identifying what you believe is maybe the generally appropriate use however when you get to looking at the appropriate zoning as a development potential development project uh comes comes for consideration we are able to refine that and so I think that you do still have the opportunity to sort of weigh in on for the proper buffers at the time in the future well that that's my hesitation and um I know it hadn't happened yet so yes I would like to hear from the developer okay before he comes Patrick yes does this uh does do does this constitute part of the Gateway this would be considered one of the gateways into the city yes okay that's all I have so that commerci in the event that it could get annexed into the city I'm sorry that that is just a commercial designation it's not a specific it's not a specific zoning classification but a very interesting question because in the end we may want to see more design controls put on these areas than simply just being kind of a wide open zoning classification again my concern is that we're dipping kind of deep into what looks like residential MH when you're not really addressing the streets you're not addressing the street fronts where you're more likely to have successful commercial development so I'm wondering if it's

[1:38:46] possible to refine that a little bit at this level and and kind of address how that activity Center commercial Activity Center would develop in the future addressing again the the streets and the transportation system we could do that let me I would I would like that maybe the applicant to be able to share shed some light on what essentially is looking at and we could if we could maybe entertain some some discussion following I have a question first for you yes sir why are we doing this I mean our plan and always has been to bring it in is r& and then when we know what is going into the area then we're able to to change classifications on certain blocks and certain areas what are we gaining by bringing this in as commercial instead of r& I mean it it doesn't make any sense to me to do this and it's really we can't do anything anyway because it's not even in the city limits s Angelo so really it's it's moot point anyway but why are we changing our the way we do this with the r& has always worked before okay well I'll try attempt to answer that the r& is the default zoning U and so there the idea is that there is a highest and best use for the potential property and so in areas throughout the etj there is a recommendation for land use that may not necessarily be consistent with RNE although as far as the ordinance goes the the land will automatically become an RNE so there is a specific vision for each of the areas that lie without with outside of the city's corporate limits in this case we do look at the patterns for development believe that it's likely that commercial along the major Corridor would be more appropriate and given the fact that the applicant has made a request for such they believe that it it would help assist them as they look to develop the property for it to be uh identified more appropriately given what we all are

[1:40:51] likely to see in the area so that was the request that was made and we didn't have any objections given the fact that we believe that that's that's probably would be appropriate given what we've seen happen I think it I think it shows foresight I mean I I I think it's a good thing but you're right we don't we don't have control of it no we don't but it's it kind of makes sure that they're heading in a Direction that's good for the city I understand said a portion of it in the city limits no ma'am it's all out of the I'm not understanding the red lines then let's hear from the proponent please and and that odd shape down there is actually the railroad tracks correct so okay so I need to stop with my concern identify Rocky and then you've got the floor Rocky templin if this was uh if the vision map was r& we wouldn't be here so the reason we're here is because the vision map is residential and so we're trying to do this in advance what we've seen in the problem is we Annex something it comes in ranch and estate but the vision map has something else well so now we already run into another problem so we're trying to do it in advance and what we've seen with the Boulevard and Appaloosa and the motel is that there this is already leaning toward commercial so that's why we're trying to do it in advance as we build from I guess it would be from the East with residential we wanted to change this to commercial neighborhood so I could protect the residential so I kind of have a control of what's going in out there that it's not just commercial or heavy commercial Char help me out here the aoya doesn't it run through there on behind it so that it would be but the aoya would be between this if we get some commercial and your residential back there which adds to a buffer I'm just trying to clarify the location I drive it enough but I don't fly it uh no there is a 100ft drainage ditch is currently being put in behind the

[1:42:55] boulevard right now which is not annexed the drainage ditch is not annexed I would move to approve second thank you thank you Ro do have a motion to approve or do we have a second do we have further Council discussion on this public comment going to call for the vote the motion has been made do we approve as presented it has been seconded all in favor please say I I I any oppose Nay put a 60 on that one let's go on now to item number 20 which is consideration of adopting a resolution authorizing the release of an emergency vehicle access easement in the homestead section 1B block one lot 11 and Saddle Club section 1B block one lot 9 in Southwest St Angelo Mr Howard okay the uh there's been a request to release an easement that was originally envisioned for the development uh when it was platted there is uh no longer a need for that this easement which was primarily for fire fire suppression and the applicant is again requesting a release of the easement so this is the property in question um as you can see the area outline in red was identified as an easement in with discussions with the fire prevention um there is uh been deemed no longer need for this easement and again there is a request that this easement be released this is the an aial that shows the same area in question is the fire chief happy with this fire you're happy with it Brian I believe when this was put in

