[0:00:01] good morning morning my goodness we've got a full crowd here this morning makes me want to do a little preaching microphone in a crowd like this we welcome you to our meeting this morning and this is a very important meeting and we're very glad that you're here with us today we will begin our meeting this morning with the prayer I will ask uh Mr Andrew Holden to come forward and ask him to get us started please stand as you are able good morning sir the mic is yours thank you sir good morning everybody father we come to you to youday very thankful for who you are what you've done and what you're doing in all of our Lives Lord God we ask that you would just give us uh discernment that you would give us a sense of wisdom Lord to especially the council members and uh everybody elected into office that they would make the right decision Lord according to your word and according to your your rules and your guid guidelines set out by by everything that you've said in your word Lord we just thank you for who you are we want to remember the the police officers and the families in Dallas and uh Across the Nation Lord that you would just be with them also Lord we do ask that uh you would just bless the city that you would heal our land that you would uh provide rain Lord Jesus that you would just touch our families in all you know every way possible Lord we want everything to be done in your way Lord and in your time and we just thank you for who you are and what you're doing in Jesus name I pray amen amen let's get a picture here and now if Mr Jonathan Thompson and Miss Megan Thompson would please come to the front uh Jonathan is a seventh grader at Glenn and Megan is a fourth grader at Fort

[0:02:05] koncho and they are going to allow me to assist them with the pledge this morning are y'all ready let's start with the American right here Al to the flag of the United States of America to the Republic for which it stands one nation under God indivisible with liy and justice for all the Tex flag toex and indivisible and I will admit this is the high part this is the highest part of my day right there when these kids come forward and we say the Pledge and I appreciate you very much you may be seated and Andrew I want to thank you for mentioning the Dallas police officers and that is one of the greatest fears I have as mayor that that foolishness will come to St Angelo I pray that my citizens will care for each other and respect each other and love each other as we're supposed to cuz we do not want that nonsense in our city so let's stay with this let's do what we're supposed to and maybe God keep that strong arm of protection over us and I got to do a little preaching after all we do have a proclamation and Andrew I need you to come forward this is Jordan Holden day and this is a very important this is a very important Proclamation John 15:13 tells us greater love hath no man than this that a man lay down his life for his friends and on July the 20th of 2008 that is is exactly what Young Jordan Holden did early that day Jordan and three friends surprised two armed Intruders at the home of one

[0:04:07] of these friends while coming to the homeowner's AIDS Holden was shot in the chest despite the wound he chased the ass salant through the house and into the backyard where he collapsed and died as the burglars made their escape they have yet to be captured Jordan Holden died at only 22 years of age six months later his son was born also named Jordan he knows nothing of his father other than this he was a hero in addition to being a live Scout who earned merit badges for exhibiting strength endurance and Ingenuity Jordan Holden was a loving and a faithful friend son and brother he also unquestionably was courageous and heroic therefore I Dwayne marrison mayor of the city of St Angelo Texas on behalf of the city council do have hereby Proclaim July the 20th 2016 as Jordan Holden day in St Angelo Texas and to accept the proclamation is his brother Andrew sir thank you sir thank you guys um well you know a lot of people uh around town know about the situation and uh and my family and kind of what we went through through the ordal and uh everybody has been so kind and uh and trying to help out uh the detectives on the case worked very hard uh the reason why the the perpetrators weren't caught just happened to fall like that it wasn't anything that the police did uh they did a great job especially the Cold Case detective right now he's doing a great job following up continuing even eight years later so I just want to thank the mayor the people of St Angelo the city council for this great uh great great honor to you know to be able to honor my brother's name have something to show his son um and just to keep his memory alive through my family and through his his son also thank you thank you Daniel Valena I think this is to you

[0:06:24] do I have some in do I have Representatives here this morning from the American Heart Association the employee Wellness committee fit friendly work site at the city of St Angelo and Janet Charlesworth and Mary Solomon and wellness coordinators and Morgan CH WT and the wellness committee chairperson did I get them all the microphone is yours Miss Charles thank you we are here to present a wellness award to the city of St Angelo um the American Heart Association grants a fit friendly gold level Wellness award to work sites and employers who a go above and beyond when it comes to employees health to achieve gold level status an employer must Implement at least six physical activity criteria two nutrition criteria and one of the wellness culture criterias on the application form uh we applied for this award back in April and we are pleased to announce that the American Heart Association granted the city of SEL a gold level award for their current wellness program that we Implement with the city employees and it's uh on behalf of the our City Community Wellness chairman community on behalf of the City Wellness committee that we uh have developed and this uh s Angelo Community Medical Center we would like to present this plaque and award to our city manager Daniel thank you first of all this is a an award that goes to the staff uh we're trying to create a culture of healthy lifestyle within the city I personally lost about 17 pounds I probably feel the best I've felt in quite a long time and it's something that we want to make sure a lot of times we look at it from a business perspective that this could increase productivity if we had less people with sick if they're healthier but on my part uh what I really would love to see is the quality of life

[0:08:28] improve for all our state especially as you near retirement uh I would hope that our staff could leave with those habits already formed uh that they can live a better uh more productive life as they do retire and again uh in part what they learn with their family as well but again this award is for our staff I am very proud of all of you who have participated of course our committee and uh that's what I have to say about that let's keep up the good work thank you all and it took me a year to lose 40 pounds and four months to put them right back on Betty teston are you here this morning ma'am I'm going to go ahead and read this Proclamation I don't see Mrs teston but this is uh has to do with the Texas hunger initiative a collaborative effort both Statewide and locally our goal is to win hunger in Texas through policy education research Grassroots organizing and Community Development St Angelo is one of the 12 Texas the city selected to have Regional Offices with the dual purpose of recruiting training and supporting Community Partners in providing additional access points for people to apply for Texas benefits and to implement local Outreach and coordination for the no kids hungry campaign in Tom Green County more than one in four families with children have times during the last year when there was not enough money to buy food that's 5,400 households in the city of St Angelo the goal for the Tom Green County hunger Initiative for 216 is to feed more children during the summer when the school is not in session in San Angelo

[0:10:31] over 8,600 students receive free or reduced meals when school is not in session more than 60% of all students after summer school ends in June local churches Ministries organizations businesses and numerous individuals have committed to provide meals in July and August at eight S Angelo neighborhood sites plus one site in carlbad therefore I Dwayne Marson mayor of the city of St Angelo Texas on behalf of the city council do hereby Proclaim July 16 as kids eat summer meals initiative month in San Angelo takes us and urge all citizens to support the initiative's goal for 216 and that is to feed the children our City's Future Leaders would you see the Miss testing get this Brian thank You' Mosaic where's Amy come forward ma'am and this is for Mosaic and Amy MOS Flint is the director of this uh mosaic has been a valued active member of St Angelo Community for over 30 years the people Mosaic serves are ingal to the social fabric of our community as neighbors and friends the employees of Mosaic share in their civic duties as responsible citizens working to Build a Better Community for all mosaic has worked to build a network of support through volunteers and donors and it is important for all of us to support the mission and work of nonprofits that make our community a better place to call home therefore I Dwayne Morrison May mayor of the city of St Angelo Texas on behalf of the city council to hereby proclaim the month of July 2016 as Mosaic possibilities month in s Angelo Texas congratulations Amy hi my name is Amy Melle flint and I'm the community relations manager for Mosaic and I just wanted to thank you all for um or thank the city for giving this this Proclamation mosaic's been in St Angelo for 30 years we're celebrating our 30th Anniversary this month and we're um celebrating a community of

[0:12:34] people with intellectual disabilities that are often marginalized and so a proclamation gives them the same um the same presence that anybody else in the community would like to have so thank you very much Rick Tinsley where you are my friend he's headed to the front Rick is here to introduce and to give a whole bunch of certificates of recognition out to the Texas Poli games all of you guys come up that have something to do with this and let's help Rick good morning sir good morning uh the Texas police games were held in St Angelo here recently it was a Statewide effort it took a lot of work to get this here and we were able to do it in s Angelo and they were all very pleased with our city it's a resolution of the city of St Angelo to support the 2016 Texas police games as organized by the Texas Police Athletic Federation the S Angelo police department and the Chamber of Commerce convention and visitors bureau anybody else will appear anybody else that's involved with this come on forward we don't want to confuse Rick Susanna where are you Susan I think she's T you're taking pictures aren't you Susanna okay I'm turning the microphone over to you Rick here's your take all thank you it does take a lot of people to put these games on when we took it on we didn't we didn't realize how much how many people we were going to need and citizens of St Angelo and everybody around us when we asked for help they stepped up and helped us we couldn't have done it though without the help of Susanna we would go to meetings and she would have sent us something and most of us would say oh you sent us that and she' well let me go get you another copy and stuff like that so Susanna also held us together she she was also real big in that but she's going to take pictures and ask not

