Tallis appreciate it morning please join me in prayer Almighty God at the conclusion of one year and the beginning of a next we gather here thanking you for blessings past and blessings promised specifically we thank you for this opportunity this morning to invoke your presence upon this meeting like this gathering of our city officials our mayor our city council we ask that you would grant them wisdom to govern amid all of the conflicting interests and the issues of our times give them the ability to work together in harmony even when there is disagreement most of all we pray that you would bless all the decisions that are made for the greater good of this city of San Angelo in the name of Christ amen we are now going to have our pledges and so I'm welcoming this morning Davis Darby if you'll come forward with your sister sister Mary Caitlyn Darby Katherine well I want to got it you told me you were nervous the mayor should be nervous she can't even get the names right so you ready to go turn around [Applause]
[0:03:05] we will now do our proclamations and recognitions in the first one we're going to do as a proclamation of January January 2019 as school board recognition month I know there are a lot of folks in the audience and if you would like to come forward as I read this Proclamation it would be terrific the mission of public schools is to meet the diverse educational needs of all children and to empower them to become competent productive contributors to a democratic society and an ever-changing world local school board members are committed to children and believe all children can be successful lifelong learners and that the best education is tailored to the individual needs of each child local school board members work closely with parents educational professionals and other community members to create the educational vision we want for our students local school board members are responsible for ensuring the structure that provides a solid foundation for our school system and local school board members are strong advocates for public education and are responsible for communicating the needs of the school district to the public and the public's expectations to the district therefore I Brenda Gunter mayor the city of San Angelo Texas on behalf of the City Council declare our appreciation to the members of the San Angelo Independent School Board and proclaim the month of January 2019 as school board recognition month in San Angelo Texas energy all citizens to join us in recognizing the dedication and hard work of local school board members and in working with them to mold an education system that meets the needs of

Taylor Kingman and build indle and we have a number of also I don't know if certainly the mayor knows this and our council knows it but we don't do a very good job unless we have a great administrative team so I'd like to ask members of our administrative team to stand up as well so for who are here to join us so thank y'all for them it's an honor and a privilege for us to represent the city of San Angelo and to take care of the kids in San Angelo and we're honored to that you know 14,000 students we're able to represent 14,000 students so we appreciate this recognition and and I look forward to working with the city on a number of projects in the future thank you Becki done in the audience come forward
[0:07:17] recognition of the city of San Angeles Salvation Army tree and Becky done San Angeles City employees serve the community when they're on the clock that's their job but their service rarely ends there an excellent example of this is their annual response to the Salvation Army's Angel Tree program the Angel Tree program seeks to provide a Merry Christmas to underprivileged children in our community in addition to request for a few fun items such as Barbie dolls and footballs the children's families provide their sizes for clothing and shoes donors provide for those needs which include basics such as socks underwear winter coats pajamas and shirts and pants this year a city employee sponsored 75 Angel Tree Children one city employee was assisted in his shopping for an 8 year old girl by Walmart associate afterwards he thanked her for her help know the young woman replied thank you I remember what it was like it used to be my name on that tree every year I remember getting these gifts from people thank you for your service and for what you are doing it means more than you know the effort was again spearheaded by Becky Dunn executive Office Coordinator in the city manager's office Becky diligently works to ensure every child has a sponsor and that gifts are bundled together and delivered to the Salvation Army therefore I Brenda Gunter mayor the city of San Angelo on behalf of the city council do hereby recognize and applaud city of San Angelo employees and Becky done for their achievement and positive determination to make a difference in our community I just want to thank the city of San Angelo employees who gave and rose to the challenge of not just meeting our goals but exceeding our goals I look forward to seeing what next year holds [Applause] good morning I made you stand car the
[0:09:29] commanding officer for the Salvation Army in San Angelo and it's just a thrill for me to be here well Becky is being recognized for her work with the Salvation Army Angel Tree 75 children is about 10 percent of all the children who we took care of this Christmas so that's a remarkable thing for these city employees and for Becky to head up I've been doing this for 32 years and I've been in big cities and small cities I've never been anywhere where the citizens have been as generous and thoughtful as they have been in San Angelo and this has been my first Christmas here so I can't thank all of you enough Becky thank you so much for all that you've done to make this happen we really appreciate it we're now going to have a recognition of Shannon's Medical Center is one of the nation's 50 top cardiovascular hospitals may I have folks from Shannon Hospital please come forward cardiovascular disease is among the most widespread and costliest of all diseases in the United States it is estimated to account for approximately one out of every six dollars spent on health care in the country last year Shanon Medical Center performed almost 2600 cardiac catheterizations and more than 150
[0:11:33] open-heart surgeries it's team of interventional cardiologist and cardiovascular surgeons provide 24-hour care for their patients Shannon was recently recognized by IBM Watson health as one of the nation's 50 top cardiovascular hospitals this is the first time Shannan has received this honor Shannon is one of only three hospitals in Texas and the only West Texas hospital to receive this distinction winning hospitals in the study have established the new benchmark for cardiac care performance by providing better outcomes at a lower cost per case than non winning hospitals the designation of being a top 50 cardiovascular hospital was unexpected to Shannon as hospitals cannot apply nor pay to be part of the IBM Watson health study the award coin cited with the opening of the cardiac catheterization lab featuring a dedicated waiting room for patients and their loved ones larger individual rooms for patients in an additional procedure room testing and treatment are now consolidated into one place for patient convenience featuring a state-of-the-art imaging system for even more precise treatment therefore i brenda gunther mayor the city of san angelo on behalf of the city council do hereby recognize and applaud Shannon Medical Center for its achievement and positive determination to make a difference in our community [Applause] madam mayor and the council we really appreciate this recognition the board and the administration of the hospital view this Watson IBM Watson award as a validation and what we've been trying to do over the past few years and that's recruit and retain the very best medical staff that we can and surround those
[0:13:37] people with the support staff and the facilities so that our citizens don't have to go east of i-35 to get cutting-edge care that's where we view our competition is the Dallas the Houston and the San Antonio hospitals and we're striving to maintain that now you know we're here we are one of the top 50 in the nation and only three in the state and we really do appreciate the recognition it's been a lot of hard work especially on the part of these guys and their families that takes plenty of dedication in education and whatnot and we're extremely proud to have them on board with us thank you very much [Applause] may I remind everybody to please put their cell phones on silent and we will now open up the meeting for public comment issues or items that are not on the agenda may be raised by the public

[0:17:46] access to all the information we believe that I believe that that this is not correct and you're overworking your and we are not getting our due process the citizens are not we are asking that you I am asking excuse me that you let the citizens in and and participate in this if time is a problem then well maybe you shouldn't be there the these things do take time and just want to remind everyone that we did have three public town hall meetings for the citizens to come forward and share their information their concerns and their issues as it related to the contract and what they wanted to to have in the contract going forward my time when you're making they exit they took that away okay you get it back all right so you know we're we're patting everybody on the back today and I would love to come up here and pat you on the back I feel that you're over using this you're you're you're putting it you're doing it behind closed doors and you're putting your award-winning propaganda machine on doing interviews and and to sell your your product and the citizens who have to pay are not being allowed thank you thank you Steve Mitch would you like to come forward morning everyone Mitch sprayer interim Airport director I just wanted to get some recognition to some individuals out at the airport for their actions the day after Christmas we had a little bit of a security incident in our terminal building and it got a little bit a little bit of media notoriety and the responses of some of the individuals out there to that incident I was just
[0:19:49] very impressed by one of which was from our Airport police officer Bruce Burkett the way he handled himself in that situation I saw total selflessness on his part and I just wanted to recognize that publicly but in addition to Bruce there were three other individuals and I just wanted to say their names it was Cody Inc doll envoy Airlines Ric Hollenbeck from Avis rental car and Alma Hernandez from Hertz rental car when the situation escalated they didn't hide they were willing to come over and assist Bruce and their efforts enabled Bruce to handle it in a more efficient manner so just wanted to recognize those names publicly thank you greatly appreciated thank you yes do I have further public comment Diane Bates I'm the vice president of the Convention and Visitors Bureau I just wanted to let the public know that Thursday 5:30 in this room we will be hosting a Texas music friendly workshop on with the office of the governor's Texas Music Office we are seeking the Texas music friendly designation much like our film friendly designation and the public is invited to that they are looking for people who are venue managers promoters and musicians so we want to make sure that the public knows that they are invited to come to that do you want to talk about this yes I think at the last council meeting I did talk about our designation of the number two city by true West magazine in the top ten Western towns in the United States and it is hot off the presses available in your stores as we speak so if you are interested in seeing that please let us know you can also come by the Visitor Center we have copies there that you can look at you can't really take them but you
[0:21:50] can't look at them we don't have enough to hand out to everyone thank you do I have any further public comment with no further public comment we will close the public comment part of the agenda and we will move into the consent to the consent agenda I'm going to start with Billy do you have something that you would like to pull from the consent agenda I would like to pull item e mayor okay Lane I hate I want to pull the awesome okay Tommy okay with that may I have a motion to approve the consent agenda which will be a motion to approve items a B C F and G any public comment with no public comment we will take a vote all those in favor of approving items a B C F and G say aye not opposed that motion passes 7-0 we will now entertain item d consider approving the award of W you O 9 - 1 8 - online information services for collection purposes in the amount of 20% of the collection balance and authorizing city manager to execute all related documents lanced you want to talk through this morning council Lance Overstreet assistant director water utilities first of all was there any specific questions that you guys had in regards to the proposals no questions I wanted you to emphasize more of the importance of collecting the amount that is owed and the efforts going into that sure sure I can I can definitely do that the first slide we did kind of prepare something in the possibility this occurs and and right now the city is actually on a yearly basis putting about $500,000 into collections
[0:23:55] over a three-year period that's about 1.5 million and historically we have about 3.4 million dollars of outstanding debt that has not been collected over the years and so having an institution that has a very good track record of being able to recover those things is very important to the city and that's why we actually put out this RFP recently was to try to handle that you explain what this institution is doing different than what we have in place currently sure one thing that what we have in place currently has not yielded a really good return percentage whereas the the proposals that we have received this particular company has one of the highest return rates of being able to receipt to retrieve those things not only on the first year and for the first three years but even on some of the older debt and so that is one of the things the other thing that this particular company has as a benefit is that they have been doing this for quite a few years 60 years of history and this and the other thing too that we have seen with them is they have a really good precedent in terms of how they step through the contact collection processes the reporting to us on a very regular basis as well as the ability for us to go into a web portal on a regular basis and follow up on how things are going so that's how much what percentage of the uncollected is commercial versus residential at that time mayor I don't have that particular number and on this contract we pay nothing is that correct unless they collect something so we don't pay them a fee plus a percentage we simply pay them a percentage correct this is performance based so that way if they receive collections then they have fees off of those collections but otherwise it's it's no charge does do they have a standard do they have a percentage that they claim they have been able to collect from their other clients yes they actually have a
[0:25:58] historical average of 15% collection rate some of their clients I think ranged on the first three years from six percent up to 36 percent depending on the efficiency of being able to track those things the maximum is 36 percent yes ma'am and of the total dollar amount that is currently owed the city of San Angelo how much of it is within a three-year window meaning zero to three years versus older than three years it is approximately half of it is within that three-year period so our chances of collecting half of it are probably pretty slim that would be correct I believe that once you get outside of that three-year window the recovery rates actually go down to one or two percent outside of that 3-year window part of that is statute of limitations in certain areas part of it is being able to find people and track people down this company does have some fairly aggressive means in that they actually do credit bureau reporting which is something that we have not had the opportunity to do in the past and so if there is a individual that is just not pane they do have the ability to report to the credit bureaus they also are located in all 50 states and have collection capabilities in all 50 states with other utilities which the benefit of that is if someone doesn't pay here they move on they go to establish account in another location then this particular company has the ability to follow that path into those other other states as well what percentage or what number how many accounts does this represent I don't have that number exactly but I want to the 18 thousand roughly kind of sticks in my mind and at what point does the city of San Angelo choose to turn off their water if in fact they haven't paid because it seems like to me there's a huge dollar amount that we have here
