[0:00:00] good morning everyone happy September 1st uh I am calling this St Angel City council meeting to order and uh we will be we begin with a prayer and pledge and let me make my first of all let let me try this let me welcome our my colleagues Miss grindstaff Miss Gonzalez Miss farmer good morning good morning Mr Valenzuela morning Mr s and and Mr Fleming good morning thank y'all for being here let me make my my way up for those of you don't don't know me I'm Johnny Silas I'm the mayor protim uh our our uh mayor could not be here today and I am taking his place we would like to start with prayer and I ask Bishop Michael sis to please come up and uh lead us in prayer please good morning everybody the prayer that I'm going to be using this morning uh is chosen specifically for this date September 1st because this is a day where Pope Francis has asked people around the world to pray for care of God's creation and this is a prayer that was written around around the year 1225 by St Francis of AI and as I pray this prayer I encourage you to give thanks to God for the beauty of the created world around us let us pray oh most high Almighty good Lord God to you belong praise glory honor and all blessing praised be my Lord God with all creatures and especially our brother the sun which brings us the day and the light fair is he and Shining with a very great Splendor oh Lord he signifies you to us prais be my Lord for our sister the moon and for the Stars which God has

[0:04:15] flag to the Texas one state God one indiv [Applause] thank you all that Texas is always a tough one for the young ones sometimes even for me we do have a proclamation and this one is for uh go go for Childhood cancer awareness day which is September 12th and it'll be received by Robbie F Miss F you come join us yes okay I have a proclamation here I'm going to read for you the Proclamation reads less than 4% of federal dollars for cancer research and treatment are allotted to Pediatric cancers most often private family Foundation fund clinical trials and often means for keeping pediatric cancer patients alive after their son Charlie was diagnosed in 2012 with stage four high-risk neuroblastoma cancer Angela Dina and her family Dena and her family said it was on our heart to do something bigger later that year the denas launched their family Foundation gaining national attention with Texas ADM Quarterback Johnny bzel wor wore Charlie's prayer band during his Heisman Trophy winning season the denas I'm sorry denas D the denas and their foundation will soon be the focus of a PBS documentary titled going gold it will tell the story of how a seed of an idea has grown into a nationwide awareness campaign for childhood cancers through the use of gold ribbons throughout the month of September the dena's goal is to make this effort as PR prent as pink ribbons are for breast cancer each October they recently rebranded go gold fund has a new slogan be brave be bold go gold and a new website at go gold.org Manzel also continues to partner with AAS and to endorse their
[0:06:17] efforts the city of St Angelo recommends the Dena family for their important and Noble efforts to raise awareness and funding to fight this Insidious disease and the suffering that causes among children and their families therefore I Johnny silvus mayor protim of the city of St Angelo Texas on behalf of the city council do do hearby proclaimed Saturday September 12th 2015 as Childhood Cancer Awareness Day thank you so [Applause] much thank you I just want to in on behalf of the Dena family and all those in Houston and here and elsewhere that have worked on getting go gold up and going we truly do thank the St Angelo city council for its uh help in getting this off off the ground and being on the ground floor with us um St Angelo is Angela dena's home and she is thrilled to have you backing her and I also want to thank Elizabeth gr staff for helping get this Pro Proclamation written and um she's my councilwoman and I want to thank all of my friends and family who've come today to support me you've been there with us since day one and we're going to keep on keeping on until this is nationally known thank you thank [Applause] you yes this is your I've got think I've got to sign it maybe words let me sign it right that's a pretty neat little gold ribbon that they will be passing out for us to wear the next we have a recognition uh Amanda vasana I believe that's for
[0:08:21] painting the mural at the animal shelter Amanda are you here there she is how are you welcome let me read your recognition Amanda vasana has spent her days the past three and a half years collecting and running bacterial samples in the laboratory of the city's water qualities division but there's also a budding artist beneath her lab coat that last year Amanda began painting classes and discovered how much she enjoyed creating with a blank canvas and a pallet of paints after her colleagues learned of her Newfound talents they asked her if she would be interested in voluntarily painting something at the city's animal shelter she gladly agreed to do so her resting mural which she designed sketch and then paint painted required more than 6 hours of work in her free time the design is a various of the A variation of the shelter's opt to adopt motto it shows a patient dog and cat Tranquility awaiting their forever home and it rightly includes the capap adoption is a better option while working on the mural Amanda witnessed far too many people surrendering pets to the animal shelter she is hopeful that those who see her mural mural and this message will be moved to adopt and save the lives of unwanted animal rather animals rather than abandoning their pets therefore I Johnny Silva's mayor pro team of the city of St Angelo and on behalf of the city council do hereby recognize and applaud Amanda vasana thank you [Applause] did you can say a few words please okay um well thank you everyone um it was a pleasure painting the mural it did take a little while it was very hot but it was well worth it and I hope that it touches everyone so where
[0:10:24] they would rather adopt than give up their animal thank you thank you [Applause] all right thank you and we have one more recognition of uh it's city of St Angels working on Wellness committee for the for winning the Platinum award for achieving a fit friendly work site from the American Heart Association and I don't know who is going to accept this but I'll read well there's some folks coming up a lot of folks coming up come on up I don't bite I'll go ahead and read the recognition the American Heart Association recognizes employers as fitf friendly work sites for creating a culture of Health in the workplace through Progressive leadership and employee Wellness initiatives the fitf friendly work sites program is a catalyst for pos positive change and we encourage other work sites throughout the nation to be a part of the initiative and make employee health and wellness a priority the city of St Angela was recently recognized as a 2015 Platinum level recipient of the American Heart association's fit friendly work sites program physical activity and employee Wellness are very important priorities at the city of San Angelo and we encourage all of our employees to participate in the many Wellness challenges and and activities as we offer as a part of our while working on wellness program throughout the year therefore I Johnny silvas mayor protim of the city of St Angelo and on behalf of the S St Angelo city council do hereby hereby recognize and applaud the city of St Angelos working on Wellness committee for their service and positive determination to make a difference and who is going to speak good morning uh amongst us today
[0:12:28] as our city Wellness committee we meet on a monthly basis as we implement the wellness program for the city of s Angelo we'd like to commend the city of St Angelo for allowing um for implementing a wellness program amongst its employees in an effort to make employees healthier and we'd like to present this award to Daniel the city manager and um and again for its efforts and and supporting us in implementing a wellness program for the city there were 4600 uh communities and municipalities that applied for this award and only 362 uh communities achieved Platinum level status so we are privileged to have this honor and to allow um Mary and I to implement the wellness program be your Wellness coordinators and to have a wonderful Wellness team to support the efforts thank you [Applause] Wellness is a very important topic for the city of course we want healthy employees uh whenever we have healthy employees we have happier more productive employees but we also have employees don't miss work as often uh it's really important for us to uh keep that wellness program going and it's going rather strong we we know we have a 5k U event coming up here pretty soon which will be advertising we hope to get everybody to participate in that but again thank you all we appreciate you [Applause] there we go
[0:15:18] okay again I want to thank everyone for joining us we are at a public comment portion of the meeting and this is for issues or concerns or items that are not on the on the agenda at all and uh that anybody wishing to speak from the podium by stating their name and limit remarks to less than five minutes council members May request that whatever is spoken about at the podium be placed on a agenda for a for a future place on the agenda for the future the council takes public comment on all regular items during the discussion of those items so anyone wishing to comment about anything not on this agenda please step to the front state your name I've been gone for a while so I will state my name Harry Thomas um I appreciate everybody's prayers and good thoughts as I went through this surgery a little bit ago uh I want to talk a little bit about uh Boys and Girls Club 50 years in St Angelo uh one of our alumni happens to be your mayor Pro Tim another one of those individuals won an award and at ASU uh last week and that's Joe mono those are two the high-profile alumni from the boys club back in the 70s what we want to do is invite everybody to come and help us celebrate on October 22nd at the cactus Hotel uh Texas Roadhouse is going to be serving dinner that night evening uh and a group called Jennifer B and the grooves that won the Blues competition a couple of years ago here will be our entertainment we want you to come and help us celebrate as we reach back in time a little bit and honor some of those other alumni uh that uh we made a positive uh impact on their lives and today are successful citizens uh one of the things we want to talk about real quickly is what our mission is and that is to
[0:17:20] enable all young people especially those that need us most to reach their full potential as productive caring and responsible citizens and we take that every day as we take these young people some from disadvantage circumstances and improve their lives we have a 91% graduation rate for our kids that come at least two days a week every one of our kids last semester in the spring had an or was on the a or AB auto roll if they came at least two days because the first thing we do every every afternoon has put them through an hour of Education helping them with homework playing Gam games that sometimes they don't understand is helping them with education our five core programs are education leadership the Arts Sports Recreation and fitness and abstinence so I want to talk a little bit say just say thanks for the support that you given us in the past and invite you to come out you may contact the the club directly at 655 8343 or you can talk directly to myself or Mr Ed Lopez that is the chief professional officer at the club thank you thank you Harry I'd like to also Echo you know I they do a fantastic job and look at when he said 70s it brought back memories uh you know I was 10 years old when I first attended and and it kept us off the streets and on the straight and narrow and there was a lot of good leadership back there so thank you Harry and Ed Lopez for what you're doing any more public comment of any kind got one coming Mr Rick Council I have some exciting news I want to share with you today which involves an introduction I want to introduce to you uh Mr John James who is our new planning and development services director and so John joined us yesterday I'm probably more thrilled than anyone um he comes to us with great he comes to us from the
[0:19:25] city of abene where he had over 10 years of experience there prior to that he was in in the city of Stan Marcus uh John has a Wellspring of uh of experience and talent that he brings to join with um some wonderful staff that we have working in in that that area so I just want to introduce him to you and um you know you know where to find him if you don't I can give you his phone number and so we're glad to have him join us what took so long Rick John would you care to say a few words just uh just good to be here uh glad to finally be on board and uh look for to working with you all all right good having you welcome if there is no more public comment I will close a public comment portion and open it up to the council and maybe we can do consent agenda items as well as public comment Miss granstaff will'll start with you I don't have anything to remove from the consent agenda but just wanted to let everyone know that my next neighborhood chat will be September 14th that is a Monday evening at 6:00 p.m. will meet at Mr te's and we'll be talking about uh new trash service how it's going and what um what Republic can do to help us and what we can do to make Republic Service um more streamlined in our neighborhoods awesome thank you ma'am Miss Gonzalez nothing nothing Mrs farmer I have nothing to pull from consent agenda just one comment I want to thank the staff and St thank the Republic officials for attending and making one more town hall meeting for me uh recently and I think a lot was settled and accomplished uh with some dissatisfied people and hopefully we can continue to work with citizens thank you thank you ma'am Martin self I I have nothing to pull I I would like to say while I'm going to be voting on the uh consent agenda I'd like for the records to show that I'm going to abstain from item L item l so noted thank you sir Mr fliming nothing to pull from the consent
[0:21:29] agenda but two different comments uh the first comment I would like to State uh about the upcoming election and uh a lot of the phone calls that I've received on the there's a lot of misinformation out there and a lot of misquotes out there and one of the things I want to say is two meetings ago that when this was talked about um it was never brought up to me by the charter Review Committee or anybody before that meeting that that was going to be an automatic appointment when I left the meeting I left and within 30 seconds that that situation changed totally it wasn't by vote it was by concession and I I'm very unhappy about the situation I did not even know that that that situation had happened because I was reviewed by or I I I met with the Review Committee a couple of times and that was never ever talked about about automatically appointing our police chief that he would be just automatically appointed I have issues with that and I'm not sure what I can do about that I I've been told there's not much much I can do about it other than cancel the or try to cancel an election so um I just wanted to put that out there and let everybody know that the second thing I have is a community meeting that's going to take place uh concerning Highway 277 and Grand Canal intersection it's a very bad intersection and the the my residents that live in that part of town we're having a community meeting on Thursday at 6:00 p.m. at uh Southgate Church of Christ and uh the meeting should not take more I wouldn't think more than an hour to discuss what possible fixes we may be able to do at this time thank you thank you sir and I do have I just wanted to mention I do Echo uh what Marty said on the excuse me from roding said on the appointed versus elected sometimes our personal lives come into play uh and and get us out of the role of this volunteer position we sit in so you know that's what happened to me too I think I left minutes after he did or before he did I don't remember so I too Miss James I am very concerned and would
