[0:00:00] 18th 2019 and we'll start this morning with our chaplain prayer so Gary if you would like to come forward please good morning everyone - mayor the Honorable Brenda Gunther the esteemed members of the San Angelo City Council and to all the officers that are here and all of the guests that are in the chamber I am honored to be here let's pray father in heaven in the name of Jesus we bow before you because it is written in Psalm 33 and 12 blessed is the nation whose God is the Lord father you are our Lord and we praise you and we thank you for this opportunity to come before your presence today but before we begin the business of the city we seek your face in your council for guidance for wisdom for knowledge and understanding and the power and the ability to work together in a spirit of love and unity we pray father that you bless all of those that labor here in the city government we pray for every organization and every company that's represented here today and we ask for your wisdom to help us to be the people you would have us to be these things we ask in Jesus's name and for your name's sake amen thank you for remaining standing and we will now have our pledges and we have to clap worthy brothers today one from the fourth grade ace is it Jace or JC Jace come on up here and then we have Robbie right okay well you're going to join me in saying the pledges so what we're going to do is we're going to turn this way
[0:02:02] gonna put our hands over our heart and we're going to start I pledge allegiance to the flag of the United States of America for which it stands one nation under God is why I get to wear a dark suit we have two proclamations today so we will start off with the proclamation of September the 15th through October the 15th 2019 as National Hispanic Heritage Month during National Hispanic Heritage Month we recognize the important presence of Hispanic Americans and their contributions made to the United States and San Angelo Texas this is also a time to celebrate the Hispanic heritage and culture El Puente foundation seeks to bridge culture through the arts and education the city was named after the patron saint Santa Angela in honor of the city's founders wife Karolina Angela de la Garza forty-five percent of the city of San Angel population is Hispanic and has contributed to the community since its inception through agriculture the arts business civil service education military music ranching and religious efforts we encourage our citizens to share in this tribute by learning and celebrating the generations of Hispanic Americans who have positively influenced and enriched
[0:04:04] our community and nation therefore I Brenda Gunter mayor of the city of San Angelo Texas on behalf of the city council do hereby proclaim September 15 through October 15th 2019 as National Hispanic Heritage Month in San Angelo Texas and encourage our citizens to learn more about the history and rich contributions to our society by Hispanic and Latino Americans do we have folks in the audience who will accept this proclamation today Jason good morning all on behalf of winter foundation and then spent at community of San Angelo it is an honor to celebrate our traditions and value with all and as the mayor Brennan Gunther said Hispanics cultures are deeply rooted here in San Angelo Texas and her great nation as you can tell I'm not a people's person I'm a little nervous but you know it's just it's an honor to have City Council acknowledge the Hispanic Heritage Month and we hope to continue to move forward and celebrating and sharing our values and enriching this nation [Applause] our Knicks Proclamation is a proclamation of the city of Odessa as hashtag West Texas strong the city of San Angelo is shocked and saddened by
[0:06:09] the events that occurred on the afternoon of Saturday August 31st 2019 in Odessa Texas seven victims were killed in this act of violence and more than 20 people were injured our hearts go out to the families and friends of the victims of this horrific violent attack we acknowledge the bravery and skill of the multiple agencies across West Texas and those throughout the state who responded and will continue to investigate this tragedy this senseless act of violence the second such attack impacting Texas this August will not weaken the resolve of West Texans to stand strong in the face of adversity adversity and support each other in our quest to provide a safe and secure environment for all of us therefore I Brenda Gunther mayor of the city of San Angelo Texas on behalf of the city council do hereby proclaim the city of Odessa as hashtag West Texas strong in San Angelo Texas and call on all of our citizens to lift up the people of Odessa in all of West Texas and their thoughts and prayers I will present this proclamation to the mayor of Odessa on Monday when I'll meet with him in other West Texas mayors thank you very much [Applause] we will now open up the meeting for public comment first again check to make sure that your cell phones are on silent or on vibrate and as you come forward to make public comment please state your name and address or your SMD area each citizen can speak just once per item
[0:08:14] unless asked to comment by council the public comment will be for three minutes unless extended by council or translation services the proponent or opponents five minutes unless extended by council or translation Services Council has no obligation to respond to comments or questions from the public in a response from a member of the City Council to non-agenda comments is limited to a statement of specific factual information recital of an existing policy and directing staff to place a subject on a future agenda with that we will now open up our public comment do we have anyone here who would like to speak good morning counsel Steve Hampton district 6 area I have two things that I'd like to bring before you one is and I've been up here before on this there is a trash problem on the 306 this morning it was especially bad it looked like the whole side of a trailer fell off and was strewn from the Sherwood corner down to the next exit there was a couch and a chair look like laying on the side and I think that we have a problem in if we have a tie down and cover rules we're not enforcing them it may be our trash people I don't I don't know I didn't see the accident occur or the situation occur so I don't know exactly what the cause is but it continues it's gotten a little better over the last time it looks like we have
[0:10:18] a higher people to go out and pick up the trash periodically but from time to time we have large quantities of stuff fall off it looks like what a trailer on the way to the dome and that brings to me to my second point is that last time we had a shortage of 325 350 thousand on the police what their revenues were and and they came and asked us for money for the new budget if I think some of this situation could be handled by them if they were out patrolling the streets I'm a law-and-order person I I think they do on the majority a very good job but when it comes to to these situations here three minutes is up Steve thank you for your comments further public comment good morning my name is Joe Tong Kesey late at 2503 West ooing a fourth-generation here in San Angelo and have lived here my entire life I'm here today to raise awareness on the unknown effectiveness of what's being done for the citizens to provide animal population control and shelter for their lost pets I'm here an attempt to motivate the city did you put the microphone a little closer to your mouth please okay thank you I volunteered my time and money for more than one of our local animal shelters and rescues I'm not alone most of my volunteer hours are spent with Kurdish a
[0:12:19] kreski which is where most of my dad is from I've provided a list of volunteered time and money by just a few there are only these are only the people that I personally spoke with and verify the donations I did not collect or include data from Cassie's rescue their rescue facility and operations are funded by a primary donor and other donations if you when you look at the data that I'm providing you will see that currently the city has received a benefit of two hundred eighty four thousand and ninety six dollars during the last year from just a few people this should not be on the shoulders of just a few especially when they are not the ones that are behaving irresponsibility irresponsibility and violating Sydney ordinances I do not know who would benefit from manipulating the shelter numbers that are reported to this council rather it is intentional are not closing the shelter to animal intake for being full or does disease containment does not allow an accurate depiction of our situation if the shelter closes regardless of the reason the strays continue to wonder pets continue to escape people continue to dump their pets and puppies and kittens continue to be born when numbers are presented to you they only reflect the show the intake by the shelter and their adoptions and euthanasia three yes man dude can you just find a closing point just I want yes with dot with the dogs in the shelter intake numbers where they're referred to critter shack and Cassie's and we're taking those on and I want our shelter to be a no-kill shelter but closing it and putting off to the shelter's does not make it a no-kill shelter thank you very much thank you for their public comment no further public comment we will move on to our
[0:14:23] consent agenda I am going to start with Tommy do you have an item you'd like to pull from consent agenda he is pulled already is off the agenda consent agenda so cross it out Brenda this has changed yes since the number streets I want to pull ass okay and Lucy Lane ma'am Billy all right with that do I have an approval to on the consent agenda with the exception of item F and a second lane you second it any public comment does that motion need to include item D not being included in each other we've already pulled it we've already removed it all right no would be the answer okay with that we will take a vote all in favor of approving the consent agenda with the exception of item F say aye with none opposed motion passes 7 0 item F is consider proving an agreement for uniform rentals with the universe corporation through by board contract number 5 8 7 - 1 9 and authorizing the city manager to negotiate and execute all related documents and so Nolan you're up Tom well I actually have a commercial clothing store within my district and a lot of people don't understand why people actually use a facility and this can you give them a brief explanation of what the purpose of a commercial clothing does for the city yes sir thank you and a few divisions have a higher