[1:47:10] Charter concession on the Waters of lake nasworthy at Mary El Le Park Carl white yes sir we're coming back to council back in February 18th of 2014 Council uh reviewed the concept of this agreement with the the the tour Boo and uh the council had a couple suggestions one was to uh choose the location behind the Nature Center there was another location further uh along the bank towards the uh other concessionary the other boat concessioner and then um make make a modification on the name of the business those two suggestions have been achieved and negotiated and uh we're ready to have you all consider um adopting this resolution so we can do the agreement and I'd like to bring Mr Fox up to uh talk about it just one so he can have some some camera time to let other folks know about the operation and we'll keep it short okay do you have a map of the area Carl it'll be on here here's the the Nature Center Mary Lee Park this is the marina that that's there uh this is off nicker Barker thank you good morning Council welcome Mr Fox last time I saw you you were living in a trailer park at I was I'm trying to bring my standard of living uh back up but uh I will be short and brief today because I know your time is very valuable uh for the newest member of council here she she may want to hear some of this so I'll be quick and to the point and answer any questions you might have um as Carla said we've negotiated with the city a lease that we feel is both fair to the city and to myself as a business operator and we hope that we can go forward today our paddle Bo Steamboat will provide a truly one-of-a kind unique attraction to S Angelo she is the last and only operational walking beam steam engine Paddle Wheel steamer anywhere in the world so s Angelo likes to brag about its uniqueness well this

[1:49:14] thing's going to fit right in there with everything else we got that's great about this town uh we're going to showcase the Lakes origin both back 10,000 years ago when the Indians lived here when it was turned into a lake how the fact that the cono rivers are the whole reason we're all here today is that God put these Rivers where he did to provide us the water he has it will be a water-based activity mostly geared towards family and children uh our logo is called the Tuli princess Steamboat company we changed it from the original L we went with we're going back to the original name the boat was named after Tuli which means uh Sha plectus occus which is the species name for the Reeds that grow along the shores of Lake nasworthy which are the common North American freshwat uh bull rushes and weeds so we're taking the boat back to her original name this is a view of the vessel and she looks just as great there as she does in person I had the pleasure of of riding on her two and a half weeks ago up in Bay City Michigan God granted us with a successful sale of this vessel to us and at this time she's probably south of sagol Michigan headed to St Angelo the site is located directly behind the St Angelo Nature Center this was a council suggestion that we move to a location a bit further away from the other operator at the lake which we were happy to accommodate both the council's request and his we will be operating on a lease that's about 30 ft offshore and 130 ft in width including the small Stone building that you see indicated there and the floating dock is indicated there which will be along that concrete embankment uh on the Lake Shore there council president did you want to look at this anymore any other details on this map no I just wanted to make sure that I thought I knew where it was if y'all want to go back I'm happy to go back we're going to operate basically since I am a school teacher here in St Angelo I'm going to keep my job with the school district thank you and uh we're going to be operating on weekends

[1:51:16] Saturdays and Sundays unless school is out for summer break which we will go to a Thursday Friday Saturday Sunday oper option we will be available for private Chargers 7 days a week basting upon weather and crew availability there are high Seasons which are April through September and our low Seasons October through mid December and March um our basic Excursion tour is going to approximately be a 50 minute tour of the lake back in through some of the marsh Islands to give people a really close-up experience with some of the wildlife and the nature that exists on the lake and it will also include our narrative tour our private Charters will be small Charters uh the the Arrangements on the vessel will be that probably parties of about 12 would be the largest parties that we will accommodate on this vessel uh so it's not going to be a big Rowdy loud noisy uh uh party idea it's going to be small it's going to be intimate and it's going to be more more intimate based as opposed to big and crazy and loud uh we are not going to be selling alcoholic beverages but we were able to arrange that the city will allow our patrons to bring their own personal beverages just for private Charters only we're not going to have any alcohol on board the vessel served or consumed when we're open for general public excursions where children may be present in families that that might be sensitive issue too so any kind of adult beverages will be only on private Charters only we're going to sell a few hats a few C apps maybe some pens maybe a t-shirt or two we're looking to seek approval from the council for a 5-year lease that will incorporate an annual fixed base payment per president that has kind of already been established with the city that will also include an annual percentage payment concession fee to the city as well uh we've been able to work out uh agreeable termination notices both for the city and for myself and according to

[1:53:19] Carl and the city attorney's office most everything else in the contract and my lawyer has been boiler plate standard issue um we see this as an excellent opportunity to tie in both our Endeavor and what is currently going on at the St Angelo Nature Center the folks that run that Center out there see a wonderful chance to take the experience they get inside the Nature Center and then move that out onto the boat and take the folks out onto the lake to see how the native wildlife and species of West Texas exist in conjunction with the waterborne activity and Council that sums up my entire presentation any comments or questions from councel one question to Carl you think this is a good move and well thought out defin definitely move to approve as presented second further comment I think it's a great idea I wish you the most I wish you great success do I have public comment on this motion has been made to approve it has been seconded I'll call for the vote all in favor please say I I oppose Nay put a 60 on that one thank you Mr Fox thank you Council have a nice day number 22 is consideration of awarding RFP FD 0214 for supplemental program services to Messa messen Alpharetta Georgia authorizing staff to negotiate a contract in substantially the attached form and authorizing the city managed to execute said contract I got Chief done on this one mayor that that item has been pulled also never mind Chief done that item has been pulled we will not deal with number 22 number 23 public Hearing in consideration of approving the 214 annual action plan for use of cdbg and home funds and authorizing the city manager to execute the applications required certifications related