[0:23:33] like to talk about it in the near future maybe uh an executive or wherever but I just wanted to say that also uh and I'm glad I see Shane here I got a CO phone call last a couple of phone calls uh last couple of days on Harris Avenue that it's uh it's needing to be swept real bad is what I've been told and then I got I did receive a phone call last night from a uh from a parent whose child or grandchild goes to Migel I didn't get a chance to call the the school admin Administration bill this morning but there was uh there was a couple of children out there they got sick from their drinking water at McGill Elementary so I just wanted to make that make that public and known and maybe somebody from the school will will hear of it but I just wanted to share that and that's all I have I do want to I do want to make sure I make very clear that there's nothing uh as far as with the city water there's issues at this point that uh we're aware of so I just want to make sure that you made a comment that it's not right no it's not city water she did mention and it was the grandma that mentioned that where they get their cold water it is filtered but I guess it's their water I don't know somewhere around the water fountains that there was she knew of two kids that went home you know just but we do have safe drinking water the have make okay all right I need a motion on the consent agenda motion to approve second except for and we know about Mark we have a motion to approve and I do have a second all in favor of approving I I and against okay that's a 60 vote m is Marty on item L it l yes yes yeah when you never done this before it's it's a little
[0:25:38] different okay moving on to regular agenda items we will start with item a and it's a public hearing and consideration of and of appeal of a decision by the Planning Commission in regard to a request for the expansion of a non-conforming use in a neighborhood commercial or CN zoning District to allow for the construction of a residential storage building accessory to an existing single detached dwelling located at 1217 South Bryant Boulevard occupying 0.307 of Lot 12 and South 30 ft of lot 11 and North 9 ft of lot 13 block 36 of the Park Heights Edition presentation but managing planning manager Rebecca Gara please ma'am good morning Mr Mayor proam city council Rebecca G this item before you is an appeal of a non-conforming use that is case number 1501 in the name of dve it is 307 Acres it is 110 ft north of West Avenue I on literally on South Bryant Boulevard it is in single member district number five and it is in located in the Santa Rita neighborhood so before I move from this slide this project went before the Planning Commission on July 21st so that's a correction that needs to be made on the staff report um it was unanimously denied 7 to Z which is the second correction that needs to be made um and so as a result the applicant Mr Davis has chosen to appeal before the city council and so the zoning ordinance gives any applicant the opportunity to appeal any decision whether it's an approval or denial um from Planning Commission to city council where they can make the ultimate decision so that being said the future land use of this site is Neighborhood Center the zoning is neighborhood commercial however as we get to the non-conforming use there is a single family residence on this site so because the site is zoned as you see before you neighborhood commercial and there's a single family residence on the site any expansion of that residential use is called a non-conforming use expansion and so that requires approval
[0:27:42] from the Planning Commission and then if denied or even approved can be appealed before city council so the applicant has requested to expand that residential use by constructing a um accessory structure or a storage shed in the back of their property and so so here are some pictures of the site and the surrounding site the site is located on the top left corner of the screen before you and also in your staff reports um and the next slide will show you on the left hand side the backyard and this is a picture taken from the alley where the proposed storage shed um is intended to be placed so staff's recommendation is approval of the appeal of ncu 1501 subject to one condition of approval as stated in your staff report the basis of the analysis is that U minimum visual impacts um are expected on surrounding properties because the proposed structure is proposed to be located in the back of the property near the alley so technically it won't be you it won't be viewed um from a principal rideway like Briant Boulevard the proposed expansion is anticipated to blend with the existing house and the future Lane use of commercial as well as the zoning designation should this site ever be developed to its um maximum potential or its maximum development capacity which is neighborhood commercial uh it provides storage for vehicles and equipment for the property owner um for residential use as he stated in his application which may otherwise be left outside or unscreened it maximizes as I said previously the Land Development potential of the site seeing as has a future land use of um neighborhood center and a zoning of neighborhood commercial and finally um the proposed storage the the proposed accessory structure or storage shed um is consistent with development standards and zoning regulations for a residential use which is what the applicant has stated that the proposed storage unit will be used for um and the zoning ordinance says that you can have 600 square fet or 50% of the principal structure whichever one is greater so in
[0:29:47] this case 50% is that amount that will be stated in your um staff report and actually actually as a condition of approval which is about 1300 ft so 18 notifications were mailed out within a 200t radius not just for the Planning Commission even though it wasn't required for city council I went ahead and sent out the same notifications again for this city council so that folks would have an opportunity to respond that original mailing had seven responses in opposition those are located in your staff report I've also this morning handed out six additional letters of objections which were received by the adjacent homeowners or residences um those are all in front of you um and were received as a response to that second mailing that I sent out so as I said previously on on July 20th the Planning Commission voted to deny the application unanimously 70 which is the basis for this appeal before you today so the action requested is to appeal is to approve the appeal of an expansion of a non-conforming use to allow for the construction of a residential storage building accessory to an existing single family dwelling subject to the following one condition of approval and that condition is the proposed residential storage building shall not exceed a maximum of 1776 ft in size on the overall 13373 FT Property no further accessory buildings shall be allowed on the property this concludes staff's presentation we're available for any questions you may have thank you my question to council is is a proponent here would you like to hear from him first sir yes yes we'd like to hear from Mr Davis hello I'm Daniel Davis and I'm the one that's trying to build the basically garage for my vehicles out there behind Bryant um I live there you know I know eventually I know eventually this that the area is going to be commercial up there and so I think it'll fit perfect
[0:31:52] into commercial and especially you know uh neighborhood commercial but I do live there and had several wrecks on the road right in front of my house the last one I had a stop sign land in front of my house and I take my kids out and put them in the car right in front of the house and y'all all know what Brian is I mean it is a major highway and so basically I want to take and put it in the alley where I pull in and pull my vehicles in and I've got boats and everything else and I have them all protected and and basically that's what I'm building this for um you know originally thought that we're going to rent the place out to Construction company and changed it business-wise and he was on to have it as storage you can't do that I mean City City Rules have it as the commercial ordinance so that's next he's already moved on and and bought it something else so that's my property I live there I plan on using it so that's pretty much it I don't know if we had questions or anything else what is this area eleth gr M gr step your area any I have questions but not for him okay I have questions of Staff okay M K Rebecca what was staff's recommendation at the Planning Commission it too was recommendation of approval for the same reasons before you the staff report has not changed other than the inclusion information for city council from what was presented before Planning Commission and why do you think the uh Planning Commission voted the way they did based on the discussions that took place um some of the things that they indicated was that the property appeared to be utilized for commercial purposes um the application that we received um indicated that it was residential use um we asked the applicant on the record if the if the structure was being utilized as a residence and if the proposed structure would be utilized as residential storage given those responses and given what was in the application that was the basis of our recommendation and if I look on the front of uh Abe there or South Bryant it
[0:33:59] looks like the neighboring properties are also commercial in nature yes ma'am all of them have oh all of them have um zoning designations of neighborhood commercial um and as well have future land use designations of Neighborhood Center so as I said this is a this is an anomaly as a single family dwelling um but as an anomaly or as a non-conforming use they have the right to expand subject to approval from either Planning Commission or ultimately city council so so really everything in that block face is some sort of commercial you say neighborhood commercial yes ma'am and then the problem then being everything across the alley is still of a residential nature that is correct ma'am okay thank you I'll just go down Miss Gonzalez do you have any no sir questions Miss farmer well I heard the proponent state that everybody knows this will go and be commercial in that area uh I disagree with the statement I do know that it's currently got a lot of residential um and I know it's zoned and looking at the map which I was trying to find here it's what I call it's a multi area neighborhood commercial you know office space I don't have a problem with but I do have a problem with warehouses and exceeding uh setback line and just looking like a sore thumb as well as the commercial and and heavy traffic that I've seen in the pictures that were proposed so you're going to have to go ways for me to support it okay is that it I'd like to hear from the other council members I'm waiting to see if you were finished yes I I I I would just like to hear the opposite position if there is any I mean I I take it there's somebody here that's going to speak in
[0:36:05] opposition Rodney I'm going to have a hard time voting against this because um he does have the right if I if I own that house and I wanted to put up and I lived in that house and I wanted to put up a storage building and park my boat or whatever I have I think that I should have that right I think he should have that right um he's not he said in front of us he's living in that property right there the majority majority and you can answer this of the properties that are right around that property are commercial in fact I think this might be one of the only ones that's not right there on that one block in the block correct sir on that block cuz so I drove over there and looked at it and so I think he probably is right that in the future it will be commercial at some point I know our future plans as a city is commercial so that that would fall in line and he is correct when he is saying those things so I I I it's hard to believe that that many in opposition and but two of the oppositions on here that I was reading are are two commercial people that are next door to him and they got the right to do it at some point those were all houses at some point over the years and um so I I think it's hard to keep him from doing this especially when he's saying he's not even asking to changes the commercial he's just asking to store his stuff in there personal stuff so I I'd have a real problem if he was parking you know a whole bunch of bulldozers and things like that which would never the zoning would never be correct for that anyways but that that's what I would have a problem with Rebecca is there concern about him using the alley for this the residents have expressed different concerns to me um some of them have been some commercial vehicles parked on the site some have been access Through the Alley to get to the back um the storage of some equipment in the back the applicant has stated on the record that the app that the U vehicle the vehicle God help me it's a backhoe okay I'm terribly sorry it's not my a personal is
[0:38:08] that an item that he uses for is that personal or commercial it could be used as commercial or could be used for personal that's probably a better question for the I probably like that on the record because again if you're if we're seeing a lot of heavy equipment go in and out of the alley and I'm the residents behind I have I have concern none of that is neighbor Hood commercial use you are correct that would be a great question for the applicant to answer but yes some of the concerns have been access off the alley whether that be personal or any other at this point I don't know okay now that excavator is a it's to tear the down the building and to build and to dig out the fooing that's all it's there for um it was there for about a month because we thought Planning Commission and I've heard several things we were approved by the city and we're pretty much good to go and so we we and moved the carport that was back there in an old storage building thinking this is good to go put the C for the horse um but those aren't there I mean the ordinance in y'all City says y'all cannot have heavy equipment in that commercial neighborhood so there's not going to be I it's really not and I don't have a personal tractor at all so the only thing that's only going there is I've got a couple boats a bay boat bass boat and my two vehicles that me and my wife Drive yeah I mean we're not even powering the thing we're not running electricity to it it's just a storage unit all right is that all you have for him Miss Miss farmer yes uh first of all I have three questions and I need Miss guer to Define neighborhood commercial what is allowed in neighborhood commercial what is considered neighborhood commercial and then my next question is exactly what is climate right Construction when I I first read it I'm thinking air conditioning services why does that keep popping up climate right in all of these comments CU it's on his truck but again you know I have stuff written on my truck and I park in my driveway if you
[0:40:10] want to well it's my question and I would like to ask it I would like to know the type of business that that particular truck does and equipment is it you know free on I mean I don't know what your your company does and that's what I'm asking for the definition definition of what kind of business is it so ma'am um I'm going to read to you the definition of neighborhood commercial in the zoning ordinance um then I'll just give you a quick synopsis of what that is um neighbor commercial district is intended to provide opportunities for the development of commercial development that serves and is supposed and is supported by a relatively small surrounding area a neighborhood allowable commercial uses include a wide variety of office activities as well as a more limited range of retail trade and services so again retail trade and services a variety of office activities as well as a more limited range of retail trades and services aim towards meeting the routine needs of residents in the neighborhood commercial development should be low intensity with small floor areas and limited traffic generation and trade area the character of commercial development is compatible with the surrounding residential neighborhood this district is also intended for commercial establishments whose activities and materials and merchandise are housed entirely inside a building except as may be allowed by the general development standards of this zoning ordinance so basically small development focused primarily on retail service or uses compatible with the existing neighborhood and meant to serve the existing nearby neighborhood climate right is not owned by the applicant climate right is owned by a separate entity as I understand it is a Remodeling Company um that is probably a better question for you to ask the applicant as to why the references to that or some of the opponents that have come up um this applicant has requested has indicated on the record that um this is