[0:18:59] limit remarks to less than 5 minutes council members May request that a discussed item be placed on a future agenda the council takes public comment on all regular agenda items during the discussion of those items so if you have anything that you wish to bring before the city council if you want to praise us we take it if you want to condemn us we take that this is your opportunity if you would step to the mic state your name and you've got five good morning mayor um good morning Council my name is Sylvia Martinez and I am here as uh representing my son that's in the prison and I am in charge of his business um I have a uh my son has a business that's on Oak Street and uh it was under the grandfather clause and um when uh this person went to open it they gave us a lot of like it was going to open for the first time which it's been existence since 1973 I understand that there is loss but the city planning does not have a right to tell me when I can open and when I can close because they don't know the situation uh the city council from my District 3 Mr Thomas I thank you and uh the city manager uh Valenzuela and Mr Daniel cardinus I wish to thank them for all the help because there has to be that we as business owners they we rent a place and they leave it destroyed and we have uh barriers we have to pass by fixing them and doing you know minor uh you know fixing well I'm a a sick lady I cannot be doing like amand does and I don't think it's right for the city to tell me when I can open open and when I can close I pay the water right now it's been for 14 months open the water the

[0:21:04] storm water taxes uh light it's not abandoned I have it uh painted through the outside it's fixed to where it's rentable when I got a renter they put all this uh stuff you know uh affidavit when it was at this affidavit it was another one I could understand if I was going to start firster but I wasn't going to start it's been an existed I'm under the grandfather's class but because I stayed two months over I'm no legal it's not legal no more but my question is to the city council and to the Planning Commission we live in the United States of America which we stand that we have the freedom of choice to talk and to open our business when we are capable of opening not when the city planning or the city council tells because you all don't know the the people the owner uh situation and I would consider since y'all passed a lot of laws that you would take that ination because I um feel that it's not right it has been open for too many years and they I had to for every table I had to have a parking there's a lot of places that they don't have no parking and you all gave them the permit you know when we got everything done all even the man that uh Mr um uh my neighbor that I had been cutting the grass for 19 years for using the parking I even had to get an affid dat from him why if I'm doing the lawn you know for the parking because I had to the the city wanted an half a day but I he went up to $75 if I ever want to use that parking so I would love to hear if you all can uh have the wisdom and uh because y'all are there we voted for you the wisdom and the knowledge to know

[0:23:08] when people come toward you and as me representing my son uh please try to understand where I'm at um I know there's laws but you don't have a law to tell me when to open and when to close because of people destroying the business sir and that's all I have to say and I hope that you all can think about it and let me open you know I don't mind paying the 447 but they kept affidavit affidavit affidavit a lot of people have open they're not asking them for all these affidavits they don't even have water in some places they don't even have light and I have Water and Light and they don't let me open so I leave it at that and I hope God bless you and I hope that you all can do what is best for for not for me because you know I'm an elder but for my son because that's his business I'm asking for the mercy of you all to think what's right for not just homeowners but business owners we're all maybe you all have business a business how would you like if the the city or or the Planning Commission told you when to close and may God bless you and thank you again city council number three Mr Thomas and and I thank you very much City Commissioner uh all of uh all of you and the city manager I'm sorry for everything you tried to help me and it didn't work but maybe now that I came forward y'all can do something to help me out because I need your help I uh need it very much and I hope you're open to what I brought toward yall God bless Mar do I have any further comment the microphone is open step to the front if there are if there is no more public comment then I will close this portion of our agenda we will now move

[0:25:11] on to the consent agenda this is items a through H I'll start with you Mrs farmer if there's any statements that you would like to make or if there are any items on the consent agenda that you would like to pull I begin with you ma'am thank you Mr Mayor and when I asked to return to my regular seat in order up here I didn't realize I'd be called on first so I may pass on from here on out uh yes I do I have a statement I want to give a heartfelt thanks to the uh St Angelo Board of Realtor Association here a while back they had provided each council member with a binded book of uh regulations state federal and case law on property rights and I want to thank them for the excellent information and the sleepless nights of falling to sleep reading but uh I do want to give them thanks for putting that together for us they pulled a lot of information in various States and put it all in one packet to give us some study information and I thank you that's it thank you ma'am you all right with the consent agenda I'm fine Miss Lizzy I have nothing to pull but I do want to wish my mom a happy birthday she will be turning 86 years old birthday happy birthday Harry do you have anything sir uh I'd like to pull item number F oh r that be all that's it Marty did you have anything sir I'd just like to say with all the law enforcement here that I I hope someone's protecting s Angelo in the county so and we've got him from all branches Mr Richardson do you have anything sir uh Mrs uh farmer she mentioned that b supplied by the real Association I called Mr allerson about that and I asked him uh I said well it'd be nice if

[0:27:15] it was summarized and he said there is a summary it's now I you'd have to get back to him because I kind of forget right now but there is a page in there that summarizes everything and and lead you to the different articles in that whole booklet if you look at it uh at first it looks uh kind of frightening but I have nothing to pull from the consent agenda all right sir then I will entertain a motion to accept the consent the consent agenda that will be items AB b c d e g and H move to approve with the extion I do have one from shed you you make a second on that one with the exception of f do I have any public comment on this item before we vote any further Council discussion before we vote all in favor of all of the consent agenda with the exception of f please say I I oppos name f is consider authorization to increase amounts for award contract v513 auto body repair service from not to exceed 75,000 to an amount budgeted each fiscal year of 120,000 annually for auto body repair services Mr Kramer are you here to speak to this sir you'll be speaking for him Daniel or do you have someone you wish to come forward here we go what are your questions Harry well really I just want to make sure that we got a clarification for the public to have a better understanding of why we're moving from 75 to 120 on this Auto botle Repair even though the 120 is already budgeted uh sometimes the uh citizens don't see all of background information hi Julie hello Julia antley purchasing manager um the reason that the increase was asked for is oh Sor sorry about the delay um we are looking to increase this award amount we have had uh a little unusual year uh we typically see our accident spend amount uh somewhere between $60 and $70,000 for the year uh currently um as of about two

[0:29:19] weeks ago uh we're sitting in about a $60,000 amount spend amount actual spend amount for the year uh for body work body repair um and and the majority of that is accident repair uh we do see that uh if we are currently at that amount I also have several um accidents waiting pending repair um and have added those up the tentative quotes and we are going to push that number this year and so it was appropriate time to go ahead and ask for that increase I don't I sure have my fingers crossed that we won't reach that $120,000 number um but the most prudent thing for me to do is to request an amount that I believe is appropriate and and will sustain us for the year um and and I believe that that this will do that for sure I believe that answers the question move for approval have do have the second from Marty and Harry has made the motion any further Council discussion on this item do I have public comment on this item all in favor please say I I and oppose nay and now we have come to the part of the agenda where we have all gathered to come to this is a special agenda uh there will be a reception follow immediately after this special session and the regular agenda with the new to C council members will begin approximately 30 m minutes after the recess for reception I got about 15 minutes worth of reading to do here to meet all the legalities that the state puts on us so if you will please bear with me I will read this then we will swear we'll swear you in first lane and then we will swear you in Frank so then we can swear and do the do that you ready judge okay a resolution for the city of San Angelo Texas canvasing returns of the runoff election held in said City on the second day of July 216 for the purpose of electing Municipal officers declaring results of the runoff election providing a severe ability clause and providing for an affected date whereas Pursuit it

[0:31:22] to resolution number 2011 60568 of the city of St Angelo Texas adopted only 18th day of May 2016 a runoff election was duly held on the second day of July 26 for the purpose of electing Municipal officers to the following positions chief of police to a four-year term and city council member for single member district five to a three-year term and whereas said runoff election were held with the cities and formalities necessary to make a valid election all notices having been posted in the manner and for the length of time required below and whereas only duly qualified resident voters of the city of St Angelo Texas voted at the special election called and held on July 2 20116 and whereas section 67.3 A of the Texas election code AS amended generally provides that the canvasing authority shall convene to conduct the local canvas at the time said by the canvasing authority presiding officer not ear earlier than the Eighth Day or later than the 11th day after the election day and whereas section 674a uh the Texas election code AS amended establish the Quorum level required to canvas election results to be two members of the canvasing authority and whereas a quorum of the city council met on July 12th 26 and duly canvas the election results of the above described runoff election attached here unto as exhibit a now therefore be it ordained by the city council of the city of s Angelo Texas section one the findings set forth above or incorporated into the body of this resolution for all purposes as if fully set forth therein section two the city council officially finds and determines that the election was duly ordered to be held in the city of St Angelo Texas on the second day of July 2016 for the purpose of electing Municipal officers to the following positions chief of police to a four-year term and city council member for single member district 5 to a three-year term and the proper notice of set election was due to given that proper election officers were duly appointed prior to set election that set election has been duly made and election returns delivered and that the city council has duly canvased and returns all in accordance

[0:33:24] with the law section three the city council off finds and determines that the only qual that only qualified resident voters of the city of s Angelo were allowed to vote at set election and the following votes were cast at set election and that the canvas of the votes cast in set election and returns hereof thereof which is attached here unto as exhibit a were made in accordance with law chief of police Tim Vasquez 2165 or 3410 per early absentee 1159 or 3.92% on Election Day for a total of 3324 votes or 32.9 2% of the election Frank Carter 4184 or 65.9% early absentee 2589 votes or 69.8% on Election Day for a total of 6743 votes are 67.8% in the election city council member SMD number five Elizabeth Miller gr staff early absentee votes 710 for a 48.4% 321 for 4446 per on Election Day and 1028 total votes for a total of 46.79 per. Lane Carter early absentee votes 768 for a 51.96 per 41 votes on Election Day for a 5554 per for a total vote of 1169 or 53.2% of the election section four pursuant to the appal provisions of the Texas local government code Texas election code and the City of St Angelo Texas Home Rule Charter the city council officially finds determines and declares results of said election to be that number one Frank Carter is elected chief of police for the city of St Angelo to a four-year term of office by majority vote of the votes cast for chief of police and number two lane Carter is elected to the position of city council member single member district number five to a three-year term of office by majority vote of the votes cast for City Council Members single member district

