[0:00:06] city council to order we I've never been told I had to use a mic before usually cut mine off good morning it is 8:35 it is time to begin our meeting of the San Angelo city council and we welcome you here this morning we will begin with prayer this morning I'll ask J St Jim Stanley to please please come forward and to direct us in prayer stand as you are able please come forward sir good morning well good morning let's pray our great Heavenly Father we would begin with prayer this morning because we acknowledge that you are here with us watching over this meeting watching over this time and Lord we would begin by giving you thanks God we thank you they are that we are yet today one nation under God we thank you that we continue to express the mot in God we trust and Lord we would pray today we would give you thanks for our great nation we would give you thanks for our president our Congress our courts uh God we would give you thanks for our constitution our guiding documents in our land and Lord we would also pray that you would continue to Grant Liberty that you would help us to be a people of Law and that you would help us to guard the freedoms that you have so graciously given to us and Lord now as we think of our local government we give you thanks for our city for the way of life we enjoy here for the the many wonderful people that you have brought to us and God we pray that you would continue to preserve that way of life here in St Angelo Texas and Lord now today as we think of our city government we give you thanks again for the law enforcement and officers that are represented here today for those who work diligently to protect us day by day our firemen Lord and others that that are are are given

[0:02:11] by you to us to help us preserve our way of life and Lord now we think of this city council meeting that is about to begin and we uh we we would we would give you ask that you would give wisdom to our city council members to our mayor to all those government officials that are present today and Lord as the proceedings go we pray that you would help them to listen carefully uh to to judge righteously and fairly and Lord we pray that all the things that are brought before them would be given due consideration Lord we pray for wisdom in every matter and we pray that all of those who have item items to bring could could Proclaim and and and discuss them clearly Lord we ask that this city council would be a representation of the kind of attitude actions Justice and fairness that is expected of them by this population and Lord we would give you thanks for everything that is decided today trusting that it is according to your will and it is in Jesus name we pray amen amen theor Schartner would you come forward and help me with the pledges please ma'am she volunteered good morning pledge the flag of the United States of America and to the Republic for stand one nation under God indivisible with liy and justice for all and the Texas pledge honor the Texas flag I pledge alance to the Texas one State under God one and indivisible thank

[0:04:25] you we do have several recognitions this morning uh Sydney are you here come forward my friend bring your arm to Raj with you United Way of the cono Valley 2016 campaign good morning sir sir let me read this it says the United Way of the conso valley matters that's both the theme for this year's United Way fundraising campaign and it is the honest truth through years in campaign chairman and Civic events manager Sydney Walker fellow United Way volunteers and staff will be hosting scores of fundraisers and visiting local employers during those visits they will be asking their neighbors to consider helping others in our community who are far less fortunate the end goal is always the same to raise as much money possible to help as many people possible we understand Economic Times Are Hard for many United Way donors at the same time that means that the needs are greater than ever before does the United Way matter to the battered women who find Safe Haven at the ICD family shelter yes the United Way matters to the abused youngster served by children's Advocate Center the United Way definitely matters for the families who rely upon the YMCA for Afterschool care the United Way certainly matters and the list goes on 19 programs all of which matter offered by 17 local nonprofits as a result no other form of charitable giving is more efficient or effective one gift can literally to touch hundreds of lives impacted by the worst social ills we see in our community the city of St Angelo supports the United Way and ask that you please consider doing the same therefore I Dwayne Morrison the mayor of the city of St Angelo on behalf of the city council do hereby recognize and applaud the United Way of the conso valley for its achievements and positive determination to make a difference in our community let me present this to you and give you the micophone how's everybody doing I'm Sydney Walker

[0:08:30] baseball theme but we're going to be honoring volunteers that give a lot back to the community Through service United Way that's here kids eat free and a lot of different things and actually tomorrow we'll be going to Austin the Department of Aging and Disability Services is recognizing a group of these volunteers who provide medical transportation and we recognize these volunteers stayed with us for many many years once they joined the program and it's a great way of expressing our appreciation to them for what they do in the community so thank you [Applause] is Herbert and Miss V good morning ma'am the mayor's Wellness partnership is presenting the first annual family health and fitness day with the purpose to increase good health awareness and promote family involvement in physical activity this is a national event that meets one of the goals of the US General's report on physical activity in Health the report made it clear that health benefits can be obtained from moderate physical activity on a regular basis the mayor's Wellness partnership was established under the health and wellness task force of the Tom Green counter hunger Coalition the mission is to encourage educate and empower the community Through programs that promote a healthier Body Mind and Spirit the vision is to work toward a healthy and a Vibrant Community this event shall offer the opportunity to participate in a run and or walk on the roroa trail and free health screaming as well as education and information about health and fitness topics this event is free to the community encourages families of all ages to participate as area agencies and businesses provide information and support the mayor's Wellness partnership therefore I Dwayne morson the mayor of the city of St Angelo Texas on behalf of the city council though hereby proclaimed September 25th 2016 is family health and fitness day in St Angelo and encourage all citizens to support the initiative and come to the unad Park from 2:00 p.m. to 400 p.m. to enjoy the

[0:10:32] activities and adopt a healthy active lifestyle Miss Herbert thank you you have the M now I wanted to let you know that the way that this began was we had uh about a year or a year and a half ago we had a conference called growing healthy Texas uh here and it was sponsored by a number of organizations one of which was it time Texas and they have tried to make that uh the idea of Health and Fitness and Wellness a big part of their life there that's the reason for their name it's time Texas it means it's time Texas to wake up and start working on our health and wellness that we may have pushed to the side up to now so uh as a result of that the there was a group that started called Wellness Wednesday and we would love to encourage anybody to come to that if you'd like it meets at uh St Paul Presbyterian Church the first Wednesday of every month and the idea behind this group was that we could communicate with each other to know more about what was going on in the community because there are lots of little pockets and people working in silos in uh various ways about health and fitness so we wanted to bring everybody together and so this Wellness Wednesday group was formed and out of that which was a that group was a another ta task force with the Tom Green County hunger Coalition that hunger Coalition also does things like our Summit uh West Texas hunger Summit and our kids eat free program but from that uh group The Wellness the mayor's Wellness partnership was born and uh we this is a an initiative that is used in many cities across our state and so we wanted to do that in in our own community and so to do that we wanted to have a kickoff event and this family fit uh health and fitness day that is this coming Sunday September 25th uh from 2: to 4: Unidad Park is our initial event for this group and for the mayor's uh

[0:12:35] Wellness partnership and so we hope that all of you will attend we have uh many partners that are helping us with that uh we have uh Texas AGR life uh Angelo Community Hospital Shannon Hospital adak the City wreck department uh HB uh West Texas Rehab uh Methodist Healthcare Laura Bush Institute for women Women's Health and and of course the Texas hunger initiative so there are many there'll be many Health screenings uh giveaways there's the as the mayor mentioned there is a 5K a walk or run and so we really hope that everybody will make this a priority and come out on a good Sunday afternoon and uh join us thank you [Applause] m it is now time that we allow for public comment this is a time in our meeting which we allow anyone that wishes to address the council in any way in any matter just come forward to the microphone and take your turn nobody needs to sign in or register just walk to the front let me read the legalities and I will open up the public comment issues or items that are not on the agenda may be raised by the public at this time citizens should speak from the podium began by stating their name and

[0:14:39] limit remarks to less than five minutes council members May request that a discussed item be placed on a future agenda the council takes public comment on all regular agenda items during the discussion of those regular agenda items if there is anyone that wishes to approach the council this this is your opportunity the sign the line forms at the front good morning counil and mayor uh my name is Sylvia Martinez I am here today because um uh for the actions that I couldn't get my uh business open uh and I was paying for my water bill and my storm water and my taxes um I have not uh I went down to the water department and see if they could uh put my stone water till the 5ifth when I get my my uh disability that I'm in and they refused to give me uh five days you know so I can pay so I told them turn the water off which I've been paying 89 that I pay for a place that is closed M and I think that um $48 $89 that was going to the city it's in you know money for this um that we don't even have to give the police officers a race every penny counts right now and I hope that you all have the wisdom to to go on and do something about because it it's a lot of things going on right now and I feel that we have to do something to give a race to the police officers as a taxpayer I'm a taxpayer sir and I hope you can do something about these people that work in the water department because they don't try to work with us people and we're taxpayers too sir and God bless