[0:42:12] a single family residence it is being utilized as a single family residence his application has stated that and he stated that on the record so as far as staff is concerned this is what we base our review on and that and the zoning ordinance is the recommendation that's placed before you I was reading the minutes from the Planning Commission and the proponent uh statement that it was his he was asked if it was his home or was it his office and his reply was it is my home office so the zoning ordinance allows any single family residents to have a home office in it um as long as there are certain stipulations within the zoning ordinance um but as long as the structure the principal structure is not being utilized as the business itself but instead as a home office you take calls you may even get a client um but again it's not meant to be a business it's meant to be as an office based in your home and then reading in your general information I was reading the items around it you know offices residential single family dwellings offices offices residential and there are uh office commercial I can't support the use for it so i' I've not been convinced that we need to I will vote to overturn it that's it I'm sorry I have one more question okay go ahead okay Rebecca I think that this um regardless we're we're looking at an area that is commercial whether it's really neighborhood or not it's it's commercial is there anything that he is there any um development benefit he gets out of developing this in residential in the way of setbacks that might not uh be the same if it if he had made application let's just say for some commercial designation he already has a commercial designation so in this case because he has a commercial designation he wants to expand the residential use by creating that storage building this is the only way for him to do this but he's he's he's legal non-conforming as a resident
[0:44:16] as a residence in a commercial zoning District so he has me all of the same requir the only thing is that his certificate of occupancy for the principal structure is for a house as opposed to anything non-residential okay I just want to make that clear but to answer your question specifically actually commercial has um is more lenient with the setbacks with the heights well I know and that's what I want to make sure that that's not what's offensive to the residents on the back side of the property it's probably a better question to ask no it's for you because it has to do with development requirements of in within the different res has a cap as I stated in the condition of approval there's a 50% cap or 600 ft whichever one is greater on residences commercial doesn't have that restriction commercial doesn't have the set restrictions or even the height restrictions that resal has I'd be happy to make a motion to approve to approve his appeal I believe we have some opposition here yes I was going to ask but I was also going going to give you my humble opinion you in reading through a lot of these letters of opposition this activity of high traffic has been going on for a number of months seems like I mean for for these folks to be opposed to this something's going on out there and you can say that this is your residence that you live there but something caused alarm from the neighborhood around you so I have a concern about moving forward with this because of the if there's going to be a lot of traffic and there's big trucks and they're cutting through that alley and they're creating dust and and just un unstableness out there that that's my concern I'm listening to to the people that are opposed to this so that's I just want to throw that out there do you live there or do you not is the question you know you can say that you office there but do you do you truly live there with family is is what I would be asking but right now I guess we'll just open up to to the public Comon portion unless anybody else say anything else uh that that would be my my concern is Sir for it to be true livable space for for this gentleman so let's open it up to public comment if we if we could before we do
[0:46:20] that I do live there the way when I bought this house about I guess it's 2004 which is going on 11 years ago go it's broke up in two different properties it's one is a commercial Corner basically I guess that guy when I bought it added a a just an office space or two office space that were actually commercial and then had the house but they had it broke up in actually two different properties I do live there my kids go to Santa Rita I paid I mean I'm Homestead and all that and stuff and originally I was going to rent to climate R Construction which is a construction company um he wanted to rent there because you know as I do is Bryant is a very visible Street and everybody in town just goes by Bryant um since we found out and since we go well you know he needs storage and or I need storage and all that we took it and took the city and said well you know I was going to build half and half let him have half because he's written a commercial deal and started digging in what the actual rules and laws were and figured out that that is which I didn't even have a clue what neighborhood commercial was until getting into this but found out what the neighborhood commercial stuff is and you're not allowed to have high stuff but the property the excavator and he's had a a skid steer there basically to tear down the the building and they've been there so we started this almost beginning summer so it has been a couple months and that's why you're probably getting some of these letters on that but the traffic area it's gone after the building's built it really is and it's just going to be you know me and my my kids which we will cause more traffic cuz we'll be going down there um and then maybe weekend traffic to pull a boat out or whatever um but yeah I mean we live there kids go so there's no commercial activities going to be happening out of there other than your office and your personal vehicles in your boat that's all that's it not anym I mean we originally planned yes cuz we're going to switch this to straight commercial and and have it part of that
[0:48:25] office space that's up front and now that what it is is it's not possible so climate R has actually bought some land outside of town and is going to be building out there and it's clim IR construction they do remodeling they do everything but David no nin's a really good friend of mine too okay I'm ready for a public comment anyone wishing to speak for or against this item state your name and you have three to five my name is Steve Yus and um I um own the property next door to this property uh to the north and um I would like to request that you not limit me to 3 minutes my testimony is very important to for the record and I've got answers to every y'all have brought up some excellent excellent points and I have a prepared presentation and uh would like to make that a part of record because I answer everything y'all brought up and y'all have brought up some excellent points um I also speak for the neighbors that couldn't be here today uh over the last 40 years I've probably been involved in more than a hundred zoning cases and I've never seen one like this nor has anyone ever been as difficult to speak about than this one is going to be today and Mr Davis has been a for over 10 years to my office building and I want him to know that what I say here today is not personal uh my presentation is going to be in two parts part one will be my arguments against approving the expansion of non-conforming use based solely on Mr Davis's application and his testimony at Planning Commission and assuming there's no outside circumstances and assuming his intent as as he stated um that's why you've got various
[0:50:29] comments uh part two will be about other factors that lead me to believe that there's an attempt being made to circumvent the zoning process so what is an appropriateness in allowing this expansion based on what Mr Davis wrote in his application and testimony uh again as was stated the zoning along South Bryant is a um CN or uh Co zoning and there's a few Parcels that are still residential the majority of the improvements have a certificate of occupancy for offices single family dwell dwellings and a few retail the properties with the co for office are either modern professional Office Buildings like mine which is right there on the right the subject property is to the left all right so or Mr insurance building that's shown there or they are office buildings that have taken an existing single family home and done all the requirements necessary to improve it and have a certificate of occupancy um uh code which is ADA compliance and parking and wiring um and then west of the property are single family residences Mr Davis has a CEO for a single family dwelling meaning no changes have been made at all to up grade his property to commercial now the city has a handout on nonconformities and the first paragraph States what is a non-conformity and we all kind of know what that is uh doesn't it's kind of grandfathered the second paragraph says can a non-conforming use be expanded a non-conforming use may not be enlarged expanded or extended to occupy a greater area of land floor than was occupied on the effective day of the most recent approve zoning ordinance authorization to do so may be granted with the approval of the Planning
[0:52:32] Commission Now the Planning Commission denied it 7 to zero in order for the Planning Commission or I assume this body also to approve it the zoning code requires five different additional approval criteria that has to be met because you don't want non-conforming uses to expand those are impacts minimized here's what's out of the code book and they're in this handout also so um so this is why the the properties had a non-conforming use um all right so let's let's run through these right quick because uh there's five of them and the city um planner that that uh made his report um used just whatever Mr Davis put on his application to address each one of these so let me kind of just run through real quick the first one is is uh impacts minimized this is a very large storage building for residents and the applicator the application asked for a 30 by 80 building that's huge now the staff cut it down to 1,700 let's say 1800 just for just for rounding purposes that's a 30 by 60 building um and uh you'll see that the that the loading and unloading of construction equipment and I'll get to this construction equipment and climb it right in a minute but getting out of that alley see there's a vehicle being blocked right here I get to see all this because I'm in a upstairs office looking right down on his property and so is my uh secretary um so um first of all impacts minimized um the only way would be from the alley and just across the alley our single family residence along David Street Steve excuse me can I stop you for one
[0:54:35] minute it's been five minutes and I need to what what's the pleasure of the council you want to give him a little bit more time oh I do uh he's uh very familiar the business in the area and we give you five more minutes more than five more minutes though no more than five more minutes okay so there's got to be five approval criteria before expand a non-conforming use it blocks the alley um now so you know we're talking about the impacts minimized I have no confidence at all that Mr Davis is going to build anything that's not going to be a negative visable deal this is what Mr Davis uh submitted in his application that was going to build well there's three of them here I don't know which one he's going to build um this most likely was taken from the internet there are different sizes shown here how tall will it be um you know is it going to be tall enough for this trailer that's been sitting out in front of his house the last few weeks um or large enough for a backo that I'll show up pictures of later Mr Davis States the water the building will have no water sewer gas or electricity he also told me he's going to do some of the work himself to me that translates it's going to be a built as cheaply as it can uh we've had past experience of Mr Davis's um self-d do projects um several years ago he asked Mr insurance and I to go in halves on him building a fence and we did that was the crookedest fence you've ever seen the day he was finished with it and for the last 3 or four years that's what the fences look like and uh he also until just a couple of weeks ago when he got in trouble by the city won't mow between his sidewalk and the curb because he told one my people in my building that's not his property it's the city they mow their property I'm just telling you that he's not concerned with pride of ownership and he's going to build a
[0:56:38] cheap building second criteria has to be met is compatible to surrounding area and he said in his application there's other buildings like that I've driven ever alley in sanorita there is nothing even remotely like this where they get that I don't know there's probably very few personal units in town that are this big um it does not fit in uh don't know where the water's going to go that's another one of the criterias uh and he says there's a community need that's one of the criterias you have to meet that's just not that's just not correct now here's the big one and yall have all kind of touched on this a little bit and that is development patterns the orderly patter pattern of development is a continued development of of light retail and office not a single family residence Mr Davis States in his application that the se's 10-year plan is is is for more more large warehouse and he says a large Warehouse that's what's going to be needed is a good large Warehouse folks the land is Zone CN with mainly Co Op you can't have warehouses in a CO or CN so you know that's why this compatibility with development patterns is there you can have a big storage building in your backyard but in a CO or CN this is going to instantly become a warehouse that's not allowed there so it doesn't meet that criteria at all so um I just you know the Planning Commission looked through all of these and they recommended seven to nothing to deny and I I hope y'all support that now the second part is why I think there's an attempt to uh to circumvent zoning uh over minutes you have two minutes last three or four years Mr Davis has tried to get me to buy his property I always tell him the same I don't know it um so uh he's been selling these little ATVs
[0:58:41] out in front of the yard for up until a couple of months ago and then around the first part of July or the end of June my secretary saw him them moving a bunch of furniture out she said I think the Davis is moving about that same time the yard started getting filled with construction right equipment and Mr Floyd will tell you about an IT company that was parking in his lot that told them they were putting a large it Network in that building for climate Ro construction when I got my notice for this meeting last month in July I went over there and to talk to Mr Davis he wasn't there but David and Allen followed me out to the yard and I asked him what Mr Davis was planning he said it's a storage building from my construction equipment that's in the backyard there's more climate Rock Construction they're there every single day 8 to 5 maybe there's one or two trucks maybe there's six or seven they're there every single day including yesterday um so this is the construction equipment it's been parked in the back for it was moved about 10 days ago but they would bring trailers in and load it up and go away with it and then bring it back now it is gone for the last 10 days or so but the construction Right company is in the in there every single day and Mr Davis says he doesn't they're not he's not renting it to anybody that was his testimony at planning I will tell you that right after the Planning Commission meeting within a couple of days there's no vehicles at that house and also Mr Nan told me in that conversation that that uh Mr Davis and his family had moved to Coleman and he said he's keeping now he's keeping a few things here so he when he comes to town a couple of nights a week there has been no vehicles there except about three weeks ago two nights on the weekend and this past weekend that place is nothing
[1:00:45] there after five or so till 8:30 till climate right okay that's enough thank you sir time's out this should be denied absolutely thank you can can I ask a couple questions just while sure his testimony is fresh um on the the co and the CN can you do storage build this is for Rebecca can you do storage buildings and Co CN depending on the warehousing or the storage so uh the warehousing and Freight movement as unfortunately we all know now at this point um is not a permitted use outright in the CN zoning District however Self Storage um may be permitted with a conditional use approval from the Planning Commission in the CN zoning District okay and then uh Mr eustus was talking about the expansion of but I thought the expansion was on the main dwelling and not the garage are well that's when I first got the notice I thought why is he building on he's trying to sell and he's moved right but there they say that that's an expansion because he can anybody can have a storage building in their backyard for personal use for personal use and even for personal use 1,800 Square ft that's bigger than a lot of the houses across the alley yeah uh and and again it will become a warehouse when he vacants or because it can't be self storage I can't imagine uh well he's still going to have to go through he'd have to go through some kind of zoning change though he'd at least have to bring the prop that's my worry now is he can come back to us now and ask for or he could actually just do the this ask for a certificate of occupancy and change everything in to make it because it's already zoned commercial it's zon but it it'd take a lot of money to convert the house and that's why my suspicion is that there's an attempt to circumvent the zoning process yeah my thought you know just from what Nan told me let's get this built that's this is
