[0:00:00] thirty four in the morning I would ask that anyone who has a cell phone to please double check and make sure that it is turned off and and or on silent or vibrate so with that we will now do our prayer we all bow our heads please our most Heavenly Father we thank you for the abundant rainfall you have blessed us with a rain that we so desperately needed we pray Lord that you will continue to look over all those who have had to suffer with flooding and the loss of home and Families may we all find a way to help those in need Lord we continue to praise you for allowing us to live in this great city of San Angelo and for allowing us the privilege of serving our citizens I pray that you will guide us and help us make the tough decisions that are the right decisions for the citizens we ask that you continue to watch over all our first responders and make sure that they get home safe every day we thank you Lord for the many blessings that you have bestowed on each and every one of us thank you for the food that nourishes our body and that we may find a way to help all those in need particularly again those who have lost so much with the rains the Hurricanes and the flooding we thank you Lord for the wisdom that you show us and give us we thank you for the life that you have provided for us and this we ask Lord in Jesus Christ's name Amen we will now do our pledges today we are privileged to have Samuel Hagen fourth-grade and grace Hagen second gray from Glen Moore and they are the children of our risk manager Charles Hagan so I'm going to turn over you want to step up here just a little bit more

[0:02:03] and who's going to start [Applause] today we are going to have a proclamation for Mark McLaughlin day John Mark McLaughlin and his wife Amy moved to San Angelo in 1962 and thereafter the pair made an incredible impact on the concho Valley community today we commemorate Mark's contributions accomplishments and dynamic leadership over the years do we have mark in the audience see him among the vast areas that Mark contributed to the success of or brought to San Angelo are the following founder of Texas State Bank along with Bill Maher Maher school in 1962 and thereafter serving as chairman of the board and guiding its continued success founder of the first cellular telephone company in San Angelo now known as West Central Wireless president of the San Angelo chamber in 1988 one of the earliest benefactors of the San Angelo area foundation along with his wife Amy and board member of the Angelo community hospital and the

[0:04:07] Boy Scouts concho Valley Council in addition to the service in San Angelo mark also served as at a broader scale for our great state of many respects including his role as president of the mohair Council of America president of Fort Worth based Texas and southwestern cattle raisers Association in the 1990s trustee and president of the UT Law School Foundation judge advocate in the US Air Force and board member on the UT Development Board Mark McLaughlin has demonstrated excellence and spirit and he continues to inspire and guide citizens of San Angelo he has truly helped to shape our wonderful city therefore I Brenda Gunter mayor the city of San Angelo Texas on behalf of the City Council and together with the San Angelo chapter the Texas Exes do hereby proudly proclaim October 24 2018 as Mark McLaughlin day and urge all the citizens of sin Angela to acknowledge the occasion of this day thank you we will now have another proclamation I believe come on forward anyway we would like to present some awards for first one introduce myself Brent Casey recreation manager and would obviously like for you to stay here and present their words to some individuals that we have for some outstanding service this year but also have John Henry Perez who was a recreation supervisor here in San Angelo and Sandra Pena who was also a recreation supervisor here in San Angelo and our special guest to help us present these awards besides the mayor is Annie zinc which is the Texas amateur athletic Federation president so Thank You Danny for being here appreciate you driving up from Bernie this morning in the rain I don't get started with the awards good morning to everybody thank you very much

[0:06:11] our first award is gonna be presented to Trey Allen wait one second Trey I'm gonna read something real quick Trey Allen's nominated for the local athlete of the year for the city of San Angelo Recreation Department Trey participated in Youth flag football in youth basketball this past year Trey's eight-and-under flag football team got 3rd place at the state youth like football tournament and second place in the 8th in under Division 2 state youth basketball tournament so Trey was a ecstatic standing leader for his team and a great teammate and right now we'd like to present Trey Allen with a local athlete of the Year award come on [Applause] our second award is gonna go to Jacob Padilla Jacob was nominated for the regional athlete of the year for region 10 Jacob participating new flag football and also youth basketball since he was the age of four years old this past year Jacob was part of a third-place youth FLAC football team and also for the state tournament for Aiden under and Jacob was also part of the second-place youth basketball team that trade participate also this past year in the state basketball tournament Jacob has many skills at a young age that we saw he was a great leader for his team and every time Jacob plays a sport sander and I were amazed by what run he had just done or what shot he had just made for his basketball team so this year Jacob D is our region 10 athlete of the