[0:35:26] number five section five it is hereby declared to be the intention of the city council that the phrases Clauses sentences paragraphs and sections of this resolution are severable and if any phase cause clause sentence paragraph or section of this resolution shall be declared unconstitutional by the valid judgment or decree of any Court of competent jurisdiction such unconstitutionality shall not affect any of the remaining phrases Clauses sentences paragraphs and sections of this resolution since the same would have been enacted by the city council without the incor incorporation of this resolution of any such unconstitutional phrase clause sentence paragraph or section and section number six the resolution shall be effective immediately upon its adoption I don't have to read this again for any clarification do I they did that to you on purpose you did all that without taking a breath I did I did or getting a drink of water I now need a motion to approve the resolution that I have just read second got a motion to accept by Marty I have a second by Lucy do I have any Council discussion on this do I have any public comment on this before we swear these gentlemen in I will call for the vote all in favor please say I I oppose Nay put a 60 on that one brother ready start with you judge and you Lane if you will raise your right hand please and repeat after me I Lane Carter I Lan Carter do solemnly swear or affirm do solemnly swear or affirm that I will Faithfully execute the duties of the office that I'll Faithfully execute

[0:41:39] thank you city manager and Council I look forward to a great working relationship judge I thank you for being here today many don't know my father ran in 1978 for police chief 38 years later we come for Full Circle we made history I don't think in the history as sapd there's been a chief and assistant chief Father and Son in St Angelo Police Department I want to thank my campaign manager come up here Kim as she comes up here I asked her to be my campaign manager she was very hesitant she said I don't know nothing about politics I said me neither will be fine uh it's just an example it's not about your experience it's about your drive and compassion and what you believe in I want to thank my steering committee she was not alone we had great people by our side I can't name them all I I'd be scared that I'd miss somebody my family my father my mother and my wife stood by me the entire time and for everybody in here and the supporters the voters I can't thank you for enough I'm grateful very grateful I ask for each one of you to continue to pray for the families of Dallas and the police officer thank you very much thank you for

[0:48:48] understand but I would be happy to my public comment on this item all in favor please say I I oppose Nay put Charlotte down by 70 vote please public hearing on the 216 annual action plan for use of cdbg and home Grand funds consider approving a resolution authorizing the city manager to execute the applications required certifications related documents and annual funding agreements Bob Salis you are own sir you have the phone good morning mayor council uh the annual action plan is our petition for the federal cdbg and home Grant funds it is an annual HUD requirement and it's due next month uh the plan certifies that we're adhering to the requirements that they set uh things like fair housing anti-discrimination managing a drug- free environment it also addresses some key interest items uh such as housing for the homeless special needs uh bearers to affordable housing and lead based paint abatement but most importantly it documents the city's projects allocations and expenditures that Council approved last month during the deliberation meeting uh we did advertise in a standard times uh we posted online and we made copies around the city and we're asking Council to approve the plan as presented so we will be presenting approving the plan as you gave it to us last meeting yes and what I'll do is actually you have a copy of it and it uh this will go to HUD uh that that's our petition and we'll get our funds hopefully and with no problems and uh we'll move forward October the 1st move to approve is presented somebody want a second second do have I'll take Harry second on that made the motion to approve as presented we went through this pretty in pretty good detail last time saw no problems with it it looked like a good plan do have a motion and a second to approve as presented do I have any Council discussion on this item public comment on this item we'll call for the vote all in favor please say I I and oppose nay thank you Bob put a 70 on that one Brian B is consider approving the conceptual design of a set of three

[0:50:51] sculptures regarding the historic B beginnings of s Angelo landscaping and his placement at Barty Wick Park Carl white you are own sir yes sir this is uh being proposed by the historic beginnings of s Angel it's a group a committee that's been formed and they um submitted a proposal we took that proposal to the public art commission uh just last late last month and they recommended approval what this is is a u set of three sculptures that would be placed at Bart dwit Park in a landscape setting and it would be implemented over the next couple of years and I would like to show you where this is physically on the ground and we have folks from the public here uh especially Mrs tyy Chandler who would like to speak about the project and why they have proposed it this is um here's the Concho River the north Concho River this is Oak Street this is Bart dwit Park and uh if you remember this is the old western mattress building the egim uh outdoor museum is right up here and the area is right off the trail between the trail and the bank of the river this is looking on the ground this is looking towards celebration Bridge which is back here and the art museum which you can't see hidden by the trees it's fairly flat but it does gently slope towards the river this is looking back the other way this is Concho Avenue back here and the rivers back here yes I I do notice that we have some trees that do need some pruning this is this uh conceptual of what this might look like on the ground and I would like to point out that what the what we're seeking today is conceptual approval we're not asking uh to approve the final design for this project we're asking for conceptual approval so that the project could begin

[0:52:55] the this is the the setting at the site that I showed you it's uh has an entrance you see the the stone wall uh which gives you a feeling that you actually have arrived somewhere which shows the entrance for the setting it's separated into two areas one area would be a fairly wooded pasture area where there might be wild flowers and Native grasses which would have two sculptures and I'll show those in a second and then the other area would be maybe a little bit more zeroscape Landscaping more of a West Texas Plains look and would have a single sculpture which would be a humano brave and I'll show that here in a second but this would be um would wouldn't have a heavy vegetation wouldn't be a lot of landscape plants it would be fairly low maintenance in terms of the plants that would be planted uh which would be put on drip irrigation you would have a we would have a stone border around the area and uh the plants would be put on dripper irrigation and there would be different areas for seating uh for folks to gather and sit and contemplate at this um you'll see here this is the one uh site where there would be um the lady in blue and the child in the the wooded pasture setting uh this is a conceptual of what the sculptures might look like this this Stone structure here would be a digital kiosk that uh could give you the story uh behind this and uh you basically just walk up to it and be a touchcreen and it would give you the story this is the other area with the humano brave which would be like I said a little more zeroscape Landscaping um and then there would be the boulders around the the sculpture with the painted rocks in terms of the estimated budget um the proponents have stated they have

[0:54:58] a donation from a Anonymous donor for 500,000 for this project and this shows what the estimated budget would be uh I suppose we do want to talk about the maintenance and maintenance endowment of this and uh you'll you'll notice here there is a line item for maintenance endowment because there would be some cost to this essentially they're not asking to lease the property this would be an physical and Perman physical and permanent Improvement to the park it would become the city's property and for the overall budget of 500,000 again the public art commission did recommend approval um Mrs Chandler is here she may want to talk about the project and implementation and then if you want to talk about future maintenance of it um we'll do that again we we seek conceptual approval to move ahead with this project if you have any questions or if you want to hear from Mrs Chandler yeah bring Miss Chandler and let's have her then we'll discuss it good morning ma'am city council Mr Valenzuela um I was told that I could take as much time as I wanted because the mayor wanted to be here all day who told you there yeah squeal see them but anyway I try to follow instructions most of the time and Carl white told me not to do this but I'm going to do it I'd like to introduce they drove a long way some of the leaders of the humano tribe and we make a lot of mistakes but they're all mine you all were graciously given uh children's book with with pictures and some of you said I think I would have liked it but it was in

[0:57:03] Spanish so Elizabeth Flores and her daughter Harley are going to give you the same book and keep the Spanish book you might know somebody that uh can read it and Elizabeth has never met miss a meeting and she has a long way to drive also here is Carmel Luhan stand up Carmel and Chris Luhan they are humos and they have given us leaders and they have given us a huge amount of help and of course we have done nothing planned nothing without consulting the historians and the humanos on how they want it done my interest I'm I'm just the peon uh my interest is that I would like people to hear about our fabulous history that can go back thousands of years and there weren't brothal then that line the streets if San Antonio had our River and our history they' already made a billion dollars on it they took a dirty cadal and made a billion dollars we have as the donor said of fabulous story we can go back 4 to 600 written history and as the editor former editor said our history hist has been buried long enough now as I said I'm the peon I'd like to bring up the professional Katie merch Johnson she and I served on

[0:59:07] the Angeles committee and if you have any technical questions Katie can certainly answer them very very typically Tilly Chandler I'm I'm Katie Johnson and Tilly and I did did work um over the last 10 years and with the completion of the Los Angeles um sculpture project at The Visitor Center in uh 2005 um I just wanted you to know that it's a terrific Committee of PE people who have lots of experience with the S working with the city in um working on public art installations and our donors um condition uh of of beginning this project is that we have the most recognized and the very um best piece art quality um bronze sculptures there that we that we can possibly get so um there is a committee of us who have experience um working in art museums um and uh working with the Arts Community working with sculptures sculptors to put um our wonderful Umano Community together with an artist who can Faithfully represent um what needs to be represented so we are honored our honored duty is the Integrity of the art for this permanent um site in St Angelo that I think will be a another terrific spot along the river that links with koncho street is going to be a terrific um destination in a beautiful side that we're very happy about so do we have any questions questions Council time I just have a question about the painted rocks and the P pictograms are they accurate and do do they tell a