[1:02:49] my opinion let's get this built as a not now I'm not accusing now he was very nice and open open and honest in our discussion that he was going to be in that building right but I suspect that that Daniel's thinking let me get this buildt as a personal storage deal and then I'm out of here and climate Rock can buy the property and there's our warehouse back there that's what I feel let's get more public comment yeah Rodney any anyone else state your name please uh good morning I'm Rodney Floyd and I'm with Mr Insurance Agency we're located at 1225 South Bryant directly the South neighbor to Mr Davis um on the morning of July the 9th I returned to my office to find a kbo's office systems vehicle in my parking spot assuming they were in our office working on our equipment but they were not later that afternoon the vehicle was still there and they were not at our office so I called kbos to find out why that vehicle was parked in my parking spot at our office and my contact there told me they were doing a big networking job their it guy was there doing a big networking job next door at 1217 South Bryant for climate right construction well with that knowledge uh when we got the notice from the Planning Commission we were obviously in opposition to that our concern has been the loading and unloading of the construction equipment that block our alley we didn't want clutter of construction equipment laying around uh and we were also concerned that there's not enough parking there for the construction uh employees um although the construction equipment is no longer there the climate R vehicles have been there on a daily basis and they've parked in our parking lot and they've driven across the curb that separates the two properties and to drive through our parking lot there's that um also my understanding is the Planning Commission just has to tell you
[1:04:52] what's on the application that's why they're recommending approval it was obviously over it was unanimous denial by the commission so I don't really understand all of that um but here's here's what's happening climate R construction's been there on a daily basis this picture was taken Friday morning this past Friday morning so things really didn't change after the Planning Commission denied um I I took this picture there's actually three trucks there you can only see kind of two of them but there's one in the middle um the the next photo this happened Friday afternoon Fridays are real busy there I think these construction workers come there to turn in their time sheets or get their paychecks or something this truck right here with a trailer hooked up is a climate right construction truck parked in our parking lot where our employees park and if you look back over in the corner next to our sign there's a white pickup backed in with a wheelbarrow in the back of it also a climate right construction employee so this property is not being used solely for a residence with a home office it's just not the evidence also indicates current and future intended use of this property is for a construction company operation I appreciate your consideration very much thank you thank you any more public comment uhoh morning good morning council members I'm Sam Allen Mr eust has asked me to appear here today just have one point to make on this item that is to remind you that this isn't appeal and so the the council can affect this vote only if the action of the Planning Commission is not supported by a substantial evidence or if that action is contrary to the uh vision statement in the zoning ordinance so this is not a decision in and of itself it's a determination of whether uh the decision uh was unfounded so
[1:06:56] you're you're reviewing the decision of the Planning Commission just want to put that in perspective before you vote thank you Sam I'm going to remove my second I'm not you should have let me go first ladies first I was doing it go ahead mayor any more public comment I am going to close public comment and uh I'm going to ask for a vote for this well no I'd like to withdraw my motion you like you withdraw your motion and he beat me by withdrawing his second well then I can I make some comments yes ma'am by all means um I think when we make planning decisions they should always be made without um regard to personality um personal relationships Etc but hearing all of this I have no faith that this project is meant to be for personal use in a otherwise for the use of a residential home um this is a district that I'm very concerned about um I'm fine with the uh essentially the expansion of an office use here but uh understanding how this property has been used over the last several months I have no faith that it that that heavy equipment won't continue there and that is not appropriate in a neighborhood commercial area so I'm happy to withdraw my motion and I'm not sure how how much of this information staff had when they made their recommendation but at least for me I I don't think it's um it's uh the use intended by the ownership is that which is allowed by the current zoning standards okay you R re there's no motion on the table motion motion to deny second we have a motion to deny in a second all in favor of that motion please State say I I I anyone against okay Brian 7 60 60 we are going to take a short 10 to 12
[1:09:00] minute break how's that short break we'll be right back convene item next item on the list is Item B on the regular agenda discussion of continuing river river improvements including dredging Bank stabilization and park Renovations seek council's Direction regarding this ma these matters I had mentioned this a number of months ago about moving forward to maybe the next phase Carl and Carl white will be presenting to us uh what he found out thank you Carl yes sir there's been a good interest in continuing the river improvements we've heard uh several comments during the CIP process uh I've heard interest from the public uh we ourselves are interested in continuing the project we always have plans to continue to continue the improvements and have developed uh schematics for such um with the money that we had and the grant monies that we got we concentrated on the the core area of downtown along the river so in this presentation we'd like to show what we have done with uh the past monies and what is still ongoing what is yet to be done uh primarily look at the stretch from First Street uh North to Kirby Park and then focus our attention on the stretch along the River from Oak Street East to Bell Street we'll look at the uh conditions now uh the proposed work the possibility unique possibility to add an Old West Town to that stretch look at Cost estimations uh funding possibilities and then what we would like to get at the end of this presentation is some direction from Council how you would like us to proceed do you want us to continue uh pursuing this project and and uh figure out how we might be able to fund it I would like to mention uh if you recall back in the February work session that Council had we talked about different priorities uh specifically priorities that weren't
[1:11:02] related to water and um Street improvements and you prioritized those for us and River improvements showed up at number five and restroom facilities which are tied into this proposed project were listed as number four the stretch that we did improvements to basically from First Street below the library at Central High School going down east to Oak Street Park improvements were also done in the stretch from Oak Street to Concho Avenue but that stretch was not stabilized the bank was not stabilized and we own property on this side of the river just an example of some of the bank stabilization that we did this is before and this is after you see the the amount of land that was sloughing off into the river and now those banks are now stabilized on our property uh finished slopes we've added lots of cool art along that stretch we renovated the uh pedestrian bridge on the east side of the Bryants I'm sorry the West Side some nice stacked stone in the main core area below the visitor center in Kids Kingdom more art outdoor fitness equipment by Kids Kingdom uh unique lighted columns LED lighted columns and a crossing at Irving Street along the the trail interesting carved panels in those light columns we created the BOS the games Court area and we're continuing to develop that with uh the concession building that's now being built as well as the PB course that's going to be added here in a few started to be added in a few months there's the bosi added new lights along the trail we renovated The Fountains and got those going again at added shade structures LED lighting underneath the bridges more art interpretive areas below the the Oak
[1:13:06] Street where the old Crossing was from the fort to downtown we added new Trail sections primarily the one on the south side of the river from the Girl Scout building from Visitor Center to Irving Street we added some landscaping and still have more to do going back a little bit farther to the first part of this project we completed the Poo connection if you recall this used to be um before then just kichi it was a dirt road that connected below the art museum so we added the landscape areas working with the ucra the filtration fountains I mean ponds and finished that area out very nicely we also early on purchased property we purchased the old Edgewater site on the south side of the river uh between chadburn and Street we also purchased property between 9th Street 19th Street and 29th Street so now we do have all uh property between 19th and 29th Street so that we can connect a trail through that section except for one little sliver what one small area at the end we lack well most of it I thought we have it okay bosi looking at the bosy this concession building is getting built right now we'll have the food truck area and then the pet Golf Course here just right quick talk about the section above First Street here's First Street there's the uh the loop Houston Hart this section is one section to be considered for improvements as you can tell there in this section there's not too many large areas where the there's pools of water some sections are more like a stream especially the section between 18th and 29th Street uh as you may recall we dredged the river primarily from this location below 14th Street all the way down to Su for draw so that section wouldn't need to be dredged and the banks are fairly well stabilized from 14th Street down to C
[1:15:12] Dam here is the location where we could eventually add a trail from Kirby Park all the way down for and we don't have a trail until we get to 14th Street so there's a good opportunity to create a trail from 14th Street to 29th Street much of that um section has been designed for improvements but this section here has only been designed conceptually but the section we'd like to focus on are next are improvements from Concho Avenue All the Way East to Bell Street that section has already been uh designed we don't have construction documents for it but but it has been designed for all the improvements now the the design does not continue down to lwood bridge it continues East to Bell Street so some examples of what we'd like to do here this is uh Concho Avenue right before you cross the river leaving downtown we we need to improve the crossing here and actually our plan is to bring that Crossing underneath the bridge to connect to City Park and then a cross over to Rio Concho Gardens across the river we have serious erosion problems this is across from um the the Clarion we have opportunities to add nicer restroom facilities this is at city park more erosion we've actually closed off sections of the trail along the river because of the erosion examples of erosion an opportunity to create another Crossing underneath the bridge this is at uh real conso drive before you cross the River heading towards the sports complex sheet erosion uh destroying the parking area and the the Parklands uh below the road opportunities to add lights and irrigation to bring this Park section back to life so what do we propose to do in that
[1:17:15] section we propos to dredge the river basically from uh below Johnson Dam to to Bell Street stabilize the banks along our prop of course we can't do the private property add lighting and electrical add restrooms at least one set of restrooms in that stretch think consider the opportunity to add an Old West Town which I'll show you here in a second uh improve some of the trail work and maybe add some trail sections add standard Park amenities irrigation landscaping and some more art the Old West Town uh you may have heard something about this this is kind of what we're thinking about and it's been proposed by the koncho Cadre company they're a local reenactors group that performs at uh Christmas for koncho and other events they're really um very fun and entertaining they uh do exist as an organization and they're trying to find a place where they can do these reenactments on a regular basis perhaps as events uh drawing in TS to downtown and we think it's a really good uh idea to consider this is the location that we're thinking about adding it this is east of Oak Street below the egar property here's the egar property the rivers behind us here throughout these large pecan trees this is looking back to the west of that proposed site here's a a conceptual layout of what that might look like you have building fronts as you saw in the earlier picture maybe one building that could be either a restroom or concession building but also look like maybe a bank or some other old west building another building that um would be more open that could be like a saloon where you could have reenactments maybe gunfights other things like that with the Oldtown and perhaps even a opportunity to connect to the the art the um old agricultural Museum where at the egam site as far as a cost these are our cost
[1:19:20] estimates dring about 3 million if you recall we spent 1 and a half million at the last time we did dredging uh from 14th Street down to self- withdrawal Bank stabilization about 5.5 million and then you can see down the line uh restrooms qu million the Old West Town about 600,000 and then a total of about $12 million how could this be funded uh we haven't figured out a funding plan for it yet but it could include Half sales tax Hotel occupancy tax primarily Hotel occupancy tax um for an improvements that would draw tourists uh perhaps water funds because we are we would be improving the war water storage uh capacity below Johnson dab in terms of the capacity and the quality of the water that section grants are definitely a possibility we got $2 million in Grants at the last time we did River improvements and then um Council cons could consider a bond so those this is the presentation we're interested in moving forward with the riv River improvements farther Downstream and we seek your direction if you're interested as well you know Carl I ask for this to be presented to us you know it's been a while back but that's this is good information I've seen what uh even the Kids Kingdom area did that was kind of like a seed to the whole thing and and I've seen the foot traffic that that's created down there it's beautiful to see people walking up and down and having parties out there and uh one thing you might want to work on is the the idea on the pinata thing okay but anyway but I've but I've seen all that and I think that uh folks are are very much interested in expanding and moving forward even to the east uh not only because it's in my district but it's this benefits all of us all of St Angelo and I think it's just a feather in our hat when we see folks that are happy and out there walking and it's a health issue uh you know Health activity that they do out there so it's it's a plus for all of us you know it's just a it's St Angelo would be a diamond and rough