[0:16:42] you and you have the wisdom to know the difference because things are not going right when we can't give a race to our police officer sir thank you God bless youall yes ma'am good morning good morning uh my name is Ronda Moore I am a citizen of St Angelo Texas I have been for the past 30 some odd years I'm not going to tell you how long um Mr Carter I voted for you um I live in your District um I wanted a change so um I helped you get in your seat um I am quite appalled that the S Angelo police officers have to um negotiate their um their pay I read the article that was on Facebook the other day and um something caught my eye um I noticed that uh there was a clause that was written in the contract um that stated um something to the words of the effect that if the city was not able to um meet the contract that uh the contract would become a null and void or something like that um which uh tells me as a citizen that um y'all probably never intended to um pay it in the first place which kind of saddens me as a citizen of s Angelo Texas um because that doesn't make me feel very safe um I have uh myself noticed that um there are several officers that have retired lately and um I know that St Angelo um police department has hired several um new officers so I know that there are are a lot of new officers out

[0:18:47] there and it just makes me wonder how young this department is so um that being said I also noticed in the article that y'all politely reminded um the officers that if y'all were not able to come to an agreement that um this uh contract would also become Nolan void and the um members of the um I forget the term the members of the police department who came to y'all with a uh new agreement was rejected by the city council and maybe also the uh financial department I'm assuming um I I'm not sure exactly why and I'm not sure exactly what their um their agreement was or what their terms were and um you also politely reminded them that if there's not an agreement that comes upon today that um that the entire contract is to be null and void back to September of two or back to sep um excuse me back to 2013 that you'll take away their pay do you realize that these people have families that they have to support and that um that that cost of living has gone up immensely since 2013 that we are now in 2016 and that these people have children that are in activities and they have to pay for food and and bills and everything that this just concerns me that you know they have to pay for a roof over their children's head and they have to pay for all this stuff and now they're being threatened not to mention the city of

[0:20:50] San Angelo These Fine members and um the city that if these these is that my my time up I'm so sorry but um can I just say one more thing go ahead okay my final thing is that I I feel that this St Angelo Police Department is being punished but you're not just punishing the Stan Angelo Police Department you're also punishing the citizens of St Angelo because the PE the the police the police that are not tied to St Angelo are going to leave and if you think crime is high now just wait until these people leave or retire because they're going to leave and then crime is going to C wind it up please ma'am that's it I want to say but thank you for letting me speak respectfully thank you yes ma'am mayor there's some things there that I think we need to clarify not now this is not the time appreciate your comments yes ma'am hi I'm Kyla gust I'm a citizen of St Angelo for 30 plus years um I would just like a microphone please ma'am I would just like for y'all to um for our sapd to please consider how they protect and serve us daily and it's now our turn to protect and serve them without a strong police force and a strong infrastructure of our fire department schools and everything else we're not going to attract business bus and families to this city and that's something we really need thank you thank you ma'am yes sir good morning your honor Council good morning ra counil citizen of St Angelo I have in my hand a petition to the city of Council of St Angelo which reads we the undersigned are residents of

[0:22:51] McKenzie and shaer streets these streets share an alley that begins at Avenue I and ends at Avenue M this alley has been used in the past for the collection of garbage and we would like to return to its use for that purpose I'd like to convey this to my Council Brian he can take care of it sir uh I understand there's a meeting on the the garbage issue this evening that's correct did anybody see a notice in the St Angelo standard times today regarding that I looked I couldn't find one is there a representative of the standard times here what oh so there's no notice in today's paper about it well I looked at it but that doesn't mean it's not there uh you know when the way we got into this tragedy of the trash we trusted city government City staff and our local institutions to take care of us and one day we woke up up and our city was a garbage dump we don't feel like that that was all effective and I hope that we can reverse some of it and I want to convey this to my council person thank you for your patience thank you next does anyone else wish to approach the city council with any comments Pro or con if not I will call an end to the public comment section of our agenda have one thing to move move from the consent agenda that will be item number L this is a budget issue on property taxes we will move item L to the very end of the regular agenda so it will be put after F on the regular agenda so L has been pulled it has been transferred

[0:24:54] from consent to regular we will now let's start with uh you miss farmer if there's anything on the consent agenda that you would like to pull if there are any comments that you would like to make this is your opportunity thank you sir and I don't have anything to pull off the consent agenda but I have one comment there have been several times uh not a lot but a few times over the years that I have uh complained about staff or things not getting done and you know you really don't know how much your city employees do for you until you work with them for several weeks and they are the most giving employees that you will find they love their city and they love their job uh the porch dep Plains conference that was held here was an outstanding Su success and I believe that it's due to all of the employees who worked to make it and gave of their time freely uh I can't say enough about Shane Kelton or uh Teresa James Rick Weiss Becky gun you know who you are you know I can't name all of you but their efforts and their work was outstanding and like I said you don't know how hard they work until you walk in their shoes with them for a few weeks to see how much extra they do to go that extra Mone and I thank you sincerely B do you have anything to pull or comment sir nothing to pull but I just want to thank uh Mr Ruben aquavera for inviting me last night to his son's uh Eagle Scout ceremony uh kin aquavera along with his friend Carl Houston uh they both received their Eagle Scout last night and I want to congratulate both of them for their for their uh tremendous efforts in our community thank you sir see I would like to thank

[0:29:02] has been pulled I would like a motion to accept the consent agenda with the exception of m l h and E move to approve with those exceptions second n n did you mention n yes thought it did yes n l h and E have been pulled I a second second Marty have any further Council comment on this do I have public comment on the consent agenda all in favor of accepting as as the motion is has been amended please say I I and oppose nay this will be a 70 vote we will start with e that's the first one we pull Lucy this is yours ma'am yes um I believe James there he is J I want you to explain a little bit about this item that or this project for me please yeah and if uh if you want details on the project Russell pale can probably describe that $15,000 yeah in terms of exactly what this is um this is the project that would widen West Kono uh just that one block um east of of Kim uh this would be simply the design of that project and so that's about $115,000 and the request of the te board was to fund the design of that project in that amount which the ti board recommended okay so where are we supposed to get the money for the actual project after the design and the surveys is all done who's going to pay for that street to get widen the city I think that well it's the short answer is a it's a combination of the city but Tex dot will cover a portion that's in the Tex dot the intersection

[0:31:04] there at Kim uh but I'd have to defer to someone else to answer that question on the funding and one the last question that I have is um the time frame what are we talking about I mean like is it going to be next year is it going to be this year do you have any idea of I'd probably defer to Russell on the the timing and the source of funding for that um if you have questions about the the funding of it for this particular project and and the te board element of that I can answer those but otherwise I think I'd defer to Russell he's behind you Lucy um this this contract to do the engineering is actually a 90-day contract to complete the engineering design work on that on those Services um we're proposing to work with Park Hill Smith and Cooper um they also did the uh design and implementation of the bank facility that's right there um across the street from the YMCA as well so you that's where we're at with that thank you funds are paid out of the tear fund is that correct they will be5 will be this this is just for the design correct what I was at get into is the street itself the project itself after the design and the survey is taken care of I wanted to know where the money was going to come from to actually build the widening of the street M there's there's currently no uh designated funding to actual do the construction at this point it has been placed in the CIP program is one of the projects moving forward and so that will be as we move in through the this next budget year we will be trying to identify uh any funding sources that would be possible whether that's um it could be with the help of tear uh possibly kosa DC um other Capital funding that could be identified through the city uh or if it's prioritized by the council to find funding we would look it that way also Tex do has set aside a certain amount of

