[0:00:00] will everyone please sit down we are calling the meeting to order at 8 33 a.m on the 12th of january 2021 happy new year everyone and as we should we should start the new year off in this city council meeting with a chaplain prayer and we have marcella jenkins here to do that and i think gary is going to lead us in our pledges today so if everyone would rise bow your head as i pray dear god in the scriptures you have said the citizens ought to obey the governing authorities since you have established those very authorities to promote peace and order and justice therefore if i pray for our mayor brenda gunner for the various levels of city officials and in particular for this assembled council i'm asking that you will gracefully grant them wisdom to govern among the conflicting interests and issues of our times a sense of welfare and true needs of our people a personal peace in their lives and joy and their tasks i pray for our police department as well as around this country that you will grant them wisdom to make wise decisions as they serve and protect our communities i also ask you to protect them from all hurt harm dangers seen and unseen i pray lord that you protect san angelo and the entire world from the spread of kovac 19 as we turn and seek your face i pray for the agenda set before our council today please give an assurance of what will please you and what will benefit those who live and work in and around our beloved city of san angelo this i pray in jesus name amen amen will you join with me as we make the

[0:04:07] is any public comment or anyone here to offer public comment today yes please come forward good morning jennifer poppe smd5 i was here at the last two council meetings regarding the outdoor lighting issue ordinance change and also the about the driving range lights in our residential neighborhoods in the red arroyo area and i just wanted to give this handout to council or maybe even my councilman it's from the international dark sky association and this particular handout is on led practical guide for for lighting of led lights and since we are starting to see more led lighting pop up in the city um this website um and the international dark sky association is a really good source of information um about how to cut light pollution and light trespass down in municipalities and i just wanted to give the handout to somebody theresa who can she give the handout to or yeah julia all right that's all thank you very much thank you is it further public comment today with none i would just like to offer just a few comments and that i want to continue to message to everyone out there that certainly covet is still with us we've had a large week of new positive cases last week but unfortunately we also had a large number of deaths last week and i want to encourage everyone to first of all go get tested you don't have to have symptoms to get tested we have a free testing site and you may get tested with no symptoms i encourage you to do that if you have a family member that does have symptoms i am asking that

[0:08:13] t-e-r-a-p grant from the texas department of housing and community affairs tdhca in the amount of 197 912 and 21 cents to extend parental assistance for households experiencing income loss due to covet 19 related issues bob thank you for being here yes ma'am good morning good morning bob um i'm sure you felt like this agenda item might get pulled um we've been hearing the news brian gross did a good job of sharing you know through the media what was going on with this but was this a grant that we had to apply for or was it just given to us this is a very unique it actually was offered to us since we have a program already in place with the the first round of cares act funding this is the second round and he went to the states and usually we're not authorized to compete for that funding for the state because we are an entitlement city this is unique uh they were approved by hud to offer it to us cities like us and we accepted we were going after it so yeah so when you say cities like us could you entitlement cities uh this is the same pot of money cdbg funds that we have uh we already have second round cdbg cv funds already this is an addition to that so with our with our funds that we got directly from the feds we're going to create some other programs so we're going to use this to continue the rental assistance do you have any idea bob of the numbers how many people because we got some money i think is like 388 000 before for rental and utilities and things like that do we still have we used all of that money and then um how many people from our families were we able to assist with that uh well we're we're we spent about half of that on money already so uh i don't know exact numbers in my head i should have brought that with me but i

[0:10:14] don't have that with me um so we spent about actually more than half of funding we've already spent so uh we've helped considerable amount of folks that families who are who are in need of course so since we still have some of that money apparently the need you know for the rental assistance or either people didn't qualify that may actually have needed it are we going to look at putting any different guidelines in place because you know to me we need to use this money and i know that there are people that need some assistance and i just wonder if we can put some different guidelines in place so more people maybe could qualify that have us you know have a legitimate need absolutely a fortune unfortunately we won't be able to these are these are a state as a state program we're going to use their their their program design we're going to use their forms we're going to use their requirements so um they uh we are limited unfortunately um you're right we can't reach out to everyone so again it's it's based on income eligibility and need of course and that always uh that that does limit uh the number of folks who can help that's unfortunate but that's we are stuck with that okay now um it just says rental assistance will uh can it be used for utilities as well or just rental it's uh this is strictly rental unlike our our program which we have we can help with utilities and mortgages this one's strictly rental okay yeah okay thank you bob yes ma'am bob um when is this money's available well um after today uh this friday they're going to send out the contract uh we submit the contract next week and then we start february the first now here's the thing it will extend it to six months for example if you've never if you have not had access assistance already you we can help for six months if we already helped you with three months we can add three more months so that's that kind of helps a little bit yes definitely