[1:21:23] again for a lot of folks that come visit the visitor center people have commented many times on the beautiful building the area down there so you know thank you for bringing it Forward uh all it takes is money now so I guess in in my humble opinion we look move forward to finding ways of putting all this together making it happen so I'll know 10 years ago Johnny when we worked together on the River Project the Bosque and the visions that we had with Carl and Rick is to capitalize on what the good Lord provided us here in St Angelo and that's the Concho River and the bank system and I'm excited as long as we can find the funds without using general fund dollars to move the next 10 years to continue to let's try tie the Bell Street with the downtown along the river and then I had the opportunity this week to drive uh the area along the River from Central High School all the way to Kirby Park got out and walked some and it is absolutely beautiful it is beautiful as to what we have here in St Angelo that we don't take the time to get out and enjoy it so I'm in favor of moving forward further discussions any comments from I I think like you said the river is probably one if not our single greatest asset here in the community uh with regard to public space and the health benefits and just the ability for a community to gather and not spend any money in a beautiful environment but right now with what we have ahead of us regarding water rates and water infrastructure and Street infrastructure I can't imagine right now putting anything in front of those two projects until we have a solid plan in place we have something next on the agenda which I feel is um kind of an unexpected uh expense um but I'd rather
[1:23:30] get one thing finished before I start on another and so right now I would I would kind of like to see this placed um not in the Forefront but let us get some work done before we start talking about more public dollars for these kinds of activities and and I'll say I totally agree with Miss gr but this aside from everything else we understand the streets are in horrible condition it doesn't mean we're going to you know forget about streets and concentrate on this but I think this at least needs to be looked at and and and and played with as far as bonds or grants I mean continue continue the process doesn't mean we have to shut the idea down I totally I totally agree with what she's saying about everything else is top priority but if if there's a way to to find the funding to to proceed to to move forward later on that's fine I you know I'm okay with that but I think we'll probably have our other plans in place within the next six months I would hope I think we were going to have commitments and when you're going after public or private dollars you're going to have to match them with public so I would prefer that we at least wait 6 months before we talk about it again in the sense of getting some other priorities taken care of whether that be also the expenditure of hot tax have sent sales tax Etc which the other projects ahead of this are going to require then we'll know what we have remaining and what how aggressive we can potentially be with this sure miss farmer no Rodney I was just pointing to Rodney I totally agree with Liz on this we need to take care of the stuff that we've got on the books right now and we don't even know what the total costs on all these projects are so if we get through this next six months we we may be able to come back and talk about this I have a feeling we're not going to be talking about this for a for some time I love the plan I think it's a great plan but I also think that we need to be doing a lot of other projects before we
[1:25:33] ever get to this one of the things I would like to ask you Carl is you know you had mentioned a concession on there where are we on the concession that's down there right now at the bosi the concession building is getting built right now okay so I'd like to see even those things being built and finished and be in and see how the public takes to them because one of the things I I I have somewhat a problem with right now is that we've spent between what 10 and 12 million down there now on the river total it's more than that if you count everything well with everything we spent a lot of money down there and and I love it it looks great I love walking it we don't I don't see near enough people using it and so for the everyday person I I really want them I I want this our next big projects we have I want them to be very utilized projects and I I I could see uh the Bell Street Fields the softball fields and things like that getting more money than this just for the simple fact that they're going to bring in so many more people on the weekends for these tournaments and things like that H and get those hot dollars that truly that does fall under Hot Dollars to me than this would even so I I think that we need to wait on these projects and and and see how the things that we've got going you know when that concession is done I hope that that brings a whole lot more people down there like I remember when nef's Park was down there and going down there and and riding the rides and doing those things I hope that that becomes like that again I think we're going to see it pick up a lot once the concessions built the Pet's done the Twisted Roots open yes and I I really think that it will I I think that it will do that and I think that that's when you'll really start and if you do that and we get a lot more people down there then you're going to get the the public money will be a lot easier to find once you get people going down there and taking their grandkids and kids and everything I think it'll it'll work out much better Miss farmer one thing I have learned in city government in 10 years is you don't Channel and do just one
[1:27:39] thing at a time and granted uh the anchors on each end are exactly right completion of projects is is very important and the priorities are very very important and we we don't lose sight of those and we don't justop working on those but in order to grow you know it's kind of like planting that seed and getting the planning and all of the ifs ends and the committee works and stuff that need to be done that's what I want to move forward on to get a lot of that done now and out of the way to move toward this while we are in the process of redoing our streets and researching for water that works going on this is a different department a different bucket of money different funds hopefully but that's what I'm in favor of is moving toward that goal and we just don't sit and wait until that last nail is finished before we put up another board on another house so to speak that that's just the way it is it's the pre-planning I think that's what you're saying is is you're wanting us to plan toward this future it's not a commitment at this moment to save money you're going to come back with the where the money's possibly could come for from and how the stages that it would take is that correct that's correct okay if you're interested in doing so yes I'm not trying to be non- futuristic it's just right now we have a lot of things that we haven't written the check for M and I think we need to write the checks before we start looking at the same funding sources for the same projects He has a good he has a good concept and I think if there's private dollars that are interested in that he knows where to get them but the Lion Share is going to be probably public dollars for these projects uh particularly the stabilization so I I'm more interested in seeing what we have what the ongoing maintenance is going to be just like the the things that we've built before we start committing but as for planning um
[1:29:44] you need to you need to have the projects honed in um but I I don't want to talk I have no interest in talking dollars for these until we get other things behind us and I don't think we're really talking dollars now just the just the concept of what could be there in the near future so I'm not committed to talking funds now if you want to go reach out to the private sector for something like this or bonds or grants then so be it I mean just at least we planed uh now and around everything El was happening to us so that that was that that's my interest is just saying at least you brought us a a visual so now let's uh move forward for for uh for later on we've heard the statements at this point so I think we have pretty good direction uh and that's true we do have so as far as competing projects and projects that have been prioritized by the council we definitely know that we're moving forward with funding on those but again these are important projects and uh good direction given and we'll move forward then thank you Carl thank you moving on to the next item is to update and possible action on matters related to the City Auditorium renovation and expansion number one discussion and consider allocating $2.5 million toward the City Auditorium renovation Expansion Project and number two discussion regarding the terms of existing agreement between the uh city of St Angelo and saac for the operation of the auditorium Johnny Yes I need I need to abstain from from see okay from C and D from C and D okay Marty self will abstain from C and D so presentation by construction manager David nap I'm gonna help with this and David is going to assist me as well um today we're bringing an item to you I think most of you are aware of we've been working on the City Auditorium and of course the associated Performing Arts Center and so
[1:31:48] you've got in your packet as well as this presentation we'll kind of go through it uh quickly and and let y'all ask questions and and then there are individuals here from the supporting organizations if you want to hear from them but in short here's a slide just showing our campus you'll see on the rear of City Hall where it's La labeled City Auditorium that's the the small area that we call the annex which is proposed to be added on to the rear of the auditorium which actually takes us to basically phase two of what was envisioned uh when this project started of course we only envisioned with our half cent sales hex dollars of just sort of fixing the inside of the building putting a Band-Aid on it fixing the lights the electrical since then we uh had a group zpac that formed and saw a much grander Vision uh than what we had initially so that project grew uh which includes now the addition of an Annex onto the rear of the building uh which actually the great part about that it really expands our opportunities as far as what we can do with the building and what we can bring in going to the the next slide you'll see just that just sort of highlights the plan it shows you that Annex area in the rear uh which has a basement and the ground level and then the following slide is just a a cut through graphic of the building so you see uh the exist the interior the city hall the interior and then the far back is where you have the add-on behind the the stage area these are some graphics just that show that new portion of the building just to give you some visuals and then uh we go into our topic today which is of course the funding that we've discussed uh just to lead off a little bit of history at their meeting uh last week uh co-c uh recommended uh allocating 1.5 million to uh the annex portion of the project so you'll be hearing that their recommendation will come to council to give you a little
[1:33:51] history this is sort of the whole scope of the project this project actually started back during City Hall renovation because there were some things done in City during the city hall project which needed to be done uh that would assist in in in the auditorium project those were mainly air conditioning uh pipes sewer pipes things that needed to be routed through the building so if we did it then it saved us money now so you'll see their uh work completed during the city hall project of 1.8 uh we have design fees and Engineering that we have done along the way we've done the asbest testing and security uh the seating item that you see there for for half a million is the actual seats that are will be in the auditorium some of these things we are paying for outside of the contract because it would save us money uh you'll also see uh we've put in in this particular the city part a contingency of 300,000 in addition to that Lee Lewis who is our construction manager has a $200,000 contingency built into their uh their Pro so that gives a total of a half a million contingency uh you'll see the base bid there from Lee Lewis and then you see uh the alternates for 379 what they did was take out all of the things that we might want to Value engineer so they gave us the base bid and then uh we would add those back in if we want them and then the proposed complete finish out of the rear the annex uh an additional 500,000 which gives you a total Construction project of 15.2 million the next slide what I want to do is sort of make that separation we had work that we've already done during the city hall project so if you take the 15 million and you deduct the 1.8 that we previously worked it leaves us our current project is um for construction is 13.3 million so that's what the project is that we're working on today in addition to that there are associated cost uh that go with with the operation
[1:35:54] of the building those are things like the orchestra lift the orchestra sh shell the tables and chairs and an operating fund for sapac which is something that the city talked about in our agreement with them so those items equate to an additional 954 th000 so if you put all that together that gives you a total project scope today of 14 almost 14.3 million so then we talk about our funding sources in regard to the current funding we have uh 1.87 six remaining in sales tax funds we have 304,000 in our risk funds those were allocated uh for the replacement of the roof on the auditorium uh we have naming rights and saac contribution which total 5 million uh additionally uh today we're seeking Council authorization of $2.5 million kosad DC has recommended 1.5 million toward the project which would leave in a remaining 3.1 approximately for saac uh to be able to come up with and raise in order to reach our 14291 million goal now with that said when we when we came up with all those figures know that we put everything back in we did didn't assume that any uh deductions were going to be made we we priced it as if all of those alternates were in place so if there's some value engineering to be done then the amount needed to be raised by saac would reduce uh we also didn't put any stipulations on how they can raise those dollars it can be through private donations it can be through uh grants it can be through uh historic tax credits whatever that is um to get the the project done So today we're going to talk about uh
[1:37:57] the the funding sources the two that have been uh mentioned and brought up and Tina is here somewhere to there she is to talk about these two are uh from the solid waste fund and from the hotel occupancy fund I'll let Tina come up and speak to those uh good morning Council Mr Valenzuela um so you'll recall about a year ago we received a world payment um through our new landfill contract the amount was $3.6 Million we've kind of thrown it around a little bit and talked about ways in which we could use that amount to kind of give back to our community um one of the recommendations or the suggestions made by the mayor um initially was to use part of that money to help out the water fund and so our proposal before you today includes that amount and then as well an amount for this Auditorium project um that would leave just over $500,000 that would fall to the water to the landfill funds fund balance to help cushion that for future projects uh the current uh loss in the water fund for the current year is just over $1.8 million and then you uh take out the $1 and A4 million and that that's what leaves your remaining royalty of about $500,000 okay and then we also did a scrub of the hot occup the hotel occupancy tax monies um and we feel that there's a $2 million approximately that that could be used for this project as well as any other projects that might require that kind of funding and that's after all uh all current obligations and also leaving a 90-day uh Reserve in the fund balance for that fund any questions are you committing the 1.9 to this no no sir that's just the amount that's available currently for hot money so what they proposing or what has been proposed is to take that um 2.5 million uh committing