[1:55:20] documents and annual funding agreement for $ 71,72 of cdbg funds and $249,950 of Home Grant funds and the first wait is that all of it presentation by director Robert Solas and first thing you need to do is to explain to our boy scouts and the mayor what all this stuff means all these absolutely this is the annual action plan which is really our petition for a federal cdbg and home Grant funds uh it is our last opportunity for citizens to make comments on our allocation for the year it is a HUD requirement uh which is due the August 15th the uh plan basically certifies that we're adhering to all the federal requirements such as fair housing U anti-discrimination uh maintaining a drug-free environment it also addresses a u some key issues such as housing for the homeless uh barriers to affordable housing and lead based paint abatement um but most importantly this plan uh documents all the city's projects and allocations and expenditures that Council approved last month um we did advertis in the standard times and we have copies made available throughout the city and we're asking Council to approve it as written cdb cdbg Community Development block grant and the home is the home investment partnership program thank you Council I need a motion motion to approve second second do have a motion from Elizabeth I'll take I'll take Johnny second on that do I have further councel uh discussion do I have questions for Mr Solace do I have public comment motion has been made it has been seconded that we accept this as presented all in favor please say I I oppose Nay put se0 on that one number 24 discussion and any action regarding the

[1:57:21] fiscal year 214 215 budget prepar preparation Morgan chwen you are on ma'am good morning uh Miss Marley is also going to assist me today um with some of this information so we'll get right to it we'll get this uh in the interest of time I'll move quickly but certainly y'all flag me down and let me know where I need to stop and spend more time uh we wanted to take the opportunity to review other funds we've spent a lot of time talking about the general fund also substantial time spent about talking about the water fund um but there are other major funds that uh we wanted to update the council with while we're in this holding pattern waiting on certified values and all these these other items so uh these are the funds we're going to go over with you briefly the major Revenue sources and major expenditure categories uh the Texas Bank Sports Complex fund of course serves the the sports complex there on Bell Street and uh the revenue is unchanged for the coming year uh so easy for that one expenditures are also uh largely unchanged uh so that that fund balances um this does not yet include we've had discussions with staff budget review and during budget work session that um there would be an increase to the the water and maintenance at certain facilities that were that were necessary and so we're still working through that that list but uh we've had those discussions and this budget does not yet include that the fort Concho fund we have continued uh Financial Health occurring in the fort Concho fund um this is the best financial condition that we've seen in a while so you'll see that that revenue is continuing to to grow and increase in the the fort Concho fund by about $33,000 so proposed revenue of $96,000 so expenditures balance so that that marginal revenue is reinvested in programming and uh the substantial maintenance uh associated with maintaining that that Historic Site Fairmount Cemetery you'll also see um improved performance there uh Revenue increase uh proposed by $223,000 so total revenue of uh

[1:59:24] $367,000 and that's largely due to the uh the change in the policy directive related to Outer barrial containers and so we're continuing to see uh positive economic information from that and uh you'll see a corresponding increase in operations and maintenance and that's primar primarily associated with water and maintenance of of the grounds at that facility Morgan can can we interrupt for a second absolutely um mayor I think I think we've heard about the watering issues at the cemetery and grounds maintenance I think their primary concern is having an adequate budget and um I don't know if that issue has been addressed in this budget and and so I I don't want to glaze over an issue which might be unresolved and I'm I'm sorry to interrupt Morgan do you know if a substantial increase has been made to the watering budget in this area an increase has been made I'm under the impression it's not sufficient to to handle the the the trees that we've had some trees die in recent years and we I don't think that this budget will satisfy that need completely there will be additional resources identified I was thinking that we had a an Emergency plan whenever they exceeded their budget should you know we fear the loss of trees and stuff I need to look at Rick because that's where the discussion was y'all really didn't give us an answer we we have been responding and just sort of doing that but as we brought back last time you know I brought it back not that long ago and I still didn't get an official answer why don't we revisit that issue like to write us an emergency plan why don't why don't we uh revisit that watering issue uh we talked about uh in excess of $6 Million worth of requests and uh 4.7 million of those were cut out and why don't we let's let's just revisit revisit that watering issue and make sure we're not just uh that we're