[0:12:17] um what is the the income that you based it on what what amount yeah that's uh we uh it's set at 80 percent ami which means it's area medium income so um give an example a family of four cannot make more than 49 000. i keep thinking of that in my head but it fluctuates based on number of in the household and the area of course thank you may i have a motion for approval on item h a moved mayor and seconded by lucy any public comment with none we'll take a vote all in favor say aye any opposed motion passes seven zero item q um i is second reading of an ordinance providing for the abandonment of approximately 7 200 square feet 0.165 acres of alley right-of-way located north of east washington drive between south chavern street and and orient street and i will not be voting on this item but may i have a motion for approval a second a second by lane any public comment with none we'll take a vote all in favor say aye aye thank you motion passes six zero that completes no he didn't did you pull l harry harry didn't pull anything mayor thank you very much these masks is hard to hear so we will now move into the regular agenda comments regarding items on the regular agenda may be made by the public when each item is discussed as outlined above applicants proponents and appellants are expected from the time limit above and must limit their remarks to less than five minutes so the first item is consider resolution creating the

[0:14:19] catalyst project infill program and designating a funding source and john james you are on for this presentation thank you again john james director of planning and development services this is as you know we we do have uh two other existing infill programs the first one is that development incentive of five thousand dollars per home for single-family home development we created about a year ago the empowerment zone uh infill incentive and that can be used for economic development or housing there's no limit on funding like the five thousand dollars per home it's it's purely at the council's discretion although it is both of those programs come from the same funding source and so the 200 000 per year is what you all have set aside for that so that's the cap on both of those programs and the way those programs are created you can use one or the other but not both you can't apply for funding under both of those so that's kind of the where we are right now this is a proposal to create a third infill program we're calling the catalyst project infill program the goal is to assist projects that would be a catalyst or spur development in a larger area that has gone undeveloped the boundary is still the same uh this as the other two programs it's the target neighborhoods uh that have already been identified and the emphasis uh similar to the others but the emphasis on this one is extending utilities uh so if a project would help by this particular project that you might be looking at under this program if it helps expand the roads water or sewer that would help open up further areas for development that's kind of the intent of this catalyst program the granting of funds as with the second program it's discretionary or actually the second program as well as this one would be discretionary by the city council

[0:16:19] so an applicant would have to come to you with a proposal asking for funds for something that's eligible and then you would consider that and could authorize any amount of funding subject to the availability of funding in those infill funds this program is different in that it can be in addition to one of those other programs so if we've got a project and they've applied for the five thousand dollars per home they can get that but then they can ask for this money as well so it can be combined but again as of right now we've got the 200 000 authorized per year so all three of these programs have to stay within that 200 000 unless you all for some reason decide to to place more money into that fund and i will point out uh right now we've got about 165 000 uh in that fund that has not been uh already allocated and which one john well the the infield that funds all three programs oh okay do i have questions from council on for john on this i just want to say that i think this catalyst project infill program is as important as the original infill program in that in many cases the developer is putting in water sewer and roads and so the original five thousand dollars barely helps that part and then if you're expected to extend it as well that's another hundred thousand dollars or more you can't develop in these areas where there is not water sewer and roads are in disrepair if not if existing so i think this is hugely important and i believe that council felt like in one instance anyway that we had approved a developer not happen to do it only to find out that we were not informed enough about what we what was out there in terms of

[0:18:25] ordinances so i believe strongly in this catalyst project and would ask for support on this do i have a motion for approval move by lane a second by tom any public comment was none we'll take a vote all in favor say aye with none oppose it passes 7-0 but i do want to ask you a question if i could john on the if you'll go back to your slide for future conversation on the first one and that is the second the item that says second empowerment zone number one infill incentives for economic development or housing and no limit on funding i think these programs have been hugely successful and very important i'm wondering if we need to re-review down the road that they're on the item two in the empowerment zone that there is no limit on funding and i don't want to bring it up today we don't have the information to discuss it but i do think it's something on that empowerment zone that there should be some limitations on funding because we have limited funds to begin with so with that said put that on a future agenda all right thank you on item b consider approving the catalyst project infill program request for infrastructure funding in an amount not to exceed seventy seven thousand fifty dollars for the lakeview edition block eleven and the presentation made by chad decker an introduction by planning development services director john james thank you john james director planning development services i'm going to give you an overview and i don't chad doesn't have a presentation per se but he's here to answer questions if there are questions about this particular project this is a request for funding to extend water and sewer lines as required by our development ordinances this is a case i'll show you in a second on the map