[1:01:08] story um the concept is that since it is a distance from St Angelo out to um the Paint Rock pictographs that those pictographs will be they'll actually be copies of the ones that are there in Paint Rock and everything has to be accurate um for the historic Integrity of this project so there won't won't be any interpretation um that is not consistent with Paint Rock and with the Umano Community does that answer your question um but as as it is displayed do they uh do they tell a story or they this random yes the interpretation of the site will be through the digital kiosk so there will be uh interpretive information as well as didactic information there for the visitors okay thank you we'll also have um what do you call not plaques about the humano history uh so many people will never get to paint rock that live here so we thought we'd bring a little bit of Paint Rock to Town the Campbell who own the ranch are very excited about it and we will have information that talks about the daily life the history of the humo um how they earn their living that'll all be explained and will also be in the movie in the kiosk thank you anyone else Harry uh I think this really is a great concept for the history of son Angelo and I want people to understand that this was before the fort and any the places downtown so this is really something that will draw more visitors to the area I want to say also who can ever say no to Tilly here we

[1:03:14] are further questions from Council I don't have any questions i' uh have looked at the project looked through it I've asked the questions that I wanted answered and needed she had the answers and you're right you don't ever say not to CH Tilly um I got the phone call you know charot I need to meet with you and I just said where and what time didn't ask what it was about but um I appreciate the English version uh my Spanish isn't good enough to read I I agree with uh Harry that this is a win-win situation uh to bring more tourist to St Angelo but also to bring the uh Paint Rock the sayings of the Paint Rock to a lot of people who come to San Angelo to travel they have time to walk our River but they don't have time to drive out to see the the ranch to get permission to actually see the carvings and this would give a little bit of the taste of what we have here in the koncho valley and with the Indian blood that I have in me uh it just really speaks to my heart I don't see this as being of any denomination of anything it is simply seeing a vision whether you believe it it's like we have a vision of what we want our River to be and what we want to include in its history to tell the people a story uh to realize how really wonderful it is here to live in St Angelo there is so much to offer and the Indians were long before the fort and to tell the story of the hos and the teachings that they were giving of the good Lord is is a wonderful thing a wonderful thing and just to be able to share it and have it downtown on our River uh for the enormous income that it would provide to the city from tourism tourism alone uh we have long ignored how our river runs

[1:05:18] through how it runs through it in what a beautiful way to do and to respect it that's the end of my comments Mr Mayor um I just wanted to tell yall that I really appreciate all your hard work that you have done and I think also I agree with the other two Council people on on the board that um this is a great thing for S Angelo and I think it's even more wonderful with the fact that it's more historic than anything and that the the young kids of today can actually learn something from from what has happened a long long long time ago so thank you very much for bringing this to us anybody else because I've got a couple of comments too y If This Were on private land I would be 100% for it but I do see this as a religious thing and This concerns me that we are having a religious artifact placed on public lands because we do have the separation of church and state uh so my legal question is going to be to you Miss James if we allow the Catholic faith to put this up on the private prop on public property on the banks of the river what happens when the Jehovah's Witnesses or the Mormons or the Baptist or anyone else even non-Christian religions what happens when they come forward and ask for the same thing what are we going to be able to say except we've already opened the floodgates and we and we could have we could have every religion and there's a hundred of them in s Angelo we could have a hundred different memorials all along our River on public land This concerns me well I'm less concerned about it because it does deal with the history of the area if it were purely a religious um statue or some sort of um display that deals strictly with religion that would be a concern but because there's a historical aspect of this I think that is what the difference is I don't want to get us in trouble and I don't want to open the floodgates to

[1:07:20] something that we once those floodgates are opened we can't close them that's true I don't if if any other religion in this world wants to come down on by the banks of the river and build their own Monument next to this one there's not a thing in the world we can say except yes because we've already allowed this I would feel much much better about this where it on private land somewhere and being on public land and that's the only concern I've got and also Carl I thought this is where we're going to put our Cowboy Town what happened to Cowboy town where are we going to put Cowboy Town yes sir it is close to the site we did discuss but if you recall we didn't get approval to move forward with that and we don't have any funding behind it so this project does have funding behind it I think I might also add Carl go ahead on the spot you were talking about we were talking about this area and I would agree they wouldn't be compatible uses but I hope to find a place for the western town one thing that Council also a few years back you know we were having some uh donations of artart and those type of things for our community so at that time the council established the public art commission which is appointed by Council to review things that come before the city to see if we feel they're appropriate for for the community so this particular item like any of the others went before that commission sort of a safeguard that you set up at that point to make sure that just random things aren't placed in our community so well I have no problem with the with the concept I have no problem with the historic I just have a problem with the location and I don't want to get our city in trouble I don't want to get into something we can't get out of and that that's a very deep concern for me Mr Mayor yes ma'am and now Harry's first he was waiting yeah I just want to make sure that that the public knows that this really is not a religious symbol as much as it is a historic symbol and I think the history portion of this regardless of how it comes about uh the lady in blue certainly uh comes

[1:09:26] from uh Catholicism back in Europe but that's not the the reason for this this is from the human Indians and the historic portion of St Angelo the beginnings of of St Angelo long before the fort and and and down town so I think from my perspective from The public's perspective putting it on land that belongs to the city really has nothing to do with religion it has to do with history I totally agree agree uh it's not so much about religion um you know anyone can determine what denomination they wish once they have discovered the good Lord and uh to put a denomination on it would make it religious this is not a denominational thing for Baptist Methodist or Mormon or anyone else this is history and how we were taught in the lessons and I still see that there is room either forward down river or a little bit up River for the western town because it all came together you know the Indians and then the western town then the fort it all came together to make a part of our history to why we're here today and because of that I'll make a motion to approve as recommended have a motion to approve as presented did you second Harry second we do have a motion we do have a second do I have any further Council discussion on this yeah I believe I believe if if you go across the country you will find that uh some of the uh government sponsored uh museums have religious uh paintings and artifacts in them on display so I don't think this is a religious issue I think it's a historical issue all I'm looking at is the paper here that was given and it does describe her as a Franciscan nun it is she was a Catholic I mean it was a Catholic

[1:11:31] religion is spoken of here I don't have one problem with the concept I only have a problem with the location and you've got enough votes here it's going to pass and that's great put it up but I'm I'm I'm afraid of this I'm afraid of this and I'm going to go on record as being I'm not going to support it because of the location and I think that we're opening ourselves up to some serious things because we could have a hundred people in here next week each one of them wanting to put up a monument to their to their religion and it it worries me I we have a very ecumenical committee it is not Catholic there's nothing Catholic in our Endeavor and if anybody else steps forward and wants to put up a monument if they can document 12,000 years of the history and that's what San Angelo is about very well I know you've got support and it will happen but I've also got my concerns and I'm responsible to to say my concerns and to stand up for them do I have any public comment on this further comment before we vote come forward guus comment on the history side I've written about this history for 35 years so I know all about this if you eliminated religion from history you would have wipe out all of history uh this is not about uh it's not even about the lady in blue it's about why were there Spanish missionaries at this spot in 1629 a year before the city of Boston was founded that's what this piece is about it's not prati in Catholic religion it is just pointing out a fact of history that is completely backed up by documentation thank you further public

[1:13:35] comment on this come forward sir mayor council my name is Steve Hampton and I just happened to be here today uh uh and you brought up religion and so I would like to make statement about that uh the uh see I'm I'm a member of the Mormon church and uh I find no problem with this at all in fact uh I think one of the great benefits of living in this community is because of the religious environment that we are exposed to and I um I think this would be well accepted also um I have another question that is uh is there a master plan uh concerning the this seems to be in a location that's east of of the oak Oaks Bridge LI or the Liberty Bridge is anyway or Freedom Bridge what I can't remember the name c uh is is there a master plan on this are we is this opening up a new set of um developments along this uh part of the shore uh uh you know are we going to get caught up in in more expenditures because of uh because I don't agree with the uh I don't agree with the um that this is going to be in a bunch of uh tourism uh that's going to support any development along that in that way um but I think it is is certainly notable to uh remember our history so I have questions about the do we have a master plan on this on this eastern part of the river uh that uh I'm unaware of I don't know of anything Rick what do you say to answer that question

[1:15:37] and Carl can chime in as well we we had did a master plan of the whole river uh for the most part that included trails and lighting and bank stabilizations and and various nodes along the river this particular area was not specifically designed out uh the goal is to develop nodes of Interest along the river so as you're moving along the river whether it's Kids Kingdom or or the BOS or these the points of interest as you go along to draw you along as far as your question in regard to maintenance you'll notice in their presentation staff of course brought that up um this group has graciously agreed that they would work on an endowment of funds to help fund those maintenance dollars so we're suggesting that that endowment needs to spin off a certain amount of money each year that would then cover the cost of the increased maintenance of this site so you're you're saying that there will be further development on down the river our goal is to make the the river of course have a natural feel to it but as you've looked at the downtown area there's various concepts of development uh in the downtown area versus As you move away from the downtown area so there are various Concepts developed and there's a dam uh in this area correct and will that be moved or or changed in any way and parking in this particular case there's parking right there behind what I call the old western mattress building that is owned by the city uh so the goal is and that was one reason they actually selected this site because it it was a little more quiet in location but it also had uh easy access to parking for it thank you thank you sir any any further public comment man be remiss in not thanking the anonymous donor for his commitment to our town it's not like it was a dollar or two I agree yes