[1:40:02] 1.25 1,250,000 from hot and the same from the uh Solid Waste those two areas and I think the key is that uh Tina is telling us that that capacity does exist in those funds to make those contributions absolutely yes that's what I'm saying all right there's your summary page that I didn't oh that's okay any questions on any of those let me just say I'm all for this project I believe that in the end uh we're all going to benefit from it but again kind of like comments that were made earlier what do we tell the public when they're seeing the condition of the streets and the the infrastructure you know I again you've got to you've got to balance it out so we've got to let the public know that is this more important than than than the other so you know what do you tell them what do you how do you sell that we're still planning uh regardless we're still planning moving forward with the streets and of course the water study as well so that's something that's already in the works regardless uh this is an additional project that uh again we've taken a look at I think Council uh you've taken a look at as well and do see it a project that's that can be completed with a little bit more funding uh again as far as the streets those are areas that we already committed uh to and it will be funding regardless so that's already that's already going to be in play and I just just so the public understands how long has this project been in effect the the auditorium actually closed down when we moved out of City Hall when we were doing the renovation so I guess it's been closed about going on six years now and so um you know that planning started back then it's it's the exciting part is that it's grown beyond what anyone originally envisioned I mean it as as far as the scope of the project and what it can bring to the table it's way above and beyond but six years at least so now if the funding gets put in place how long will it take to complete it yeah once the this goes into effect
[1:42:06] of course sapac will still have to raise additional dollars for us to be able to execute the contract I will say this there's there's some of those things you know about a million dollars worth of things that are are things that are being done outside the contract so you don't have to actually have those dollars in hand for a a cont contract to be executed um once a contract is executed which we have to bring that back to council because the the project will be done through the city so we would come back to you and say okay the the money is in place to be able to uh award this contract and then the construction time is anticipated at 13 months yeah 13 months 13 months after that point how long did you say they would honor this we and in this case you know we're bringing this to you today because the as of uh Friday we received the the final numbers um from Lee Lewis at this point now they're continuing to try and get some additional bids uh but the clock started ticking then so we have the bids are guaranteed for 60 days um so we're moving rapidly um of course sapac is thrilled with with the council being considering the uh allocation it greatly helps um their fundraising as well when you see that the city is behind the project and it means that much to them um the community tends to get behind that as well and and support it I still don't understand though if it's a if their bid so to speak is a guaranteed maximum price and they'll hold it for 60 days you will potentially have some answer from us today but where does that leave saac in in their own fundraising efforts let's say if we if we move forward with this leaves them with the I think I had it on a private prior slide but basically an estimated $3.1 million that um they have to raise in order to meet that obligation and you have the slide there
[1:44:11] m so on the funding sources you see we have the prior remaining halfs and sales tax the risk money the naming rights and saac prior do contribution of 5 million and then you see the additional sources that are proposed which is the city of St Angelo Costa DC and that leaves with without taking any value engineering or anything it leaves them with 3.1 approximately to come up with but how do you contract for this amount with Lee Lewis without having 3.1 in hand because the dollar amount actually that would need to be in hand in hand would be whatever let's say they value engineered out whatever $250,000 so you deduct that amount down um and then I went over this this prior slide that shows uh this almost a million dollars are things that are being purchased outside of Lee Le's contract and so those things the money could be could come in later after the fact of when you awarded the contract but you have to have the money in hand as you stated to award the contract and the key uh Miss gr staff is we will have to answer that with certainty in the contract when he brings that back for Council approval so while there's speculation about maybe cost can come down and maybe they'll raise a piece of the money up front that will have to be certain uh when he brings the contract back we're The Entity that's going to contract with Lee Lewis and you basically won't have that money in hand well we will have to have it in hand before I can come the only money that I can't have good I just want to make sure the people in the back of the room hear that yeah the only money I can't have in hand is something that is outside of Lee Lewis's contract I have to have everything else in the coffers right because you showed 31 and then you showed about a million in furniture and fixture right so there's and at that point council could decide you know they may have the whole three million in place if they're still lacking some on that then Council has the but they have
[1:46:13] enough to award the contract then you could decide at that point if you were going to give them flexibility in the time frame to remain raise those dollars outside of the contract well since it's been six years and I think that there's you know a lot as you say the project scope has grown and most of that has been driven by sapac um I think they're a wonderful partner and I don't have any doubt that they can do what they say they're going to do um it but I think it's time to get this thing finished I don't think any of us intended whether we were staff or counsel that we or the public that we would be six years down the road and still not having that that Auditorium operational so you know Johnny I don't have any trouble talking to the public about why this with the other things because this again is an asset that is sitting um and it's not finished out and it's it's a and I totally agree yeah I mean it's a problem and so I think this one is much more defensible than than uh starting a next phase of something that right now is not as pressing I consider this to be a very pressing issue and we all know that every school child in our region goes in and out of this building on a regular basis not to mention what's going to happen with sapac and all the wonderful performances and presentations that it will bring so uh I'm happy to consider it but I have a few questions I don't know when when that's appropriate but can I ask you about the royalty money because I'm not familiar with ex royalty the royalty of uh from Republic uh is there there any restriction on how that money can be used or how it was intended during the negotiations of that contract no there is no restriction and from my understanding there was no stipulation as to how it should be used Shane might be able to better answer that question as far as the contract language um but we're fully confident that this is available for use I I'm not sure why we ever took
[1:48:16] money associated with a trash contract that we put then toward uses that have nothing to do with refuse or the landfill um but on this one I'm I might just be okay with it is that is that your final question I want to hear the answer from Shane since he was so comfortable stuck to the back wall where where you like to be the uh no that there are no restrictions on those on those funds it was uh part of an U just upfront monies too um as part of the negotiated contract it just to it was just you given to that one to help clean up uh the negative fund balance and some of the other issues that we had uh within the within that fund so um it it's cleaned it up we're in good shape in the fund now and so those those funds are available for council's discretion so thank you Miss farmer since I was uh had the privilege of being on both committees I uh I understand Miss gr staff's concern and I do recall as somebody correct me I stand corrected that those funds were given for the benefit of the city citizens of St Angelo for no restrictions as Shane said I I had the pleasure of sitting next to the mayor at our meeting with saac uh discussing this and it was the mayor's suggestion to surprisingly to use these funds and if we could I fainted and they picked me but if we could possibly it was his uh request that if we could solicit private donations to assist in these funds then we could restore that royalty balance uh we're still using it for the citizens of St Angelo but that was the goal to try and do but I'm for the project I I believe that uh Rick and his guys can successfully work and get the auditorium
[1:50:22] open and saac can get on with the business of Performing the Arts that are so plentiful here in s angel on our surrounding community and so I support the idea along and I'm speaking for the mayor is he supports the idea let's hear from Rodney uh this this is for Shane and I know the answer to this but so you can tell the general public this was one of the questions I asked was when we got that money um we're anticipating a closure of the the site and moving across the street to the next site probably within the next 10 to 15 years depending on how everything falls out uh a lot of that money is was intended to start a new site and the cleanup of the old site that clean up with the old side a lot of people don't realize it's you're you will be taking care of that for always and it costs a lot my question to you is do we have enough money in that that fund to take care of both of those items with without using this money we will let we we actually have uh we have I uh we have several years before the end of of the ex life of the existing site and currently we have we have cleaned up our negative fund balance that we that we were struggling with we have uh We've also uh through the negotiations uh with Republic and everything uh they are going to be responsible for closure and post closure care costs now that's what we have we set up the trust fund so so that that end up is covered now as we move forward and we're looking into uh permitting the new site that's that's where the funds are really going to become important as we move forward um and we we're we're currently projecting that we will have the funds uh when we get down the road uh whether that's depending on volumes but whether that's 12 or 20 years from now that those funds will be available in that account at that time to permit the new the new landfill site okay you understand what I'm I'm saying though I don't want to pull this money out of that fund and then us 15 years from now
[1:52:25] or 20 years from now or five or five years from or five I don't think it'll be five but I would also mention that uh through that um through a republic taking responsibility for the post-closure care costs uh it did free up a liability that we had in the landfill account of 3.3 about $3.3 million that will also be available in their fund balance as a result of that asset being on the books well don't say that out loud because they're just going to spend it on some some River stuff or something okay I think what's important is this money is not the same money that's set aside for the closure and post closure cost there there that money is actually physically located in a separate in a in a trust that that Republic is now funding and y'all already told me that but I wanted the public to know that we're not pulling money out of some fund that was that initially was going to be used for something else and now we're using it for the Arts and the the only other thing is uh one of the phrases you used was cleanup that might lead some to believe that there's something to be cleaned up those monies are actually for closure and post closure monitoring there's actually not a not a an issue to be cleaned up I wouldn't want anybody to draw the conclusion let's move on any other comment from Council any comment Johnny if I could there was there were a couple of things that I people had asked me questions one is that we will continue to work with Lee Lewis to explore ways to reduce the cost of of the project so we'll continue to work with them they've been great in that aspect one thing that was brought up was concerning in this particular project um use of the the Davis bacon wage rate and you know was that something we had to do and could that be a way to help with cost um as I understand and Julie is here to speak to it if NE necessary that that is just uh required by the Texas mun the Texas local government code so we have to either use um the city's own conducts its own survey or we have to use Davis
[1:54:28] bacon for Tom Green County but I wanted to clarify that we did look into it they're here to answer those questions if you have any further of it anyone have any questions on Davis bacon if not I'm going to open up a public comment for this item so we have any public comment of any kind please step forward having none I'm going to ask for a vote for this item any um do you need a motion a motion for this item I'll make a motion to move forward with the renovation or Rehabilitation of the auditorium I'll second that as y all consider that let me skip this slide right quick and go to this is a a recommendation concerning u a concession that you may want to put on it um we talked about with Council about this item having contingency that it is upon the ra that contingent upon sapac raising the additional funds of approximately 3.1 million necessary um to allow the city of St Angelo to execute a contract with Lee Lewis Construction and for funding uh of required FFN uh to complete the project in accordance with the existing mutual agreement between the city of St Angelo and saac so that may be something you want to M gr would you care to ratify your motion absolutely to read just that what he said yes and we hope that we have the opportunity that there'll be more funds necessary uh than are needed for the project what has been discussed is if that happens then we would agree that those are returned pred to the entities in which they came from we have a motion actually there's a resolution in the packet that addresses all the issues that and the dollar amount is the estimated dollar amount in resolution may be wrong so what do you need some do do we need to specifically say 2.5 million I think at this point we have more it would be approval of the
[1:56:31] resolution Okay appr resolution modifying the amount 3.1 exactly yes we have a motion second second Rodney okay all in favor of is approving this item as presented uh signifi by saying I I I any against nay no Nays Brian 605 f 50 I'm sorry Marty obain Marty obain 5 with Marty obain Johnny I have one other item on this just for some guidance as we look at getting the funding for this project the remainder uh one of the areas we'll look at is historic tax credits um those rules are still be being written but our current agreement with saac is a 20-year lease with three 10year options to renew which is a total of 50 years but in trying to meet the requirements of those tax credits we we think we need that initial upfront uh lease to be longer so I'm proposing that I I come back to you with a change in that contract making it a 30-year lease with two 10-year options it's still the same length of time it just meets the requirements so if I don't hear any concern with that from yall then staff will bring that back to you in the near future bring that back would be fine with me that's it thank you all right thank you moving on item d consider approval and ratification of the city of s Angelo development corporation's approval of an allocation up to 1.5 million of kosad DC Economic Development unreserved Fund balance account for the construction of a new annex phase two of the City Auditorium and authorizing the director of economic de development to negotiate a proposed contract with the S Angela Performing Arts Coalition or saac for kosa DC board approval in subject to approval of the city council contingent on saac raising the additional funds of approximately 2.2 to 2.5 million necessary to purchase the required Furniture fixtures and equipment and allow the city of San