Gary Gabriel so Murray what's on the plaque coach gate so this year Taff is a contributor appreciation award to coach Gary Gabriel coach Gabriel has been a you attract coach for the city of sandal for the past 14 years coach gabe works every day with the city's track team starting after Memorial Day and finishing up the summer games of Texas which ends end of July coach Gabriel has done this was the Pat past 14 years not missing one single day that I know of coach Gabriel started off at ASU as a voluntary coach and now is a now as they head cost crunch we track coach at Cornerstone here in San Angelo so coach Gabriel on behalf of Taft behalf of the city of San Angelo thank you for this award [Applause] Aric council first of all I just like to

[0:10:21] thank you for having me today on behalf of the Texas amateur athletic Federation we just celebrated our 93rd birthday so for those that don't know we've been around for a long time and is always a pleasure to be able to present these awards to receive these awards I'm a Parks & Rec director for the City of Boerne and so the really great thing about these and the really exciting things about these are that these all these awards are decided and presented by peers so the Parks and Rec professionals around the state of Texas are the ones that give these awards so when you get one of these it means something very special because you're getting it from your peers and so on behalf of the Texas amateur athletic Federation I'd like to present San Angelo Parks and Recreation with the goad member city award for 2017 2018 [Applause] one more it's a great year for San Angelo so at our annual meeting this year not only was San Angelo selected to host this year's state tournament for flag football but next years I served 16 years as a state commissioner for youth flag football and then as I took over as president I gave up that position John Henry was elected into that position this year so congratulations on that but also he was recognized as the region 10 regional director of the year and not just for region 10 for the whole route for the whole Texas amateur athletics fader Federation so John Henry has done an amazing job I've known him for about 15 years as a coach as a state commissioner I had him as a coach I've worked with him since then in various different teams and committees and I can

[0:12:25] tell you that Sanja Lo has always represented itself extremely well whether it's through competition or at our annual meetings through the work that they do inside our committees so congratulations John Henry [Applause] all right we will now move into public comment items or issues that are not on the agenda may be raised by the public at this time citizens should speak from the podium begin by starting their name and limit remarks to less than three minutes council members may request that a discussed item be placed on a future agenda the council takes public comment on all regular agenda items during the discussion of those items do we have anyone here this morning who would like to make public comment with no public comment with no public comment we will move into the consent agenda we are removing item B from the consent agenda and now I will ask each council member if there's items that they would like to have pull Billy I'm going to start with

[0:14:28] you okay laine nothing besides that already Lucy okay Tom Tommy Perry with that do I have a motion to approve from the consent agenda item a C D E H I J L in and O in there a second any public comment with no public comment we will take a vote on the items all in favor say aye any opposed the consent agenda is approved we will now go in starting with item F consider approving by board contract number five one five dash 16 for the purchase of one streetsweeper from tim co inc waco texas in the amount of 258 thousand six hundred forty six and fifty cents budgeted in fiscal year 2019 an item G consider increasing award of our f b FS 0 7 - 1 8 haul truck to Lone Star truck group of San Angelo Texas in the amount of one hundred and forty thousand five hundred forty-one point one one budgeted in fiscal year 2019 for the purchase of one unit Ryan you're on and Billy do you want to go ahead now some questions yes Thank You mayor good morning Ryan my question is more about process these are two very big ticket items and in reading the black background material I saw some specific detail on the BI board contract for the sweeper where it was showing the original price and then the discounted price and it looked like through by board we got some pretty good discounts

[0:16:32] I have no idea what a street sweeper cost but it looked good on paper those discounts so my question is on item F we went through a buy board contract on item G the RF B we went you know through the request for bid and the price increased why didn't we use buy board for both of those contracts well I would say initially there's definitely a time and place to use purchasing co-ops versus bids and in this case the purchasing co-op was definitely the right way for us to go for the street sweeper now the item G the RF B if we consider that item that's actually an RFP from last year so we're actually able to use last year's prices including an escalation clause that's built into that contract for this year which means again a good deal for the city and so it's all about the perspective of what the item is and how we as the city can best benefit from the options available okay so the contract that we had for the RFP for last year we're using to purchase this young we didn't have to go out for bids again yes man because the term of the contract includes an initial year plus one more year including the possible escalation of price up to a maximum amount okay because the price did go up and that's what's on the consent agenda for the questions from the council on item f/4g Lucy please and how often do we buy one we own traditionally we try to keep six in our fleet as we buy one you know we'll dispose of one and so that may mean a little fluctuation just initially but we try to keep those six in good health and so it depends on their age their life their their usage