[1:24:00] was on private ground I would never have said a word put a 61 on it thank you very much good luck with it and to remind everyone that this will need to go back to the public art commission and then council with the final design some months down the road we have just approved the concept St in them item number c is the first reading in public he of an ordinance for a street name change from Quest crestwell Street to Lighthouse way for a 472 ft length of the RightWay from vau Street to Austin Street John James you are on sir thank you John James director of planning and development services as you mentioned this is a street name change request uh from a private property owner you can see here it's crestwell it is only that one individual block is the only length of that Street um and they are requesting the name lighthouse way for that street this is requested by the Lighthouse for the Blind organization and that's what prompted them to ask for the name lighthouse way uh here's the future land use of the area it is a commercial area uh it's uh a combination of zoning districts including manufacturing commercial and you can see some single family there uh I will point out that there are I'm sorry this is the let me go back um there are currently no properties addressed on this street so in terms of addressing it won't make uh any difference uh in it won't be changing anybody's address in other words uh we do have a lighthouse Lane that's out in the lake area uh typically our standards would suggest that we don't name two streets so similarly a lighthouse way and a lighthouse Lane um because of the shortness of this street the length and the fact that there are no properties addressed on the street as well as the fact that there are currently no properties addressed on Lighthouse Lane at the lake either um in our review process the the number of

[1:26:05] departments that reviewed this felt comfortable with this particular name change although again I'll say normally if somebody comes forward asking for a name change that would a lighthouse way a lighthouse Lane a lighthouse Court we wouldn't typically recommend in favor of that this is I don't understand that statement because we've got old poost Circle oost Lane oost Court oost I mean we have that so why would you not there are some distinctions Courts for example where you have a a Long Street and there's a culdesac that comes off of that street it's not uncommon for that culdesac to have the same street name and just a court designation but because of um because they're in the same area that doesn't cause the same problem uh the potential problem here is somebody calls 911 and says I'm on Lighthouse Lane um you don't want somebody showing up at Lighthouse way uh and so it's that confusion so we look at each one of these on a case-by casee basis and so that's not to say that this can't happen again in fact we're we're recommending in favor of it in this case uh but the general rule rule would suggest that we don't typically do that but there are exceptions and we do have those elsewhere in the community does that answer your question no but that's okay this is just showing that existing Lighthouse Lane again it's just a short segment but that could be continued into the future uh as that uh undeveloped area develops answered my concern I move for approval second you have a motion to approve is presented do we have a second I I don't see any problem with with it does anyone else see a problem with it on the council this is your time to speak if you do it does require public hearing does require public hearing this is the public hearing so if anyone in the audience has a problem with this or a concern this is your time to step up and make your concerns

[1:28:11] known no public comment then I will call for the vote the vote the motion has been made to change it to Lighthouse lane from chriswell and it will affect only one res or one address Lighthouse Way Lighthouse Way Lighthouse Way from chriswell and it will affect only one address actually no addresses at this point okay all in favor please say I I oppose nay let's move on to the next one which is another uh first uh first public first reading in public hearing on an ordinance to repeal an ordinance approved on September 18th to12 naming a private drive as Tom clock drive and to designate an unnamed Private Drive in the 2900 block of Southwest Boulevard is time clock drive you have the the floor sir thank you uh this is a similar case in that it's um it's we're treating it as a street name change uh in terms of process it's actually not a street and so that's the distinction and I'll get into that here in a little bit um you can see here uh at this location is the new location of the time clock plus uh headquarters of that company uh they currently are addressed at a different location on a private driveway that is addressed as TimeClock Drive since they're moving their facility uh they want to resend that previous ordinance designating time clock drive at their old location and they want to basically carry over that same address and street name to their new location what that would mean is give giving a street designation to this internal part of the shopping center driveway basically giving a street name to a driveway and a shopping center with uh an address being addressed off of that so again there are two actions required one is to resend that first ordinance that designates time clock Drive uh over off the loop at their old

[1:30:16] location the second action would be to enact the new ordinance giving that name to this the new location this is the previous location again that's currently addressed as TimeClock Drive uh just the zoning of the area it is commercial here's a picture this is the driveway in question uh again it's it's off of uh Southwest Boulevard the the building itself is currently addressed off of Southwest as are all of these other shops uh in that shopping center I'll point out that th this change would only affect the one building uh all of the other buildings in the shopping center would maintain their Southwest Boulevard address uh and I I'll mention in a minute that's one of the reasons for concern uh this is just a picture of that uh their new business and again seeing the driveway in front of the business that would get would get the street name so uh staff is recommending denial and I'll go about the reasons for that um it it is more reaching the previous designation only affected the single building this potentially affects the whole shopping Center all of the other businesses in the shopping center will have a Southwest Boulevard address whereas this one uh would have a different not only a different address but a different street name uh it implies an address portability that you can pick up your address and and move it somewhere else uh we're concerned that that may set a precedent uh that could be problematic uh this was reviewed by all of the departments in the city and I won't read all of these but all of these departments and divisions recom recommended against this for a variety of different reasons obviously police and fire and 911 had some concerns about uh number one giving a street name to something that's not a street uh and some of the other concerns I mentioned as well um some of the other rationals that we looked at uh possible delays in updating things like uh people's GPS Google Maps make it more difficult as

[1:32:19] those changes transition through those systems uh confusion to the public as I mentioned some of the businesses in that shopping center will have an address on one street this building will have an address uh as another street again which isn't actually a street uh there are no similarly named streets so that's not a problem um again this is It's a unique circumstance uh the applicant's going to tell you that that's a reason to approve it it is very unique um you saw one of these in 2012 when they asked for the first designation to be named um they you approve that the council at the time approved that at the time um no one else has come forward so I I understand that one of our concerns is this will set a precedent and other people will want to be naming private drives as streets at least since 2012 no one else has come to do that uh but it is still a concern that we would have uh we did send out Noti notices we did not receive any responses uh in opposition or in favor uh I will add that the owner of the shopping Center has submitted a letter they're comfortable with the uh the change and how it impacts the shopping center staff does recommend approval of resending the uh street name at their current or their previous location so we're okay with that that needs to happen in any case uh but as I mentioned for the number of reasons we are recommending denial of the renaming of the new location as time clock Drive uh with that the um the Planning Commission recommended approval of both and I won't read through these but they looked at both ordinances as well uh but their recommendation was to approve both ordinances and giving the new name time clock drive and that was a 5-2 vote by the Planning Commission with that I Happ answer any questions it's my district and uh I've driven it I've walked it I shop there um I'm accustomed to giving people directions and I would always say well you know the multi Kim you'll pass the

[1:34:21] multi Kim when it was there big name on the front they can see it from Sherwood Way and I don't have a problem with it I think to me it's a win uh simply because of the employees that they have that they value and they're increasing in size what they offer to S Angelo uh I certainly uh don't want to disagree with staff for their recommendations but on this I do because uh I believe the public private business out there needs some consideration therefore I'm going to recommend uh the resend of their first request and also approve uh recommend uh their approval of moving the name over to their current location I think for clarification uh that would be going with the planning commission's uh suggestion no because the Planning Commission oh the Planning Commission yes I recommend we go with the planning commission's recommendation for clarification just need a second well I think it's very confusing to put a not even a street and just for one business on the street because there's another six or eight on past that that will still be on Southwest and just one I think it's very confusing so the only thing that's we do have a motion we're waiting on the second any further counsil the only thing that's pass that is the Social Security office and a hair they showed about four or five different build minut past it going this way the rest of the L uh so the only ones that would be affected like you're saying would be the Social Security office which everybody pretty much knows I saw your picture there that there were four or five different Lots drawn off there this is the shopping center was edot right I'm talking about the bottom part of the shopping center when you showed it while ago there was a

[1:36:22] picture and it showed about four or five different different this is the area that has hobby Hobby Lobby in it no that's that's right there you show all of those that's one two three one two three four five different different addresses right there that end I'm talking about the L-shaped of the shopping center the bottom part of the L where the Social Security office is next door and there's a hair hair design yes work of art thank you those are the only six different there are six different Lots there there are six different buildings there you can see it so we would be change we would change the address on one which would be and the other six would still be in Southwest yes that's that's not what I'm saying is the directional of it the L shape Mr Mayor the bottom part of the L yes ma'am there's only the three businesses there the other six are on the North uh South you know leg of the L and I'm seeing something wrong because I'm seeing 1 2 3 4 five six areas there different businesses it could be that those some of those are combined in multiple you know one tenant has multiple spaces how many businesses how many businesses are in those six spots I couldn't tell you Rebecca's telling me two two so they could be split up further but right now split that's I'm saying that's to me that's very confusing to come in a parking lot and change half of it and then the other six not CH it's confusing to me so but Harry my question is do we need two separate motions on on these okay then I will second what Charlotte said to approve from the Planning Commission stand point of view we have a multi-million dollar operation with Time Clock Plus World recognized that's headquartered in San and I think even though this sets a predent