[0:16:28] propensity to damage their personal clothing as well as city issued clothing so even if we were to do the alternative which is to purchase the uniform the employees are still going to have a higher propensity to damage that article of clothing whether it's waste chemicals just by the nature of their job it's going to get soiled a little more easily than employees working in different capacities so because of that inclination certain divisions like wastewater Water Reclamation Street and bridge fleet services those divisions have actually opted to have their employees lease the uniforms at a low weekly cost so the handout provided to you show some of the price changes across all items that we use we're seeing a price decrease and the advantage of that to us is that rather than buying and having to account for a different sizes of employees especially in roles where a turnover can be a little higher it's it's difficult to stock sizing storage cleaning fees so we can kind of bite down on some of that cost by doing the lease program it's more cost effective the average annual spin on the leasing program floats somewhere around 32,000 departments budget for that during their annual budgeting process and we're able to take that cost substantially lower than it would be if we were to provide a uniform allowance to those employees and then have to mitigate the costs of cleaning and laundering and stuff of that nature good you want to make a motion then Tom motion to prove this presented in the second by Harry any public comment with no public comment we will take a vote all in favor say aye with none opposed item F passes 7-0 with that we will now move into the regular agenda and on the regular agenda comments regarding items on the regular agenda maybe made by the public when each item is discussed as outlined above applicants proponents and appellant are
[0:18:32] accepted from the time limit above and instead must limit their remarks to less than five minutes with that we will go into item a which is the first reading and public hearing of an ordinance amending pd-1 803 a rezoning from the single-family residential rs1 zoning district to the planned development PD zoning district to expand the existing PD 1 803 boundary to allow for uses permitted in the general commercial CG zoning district with the principal use of cave campground recreational vehicle park being 40.5 8 acres located at 26 80 and 2698 camper Road John you're on thank you John James Director of Planning and Development Services you may recall this is a planned development that exists not too long ago you all adopted a plan development for the existing RV park this is basically an expansion of that pd to include a new proposed expansion area of that RV park you can see here on the map the blue line represents the existing plan development district and then the red reflects the expansion area the future land-use plan for this area is open space and the the RV park and other recreational uses are considered consistent with that open space designation just a few pictures of the area you can see the existing RV park area their existing retail store that's on the sides as well as the boat rental all of those are included as part of the original PD the expanded area is basically expanded for largely the expansion of the RV park itself again it is right on the lake this is the concept plan you can see
[0:20:37] that proposed initially they're proposing about 22 new RV spaces with the possible expansion of maybe 11 more in the future they could expand into this area as well in some long-term future but my understanding is they don't have any current plans for that it also as you can see provides for boat parking a possible restaurant up there at the north end as well as some boat storage areas there is 200 foot setback from residential boundaries I have a better map of that in just a minute John just for clarification if you'd go back to that slide the the proposed spaces are right there adjacent to and I would say off of camper Road right there across from the water is that is that accurate yes so camper Road comes in through like this and then here's the the water right there okay and as far as you know at this point there's no there's no plans for future expansion in that back section it is quite on your mantle well there's not but again what you're approving would allow that so knowing that there's no immediate plans but this PD would allow more than those 33 planned expansion spaces yes Billy yes that one so right now with this concept drawing you're saying that this white space we don't know of any plans if we approve this couldn't we put conditional uses on that absolutely the the planned development district can have and as you know in your background information there are already conditions placed on development on this property so yes you can add additional restrictions or conditions this property is unique in that the city owns it so you all act also or the city acts as the lessor of the property so depending on exactly what types of conditions you want to place on it some
[0:22:41] of those may be appropriate to add to this plan development although you might consider and some of those in the terms of the lease because that's also that's not before you today but that will be coming back to you as the property owner you could place stipulations in the lease as well I just want to make sure I'm clear since we're going to be voting on this could one of the conditions be because I got a call from a concerned citizen you know about how many spaces could be added to that and I guess in the background information it said it expansion could allow up to two hundred and twenty-nine additional spaces so could there be a condition put on by the City Council were in the lease that RV parking could not expand into that white area that it continued to be open space and that's just a question I'm not saying that's the condition I want I'm just asking the question yes you can place those types of conditions through the plan development and and I might defer to the applicant to talk about their future plans or even maybe someone from the city side as well maybe Carl or someone else might be able to speak to in terms of that that land as the city being the owner of that land what the long-term plans might be yes some point when John finishes well why don't we have the applicant come forward now since the slides up and go ahead and and add conversation to this I'm really I'm the aren't Irving y'all space are out there yeah the open space there there is no plans for development there long term plan there is events having events there you know are so things of that nature maybe you know when some of that stuff out there there's no there's never no
[0:24:45] plans to move for us to expand out in that open area with RV spaces so right you are you saying without saying it you would be okay with the condition that no expansion of the RV spaces in that area would be acceptable is that what you're saying - it's just in this white area yeah I'm okay with that okay all right all right thank you Ray thanks John you wanna come back up I'm sorry what was it a question no it was would you come back up oh yes you can say no if you want to John but I don't and just a clarification Carl pointed out that you all have already approved the authorization to negotiate the lease so that's with with city staff now and so if there are additional restrictions that you would prefer to be in the lease versus the planned development we would need that direction as well since that won't be coming back to you John so we put a condition like that on that open area somebody wanted to expand opportunity to come back before the City Council to get that condition removed absolutely it would just be a PD amendment just like we're doing today expanding the boundary we could come back within an alter we can strange that we want to leave it as it is with restriction on nothing being developed for RVs without council approval and then you don't I mean you can limit it like that make a motion accordingly I won't read through all of these that's in your background information but it's just some of the reasons we looked at for why staff is recommending approval of the side it basically fits with the area it's an expansion of an existing
[0:26:46] use in that area and really is consistent with the city's adopted plans for that land we did send out our notifications the mailed notifications and did not receive any in favor or an opposition although there was some opposition expressed in the public hearing at the Planning Commission there was no formal written opposition as I said staff does recommend approval subject to that one condition which is this is the recommendation from the Planning Commission if you recall the concept plan that we just looked at there was originally a caretakers residence proposed for the property that was close closer to those single-family homes Planning Commission recommended removing that a natural buffer and I'll show that on the map in just a second and then removing a sandy beach area that was originally shown on that concept plan so what comes to you is the changes with the changes recommended by the Planning Commission go back to that so when it says removes the sandy beach area explain that the original concept plan had shown an area where they could do a create a beach for I guess the RV customers would have a beach area and the Planning Commission recommended removing that from the concept plan would that have been across across camper Road there on yes I think if I recall it was kind of up in this area somewhere okay but that has been removed correct okay and my understanding is that the based on the conversation at the Planning Commission the applicant was okay with all of those stipulations as I mentioned the Planning Commission did recommend approval a 5-1 vote the issue