[2:01:28] uh making a conscious decision about the effects making an informed decision Marty do you have a question sir well no I I I I think we need to make sure we address it and I think because I think it's irresponsible on our part not to not to make sure there's adequate water for to water the the trees any further the comment Council on this thank you sir yeah and we'll work on something but remember at some of these places we talk about trees but sometimes we don't have a system in place that just Waters trees so it becomes very difficult uh in looking at that we wish we had one that just was a drip system that went to every tree but we'll we'll work so what you're saying is maybe the next time we see the fair Mount information there may be an increase due to enhanced watering Beyond what she has correct when yall all get together and I would assume that they'll look they're looking at that from those other it's it was our discussion was broader than just fair amount yeah yeah way broader continue please ma'am thank you sir the uh the next fund the next major fund is of course the solid waste fund um some recent activity on of course the the new contract and so the the proposed budget before you is including uh that revenue and expense associated with that new contract U to ex execute and include compliance with all of those items the vehicle maintenance fund is an internal service fund certainly that serves um the city and other uh local agencies that we contract with you'll see revenue is proposed again at about 65 million slightly down due to gasoline prices being down and you'll see a corresponding reduction in their expense for the gasoline that they purchase so uh not much new information there the communications fund is another internal service fund run by our it division that provs provides communication services to the city uh you'll see the revenue is down slightly

[2:03:31] um I believe that that's in um cell phones and the Voiceover IP phones and you'll see a corresponding reduction and expense certainly um still available funding to offer services at the the necessary levels to to have what is needed Morgan is that we see a reduction in phones does that reduce usage or we seen prices go down do you know off the top of your head I'm sorry I don't I don't know if John's here today but I think that is largely due to that decrease in that new contract that he just got into with Sudden Link okay I think it was like a $21,000 decrease okay thank you the next item is again another self uh internal service fund for the health insurance fund we've Ted talked about um during the work session how there will be an increase necessary to fund compliance with the Affordable Care Act and so revenue is proposed to increase however I think it's important to note that there will be action needed for all the other funds expense so that this Revenue makes so that we can ensure compliance so they' proposed a budget that does Ensure compliance this staff division has uh property Casualty Insurance Fund another internal service fund for our self-insurance uh for Property and Casualty uh Revenue down slightly due to uh recent claims experience and expenses down uh to match so uh that that fund is also budgeted uh exactly to balance the workers comp fund of course our self- Insurance Fund our internal service fund uh for our own workers comp claims um that revenue is slightly up uh we have seen a slight increase to claims experience uh certainly is right at that $1.1 million mark so no large changes there and then you'll see a slight um increase as well to expenditures however we do generally budget this fund at a profit it usually uh so we can set aside funds for future major claims in the

[2:05:35] have an appropriate fund balance uh I believe this is the last fund before you is the Development Corporation fund um you'll see Economic Development uh proposed a slight increase of 2,529 th000 in ballot um the there's really two funds under the Development Corporation umbrella and the de ballot is also up uh to be about 6, 214,000 um recall that the ballot has 28% of sales tax revenue going to Economic Development the remaining 72% to ballot um however you'll note that that's not exactly a 2872 split that's primarily due to the fact that Economic Development has additional Revenue outside of sales tax for example lease income rent income um sale of assets and uh event sponsorships so those um items there and the sales tax for economic development or Development Corporation is uh projected in a level consistent with what we have projected in general fund at about an 8% increase and then you'll see um expenditures are proposed exactly uh to balance and so reinvesting that marginal revenue in um programming uh for example the the bre the business retention and expansion programming investing um in in in launching that new program and with that I'll turn it over to Miss Marley for um discussion of the methodology of allocating pay raises good morning mayor and Council city manager um one of the things that we discuss each year is uh the interest to find out how we set with our salary ranges as it compares to the private sector within the cono Valley uh this year Texas Workforce Commission the St Angelo office offered to conduct a survey for us which um was really beneficial and we appreciated they doing all the hard work um some of the information however that uh

[2:07:40] that ah some of the information that came from the study um is listed here for you I'll just briefly go over them really quickly um our uh minimums of the range we are 33% less than the koncho valley minimums uh 43% of our minimums are less than the 25th percentile for those jobs in the koncho valley um additionally 45% of our jobs uh pay less than the 50th percentile um oh oh I see okay sorry the screens are a little different than how I did them um when you uh compare midpoints 4 5% of our jobs pay less than the Kona Valley and 55% are either equal to or greater than those in the Kona Valley when you compare maximums of the range 50% of our jobs pay less than the 75th percentile of cono Valley jobs and what's really difficult about this information is that this is comparing our current salaries to the 2012 data that the Texas Workforce Commission could get from the state so it's a year old old data but comparing our current numbers so I would expect that they would look a little worse um presently uh just to give you a brief update we have uh 282 non- civil service job titles and we have 27 different pay ranges for those 282 jobs some of our pay ranges have as few as one uh title within the range for instance the city manager there's one of those it is the highest grade that we have and then there are as many as 30 jobs in some of our pay ranges so in accordance with how um HR deems as best practice for the industry we survey the midpoints of 200 jobs each summer we've picked 200 jobs that go across all different pay ranges within the city uh we're always one year behind though in