[0:33:06] funding for their portion already uh but currently there is no specifically identified funding for this project right thank you very much this has always been on the radar has it is this is actually an item that in February when we do our strategic planning workshop we'll be talking about the priorities on the capital Improvement projects and this will be one that will be discussed as well and city council will establish those priorities on the projects that will be be moving forward so this possibly may be one of those and for the for the few years that or the eight years or however long it's been since I've been in the operations department now it this has been somewhat kind of on the radar but you know way back on the back burner but it has always been thought of from the from the Downtown Development aspect of it as a Gateway into downtown and has been you know kind of looked at looked at for quite a few years now and that street past that is wider all the way rest of the way down right correct it is Bill yeah I looked at the the map that came with the uh agenda package and I thought that was two Street two blocks no sir it's just one block from conim to Randolph Street it's just that one block there but adjacent to the YMCA and the new bank facility okay further questions public comment if I if I understand right that's uh $115,000 which is ,000 hours at $115 an hour or 115 hours at $1,000 an hour I'd like to find out just what the heck you do over 1,000 hours at $115 an hour to study one block pretty good question the 115,000 is actually just an

[0:35:10] estimate it's actually a little less than that we're looking at more like 12,000 uh dollars but which it can which includes surveying and you know engineering design time typically an engineer's time is ranges from $150 to $160,000 not1 15 or whatever the number was thrown out there um and it can and it varies from um from consultant to consultant as far as what their fees actually are um this was determined based on uh summary of qualifications and not based on actual dollar amounts which is against um purchasing laws and things of that nature y I think this is the one of these nice to-do projects and I think we can't afford it right now so I'm going to vote against it I have further public comment on the ad good morning Steve Hampton um my question was uh the total amount was that 800,000 is that the one uh what we're dealing with today is 115,000 okay but today it's only a part of it yes this is a design is there a is there a deadline that you are you fixing to what's the motivator here is it the the bank or is it the uh fact that you're going to lose some money if you don't use it or something like that excuse me um ma the motivation that I recall is the amount of traffic that has increased to the downtown area and that being one of our main thoroughfares that cut off of coim the traffic there and takes them into the downtown area which is economic dollars and that was the driving force behind it other than the storm water and the wash outs that occur that that needs to be done at the same time is what we

[0:37:14] were trying to achieve right so there's there's more to the project than just putting in a a new building over there yes okay and um are is there a deadline on the on the usage of this money this this te money those are ti dollars which are allocated for reinvestment within those particular zones so this money is specifically can only be used in certain areas from ti so there is no deadline on when those have to be used thank you thank you any other public comment we'll ask for a motion okay Charlotte has moveed to to approve as presented do I have a second second do have a second from Harry any other Council discussion on this I've called for public discussion is there any other public comment then I will call for the vote all in favor of accepting this 115,000 of TI funds for design work please say I I oppose Nay n n put a 52 on that one please item number eight we have postponed at the request of staff item number L we have moved to the end of the regular agenda item number n has been pulled by Bill Richardson that is the second reading and consider adopting an ordinance amending chapter 7 health and sanitation article 702 Property Maintenance section 72063 weeds and vegetation of the S Angelo code of ordinances to add affirmative offenses in cases where developed property is 10 acres or more Mr Mr Richards yes I received calls on this and uh it I was there some citizens think that this is special treatment that uh the person who who bought the lot which is larger than 10 acres made the choice to buy that and is responsible for maintaining that just as somebody who

[0:39:17] buys a lot which just a large enough to have a house on they're large enough to maintain that so I I believe that we should vote against this [Music] well the way I understand this and correct me James but this is property that has been bought that's exactly like the Lord has let it be I mean with the trees just just in a natural state and they have bought the S10 Acres or more with development planned in the future and what this does is just put a what was it a 100 foot around the thing that it has to be mow but the rest of it could be left in the Natural State until the development has occurred am I correct on that sir well that's that's kind of correct uh to to clarify it even further is uh when a parcel of land was purchased uh regardless of the size this Nuance is the 10 plus acres and the uh key of it being developed or undeveloped so let's just go back to the original undeveloped lot that you buy um that was to be kept in its native state and was allowed through the ordinance as an affirmative defense once the purchaser of that parcel of land despite the size uh mowed it uh cleared it with intentions to develop it that was no longer its native original state they were to maintain that property um as we grew uh or or we didn't from an economic standpoint in the Housing Industry for instance a person buys 50 acres their plan is to develop it they go in and mow it they clear it uh don't put infrastructure in it but they've Disturbed the vegetative the natural vegetative state uh today we're letting them uh go grow back to its original vegetative state with the exception of a 15ft swath around the perimeter and a 100t from a nearest structure that that's what this affirmative defense is doing to this this particular ordinance also with the the studies that we had done um four years ago can't say exactly but I believe it was about four

[0:41:23] years ago the city uh with all of the land that they own especially along the river and uh the amount of mowing that they have to do the city is allowed then to only mow and the it's not Riverside dried but it's where Veterans Drive goes under the bridge and all the way around down there it comes out at a they're on what is that n not 19th it's but anyway yeah it allows them to leave it so much of it in the vegetative state to grow and help with soil erosion it's not just uh the developers that are receiving treatment it allows the city to do this also uh to allow for the regrowth to its natural state oh I just want I just want to make sure I understand with all the burdens that from time to time that we place on our taxpayers this is one time that we're lessening the burden yes correct I mean I guess if that's how you sure okay make sure I understood it well put yes Bill well problem problem with this is that U these areas are adjacent to uh um property owners that own houses and and they're not being uh maintained and the property owners are continuously having to call cold enforcement or get don't mow themselves and I I just think this this is special treatment and I don't think the city nor um somebody who bought 10 acres or more of land and and this is this has developed properly I don't think they should get special treatment under the ordinance at the time under the ordinance at the time that the definition of developed was developed on this on a particular parcel of land because they did go in and disturb its natural vegetative state so uh in in the definition standpoint it was developed I

[0:43:26] mean the minute you put a mower on a piece of property you have developed that property it doesn't have to do with water sewer phone lines or anything else um and since then we have met and uh discussed and that's what this is now doing is allowing that person to allow it to go back to its vegetative state U and ironically the the acreage doesn't have a whole lot to do with it um just yesterday councilman Thomas and I were with a property that isn't 10 acres hasn't been developed never was developed and unfortunately that's going to be in compliance and it's it's not the prettiest lot I guess but there's nothing we can do from an ordinance standpoint on that particular location uh as long as a 15t swath is around it and that that that parcel that's not 10 acres it's not even an acre it's a lot technically and U it will be allowed to stay in its current state next to the houses they have to go 100 ft they got to be within 100 ft of the nearest structure yes sir structure could be a fence too um there's a development that didn't that that was that was developed back in the day behind um oh gosh I can't think of the it's in the Bentwood area um those people's wooden fences uh Valley View if you go into Valley View uh headed nor uh uh South on Valley View and the Bentwood area behind those those homes on that first row of streets on Valley View is a Subs subsequent uh uh development that that didn't pan out uh the the burm or the the the mowing or the the maintaining that property was 100 foot from those people's privacy fence and that got heightened in the Wildcat fire era and all that stuff that we had when we were in a serious drout situation um but even that property owner SL developer whoever it was had to had to be 100 foot from all those people's privacy fences so it's structure Mr Mayor I would like to add what comes to mind is I just recently was driving Red Bluff Road and the city owns a lot of the property out there and the city does

[0:47:32] there it's hazarded to the bario how y'all see it thank you thank you further public comment I do have a motion to approve as presented I do have a second I will call for the vote all in favor please say I I oppose Nay Nay put a 61 on item number in regular agenda update on the Sherwood Way Improvement project this was requested by council member farmer John DeWit is here text. director of Transportation Planning and Development so I guess you are on John DeWit I am welcome sir thank you mayor good morning good morning Council Daniel good morning M farmer thank you for putting this on the agenda this morning it's a great time to update the council and the city on chairwood way in our progress uh toward making that project happen um I'll start at the end this project went to contract in July and I'll talk about that more specifically toward the end of the um discussion this morning uh it's under contract thees Albert we have not gone through the preconstruction meeting yet I don't have their schedule yet so there's still a lot of unknowns but the project is culmination of about three years worth of work um and partnership between Tech do the city the no the Chamber of Commerce and the existing businesses along the Sherwood Way Corridor um so I'm sure council is aware the Sherwood Way this segment of the Sherwood Way corridor from Luke 306 to um Southland 2288 has historically been been among the highest accident locations in town um to see the pants fuel I think everybody recognizes that traffic is increasing and honestly spiked during the oil field activity May again and um key here is that it's in the middle