[0:28:47] and the question for you all our RV park standards were modified five or six years ago and as part of that there was a citizen committee and then ultimately came to City Council and the recommendation was that all new RV parks and all expansions of existing RV parks would be subject to these new rules which included paving of all internal roads and spaces the applicant has asked not to have to pave the roads within this side but they could dirt or pack caliche kind of roadways staffs recommendation is for it to be paved consistent with the RV park standards that apply throughout the city the Commission voted to approve without the paving requirement the 5-1 vote the one no vote she was supportive of the RV park expansion but she believed that the paving should be required the require there is a requirement also for a concrete pad where the RVs actually sit that is still within this requirement so that was not waived but what we're talking about is all of the access roads within the RV park to get to those concrete's pad signs what would be the additional cost of paving I would I would defer that to the applicant to address what what those costs my John when were Tommy would you like to speak thank you I thing what kind are we talking to coarse are we talking like when we require of a developer when putting in the streets yeah to course would work there's a list in the ordinance of it could be concrete it could be asphalt like hot mix like a street uses or a to course all of those would be acceptable and so in other words it's not it would not have to be to the full standard like you're building a city street can't council we I think we need to keep in mind this is our property so it's going to fall to us if something goes awry with with the streets out there it's on us since we own the own the property and
[0:30:52] the property but they're responsible for maintenance of the streets so we're not responsible for the maintenance of those streets whether they're paved whether they're caliche or whether they're dirt at least for the terms of the lease the lease ends its falls back to the city as the some point at some point in the future we'll get it back at some point so you hope not we hope it's incredibly successful and that it will be a property someone wants to continue to develop and grow for the citizens and this is the last slide here I mentioned the map right now what the wording of the plan development is these are the homes they're on Sleepy Hollow and from those homes there's a buffer that nothing in the PD can happen within this 200 foot buffer we had a question so we showed a couple of different buffers if we increase that to 350 or 500 feet just to kind of show you what what that would impact one of the conditions that was recommended by the Planning Commission was this little finger of land could not have any development so in effect if you adopt the PD as recommended that area where there could not be any development would look something like this so none of this area could have any RV park or any other type of development but they could develop you know anywhere in the rest of this as per the recommendation that comes to you so if we approve it as presented we're proving that that little finger cannot be developed as you just direct that's correct so that's in the existing language that's correct John Dee I've been out there several times to look looking at Google Earth and then driving out there since you this it's not accessible from a couple of spots because of being gated do you know by chance that which it appeared the darker in the in the photograph there appears
[0:32:56] to me to be mesquite grown up with with brush mesquite and so forth is that an accurate do you know is that an accurate statement I do not know I perhaps the applicant or maybe Karl or someone could my point really being that that is a visual buffer if in fact because it appears to me driving out there and looking and getting as close as is a as possible on and staying on the in the bounds of the public roads that are accessible it appears to me that that that's a buffer there that you cannot see across even the water there to even even if the development were further back than what it's proposed to be so yes I do know that there are some trees in that area that do create something of a visual buffer I don't believe that was a stipulation that we added hey would you like to come forward and talk about that that's right the Planning Commission did recommend leaving this area as natural to maintain that visual buffer between these residences and the RV park okay yeah yeah this this currently right here is all so you really again I couldn't get obviously I couldn't go in somebody's yard close to the water there so to see can you see ray if you're in someone's backyard on the on the like there can you see through those through that buffer there or is it completely screened bring our fault might be different yeah yeah to their houses and yeah you know depending on where you're standing and what you're doing over here you could see across there and so that's why you know I was in agreeance too with with this with this finger here all being never
[0:35:00] developed leave it just the way it is because you got to rule the trees here and y'all go over all the trees on this side here as well that act as that visual buffer so it just still made it so that it was hard to see anything beyond that thank you thank you John and I think that was it unless you have any other questions for me you have further questions from Council I have one mayor okay go ahead Tommy um John what in terms of when we're talking RV parks what what kind of disposal are we talking about for white waste disposal from from the RVs are we talking a septic system right are we talking any kind of sit what are we talking about I think I would defer to them on that I do believe this is connected somehow to our sewer system riders and the lift stations in there so I mean it we address that early on when we were talking about this lease and the development of it so just we remind everybody ray of what that was done what was done on that so the new development will tie into our current system which we're handling us our our system well you've done some studies on it and and we can add you know this much more to it and be okay and we with the live stations that we have that are full grinders they either manually or automatically time differences so it's not all pumping at one time out of the city but the line that goes to the city you know it's just the same line and we're gonna have all internally and get it all so it doesn't add any more you know load you know load per hour or load per minute on the line or nothing it's the same below the floor rates going to stay the same we just separated out at different times with with ordinance stations on the RV park ray will it be set up to accept Class A B or C RVs or because they think there's certain
[0:37:03] issues in terms of weight for different RVs there won't be any issue with the weight no okay I do you know how much additional the cost would be you to do a two course treatment pavement pavement is about ten dollars a square foot is our cheapest bid and fifteen dollars a square foot is our highest bid only one contractor what you don't want to do it out there they said just because of the water tables that land actually moves out there a little bit when the water goes up and down you know the current water tables the parks about 18 inches so it's just that weight and the fluctuating of the roads and all that it's easier to maintain it with like the number two commercial base you know we can take our road and maintain our out there and maintain it easier that way versus a constant with the weights with a constant with them moving out there you know the roads would be would definitely be would be breaking up a lot more you know just because of that the other issue is is if you did have to do paving what would be the additional cost for rentals to do that and would you then not be competitive with anybody else because obviously you have to put in to the cost of a rental the cost of yeah yeah you know even just the concrete pads are gonna raise a little bit since how most if I all starving a park scenario it doesn't have any of that they don't have any of that cost to maintain and upkeep but yeah it would it probably put us in the seam in the same rental stuff as the coastal parks so if you're gonna pay that price why not go to the coast you know I mean that it does it does it just cause a huge a huge cost increase to that you know like I say and even getting as one contractor that would do it but wouldn't really stand behind it because he knows that's you know there's and we could do a lot
[0:39:06] of work out there you know and he was about 15 dollars a square foot you know to pave anything out there it's a huge increase in end it would be I think we'd be pricing you out of business if we did the paved road yes I believe so too as far as pricing us out of the expansion yeah all right with that do I have any further questions for Ray before he sits down if not do I have a motion on this item a I move approval as presented by staff the 200-foot buffer and and I would include in the the language in the lease as well that any anything is has got to come back to Council as we discussed earlier well we need to also address the issue of pavings I need the motion to say that we will not make him paved those streets I would I would waive the waves of the paving effort yeah after hearing the conversation here the motion is to do the 200 feet buffer and to not require pavement correct and include in the lease the language that you know it has to come back to council there's any further develop if there's any further is the paving exception is that for the streets and the pads or streets on the concrete pads have to exist Julia did we want 200 or 350 the Green Line is the 350 no we wanted the 200 with that outreach in that one little finger that which is what he what John presented yeah so it's inclusive of that and to maintain maintain that that visual buffer that that not not ever be removed there is everyone clear on the motion
[0:41:10] okay with that motion do I have a second a second by Billy do I have public comment yes ma'am please come forward my name is June Bell I live at 2654 Kings Road which is this area over here and I was not aware of that apparently the six people that were were contacted about this I'm a little bit further out than those six people so all I have heard has just been rumors this is the first time I've seen this plan I know several years ago there was another plan and that was not approved I do have some concerns I have this is a residential neighborhood this road right here it's not going to be paved and there's houses there I mean you start thinking about the traffic constantly with those RVs going back and forth I understand you know the conversation with you know the the roads not adding additional cost and pressing him out of business however like I said it's my residential neighborhood so you know you got to think about do you want to it's not good but you know I really don't want to caliche Road down just down the street from me it's cool ichi now yes yes and it's only been used during the boat races but you know this road would be opened up for you know more use currently and he hasn't I haven't seen the number of spaces that are already there that Park and the traffic down fisherman's Road and in there that's one way in it's already