[2:09:43] our data because other cities that we compare ourselves to are going through the same process so we have no idea what they're going to be doing next year we're only looking at where we currently are I thought that I would do a little example because it seems that midpoints are kind of confusing to people and I thought for everyone to see it's not voodoo we really have a science assigned to it so in this example we're going to just look at Job X and City a pays that job as a minimum 30,000 as a maximum 60,000 then in City B they have a minimum of 275 to 55,000 and then City C has 34,500 to 65,000 so as you can see there's different distances from minimum to maximum in every single job and so the only way that you can really be fair about judging the one thing that is the same in every job is that there's a midpoint of the range and so what we survey are those midpoints okay last year we made great strides with our salaries we were very fortunate the council approved very generous increases to the lower ranges within the city and it's really benefited our our pay ranges uh where we currently sit with the data that we were able to uh research this week or I'm sorry last week we have eight grades that are under 85% of the surveyed cities seven grades under 88% Three G grades under 90 four grades under 95 and five grades at 95% or above the surveyed cities this isn't koncho Valley these are the other cities that are compared so the unfortunate issue is that as you look at all of our pay grades remember there's 27 of them the shortages don't actually occur in

[2:11:46] numerical order the way the grades set out so the best way to handle any kind of an issue like this is to just assign adjustments across the board otherwise if we give it to the low pay ranges they may jump their supervisors because the supervisors didn't get anything so it it makes it very difficult um in years when the budget has allowed it um we have always tried to do something to the ranges and I think it's really important that we continue to nibble away at the differences that we have with uh our survey cities as well as as I've shown you the Concho Valley salaries so my recommendation this year in keeping with the council's goals and priorities is to go with some sort of an across the board um adjustment to our scales as well as to our employees and that way we can concentrate on our retention of our folks that we have here that's all I have thank you ma'am thank you very much questions from Council disheartening what Don one of the things that we started last year for our firefighters was Equalization of the different um the the different levels that are within there and we told them we were going to start last year and then follow up on it this year and all of the the things that I've read I haven't seen where that was addressed anywhere is it being addressed whatever whatever salary increases that would be um granted by Council would also apply to those now our firefighters and all of the ranks in the fire department have one step so whatever increase is given would be handled at each of those steps but I I thought we were having some problems with longevity and some of those sort of things that we began to solve last year but we agreed that we needed to take two years to actually get that problem off the board are we addressing those yes

[2:13:48] that I mean that would be encumbered within the recommend that I've made yes sir all right Charlotte I just want to note that since 2006 and I'm sure the mayor remembers this that we as a council have been trying to bring the city salaries up to the National Standard it's um not been an easy job it's not something that we've ignored but I know for a fact since 2006 this has been a constant to bring these up to 85 90% And it's not something we just started last year it is an ongoing and as I said in 2006 it's a moving Target yes with the cost of living and the Rises so it's not something we take lightly it is very difficult to play catchup just like it is in streets and Roads it is very difficult to play ketchup with salaries but when I say that I I Adore it and and compliment all of the city staff on the work that they do it it's tremendous and the dedication that they have to the city and the hours that they put in um at the same time I'm asking you to remember that your health insurance benefit is a huge part of a salary increase that you don't take home and you spend but it is a huge part of your benefit and to be understanding of that when this is voted on that's all I have to say thank you anyone else Don I have one other thing one of the the hardest things that Lisa has to deal with also is her XYZ uh benefit that she showed a while ago a lot of those have car allowance they have benefits that aren't actually shown as part of their salaries and so her trying to to hit them moving Target

[2:15:51] is exactly that along with that uh you know position x uh in Midland may do two things position next in s Angelo may do six things and so you know the tasks that are are given to each one of those are are different also so she she has a definitely a difficult uh time whenever she's trying to compare apples to apples fars thank you I have a question yes ma'am I usually like to ask question questions that I know the answer to this one I don't when other cities address staff salaries are there ever times or methods where they actually might approve something kind of on a multi-year basis I mean I don't know if that's through ordinance I don't know mechanically how that would work so that you ensure that you keep moving or staying at least somehow at some level with that you know that pay Target that you want maintain I'm not aware that any other cities have anything in place um it's certainly a discussion at most cities to try to stay on track and I I think this Council has come um a long way in in understanding how salaries work and that it's important to stay with it and retention and recruitment so I I think we uh are making strides but I've never known of anything that has been set in stone from one f fut year to the next because you cannot um as a council as I understand the council can't promise funds for a future we say that we can encumber a future Council but there are ways that we do it all the time okay so I'm just wondering if there's a way to sort of memorialize that in a stronger way because we can say what we're committed to and then when the budget falls short we back off of it and then two years later we're scratching our head wondering why we're in the hiring position we're in or I mean it's it has to be it has to be addressed to me