[0:28:00] that I'm just questioning or asking not questioning asking the policy as it relates to how do we get to this point of this dollar amount right the the the biggest number of counsel we have is not necessarily the ones that we have shut off but it's ones who and vacate the city go to other locations and and don't pay off that final bill currently right now I believe that an account gets put into collections State for shutting off if they have a balance of 84 dollars that's carried for more than about 60 days and that's when they would then get a disconnect and then they could not reconnect until they have brought their account back up or put down a deposit to cover that and the deposit we obviously get the deposit back but obviously the deposit isn't large enough to cover the debts that exist on this five million bucks that is correct ma'am do I have further questions I want to ask you in the last three years that we started this how much money did we bring in or how much do they collect the first company I'd have to go back and look at documents on that I've seen that but I don't recall right offhand miss Gonzalez I know that one of the things that with our current company that has been very good for Municipal Court one of the reasons for that is because Municipal Court has the ability to also add to it you know other legal obligations if someone doesn't pay one of the things that we have not been able to do is do the credit bureau reporting and so in an instance where someone just isn't paying the current company has not really been willing to to go after them in any other form and so that is one of the big things that we were looking at is what our options are if someone is not paying additionally the other company that we're currently using has a pretty much a Texas only presence where as this company can actually with the 50 state presence has the ability to track them
[0:30:02] follow them along and try to do a better job of collecting if they move out of the state in how long is this contract for the one we're gonna be getting into they they are going to basically be one-year terms I believe the first one maybe two years but then after that one-year term and then this way we actually if for some reason we don't feel that we're receiving the the the benefit from having them we can at any time really is the dollar amount that we that is owed to the city is that principle only or is that what's owed plus interest and I'm assuming we add interest to the amount owed I believe that that is the the overall charges on the accounts whether it's fees interests all those things okay is are there further questions from Council on item D with no further questions on item D do I have a motion to approve with a motion and a second to approve item D do we have any public comment with no public comment we will take a vote all in favor of item D approving item D say aye aye any opposed with none opposing it passes 7 0 item ii consider approving source well or njp a contract number o 6 2 1 1 7 - e XM for the purchase of 8 mowers with the option to purchase two additional mowers from cross texas supply in the amount of 128 thousand seven hundred fifty dollars which is budgeted in the fiscal year 2019 good morning Ryan morning council my question is Ryan it seems like sometimes we bid out high dollar items and other times we
[0:32:05] don't and I just wanted you to step me through the process of why we did not have to bid this particular these mowers out sure and I may defer that to Candace our purchasing manager she may have a most appropriate answer thank you good morning Candace winning purchasing manager so the state laws that purchases over 50,000 have to be bid out it doesn't say that as a city we have to bid them out we can use competitive cooperatives that have a lead agency they bid out those items and we can purchase off of this a lot of times we get better pricing because they have a discounted rate for bulk for items such as like mowers it's a pretty industry standard item a lot of cities need that so it's an easy item to go there and find the cooperatives that we work through are there more than one in San Angelo the so the cooperatives are usually statewide or nationwide and then they have vendors on there and sometimes the vendors are local in San Angelo but the quality of itself I don't know of any station in San Angelo so we actually perhaps get a better rate for what we're purchasing by going through the co-operative yes that's always good for the departments to kind of shop around to see what the pricing is if they know you know a mower is gonna be 40,000 per mower if we went out and bought wine first is if we go on the coop it's 35,000 because we're they've got a bulk discount then it usually is better pricing and then some of the coops we actually get rebates on so that money comes back into a general fund for the city okay all right and you know what is the anticipated life of these mowers I'm gonna defer that one to Ryan I guess it depends if it rains a lot or not we're definitely using the more this last year then we have been but we try to keep these mowers less than eight years old
[0:34:08] with somewhere around 2000 to 2500 hours of mow time on them thank you that's all the questions I had do we do we put out I know that in the automobile business there is always fleet services fleet rate services that that people might offer do our local businesses have the opportunity to quote a fleet rate for something like eight mowers sorry I don't think I understand your question when one goes out to buy if you're a company you go out to buy twelve pickup trucks many times people have Fleet Services or fleet rates locally does this exist in this business as well it does not seem to we seem to find the the rates that we would be most interested in just from the municipal government side of it instead of a fleet rate in this case are there further questions from Council there's no further questions from Council Billy would you like to make a motion to approve yes I moved to approve item e there's a second from Lucy is there any public comment Thank You mayor Steve Hampton I have a question are these are these mowers serviced as the as the car fleet is and what is the industry standard on on the service times yes we do service all this equipment in a similar fashion to what we see with automobiles or other equipment in this case we service these mowers approximately over 500 hours for a portion of their needs and at lesser rates for other portions so for each
[0:36:14] manufacturer it might be slightly different but industry standard will be anywhere from 150 hours to 500 hours on something like this I'm sorry my question was not between service times but the total length of service well I think depending on how an organization uses a piece of equipment really needs to dictate how and when we cycle that equipment out of service in our case we definitely noticed a drastic increase in maintenance and repairs a little before that eight year mark so we start shooting for that in order to reduce our maintenance cost so as an industry standard I wouldn't know I think if you were a landscaper with somewhat limited funds and really self-reliant you would obviously be watching things very very closely with one machine and we watch as a group and we try to make those balances across our fleet so that we know where trends start to head as soon as they head there and so for us it's it's right around that eight year mark also downtime right keeping employees at work yes sir absolutely there's there's a huge portion of this that if if we have broken mowers then we're not working we're not mowing grass and so we do have to watch very carefully our downtime along with those cost that's right what happens in the winter time we get some time to service and when other times we do not because we do need them out working regularly we we try to get some of the major services or repairs or or updates or just inspections done and in the winter times there's another comment and the last question is you're buying
[0:38:20] eight here how many do you have in your fleet how many how many what is the percentage of replacement we currently have forty-three active units in our in our fleet of this type we we're - with these numbers that you're seeing here in the storm water division so they're getting four of these mowers and we're going to be adding two because of a difference in update to their practices so will actually be increasing their assignment slightly the rest of replacements so any further comment or questions on item e no further questions or comments on item e we have a motion and a second and so we'll take a vote all in favor say aye any opposed motion passes on item 7 0 moved the consent agenda and we will move into the regular agenda first item is item a first reading a public hearing of an amendment to the zoning ordinance establishing new standards for regulating mobile food trucks on public and private property in the city of San Angelo John you're on thank you john james director planning and development services this item as you mentioned is related to food trucks or what the state code calls mobile food units and so you'll notice throughout our ordinance that's that's what we call them but I'll I'll use those terms interchangeably some of the reasons where we looked at this our current ordinance really doesn't address food trucks we've sort of pieced together regulations there are current regulations for restaurants and so some of the rules that apply to restaurants apply to food trucks but as you can imagine those rules that are
[0:40:24] written for restaurants don't necessarily always apply appropriately to food trucks and so this is intended to address food trucks directly and and make some decisions about exactly how we want those to be regulated rather than just relying on other rules that were not written with food trucks in mind with that said there are really two different things we're trying to accomplish with this one is to allow food trucks in areas where we think they're appropriate again there are some locations now that food trucks are operating where they're not technically allowed and so we want to clean that up and we want you all to tell us where are those locations that are appropriate and not appropriate and of course I'll be presenting you what the staff recommendation and Planning Commission recommendation is for that on the other side of that coin we want to ensure that we're protecting the public ensuring that food truck operations meets minimum some minimum health and safety standards that we're appropriate they're meeting similar regulations as to what restaurants have to meet so we're not giving them special treatment as compared with restaurants but we're also recognizing that in some ways they are different and so some different regulations would apply so throughout this I'm going to talk a little bit about what the current ordinances say and what's being proposed and how those things different so as I mentioned under the existing zoning ordinance food trucks are only allowed where restaurants are allowed which basically commercial areas and so within residential areas even churches schools or even industrial areas food trucks would not be allowed under the current rules and so this would expand that into some of those areas where we think it's appropriate one of the points here is that for non-residential uses such as churches and schools if those have approval to be in a residential area then we think that a food truck is appropriate not for those as well whereas if those non-residential uses
[0:42:29] haven't gotten some approval to be in that area then the limitations are a little bit stricter for those in terms of look there's a distinction here I'll talk about right now we'll talk about private property as distinguished from parking in the right-of-way so the rules as you'll notice in this proposed ordinance are a little bit different in terms of what can happen on private property and what can happen in the street right-of-way so as we're talking about private property in any case property owner written permission is required that's that's the case today and the proposed ordinance makes that explicit you can't go locate on somebody's property without their permission we're also proposing that you can only operate from a location for three days in a row without moving and I'll get to the exception a little bit later but unless you're located at your commissary again I'll describe that a little bit more but if you're not located at your base of operations you can only stay in one location for three days at a time and if you're parking for more than four hours at one location you have to be on an all-weather surface which could be pavement concrete caliche even so the idea there is if you're there for a couple of hours for some event you can pull up on the grass and that's probably not a problem but if you're gonna be setting up there for eight hours two days we think that it makes sense to be on a all-weather service and then in terms of on street parking there would be no on street parking for more than four hours in a 24 hour period unless you get a special event so as I go through these many of these things can be varied through a special event permit that allows you to close streets that allows you to park in places you're not normally allowed to park so all the rules I'm talking about here don't apply if a food truck or a festival or something is is getting a special event permit that can also be it says you can park in the street for up
[0:44:35] to four hours but in locations where parking is restricted for example in parts of downtown where some parking spaces you can only be in for two hours or three hours that shorter limit would apply instead of the four hours we've also put in some restrictions recommended no parking within 200 feet of a public or private school without written permission of the school and talking with the School District they have some concerns about food trucks locating you know maybe just across the street from the school and interfering with their activities and so schools now already have some control legally within a distance of their schools this just lets them say whether or not a food truck can locate within that distance of the school again many of our schools allow different vendors to come in at certain times and so with the school's permission they can locate closer or even on school property also no on street parking near homes or apartments except in downtown get that the idea is you know we don't want food trucks setting up in the street in a residential neighborhood those need to stay within the commercial areas generally again some more on street parking rules no on street parking with 100 feet of an entrance for an operating restaurant except with the owner's permission part of the idea here is restaurants have made a significant investment in our community and there's some concern from some of the restaurants that you know if a food truck can pull up in the parking spaces right in front of their restaurant then that can negatively affect the restaurant and so this is as we looked at other cities this is something that some other cities have done is is place a spatial limitation on where those can locate in relationship to a restaurant I'll note here that the Planning Commission approved that at 50 feet separation as we looked and compared with other cities we're recommending