[1:38:24] we ought to be H happy that these people are still here and employing the number of people that they've got so I'm going to move to a second to approve what Charlotte had thank you go ahead further Council discussion on this I believe you said that there was no objection from the manager of the shopping center that's correct any other questions on the rightwing do I have public comment on this item okay mayor will you please clarify what we're going to vote on the vote is that we give Lighthouse that we resend the lighthouse off of uh 306 time clock we resend time clock off of 306 and that we give them change it to time clock for the first half of the parking lot that takes care of their building okay so this is all in one it's what the Planning Commission it's all in one yes sir uh my name's Ernie neighbors I'm the chief operating office officer over at Time Clock Plus um it's it's not our intention to to to disrupt everything over there you know we we want to keep and it's my it's my understanding with when working with the city that this is this would only affect us I mean us the address would only be for for Time Clock Plus and um I I kind of wanted to say something at the Planning Commission and and I'm I'm I'm I'm very glad that the Planning Commission voted the way that they did one individual on the CL Planning Commission said so and it didn't sit very well with me he said so you just want to name a a piece of pavement it's not a piece of pavement to us you know this you know like like Harry said we're we're National company when we put one time clock drive for Time Clock Plus when we do a bid when we Market when we do all of that it's it's a base hit and those base hits are are what makes us successful in this town and you know I'm not asking you to name a piece of of P of pavement I'm asking you to be a part of this you know we you know last week we we we broke 200 employees finally and and that's that's a big deal for us it's you might say you know Lowe's has 200 employees but not you know 200 employees in this sector

[1:40:26] this this computer science sector that wouldn't exist here in St Angelo if we weren't here U Howard College uh ASU when those computer science graduates and those Mis graduates and those Communications people when they graduate they have a place to go they don't have to go to Austin they don't have to go to San Antonio they have it right here in San Angelo so that that that's what we're asking uh the city to be a part of I'm not asking you guys to name a a piece of pavement for us I'm asking you you know to to be a part of this thing and and and the base hits really help and I've asked Roland to come with me from the economic development department to to speak so you make a good point good morning Council um I just wanted to share share some com comments with you um Phil you know Phil's not not here and and the Chamber is not here and I think and these kind of opportunities is when we relied on a business advocate and um the chamber is not here but but I think the the business and industry needs to know that they have an advocate within municipal government and um as Ernie said I think there is a partnership between uh the municipality and business and industry and um we've partnered with TimeClock plus with their recent expansion in fact you may say We we played a part in that expansion and helped them to move and uh and we looked at their economic impact for this this recent expansion and it amounts to an economic output of $19.1 million for this city that's just economic output 200 jobs these are it related jobs an industry sector that we've been struggling to have it helps to diversify our economy and so these are well um uh attractive jobs that every Community would want to have in in in in their city and I'll tell you communities across the country country are doing this and they do this to ensure and that's what I what I say as I'm talking to business and industry that's coming

[1:42:28] to St Angelo as we're trying to recruit them we say that we have a business friendly environment that our city council Works in Partnership to help them be successful and and to grow I went back to the minutes of September 2012 and I read the the minutes and I read the resolution in the resolution it said that this was a project and the reason part of the reason for changing the the name uh was because it promoted Economic Development and it helped to create jobs and it helped to retain those jobs and I'm here to say that's exactly what what we're doing this means a lot to Time Clock Plus it creates loyalty to our community and I will tell you just as we're recruiting other companies in other cities to bring them to St Angelo I am sure someone is knocking at their door someone's wanting Time Clock Plus in their municipality in their City especially when they see that they're they're successful and that they continue to grow this is a company that is homegrown that started here as a startup company and they've grown and they're successful they're not a regional facility like the background information says there are headquarter this is corporate headquarters for TimeClock plus soft U manufacturing light manufacturing it Information Technology jobs that's important to us as our community uh the name change is important to them and um that is why I support what they're what they're pursuing not not to counter what my counterparts I was the only Department not mentioned up there but uh it's because I think business and industry it's part of my job it's part of my responsibility and so I support uh their request thank you Roland good point any other further comment on this before we vote Yes sir Blake heartsfield I uh live in that District uh I also was a former employee for TimeClock plus and uh that that business brings a lot of income and stability to our community and uh I

[1:46:37] the resoning from single family residence rs1 zoning District to office commercial Co zoning District on 0.642 Acres generally located at the intersection of freeden Avenue and North Campus Boulevard John James you're on again sir yeah this is a rezoning case uh as you mentioned it's a request to rezone property to a commercial designation uh the future land use map is neighborhood uh I will add that office uh designation can be consistent with neighborhood that doesn't necessarily imply all single family residential uh it is currently Zone single family residential but as mentioned in the staff report it has been used as a church office and the Associated parking for that uh for a number of years this is what the building looks like from the freeway Frontage Road Again typical office Tope building uh this is the parking lot uh that's across the street the rationale for approval again it it has been an office related use although it as a church office uh which is allowed um or was allowed at least at the time in the single family zoning District uh and the low intensity office that could occupy that building uh would have minimal impacts on the neighborhood and we believe would be consistent with the neighborhood classification uh we did send out our notifications only received one response and it was in favor uh so the the action requested is from single family zoning res residential zoning to an office commercial designation uh staff does recommend approval as did the Planning Commission unanimously who's whose area is this Lucy this is Lucy Lucy take over uh I am going to approve as presented I don't see any problem with that second do have a second from Charlotte Lucy said move to present to accept as presented with a second uh George you have anything you want to say on this do I have any further comment from the council do I have any public comment

[1:48:40] motion has been made to accept this as it has been presented it has been seconded all in favor please say I I oppose Nay put a 70 on it Brian let's move on now number f is an update on the progress of the auditorium project and consider authorizing the city manager to execute change order number two to the Lee Lewis Construction contract as construction manager at risk CEO 214 for a total of $445,900 funded by the project budget David nap you have the floor sir thank you mayor and Council good morning um quick update on the auditorium and there's always an extended invitation to the council if you're ever stopping by a city hall and want to go out and look at it happy to meet you at the trailer we'll put on a hat and we'll go look at the progress as it's going so uh always welcome jaylen's doing a wonderful job pushing that is yeah we've got is phenomenal best in place there running a tight ship so we're in good hands and so Lee Lewis Construction is a contractor they began work in February uh this year and their scheduled completion is the very first of uh around April 6th of 2017 so they're uh making good progress and uh uh moving on so far um bulk of the work right now has been demolition we've uh protected all the historic finishes of the walls and the ceilings in the in the City Auditorium um and you'll see plywood on all that when you go in there uh We've removed all the seats salvaged the pieces that we need for to be able to reuse on the new ones and I'll get to that a little later um concrete floors it's a big Dusty spot right now but all that's been torn out in the auditorium as well as the balcony um all of the rigging and weights in the U fly space of the stage has been removed and that that has been a safety issue for many years but now we're going

[1:50:42] to get it done right um and all the interior walls restrooms restrooms underneath the balcony restrooms in the basement uh have been removed and we're kind of going back with a clean slate and building everything new um and if you've driven by you've probably seen a big hole in the back there and I think that started the rain but um we've we've got the annex expansion dug they've poured the concrete walls the concrete foundation and so you'll start to see some uh steel going up um very shortly on that um one of the things that um I've been impressed with is their care and and um conscious uh effort in doing demolition this is one of the items that you know historic uh decorative uh plaster medallions on the ceiling there was six or eight of those that had to be removed and uh Galen was uh very inventive in how he was able to bring those down and and protect those and uh save them for reinstallation later uh here's a good view looking from the balcony down you can see what a mess it is now but um all the concrete's been removed and the big hole in the bottom is the orchestra pit uh that we will be expanding on um and here's the uh what's left of the steel uh you know of the balcony we've taken off all the risers is if you remember is very Steep and uh somewhat dangerous um so now we're going to rebuild that to we we're losing some seats up there but we're going to have more comfortable seats and of course it'll meet code and everything else so this is the Bare Bones of uh what is up there here is the uh Orchestra pit um you know we're going down a few more feet than that but uh in this wall right here has been removed had some structural issues there but um we're getting that resolved and um the the stage will extend out a little bit

[1:52:45] further beyond that as well um this is the before shot they've poured the concrete walls of the annex and just last Friday they poured the uh basement floor so that is done um and they're ready to get going um the contract um base bid was uh 10 10, 369 that's what we started with um we're doing a change order of 590 well we you guys already approved a change order 593 th000 so that bring the current contact contract to 10,963 and then we are pending change order two that I will get to in a minute of 445,000 for Auditorium seating um so here we go the asking Council to consider auth authorization of the city manager to execute the change order number two to the Lee Lewis contract as construction manager uh for a total of 445,000 seats um you can see on the right this was an original chair that we refurbished this was our first attempt to try and Salvage everything that was there and um it's cleaned up a bit and would need some more but the reality was that the mechanism for the seat uh was not salvageable and we would not get a warranty out of the contractor for that so our our goal was then to maintain the look we're savaging the armrest uh which have a very unique wood scroll to them as well as the cast metal end caps uh those are historic and those will be redone the seat back is a little thicker than what you see in most auditoriums now and we we are going to re uh replicate that with the new seat so um I think when you go back in there um it'll if you remember it from before it'll look uh very authentic so on the left you see the two seats um that will be refurbished the one on the right has the