[0:18:35] as for when we're replacing them but we watch that very closely and because of the fund we have a little more flexibility than we might somewhere else but we have to watch those street sweepers very closely because of the price they are we don't want to get behind on those and so we make sure that we watch our disposal value as well as the health of the unit and so we we dispose based on that and in this case we bought too last year if you remember right early in the year we bought two street sweepers that replaced two of our oldest and the reason that we bought two and then another one this year is because when we started the stormwater program about eight years ago if I'm not mistaken we bought four right away so that means that we don't want to replace for every so often we want to space that out and so we're trying to do that through this process what's our lifespan did you say well we like to see eight years but it really depends on the equipment the job it's done and and extra things that it has to do and so depending on its application and how the equipment is treated which the stormwater program does extremely well our values are extremely high when we resell them we try to just balance all those things so is a very good number because a lot of folks won't give that long out of their street sweepers I mean I just had one morning this is more for the constituents and I don't know with you do you all have a schedule of harmony I mean how you go around town doing them unfortunately I can't answer okay thank you based off of the growth of the city since 2008 does having six suffice for the city and that's probably not something I could answer what I could answer for you is how much they're utilized based on the data that we're seeing the miles they drive the hours they run and the all the machines are very well utilized but I can't answer and someone else could but I couldn't answer for you if we're sufficiently funded in that fleet realm if we have the quantity when you okay

[0:20:37] you'll have other questions from Council on the item we can do them together is that right yes well I make a motion that we approve item an item G okay second by Lucy any public comment with no public comment we will take a vote all in favor of approving items F and item G please say aye aye with none opposed we will move on to item K consider a resolution approving the Texas Department of Transportation or TxDOT routine airport maintenance program ramp grant for airport maintenance reimbursements up to $50,000 for fiscal year 2019 and authorizing the city manager to negotiate and execute all related documents Mitch good morning Harry do you want to have a question I've got a couple questions I'd like to have a little more further explanation about how these funds benefit the citizens for those people that are watching this is a ramp grant it stands for routine Airport maintenance program grant so this will supplement our operating budget at the airport for routine Airport maintenance items so just routine pairs repairs that I may do out on the air field such as airfield lighting airfield markings I may look into looking to replacing some HVAC units on the terminal building with these funds Texas Department of Transportation will match up to 50% of that up to $50,000 fiscal year so really this is a savings to the taxpayers of San Angelo is it's a sentence of the airport user move to approve this is just see if anybody else has any questions or comments but no other questions or comments Harry has a motion on the floor to approve item K any public comment there it's been several years since

[0:22:43] we've had this grant mitch is our interim director and he initiated this effort so his efforts have generated if if this is completed successfully an extra fifty thousand dollars in maintenance work that the citizens won't have to pay for so thank you Mitch for your work thank you thank you Mitch we appreciate that all right we are going to move on to item M which is consider resolution approving effort oh sorry oh sorry okay all in favor any opposed Thank You Billy motion passes item K will move on to item M consider resolution approving a first amendment to the Santa Fe Municipal Golf Course services agreement that outlines obligations of to pro management to the city and authorizing the city manager to negotiate and execute all related documents Carl he was here Teresa and I may be able to answer these questions okay um you want to start with your first question Harry quite honestly all I all I wanted to do was just that there he comes I know the background information on this but citizens watching may not just a real belief brief explanation of what we're doing here and and how we got to this particular point Carl so this is about Santa Fe Golf Course the two pro mesma approached us back in June and asked that we consider issuing some water credits that are in the agreement that we have with two pro and those water credits are 10,000 a year up to 2,500 per quarter if drought stage is in place and there is less than average rainfall which wasn't the case when they submitted that request their request was based on their the number of rounds they had for use of the golf

[0:24:45] course had gone down during the time of the utility line installation at the golf course in January when it's really cold out no one was really playing outside does that be correct that's what stated so when we got that letter and started doing research we realized they were remiss in pain reimbursements for water at the time and we have changed this at the time the water meters were in our accounts we got the bills and then we sent reimbursements to them to pay us back for the use of their water they had a balance they had they had do to the city so meeting with them and talking with the City Council back last summer we came up with a plan for them to reimburse the city which includes the water credits that are in the agreement it includes withholding the final quarterly stipend to them which is eighteen thousand seven hundred fifty dollars and the balance they they have to pay to the city and like I said what we have done is removed the water counts from the city's accounts they now belong to two probe we don't get those bills they pay them directly so we won't come into the problem again where they owe us money are they current on their bill this this resolution and this amendment will make that happen this will require them to make that happen okay so when did the water meter go into their name this summer maybe July late July okay so that again my question so August September and October we didn't have to worry about them paying the bill because it was in their name that's correct and this this plan under this amendment is is from the past what they owed us under when we held the accounts all right so the other question is when we went into an agreement with