[0:43:14] very congested and adding more spaces you know is there a limit you know to the number I'm all for growth but at some point in time you've got to recognize you know where where you're at what's going on there three minutes is up thank you further public comment no further public comment we will take a vote all in favor of the motion say Aye I'm sorry just to clarify around her comment this this road is a secondary access road for emergency vehicles only so RVs won't be accessing the park on that road thank you John all right with that we'll take a vote all in favor say aye none opposed motion passes 7-0 we'll move on to item B public hearing and consideration of a resolution approving a special used to allow an indoor multi-use recreational facility and related recreational activities day care community outreach community services and educational programs on properties owned single-family residential RS 1 & 2 family residential RS 2 located at 8:10 and 811 Austin Street and 8th 1/8 Kenwood Drive John thank you again John James Director of Planning and Development Services this is a church site you can see the location here off of Washington Drive the River Terrace building is from back here in the background and the remainder of the surrounding area is mostly residential as you know we this is a church within a neighborhood which is not uncommon in this case the church wants to lease a portion of their facility in this case for a gymnastics gymnastics business that would operate out of their gym and that's really the crux of what we're we're talking about here is church services and related uses are allowed on
[0:45:17] the property because the church has an effective conditional use on the property however once they want to expand that to a commercial activity that's what prompts the need for this special use and why it's before you today the future land use plan for this area is neighborhood you can see the zoning is a mix of Rs 1 and rs 2 single family and to family dwellings actually while I'm on this map the River Terrace back in back across over here although they are zoned for residential they do have a special use on that property for the restaurant that operates on that property just a few pictures of the church campus as you saw on the map it does take up about a full block and a half of of property in the area here's the gem in question and then I think in this picture the gem is just off the screen you can see homes across Avenue D this is looking across Kenwood Drive so the point of this is that as you can see there are homes literally right across the street from the church facilities it basically in all in all directions this is looking toward the River Terrace property staff did review this and we are recommending approval service uses are not always appropriate within the neighborhood and we do have this similar concern shared with the neighbors on the impacts on the surrounding development we think the special use can place conditions on the approval that would help minimize any of those impacts the intensity of church uses on the property creates some of the same potential issues that a business on the property would in terms of things like traffic as you'll see from some of
[0:47:20] the public comment I expect well here and what came out in the Planning Commission the church uses of the property aren't as extensive in terms of time frame you know most things happen on Wednesdays or Sundays with some other things happening throughout the week but what we're talking about here is a gymnastics facility that would pretty much be every weekday pick up and drop off of kids potential use for as a daycare as well and so that's some of the potential issues that could occur on this property again one of the things that this last one I don't want to skip over West Washington Drive is a major collector Street and so being a collector Street and with the grid of streets in the area it is designed it's in an area that we think can handle the traffic as compared to if this was more sort of in the central part of a neighborhood away from any major streets it might be more problematic but given the large parking lot of the church and the multiple streets to get in and out we think the traffic problems we think the streets can handle that traffic with less impact as it might otherwise we did send out our notices we received one in favor and seven in opposition you can see here on the map a number of those were from River Terrace but also from other properties in the area there were some property owners who did not submit a formal written notice but spoke yesterday at the Planning Commission meeting I suspect some of those are here to speak as well as I mentioned staff does recommend approval with conditions the Planning Commission discussed this quite a bit yesterday there was a motion to deny which failed because it got a 2 2 vote we did have another Commissioner that was present but had to abstain and so there were only four voting members so that resulted in a 2-2 vote there was some discussion of tabling it to allow the church and the potential business owner and the neighbors to get together and maybe see if they could work some
[0:49:22] things out that motion to table failed for a lack of a second so formally what comes to you as no recommendation from the Planning Commission and so there's because of the - to vote it was not an approval or denial we do have some recommended conditions including shielded lighting limits on hours of operation I will point out that based on the conversation yesterday the applicant and given the the proposed business on the location they were ok with these numbers being 8 a.m. to 8 p.m. instead of the 6 to 11 p.m. so that's something you may want to keep in mind those hours of operation were one potential concern from the neighbors no illuminated signage after hours so that any illuminated signs if they have them would not negatively impact the neighbors new signs must comply with science standards for a non-residential use in a residential district so basically the same as what a church would be allowed which aren't as big in as large as a normal commercial business might be able to have it also allows the city to inspect the site to make sure that they're compliant with any relevant standards that's that's the overview I'd be happy to answer any questions I have any questions from Council lame I'm okay with the 8:00 a.m. to 8:00 p.m. I think that's a good recommendation but I think I have two questions for the applicants themselves one would be for a traffic come on act I know that the tumbleweeds currently are over off of am at the old school and how about how many cars how many students they see daily that way and also one of the opposition's mentions about outdoor playground during those times are these facilities going to be mainly indoors for the gym itself does the church
[0:51:27] already have a playground let me speak to a few of those issues first the time-frame land and I discussed actually after the meeting there are rare occasions where she has tournaments that would go past 8 p.m. so I think 6 to 11 would be more agreeable just so that we're not so that was so that during those those times that were in agreement with the special use permit as far as the as far as the playground equipment goes we have an area where a playground was for a long period of time but all of those apparatus for the the jungle gym and all of that were were weather-worn and so we removed those about a year ago because we felt like that was a blight in the neighborhood and so there's a place for a playground there was a playground within the past year we've taken it out and we potentially could put it back and John for playground purposes a charge right now even being zoned for residential can have an outdoor playground or okay for the sign can you can we go back no illuminated sign eliminated signage between 8p and and 6a can we we strike that to say no illuminated signs just to prevent any only question I would have as the church currently has an illuminated sign so with that we gotta say it does okay what grandfather is okay no additional illuminated signs okay so you know that that would make it more restrictive than what the church could do today but again you do have the ability to do that
[0:53:29] through the special use okay all the questions I have for the moment I see that the traffic goes how many cars how many parking spaces do you have currently we have like 24 parking spaces at the gym now and then there's a little circle drive we also use and I think there were nine vehicles over there the 33 under 40 probably for sure okay you mentioned tournaments is that during the week and for in gymnastics meet that would be one time of year one time of year on a Saturday on a Saturday okay any further questions from Council Harry one second Lucy I'll get you Harry from my perspective I want to know before we take a vote one way or the other can we actually vote to send this back to the Planning Commission I don't think you're gonna get anywhere on that I think it comes to here because they can't come to a conclusion but John go ahead yes you could you could send it back to them for further deliberation or you all could do what they tried to do but didn't have enough votes to accomplish was tabling it to allow the neighbors to work with the is there 7os we probably make a decision on where the there well and it was unfortunate that there were only four planning commissioners that were able to vote had it been a more full body that they might have come to some resolution Lucy I just want to ask how many children do you propose to have in this program the whole gymnastics program we have a little over three hundred three hundred class how many would you have per class and with our younger students we have like six and a class and the older kids are eight in a class the team is there and generally there's about 20 so at one time we might have what is that the 35 students out in the gym at a time and
[0:55:34] about five coaches okay all right was that do I have a motion I have one more question I had time for John I guess that are maybe Theresa or Julian or all of them and does this require a supermajority vote would do the did the opposition they're calculating that number right now if it's 20 percent okay it will but yeah it does require it if it's a 20 percent or more of the surrounding properties they requires a supermajority and for approval 3/4 majority but we're calculating that right now so okay can let you know if that's trigger so since we're kind of having to do the job of the what Planning Commission it was supposed to do yesterday given the circumstances can we go ahead and listen to the public well let's have a motion and a second then we'll open it up for public comment so for the I guess for the time being then I'll go ahead and make the motion and I can amend it if necessary yeah I'll make the motion to approve with the 6:00 a.m. to 11:00 p.m. 11:00 you said that is the tournament the time that we have that go out of normal range gymnastics meet starts about eight o'clock so like we just hosted one this last weekend at Central and so we were all there about seven o'clock you know to set up so that the teams could come in and get started by 8:00 and I think we were out of there probably about eight o'clock yeah okay thank you all right seven to eight pm seven a just eight pm on that yes sir so normal for normal day-to-day operation during the