[0:46:38] that that be a hundred feet instead and then finally here on this slide the on-street parking must respect parking requirements in other words even today you're not supposed to park a food truck across multiple parking spaces so if it's angled parking downtown for example food truck can't come and park across you know three four spaces you're supposed to park legally one of the things we'll be looking at down the road is possibly designating specific food truck areas particularly in downtown but again this this is really not a new regulation this is just basically restating what's in the parking standards already in the city and then we looked at some public safety issues Mobile's the food trucks can't or their customers or seating areas can't block fire lanes driveways sidewalks etc so we want to make sure that those are clear as well as visibility for intersections we don't want them parking so close to an intersection that it makes it hard for cars to see you know on the corner and so those are things again those are both things that we already have the ability in force we put it in this ordinance just to make it clear that those do apply to food trucks as well some other various rules must have trash cans on side that's already a component of the health code and must clean up trash associated with the business these are just making clear to the food truck owners that they're responsible for the area around their truck where they locate and if if they or their customers have trash after they're you know at the close of business they're responsible for cleaning that up before they leave they can't just leave with you know customer trash littering around where they've set up in parks we've said parking only within designated areas and so I know the parks department is going to be looking at what are the appropriate
[0:48:40] areas within parks where food trucks can locate but in terms of this ordinance we've just said in designated areas in parks and so that will be determined at a later date we've for residential areas and Parks we've proposed a hours of operation limitation so 7:00 a.m. to 10:30 p.m. so in those areas no operations after 10:30 p.m. but in other areas like commercial areas we have not proposed any hours limitations and so now that all of that we talked about up to this point or many of those requirements apply for mobile food trucks that are moving around not located at their commissary and their commissary is what the state health rules term their central preparation facility all food trucks have to have a base of operations that they go back to to empty their trash empty their waste water do all those kinds of things that they can't maybe do on the mobile food truck and so each of those has to have a commissary where they go back to if you want to locate at your commissary you can be located there more than the three day limit in other words you can basically set up mostly permanently if your locating at your commissary commissaries are located are allowed where restaurants are allowed because they have many of the same type of facilities if you're locating at your commissary on a more semi-permanent basis and you would this ordinance does require that you would be on a paved surface and a lot of these rules that we're talking about for food trucks that their commissary are sort of leveling the playing field with the kinds of site characteristics that a restaurant has to meet for example we the ordinance would say that they would have to comply with zoning rules for things like setbacks and parking and fencing in other words
[0:50:43] if you're gonna set up at a site permanently and not really be mobile for the most part you're gonna have to meet the permanent size standards that other businesses have to meet as well you must comply making it clear that they must comply with special rules within districts such as downtown or the river corridor they're gonna set up semi-permanently like that then for example if they're near the river they would have to go to the river corridor or the downtown or the design and historic review commission to get approval for their site design and a site plan would be required to ensure that they meet all of those standards like parking and fencing and those sorts of things I know I went through that quickly and I'm sure you have questions that's kind of the overview of what's in this proposed ordinance staff does recommend approval the Planning Commission also recommended approval of this unanimously and I should mention again that one change from what the Planning Commission recommended to what we're recommending today is that change from 50 to 100 feet on the distance separation from restaurants again I know a lot of the things we talked I spent a little more time on were the restrictions but I want to reiterate that right now food trucks aren't allowed in many areas of the city where we think they should be allowed and so a lot of what this ordinance does expand where food trucks can locate in the community with that emissions Tom would you like to ask some questions example of where they're not allowed to go now uh as I mentioned the industrial areas so an industrial park for example you know food truck wants to come at lunchtime in front of a business in the industrial park if it's zoned industrial right now it wouldn't be allowed a church that's zoned residential II many of our churches are in neighborhoods and they're zoned residential E so under our current ordinance technically those food trucks aren't allowed to locate there that's something we haven't enforced
[0:52:47] largely because we wanted to bring this to you and see if you think if you think that's correct the way it is that it they shouldn't be at churches and residentially zoned areas well then you know we can write the ordinance that way and then we would start enforcing it but you know daycares other kinds of facilities that are located in residential areas even the parks many of our parks are zoned residential E and so again technically those food trucks wouldn't be allowed in a park that's zoned residential under the current ordinance do I have questions Billy so if they get though a special use permit for instance you're having a child's birthday party and you want to do a food truck at your residence we can come to the Planning Department and require whoever and request a special use permit for up to four hours did I understanding that you could always get a special event permit which is a little bit different the special use permit is more of a permanent zoning issue so a special use or a conditional use would be something like a church would get to locate in a residential area and that would be a permanent designation for that to locate there but a special event permit would be what you would want to get for a short-term event say you know festival or closing the street for a neighborhood block party that sort of thing but that would be allowable and my second question is when the food trucks are located at their primary place of operation the commissary as its termed they don't ever have to move or do they have to move periodically well they still have to be mobile per the food the state food rules and so I might defer to to Teresa or Sandra on exactly what that means but they do still have to be mobile and prove that mobility to get their annual food permit but from a zoning standpoint yes they can they
[0:54:52] don't have to move if they're located on their commissary site but they still may have to because of the health rules at least annually and maybe more often than that Jones correct that if we if they're gonna be considered a food truck they still have to meet those requirements that Sandra has under the health code food trucks have a different impact on the community and on the safety for the community than a standalone business or a standalone restaurant well and so if they want to be a standalone restaurant we can help them do that but if they want to be mobile there's gonna be less of an impact typically and so we're gonna have lesser standards but to get those lesser standards you are gonna have to demonstrate still mobility Lucy you had a question or comment yes Mary um I just went to ask on the on these food trucks did it I know that they pay taxes but can you explain that a little bit as far as the taxes go that they have to pay what else might be better able to answer that I'm I know that they pay sales taxes on the food that they sell obviously they would if they have a commissary site that they own they would be paying property taxes on that I don't know if the food truck itself pays any sort of property tax how much is their permit you know like when you go and get the permit how much does that cost I would defer to Sandra I don't know what those permits cost Sandra would a second sender if you'll come forward I need Sandra medium health director yes the permit is $150 per unit for if annually long yes ma'am annual permit and according to I just wanted to say which Arisa said the food rules the Texas food establishment rules do state that the Mobile has to demonstrate mobility at least once a year so this particular year we started something brand-new so all of January because we are in the actual a permit process renewal process and so we are actually
[0:56:57] requiring each mobile unit to come to City Hall and demonstrate mobility make sure that everything's in operation and all of that so last month we sent out a letter and I believe that you got a look you got that information excuse me in your Friday packet so anyway and we are doing that we are trying to follow the rules again the permit $150 per unit so any other questions okay Tommy a couple questions for John I'm assuming but so not to assume do they make a declaration at the time they seek the permit of the commissary location so that we know where the home base is yes when they get their health permit for the food truck itself they have to designate where their commissary is and could that be a residence in a neighborhood could the commissary location be a residence we actually have not allowed that the food rules really state that it has to mean well we can't permit facilities at home so we just have never gone there and we've always you know told the applicants that they have to go to a zoned correctly part of the city and with the application we actually have a packet we send the applicant especially if it's a brand new one brand new establishment we send the applicant to planning and we actually get signatures that they have spoken to zoning permit it's planning and the fire marshals just to make sure that everybody has had a chance to speak to the applicant and just let them know of all of their rules
[0:59:00] that are in requirements for each of those mumbles so uh thanks Lucy you had another question before that if I could add one more thing to Tommy's question this ordinance says it's written does clarify that and explicitly states that a commissary can only located and in a zoning district where a restaurant would also have good thanks my next question is um who's gonna enforce the three day rule as far as for the mobile food trucks like who's gonna be the one to say yeah you've been here four days or five days I think that's something maybe still to be determined it would be a combination of planning development services staff code enforcement perhaps even police department would assist with that but that's something once an ordinance gets adopted in place we'll look at for each different type of violation what's the most appropriate enforcement action there any further questions from City Council members Lane can you just explain the concept of commissary for the public to you can you give an example of one of our food trucks that is in a commissary style permanent basis operating out of Andrew may be better able to answer that because issuing those permits and notice which ones and what their commissaries are I know a few I just want a clarification on that for everybody watching actually commissary is actually a central prep prep facility or a servicing a servicing area that is your base of operation and it all depends on what you're doing on your mobile as to what your base is going to do for you if you are self-contained and everything is happening washing your pots pans everything is in your mobile then you would not need certain things in your servicing area or central prep facility now if you let's say your central prep you're going
[1:01:03] to be prepping cutting chopping and all of that then that's going to require more things at your base so it all depends on what's happening on your mobile as to what that base is going to do for you I'm going to throw a couple names out there does that just come to my mind as a what I would think as a commissary with the Hamptons aides style of commissary yes I'm starchie's burger the pit don't have to move every three days they are next to their commissary so we have allowed them to stay close to their commissary just because they are because according to how the ordinance is right now is stated they can be there three days but they've got to go back to their commissary well these folks are already at their commissary so we have basically allowed them to stay at their comments the three day rules out the door for them and they would just have to prove mobility and they must always be readily mobile according to the food rule so the tires always have to be inflated I mean we can actually ask them the inspector can go and say I need you to go around the block or something like that just to demonstrate mobility but we are going to at least limit it to that one time per year I'd like to add to that something that John mentioned is that if they are going to operate from their commissary there are going to be site plan requirements and other requirements to make sure that the public is safe and that they have appropriate parking and those sorts of things so it's not just a matter of move and then you can park if you're gonna park and operate there there are some some limited things that they are gonna have to demonstrate yes John or meetings held with food truck operators and owners to get their input on this proposed ordinance yes we had we had an initial forum and those dates are in
[1:03:08] your packet on January 30th 2018 so just about a year ago we had a first forum to talk more generally that included these kinds of issues but also health permit rules but then as we got to a draft list of ordinance standards we held another forum September 5th 2018 so a few months ago invited food trucks and restaurant owners and anybody interested and presented our thinking at that time in addition to that of course it went to the Planning Commission and there were folks who came and spoke at the Planning Commission as well and then so now they have this opportunity to speak to you all so we've we believe we've given them the opportunity to number one understand what we're proposing but also have opportunity for input and many of these rules were changed in response to input from the food truck folks to make sure that this you know is addressing some of the concerns they brought up for the restaurant owners that participated where they generally satisfied that all of that their interest were being represented that's well it's a little difficult to say that there were not that many restaurant owners who spoke there were a number in attendance at those forums but not many of them spoke and so I would be a little hesitant to try to characterize that I know there are some restaurant owners that have concerns and perhaps think food truck restrictions should be more restrictive but our goal here was to try to balance those concerns of restaurant owners versus the concerns and needs of the food truck operators and so that's that's where we tried to try to balance those different concerns but I wouldn't say everybody is 100% in agreement with everything in here are there any further questions if there's no further questions may I have a motion to approve the food truck ordinance as presented by John James second public comment please
[1:05:18] Steve you Hampton I have three questions the mobility Dimon's has to be demonstrated once a year it's a motor vehicle don't they have to renew their licenses and they have a state inspection so why are we involved in that unless it's a trailer or trailers involved in this okay the other the second one is parking surface I find that particularly obnoxious that you know you can't for hours on dirt and you got to move who's going to be watching you know you could move down to the other end and is that qualify there's a lot of this is kind of vague to me the permits the permits he said that you you go down and get a permit but if it's over here you got to go over here to get a permit and we were trying to get a one-stop shopping on permits organized for other things why not this further public comment if you'll please state your name alright um my name is Tim Condon I'm the owner and executive chef of Lone Star cheeseburger as well as angry cactus I'm a single dad with a 14 year old daughter that goes to central we live here in San Angelo I have a house here I pay my property taxes I'm extremely involved in the community I'm the president of the San Angelo Restaurant Association I'm on the Convention and Visitor's Bureau I'm on the Cultural Affairs Council I'm also sit right there where you do Harry for civic events I love San Angelo I moved here 10 years ago from Honolulu Hawaii paradise right Honolulu Hawaii