[2:17:56] during every budget cycle yes so I'm I'm just thinking of a creative way that hasn't dawned on me yet but Daniel I like your thoughts actually but of course um for any City you look at salaries is going to be the biggest expenditure that any city has anywhere between 70 to 85% that I've seen so a lot of times to try to establish some type of a policy or something that we're going to follow especially if the economy does actually Curel or start going down it becomes even more difficult to maintain that um I would love to see something like that because we definitely want to do everything we possibly can for our staff the city council made it very clear at The Retreat that uh you want to make sure that within a three-year period we can get to a uh uh the market value for those positions uh the biggest challenge is just that it's such a big part of our expenditures the biggest part of our expenditures seven what what percentage of the general fund 72 but that's typ that's typical right that is correct and actually I think it's a little bit lower than some of the other cities also as far as the um that expenditure but again that in itself is a challenge is such a big expenditure sure yes ma'am in my years on Council I have worked with all the Departments I believe and and I have to say it again I have been amazed at the dedication to the city the dedication to their job the majority of our employees have that heartfelt dedication to do a good job for the people and all I ask is you display that to the public when dealing with them at all times and I I commend the staff for that and certainly want to try to take care of their salary anybody Johnny yes at least I have a quick question yes sir you know we're talking about uh pay increases uh pay increase or raises and in the same breath we mentioned uh job evaluations how how do you do that how I mean what what process does each department take are you involved with every evaluation or how do you handle that okay um each

[2:20:01] year we do have a performance evaluation that um employees go through supervisors will grade their employees provided the employee was on the payroll as of April of the current year um and those evaluations um come come in in a department batch and they'll come to HR and we go over each and every single evaluation for all 980 employees we make sure that they um have got the sufficient documentation to make sure that we understand how this employee is performing um in years past we have awarded um different size increases based on how the evaluations go um this year that is not my recommendation my recommendation is to go across the board because of the situation that we um are faced with as far as how We compare to other cities so yes we will still do evaluations this year but a a an increase is not my recommendation to attach that increase to the evaluation okay thanks Marty you have anything sir no not really I I think our percentages are low because our people are so efficient we do more for Less what else did you need from us Morgan I'm good thank you thank you Lisa in closing oh and a couple maybe six years ago our uh general fund portion for pay raises was about 74% 75% but since we've been investing more in streets a few years ago we almost tripled the Street Maintenance budget that that made it some changes in uh in what we're doing and so as we're addressing other priorities you'll see that this percentage start to fluctuate and um between 70 to 75% is historically where the the city of s Angelo has been our people are more efficient absolutely okay and uh closing I just wanted to do some brief um upcoming dates uh with with the calendar you know we've talked extensively that we have um uh certified property values coming in I've been in communication with the appraisal district this morning uh and we're

[2:22:02] certainly waiting with baited breath for those items we had uh talked tely tentatively about having a budget work session in later July once we have those figures in you know we talked during the budget work session last week extensively about kind of um projecting in our our our crystal ball where we think those might come in and so if if they don't w't uh reach those levels or um or reach a different level then there might be a need for greater Council discussion and we attentively talked about perhaps uh Thursday July 31st that that would give staff time to be able to to work that uh those values when they come in and make sure we have everything we need um and just to give you an idea of how that would fit in our calendar is um August 5th is really our last budget discussion before the budget adoption and so we'll start with our state deadlines in August uh we'll have our our record votes on the proposed tax rate and uh and Council discussion and so hopefully by August 5th we would have the final details to know uh where we can aim for for for pay raises and the other Council priorities um but then we would have to introduce a budget ordinance by August 21st and so we're getting down to um to the wire on on on those deadlines Morgan are you saying you'd like a work session on July 3 first we've we've talked about it and I think I think it would um be helpful to have something scheduled to to be aware that if certified values come in dramatically different than what we're projecting uh there there may need to be some additional uh work done by staff and the council to um balance the budget is the a Tuesday the 29th like a regular Council day is that acceptable so that I don't think we would have information for you on that time into with the property values yet if we get them Friday the 25th it's often late in the evening the appraisal district often stays till 10 11 12:00 at night making sure they get us to them by the the state deadline um certainly me and my staff will work that weekend to get U those figures as best we can but often times there's followup needed with