[0:57:39] week hours workweek hours Monday through Friday this might get complicated can we do the normal business our kind of 8:00 8:00 a.m. to 8:00 p.m. with tournaments on a Saturday with the extended hours can is that a possibility what do you really have a need at all during the week to have it open till 11:00 p.m. no ma'am our classes generally end around 8 o clock because you've got school kids I've got to go to classes so limits the hour that it would be in so Monday through Friday hours a day to 8 P Saturday hours from 7 to can we do that was it oh yeah that would we could get everything in there make the motion to approve with those exceptions of the hours Monday through Friday 8:00 a to 8 P weekend hours of 7 a to 9 p i know'd additional illuminated signs except for church uses commercial uses their current signage there's there's current signage but if the church if the church already has the ability to have an illuminated sign what I'm no illuminated signs for the commercial use of what we're voting on today I'd have to apply for a new sign correct that currently they have illuminated signs so any if they want to put up a new sign they'd have to come to to get it you can put it in the motion timeline that they're already able to have they can apply for it and get a sign the church itself that's right okay the subject of limitations because it's in a
[0:59:42] residential area but yes and I don't think I have any problems with the traffic impact that you all have so I would make that okay all right there's a motion is there a second second second by Tom do we have any public comment one thing Lane Landa just told me with the deck here it might be more advantageous to have the opening time seven o'clock because of drop-off for kids as they go forward with that particular program if that makes sense verses 8 a.m. versus 8 a.m. okay okay this may take just a few more than three or five minutes whatever I'm allotted but I've worked about 60 hours on this over the past six weeks so I'd appreciate just a little bit of latitude and being raked over the coals yesterday one address for issues one with our neighbors during the meeting yesterday several issues were raised by our neighbors most of which I feel predate my time in leading our church and without getting into those issues I would just say that I've tried to work on abating their concern over the past three years of my pastor it and I genuinely want to be a good neighbor as we move forward but maybe more than explaining all of those things I can just offer my sincere and humble apology to anyone who has been inconvenienced by our congregation any one of our neighbors today wants to meet after this meeting and discuss whatever frustrations they have with our church I would certainly be glad to do that I'm hopeful that we can work on those issues going forward secondly another issue that was raised yesterday was the potential of decreasing property values by allowing a business into our neighborhood and I understand the concern about property values but I would just offer this as a explanation that I don't know that I have to give them it might be helpful in a good-faith effort we have passed a resolution as a
[1:01:47] church that says the proceeds this is the exact resolution in part the proceeds of the lease - expenses related to the respective building will be used to pay down the capital debt of the church when the capital debt has been satisfied proceeds will be used in maintenance and improvement of church property this is important to note because our desires to maintain our property in a way that would not have adverse effects on property values in our neighborhood but without the capital from the lease the facilities will likely fall into disrepair and the fear of blight and loss of property value will actually be realized third and I really didn't want to get into this but yesterday it was continually brought up during the planning commission I was castigated by one of the commissioners mr. Connolly Brooks he took issue with the fact that the church doesn't pay personal property tax and he's certainly entitled to that in opinion and in part I share his opinion I don't think that churches should pursue endless business ventures that are at best tangential to ministry however if a church already owns and has available real estate that could be leased to others and consequently help the church maintain its place of worship then it shouldn't be penalized for doing so in fact that's what the courts have upheld churches are able to do time and time and again and that brings me to my final issue and I think this issue is one that I care most about in the past six weeks it has been unsettling how many times I have been discouraged from talking about the topic I'm about to I have had a city officials say that they weren't prepared to talk about it yesterday I was mocked for bringing it up the issue is that of equitable application of the law there's something altogether unsettling about having people that work in the city tell you that you don't want to get into the law that is why we're all here today in 2001 the federal government passed
[1:03:50] the religious land use and institutionalized person persons Act the legislation is important because it guarantees that municipal governments equally apply their zoning law since then numerous appellate divisions at the federal level have enshrined this law and clarified its application one decision in particular third Church of Christ Scientist versus the city of New York is about a church that leased out its facility through the week to a catering company the city subsequently revoked an occupancy permit because the neighbors didn't like it however it was found that the city had granted similar permits to secular organizations and the appellate court held that it was unlawful and was subsequently in further appellate decisions upheld you can't set one standard for the church and another for the secular world so the question as do does this law apply here well one the river terrace where most of our opposition is coming from has brought up impact of traffic and yet the River Terrace itself often has traffic that creeps into our streets it's troubling to me that at times we've even had overflow into our parking lots from River Terrace and yet those in opposition lists this as a reason to deny us of this use permit there's some concern about allowing a business into the neighborhood and yet River Terrace itself has been granted the very same special use permit that we are applying for today letting businesses in - our neighborhood seems to be a question we've already wrap it up yes and then finally the daycare issue about traffic flow there's many daycares in our area let me just say this in closing my greatest concern is not whether we get a permit today I do care deeply about that decision but I have to tell you that there's something more important my oldest son who led us in the pledge of allegiance today is with me and we recently returned from a trip from Washington DC we spent a week reflecting over our freedoms I taught my son about
[1:05:53] how in America we treat each other with equity under the law how we might not all agree religiously but we can agree that every person has the right to use their giftings and property in accordance with their own convictions as long as it doesn't infringe upon the rights of others thank you we're not asking to infringe on the rights of anyone else Thank You Jay all right we have a motion forward we have a second we wrap we're having public comment do you have a question for him about the statement for the personal property tax I know that the churches except the schools are exempt they are currently in a school so does the business whether they're in a school gym or a a church gym tax some so my understanding there's a lot of tax law and I'm not a tax lawyer so there's that but my understanding from the Tom Green County Appraisal district is that and this has been decided in many cases if the church uses the proceeds to fund the continuation of improvements to the property then that income can and that property is not taxed once we start using the income for something other than keeping the property up and the tax question gets raised again does that make sense I would like to the council to not consider whether or not this is a tax-free organization when making this decision that's really not the purpose of what we're talking about today I mean we wouldn't talk about that in any other context that was really not relevant today and also I think you need to consider the actual use that's going on here the law that he's referring to you there are protections lupa is what it's referred to commonly is a federal statute that does limit a city's ability to regulate churches in some instances but the instances are where you're imposing a substantial burden on religious exercise so if we were saying you can't have a church in a certain
[1:07:54] area at all or we can't have churches in the city of San Angelo that's where that would come into effect if it's treating religious uses worse and secular assemblies so that's an Apple to Apple comparison I'm not sure whether or not he's gonna disagree completely with this but I'm not sure whether or not having a restaurant and having a gymnastics facility this Apple to Apple that's for you to decide whether we're discriminating on the basis of religion whether we're totally excluding religion or whether we're placing unreasonable limits on where to locate this is very similar this circumstance is you know we had a request recently as a city to have a recreation program that was for-profit in a city facility so although the city facility as a city we were able to have that particular activity in our facility if we were hosting it when you bring in that commercial enterprise component that's when you have to evaluate based on that commercial enterprise we can't stop this church from leasing their property however once they lease their property we can look at the use of that property and determine whether or not it still meets the protections of that act first to get there they have to show is the land use regulated well yes I mean this is a land use regulation that we're trying to impose but the second is the using question a religious exercise and I think that's where the dispute lies is leasing your property to a gymnastics gym a religious exercise and exercise of religion or is that a commercial enterprise and really the proponent in this is not the church but it is the person who wants to have that gym and our job today is not to get into the determinations of those issues that you've just raised so we I don't want to drag this conversation out because we can't change any of those things that you've just said I have a question yes sir that though how do how did mother's day outs that are at churches where do they fall my guess John can probably answer that better than me but I know a lot of