[1:07:25] San Angelo is where I choose to live now there's a lot of reasons for that I'll explain I now own two restaurants here in town I've contributed over 1 million dollars in state and local taxes I mentor kids at Central that want to be chefs just like I do I've never worked a day in my life because I love and I am extremely passionate about what I do I'm a chef I wake up every single day excited to feed people tonight at angry cactus I get a battle one of the greatest chefs in San Angelo for a food fight we just thought of this one day I get a wake-up every day excited to come to work I've never worked a day in my life I am a Saint Angelo success story I moved here when I was 25 years old with the dream to sell as many cheeseburgers as I could and I did it think about this for a second guys I own a restaurant it's one page to get a health permit there's 600 restaurants or more that have health permits in the city of San Angelo and it takes one page to get one of those this is where bureaucracy is its worst you ready for this to get a food truck in the city of San Angelo all right there's about what about 30 maybe 20 food trucks that have health permits in the city of San Angelo only five of us are operational okay every single day it takes one two three four five six seven eight waiting on nine pieces of paper you have to fill out to open a food truck in San Angelo Texas ten years ago it was 110 years ago it was one that is ridiculous guys everyone up here runs on platforms of taking the government and getting it out of business anti-regulation smaller smaller government more efficient government right I had over 50 members of the staff stand at Lone Star
[1:09:29] cheeseburger on July in July and watch me move my trailer that I brought here from Dallas Texas around the block to prove that I'm readily movable okay think about that for a second this trailer that's been sitting there for ten years has to drive around the block to prove I'm readily let me get to the regulations that we're proposing if I do I know I'm taking my time you've got three minutes me so you need to wrap it up all right I'm gonna talk about the regulations that they did not mention we are now required to have a generator and go to City Hall and prove that we are operational at City Hall I don't have a generator any food truck that operates at a commissary doesn't have a generator we don't have a way to do that we must have full water tanks when we go to city city hall which is not required by law also none of the food trucks that operate at their commissary drive around with full water tanks and I'll tell you why that's really heavy suck a piece of paper through their vent system I've been doing this for 23 years now I've never even heard of a standard that takes a hood and makes you suck it through a ventilation system there's many more to counter many more things that we have to do we have to go to DHR see if we're gonna be in river corridor we can only work operate from 7 a.m. to 10 p.m. as it was stated add different surfaces all that kind of thing this is the bigger picture these are business incubators for my industry if you want to open it and have a dream and be a chef one day and start a business in San Angelo Texas that's the way to go start a small food truck and grow up and maybe become successful every single person that has a food truck has a dream a dream to become successful in San Angelo Texas we all want San Angelo to be a tourist destination we all want San Angelo to thrive in downtown food is just that same way it's a very important component so I call on you guys please that of any added regulation in regards to the food truck there's no broken system here it's been working for 10 years there is no broken system the only people that think it's broken is certain members of city staff there is no broken system when it comes to food trucks for
[1:11:33] ten years we've been successful so I gladly ask every single one of you guys to clearly consider no additional regulations for food trucks it is red tape and so I want to just demonstrate this and I will have plenty more but we want to cut the red tape and not add red tape to the food truck industry it's an important industry it's personally important to me because it is my always been my dream since I was 13 years old to be a six full restaurant or a successful chef and it always starts at the food truck level and so getting out of regulation on food trucks is the way to go any additional regulation should not be tolerated thank you very much do we have further public comment and I can answer any of the regulatory questions as well if you're interested in the actual nuts and bolts of what is being asked in the I have further public comment we ask that everyone limit their comments to three minutes please it is more of a question sure please state your name for us if you would Adrienne Soto you had talked about moving the food truckers had to be 100 100 feet from restaurants let's say Hamptons barbecue right now where they're currently at if a restaurant were to open up next door could I close them down with our zoning rules like this once something is in place and permitted they're allowed to continue and so if a restaurant located within a hundred feet that existing food truck operation would be grandfathered or considered non-conforming but allowed to continue as long as they they stayed in business another question I had so I saw that you were wanting to change more rules as far as like of a truck was to operate as a commissary they were going to need to have certain things that a restaurant has and I think that's the
[1:13:35] biggest issue for me I was a food truck now I'm a restaurant but there's a lot of misconception as a lot of people think that these food trucks don't have to meet certain requirements but that's not true the only the only difference is between a food truck health health-wise it's all the same it's safe for everybody they're gonna go through the same rules as far as the building they might need a restroom that a food truck wouldn't have for their guests and it might need some parking spaces outside of that there's no real difference when a truck needs to demonstrate mobility it's honestly pointless it doesn't do anything for anybody if they're operating at their commissary we're saying that it's safe a commissaries basically just has everything that a restaurant has between the truck and that commissary everything that a restaurant would need it already has so we're making them drive to downtown it's pointless if you're gonna add more rules and say that we need parking and whatnot then it's truly a restaurant at that point I just don't see the need for it we see you want to address the issue of mobility the issue mobility comes in the Texas rules that's where you're required to demonstrate mobility we have decided that the best and most consistent way to do that is to have you drive downtown I don't think Sandra mentioned it but it should be noted it did come up that you know vehicles who are like trucks who are food trucks they have inspections and so why do we need to check for mobility trailers also we're supposed to have an inspection sticker and that's one of the things that will be checked this year to make sure you have an inspection sticker from GPS to make sure you're street-legal but the whole idea of mobility comes from which set of rules do you want to apply if you're not going to demonstrate your mobile we have a different set of rules for that and we can help you accomplish that but you want to be a mobile food vendor therefore there's a different set of rules that our state of Texas rules I'd also like to point out that a lot of the regulations that mr. Condon referenced in the meeting today are not what we're talking about today what we're talking about today is really lessening restrictions on food trucks letting them operate in places these are zoning rules
[1:15:38] the issues with the food regulations there's the Texas level in the fire code regulations and all those are not what you're deciding today you're deciding the zoning issues where they can park where they can operate I just all I'm saying is it a lot of such as didn't seem necessary point is is that that's a state law that is has nothing to do with what we're determining today do you have the ability to create we have our own Health Department and whatnot how to operate you'll have the ability to do that we don't always operate by what the state things the Health Department for instance if we did by the state it'd be a lot easier if we went by state code well we go by our own health code so I'm gonna reply to that Theresa when I look at what the health rules are that we have in our for as far as the state rules and buying those basically what we say and Sandra you probably know more the details is that we're gonna apply the state rules to you and to demonstrate mobility which the state rules says we need to do we're going to ask you to actually move so we are applying the state rules I don't think they make they bring their trucks downtown now they give us the ability to allow to make that happen we had this whole conversation back in July I know it doesn't specifically say that you have to make them come downtown it does say here we thank you you can determine how you demonstrate mobility including moving and the easiest way to demonstrate mobility is to actually move okay well thank you Billy did you have a question have a question I'm Teresa we're talking about food trucks and demonstrating mobility if a food truck has a commissary can they apply to become a restaurant so that we don't get into the minutiae of mobility demonstrating mobility okay yes first of all today we're not talking about mobility again that is part of that other regulation we're not even addressing today but if the way we drafted this ordinance is that we have
[1:17:40] sections if you guys want to say if you're going to stay at one location and operate like a restaurant just follow the restaurant rules we can do that we can just delete that section for second reading where it allows you to operate at your commissary that is something that we can allow most cities do not allow food trucks to operate permanently at one location this is going to be a unique Saint Angelo situation and if you're interested in not doing that we can certainly delete those provisions when we bring it back for second reading but because we have a number of food trucks that you operate mostly from the restaurant that they're associated with and that seems to be a popular thing here we wrote regulations to allow that to continue and also address the safety issues that arise from that I just wanted to be clear that there is an option if you don't want to demonstrate mobility that you have the option of becoming a restaurant or applying to become a restaurant absolutely and we are happy staff I know is happy to meet with anybody who would like to look at what differences and those regulations are lane you had a question for Steve maybe earlier I did the first one was related to his comment of the four hours to eight hours of parking on grass okay this is actually more for John okay John the way that I see it because of the weight of the trailer and John you might explain this better the weight of the trailer after a certain amount of time it's going to make it's gonna cause damage to an unimproved surface sinking down into dirt especially after a recent rain if it rains here for more than an inch and a half and they go park on it three days later they're gonna start sinking a little bit is that kind of the process of that sure that's part of it it's you know the weight of the trailer customer traffic if you're set up for a long time people coming and going and oftentimes these are set in locations where cars just pull up to them and so it's all of that sort of thing it's also
[1:19:44] that issue of if if you're locating at a site with a regular on-site business you have to have paved surfaces you have to meet these standards of what we call our site development standards and so what this is saying is if you're a food truck and you're gonna operate at a at a single location for longer than a certain period of time you need to meet those same rules that everybody else has to meet that's where our relation right now correct well again for food trucks it's it's not clear that those all of those rules apply because ordinances just don't mention food trucks so part of this is as I go down through this a lot of these things are already in place but there's been some argument and so is that the case or is it not this just makes it explicit one way or the other so that we're not arguing with with food truck operators well is that really what the rule says we're just making it as explicit did you have further well when I first saw the four hour I was thinking about the same thing of Steve this is is this a little bit more overstep but I can see because I have trailers and the weight of the trailer will sink down into your yard in cost and damage and again for that provision you know like a parking lot for a business has to be like concrete or asphalt right for this provision all where they're surface in ordinance means something broader which could allow gravel caliche other other kinds of surfaces that don't necessarily mean it has to be pavement absolutely the second question I have and I have three total is moving 2 to 3 feet feasible is that okay to prove mobility instead of taking it around the block or going in this ordinance today is not addressing anything about mobility that's in the food that's in the state health code in our local health code rules so that's number one I would defer that to to either Therese or Sandra but again that's not decided so we can fight that another day this is this this on the agenda today is actually allowing a
[1:21:48] broader spectrum of where they can operate I can see that is that so this is another question for a fight of another day we needed to explain the seven extra pages of the permitting that Tim Condon put down defer to Sandra on that I'm not sure what a normal restaurant has tuned this one has nine so it's seven I do know there's a food truck application then there's a separate one for your commissary yeah but that's not we're not voting on that today we're not voting on that a restaurant has two sheets of paper a risk a risk form in the actual application the mobile food unit has a risk form is the actual application we need a commissary agreement because we want to know where their commissary is and we need a restroom agreement there's other information they just have extra information that they need to read and that's the packet that I submitted to or send the mobile units but what I need back what we need back for those four sheets of paper commissary restroom the application and the risk just two extra ones commissaries require restrooms a DA and a lot of times sometimes the commissary is necessarily owned by the person who is operating in business so we need that to prove that they have an agreement as well with whoever owns that building for example if you are renting the location or let's say Golden Corral wanna see Golden Corral they have a mobile unit but they also have its Golden Corral they don't need a commissary agreement because we know that's their commissary so just to clarify today we are just broadening the spectrum of operational areas Daniel do you have a car I just I'm curious you we're talking about nine pages here we just heard it's actually four pages Tim would you come up with