[0:26:47] to pro management and offered the 18 750 per quarter was the intention on that originally to be for a limited time as they started to get that business the golf course up and running the original agreement when he first started out and did have a plan like that where the city paid them the stipend and it back the amount backed off reduced over the years but there were change there was an amendment to that agreement and when we did this current agreement it doesn't have that plan it's basically why no better request doesn't mean approval came to council so that request came from the group in this case to pro and then we brought that request to Council which most of you were not on here at that time so that request came before council and then council chose to approve it do we get a P&L statement from true Pro just the rounds we don't get full accounting of so we don't know whether the money that we authorized the 18 750 is needed to make them profitable what do we know anecdotally I know that they're they're having a hard time making ends meet they're really having the hard and this originally came for a little more history as Harry was asking for it this originally came to council because the Golf Course had lost money historically when we were running it it was not something that would break even so the city was subsidizing it so the city was looking for a way to cut those losses and that's where the agreement came in as you were talking about you know the idea of scaling off they were not able to do that and then they when the contracts came up they sent in new requests which counsel reviewed in looking at those numbers council felt like at that time that they were still

[0:28:50] using less money going with to Pro than they would have if they were if the city was operating in ourselves so they chose to proceed with two pro in the case you know the option in the future remains that the city could look at do we want to be in the golf business at all you know we currently have a contract I think that contract is up in two years there's it less than that now 2020 so coming up in the near future so I would suggest this may be something that council may want to review in the future as that contract comes up do I have further questions for Carl on this contract then Harry you asked to have it pulled would you like to make a motion move that we approve this based on conversation but I agree with what Rick said we really need to be looking at this in a year from now or whatever that timeframe is before it may not be that this particular city needs to be in the golf business on Santa Fe golf course do I have public comment Steve mr. Hampton please come forward Thank You mayor I appreciate and I appreciate the questions that have been asked I think it's curious though that you should pick this particular one because I mean we didn't ask questions on the contract with our the renewal of the lease with on item D of the Hartzell because I mean which is only four hundred and seventy dollars per month and so you want to drive us a hard bill you need to talk only on the item in discussion that would be item in I'm comparing your your your values in contract you can only talk to item in you cannot compare it to another item that item was not pulled and it was already approved it was already approved just now and you you

[0:30:54] that passed right on by and this one is being picked on we certainly had an opportunity during public comment for you to have asked to have that pulled or ask someone of us to do it did not happen so continue to ask your questions in regards to item in yes my question is not a quest I don't have question I have a comment that I'm in favor of this because I think this golf course could be used in a better way down down the road but negotiation with the city seems to be their contract striking deals are not so well thought through and I appreciate the mayor focusing on trying to go to negotiate better than than they have in the past thank you do I have further public comment on item M with no further comment on item M we will take a vote all in favor say aye aye any opposed motion passes 7 0 we will now move into the regular agenda item a first reading the public hearing of an ordinance approving case z18 - 20 a rezoning from the general commercial heavy commercial c g CH zoning district to the single-family residential rs1 zoning district being 2.93 acres located at 3210 Lake Drive and 3201 3207 and 32:11 grape Creek Road John thank you John James director planning and development services this is a rezoning a request as you mentioned you can see the area there on the map I will note that this is the subject area of the request the large lot as you'll see on the upcoming map the city staff has initiated rezoning of those pieces

[0:32:57] most of those Lots are already zoned residential but a portion of them were not so this kind of cleaning up that area as part of this you can see that whole area is future land use of neighborhood although the existing zoning is general commercial heavy commercial you can see here how these residential Lots have just small slivers at the back of the lot that's part of that CGC H so as part of this case we're clean cleaning those areas up as well but the applicant on the larger tract looking at legalizing the existing residential use on the property as well as possibly developing some additional homes on that property and they need this rezoning to move forward with that you can see the area here that there are existing homes in the area there's no commercial area on these tracts or on the adjacent tracks we do recommend approval and here are some of the reasons that again the area is residential they've been used as residential and just happened to have been zoned commercial at some point in the past the rationale for the A+ approval yes is that a hint to us in terms of what you want us to do you knew I would we did send our notifications to the surrounding property owners we did not receive any in favor we received one in opposition however that person just indicated by checking the box opposed they did not provide any commentary on why did we call him and ask him we did not should we that's not our normal practice we we rely on them we send them a notice and provide them an opportunity to provide us comment as well as inviting them to the public hearing but if they choose not to take advantage of those opportunities to let us know we we don't