[0:49:35] of a major commercial Zone in town with a u imant Prospect of more development so as uh traffic and crash rates have escalated there again uh we banded together to explore ways to improve the traffic situation there in the safety for three traffic on cherwood way us67 so I keep restating the same thing here um but the new ingredient and uh kind of what spurred the conversation along than uh recently is the potential for new big box type development with the potential for major traffic generation across the street from Lowe's and Walmart so there again this section of Sherway we're talking about a little history lesson uh that triangular area um nothing is north south east west in this town as you know but we'll call it North or Sherwood Way um is there and is result of the original schematic for the Houston heart Loop 306 uh C that's in place now and it was preserved for the eventual construction of a direct connector from westbound us67 onto or excuse me technically Southbound us67 um as it proceeds out of town and currently that traffic movement Shane said I could do this I'm not sure I could let's see car traffic movement that is pretty slick comes through this intersection takes a free ride or has to go through this signal to proceed on Loop 306 the idea was that some point in the future traffic would build to a point where it would be necessary to provide this movement to avoid this intersection touch it down before you get to Sherwood Way that never really materialized okay I can do that but I can't clear it there it is um and as the community has grown and the commercial

[0:51:39] development has occurred here there's been more and more pressure on us to find ways to balance safety um on sh would way against access and um the need to Foster Economic Development um specific Ally um for potential development on the other side of Sherwood Way and so that's where we are today and that's the seed of this project currently there's seven points of uh Ingress into the Lowe's Walmart and out Parcels uh complex um highlighted here honestly our current um access management policies would allow two in that stretch and that roughly 1900 ft stretch Long shw Way given the nature of the traffic there in uh the speed zone so it's gotten a little out of hand and that contributes to the accident rates as a result as that's developed over time we have protected access across again the area shown in yellow um to minimize and prohibit conflicting traffic uh movements and turning movements across Sherwood Way which would only exacerbate the situation as you know the area highlighted here is all Zone commercial with of course the new chick filets in place and there's two Parcels adjacent to it uh one of which is about to develop and uh turn into something that's could be a major traffic generator key to our discussions along with u working with the public entities we've talked about have been um indiv idual sit down discussions with the businesses shown here I think eight individually we didn't talk to all the out Parcels but we talked to the ones that should be most um um affected potentially and concerned about what we might or might not do on

[0:53:43] Sherwood Way to try to balance things out so Lowe's Walmart Dairy Queen Wendy's Stripes Sam's Club Chick-fil-A and the bank um all came in talked with us individually I'd like to thank the chamber they set those meetings up for facilitated it and was a key honestly to this whole project moving forward so we've had the safety issue um there's always been the issue of access and access management along Sherwood Way and now the whole thing's been driven forward Again by the potential for and the need to allow the community to benefit from further development this time on the other side of Sherwood Way and how we allow that and manage that safely on that facility um so the stakeholder meetings were key a key input into that process as well as um a public meeting held on November 10th last year which Miss farmer hosted and we were part of um gave us feedback also that led to this is what we presented in November and what I'm about to show you looks a little bit different and part of the changes that were made on that were partially due to comments receive that n so this is the final footprint of the project as it's gone to contract it looks a little bit different also I'm sorry I threw you off a little bit because the perspective may be a little bit different from the previous slide but I'll run through the major features of this project for you first of all and probably of um most interest everybody is that the project will provide for the installation of a rais me in Long shwood Way With The Brak mid block and we'll talk about that in a second um and I won't dwell on this for very long but we do have guidance and standards um and essentially Sherwood

[0:55:46] Way is to the point where it meets or exceeds the warrants for that sort of um feature for a rais median as it traffic control measure on a facility with that sort of traffic on it that's where we are in our projections for the next 20 years which is des our typical planning Horizon for this type of project indicate we're running about 20,000 Vehicles a day now heavy dose of trucks in that um and we expect to ramp up to somewhere in the neighborhood of about 32,000 in the next 20 years or so and as development occurs that we can't foresee uh to today not just the one that might be more immediate um that will change as time goes on also and probably escalate beyond that um we proposed two points of access to the uh proposed development on the other side of Sherwood Way one a driveway one uh part of new city street system I'll talk about that in a second also new midblock signal location basically lined up with um main entrance if you will between Lowe's and Walmart as is right now and aligned with the new city street on the other side Excuse me while while we're at that subject uh if I could ask you and Shane uh the new city street that you're talking about on the North side where the traffic signal is going to be on the South Side going into Lowe's in Walmart is all of that privately owned or can that street that goes in there also be widen approved improved on the other side were you talking about specifically inow in Walmart or okay that's privately owned yes it is all privately owned and I had asked I believe Shane to check in with those two businesses if they would be willing to pay the cost of widening that uh because it directs the bulk of the customers is for them as well as a

[0:57:50] lot of truck turning trucks go in and they go into Lowe's Walmart and that's such a narrow two car two lane is all it is and if we're doing a city street across and putting a light in there it only makes sense to improve that area if that could be worked out with the private property holders so we could do it all at the same time okay you're Mo you're working on it okay I just wanted to mention it because well now it's time do it honestly I mean I mean I have happy hour every just about every day at Dairy Queen and to to sit there uh you know at 4:00 and watch the traffic it's pretty exciting it is and and and I want to emphasize that yes the oil is not as it was but people need to be reminded that s Angelo's uh uniquenesses were extremely Diversified and there are still a lot of businesses that are doing well and going great guns and it has added and continued to the traffic out there yes ma'am and there again I'm I think we're all in conceptual agreement at least that it's time to address the traffic issue and try to get ahead of them a little bit um next um of course the whole uh system up and down Sherwood Way and into town past Loop 306 will need to be amended we're working with city the city on that did you sir yes yes okay I'll call it the access road which is uh north of Sherwood Way yes now that's that's one way now it yes and that be change to a two-way right I'm going to talk about that in a minute okay sorry didn't mean to put you off I do have a slide that kind of talks about that and walks us through it okay um so the whole signal system going into town um up to Southwest will need to be amended to time this out to insert that new signal in mid block here but also there will be a changes to the phasing

[0:59:54] at the intersection of Sherwood Way and 2288 Southland Boulevard that will most notably feature a protected U-turn movement which is kind of a new thing for us here but to try to accommodate uh some, Parcels the stretch here uh that might be most negatively affected by the installation of raised median and allow traffic to come back to them relatively simply of course there's other ways to get there too um traffic coming from town has this option or they turn turn on Southland there's a corresponding project as I'm sure you know on Southland that facilitate that also I'm looking at Shane he might want to speak to that in a minute also but but that's um I think that's a key ingredient that might be kind of subtle and easy to miss just if you look at set of plans but that's one of the things we baked into this also okay so this is talking about now what you were speaking of Mr Richardson uh the conversion of the existing um now connector from um southbound 67 um over to Northbound 2288 this section here will be obliterated this which incorporates a stretch of existing Front Road will be uh reconfigured and repurposed as the city street two-way traffic um to P to provide access into this new development and back into the Bluffs um there's obviously some administr administrative steps that will need to be taken the course next few months and we're working with City staff on that we'll be coming back to you uh to uh execute the appropriate agreement is to make that

[1:02:00] happen S I don't want to does that clarify that or would you like um I have another question okay um the the part part of that uh access road that that I mentioned which uh uh meets the axis road coming off the off the loop okay that going to be eliminated this portion of it will no I I mean and then this will remain it will be reconfigured this is here this part will be obliterated will Square this intersection off and there again what remains and this I know this is getting messy but this segment right here will be a city street it will be two-way so it's no longer an access road per se for 2288 the traffic that accesses or that utilizes that access road for 2288 sorry I don't have the numbers in front of me it's something we looked at we feel we with the other improvements we're making to Sherwood Way current traffic as well as projected traffic levels for that movement can be accommodated on Sherwood Way and do not need that separate facility and so that's what opened this possibility up for us thank you yes sir um as we've been hinting at here there will be uh modifications of both those intersections and most notably this one will be opened up to four lanes all the way through on our side which made Chick-fil-A and the bank honestly pretty happy and the then corresponding project on Southland will match up with that and the city's working on that now Mr dit before you take your map down can I ask a question or request something I requested and this is back when Lisa Sana was with the no so you know how long ago that's been we were both here