[1:09:57] numbers day outs that my children have intend to have a religious component to them and they are operated by the church and that's that's the distinction is if it's a if it's a function that is operated by the church by Church employees or volunteers then it's a church function and that's a typical church function if if they were to lease their space out to a private commercial they care then it becomes a commercial daycare and some of the daycare that's here are we are we doing a religious component to it or is it part of the commercial tumbleweeds well in mom on the distinction is less about having a religious component versus is it being run and operated by the church versus is there a third-party commercial for-profit enterprise that's running and that's the distinction is that what we're doing is that what we're discussing today that's what this would allow if the church wanted to operate a daycare through the church they could do that but in this case the the potential is a third-party commercial private daycare operating there that's what they would need the special use for and one other thing I'd like to say you know this is a highly litigated area I mean when you tell churches if they can't do something get often it's not often not all the time but frequently you'll find case law that comes out of that but it's almost always where you're excluding a religious practice there is a West Texas case Castle Hills First Baptist versus the City of Castle Hills and in that case the court explicitly rejected a claim by the Church of the financial cost and convenience and their frustration of not getting to do what they want with their property as a proper claim under this act so you have to look at it in terms of what it does protect as well as it what it doesn't protect there's a number of cases that say we can apply and apply different zoning to religious institutions it's just when we're doing that in such a manner that it prohibits the exercise of religion that it becomes a problem okay do I have further
[1:12:00] public comment my name is Don Payne I've lived across Kenwood street from the church for I lived across Kenwood street from the church for 29 years I will say that we all try to live together in the neighborhood the church is a part of the neighborhood and the church now its activities are a part of the neighborhood in the past though the folks and I can attest to this the things that the church does has an impact on the neighborhood the noise the traffic that sort of thing I did not respond in opposition to this because I wanted to know more about it the gentleman's apologies notwithstanding the fact is there's been no community outreach even though that's a catch-all word that likes to folks like to use when they're asking for things like this there's been no outreach from the church to the neighborhood to let us know exactly what they want to do here and so what this comes down to this isn't simply the staff put it the crux of it is that they want to bring a commercial enterprise in it's not simply the app it also comes down to deposit the way this is written it's the possibility of additional commercial enterprises and the gentleman's argument seems to come down to well somebody else got to do it so the church should have to get to do it too and that's not really a reasonable argument the fact I think what the argument comes down to is how much is enough in a residential neighborhood and how much is too much in a residential neighborhood and where does it stop I have a separate garage and a separate
[1:14:06] driveway on my property which is 50 feet across the street from the church I'm under the same voting restrictions do I can I come to the council and asked to use my property for a competing Enterprise and am I going to be granted especially Eustace because somebody else got it we're looking at imposing traffic problems there's been no traffic study done we're looking at imposing traffic problems in a neighborhood where we already have traffic problems because it's at some times because of the use that that River Terrace across the street is using okay I need you to wrap up your comments it's a good those those problems tend to last for about an hour two at a time here we're talking about an enterprise that's going to be coming down with 300 students and operations to go in different classes at all lots of different times beginning from early in the morning going until late at night that's not compatible with used with use in an in a neighborhood and I asked yesterday at the Planning Commission that they might consider tabling this so that we could discuss with the church more about the impact on the community and what we could do about it can we come to some sort of an accommodation I'm still asking for that but if I can't get some information about about this from the church and and some reasonable limitations easy to wrap it up please some reasonable limitation is that my vote would be no and I'd ask the council to consider what I've talked about this morning any further public comment please come forward I my name is Joyce mcLaughlin and I own the property that's right next door to dawn and we are directly across the skin wood street from the church and our driveway backs up to there to exit driveway on that side of the church we that fit that house has been our family
[1:16:11] and since it was built in 1928 we have seen that neighborhood go from residential to many blocks of the church to including the River Terrace and we've all lived with it at that time we also only have to cross the street for a while on Washington Drive I didn't send in an opposition letter because I thought the Planning Commission we would have a chance to find out what was going on it was unclear from the wording that we got in the letter from the Planning Commission what kind of use was going to be made of the property but in my mind this drops a commercial enterprise smack in the middle of our residential neighborhood that you would not do that you would not approve otherwise because it's commercial it's a residential neighborhood if they could do this two blocks down by buying some houses they you you wouldn't have to approve this and it is not conducive to sustaining a good residential flow people walk around there all the time they walk down to the park and I just feel like this was rushed we didn't get a have not had an opportunity to work with the church on it and living directly across from the facility if it's going to have kids daycare basically eight - eight seven - six whatever those that's all day long that's quantitatively and qualitatively different from what the church does on Sundays maybe on Wednesday nights when they're there for a while or what the River Terrace does and we would be in opposition unless there's some way to change the accommodations thank you very much thank you further public comment hello my name is Sarah
[1:18:12] I live at 33 10 Cumberland Drive my daughter is a gymnast at Texas tumbleweeds in our current location we are already in a residential area and we have a much smaller parking lot than what would be available to us at the church and we do not have a traffic issue yes occasionally we have to wait a moment while car pulls out of the parking lot well somebody else is coming in but it's not an issue and it's one in which the drivers all there understand the situation and work together it's not impacted the neighborhood as far as I can tell an additional the building already exists with a large parking lot and a gym facility inside to me that says that the intention was always to have a large facility in Nilo keishon what we're proposing would not increase traffic all day long as the residents have stated the daycare would be operational but people are not picking up and dropping off children all day it would happen in the morning and in the evenings after work additionally the 300 students that take gymnastics are not all showing up at the same time as Lana already stated we're talking about less than 40 students at any given time spread out throughout the week throughout multiple sessions through the day so we're not talking about a huge influx of traffic coming in all at once our gymnasts are working very hard and all of them are hoping to feed up into the central program which is competitive at state every year but yet we travel to multiple gyms throughout the state and often times we are left understanding that our facilities are well below what the standards are for many of the gymnasts in our area this would allow our gymnasts to work at a facility that provides them with the space and the facility to really hone their craft and become the class gymnast that our city has come to expect from its gymnasts so I would ask this the council to approve the
[1:20:13] resolution so that we can move forward and improve all areas thank you for their public comment my name is Ashley Panter I live at 5302 Briarwood Drive I currently have a five-year-old in seven year old that attends Santa Rita we transfer into Santa Rita and there are a lot of children that have to have after-school programs as Santa Rita Learning Center is picked up from there there's also concho Valley gymnastics they have a bus that come and pick up students if Texas tumbleweeds did decide to have an after-school program that would really help with the Santa Rita students also in question with your Bible studies we do have a pastor that is one of our coaches our children do devotion everyday on if they are on the team also it is my understanding that the daycare would go underneath the Abeka curriculum which is also Christian based so it would be flowed in with the church I'm also a concerned parent because this day and age you cannot send your child out and just ride your bike like I did until the Sun went down as a parent you have to pay for your child to do something in order for them to do anything at all otherwise they're just sitting at home bored you they cannot go outside that's just not how it is anymore so having a larger facility and also having an after-school program or a daycare is also going to help parents I know I understand that a lot of residents in this area might not be current parents in this day and age but it is not like it was even when I was growing up I twelve years ago I work for the city of San Angelo work for the Recreation Department we hosted several basketball tournaments at this exact same location and I kept score there so