[1:25:52] paperwork by the end of this month then we're get some type of fee tacked on and if somebody were to come in and do a brand new food truck to go through the same process they could do at any time of year and not get any fees they just have to pay the hundred fifty bucks so that's just kind of weird as far as the zoning last time when we had a meeting I brought up about the parks and that I saw see that that's kind of a thing that we're kind of talking about but nothing got resolved in that you're already gonna you know vote on this and approve it but the zoning for that type of thing parks are a great utilization point for multiple people to come that is not in a residential area that's not conflicting traffic downtown or anything like that I don't see why that isn't already something that was prepared to be decided on its own and this is a zoning meeting so why wasn't owning involved in doing that a couple of things I guess there's a fine line somewhere becoming a restaurant and a mobile food and your own commissary there's some line there so like for us why couldn't we be our own commissary we have three compartment sink we meet all the safety requirements all we need is a bathroom sewage drain and water supply we don't have any raw meats or anything like that so it's not a health hazard most of its sugar and flavor and so as long as we meet that but we wouldn't want to stay there we still want to be able to go to festivals and things like that but if we were to be able to hook up I don't know if you'd call it but I just don't see why we would necessarily need a commissary if we're meeting all the necessary needs right where we're at without that [Music] and then there's some would you like someone to answer those statements before you move on to the next one okay John or Teresa do you want to comment on his statement parks ordinance does allow them to operate in parks and designated areas and I don't know if Carl's in the room but Carl already has a list of areas that he's considering is
[1:27:54] designating for allowing food trucks I mean there's concerns particularly around the lake we have to watch out for but that is addressed in this ordinance back to why is the commissary required that's in the health code rules that's not what we're talking about today again Sandra may be able to answer that but again we're not talking about commissary requirements mobility any of that stuff that's in the health code today we're just talking about zoning and where food trucks can and can't operate and what sort of site characteristics like parking are those sorts of things not the operational characteristics thank you would you like would you like to come back forward and make your another comment so I think the commissary issue is a zoning issue because where can we park some are parking in their commissary and where that zoned if it's a if the area that I'm parked in is zoned for commercial why do I need a commissary research John would you like to answer that or Sandra I think if I understood the question right now again anything classified as a food truck can only locate in a zoning district where commercial activity is allowed so today again I know this isn't I know this is happening but if so let me preface it by saying if you were to say we don't want to adopt any of this today we would take that as your acknowledgement that the current rules are okay which means snow cone trucks food trucks could not locate in any residential area in any park churches schools daycares any of those locations I went through this proposed ordinance and noted each of the items and 15 of them are only restating things that are already in the
[1:29:56] ordinance but we wanted to make it clear that they apply to food trucks but we're already applying them today to food trucks five of them are expanding where food trucks can locate and then there are only seven new restrictions like the paving like requiring parking at your commissary and so of this whole three pages of ordinance there are only seven new requirements that are being listed here and again five of the things in here expand greatly where food trucks can operate and so I just want to make sure we're not getting confused on what this is actually doing when I do want to point out as well as a gentleman make a comment about the Zoning Commission actually planners only did review this November 19th and they were unanimous in their approval and recommendation to City Council correct that's right thank you further public comment on don't escape so he talked about five things that expand where they can work give me the two that seem to tighten it up because I think what we need to be talking about areas is a hundred feet good there's one of them that's 50 feet that we think needs to be a hundred feet the rest of it is the hundred foot perimeter it expands where y'all can take your trucks and go I understand the commissary there's some things here and I'm going to use a phrase I heard this morning it's not only for us to look at in value we also have to follow the rules but from some convenience store history and we do happen to have a thing a rodeo and Bob Bluth art will tell you we have food trucks and safety of our can people to come out there you know we're looking at food storage temperature control I mean there's safety factors that all of us bear when we look at this I mean we're not just here to make things more difficult I'm looking at this is that it probably opens up a lot of areas you can go and you don't have to go down the paperwork process so John give me the two things that you think are the limiting factors here oh now there were seven total that right so I'll just briefly go down through those one is that if you're at a
[1:31:58] location more than four hours you have to be on an all-weather surface one is that if you're gonna park in the in the street you can only be parked in the street for hours at one location can't be within a hundred feet of an existing open operating restaurant you can't be within 200 feet of a school without the school's permission if you're operating from your commissary you have to be on a paved surface and if you're operating from your commissary you have to comply with other zoning rules like setbacks and and those sorts of things and that actually covers really six if you look at it that way okay we have further public comment good morning miss Carlos Rodriguez I'm the owner of cone ice of San Angelo we've been here around ten years and John had mentioned how restaurants have been good community partners you know what I wanted to talk about how food trucks are also great community partners you know we are a shaved ice truck you know our our typical our customers around seven years old and we we have given back over fifty thousand dollars to our community through fundraising or just helping nonprofits and so do the food trucks when they have a church event to fundraise or some it's the food trucks that are there and that are given part of their profits back to that community to that to that place we talked about less restrictions and the whole hundred feet from a home or whatever we go down neighborhoods okay we're within that 100 foot barrier we do birthday parties like you mentioned and and that's a big part of our business and I see being difficult
[1:34:03] to have a you know a mom that has a three-year-old when to do a birthday party I have to down to the city and get a special event permit or whatever it may be so we can park in front of her house for about 30 minutes to do a birthday party it's that's kind of hurting our business a bit but I see in my in my point of view I see more restrictions with this new ordinance for me you know we we go through the same we go through we have to have a commissary we do shaved-ice you know like you said you know it's ice and water ice and sugar and we go through the same health permits and inspections and as a food truck we are designated as a food truck but I can see as my time but I can see an ice cream truck that doesn't have to go through a health permit that can still go down the street they don't require any permanent really at all because they'll have a packaged product so they're not considered a health a food truck where they can still go park in front of a house for a birthday party still go to the park still go down the streets where I may be limited because I'm doing a shave nice thank you for your comments Lane did you have a question or a comment I guess I missed this the four hours John there was a comment about four hours in one spot not on the unimproved surface but you could Park in are you saying that you could park in a church parking lot that's not paved for three hours falling church service I thought there was another comment correct if there's long I'm not talking about the unimproved surface for more than four hours but was there another comment about just being in a spot for four hours that's only in the street right out on private private property you could be there for up to three days so if a food truck wanted to go park down by the river on a Saturday if it's more than four hours they're not allowed
[1:36:08] correct if they're parking in the street the limit would be four hours approved parking areas on the river we're looking at that through Coral if it's in a park yeah Carl's looking at designated areas yeah well in that River Road along the river is technically not a city street it's technically a park Road within a park and so there are some distinctions there that yeah Carl could allow that location in particular but on a regular city street the limit is 4 hours John one more to clarify he indicated that at a birthday party a mother would have to come get a permit from the city I don't think that's the case they could come Park in this current policy on their driveway your driveway or you know we were talking about this ordinance Kona ice actually came up because he's right ice cream trucks have a different set of rules because it's packaged ice cream but they really operate like an ice cream truck so what we talked about is whether or not you know there's shaved ice places that that's all they sell cuz I don't think Kona ice is the only one whether or not they should get essentially the ice cream exception they would still have to be permitted through the state that through that through the Sanders rules because it's not prepackaged food but as far as you know they don't stay there from for hours at a time generally they stop and you get your snow cone and they move on so that's certainly something you could direct us to incorporate into this is an exception for those novelty kind of trucks that so that I mean that was an issue that did come up if that's a concern I think I think that's right the way this is worded no food truck Inc including a snow cone stand could locate in a residential area like you and I discussed yesterday in our meeting if
[1:38:11] I'm wanting to cater a food truck they can in a residential area I'd be different yes if it's if you are catering a private event that would be different versus setting up in the street and you know just so all the neighborhood kids can come that is something we may want to look at and we'd like your input on maybe we're okay anywhere even in residential areas for them setting up permit maybe an exception for snow cone and ice cream truck for their public comment alright real quick so was there already designated areas and parks are a coral or was gonna come up with that or I was I guess I missed that it's okay he'll come up and address it there are not currently any designated areas in the parks we're thinking of places like Kirby Community Park producers community park maybe you know that part a little more park the popular parks that aren't embedded well it with residential areas and we would take that to our Parks and Recreation Advisory Board discuss that and they would make a recommendation as to what areas that today's of Nate we want to stay well away from houses that make it safe and accessible to the public and the food trucks to use but you do currently have areas located for example on the river that people who have events on the river they can have food trucks there correct so that's already done as it relates to the downtown River right and through the special event policy and the ordinance is already in place for special events you can bring food trucks in for those special events and exactly where they are we let that special event person propose and then we review it the way the ordinance is for parks because most of our parks are in residential areas that's very restrictive for food trucks to operate except down in the central area like you mentioned we want to open
[1:40:16] that up make it easier for food trucks to come to can you give him some sort of timeline in terms of when Park and Rec will come up with the guidelines because certainly spring is coming soon they certainly would like to make sure that they as spring comes that they understand what their opportunities are so can we just make it yes sir for he answers that one thing we were waiting on to see how this passed today if it gives us that flexibility then your timeline kicks in right we'll have it on the agenda at this next meeting ends in January okay so it'll be immediate okay further public comment sorry about that guys I just want to follow up with the I I'm getting confused on the narrative that all the staff keep bringing up that this is less restrictive I don't know what they're reading but all of these things are additional requirements to go to d8 I have to be approved through D HRC now because I'm in river corridor I don't know if you guys know my history with D HRC but I spent six months of my life trying to get a cactus on a roof okay we're going back to this bureaucracy at its worst type of argument here we've got to now have permission get a special event permit to park at schools or churches that's never been anything before to get a special event permit if you're going to stay more than a day or two or at a certain location these are more restrictions this is an absolute absurdity that anyone can sit here and say that this is being less restrictive than the current status quo it's not this is three or four pages worth of things that are additional requirements that have never been required before my food truck is 40-foot long by about 18 foot or about 15 foot high all right that is a sign that has to go through the D HRC process if you guys are going to enact some of these things this is not a this has nothing to do with making it easier for food trucks to operate this has everything to do with trying to
[1:42:19] get into the situation where we have to start paying for special event permits now for random events we've never had to pay for it before you know if we pass these kind of things this three day rule how what did the rodeo people gonna do they're gonna be there for longer than three days you know why are we going to make all these random exceptions for every different kind of food truck the whole point is these commissaries are the supplementary area that these food trucks go the commissary has every single thing that you need to be operational all right it's a simple thing for 10 years I've never had anything less than a hundred percent credit score I mean a hundred percent Health Department score this is an overreach this is planning should not be involved in things with wheels what Wyatt what is a planning department have to do with things that have wheels on them that aren't permanent planning is for permanent buildings planning is for convention centers to plan that to plan the way the city streets are plumbed to the public utilities they have nothing to do with with food trucks these are more regulations not less or the public comment just state your name again if Hadrian so done so the question I had was the hundred feet so I was just trying to think about instances that would it could come up with right so it feels a hundred feet within a restaurant would that mean like no trucks are gonna I don't operate on Chadbourne but that means no trucks and operate on chatter and within France s tangos and angry cactus would that eliminate any truck use within any of the bars it would it would kill any business that would want to operate right there they would not be allowed to so that would be an issue I think it had John go ahead and come up and answer the question we'd have to measure to see if there's any spaces that could fit but again under under current rules and under these rules food trucks are not supposed to park across multiple parking spaces so we'll have to designate some spaces downtown to allow food trucks to do that anyway and so then if we designate spaces that could you know we could decide to overrule