[0:34:59] I'd like us to start following up on that and calling them if there's just one to call it's not too hard to make one phone call one thing I will say that as we could call we do like to have their comments in writing so that it can't be misconstrued in any form or fashion we can definitely look at that I will say that the only information we typically have on those is the property owner information from the appraisal district which typically does not include phone numbers or email addresses or anything like that do we ask for their telephone number email on the notice that is sent I don't believe so we just we send it through their address and ask if they're in favor or opposed and provide them a space to write any comments that they might have as I mentioned staff does recommend approval of this rezoning to single-family residential and the Planning Commission recommended approval as well unanimously that'll be happy to answer any questions do I have any questions from Council for John Marshall of land residents on there now or is it yes it's a mixed group over there mostly residential the subject properties themselves they're all residential completely council who would like to make any further questions or comments okay then do I have a motion do I have public comment on item a with no public comment on item a we will take a vote all in favor say aye any opposed with none opposed item a passes 7 0 item B is a first reading the public hearing of an ordinance for Z 181 7 a rezoning from the light manufacturing m/l zoning district to the - family Rs - to Sony district being 1.30 8 acres located at 501 East Avenue A and 606 six one two six one six and six one eight rest Street this is a similar case where

[0:37:04] we've got a homeowner that is currently part of lot manufacturing zoning and wants to clean up the property by getting the rezoning to residential use similar to the last case the staff is recommending rezoning some of the other adjacent properties that are also currently residential you can see here that the future land use of this entire area is neighborhood which would mean typically homes and apartments but you can see the lot manufacturing zoning there extends into the neighborhood just in this one block but all of these Lots in red are existing single-family homes so this would clean up that zoning making them single-family as well we left out this one property here it's actually a plumbing business and so we didn't want to affect that property because it's already fits within the lot manufacturing so we did not include that one just some photos of the area you can see here's that dividing line all of the home all of the properties on the left side there are existing single-family homes there's the properties the one vacant property in the middle you can see there there's the plumbing business that we would not affect with this change and then across rust Street there is some existing manufacturing type uses and so again this would not affect those but would just change the single-family homes it is consistent with the future land use as well as the existing uses of the properties we did send out our notifications we did receive one in favor and none in opposition in this case as well as the Planning Commission recommend approval area it's in your district do you have a question or comment actually sit in on the Planning Commission when they discuss this so I'm comfortable with this I moved to approve as presented let me just make sure does

Valenzuela City Council I have for you your update on sales tax performance it's up 1.9 8% for the month of October compared with the same month in the prior year and our total revenue for this fiscal year is over budget by 73 thousand dollars you have the number that we were up in October of last year fourteen point seven seven percent so we're going up against a large number yes I would like to make sure at the next city council meeting that we review the sales tax revenue from for the fiscal year 27 twenty-eight and also by category business annualized you're just going to take a look at the 2017-18 actual you want an annual lies what was a total percent increase for the year okay okay cuz we're through with that year now and then also look at it annualized by area meaning manufacturing versus AG you know the chart that you do for this man because I want I wanted to point out that we do not have industry information yet for this meeting but as soon as we do or see if it will send it in your fracking your short packets for you I'd like that present and Nick and I am I also would like to have a update on the final fiscal year for the city at the next council meeting for sales tax in particular I think for the total budget sales tax revenues operating costs an overview of the total year okay we can do an overview of that and we will not have audited numbers and there will still be many adjustments to be made after that but we can do it yeah a preliminary ask for it so give us what you have what you don't have can't

[0:41:10] present okay bottom line yes ma'am thank you you're welcome thank you with that we will move into the closed session the executive session under provision of government code title five open government ethics subtitle a open government chapter five five one Open Meetings subchapter D exceptions on to requirements that meetings be open under the following sections a section five five 1.07 one to consult with attorney when the governmental bodies six the advice of its attorney on a matter in which the duty of the attorney to the governmental body under the Texas disciplinary rules of professional conduct of the State Bar of Texas clearly conflicts with this chapter regarding the solid waste contract the selection of agent to represent city in the West Texas water partnership item B section five five 1.07 to deliberation regarding real property a governmental body may conduct a closed meeting to deliberate the purchase exchange lease or value of real property if deliberation in an open meeting would have a detrimental effect on the position of the governmental body and negotiations with a third person and items C section five five one point 741 to deliberate the annual evaluation of the city manager I believe will be out for about an hour and a half and at this moment it 9:16 a.m. and we will adjourn to the closed session we were a little light amidst in executive session as it relates to the solid waste contract we have given staff direction Billy on your issue of the West Texas water partnership was that yours I move to approve an interlocal agreement with Midland an Abilene that updates the responsibilities of the parties as they relate to the West Texas water partnership any public comment you Hampton is there