[1:54:51] historic end piece and that'll just be cleaned up and uh decorated repainted with to match and then the one on the left is is very similar um but it will have all new components but it built as closely as we can to match the original so on the orchestra level you'll have the one on the right it'll look you know that's all the historic pieces that we will reuse and then the one on the left is um what will be in the balcony as far as the fabric that's just they haven't selected the fabric yet that was just the grade that they were having on there so this fabric isn't necessarily the one you'll see these samples that we had private previously uh was really to show the U level of skill and and workmanship of the the bidder and so uh they'll resubmit a new uh sample that we will approve and and it'll be exact but uh color selection will come with that um if you remember in the the balcony used to have just wood seats very uncomfortable um so now you'll have cushion seats like everyone else um been up here a couple times and I always try and bring the same information so we're uh as a reminder uh the funding that we have as a shared um partnership with sapac what the city of San Angelo has brought in what they have brought in we have a total of 16 million um in the coffers for that and then expenditures to date uh we've had 1, 873,000 that was done during the audit City Hall renovation and then uh subsequent expenses uh you can see highlighted in in yellow is this proposed uh change for U change order two on the seating um and then the Leist base contract and and the change order one that was included so note on that one the the auditorium seating has always been budgeted originally we were were going to do that we were going to order them inhouse since the historic tax

[1:56:53] credit item came forward it's more advantageous for us to order those through this contract because then we can leverage those dollars with getting money back on our historic tax credits so that's why we we changed this into the Lee Lewis contract and you'll notice we had budgeted 549,000 actual cost is going to be 444,000 45,000 so we're under budget in regard to what we budgeted there so so this is really just bookkeeping yeah yeah and it's because it's over over 50,000 Council has to approve it so with the 14 million that we've expensed and the 16 mil million we have in hand we we still have a funding balance of a million uh over a million so staff recommendation uh for the change order to it's fully funded we we've got it in our account um it's over 50 so we need your approval and we recommend moving forward we're merely changing the paye right or the payer from the historical money that historic money that we got from state of Texas so that it will be allowed so and the benefit too to having Lee Lewis do it now it's all under their contract their warranty and and there not making anymore right right yeah I don't have a problem with it I need a motion to approve or so move Harry you need a second second Lucy do I have any further Council discussion okay now now s this a commment and Ang now have a facility with an orchestra pit yes we this will have a um we had an orchestra pit before but we didn't have a lift system so the benefit is now we have a little bit bigger pit and we'll have a lift that can you know you can lower it put the orchestra in there or if you need to you can bring it up to stage level and extend the uh the thrust of the stage out and so you know it becomes much more versatile than because I think they had to frame build temporary supports to extend the stage and it was not an easy thing and we also with old buildings sometimes you just discover this building was built in a time when I I think steel may have been of shortage so one of the things we discovered under

[1:58:55] there is those those supports under the the stage were actually not great so that is being totally you saw in the pictures that wall got totally taken out those are some things we've had to do as we came along but we had contingency in the in the budget to cover those things so it's going to be much more sturdy thank you public comment on this item before I call for the vote is there is there a chance that they have to bust another hole to help with the rain well we we may need to do that okay I they do have some roof work to do I'm sure that'll bring that bring some more rain so let's wait till we get all the painting done right public comment on this item the motion has been made that we accept the change order it's a bookkeeping thing all in favor please say I I oppose nay let's put a 70 on that thank you thank you David uh item number G is first public hearing at consideration of an ordinance submitting chapter 11 utilities article 11.5 water conservation and draft contingency plan section 11 5.3 drought stages Water Management measures by amending the minimum criteria for establishing water supply stage drought levels one two and three Allison streby you do have the floor ma'am thank you good morning Council and mayor um at the last council meeting it was briefly discussed um how the water Supply calculation is done uh some questions have been raised by the public and we want to get that um clarified so we we did bring that to the last uh council meeting and it was also brought to the water Advisory Board during the June 20th meeting um just to briefly go over what is included in the current water supply calculation um our main water source which is ohiv uh crmwd provides us with that number of that projection of how long we will stay on on that Reservoir or how long we're able to pull water from that reservoir uh we do include 1.5 MGD which is our current minimum pumping capacity to keep

[2:01:00] media wet from from the Hickory aquifer um and then the other reservoirs OC twin butes and Lake nasworthy uh their current surface Supply is included in that calculation um the calculation does include a no inflow scenario we do realize it's going to rain but we always don't know how much or when uh so we include the worst case scenario which is no inflow scenario and uh the calculation does include evaporation uh per the Texas water development board I know it's been asked what is that number and it's approximately a little over 5 and A2 ft uh annually uh for this area so what we're W to do in the ordinance change today is this is just an example The Bold and underline is the addition everything else is what the current ordinance reads so we would like to include that the minimum daily groundwater production coupled with the total amount of surface water is included for that surface Supply and this would read the same for Drought levels two and three for the 18 and 12 month triggers so that's all I have I'll answer any questions I move to approve Charlotte I don't see a problem with this this is just do I have a motion to approve is presented I do have a second do I have further Council questions on this public comment call for the vote all in favor of accepting this this first reading please say I I I oppose Nay put a 70 on that Brian okay number eight is discussion and direction to staff regarding the most recent increase of water rates in relation to the funding of future water projects this was requ requested by council member farmer yes who's going to bail is that yours I think she's got some good questions as as I recall and correct me

[2:03:03] anytime that I'm wrong in there but we recently um had approved a $5 per customer water rate increase and what was presented to us at the time of that increase was to uh start recovering funds or to pay for the debt on the $136 million that we were going to borrow for Reclamation purposes now the way I recall that's what the increase was presented to us on and now that we have postponed the Reclamation process the people are still paying and have been paying the $5 per month per customer uh and in my opinion I agree with them under the opinion that that's what it was paying for now I do do understand that we have needs in the water department improvements in the existing plant and possible expansions that are coming up but they're they're not here yet but we have been charging this $5 per customer and I don't know the exact number of customers but it U works out to be about $165,000 a month that we have been charging the people in St Angelo for this debt what is the balance or what is the amount of the actual money in there and are the citizens due a rebate of that money or can they be assured that that money that they approve for Reclamation is still going to produce water projects because it wasn't raised underwater projects that's my question great question if you recall we had uh and you adopted A Five-Year Plan and the condition of the utility uh at the end of last year was pretty dire as far as uh where our fund balance was in fact we had a negative fund balance at the end of uh December and so the water rate increase uh and the projected uh

[2:05:06] Five-Year Plan was not just to pay for new water but it was to if you recall the the words of the consultant I believe was to write the ship uh because we were uh in in need of making adjustments just to operate the utility today so the first two years well actually all five years was included in getting our uh fund balance back to a 75 day uh amount operating uh balance and then also to have a a debt service coverage included in the middle of that five years if you will it was a potential debt uh and we did use the $136 million that was the price tag if you will for that project but we uh stated and and basically at the direction of the council for sure is that it wasn't for the Water Reclamation project it was for new water supply project and so while we uh recognized that that might or might not happen that was a good number uh to put into the U projections uh to be able to fund new water supply for the city so the first two years this first year uh we were projecting to increase our fund balance which ultimately needs to be at about5 to 5.5 million uh to get that to 1.3 million I believe and it's a little over 1 million right now so we are seeing improvements in in the uh buildup of our fund balance there's nothing that is collect the collection of any money for the new water projects was not going to happen until the that projected Debt Service went into place which was going to be 2018 so we had projected selling Bonds in 2017 first payment in 2018 so the the short answer to that part of the question is nothing has been collected to date for new water supply what's being collected as part of the rate increase was just to bring the water utility into a good financial position and that's part of the fiveyear plan that's that's not the way I recall that the increase was four and I've gone back uh to look at what's written there and

[2:07:11] that is definitely not what the increase was for I don't think the minutes will support you on that does that mean then since we've been doing this for S months and we're already already up to $1 million we have $ 300,000 more to go when we hit that 300,000 are we going to reduce the rates to maintain that level the actual again it's a five-year plan to end up ultimately in the at the end of five years to have the fund balance that that we need that would cover 75 days mayor we did discuss uh during the the those talks with the Consultants as well uh we did talk about our fund balance uh we that was something that that we realized that needed to be replenished we talked about a future project um we talked about dead Service as well so those were topics that were brought up and we can definitely take a look at the minutes to see what was said but those are areas that we had mentioned needed to be taken care of well I definitely want numbers actual numbers from the Inception of time and I definitely want uh the minutes and possibly the film reviewed because what I stated my understanding was a lot of the Public's understanding that that's what their $5 was increasing um now the maintenance and the fiveyear plan was to come later and that $5 you know would be going toward that as well but I I really want it explained in detail okay we can do that and we were sold that we were funding 134 $136 million project and that's what this increase was for yes and if we're not going to do the $136 million project then we need to give the people back what they're paying for I fully understand that but I just because sorry just a real quick comment even though I was not sitting on the council at the time I happened to be in the audience and my recollection is that the first thing we had to do was write the ship so I would encourage Mr Riley to bring back those numbers have this