[1:44:23] this hundred feet if you all decide those specific locations within a hundred feet of a restaurant are appropriate doesn't that also say during normal operating hours yeah once a restaurants closed so if a restaurant closes at 8:00 after 8 o'clock they could locate permission so it's either a number of the downtown establishments who actively encourage food trucks to come and so we would give that permission distance door-to-door and chattering from side to side yeah I just looked at measurements for 200 feet so I'm pretty sure that that would definitely be an issue between those three areas that you would definitely run into something the next thing is I totally in for like the parking spaces on Chadbourne or something but there's nothing there right now and it's really you'd have to be in the business to kind understand if you're gonna go downtown you got to go downtown early because it feels up right it's not because you want to the business isn't there until like ten o'clock one o'clock in the morning but if you're going to get a business like you're gonna be down there you got to be down there early and if you're having your food truck 15 foot trailer out into Chadbourne you're it's too tight already as it is we're gonna need those spaces designated before you really look into doing that that's just what I would think you'd fix that issue first and then you come and say okay we've got this issue fixed now you can only outside that parking area or in within that parking area if you look at the signage downtown right now it says from 8 a.m. to 6 p.m. you're limited to 3 hour parking a.m. to 6 a.m. 16 mm okay what after I'm talking about after that that's usually when the trucks are downtown it's usually after 6:00 p.m. there's no limitation in terms of the timeframe on parking okay it's a pice of that as well in the four hours the four hours well so if you parked there at six well there's no
[1:46:29] limitation to parking after the hour six o'clock including with that that means like I could go there early after six o'clock and be there and it wouldn't be an issue if I was doing business there it's correct cuz you're on permanent surface yes ma'am come forward please state your name I'm Adrianna partita I am a husband we own Adrianna tropical snow you talked just a little bit louder and into the microphone and we've been in business for five seasons now and we do not go all year long because it's seasonal its shaved ice who wants it during the freezing weather um so my question is so since I've been in business for the past five years pretty much my information stays the same I bought a house last year I moved so I had to refill out all the forms one thing I am very grateful is that it's one stop I don't mind bringing my trailer out and whatever I got to do what I got to do right I got to feed my family um but this year I got a whole new packet again in the mail also letting me know about this meeting um so do I have to fill out all that information all over again with all the same information that is already in the system that you guys already have no I already filled out that from last year so but I got the I got the same packet again like if I'm a brand new business I also will you know I think and Senator you can verify this but even restaurants every year have to fill out the same packet every year it doesn't matter whether you're a food truck or brick-and-mortar every year you have to fill out that packet again so it's not for food trucks only any food establishment must do that and we try to just be consistent because many times that's how we find out that somebody has
[1:48:32] moved or has a different commissary or new ownership we don't know that until that application comes in even though they're supposed to get a new application with new ownership oftentimes that doesn't happen or the business itself the corp the corporate business has moved offices somewhere else so we've got to get that it's just consistency in our part so yes it's not just you guys it's it's the fixed establishments as well do you have further question or comment comment shot that past - I guess the first three years I didn't have to fill out whole new forms I just smelled out a check and they sent me my form back so this is brand new this isn't something that's been going on so that's why I had to ask that question [Music] I've been parked on the same spot pretty much every year for the past three years first two years I rented locations it was a waste $1,200 on rent for a sno-cone is a lot I'm not a restaurant so therefore I had to buy a trailer I said trailers gonna be the best way for me buy it pay on it every month and then it's owned it's owned but I have to rent a spot so for me my issue is the whole three days four days I'm so confused on that having to rent a spot be somewhere pay 500 hook up to electricity which is awesome so I don't have to have the gasoline going the generator going the loudness going the you know that that type of stuff I don't know if you guys are around food trucks but that's what they have to do in order to run and so that's kind of a pain so for me having to rent a spot that you know is 500 550 plus electricity is a lot and so I would like to stay in my spot as long as possible without having
[1:50:36] to move in pay rent somewhere else as well thank you very much for the public comment no further public comment we have a motion and a second and we've had yes I'd like to make ask that you make one amendment to the motion you on the enacting language it states that it'll be effective on and after the date of adoption and I think that's fine but because we are looking at some site requirements here we would like you to direct us essentially to not enforce those requirements for a period of 6 months to allow these folks an opportunity to comply okay Aaron if I may as well Lane alluded to it a while ago we talked about those private parties at a person's home if they do hurricane her whether it can actually come in and they're only surfacing that party itself then they shouldn't require a permit and also they had a discussion about the shaved ice I really do feel that that's kind of that ice cream type of a deal as well where there should be at least an exception on that as well all right well so what we have is a motion on the floor a second and I'm going to ask that the motion be amended to say the falling that the motion the amendment or the today this policy will not go into effect for six months and within that six month window know that the ordinance goes into effect that way they can start operating differently so will alone enforce for six months the we're asking that this be immediately effective with a six-month time period for non for for enforcement to allow for it and in the timeframe in that six months we will adapt this to be inclusive of regulations to allow for the snowcone situation that seems to be an issue and to allow for making provisions for private functions and at

[1:54:47] owns the part of the property that's residential to commercial so the entire site can be developed as part of a commercial redevelopment but it also takes the the heavy commercial zoning off of the property and Ruiz owns it to a neighborhood commercial which we think is its number one it's consistent with the city's comprehensive plan but it also makes more sense given the proximity of a park across the street residential immediately adjacent we think the neighborhood commercial is more appropriate and that is what the applicant is requesting just a few pictures of the area especially in case there are questions here's the side off to the right on this picture this is looking down this down Beauregard to the west right here looking across the street again to the park immediately across the street this is the side itself been vacant for some time this rezoning would be the first step in future redevelopment of this as commercial yes there's a couple more pictures of the site behind this fence is the residential off to the to the right of the screen there so some of the reasons that we looked at and the Planning Commission looked at for why this is appropriate it is the rezoning is consistent with the neighborhood center planning designation within the city's comprehensive plan we think it's compatible with the surrounding area Beauregard is a commercial corridor again it's already commercial zoning but the existing zoning would allow heavy commercial kinds of activities this would limit it to retail office and restaurant type uses I will add well we sent out our notifications we received two in favor zero in opposition I will say that we've heard some opposition from surrounding property owners but as we discussed with them it's not so much opposition to this particular rezoning the neighborhood commercial rezoning isn't I don't think it isn't a problem
[1:56:52] with the surrounding neighbors that we've heard concerns from I think their concerns are what the future development of this site might be we as they've heard we've heard the possibility of mini storage on that site in order to do many storage on that site they would have to come back for either a conditional use or a plan development approval so to the extent that that's a concern raised by the neighbors that's really not part of what we're looking at today that'll have to come back for some future approval again if in order to do mini storage on this site it would require an additional step either a conditional use approval from the Planning Commission or a plan development rezoning that would come to you all and so the concerns that we've heard thus far from the surrounding property owners are with that potential use of the site of many storage but this zoning would allow it changes it so the commercial that it would need for that but that extra step would also still be needed so you're saying with this approval that a mini storage facility would not be able to put on that property with this zoning change without an additional step to come back to you all or the Planning Commission correct and so of the folks that we've heard from surrounding that are that have expressed some opposition to this basically what we told them to do was save your opposition until they come back if in fact they come back requesting mini-storage that this rezoning really doesn't affect those properties and I think from from what I've heard that has addressed their concern and I don't believe there's any opposition at this point to this particular case there may be if that property owner comes back in the future for that second step do I have questions comments issues challenges Harry moved to be approved as presented second with

Datsuns family and and it's managed by the First Financial Trust let me just give you a quick history the property this property was long owned since the 30s by the same ownership that owned the house immediately south that was where the Datsun family was it's kind of interesting that we don't have the overhead of the property itself but approximately 55% of that lot is a strike slope down to the river and we've had a lot of problems with fragrance and and it really needs cleaning up so and and of course the building that's there now is not a very nice building and we we certainly plan to tear that down it's interesting we have an under contract to rob Watkins and his family they own and live in the house immediately south it used to be the Datsun so it's kind of coming back together it's an ideal situation number one to get that lower area cleaned up and and safety installed in that area and whatever they do on the useable part at the top will certainly be something that's not gonna be detrimental the neighborhood because they live right there so we're excited about that we will be coming back for a PD and John did mention many storage but before you here the PD just kind of get out of your mind a mini storage building with overhead doors this is a classic thing
[2:01:04] you probably wouldn't even know it was mini storage so really excited about you know getting that eyesore cleaned up from the city so this is just a change to seeing that's two steps down below what it's sewn down and I think it's certainly what needs to happen and that's what the comprehensive plan calls for so thank you I'll answer any questions if you have any I have questions some council any concerns on this issue with no questions from Council any further public comment with no further probably comment we have a motion in a second and we'll take a vote all in favor say aye any opposed motion passes 7 0 items C first reading a public hearing of an ordinance approving case z18 - 2 to a rezoning from the single-family residential zoning district to the - family residential zoning district located at 701 dar 721 West 15th Street thank you again John James director of planning and development services this is a request there's a property owner that owns one of these Lots that has requested to go from RS 1 which is single-family zoning - RS 2 which would allow 2 family duplex as we looked at the whole surrounding area and you'll see on the zoning map in just a second this is all commercial down here and this is all single-family and we thought it either made sense to keep this whole block as single-family or if if you think it's appropriate which we do think it's appropriate to go to our s2 rather than just rezoning the one lot the rezone that whole block face and so that's what we're recommending is not just the property being requested but that entire block face as you can see most of which is vacant although there are a couple of houses there already here's the zoning again you can see the large area of commercial
[2:03:09] transitioning to this neighborhood here and what you can see right here there's already one rs.2 zoning on this next block and at that time only that one was ruiz owned we think it would probably long-term be appropriate for this whole row of homes that back up to that commercial to be our s2 but again today we're just looking at this one block I just wanted to make clear though that the applicant is only requesting his lot we've initiated for the rest of the block there are within the rs1 zoned area there are other two residential or duplex structures those are non-conforming but they do exist so there is a little bit of a pattern of some to family dwellings within that neighborhood already and again given the proximity to that commercial it's pretty common in terms of the way we look at how we how we plan we like to have some transition not a lot of people like necessarily a single-family home being right up next to commercial so something like either apartments or duplexes often make sense as that transition area between commercial and the true single-family part of the neighborhood just some pictures of the area the subject area is over here to the right and then on this picture it's it's off to the left so it's looking both ways down that Street this is the subject property that was requested but again we're including the entire block face again just a few more pictures of the area I won't read through all of these but as we look through the criteria that we look at for rezoning we believe that it does make sense for many of the reasons I've already mentioned most of this area has remained vacant we believe part of the reason that might be vacant is because of that relative undesirability of being backed up to commercial and something like rental properties with new plexes might

[2:07:15] fourth year of our eight-year street cycle there's approximately 1.3 million square yards this year with a total contract price of 3.6 million comparison from last year we're seeing a 12% decrease in square yards 10% decrease in overall contract cost and a 4% increase in the overall cost per square yard how is that we're going with a higher-quality aggregate this year it's it's a harder rock it's a better Rock and it provides us more security I know the last sealcoat project that we had on Bird Street there were lots of questions and concerns with the application and the quality of work that was being done and many residents contacted I know myself but I think Harry received huge amounts of concerns and questions so saying that we're going to use this larger aggregate is this going to solve the questions and concerns and problems we had on this last sealcoat project well we do try to watch when we get those concerns from citizens we do get those calls and we do send the contractor out there and try to work with the contractor and make sure that we're staying on top of the quality making sure we're getting a good product for the citizens this isn't a larger product a larger aggregate it's just a it's a harder Rock and so it's just it doesn't crush doesn't have the prints indeed a crush into powder and so we don't lose his mind I think the concerns Harry helped me on this one the concerns were were that there wasn't enough asphalt going into the mix and it left too much oil base and that the application was not consistent across the road those are the things I heard here you're absolutely correct but I think Shane wants to wants to talk about it exactly what his inspector saw on some of these streets the area that was in question there a lot of that was