[0:20:28] it's the lakeview edition block 11. these lines do not serve the subject development so their property is served by the lines that already exist but under our ordinances if you develop a property you have to extend the lines beyond your property to the next property and that's the way as one property develops they extend the lines to the edge allowing the next property to develop and they extend it and so that's how development occurs and so if if a particular development isn't required to extend those lines that then increases the subsequent costs for development on down the line and in some cases can actually discourage that development because they're not only then putting in their infrastructure but they're having to extend lines to get out there so that's the rationale for that in the ordinance this estimated cost here this was the original estimated cost but i've got updated figures here they've they got us just in the last couple of days some updated figures and so the revised plan for utilities is only fifty three thousand six hundred and fifty dollars uh but then their original did not include the design and engineering costs so adding that in brings it to about sixty thousand dollars your the item as you mentioned did say up to 77 000 so with this revised request their their new request is the 60 650 as a not to exceed amount and the way that works is once the work occurs and happens they would provide us information on what the actual cost was and so we don't just write them a check for sixty thousand they show what they've spent and then we reimburse them the amount that it actually cost up to that maximum amount so this is the location they took what used to be three lots face three lots facing north and three lots facing south to 48th and 49th street they reoriented them to face bowie street

[0:22:30] and that way they're able to serve all of the lots with the utilities on bowie street but what they're required to do is extend the lines this way again to serve that future development back to the east and so just to real quick about the the revision they made they will be extending water lines down 49th street and 48th they had originally proposed to extend sewer lines along each of those streets as well what they've decided to do to do now is run the sewer line down the alley in the middle so instead of two sewer lines they've only got one so but that still does extend it for that future development and meets our ordinance requirements but that's why their request is slightly less now this is just the final plot showing those lots and how they were created and that's that's an overview i'll just comment that as you know the the funds are limited we have about a hundred and sixty five thousand now uh so with this request of sixty thousand and as you probably know you you've heard from miss denny a few meetings ago she has come back with a revised proposal that will be on the next meeting and that's about i think about around 80 000 of a request so um i know part of the discussion with her original uh request was well how much funding do we have available total and so you might just have that in the back of your mind in terms of how much funding is available with that i'd be happy to answer any questions and as i mentioned mr decker is here as well anyone have questions for john james or mr decker lane is second by tom any public comment hello please leave a message with none let's take a vote all in favor say i could get a clarification there i know the the autumn was listed as uh i think 77 000 um and so uh up to that amount if we're

[0:24:34] approving up to that amount or if up to this 60 000 revised amount we just need to clarify that in the motion elaine would you clarify do we anticipated we'd anticipate going above 60 right right we use what we use and the rest is not used is that correct um erica carter with carter ventress engineering these this estimate i put together was based off of local contractors while i don't see it going above that you know it's changing every day so i'll make the motion to go up to 77 not to exceed that and yeah that would definitely cover it yes yeah thank you elaine and then second that second by tom any public comment with none we'll take a vote all in favor say aye none opposed motion passes seven zero item c will be tabled to the next city council meeting so we will move on to item d consider items related to the chadburn street project one consider approving change order number one to the agreement with tizek concrete incorporated reducing the total contract amount by 1 million 202 455 and 88 cents and authorizing the city manager to negotiate and execute all related documents and two consider allocating contingency funding in the amount of 768 995 and authorizing the city manager to negotiate and execute all related documents rick so this council is a follow-up item of one you've already considered recently if you recall we the the picture on the screen is the the scope of the project that we awarded a little while back to taizak at that time you instructed us to