[1:04:03] for that sure yes and I requested at that time that if the state could please put up signs on the on the bridge and if you come past the intersection there at Lowe's and then you're at the Loop when you're coming into town from the West you're going east and the loop the lane that takes you around the circle to put you back up on the loop which is the easiest fastest and better but but a lot of the people that drive through here they don't know that you don't know the city well enough that's one of those things you really don't see coming in time the arrows if you just put post up on the bridge up there the arrows that this Lane Direction and it goes around you would relieve a lot of the traffic at the next stoplight where they have to turn behind Academy to go to the loop and that's never happened that's behind Academy can we get that done I'm glad you mentioned it now how about this afternoon we can look at it this afternoon I would appreciate it thank you about that I'd like to make one comment I knew a gentleman that worked at Walmart for seven years and didn't know that that turn around was there m yes if you're not familiar you don't know it's there it's kind of hidden I age better way to get up on the we put it there just for the locals it's kind of well secret okay I guess no I I agree it is confusing but if you just put the arrows on the bridge you know this Lane is straight straight and then this one turns left and take the turnaround it makes traffic a whole lot no I it's a good suggestion well we will I'm kind of kidding with you we will take a serious look at that thank you and then the final feature I'll point out to you it's hard to see on here but there are sidewalks provided on this also and it's kind of hard to see at this scale but every the the blue on both sides of the roadway is intended to indicate sidewalk and pedestrian ramps across the driveways and streets so so there again there's a laundry list of what I've just uh describe to you funding for this project it came in I'll go to the second slide first in hindsight I have it backwards apparently

[1:06:07] as I said we let this project in July ree Albert was the successful bidder um at an amount just over $3.8 million I've confused myself I'll go back to this one the funding structure for this project the n dedicated all of their proposition one fundings uh proposition One funds for fiscal 2016 to this project additionally we had a donation from the development group that's in possession of those two commercial Parcels across Sherwood way to make this project move forward and then we funded the rest of it there again for a total of $3.8 million I'm add a little bit of a disadvantage because uh we have not had our um preconstruction meeting yet with ree Albert so I know you might have questions about schedule and impact to traffic um ree Albert our contractor and our partner in this will have a lot of influence obviously and we just do not have that from I've uh talked to them informally about it we should be having our preconstruction meeting in the next couple of weeks and I don't want to put them on the spot but I believe they're going to start construction and some of the stuff that will honestly be of no impact to sharewood way itself because there's work out in that open area that can be done that will be of no impact to traffic I think they're going to go ahead and get started on that in October they again that's tentative they have some business decisions to make I do not want that to be binding but the point is this project may be going on through the Christmas season we and REE Alber will be sensitive to that I really think because of the nature of this project the impacts may not sound like it the construction impacts will be relatively minimal and can be managed such that uh Will Survive the Christmas season and also they can organize sequence of work to where um there again those impacts can be minimized but I just don't have a

[1:08:11] lot of detail on that yet so with that my entertain any questions you might have comments any other questions councel one suggestion when you have the turn lane that turns right onto uh right there at Chick-fil-A if that turn lane could be longer the amount of people that are coming it will be and you're taking away that one road it it definitely needs to be longer and is it going to be two turn Lanes right or just one see this area here in green that I'm drawing over now that will all be turn linee Okay so yes it will help alleviate some of the cube there at that intersection and there again keep in mind this is four lane here so that opens that up as well should help and then the other point is once this is built and put into operation we still have some flexibility especially with signalization um things don't work exactly like we hope they will after modeling it we have some flexibility and we can work with the city to try to optimize things so be work in progress thank you for the update Mr DWI I I truly appreciate it and I know uh citizens do I want to encourage uh the city to have what they need to be doing with reference to the street in between Lowe's and Walmart and also at Southland that construction taken care of that soort it's all at once and uh any underground water sewer stuff all at the same time to get it get it done so yes ma'am 20,000 cars a day it's it's a very heavy area it is and it's only getting more so so again thank you very much go ahead public comment on this adem before we move on I've got one question yes for the traffic exiting uh Chick-fil-A since you know how heavy that is will there be access for them to swing around other than 2208 to go back towards uh the Southland we feel like this will be a

[1:10:16] major leg up for them because that basically and I'm sorry this is an old aial basically new Chick-fil-A it's right there Shane I really like this by the way this is fun fun they that is where roughly the new Chick-fil-A location is this will be a right in right out type uh Ingress uh for them and it should give their customers a better option or a second good option we'll see how it works out I'll relieve some traffic there yes sir yeah appreciate it if there's no further comment from Council or public this agenda item has been closed thank you John appreciate you buddy item number B on the regular agenda is consider a resolution authorizing the city manager to negotiate and execute a Construction contract with re cyberon Corporation pursuant to RFB number ESO 316 MLK Transportation enhancement project for Street reconstruction sidewalk and Ada accessibility bicycle elements utility Construction Services in the sum of 5, 86,4 43 with a 10% contingency for a total amount of 6, 387,000 eight8 brother pale you are own sir all righty thank you sir this is the first project of our 10year plan for an $80 million reconstruct on all of our streets um the MLK project is primarily a two-part project uh the first part is basically a St Angelo bike and pedestrian Improvement project AKA a transportation enhancement project which is um funded with some Federal grant funds and then we have our street and utility reconstruction rehab portion of the project the transportation enhancement project is going to consist of uh new

[1:12:20] sidewalk sidewalk along on the west side of M from 7th Street to 29 9th Street um Ada ramps or handicap accessibility uh ramps uh at each of those Street intersections uh Ada elements that um are are signalized intersections with street lights uh striping for bicycle Lanes uh to accommodate bicycle traffic in the area and some trail modifications not working all right the street UT and utility reconstruction rehab portion of the project is basically uh replacing and uh rehabbing our water and sewer remains in MLK Street uh along with those services that extend from the from the mains to the to the RightWay line uh anything beyond the meter uh to the properties will still be a maintenance issue for the individual residents uh the we'll also be Mill and overlaying the portion of MLK from 7th Street to 14th Street what this means is we'll be removing the top 4 Ines of MLK and we'll actually be coming back with just a 2in layer of new asphalt on MLK and then uh from 14th to 29th Street we'll be doing an actual reconstruction of that portion which means we'll be removing the entire pavement base coming back with new base recompaction everything and putting a new Street surface uh for that section we'll also be looking at adding and replacing uh any curb and gutter that's been damaged or where there's no carbon gutter uh we realize there's a lot of businesses in this area that uh have a lot of Frontage and we'll be working with those bu businesses as well with lay down uh curban gutters so that they're not restricted um you know as far as access to and from their property uh but the lay down cbon gutter gives us an

[1:14:24] established Edge pavement and helps us to better maintain that street this is a basically just an overview of the project uh the areas shown in red or highlighted in red towards the north and east side of town are basically what our the contract is going to be covering um this area here is ml and all the associated work with that as far as or what I already explained uh this area here to the east is the trail modifications there's an existing trail that parallels Rio console Drive uh what we'll be doing is we'll be widening that existing Trail I mean it'll mirror or look the same as far as the material type at the end of the project will look the same but it'll just be wider so that we can accommodate uh pedestrian traffic and uh B icle traffic and keeping trying to keep people off of the street uh the the portion shown in blue is also part of the grant uh project uh here to the South um but it's a portion that the city crws will actually be doing it was in an effort to try and save us some dollars as far as using a contractor versus City cruise this will primarily just be a little bit of striping and some new signs in that in those areas to help with the uh bik pedestrian or the bike bicycle traffic in that area uh lastly the funding the grant fund funding is actually a little over a million dollars uh this it's an actual 8020 split the city will be contributing um about $270,000 of that the uh 270,000 actually included just here in the street Bond funding um 20 which of that was already approved as what the tiers will be funding what