[1:22:17] it has been in use for this for any type of recreational activities for several years so I am hoping that you guys prove this thank you thank you for being under three minutes John you and address that issue because if the church has been using that audit or that space gymnasium in the past for recreational things such as basketball tournaments why is it now an issue if the tumbleweeds want to start using it the major distinction is that they that it's it for a for-profit commercial use which doesn't have the same basically exemptions as a church would this is one of those cases where we are ordinances in fact and I guess contrary to some of what's been suggested our ordinances actually bend over backwards to allow churches to do things that any for-profit business would not be able to do but by the same token because we allow churches in the middle of neighborhoods like this we still have those distinctions that if a commercial business wants to operate there they don't get those same protections so if I'm Texas tumbleweeds I'm thinking outside the box here so pardon me for a minute but let's say the church doesn't have a lease with Texas tumbleweeds but in fact each student pays the church a fee and then a piece of that fee goes back to the Texas tumbleweeds does that qualify or not qualify again there's some gray area there but I would say that that to me looks like a commercial use of the property one of the things that we often look at is is it a typical Church use on the property so these questions sometimes come up when churches and other cities have created you know a small coffee shop or cafe

[1:28:26] congestion I understand the concerns of increased traffic on Kenwood Drive I have two two things about that the current location of where Texas tumbleweeds is now if that parking lot is full it requires so say my wife wants to take one of our three children to the mom and mean class on a Friday if that parking lots full it forces them to park on the side of the street and then she's required to get children out of a minivan on side of a street that receives a considerable amount of traffic the proposed location at the church I understand the concern with Kenwood Drive though that road only connects to the parking lot so anybody that is dropping off would actually not be driving on Kenwood Drive is it possible to go back in a picture to the front of them would you change that or somebody that one right there too bit one more so this front area of the gym was actually where the drop-off would occur it's in the middle of the property and the parking lot actually butts up against it so anybody dropping off their children would be one protected from the road they wouldn't have to be doing any street parking or anything like that because the parking lot holds about 30 parking spaces if I counted correctly last night and anybody that's doing a drop-off is actually going to be off the street not causing any congestion I looked at a little bit of research for local businesses in the area there's like it was mentioned earlier there is two daycares down the street there's also a deli the deli has about 14 parking spaces and after that it goes to street parking and those daycares have no parking spaces they're all Street drop-off so the concern is increased congestion there is already that there sound like a quick three let's start that timer again said that wasn't three minutes Oh so that congestion is already there on a
[1:30:28] main road there would be no congestion from drop-off since it would already be in a parking lot that exists it's not going to be on the main road there shouldn't be any actual road parking and as far as the Riverview restaurant I looked at the hours and unless the hours online are wrong Riverview restaurants from Monday to Friday is open from 11:00 to 2:00 for the lunch hour and then on Friday from 6:00 to 9:00 and then on Saturday I believe it's lunch hours again and 6:00 to 9:00 as well the only time that that would overlap is for according to Texas tumbleweeds online hours is for an hour at the end of a Friday they closed at 7:00 on Fridays according to their current schedule so the only time that might conflict is during the lunch time which is 10:00 to 10:45 that's the Mommy and Me class on a Friday but they'd be leaving as the lunch hour would be starting so even for that restaurant in the business that's there already there wouldn't be any congestion from this I think that the special department should be approved I think it's a safer place to drop off children I think it's a better use of a facility that's not currently being used for anything other than a couple gym activities such as basketball tournaments and I think that the congestion that's might be experienced by local homeowners is going to be zero to none thank you thank you madam mayor Thank You Johnson further public comment my name is Braxton Gilbert a little bit 35:23 South Oxford good morning morning good morning friends and neighbors and first off I would like to apologize if we have failed to adequately notify and inform you of what we will be doing and hoping to do as a facility our heart in this is not to become a commercial mobile our heart and this is not to build an empire our heart in this is a Stuart a facility that we currently have as a city we have a lot of facilities and we know what it means to be stewards
[1:32:32] of what we have been interested in given and that is all we were trying to do with this building that sits as mr. nahdi just mentioned vacant most of the week we were trying to be stewards of this building and then this opportunity to work with tumbleweeds gymnastics is a benefit to them and having a facility where they can drop off safely their children and to adequately do what they need to do in a benefit not only for our church but for our ministries moving forward as that occurs the cost of the building we free up funds to further serve our community which we have been doing for decades and so with that I want to once again apologize it if we haven't done what we have needed to do as your neighbors thank you thank you for their public comment good morning closer to the market for Neil 810 Royal Oak I've been a member of LifePoint Baptist Church for about six years now and my son three-year-old son Corbin goes to Texas tumbleweeds gymnastics for the past year and a half and when Jay and Zahra approached me about this idea just I just got excited that my think it's to worship the Lord in one building and then go across and do gymnastics and just what a familiar place that would be and I know our church's intentions are true and pure that we just want to help text tumbleweeds out and you know our intentions are not to profit to not to grow the neighborhood to be you know traffic and crazy and all kind of concerns I understand those concerns but the building but Texas tumbleweeds is in now has just it's crowded the kids need more space the the parking situation it's a very small parking lot in this parking lot you see here is more than enough spaces to to handle handle what what will require thank you thank you very much do I have further public comment I'll count to

[1:38:46] see which is the first reading a public hearing of an ordinance approving the abandonment of approximately one hundred five thousand square feet of the East Avenue D public right-of-way generally located between South Oak Street and Russ Street in the Fort Concho addition and John you're on thank you again John James Director of Planning development services as you mentioned this is a proposal to close a portion of Avenue D basically between Oaks and here's Rush Street over here a small portion of Avenue D would remain and that would be coldest act at the end so it's this alley just to the west of Rush Street would be where would the closure would begin before I get off of that I'll mention some of the discussion that you'll hear from the public has to do with concho Fort Concho Elementary which is just to the south of here and then of course the fort itself is in this area this would basically the purpose of this would be to remove an internal road that basically cuts or bisects the fort property itself this is future land use of campus institutional and you can see the zoning there's multiple different residential zoning x' on the property this is just a map of the neighborhood some of the discussions that you'll hear have to do with traffic and neighborhood streets and so this is here for the that discussion later if it comes up just showing the connectivity and I think others may may talk about this but closing that Street we believe doesn't really affect the interconnectivity they're still ways in and out of this neighborhood back here to both for general neighborhood traffic as well as police and fire service and all of that we believe is adequately addressed a few pictures of the area there's looking east here's the subject Street to be closed back west as well we did send out our notices we got
[1:40:52] three in favor zero in opposition from within the area although as you can see most of the area within the 200 feet of the street closure is actually the city property for the fort itself you can see a few properties on either end did get notifications we did get three emails outside of the notification area in opposition as well as non written opposition that we've heard as well that you'll probably hear in the public hearing a rationale for approval we looked at traffic patterns as I mentioned no negative impacts there are multiple ways in and out of the neighborhood and so we don't believe that that would negatively impact there are you in terms of utilities they're not any frontier Suddenlink lines there are some city utilities but with a replant of the area to remove the street those utilities would be placed in an easement so that we would retain an easement along there for those utilities I'll just show this briefly but it may come up later there others may want to speak to this more but our Public Works folks did a traffic impact study for the area I know this is a little hard to read I think you've got it in your packet as well but this shows the the green numbers are the traffic counts with the street open and then the red are if the street were closed how that might impact the traffic counts on those surrounding streets so obviously Avenue D would go to zero it would no longer have traffic so this sort of gives you a sense of how traffic would spread out to those other streets and again in looking at this we believe that it doesn't it doesn't she sort of does spread out that traffic onto multiple different routes so it doesn't overload any one street by closing have a new dean yes Billy the Red Data oh I'm sorry