[2:09:17] actually due to the truck traffic that was on it during that construction phase it wasn't necessarily that we got a bad application or a bad product what happened was that the level of asphalt that was there a lot of that rock was embedded because of the heavy traffic was already embedded down into the asphalt itself and that's why we were starting to see some of the bleeding issues that the citizens were calling complaining on it wasn't necessarily that we had a bad application or a bad product it was just that we already started to see a lot of bleeding because of the truck traffic that was on it in that area so not necessarily the application itself but just kind of the circumstances of what it was and so we we did have the contractor try to go back and add some aggregate to it to kind of cover up some of those bleeding issues again not necessarily a bad application but just kind of the circumstances of where it was and in the traffic that was on it it was problems thanks for the clarification because I just wanted to make clear that it was properly sealed though that's what you're saying it yes yes the the the asphalt portion of it was properly sealed we had to we had plenty of of the asphalt down and again it's just the chip the rock that we put on top of it was it was just embedded prematurely down into the asphalt itself so we've got a good product again it was just we saw some bleeding issues that was concerning the citizens not necessarily the application of so Harry just so that the citizens understand Shane you had that conversation with a contractor ahead of time on some of these streets right over here on rust and a couple of those other streets they chose to do that early and which means that because the truck traffic pushed that rock down into the asphalt they had to come back and do it again they had they did have to do some remediation work on that that's all citizens were happy with the end result the thing thing that has to we have to understand is as we were ahead of the curve the contractor chose do it a different way great thanks for
[2:11:21] that sorry to interrupt your presentation so here's the overview map you see the three sections section 1 section 2 and section 3 so we're covering districts 2 through 6 this year so everybody except for mr. he hurt I will say that 2019 and 2020 mainly do hit the north sides of town but when you come back around in 2021 through 2023 you start seeing like the like area Southland and the butler farms areas come in so base bed section one covering districts 2 through 4 the black sheer Reagan and Riverside neighborhoods for section 2 you have districts 2 & 6 in the Angelo Heights neighborhood for section 3 you have districts 5 & 6 that's the share wood Terrace and West Gate Park subdivisions so in summary Fuqua inc the total contract price is 3.6 million they actually have not performed paving operations for the city before but I have called and verified a list of references they did give us and they and they all their references gave them a great recommendation and so we do recommend approval and I'll be happy to answer any questions do I have questions from Council Billy you look like you might have one I think I might and it may be a question more for Shane but I have gotten feedback from citizens that live in Southland about the crumbling of their roads so was that a different process that was done there then the sealcoating we're talking about here right so I think we
[2:13:29] should kind of like is the 2013 project that we had we did have a failure that year but it was more than just in the Southland area it was across the entire project which encompass you know all the way over into the east side of town and that project we did settle on a lawsuit last year and that's why large part why we did more last year was part of that settlement and we had more funds available from that to be able to do more so we're doing a little less this year because okay and it was due to the softer rock it was part of the failure from the 2013 so the streets that had issues from that 2013 they just have to get in line too so well with that settlement we were able to address some of those streets so we weren't able to address all of the streets so we did go back and hit hit those again last year but we you know like I said we didn't get the entire dollar amount back from 2013 so we did get an X amount of dollars back last year and so we were able to do a large portion of it but it didn't hit most of the south on the area honestly how did you assess which one since you couldn't do redo all of the streets that were impacted how did you assess which ones to do well so to to be more cost effective we tried to stay as close to last year's project area and so you know to reduce mobilization costs and things of that nature we we tried to concentrate it closer to where the project was last year and that's how we determined that last year all right and mayor I kind of have a question that may be just a little off for Russell but Russell I know that we have a list of dates and years when certain streets will be resurfaced if there is a special need because the street has gotten especially bad what is the process for trying to move that up on the the list
[2:15:33] of urgency right so you know there's a couple of different mechanisms it really depends on the level or the resisting condition of the street not all the time like Michels start off with is that this is not to improve the the actual ride quality of the street this is a maintenance measure so you know depending on what what the issue is with the street you know it depends on what needs to be done so you know if we need to move it up and put it into our capital improvement plan we can do that you know because that plan is is flexible but we do have a ten year plan to do an overlay to do total reconstruction like what we're doing on Bell Street and you know the rest of our streets that like that so it really depends on the level of service that it needs okay thank you I've had calls questioning how they would get a certain street moved up on that list so I appreciate and a lot of times with sealcoat it's it's you know it's really based on the area you know we what we want to try and minimize the amount of mobilization cost that we have involved with that so we try to keep still code in a general area thank you Lucy you wanted to ask russell's or somebody question man gentlemen the was giving a presentation forgot what his name is anyway I was just going to ask when is the project supposed to start we're looking at projected start date of July thank you is it normal we do these in the hottest months of the year yes ma'am do I have further questions from Council or comments or needs more information thank you very okay and there's a second is there public comment Steve Hampton yes the the bill for this is quite high

[2:19:40] board member each with the remaining city council member serving as an active member of the board a manager or appointee and a city attorney shall serve as advisory members without voting privileges other advisory members may be appointed as needed and we will need to appoint a case app coordinator as soon as possible by the corporation to kind of help get the operations under way and get them started now in order for case AB to be active and viable stab recommends a partnership between case eV and the city which may include start-up funds to help cover admin calls until case that becomes relatively independent we anticipate financial support to last for about potentially three years or so at that time we staff will reassess their financial status and provide additional recommendations for Council to consider this is a first step we're asking Council to approve that the bylaws and appoint a city council member to the board at this point I'd be glad to answer any questions and I guess again this is just a starting point I was concerned about the see number of directors that says the Board of Directors shall be composed of seven members at least four of whom shall be resident the city's San Angelo seems to me it ought to be more than four who because this is keep San Angelo beautiful and it would seem to me that we would need more than four people who are actually residents of city of San Angelo oh that was we talked about that we certainly are flexible we could totally add more and then increase that number we need to we want to bring folks from the outside as well but again we're very flexible father goes if council wants us to change that we certainly can do that we're such a day at this at the embryonic stages that we can certainly amend that I would recommend that we move it up to at least
[2:21:43] five that must be residents of the city of San Angelo just but I also would like to say the following I'm excited and I know this has been something that Harry has wanted for a very long period of time and I am glad that we have gotten this back on the agenda and moving forward because I know that in the past and we had keep Sentinel beautiful it did some incredible work and was such a positive influence in terms of truly keeping San Angelo beautiful so I look forward to this becoming a active board again and for the positive impact that it will have on this city but I do on the other hand want to make sure that five people I believe should be residents of San Angelo not four I think you might tell if there's a different number but no I know I was when you were I thought that's where you were going but I was thinking five would be an appropriate number of myself very briefly so the citizens understand this was a basically something that I started working on before I got sworn in right after I've got elected three years ago so I've been working on this for a long period of time as you said mayor the bottom line is is this could be beneficial in more than one way to to the city I know that there are funds that are directed to cities for initiative sunset such as these abilene just got one last last fall for two hundred and nineteen thousand dollars bottom line is is we could get some money back in the city coffers if we do this the right way plus clean up the city help coke plants get to a spot where they don't have to work as hard and some of these properties so I think this is this is a win-win for all the citizens do I have any comments or any other issues that you would like to see changed on these bylaws so I would like

[2:25:52] the board thank you any further public comment with no further public comment we will vote to change the number of directors from within the city limits from four to five and nominate Harry as our representative all in favor aye opposed passes that passes 7-0 okay we move on to item F consider approving an amendment to the inter local cooperative agreement with the concho Valley Transit District that provides for city funding for up to three bus shelters annually and authorizing the city manager to execute all related documents Theresa actually more this is this is actually mine okay yes ma'am I wanted to talk first of all concho Valley Transit District has done a wonderful job in past couple years they've increased the ridership they've also the efficiencies as far as the timing and the stops have been it's just incredible the improvements that you have made so I do appreciate that Jonathan Stokes did approach me to talk to me about the possibility of the city working in coordination with him to get some Bush shelters up I know that every year I do get calls from council members that are requesting you get calls from citizens that want that protection we have elderly people out there people that are handicapped that need that protection so with that with John Austin Stokes approaching me I thought this is really a great project for us to work on together and we're looking at three bus shelters this coming year and hopefully even more and future years as well John Austin I don't know there's anything else you want to add to that but John are these bus shelters the one that art and in common places are designing they're going to put out there or these no ma'am I'm John Austin Stokes on the executive director of the concho Valley Council of Governments that would be in addition to the ones we're talking about okay essentially what this amendment would do would be for the city to pre
[2:27:56] and birth CVT d43 bus shelters each year we've also committed to paying for three and then they're in our we created a comprehensive bus stop plan last year when we transition from a flag down system to a bus stop system and we've used that plan to identify seven stops that we would put a new shelter at in the coming year and so 3 would be the city's 3 would be ours and then the additional one hopefully would be one of the shelters that are don't come up places is completed so just to be clear these are covered shelters right and that's what we're talking about these we're not talking about bus stops are talking about shell shelters those people have the ability to sit someplace out of the Sun and out of the I mean it's not enclosed totally but it's not a mission we we took the arid climate into consideration as we shop for these to make sure one of the problems with a shelter that's enclosed complete with plexiglass you don't get a lot of breeze through there and and then you also it creates the opportunity for a lot of graffiti so we we made that the we're under contract currently with a company that builds these things that we picked picked one that would fit the needs of San Angelo well I'm looking forward to the bus shelters John can you share where the seven are proposed to be at this time yes ma'am with the caveat that so as I said when we created this this comprehensive bus stop plan one of the things that we really wanted to ensure is that we were putting bus stops in based on frequency but then also that they were going to be title six compliant and also a DA compliant so these shelters that these shelters sites that we've identified or in that Bank we've used we've used that methodology but that being said whether accidents as we all know that our our annex down that the depot was run into you know things like that can come up and these are all open to change but here's the seven that we've identified site L which is
[2:30:00] Westland 306 community hospital to 7-eleven on South Bryant and Ben Ficklin Howard college library North Branch which is North Chadbourne and West 30th h-e-b South on share would way and the Home Depot and then we've got it's a three-year plan we've got two additional years on top of that where we've identified three in the outlying years as well were there any on north Chadbourne no ma'am not this time are there actually library north north okay and this again is based off ridership it's ninety percent frequency so we wanted to make sure that we were putting in shelters and stops at the places that we're being used the most okay Billy I think you have it so nothing on North MLK let me see if no ma'am not on this list that I have that's something that we can discuss right because one of the things is the soup kitchen the Wesley Trinity soup kitchen on 18th they have a lot of traffic in that area and I've heard even though that's Lucy's district I've heard specific complaints that there's no shell they're right we will so one of the things that you have on the handout before you we take into account the feedback we get from our ridership and they generally say three things and they all cost money of course and the first if there aren't sufficient shelters and secondly that we our hours are not long enough during the day they wish that the the bus service would continue into the evening and lastly that we would be more frequent right now we're on our loops they wish that we would run every 30 minutes of these things probably the so to speak lowest hanging fruit are these shelters we will look at the numbers and make sure that the soup kitchen if if if it is and I'm assuming it's it's not based on art the data that we collect and we've got some pretty good data