[1:16:29] we approved earlier um and then as far as the water funding there will be approximately 820,000 coming out of the water fund uh 1.5 million coming out of the sewer fund and then nearly 3 million coming out of the street uh Bond funding uh to help with the Reconstruction of those streets um bringing us to a total of $6.3 million for the overall project and that $6.3 million includes uh 10 10% uh contingency for any unforeseen uh issues that were not brought up during the design phase of the project with that do you have a question Marty yeah um we're going to from 7th to 14th we're going to Mill in overlay that's correct and and I definitely assume we're going to do that after the uh after the sewer and the water the the water is going to be replaced down that street right that's correct we the entire length from 7th to 29th will be either replacing or rehabbing the water and sewer infrastructure in in ml RightWay and uh you know it's we'll just follow it up with a Mill and overlay you know we went uh the idea for that was basically came from our fug grow Street analysis study that we had done that portion of M from 14th to 7th was in a much better condition than from 14th to 29th or at least it sees a lot less traffic so in an effort to help save some money you know reconstruction is typically much more expensive than just a Mill and overlay project so that was a better use of our funds is to and and I agree with that my my concern is once we dig up enough of that street for the water and for the sewer is there going to be enough left to to Mill and overlay that's correct yes there will still be enough to Mill and overlay Those portions they'll be coming back with either you know um they'll most likely be coming back with just a a

[1:18:33] temporary you know that we're going to come back come through there do the utilities first um the utility contractor will you know Rec compact the base underneath that street and then put a 2-in layer or 4in layer however much uh asphalt was they remove they'll they'll replace with a temporary patch and then we'll just come back with the mill and overlay portion and it'll be just one seamless pavement surface at the top and then I guess my my final question is why why was the Cur I mean why were the bicycle trails put in with this why weren't they bid separate so other contractors could bid them um this was bid altogether to try and get a more uniform you know I mean there's a lot of timing issues that are involved that we the way we looked at this is was you know there would be more added costs if we had to bid this out separately instead of having this under one contractor um you know one contractor can control the timing and the implementation of the entire project whereas if you have multiple contractors trying to get in the same location at the same time that can create issues um and two it's just the overall economy of scale you know there's there's more work to be bid on you know we can get a better price per foot for different items well I I tend to agree possibly on the on the stuff on MLK but the what about the stuff down on the river I mean that's part of it you say right that's correct the uh what Marty's referring to sorry is the that area there that area there on the I mean Eastern portion they won't be calling any there's no shots that need to be called I I just know I've had several phone calls about why why we don't leave some of that for the for the smaller contractors and and we we're kind of cutting them all out well I mean I know that ree Albert is subbing out all some of this work you know I don't I can't control what how

[1:20:36] they sub out some of this work but you know we were looking at it from an economy scale standpoint and moving forward with that okay all right this is Lance Lance over Street Engineering Services um if we had split that out that would have because of the grant funding that's tied to this it would have actually uh required us to have two different grant funding lettings and two separate contracts going through the Federal grant along with Tex Dot and so it would have been a fairly it's fairly um involved paperwork wise to begin with with just one but then to double that then we would have had to track two separate contracts with all the federal funding and Tech St would have also had two separate projects that they would have had to been also tracking to basically do some of the similar modifications of bike lanes and pedestrian enhancements and so that was why it was chosen to combine it as a single project was to uh allow that tracking to be a little bit easier on everyone as well as the fact that um knowing that a lot of the bids would have been local individuals that uh were allowed to actually come through as Subs with some of the majors and we've actually seen that as the way the project has been let is that the uh Prime Reese Albert has actually um used quite a few of the local Subs in this okay so the grant funding also included it's not just roadway it includes the grant funding is just the bicycle and The Pedestrian elements of this project not just roadway that's including along the river that you're sh there that you ccle along the river is the part of the grant funding correct okay whereas ml okay reconstruction and Rehab is just our funds and you know our portion of the project could you back up to the funding uh schedule please and if I'm saying anything wrong

[1:22:39] please correct me as I understand this this is part of our uh money that we went out to bond to fix and our plan uh to fix streets in s Angelo this kicks it off is that correct that's correct okay and but the street bond fund is only 2,974 I appreciate you letting the public know that we have utilized other sources water fund sewer fund Grant fund to bring all of this to 6,387 but that it's only the 2,974 out of the bond that's correct so we'll be able to use more bond funds on more of our streets that's I just wanted to most of these projects will be coming forward it's a great use of the funds and to keep it down so we can get more streets done so thank you yes ma'am is there any other any other questions from Council I make one comment if you don't mind I'm glad to see MLK getting started because the next project on the list is in my district that needs to be done so I'm I'm interested in getting this going so we can start working on Bell Street I'd like to make a motion to approv was presented ask you if you would like to do that since this is in your area I do have a motion from Lucy mayor one yes sir I have a small clarification for the motion uh just procedurally it needs to include that the award is contingent upon text dots concurrence you may have moved to approve contingent upon text dots concurrence concurrence it it has to do to write that way is that your motion Lucy yes sir yes is that your second Char sounds like it do I have public comment on this item I'll call for the vote all in favor of accepting this as presented please say I I oppose Nay put a 70 on it Brian it is 10:02 I'm calling about a 15minute break

[1:24:51] yes it is and 24 call the meeting back to order looking at the rest of the agenda item number c is where we are this is a future land Center Neighborhood Center uh d goes with it is there anyone here that is that is here for the C and D this would be South 14 South Bishop we do have someone here okay okay well I thought if there was no one here we would go ahead and go go to F which is the budget but since we do have someone here let's just go ahead and stay with our with our agenda as we're working number c is the first reading and public hearing for case vp161 an ordinance approving request to authorize an amendment to the vision plan component of the S Angelo comprehensive plan adopted in 209 to change future land use designation from Neighborhood Center to Neighborhood on an approximately 0.14 acre track located at South 14 South Bishop John James you are on sir thank you uh John James director of planning and development services and my presentation here is going to deal with both items C and D all at once you will have to take two separate votes on these items but since they're interrelated we'll just go through them both at the same time uh there basically two items that need to be done uh one is the vision plan Amendment one is the zoning rezoning of this property 14th South Bishop um you can see here as you look at the zoning of the area around Bard uh back when this area was zoned they basically went from Bard back 150 ft so you see that this is a consistent line uh along the back and you can see what that did um that's the future land use showing Neighborhood Center which is a commercial type uh designation but then neighborhood to the

[1:26:52] back and then the same thing here uh General commercial again in that 150 foot wide strip on either side of Bard with neighborhood behind it what that did was it pulled in some areas like this particular tract that's actually a residential home in the residential neighborhood but because they just defined that commercial strip as 150 ft it pulled in some some homes like that and so this is just really to uh Rectify that there's no commercial plans for this long term so it really makes sense to change the future land use plan and the zoning of the property to make it residential consistent with the existing use uh here's the uh subject property again it is a home has always been used as a home uh I'm not going to go through all these but the rationale for the future land use amendment is is basically as I just described uh it's just accommodating the existing use on the property uh and basically the same for the zone change uh changing that to accommodate uh and I should add that the part of the reason for this coming forward is the homeowner is wanting to do some work on the home uh and get refinancing from the bank and because in the commercial District if the house burned down for example you couldn't rebuild it uh it's considered a non-conforming use in commercial this will basically make it a conforming use uh satisfy the bank as well as reduce any hurdles they have if they want to expand the home in the future we did send out our notices to the surrounding property owners did not receive any responses um again there are two items here one is the comprehensive plan Amendment one is the rezoning staff recommends approval of both as did the planning Planning Commission unanimously I'd be happy to answer any questions okay this first item we're dealing with and see is just going from it's just changing the comprehensive plan so this is this is this is just bookkeeping this is okay uh let's go ahead and take care of C this is in your area Lane would you like to move one way or another on this