[2:24:05] the appraisal district and we usually need Monday and Tuesday to do that with them and so I don't think that it we would have information for you by the 29th the only thing on the 31st I will be unavailable uh I will be only available from 9:00 a.m. till about 1:8 p.m. then I would have to leave if it ran longer than that so when you talk about Corum issues I'm only good for the morning I'm already I'm out of the state on the 31st we we when we went through that work session we made some serious assumptions about Revenue increases yet to come if those don't materialize we're going to have then make some tough decisions how about Wednesday the 30th one day before so it's not on the Thursday the 31st is it necessary to do it that week or can we just go long on the 5th we sure okay that's also an option on the fifth it it's um you're you're a veteran of the uh agenda development process so you know that uh as we really the goal we're working toward exists for introduction of the budget ordinance on the 21st um on the 5ifth there's some State deadlines that kick in and we have to take a record vote on a tax rate uh so we would prefer to have something before the 5th so we can do a little work uh every at we're reaching the point where every day every additional day we get helps because we we can address some of the bigger issues but in any attempt to address priorities you you tackle the big ones and then you go as far down the Todo list as you can we've got lots of smaller issues for example we talked about watering in the cemetery we'd like to address that before the budget year starts and not after but Morgan the question as far as being able uh being ready by that

[2:26:08] Wednesday uh on the 30th would that be enough time we will make every effort absolutely because it looks like that might be the the date at this point did you be here yes Council I look like and we can do that in the morning again from 9 o'clock till noon and I would hope it doesn't take longer than from 9 to one and we'll double check availability of of space and Rental um to make sure the exact time okay fact I like from 9 till 10: or 9 till 11: well just as long as I know that it's 9 not8 yes ma'am I'll be here got I'll I'll be talking to you about 8:00 later so we're looking at the 30th then at 9:00 in the morning tentatively here at the mcne center okay all right and and with that just some remaining uh uh budget deadlines I think you're familiar with these and and they're a couple months out so that's that's all I have for you this morning that all you need from us yes sir thank you for thank you ma'am uh it is 1150 we've got one item left to work on the bylaws we've got it ill and executive y'all want to go to Executive I'd like to do this get this done please yes I don't problem C move on okay number 25 is discussion and possible action on amending the bylaws of the water Advisory Board this was requested by council members farmer and grind staff so I'm going to give yall the floor actually mayor I'd like to start off with this one actually okay we did um discussed a little bit of I mentioned the retreat a little while ago uh city council we did have the retreat uh one of the top or the top priority that we discussed was water uh we did establish three very specific goals that we want to accomplish for water uh we definitely want to make sure that we maintain momentum moving forward I've heard people saying now that it's rain that we're going to kind of back off we're not going to back off we want to make sure that we address our water needs our water consens moving forward one thing

[2:28:11] that did come up at the retreat was discussion about the use of the water Advisory Board the uh water Advisory Board was uh created to advise the city council Council on water issues the issue though is that uh the Water Advisory Board uh when it was created uh they only meet whenever the city council assigned items to them to review uh at this point what we want to make sure that we do is that we do have as mentioned a while ago three very specific goals and other areas that we'll have to take a look at projects that have to be bettered out I know that uh we've had organizations and individuals coming to individuals council members talking about uh the Poss ability of water or being water from other areas uh we could definitely use a water Advisory Board to bet out these type of projects uh again uh we did create the city council did create the water Advisory Board as an Advisory Group um the issue of course is we want to make sure that we do or they do meet on a regular basis uh what we discussed and we're looking at is at the very minimum to ensure that this group is meeting on a quarterly basis and in between as necessary if Council does have something that this water budg board can review it's something that can be assigned or even as followup a regularly scheduled meeting but again uh we do want to ensure that at least on a quarterly basis this water Advisory Group does meet uh we also want to make sure that we expand the uh number of stakeholders because we have numerous stakeholders uh that we feel were kind of excluded and we want to make sure that uh they're included in here uh if you look at the uh handout that I gave you uh as far as the board membership items one through four remained uh the same with the exception of item number two there was a slight change to that uh and that one reads at least one member who is involved in the banking accounting or financial services industry we wanted to make sure sure that we actually specified so we want to put it in there with a specialization in agricultural lending lending and or water financing so that was the one change that we're recommending from one through four the others remain the same