[0:26:35] make a change order to look at a reduction in the project to reduce the cost associated with that so just to clarify once again it's from the chadburn bridge from the river headed north to the intersection at borgard the scope of the project is simply this this stretch from that i just described and as defined by our tech stock grant it is the improvements along chadburn so what has been changed is that there will not be any extensions on those those intersections let me go back um that go off of that chad burn corridor along concho tuigg or bourguard so it'll be just that area along chapman not any distance going uh east or west on those intersections so what distance will it go uh rick i know it was reduced but it was originally 150 i think it's really reduced down to just right around that bubble of the intersection so in summary here's uh what we are looking for today the original bid the tizek that you awarded was for eight million eight ninety two three sixty one seventy eight uh we worked with them for reducing that cost and scope and so the proposed change order before you today is to reduce the contract by 1 million 202 455.88 that would bring their contract down to 7 million 689 905. we will want a contingency with this project as with any and especially in this case where you're dealing with unknowns sometimes on the street so our typical is 10 so you'll see uh the 10 contingency is that is not held in the contract that is held by the city uh for us this group to decide if there's something that we need to use that on so it's ten percent which is a 768 990 which is five dollars off from what was posted on the agenda so we'll need to correct that and that

[0:28:39] would leave a remaining four four hundred and thirty two thousand seven seven one that would be returned back to the street bond fund so if we don't use all the contingency then those dollars can also go back to the street bond fund if they're unused um that's that's it in a nutshell we're here to answer any questions if you have any do i have questions from counsel just on a side note this is scheduled if you approve these two today then they're scheduled to start today any questions any comments from counsel no pressure from rick right there yeah what's over with none may i have a motion for approval somebody by tom second of by lane public comment we do need approved as presented to make sure that that change from the agenda is incorporated so moved as presented as presenter city comments on anything as presented with none we'll take a vote on the items as presented all in favor say aye any negatives no so that's a 7-0 vote we will now move into item e first public hearing and introduction of an ordinance amending the budget for the fiscal year beginning october 1 2020 and ending september 30th 2021 for capital items grants and projects tina you are on mayor tina deerski director of finance excuse me i have a budget amendment for you today the first one is for general equipment this is to purchase a truck in the fairmount cemetery fund forty-five thousand dollars next is for capital improvements and within the civic events fund you did approve those projects at your last meeting in the amount of 227 thousand dollars third is budgeting for some uh excess building permits revenue in the amount of 68

[0:30:40] 388 and that will be used to uh for upfront software costs for years one and two of their evolve contracts which is their software system these next two are just kind of clean up within the water capital funds um we're budgeting for the revenue basically from the type b sales tax our cosy dc that will cover the costs involved with west texas water partnership roughly half a million dollars for the fort stockton holdings and then the other 200 is just kind of what we budget every year for any expenditures that come up with that project next is the transfer from the water fund to the debt service fund again this is just clean up in the way that we are accounting for those debt service payments 15 000 within solid excuse me ksab keeps angelo beautiful and that is for the household hazardous waste event that already occurred the solid waste fund is going to fund that fifteen thousand dollars next is grant revenue for dispatch software um twenty two eight twenty two thousand eight fifty nine budgeting for both the city side and the county side i'm 5 000 in restitution revenue that comes from municipal court and we are going to budget to use that revenue for this shelter neuter release program and that's it that's all i have for you i have questions for 14 on any of these items no i'll bring one up as a future item then would you like to make a motion tom um approved as presented okay second by lucy any public comment with none we'll take a vote all in favor say aye unopposed motion passes seven zero enter before we move on could we go back to item c and because that was noticed in the newspaper we would like to take an official vote uh to table that to the next meeting i

[0:34:46] so we are going to look at this we're going to continue to work at it to try to see uh additional funding sources outside of the city uh but we will uh we'll we'll continue to to try to work with this are you able to put on any fundraisers to help support the need what was that brenda kent are you going to have the ability to put on any fund raisers to help support the need right and one of the things we've talked with with shane and jeremy about is the solid waste fund and try to get some dollars from that but we are also looking at funding from other sources uh the health foundation the area foundation the bunyard foundation uh the kickapoo foundation uh some dot funding and i think what we're gonna see is uh that they're gonna be willing to help uh fund these types of take back programs so that citizens have the opportunity to get rid of this stuff okay thank you for that does that answer your questions any other future agenda items from council at this point and our next meeting will be next tuesday which i believe is the 19th we will see you at 8 30 in the morning and with that may i have a motion for adjournment second second by lane all in favor say aye aye meeting is adjourned thank you very much