[1:33:00] allocations authorizing the city manager or as design to apply for certain grants and execute any related documents and provided for the filling of filing of the budget this budget will raise more total property taxes in last year's budget by 1,495 628 or 4.34% and of that amount 422 442 215 44200 ,25 is tax revenue to be raised from new property added to the tax role this year and do you need that second one in there too authorizing Center M negotiate and execute an amendment to the meet no that's is that part of can we do them separately sir please pardon me can we do them separately please do it separately that's fine okay we'll just do then F you have it ma'am F1 that is the second hearing of the uh budget ordinance uh nothing new to report on that I don't have any uh uh PowerPoint or anything but the proposed budget is unchanged at $152 million uh total operating budget and the uh general fund in particulars at $69 million so um that's what's before you today we do still have that $322,000 uh parked uh in an account uh pending further research and uh to report back to the Council on later so the budget has been balanced that's correct we have $322,000 additional dollarss after the budget has been balanced we Park the 322 in an account to see whether the economy goes up or down and to research the two specific items that the council asked for related to meet and confer raises and um health insurance the unknown related to health insurance so uh we are still working through that process and don't have anything uh to report on the use of those funds at this time health insurance come up Jane that's that's January 1 through December 31 right so it'll be later this calendar year we'll talk about it with youall all right it's uh this is a second this is a second hearing on the budget and adopting the ordinance are there any questions before we call for a vote on this prove to

[1:35:03] approve is presented I have a motion do I have a second second I do have a second from Lane Carter motion Charlotte second lane any other questions from Council we've been over this for the last two months bill there's no room uh in here to give raise to the police department I believe that's item two that's the next item we'll discuss bill do I have any further public comment on this item um yes sir I guess I have one question yes sir we moved Dale is that or didn't we or did we right so that'll be next after we'll do F1 now F2 next and then L okay so L comes last okay yes it'll be the last thing then I'm I'm good public comment on this item okay the vote is and we approve the budget budget all in favor of the of it as it has been presented please say I I any opposed i n n nay okay I have a 61 motion to approve the budget as presented item number two is authorized the city manager to negotiate and execute an amendment to the meet and confer agreement as necessary they say you are on ma'am thank you mayor council city manager um what I wanted to report to you was that the budget item was originally a second hearing and would have been on consent but we did pull it so that we could add this particular item to the agenda um the meet and confer group met last week and uh following our meeting we have uh had a conversation where we continue to um go to the table and negotiate so we have a meeting later this week um to hopefully reach some sort of an arrangement uh if that Arrangement is met then we would need to go before their members with a vote vote and following that vote then we could sit down and execute an an agreement with them uh this all needs to happen before September 30th which is the deadline with our current agreement

[1:37:06] so we're asking you to give the city manager the authority to execute that agreement so that we can move forward with whatever we come up with and meet and confer now certainly we understand our management team it it consists of Rick Weiss Michael Dayne Teresa James the Fire Chief and myself so we know what you've given us to do as far as Direction so we feel confident that Daniel will make the right decision with whatever agreement we can come forward with you will be negotiating with the meet and confer to see what Arrangements we can that is correct I don't want to lose this meet and confer I don't want to go back to 213 that's that's counterproductive for everyone correct but we will be looking at this maybe again in in April is that is that one of the plans or not well no what will happen is um we uh we don't know where we'll be but the current agreement ends next September and so we will begin the negotiating process for a new contract later this fall but we have to get through what we're supposed to do 101 and that's what we'll be negotiating on Thursday someone want to make a motion to approve to allow the city manager to negotiate and execute an agreement with the meet and confer thank do have a motion to to approve this by Lucy do I have a second I have I have a question yes sir okay the contract will still be in place no if we don't reach an agreement by September 30th it goes away they have no contract that would be correct and part of that contract going away has certain stipulations that under the state meet and confer guidelines we would have to um Institute one of them specifically is the third police chief the third assistant police chief would that position would go away um the ability to hire part-time officers that would go away there are um other requirements that we would have to remove that are a result of what we've contracted with

[1:39:08] them in that contract so um that's why we're making every effort to get something nailed down by the 30th of September okay thank you I least of this contract uh the the S Angelo Police Department voted to go with a meet and confer contract instead of like a civil service like the fireman did that's correct that was their their choice yes and that contract expires September 30th of next year yes okay and then annually we review it with uh negotiating you know salaries like last year they got what a 6% 6% salary increase six and a half then year before was five but we knew we had additional income to support that in those years and this year we're not as financially able as we were in the past the the process in our current contract says that each April we will survey the other Departments of the 13 cities that we survey ourselves against and whatever that average comes back we had it in the agreement that we would reach a certain percentage each year of that average so this past April's came back and we were to move them to 95% of that average based on the contract um in April we were still hopeful that the dollars would show up with the sales Tech Revenue um but that hasn't happened so in August that was when we finally got the last word that no we're not going to have that funding so that's when we went back to the table to um explain that there was not the funding available that contractually we had agreed to and obviously because it is a contract that involves a municipality there are state laws that require there be a clause in that contract that relieves us from that responsibility should the funding not be there so that's what we're up against and if we don't meet the obligations of 101 by giving them that pay increase and we

[1:41:11] have not reached a another agreement an alternative agreement then as of September 30th the entire contract will become null and void that's why we're given we're you're asking for us to give the city manager that authority to that is correct without that Authority we would be pressed if we reach an agreement on Thursday to call a special meeting of council sometime between now and the 30th to get that approval of the of the agreement okay I'm I'm I'm Daniel I I admire and respect what you're doing but I don't want just you to take the blame or the glory uh either way it I feel like there's going to be a lot of blame and it should be spread amongst the council not just the city manager is my opinion because of economic factors uh it's not good business practice to say yes we're going to give you a raise which we meet this year and then we have to meet it next year and next year next when we don't know what those economic rebound factors are going to be that just simply is not good business no one have to I mean if we're looking at a meeting confer that has a monetary impact for this year we could definitely call a special meeting for the city council uh later this month but I think if anything I just want to see what we can do as far as negotiation and hopefully come up with something won't require that special meeting uh it'll be something that uh hopefully we can handle I know that and and thank you for speaking as far as the the shortage that we've had I know this past year alone just sales tax revenues the final numbers came in we're $2.6 million below uh what had been budgeted uh we don't see um even for next year we don't know what next year has in in store for us I do want to point out the city council's priority one of the top five priorities for the city council was uh staff increases to get us up to fair market value and that includ included the police department the fire department and all staff personnel as well so we were making really good progress city

[1:43:15] council is making really good progress these past three years we just hit a really big bump on the road this year I I I trust you I just want to voice that I am opposed to only the police getting AR raise and and and you look at what was it $322,000 that's not a lot of money uh what do I tell the fireman you know what do I tell the rest of the staff uh when we've already said sorry there can be no salary increases this year um and I certainly don't want to lose anyone in the police department but the big thing that is driving me with this too is we need to put the police in a new facility or relatively new facility and we've got that just absolutely eating at our feet to try to do something or make a decision I would say by the end of the year um you know if the rest of the council members wants to give you that authority to make that decision but I I am opposed to only one group getting an increase and that that amount of money that we've got would not be fair and Equitable to all of the policemen well and I think that certainly um you've probably seen the articles that you know our from the management standpoint our position was not to give that the funding specifically only to PD so that is part of our our continuing to bargain with that and I haven't read any of the Articles oh okay so okay well uh the Management's position was certainly to put that money money towards the insurance so that it would affect you know a greater good more people there's 1,90 people that that would be affected by if we prevent those premiums from going up 800 employees and um almost 500 retirees so that was our position so that's where we are okay mayor yes sir could I speak uh Miss farmer um how would you feel about maybe uh restricting the authority granted to