[1:58:33] Angelo to execute a contract with Lee Lewis Construction for the construction of the project in accordance with the existing mutual agreement between the city of San Angelo and seek Mr Roland Pena director Economic Development good morning Council that caption was just as complex as the project I can tell you that M um what we have before you is um a ratification of a decision that the uh the Costa DC made um last week with regard to St Angelo Performing Arts Coalition request as you heard um from Rick this is to construct a new City Auditorium twostory Annex with approximately 17,7 128 ft behind the City Auditorium it'll help to enhance uh a venue by adding the dressing rooms and loading docks to accommodate traveling shows and all the amenities that that are necessary estimated project costs are $4 million and um with your approval this will allow uh sapac to seek additional funds as you heard from from Rick uh this is only one component uh costc could only look at this as just one piece of U of the project the other components are have to do with the rehabilitation of the City Auditorium and obviously the um the remodeling of the former Coca-Cola building uh into the Performing Arts Center the um seac Vision uh is to create this Performing Arts campus uh in which the auditorium becomes the Hub the center of this uh Performing Arts campus that includes the music and dance and theater and the Performing Arts these are the specific stakeholders who are involved the S Angelo Civic ballet Angelo Civic Theater the S Angelo Symphony cultural art Affairs Council and obviously the S Angel Performing Arts
[2:00:34] Coalition you've seen the maps well there is the uh Performing Arts Center with just a relatively short distance to the City Auditorium and then obviously you saw the uh the potential Annex you've already seen these photos in terms of the the basement and the ground floor and then with regard to uh the question of the um the ballot and what allows us to or the city of city of St Angelo Development Corporation to pursue this project here's the ballot language the use of sales and use tax proceeds for the continued Economic Development projects authorized under section 4B of the ACT included but not limited to it's that portion the development promotion creation retention and expansion of business enterprises that create or retain primary jobs including suitable infrastructure up to 28% of gross sales and used Tax specifically the local government code which regulates 4B corporations chapter 505 sub chapter D authorized projects the Development Corporation has to determine a project located in section 50515 52 projects related to recreational or Community facilities and this is what the wording is under that sub chapter for purposes of this chapter project includes land buildings equipment facilities and improvements found by the board of directors to be required or suitable for use for professional and amateur sports including children's sports athletic entertainment tourist convention and public park purposes and events including stadiums ballparks auditoriums those underlined are the justification and it continues ampa theaters concert Halls parks and park facilities open space improvements museums exhibition facilities and related store restaurant concession and automobile parking facilities related
[2:02:37] area transportation facilities and related roads streets and water and sewer facilities and other related improvements that enhance any of the items described by this section that's the other piece so last week Costa DC approved uh with a the vote of 60 that was unanimous to bring it forth to city council for their their ratification uh by caption uh this is the action that is requested I uh put it on the slide I don't know if you could read it and see it uh I would be happy to answer any any questions that you may have with regard to cost DC's approval move to approve is presented second we have a motion to approve in a second second any comments questions from anyone on Council any public comment on this item well if not all in favor of this item as presented uh please signify by saying I I I any anyone against okay we have a six to zero vote five you're still that's right five to zero vote and uh thank you Mr Pena thank you item e second public hearing and consider adoption of an ordinance of the city of s Angelo approving and adopting the budget for the fiscal year beginning October 1st 2015 and ending September 30th 2016 authorizing employee compensation schedules providing for the general appropriation of funds reserving unto the city council the authority to transfer Appropriations budgeted ratifying transfers Appropriations occurring in the 2014 2015 fiscal year and amending that budget ordinance accordingly providing for laps of all unencumber or unobligated funds for the prior fiscal year and for carryover of all appropriations of incumbered obligated or restricted funds reserving
[2:04:41] unto the city council the power only is permitted by law to amend or make changes in the budget for municipal purposes providing Authority for the city manager or his designate to make certain adjustments from time to time in or between budgeted allocations authorizing the city manager or his designate to apply for certain grants and execute any related documents and providing for filing of the budget the budget will raise more total property taxes than last year's budget by $2,865 and4 or 99.07% and of of that amount 653,000 is tax revenue to be raised from new property added to the tax Ro this year Miss Morgan ched Wigan you're on thank you we have uh the conclusion bringing our budget ordinance before you of course this is second reading um and public hearing for the budget ordinance no changes in the financials of course uh just an opportunity for additional public hearing and uh to reaffirm that the tax rate is being maintained at the 776 per with the new amount added for debt service and uh the addition to exhibit D related to the Staffing levels to clearly specify the uh Staffing amounts for police Civil Service fire civil service and civilians and also in addition to that Lisa Marley is available to speak about U options for parameters for administering pay raises Council second hearing any questions comments on this item move to approve is presented we have a motion to approve I I have a question question before we vote I do too for Lisa Lisa Marley okay I know we had kind of set out how we we thought or kind of guidance on on how we were going to distribute the pay raises yes sir can you tell us how what you came up with
[2:06:44] yes sir I actually have a presentation okay for perfect thank you all right good morning um back at the workshop back in February there were five key priorities that were developed by the city council and salaries came in as number three um at present we represent uh our salaries represent about 88% of the salary information these are the 13 cities that we compare ourselves to um this is a very busy slide and I apologize to Anthony um but this is the the actual definitions for the three levels of evaluations we had a little bit of discussion about that when I was up here last time where we have um three categories below expectations meets expectations and exceed expectations the below expectations um are not entitled to any sort of a pay increase last year I've got the figures on there in red as to how many we had throughout the city so there were three below uh expectations two of those people are no longer with us and one person did improve and wound up uh moving on through the system we had 555 meet expectations and 257 exceed um then this is just some history on the meet and confer because we also went into this discussion last time back in 2007 the police department agreed to move forward with meet and confer um and at that time the fire department chose not to do so uh part of the meet and confer process required uh when during the negotiations the police department did give up some key um functions that they
[2:08:47] had had previously number one of course was being able to go to ARB arbitration on any sort of disciplinary action or termination and then this past year we did require them to um participate in a mandatory fitness program uh contrary to that the the fire department still has arbitration and they also do not have a mandatory fitness program that they must participate in um this year just to remind everybody police is entitled to the 6.26% increase based on the contract that we signed with them city council has approved the 1.5 million that was in the uh presentation that Morgan presented to you uh I've got three options today that will um use those funds to to satisfy the requirements for pay increases option one is to go with an across the board increase of 5 a half% um this would go to all employees with the exception of the police civil service the five and a half percent across the board then allows us to raise all of our pay ranges by five and a half percent thereby um moving closer and closer to the council's goal of getting our scales where we want them to be the downside to that is that they would not be connected to evaluation scores we would continue to do performance evaluations and those would have the same consequences as in the past but the salaries would not be um moved in accordance with the evaluations option two is to go with 55% for the fire department all of their Civil Service employees and then we would connect the pay raises to evaluations and we came up with 6.26 for exceeds expectations and 5% for meets Expectations by doing it that way we would be able to move our ranges at 5% um this does give us back the um ability to attach pay increases is two
[2:10:51] evaluations and the performance of the employee the you'll notice that the exceeds expectations does match up with the police meet and confer numbers as well it does a little bit less towards your priority by only raising the ranges 5% and the third option is to go with the 6.26 for our fire Civil Service employees which um links that to the F uh the police department meet and confer rate by doing that there's significantly less money available for the rest of the general employees and so exceeds expectations would be at 5.75 meets expectations at 4.75 and that would be um a 4.75% increase to all of our pay ranges so this is in my opinion the worst option only because it only raises the ranges forign uh 75% across the board can you go back to option one so this is the one as you say that does the most toward keeping within the council's priorities class but someone within the pay range that's correct what would that put us up to what 85 87 it's impossible to know right now I mean we're at 88% um we've surveyed cities and a lot of them it looks like it's going to be an average of 3% um for all the the cities in the comparable region so if you take 3% off of the 5 A2 we'd be you know perhaps 2 and a half% is the the room that we'd make up we'd get over 90 possibly uh possibly we could get to 90 right 88 89 So Def the difference between excuse me one and two what okay
[2:12:53] 6.2 Rodney and I mean I I do have one more slide that my option would be the option one obviously um I think that once you know if we can continue with the council's priority and goal of moving our ranges let's get to where we can get um and then once we've establish our salary ranges where we want them go back to connecting them to Performance evaluations that's actually a conversation that I had with leis after meeting with council member Gonzalez she actually thought of that she had mentioned that why don't we get to what the goal was the priority was to get us to that 95 percentile over the 3 to four year period once we get there we can start talking about Let's do let's do it in performance type situation that was recommended by Council on last time what bothers me about that is in 2008 with the former council member John Mark H and I sit on the committee to get these salaries up uh to at least 90 95% of the national average that's a moving Target it really is a moving Target so by doing this you're saying well once the ranges ranges get to satisfactory level in future years that's the one thing that bothers me is because it's such a moving Target it's it's hard we've been trying since 2008 yeah to raise these and we can't get there every year we'd have to look at it and see where we stand and are we satisfied with that level that's why you have to shoot for 100% just to stay within 88 or 90% actually absolutely I mean last year when we did 5% um you know we didn't gain that much ground against the survey cities with inflation yes yes absolutely how on on option one Lisa so you're meeting the requirement of this of the meet and confer agreement right on option one yes
[2:14:59] yes and then um since you call out fire I'm just going to ask where would you say and I know it's it's it's a guess where does fire fit in um in sort of the wage structure amongst other communities that we compare ourselves too well now that we've changed their structure of this if you remember last year we changed them to just one step per per position um and they they are falling right in line with 87 86 to 87% but they're low they're lower than what our overall employees I think they're one or two% down see I have a problem with this whole thing is that right off the bat I think that the the firemen should be getting paid the very same should get the same raise as the police officers and I would do away with the meet meets or exceeds deal in order to do that part of it in order to to keep the the numbers up there for everybody else but again like I stated in the past those two departments our policemen and our firemen are are crucial parts of our city government I'm not saying that they're well they they do mean more to me than a lot of the other departments and we need everybody but those two departments are are trained we put a lot of money we put more money into training those two departments than any other department we have so I would not be in favor of any of these options I I would prefer to have the the firemen get the very same race that the police officers got and I think that was kind of their understanding that's why they didn't go to to meet and confer because they they felt like they would get at least really close to what the police officers got and and by going with the 5 and a half they're getting within 76% of what um PD would be getting and I mean to me you know the fire department was really specific and they felt that the city would do right by them right by not going with meet and confer but on the
[2:17:02] other side PD gave up many many things in order to get that and it's it's you know well there the things they gave up I mean the the physical fitness thing you know that's huge cuz they f it well no you didn't see how it first started out and I was on that I was up there when that first started out it was huge when it first started and at the end you know I can pass that test so to me that's not a that's not a big deal I could go out and do it right now can I pass it you could pass that test I could I could barely pass it but I think I could pass it right now but I mean arbitration was the biggie back in 2008 I mean that is a big option that they gave up um I beg you pardon Sav yeah it saves us a lot of money absolutely yeah no and I agree with that I I wish the police office officers would go to that also and I think we would try to yeah police did fire hasn't and we spend money on arbitrations do you have a figure for that 6.26 for the fire department and what that would mean for the the rest for the remainder do you have that percentage by any chance let me see if Morgan has her plan go with her and I may be the only one up here that's saying that so I don't know well I I I mean I think it's a I think it's a difficult discussion because we want our police to be paid um according to what the prevailing pay is out there but I want the same for everyone else I want it for fire and I want it for the guy in the hole that's working in the middle of the night to fix a water leak or the person cleaning up a park I mean I think in the end we know that everybody's is important the good thing is the police conversation kind of keeps pushing us to keep to keep the wages Uh current and I and that's why I that's the way I see it anyway Morgan has the answer you also have a lot of though these two professions you have more cities posting Billboards in our coaching they're poaching absolutely of course they are because their pay is so much higher than our pay for these two professions who we
[2:19:06] in invest tens of thousands in in to each one of them every you know when they first start and then we lose them because we can't afford to pay them so I I I could see giving both of these professions more money money than the rest I would be fine with on this option three cuz I was the one that was brought up the meats are exceeds I'd be fine taking away the meats are ex seeds get the fire the same as the police department and just everybody gets that same raise right there in the middle so instead of a 5.75 and a 4.75 it would be somewhere talking about option three why is option three showing just well that's the that's the fire that's the fireman getting paid you want a hybrid you're yes I want a I would like to have a hybrid of it yes so we're looking at 6.26 for fire and then the remainder would be the percentage for the remainder of the staff then instead of uh taking out the exceeds and U meets get the same so do you have a percentage for that Morgan so we developed option three to speak to that option to speak to that issue the fire Civil Service of the 1, 561,000 budgeted for General fundraises the fire civil service at that rate would cost about $625,000 the remaining $900,000 could be divided up to um civilian staff and we would have if it's not going to be more for exceeds than meets then we could derive what that what that percentage is going to be it wouldn't be an exact meat in the middle because of the the weighted average of how many folks exceed and how many folks meet so we could develop that I think it would be about 5.25 or less 5.15 5.12 I think is where we in about 5.1 is we could do 5.1% for for civilians if we gave 6 point with no pay for performance no additional consideration for exceeds expectations um and still give the 6.26 to fire so everyone else falls behind that would be doing the still more than the majority of because they were going to get 4.75