[2:30:13] uh we did discuss the possibility of also including other stakeholders for example um the the uh item number five the board will have one member from the kosa DC and the kosa DC board will decide who that member will be uh number six also a member from the Tom Green County Commissioner's Court either the County judge or the commissioner the Commissioner's Court can decide who that will be uh we definitely want to make sure that we also have the UCR UC represented through its director of operations uh the the board also number eight uh will'll continue with what we had before also uh in the an ex official member with the Chamber of Commerce and the Chamber of Commerce as far as this board will decide who that will be we also had the water utilities director or designate serve as secretary for the board and that will not change the concern of course that we had is we want to make sure that we we continue the momentum moving forward uh one thing that we also discussed was making sure that we vet out uh these individuals that do submit uh an application for interest and that'll be for items 1 through four that may be interested in serving on this board uh again as far as a recommendation to the council this would be something that the city manager would review to ensure that the qualifications have been met and then a recommendation made to the city council to appoint certain members uh again the the the group is growing our recommendation is to grow from 7 to n and that still gives us the odd number of votes you know to decide on certain matters but again this is something that at this point we feel has to we have to start from scratch to be honest with you I think that um we definitely want to make sure to address a lot of the issues some I think the board did wonderful work in the past in addressing some of the issues but we do want to make sure that we start off again V out make sure that we have the right um qualifi qualif the qualified individuals on the on the board so again these are some of the changes that are being recommended uh and this is something that uh we can uh

[2:32:15] if with your direction move forward and come back to the council those Chang es um on the ordinance and also on this on the bylaws as well uh with that said you know I know that Miss farmer and um Miss gr staff also met with this group and any thoughts on anything I left out I think they're excellent recommendations and uh as I stress to the city manager I I want to take the politics out of this group I I want these individuals to work with the city uh these Specialists to ongoing advise us about water water right purchase uh things that uh we need to look to the Future constantly look to the Future on and what it it's it's been a a a great organization you know in the past but what I found in in the politics of it say when we change Changing of the Guard up here maybe we don't know you know what the boards are they're what they should be doing and it needs to be ongoing and by putting it under the city manager I think it is ongoing and it will continue smoothly and and that's my whole purpose in this I uh those were my feelings Elizabeth I concur I think that I mean water is uh critical to us it now and in our future so if we can um put a little bit more weight to this have them more meet more frequently and have people that um have a strong Buy in and the other agencies that we've mentioned I think that will really help us I think it's time that we take hold of this and I think this is good I like this it's possible action I'm going to move to approve as presented I have a question Johnny is is this a onee twoyear term what did we decide that these were this everything else stays the same it is a two-year term but everything else stays the same as what was included in the uh bylaws and also the ordinance but it is a two-year term I like the idea of uh giving you the

[2:36:23] two Parcels of certain real estate east of South chadburn Street at Avenue P St Angelo Tom Green County Texas easements being an essential part of the Avenue P Street and drainage Improvement project two determining that there is a public necessity for and that the public welfare and convenience will be served by the city's apposition of the easements number three authorizing the city manager or his design need to pursue negotiations with property owners and to make Bonafide offers to property owners and interested parties for just compensation within city council approve private budgets to acquire said easement properties number four considering the use of imminent domain Authority and delegating to the city manager authority to direct the City attorney or designate to file or cause to be filed condemnation proceedings on behalf of the city pursuant to law to acquired said easement properties and number five providing for the adoption of this res resolution by a single recorded vote of the city council so move I'll second I would like to add to this motion and I will go ahead and make the motion but I would like to add to it she just made a motion I said so moved after you read to it he second it but I'm I I'll okay did you want to add what I was going to add is that we would set the amount of the budgeted amount to what we had already designated as and put in the budget to buy to purch is the easements so moved okay you will you add that Amendment yes okay up to up to two Okay Okay the motion has been made that we go ahead and consider adopting this resolution to buy to purchase these two easements so that we can continue with the Avenue P and that we will apply the amount that we have initially budgeted to apply to the purchase of the easements and that is the motion and that is a second correct right do we have further Council consideration on this yes Don um I'm going to vote against this not because of anything as

[2:38:28] far as as not trying to help the people and I I've got to to go on record also that councilman syus has went above and beyond getting this project going and and doing it and it's it's not a reflection on him whatsoever either it's just my personal belief that there Comes A Time time in place when enough's enough and it's time to fight and and uh I just think that uh we're we're at a at a place where um if we uh if we back up sometimes it'll cost us more later on and I suppose for the public use that needs some explanation and the explanation on his on his statement there has been an appraisal on these easements the value of the easements the people that own the property do not agree with our appraised value and they have put their own value on it so there is some negotiation as to the amount that we will pay for this easement uh we had already put an initial budget for an easement and our motion is that we use up to the amount that we initially approved if it's if we cannot negotiate for that then of course we will go into condemnation which is about a year-long process so that is that's that's why Don is saying what he's saying he does not want to pay over the appraised value of the property any further comment no it's executive session it's hard to voice those things that's right is there any way to uh separate uh the the propo or the it's not an ordinance the resolution the resolution from the uh from the budgeted amount of money because the motion has been made and seconded so we'll vote on it I suppose if it doesn't pass then we'll we'll try another motion any further comment do I have public comment I'm going to call for the