[1:45:19] Daniel rather than voting that down perhap perhaps uh some restriction for uh he could he could negotiate and execute uh subject to not utilizing any of the monies that have been set set aside that that would be a decision reserved for council at a future date that way he could extend time frames without committing additional dollars well that's what I'm talking about as far as a a pending monetary impact immediately I mean if it's something that is going to require city council as far as monitary impact of it we could definitely schedule a meeting up to the 30th of September as far as a special meeting but up to that point if you'll allow me the authority uh to hopefully with through meeting confer negotiate hopefully something that's agreeable to both sides that doesn't necessarily have an immediate monetary impact then just give me the permission to do that I can do that okay make a a modification to the motion didn't someone make a motion L see you want to modify your motion to include no monetary exp expended yours yes sir anybody want to second that I'll second it do have a motion and accept it I don't want this meeting confer to go away so we need we need to keep this alive I'd like to add one thing you know yes Lane although we do need a uh new police station if we don't go along our obligations to this contract we're not going to have a police station to uh to fill up with employees we're 85% underneath the average currently of our sister cities no no they're at 91.75% we're trying to get up to 95 95 correct we don't need to be losing any of our good men or women in blue correct Bill okay if you're going to restrict the city manager from talking about uh finances and uh that U kills the need for need meeting and confer no that not that's not the

[1:47:22] Restriction that would that's not the motion I don't think Lucy it was your motion it just restricts the city manager from obligating or committing any of those funds he could negotiate funds but he can't commit any of those funds this gives him the right to keep this meeting confer alive otherwise it's going to die this gives him the right to make amendments to keep this thing alive until we can until we can look at it again am I right that's correct and and but he would not be allowed to to obligate the city to any Finance any financial expenditure simply to keep it alive until council is able to obligate Financial expenditures and and I would just add that you know should the negotiations go in the direction that there would be monetary some sort of monetary agreement then we would need to call the special elect a special meeting correct I don't have a problem with the motion I think it will accomplish what we need to accomplish in a very short period of time uh haric just a real quick comment and I'm sure everybody's the same way up here majority of the citizens want to make sure that we take care of the police officers now having made that statement majority of the citizens also don't want to see a tax increase to make that happen so while we support the men and women in blue or where the citizens support the men and women in blue it's going to be a challenge for the city staff and the council to find a way to pay for those raises and uh Bill okay if if it has to be brought back to city council I think the motion should uh contain that stipulation back it's implied I mean if there's going to be any Financial expenditures Daniel is not allowed to do that under this motion so it would have to be brought back to the council it just wouldn't have to be brought back before the end of the month correct that is correct yeah it would have to be done before September 30 okay Mr Mayor yes ma'am I just wanted to make a comment uh I love all you guys in blue and I you do a tremendous job and I would love to do

[1:49:26] what we did last year I just want to say that when we started the meet and confer and we did a a average and we found that most of you were at 60% of what the national average was and it was uh remember John Mark ho saying that that that was not acceptable and we worked hard committee wise to find ways to bring it up and to today it hadn't been that long since we've been working on this to say that we're now at 91.3% of the national average is U is is really remarkable and I just want to point out that we have been working toward that as funds allow we can't make exceptions to treat others better than the rest of the city employees but um we will do and we will try to honor for what funds are available and Miss Marley provided me with an entire list of salaries positions and salaries and I wanted to look at every salary that there was and when you added them all up whenever that was was what three months ago or something like that when you added it all up and divided it by the number of employees um the annual salary at the St Angelo Police Department was just just under $70,000 a year and that is a whole lot further than it was not long ago uh we've got some gaps to fill and with the new Chief possibly you know things can be brought up to where they need to be uh sooner than later yes Bill do we have the same amount of uh turnover and other departments as we have in the police department our turn our turnover for the entire city is really basically low um right now the um police department has um four vacancies uh that are of their um allowed uh budgeted positions and

[1:51:31] then when the they can go over by 5% that would be another eight positions so they've got 12 that they could fill right now um we do have a civil service exam schedule for the third week of October so we expect that we'll get some good applicants at that rate but the turnover in the rest of the the Departments is it's really very low right now jobs are very hard to come by and folks are staying put which means that people that have jobs are not turning them loose right now because the economy has gone South on us all right I do have a motion to allow the city manager to negotiate and execute an amendment the meet and confer I do have a second I will open up to public comment at this time anyone that wishes to make public comment on this this is your opportunity uh my name is Sylvia Martinez uh Miss farmer uh you're you're trying to tell the public that the city manager cannot make his own judgment toward this how do you think it's going to look for the city and the people in the in the state of Texas when they find out what's happening that we can't even pay our officers and you suggest that you don't want him you with they're pay all paying him money and I think he has the the justice and the wisdom and the knowledge to make what has to be done even if we don't agree because it just not just you ma'am all of these people up here represent us the taxpayers the people of of San Angelo and and we we can't I I am really upset because you know what you all have to understand that we can do without I think they would rather be at that police station they're at and get a race because you I know we're growing but we have to have uh re

[1:53:38] enforcement of our police officers because if they leave what's going to happen to San Angelo and how is San Angelo going to look ma'am how is San Angelo you as women you are up there uh doing for us women so you know what please lady please understand what it's these offers would go home they leave the house they don't know if they're going to go home do you think that the dollar amount is worth them losing their lives no ma'am there's no dollar signs here you talking about our police officers ma'am I don't I cannot understand how you all can be right there and want not give them the dollar amounts there are our police officers and I'm here I don't have a school man but you know what I'm tired that I see I see you on TV and y'all say there's nothing yes there's a lot of things to be done in this San Angelo Texas to get businesses in here how are we going to get businesses if we don't have police officers people are just going to get mopped every day like they do in other towns is that what you all want bombs everything that's happen in the United States right now I leave it in your hands right now and I hope and pray every day for you all that y'all have the knowledge because we voted you in but I hope the people see me and they have the knowledge when you all are going to be voted for that they vote against you because you all don't deserve to be out there if you we can't get a race for police officers and may God bless you all for not having the to to be able to stand up for these people in blue but you know this poor lady that lives in a in a come I will come up here and fight for them as long as I live because you know what I need the protection out there y'all might not need it your family might not

[1:55:40] need it but I need it and may God bless you and you have it in your hands and you're going to have to live with it and you're going to have to live what the people around the state is gonna say and you mayor you have to bring these people to understand what's going on that's your job sir and I'm sorry I got upset the the city manager is restricted by ordinance to authorizing any more than a $50,000 expenditure anything over $50,000 the city council must approve this is far greater than $50,000 so the city council must approve it and what we're talking about on the agenda is allowing him the opportunity to negotiate and to execute an amendment but he is not allowed to authorize more than $50,000 worth of expenditures in any thing in the city without the city council to approve and that's all it does it gives him the authority to negotiate this and to reach an amendment and to reach a compromise so that we can keep this meet and confer alive but it does not give him the authority to put any finan Cal expenditures further comment yes sir Merit thank you thank you very much um I was looking through the uh the budget for um 205 and I believe that this city it was listed there that we're running about 195 million dollars uh in debt is that correct everything total is that approximately right I would think it'd be a I don't know everything you know we have water department debt we've got our Hickory water right uh we have Street debt that was uh in in 15 the budget report that would be a question for Tina Tina I think that's approximately right but I imagine you're in the ball we've

[1:59:47] not speak on behalf of the police officers in regards to the meet and confer proceedings pursuing to the ground rules it the what we read them at the break and it says that members of it says the association and if you're a member of the association that's negotiating with us then I would say that that includes you so I am a member of the association I a board member of the association I'm not a member of the meet and confer negotiating committee that's been formed it does not specify that in that provision on the city Side it does say anybody at the table cannot speak but on the part that addresses the association it does not say Association members who are at the table good then okay your own thank you I appreciate you delaying I'm not sure that we're good you're not sure that we are no because it says Association you have the language I'm not going to like it's going to be your ultimately your decision but it's our understanding on the ground rules that members of the association are violation of the ground rules if they Lobby before Council I'm not going to I'm not going to jeopardize or violate anything I assure you of that so if there's some if there's some question about it I will not speak just says the seop agrees it will not contact to discuss negotiate or attempt to negotiate any issue that has been put on the table or may be put on the table with the members of the city council or city manager or anyone other than the city appointed negotiating team except that it may discuss issues with its members a similar um provision for the city is the city negotiating team agrees that it will not conduct contact so the seop agreed that seop and we're interpreting that to mean anybody in membership your call Miss James um I'm gonna say that nobody who's a member of seop should be lobbying the council at this time she has the authority by the recent Charter amendment that she makes the decisions I will bow to that thank you sir I appreciate your time though