[2:21:09] so the majority of them are still getting closer right if if we went with option three it's more than option three but you just increase the cost by what you've said for Okay police and fire get the same pay the same increase what have you done to the civilians the civilians then would get um 5.1% regardless of their performance and the r the ranges would go up 5.1% 2third of them would be getting closer I mean so the Bol majority would be getting closer to that average or increasing our average it is it is simply a question of what is your priority and and that's the beauty of these three options are there's one that uh addresses movement of ranges as the primary focus uh which is was designed I think to uh do the most to fulfill council's objective the goal item and then there were two other options depending on what your priority was if you wanted fire to be the same as police there's an option there and and if you wanted uh uh something where fire was not tied to police there's an option there so three good options uh if you create a hybrid we can probably make that work it really though is just a question of what is your priority for well it sounds like option three does all the above does it not well the hybrid do the Hybrid part of option three though I I think go let's call it option four it's called option yeah option four Lisa you were recommending option one is that correct so why and the reason's go right it gives more to the ranges so that we can recruit and retain and Rodney you like option four now no yes I like option four the best because again the firemen took themselves out of this position because they felt like they
[2:23:11] were going to get close to or the same as the police officers would get and um we just invest we just invest so much more money in those two professions I'm not taking away anything from them I agree with you all employees are important and very valuable to the operation of the city uh each person brings their own specialty however the police and the fire run into the problem put their lives at risk and I agree that there shouldn't be a difference in their pay I agree I I would move are we going to accept motions on this or this is a second reading yes I need a direction you need direction I have to yeah I have to have okay did we do we understand okay let's say let's leave option one up there all right and there be the 6 point what is it 6.26 6.26 for let's just say for the sake of conversation 6.26 for police and fire okay and then we how do we keep 5.5 you can't you can't there's not enough money be 5.1 though and and you know as an employee that I've been these hourly employees it's been a long time ago but a 5% raise to me I would be sitting there going I'd be very happy with the 5% rise but not if cost of living is three so it's better than nothing well it is but but and I'm again I'm not trying to I'm No I don't think there's anyone here that would question my Comm to police or fire but in the end our our objective was to keep all employees within within the pay scales of the job that they're doing and every time we make a decision like this we're to me we're we're sliding back on that and I I don't know how to resolve it other than to put more money towards it no but you're not we're the
[2:25:15] our regular employees are at close to 88 were last year this is a sliding scale m but last year they were 88 and the firemen were at 87 so it's 1% difference you're talking about a 1% difference in pay raise right there so you're you're sliding them all up at the same rate well if right here it's not you're 5.1 5 you can't use that it's 5.1 time out let's get Mar Marty has been wanting to well can she answer what I can she answer my question what is the question I'm sorry I mean what is the amount what would that amount be for does everybody get to the same percentage no theoretically no so theoretically tell me again where police and fire are as compared to pick another police and fire were to go to 91.2% in this upcoming year but we had to put a cap on it based on our contractual agreement so I don't know yet exactly what that's going to be but it's somewhere around 90% um fire has been sitting between 86 and 87% and then on average the rest of our generals are sitting at 88% however I can say on those those General employees at 88% it's an average we've got some outliers on both ends um so there are you know I mean I'm sure we have positions that are still on the 70 percentile and then we've got some that are way at the high end of the 90th percentile but on average for all of our generals it's at 88% and and what are we doing about those that are sitting at 70 because with this they get the 5.5 but it doesn't necessarily change it changes their range by 5 and a half% but it doesn't necessarily bring them into that's correct that's correct they're just fed into the complete average and we figure out where they are Marty well I I think they're all important and and uh I I I agree with with with Rodney from
[2:27:19] the standpoint of of of fire you know I would like to see fire with with the police but uh and and and my brother's a fireman not here I want to make sure I say that so that on the record but uh I just I just agree more with option one myself I I really do I I I think we have to move um equally across the board but it still it will option one will leave the fireman 1% back at least so if you're if you're we're as a council we're saying we're trying to hit this moving Target and getting everybody up that's why I'm I'm fighting for this so much is to get them more in line you have to give them a little bit more and they're and the investment is just there we have just there so that's that's why I'm really I'm passionate about this that they're 1% behind right now on average on average not for everybody but on average they're 1% B behind we would give them a one that would help get them closer to being where everybody else is Citywide that's all I'm going to say I'm not going to it sounds like sounds like I'm losing the deals we have the funding to do that if if we went that that route yes to a line n PD and then at the expense and 5.1 for yeah instead of 5.5 it's 5.1 any more thoughts any she needs Direction so you're going to have to say which plan you're wanting to go with we got to see what the majority is as you consider your motion I think we want to wrap this direction into the motion to approve right yes I'm not ready to vote on a budget I have other questions okay but uh while you're thinking about it I
[2:29:21] wanted you to be thinking about somebody how you might make your motion why don't we characterize what Rodney is proposing astion option four and then option one so if you were to move to approve with direction to staff to use option one or with direction to staff to use option four for pay raises yes so uh or two or three yes right well I think we're is the concess I mean most of I think it's one or four one or four I think Mr gr Ste you have questions so you don't want us to move on the vote for this or you said you had other questions she got budget questions budget questions well I'm I'll just jump out here I'm going to agree with Rodney that we need an option four I'm I'm for option Stand Fast on the firemen okay remind me what is option four the firemen would get the very same raise as the police officers every body would get 5.1 5.1 across the board there's not going to be a meats or exceeds that just everybody gets a 5.1 that that's what option four would be let her she's the beauty of Technology 5.1 is is put is on there that that's what's critical because we don't have this specific computation in front of it'd be approximately 5.1 yeah what if it's 4.9 that is but just by that's a concession of some sort because you're taking two-thirds of the twoth thirds of the city employees would not be getting a 5% raise on either one of these plans if we if we did them the meets or exceeds part well but I'm looking at leas as option or option one which doesn't speak to that at all all that's okay right everybody gets the
[2:31:23] same but then you have the firemen that are still behind fire can we answer other budget questions while you're contemplating pay raise philosophy uh just generally speaking from the budget I've keep being asked about the mental health dollars and the crisis intervention dollars that the county has U requested and do on an annual basis have we communicated anything to them or seen anything on that I think what we've got in the budget now is an amount consistent with what was budgeted last year did we determine that the county asked for increased money or the Sheriff's Office ask for increase money are you asking a council person I I I haven't received clarification on whether that was a proposal from staff over there or whether it was an official proposal from the Commissioner's Court I don't know I wouldn't have that information I'm waiting for you to tell me I don't think it was Commissioner's Court I think it was staff over there CIU okay because I think that I would imagine it was staff to staff because then they were trying to the Commissioner's Court was than trying to you know ratify a budget as well I think they're it's a parallel system so sorry just had to have that well that was what I suspected but I haven't had confirmation one way or another wasn't it 25,000 that be I 29,000 and change uh requested increase from the $140,000 budget so it's an incre yeah increase but I will say that adopting this budget today is not the end of those discussions necessarily there is opportunity to amend the budget as prescribed in the the budget ordinance
[2:33:25] and so I believe that there may be some lingering items like that that we need to continue to research and and address um once we have all the facts not necessarily because of some artificial deadline mandated by the state okay so where are we any more budget questions or is that it what's a consensus I stated mine I don't think you mayor how are you feeling you know what I like Rodney's option four I think it gets the two vital organizations out there that really put their lives on the line I'm not saying anything that about everybody else cuz I think everybody else is part of the bigger picture but again this is an increase that they don't have you know so 5.1 I'd be happy I'd be a happy camper for a 5.1 yeah cost of living raise is there but still it's it's a raise it's a you know I also go with option four for the fact that I would like to see the fire department get the same raise as the police department and continue to work with the other people that you know next year again to try to get them a little bit higher I need a motion for anything i' prob I just hope next year gets here yeah yeah option five would be that everybody got the same 6.26 oh I'd love to be able to do that we don't we don't have the money well if she we don't have it I don't know that we don't have it we seem to be able to produce dollars for all sorts of other things that we want to do I mean to me this would be a priority this has been a priority and I'm not sure why we short changed it no offense to the person standing at the microphone who I happen to be looking at at the moment sure and I would recommend that you know the op operational Revenue that we've proposed in the fiscal year 16 budget fund operational items moving forward and
[2:35:27] since payroll is an ongoing investment that we'll have this 6.26% plus whatever raise is offered in future years we would need a sustainable Revenue Source that's going to fund that and so it wouldn't be prudent to capture a one-time funding source to address it once for this year because that just sets us back in Future years so but we keep saying that we say that and you're right but that's why we don't fix this problem we keep picking and choosing one group and we don't address the rest of the of the organization we are moving forward I'm looking for a motion I move to approve the budget as presented with option four under the salary second I have a motion in a second any public comment before we vote on this any anyone in the audience no one I'm going to ask for a vote for for option four as presented uh all in favor of option four please signify by saying I it's the budget also and the budget and the budget I I anyone against 60 option four with the budget I didn't really vote I couldn't hear I Wasing it's affirmative I know did we get half a vote from thank you Council Liz will give you half and I'll give you half we'll make it a five no I know we can't do that we're voting in the affirmative for the record okay item f are we at F is that right first public hearing and and consider introducing an ordinance levying property taxes for the city of San Angelo for the 2015 tax year an ordinance fixing and L leving ad VOR taxes for the current tax year for the use in support of the municipal government of the city of San Angelo Texas for the 2015 2016 budget year providing for the assessment and collection thereof providing when the tax shall become due providing with the
[2:37:29] tax shall become delinquent providing for exemptions providing for severe ability providing for publication on the city operated website and provided for an effective date Morgan you're still on okay so we have the introduction of the property tax ordinance again we are proposing the tax rate remain the same at 776 cents per $100 valuation and of course as discussed earlier in budget about the additional contribution to Debt Service for future Capital project streets or police station or any others the increase to the principal and the principal and debt amount has been increased to 9.86 cents with the remaining of 67.7 4 cents available for operations uh this proposed tax rate is less than the calculated effective rate and the calculated roll back rate um that is mandated by the state so no problems there in addition uh this ordinance before you maintains all current exemptions so no change or removal of any of the exemptions homestead exemption over 65 exemption any of those items so those items are remain to stay the same and the tax rate is remained to stay proposed to stay the same move to approve is presented second I have one question go ahead I heard that is the state proposing a deal where we're going to get more uh credit for the homestead exemption next year is that what I'm hearing there is proposed legislation on the November ballot related to changing the amount of Homestead for school district uh tax levy um there is so it is primarily impacting School District Statewide and the proposed legislation going in November would be retroactive to this budget cycle this tax year um however there is a small portion in there that speaks to municipalities and counties it simply says that whatever exemptions you have if passed whatever exemptions you have in place your homestead exemption Etc um are to remain the same so it

[2:41:35] from ex executive session so item G uh consider approval and ratification of the city of St Angels development corporation's approval of a resolution authorizing the use of sales and used Tax funds in the in an amount not to exceed $583,500 for ratification uh this was approved by Co CC board with a 6 and0 vote last week uh for the purposes of the um educating the public this has to do with incentives for one energy Renewables of Texas they intend to invest $18 million for a solar electric generating plant they do intend to have a temporary construction of employees of 20 to 25 employees in one full-time position they have request incentives of an 8-year tax rebate Grant uh this will be in the amount of 583 814 uh over the course of of an 8-year period they do have a lease option agreement with the city of St Angelo for 143 Acres located north of St Angelo and I'll show you a map here shortly uh the the lease does include a 26e term and an option of a 10e additional years this is the um location proposed location of the industrial park this is the industrial park that we currently have and then this outer line is the city limits just to give you a point of reference action requested is as the the