[2:09:15] conversation at the next council meeting and go through this I I agree that we should not be collecting money if if that's what the intent was but I don't believe that's what the intent was at the time well I want to make sure and I want to make sure that we protect the public as well as the city because it you know if you do simple math it works out to be a considerable sum and to write the ship to bring the fund balance up yes I understand that but that's not how we sold the product as I recall so I do want want to review it and look at it and I'm not suggesting today that we automatically do a rebate that's not what I'm saying I want you to bring me the figures let's look at it and look at our 75 day or where we're at and decide what we're going to do in the future going forward until we do have an actual project mayor if I could uh I have the same recollection that there were I think were there three stages right the ship there was uh status quo and moving forward or something like that uh Anthony pointed out he's going to send you something before the end of the day uh a link to an AR archive uh I do recall the same thing that there is a bond issue built into that Five-Year Plan but it was not built into the first or maybe even second year it's it's it was going to take some work to get the project started and so I think your recollection is correct for the substance it's the timing I think the timing was farther into the 5-year plan where we we issued the bonds and begin using those uh increased revenues to service the debt the other thing for you to keep in mind I think we have a mechanism for reviewing the results of the fee increases each year did we get a copy of that model we did is that built into uh your strategy moving forward uh absolutely I mean as we as we the reason for having the model that we could look at what is collected what the projected uh needs are going to be then make the

[2:11:18] adjustments even though you adopted A Five-Year Plan it was anticipated that each year we would look at that and and adjust that next year increase as needed if you'll recall we we had a a a rate increase several years ago where the mayor then a councilman uh suggested uh that twice a year we would review the fund balance the beauty of having a sophisticated consultant assist us with a model is that we have a much more sophisticated uh and I think accurate way of looking at how are the revenues uh performing relative to the expenditures um this will allow that uh sophisticated model to help us measure are we meeting those goals for solving the financial issues they were dealing with so I guess my question would be Bill how soon would you anticipate that first review to take place with the model I think we were anticipating the the rate increase on the calendar year basis that's what we did the last one that obviously prior to that towards the end of the year probably the last end of the third quarter is we'd be able to see where we were and make projections for the next year so we may have some discussion here in the next meeting or two but we can but we'll probably be talking about it in the February time frame a bigger review of this is what we did and this is what the impact was or or by the end of the year right oh that soon right Lucy well I had a comment but I don't have one anymore well I can just remember that in December of last year our water fund was broke we had no money we were in dire circumstances we've got to get more money and we passed this and that 134 million was in it and then I think it was in March or April all of a sudden we had $330,000 in our budget to do a comprehensive water study so that kind of that kind of sticks in my craw as

[2:13:20] well how we can be broke in January and then in March or April we've got $330,000 to do a study so I am particularly interested in what Charlotte has brought forward here and if our people are being overcharged we need to fix it we need to fix it quick so bring us something please Bill Bill you weren't here uh and I wasn't on the council at the time but uh we had a pretty substantial water rate increase to cover a $20 million bond issue to build the water tower out what everybody calls the Bluffs tower out at 2288 and in the first year I got on Council and there was a water rate increase to cover those expenses and the citizens were angry they were upset they don't understand so this was proposed and passed to help cover that 136 million doll debt that we were going to incur for Reclamation of water that's what I wanted explain to the people why they're paying an increase now but we don't have that project and I need it in plain black and white simple number of figures that the public can understand they understand maintenance they understand improvements to the existing water plant but they want to know what we've been doing with their $5 per customer per month since the first of January and next year it goes up again yes we'll bring back we'll bring back to specifics that won't be a problem thank you I want ask so are y'all more or less is this what I'm thinking when we decided not to go through the Water Project which is going to be $135 million now are you just are you more or less have it in the F fund balance so for future water projects when they come up I mean is that what we're going to be uh asking the public to do is pay this extra money because of it the 5e plan no no ma' the The Five-Year Plan was to do it was in three stages as as Mike said one was do nothing and the utility was virtually going bankrupt

[2:15:24] okay so the other was to to sustain so there had to be rate increases just to continue to operate the utility that included increasing the fund balance that was at a negative point to have 7 75 days of operating Capital that was a recommendation from the water Advisory board that was the decision that you made it also included to uh for have debt service coverage increased as well well to one and a quarter okay so that was money that was needed to operate and to rebuild the reserves of the utility that's part of that Five-Year Plan that would take a portion of that increase over the five years in year 2018 we were anticipating that there would be a water supply project that still something is going to have to be done but we used the $136 million that was the uh estimated cost of the uh reuse project recognizing it might not be it but there's going to need to be some additional water supply and you're going to have to have funding to do that so in that Five-Year Plan it included bringing the utility back to financial sustainability and develop a mechanism for paying the debt service on any new project that was anticipated hitting in 2018 so to date we're still in the write the ship mode but that building up those reserves and that fund balance certainly helps when you do incur the debt for a new water supply project to be able to pay for those I I I I did think we had to write the ship before we started I think those I think those answers are going to be in that information in subsequent discussions I think you'll be reminded it is a difficult situation and it's going to take in order to smoothly and not dramatically impact our rate pairs uh we do need to stretch it over five years and uh I think you'll I think when you see the information you'll be reminded that that that that bond issue was going to occur in one of those middle years and that that's when uh we would have the capacity or we were hoping to have the capacity to have The Debt Service on that that capacity I think is the

[2:17:28] capacity you're talking about uh and I also want to include something that may very picky to you guys out there in in finance but I think it's important I want you to include the ending fund balance in the water Debt Service fund at the end of the city's fiscal year those dollar you had an ending fund balance and I want it pointed out and separated in the numbers that you provide us please Bill also want to make a bail okay it was pointed out uh in previous by previous councils that you're selling a project you're selling a product and if you don't sell that you're not going to have the revenue to run the department okay citizens were asked to conserve water so you weren't selling as as much water okay and all the citizens see is that they are being punished for conserving water their water rates keep going up I suggest you you learn you look at cutting uh expenses in the department thank you got your instruction sir sir thank you Bill easy question easy question item number I has been pulled from the agenda we will not be discussing item number I item number J is the first public Hearing in consideration of an ordinance amending the 2115 216 budget for Grants and capital projects Miss Chad gidden you are own ma'am good morning uh we have some routine items before you today I'm going to hit the high points uh the first is a total of $997,000 increase to the budget um that is fully funded uh by each of the items as I go through them no use of fund balances no use of uh general fund dollars the first item was approved on today's consent agenda the bosi uh rainwater harvesting system so a grant uh from the in National Oceanic and Atmospheric Administration $155,000 in revenue and $115,000 in expense the next item there are increase program dollars for our Wick funding so that it's $166,300 increased revenue and increased expense to continue the operations there

[2:19:34] the next item is the State Office Building improvements as approved by the council June 2nd that we have a $30,000 reimbursement for um past um Capital Improvements we're needing to reinvest that in that uh building this year so we're going to go ahead and C capture that Revenue budget so that we have it for some some minor Capital needs next item is a storm water equipment replacement we had an insurance claim where we received proceeds of $30,000 we want to go ahead and reinvest those this fiscal year so we can replace that equipment uh with the $30,000 expense and the final item before uh you today is a home buyer assistance program these are recaptured home funds and so there's 6,1 $12 to date that we can reinvest in those assistance programs so again a total of $97,400 Bill uh what what the storm water equipment is being replaced um I I believe it's a couple items we've had several claims this year uh for items that were damaged uh pickups and um a piece of heavy equipment I don't know the exact item there's Shane good morning Mr Kelton the majority of this uh of this equipment replacement was the pickup that had the accident out on Foster Road okay was uh almost all of this so oh okay I was just curious it it was the vehicle accident that was out there on Foster Road was is the majority of this okay thank you it's an insurance it's an

[2:38:05] won't get into the reasons why it wasn't picked up or residential or Republic but I will tell you that Republic responded the same day and got out there and picked the can up the very same day that I called them with the problem but it's all over our city I know it is all over our city if if we're getting the calls you know are we making them to the right I mean I emailed everybody Daniel and Street and Bridge and code enforcement and Republic and Republic got out there and picked it up let's be careful not to get into any discussion right now but we have these items we just to answer that's just a question I've got we need to deal with that bill okay I've noticed that uh like we're I live and we've got an alley and and since uh since a trash pickup has not been going through that it's gr out of control and and uh I've had to uh contact the city or the code enforcement and uh some of the Yards were out control also there and they came down cleaned it up and then I don't know if this is the direct uh result of that but we had I show I sent you the picture of that snake that we had in our backyard and on EES of EES of the house we we let the birds uh Nest up there and that's been going on for years and years and years and this is the first time that we've had problem with with the a snake and this was this was a large Diamond Back May all right this doesn't address your contract issue but if there are code issues our code officers are working those issues and they are trying to be flexible with residents who who need time to address those issues but they're still working weed and growth issues and if you have those let us know we'll be try to we'll try to follow up and if there's nothing else I will ask for a motion to adjourn all in favor say I I 12:50 p.m. this meeting is over I say