[2:32:03] hasn't made it to the top of the list but if we we can reevaluate that and make sure that that's in consideration and if the data supports that we absolutely would make that happen it'd be possible I know we have a meeting at the transit Department tomorrow would it be convenient for you to maybe have some of those yeah sure though that I could respond to I brought does that make it yes ma'am so I brought reinforcements with me I got Ryan Herer who's our operations manager and then Jeff York who's our assistant general manager will absolutely provide some more John awesome I haven't seen him ride a single thing down that you said how many bus stops do we have in the city Wow but for the people out there the answer was 108 is that correct okay I don't know we we've grown quite a bit since inheriting the city's urban portion of the services in 2007 our annual budget now for the entire system which serves 12 counties is about six million dollars a year of that a little over 60% is goes to urban and we provide riders or ridership to 20,000 passengers he month so it's uh it's it's a lot bigger than people realize twelve counties I mean I think just saying twelve counties blows your mind away cuz it's a lot well I want to repeat those two things that Daniel said earlier one is that you've raised the timeliness of the stop the routes so they're very accurate so if it says you're going to be there 1010 it's there at 1010 so that accuracy has improved the fact that the readership has the ridership has improved significant since you brought it up yeah so and
[2:34:10] credit to these guys our our on-time performance is hovers around 99 percent which is extremely which is significantly above the industry standard and then over the last several months comparing year-over-year our router ships increased over 20 percent 25 percent if you look at the entire system so they're really doing a fantastic job I think that's one of the quality of life issues we want to know about Thank You meryt is a recommendation that City Council approved the this agreement or the amendment agreement and that's to provide three shelters per year and for for the future every year we'll be looking at doing the same as well as the consequently transit districts so it is a recommendation to move forward with this with that public comment no public comment we'll take a vote all in favor say aye any opposed with none opposed motion passes 7 0 item G consider ratifying a resolution by the Cosa DC board authorizing the president to negotiate and execute task order number 3 to professional services agreement RFQ D co2 - 1 7 with Park Hill Smith and Cooper incorporated in the sum not to exceed $15,000 to perform professional engineering and surveying services for revised final plat relating to phase 2 and phase 11 point 2 the seneschal business and industrial park subject to approval of the City Council Bob you're on thank you bob nieman with the city's economic development department we have a contract with Park Hill Smith and Cooper to do all the design infrastructure design for phase 2 the industrial park this is phase what we're considering now phase 2 point 2 and council may recall that we sold 52 acres of property to a EP and they were on a very aggressive construction
[2:36:13] schedule they're now in their building they've got their their certificate of occupancy and everything is finished relative Sam but as a result of their schedule and part of the agreement that we had with them in our sales contract we were required to do a preliminary plot and a subdivision plat of the portion of the street that we had to build at that time as a result in the park you'll smith and cooper original proposal they had one subdivision plat this now is requiring a second subdivision plat to plat the remainder of unit two this gives you an idea what what that looks like what we plotted originally was this area and now we're planning of the remainder of unit 2 which is this much larger area the fee for that is $15,000 and I'd be happy to take any questions do I have questions for Bob from someone on council anyone on council comment with no public comment you'll take a vote all in favor say aye with any knows motion passes 7 0 thank you Bob item H update presentation regarding the recently completed property appraisal report of property at the San Angelo business and industrial park by Stribling probe an appraisal and you're on again Bob you're honored Bob is fine I only my mother called me Robert I was in trouble we had an appraisal done back in 2014 and at that time and that's the way that's the basis that we've used up to now for selling parcels at the industrial park for under five acres that appraisal recommended
[2:38:16] $29,000 per acre and for over five acres $25,000 per acre and of course we got to parcel the size of a EP at 52 acres I think we actually went to 23,000 and an acre for that it was a 1.2 million dollar sale at any rate so we felt it was time to reappraise and also to include phase 2 in in that reappraisal and stripping program came back with the recommendation of up to 5 acre tracts would be in the 30 to $40,000 range and from 5.1 to 15 acres 20 to 20 20 to $30,000 per acre and then anything larger than 15 acres we would look at sort of on an individual basis and the price range is dependent on the degree of clearing as we move into phase 2 there's a lot of brush so if we were to sell a piece of property out there without clearing it there's going to be additional costs to the buyer so we might sell that at the lower end of that price range whereas if it is already cleared we would incorporate that into the price similarly they felt that relative location to the major highways might add something of a premium to the to the sales price we will also be looking at as we release or as we sent out the request for bid and get bids back on the construction of phase 2 will incorporate those costs into the evaluation process and see where we are cost wise because we do want to cover our costs and our preliminary a a preliminary evaluation is that these prices the prices that in this range would cover those but we need a final number on the construction we haven't take any questions any questions for Bob yeah it's Tommy huh comment more than anything when I did serve on the Development Corporation I had a one of
[2:40:19] our well respected developers in town that has done lots of commercial business outside of San Angelo in and helping clients identify and acquire industrial business locations in business parks and industrial parks and I would just encourage you because he he mentioned to me at the time that there would be nothing amiss about having different rather than using a standard price that based on you mentioned some of them earlier location required infrastructure any topographical work anything like that that we could you know he's he what he said to me was you're not charging enough per acre out there he said you know you find a park like that and he said it doesn't really matter that this is not in Dallas or in Houston he said you guys aren't charging enough per acre so I would encourage you all to make sure you know we're not we're not out you know just also take advantage of the buyer but you know this is also you know it's a business proposition as well so I would encourage y'all to to look at that whenever you are looking to sell those tracts I mean I appreciate so much your comments and but I also want to say the fine we've had this industrial park for a very long period of time of which it was pretty empty for a very long period of time so I think your comments going forward are very valid and very important and I'm glad that we were able to start getting people out there so that it has become a more valuable asset other than what was an empty industrial park for years it's almost one of those things mayor that when we raised the price the activity began to occur how counterintuitive is that but you know when we started with the oil price went up to
[2:42:21] actually it started before that my artisans I know but still um you you you all you I think it's been doing no small part to your efforts Bob what has happened out there so thank you and just to follow up with that the one thing that we did ask one of the things that was happening with with comparative appraisals is we were our own worst enemy everything in the area was selling for the price that we were selling it at so we did ask on this one that they expand and take the whole city into consideration similar properties so this appraisal is based on a citywide appraisal rather than just in the immediate vicinity in the industrial park and with all appraisals there's flexibility depending on customer correct etc etc so and I do want to summarize what tommy said double the price double the business so let's get that price up okay I just want to ask Bob we have any potential buyers that are looking at us right now are looking at the industrial park the answer is yes yes we have three they would take what the would probably take up almost everything we have developed right now not in the face to in in phase one and phase one okay how likely are those two of course you never know for sure but I would say all three are quite likely time hotel prices town economy tells with that said okay we've had a motion in a second public comment reading moving on okay okay we'll go on to item I which is an update on sales tax revenue performance good morning mayor council more danger
[2:44:27] Valenzuela tiersky Director of Finance I have for you today an update on sales tax numbers for the month of December since we did not have those numbers in before our meeting in December and December we were up 21.8% compared with the same month in the prior year and we were over budget for our revenue year today at four hundred and seventy four thousand dollars and I also have were you the charts that you like to see this is for November which we didn't have when we presented in November so this is the this sales tax by industry information I have a question that doesn't seem right and that is on hotels because we know our hotels have a higher occupancy than they've had and yet on here it shows that in December 17 we had almost it was fourteen thousand nine hundred and thirty eight in December 18 2600 that doesn't seem right we can double check that but this would just be strictly sales tax at hotels and not related to the hotel occupancy tax yeah but that's a huge difference and I just it just seemed like an odd oddity because even though it's not hot tax money it is related to that related to the facilities so I just thought that was odd and can you give us what cumulative for the October November December or your your cumulative percent increases at this point through this presentation I do not have that information with me but I can certainly provide that for you yes then at the next meeting sure and you'll probably have waiting we'll have January yeah and do a quarterly yeah at 8:00 great okay okay and then for the month of December here's your sales tax by industry information that's all I have for sales tax unless there are any questions keep up the good work Dana does this include can you speak to the Amazon effect in other words we know that it was been it has been passed that the M we now have to start playing sales tax on Amazon
[2:46:30] purchases we do receive sales tax on Amazon purchases as well as Walmart online and several other online art so how do we track that by the way we have a software program that we use to track that information and we also receive a monthly confidential sales tax report from the Texas Comptroller so you can start to see that grow we should we could certainly start tracking that it would be interesting I think when you feel secure enough with some of those numbers I think it would be nice to see those numbers we'll make a note to start looking at that and yep any other further comment or questions for Tina all right they will move on to item J first public hearing and introduction of an ordinance amending the budget for the fiscal year beginning October 1 2018 and ending September 30 2019 for capital items grants and reimbursed expenses okay so this first budget amendment is an amendment to increase marginal revenue and they're wanting to use that marginal revenue for salaries and supplies and some capital items and this is for the neighborhood and Family Services Department marginal revenue mean having to do they're having to do up eight more properties because of the abundance of rain so there are going to be more people charged for having their Lots mowed revenue that they didn't expect to receive in their original budget and so they're wanting to increase that revenue budget because of those additional services that we're going to be providing and use that marginal revenue or the increase in the revenue to fund these I want us to be very cautious about that mowing situation because of the falling number one I received many complaints about the bills for mowing people's properties because combination of things people don't understand that number one you get a letter at the beginning of the year and that says well this property on
[2:48:34] this date we had to mow it so you no longer get any notices the rest of the year but people keep checking on that property and if a second time you haven't mowed it then you get charged it again but you don't get a letter per episode you just get a letter at the beginning of the year that you're supposed to remember call it carries you for 12-month window that's not fair to and I know we're changing that so just want to repeat that I know we're changing it but we got to do that because that's wrong and then number two is many people hired people to mow their properties commercial particularly but because of the rain the mowers were so backed up they couldn't get to them for two and three weeks because all of a sudden we got rain all of a sudden everything bloomed and there was a need for mowing everywhere and some of those it it's created tremendous issues so I just want us to be a little cautious on this thing because it's a little bit heavy-handed and I know that I wouldn't have remembered if I got a letter in January 1 2018 that that letter was supposed to cover me for every time I might need to mow till December 31st 2018 and as you mentioned the process has changed now so now we're talking about absolutely we'll be sending a letter actually before we do any type of work on a property than just to notify them and let them know as well if they hire a contractor somebody to come in and do the work they or the contractor can absolutely contact our office and we'll give that extension especially during times of heavy rain so we have addressed that process and we have made changes to it to the next so this next budget amendment is related to the concho Avenue improvements project and this is the budget for the revenue for the tech stock grant and the expenditures associated with that as well for five hundred ninety seven thousand dollars we have the budget amendment for the Development
[2:50:37] Corporation funding a portion of the airport Business Park planning for the master plan the Development Corporation is planning to fund almost one hundred twenty-one thousand dollars of that part that is not allowable through the other funding Mica's mechanisms and again the Development Corporation here is funding some improvements at the US Customs and Border Patrol facility out at the airport and that amount is forty nine thousand dollars and finally that we're budgeting here for revenue from the Fort Concho foundation they're going to be assisting with purchasing a piece of property that the council has authorized for the fort to purchase they will be funding twenty six thousand five hundred dollars of that the remaining of the difference between the eighty thousand and twenty six thousand dollars will be funded through the Fort Concho fund balance just repeat we've got a lot of work we need done at that Fort Concho project and I think the last time we got an estimate it was not an estimate that hard to digest he was preparing to retire yeah you know we brought it up before I've been pretty aggressive about pushing this issue but we're not taking care of the existing property I have concerns about because we've got five hundred seven thousand dollars worth of issues at that fort and they need to be addressed and Bob you're going to come speak to that yeah we need to kind of keep the discussion on topic to the budget amendment morning mayor and council had a premonition I might be on she just cautioned us that I was probably out of line saying anything and so I opened the door I don't know if I've opened the door I have no slamming shut real fast we remember we work for you Joe issues here one as I noted an executive session the property issue is a lifetime investment if the fort had stopped and not taken advantage of an opportunity in the last 50 years to put the place back together we be still in the original headquarters building no