[1:43:02] and that those traffic counts would then go to the green area is that what you're saying as I understand it the green is the traffic counts so for example here on Avenue D there is on a weekday approximately 769 average daily traffic on the weekend about 562 average if the street were to close you can see here it says that goes to zero there would be no traffic because the street would close and so just as another example on Washington weekday traffic is 467 average daily traffic if you closed Avenue D that would increase to about 530 so a hundred more cars will be driving on Washington versus with the street Oh with Avenue D open or closed thank you as I mentioned staff does recommend approval of closing that portion of the street the Planning Commission also unanimously recommended approval with two conditions one is that the property to be resub divided or basically in this case combined so that the Fort Concho property would all be combined into one property right now it's a bunch of multiple individual Lots but the purpose of that would be to incorporate what is now the public street once it's abandoned it would be incorporated into the overall property and as already mentioned providing a utility easement for those using those existing utilities that'll be happy to answer any questions does counsel have any questions for John my times I'm sorry questions any further questions from Council do I have a motion second there's a motion and a second to approve as presented do I have public comment please come forward state your name your where you live and you have three minutes

Detlef and Jeff bright we've been talking about maybe trying trying to get him to buy some of that land on Highland Street and remaining two homes that that exists on a Washington Drive to maybe eliminate some of this track some of this traffic so these are things that we're looking at from the immerseus point of the
[1:47:11] Mersey same point point of view the only the they're all when you when you do zoning you always have ingress and address the ingress is from Baker Street the address is from Highland Street okay we don't have no other way to get there an immersive vehicle straight shot into the neighboring to the heart of the neighborhood is that Avenue D you closed Avenue D your why is the purpose of closing an Avenue D to accommodate for concho an organization that's that subsidized by the city I mean you're I mean you're talking about bottom line we got a look at it he's cost us money too you know and now we're accommodating for kancho that doesn't bring no funding to Cenac to the city of San Angelo we have to fund this for concho out of the wrong text pers money's okay so I'll hope that you take this into consideration and it's very very important to us this said this request has passed up a City Council three times when I was on the council he was denied every time I hope that you do the same thing thank you for you thank you so much and I understand y'all didn't extend that mail outs farther so we could get opposition's well we could kill it maybe kill this thing but I don't have a games plate thank you very much thank you for the public comment please I'm Peter hiding her I live on Baker Street I've had three daughters that attend four concho elementary including one that currently attends Fort Concho elementary mayor Gunther mr. Thomas Rick Weiss Bob from the Fort bloom Hall mr. bloom all we had a meeting earlier this year where we discussed this and I think the neighborhood pretty much said their opposition to this plan we were told there'd be a traffic study there'd be a
[1:49:14] further meeting there was no further meeting the next we know there's a sign up saying that this is going to be a right-of-way abandonment there were nine letters sent out to notify people if you look at the map of the notification area most of those letters were actually sent out to Fort Concho Rush Street and the and the school the residents didn't get one even though that is the letter of what the city had to do that's not really representing the interests of the residents this school is a magnet school for the city that Drive is used for drop-off and pickup for everybody from the city gifting talented students there all funneled into that school good fuller Air Force Base has students that come to that school asking the fort and Rush Street the skull and none of the residents and now the other people that use that street what their opinions are is not doing justice to the residents of the city as you said this is the fourth time that I recall in the 12 years I've lived in that neighborhood having to come out and having heard about them attempting to close down Avenue D we've already given up other streets to the fort we as residents they're good neighbors of the fort we deal with the fact that every time they fire the cannons every dog in the neighborhood barks the people who work evenings and nights their sleep is disturbed we deal with the fact that every time there's an event at the fort like Christmas at Old Fort Concho we have trouble navigating our streets we understand this is part of having the for in the city we want to be good neighbors of the fort but we ask that the fort reciprocate we have said multiple times don't close Avenue D we ask that they respect our wishes and stop trying to close Avenue D on us thank you very much thank you very much further public comment good morning my name is Fred Dietz I'm a retired police officer I leave at 6:02 Powell Street directly behind a ford console to the east we're blocked in back there by the river
[1:51:19] it's as you can see it curves around Allen goes all the way around Avenue D is the only direc street that goes beside besides a Highland the traffic just congested there we love Fort Concho we're proud to be part of that historic district there and live there but we do not want Fort Concho closed due to the fact that they can't get back there the ambulances and stuff when they had that storm back years ago I had to use out in you need to get back there because all the lines and stuff we're down the electric lines were down I had to get on Avenue D to get to my house but the traffic is terrible if you close a venire D it's gonna make it worse on Highland Street they're already backed up like Danny said on Oak Street it's going back it up further thank you very much thank you do we have someone here to comment on fired police morning counsel good morning Patrick Brodie assistant fire chief for the fire department so uh unfortunately chief Dunne was unable to be here today he's out of town so I think it's best if I just read exactly his words on this issue so closing down Avenue D that runs from the front of the fort in no way will impede the operations of the s'n angel' fire department the street isn't used as a running lane and does not occupy does not have any occupied housing and I save SAF D doesn't use Oak Street to cross the river because the bridge is not rated for a fire truck to support it so our runnin lane this that neighborhood the first district that it responds out of his central fire station and our running Lane is Bryant would run down Bryant and our first major lane is
[1:53:22] Washington to move over this access road and as you can see on the map washington accesses that entire neighborhood pal Parsons Spencer and Avenue C Thank You Tracy Howard with the Seneca Police Department Howard I'll echo his sentiments from a police standpoint we looked at it and we don't think that it'll impact our response to that area thank you guys further public comment hey so excuse the attire fine my name is Michele Malone I actually live in Christo Ville but my family my mom and dad live on Avenue D East Avenue D kind of right here on the corner of pal Avenue D they have tried to close it many times and my dad has been very ill and so if somebody needs to get to my dad's house they've already closed so many roads around Fort Concho sorry I'm kind of nervous too because it's just frustrating and to get to him is very hard to do because you have to go and all these crazy zigzags but if I go straight Oaks straight down Avenue D I'm right there to him same with if the police or the ambulance have to get to him there's been numerous times he fell off the roof they were right there coming down Avenue D not through all the other streets because you do zigzag all around so if they close it Fort Concho uses it I you I go to it every morning every day I'm at my parents house every
[1:55:24] day and so I think it would be detrimental to closing it for all of those people because most of them are elderly people that live in that area and you'll see my grandma lived on Spencer Street and it curves around so you come in and you have to curve around if you use Avenue D you can go straight in to all of that back in the back area and now there were no letters sent in opposition to the people who it concerns those are all businesses and empty buildings and stuff all between about with guess that's Burgess Street all of that over and all of that down that street between Henry flipper and Avenue D that was a straight street and you could get there easily there as well so thank you very much for their public comment morning good morning my name is Tara hiding her I live at 8:20 Baker Street which was back here in this neighborhood where the river winds around I've lived in this neighborhood for 12 years and as my husband Ari told you this is not the first time we've had to come and say please don't shut down one of the major arteries into and out of our neighborhood but one of the things that I really want to say to you guys is that this has been purchased some kind of safety issue for the fort and I was able to obtain the all the numbers from the traffic study as well as the number of incidences made to the fire and police department from January of 2018 through September 5th of this year and I'll tell you there were five calls to all of Avenue D that was it there was only one on the stretch of road that we're talking about and that was a medical call which I happened to have come upon because I live in that neighborhood it was it was an overdose so the idea that this is a safety issue of some kind is
[1:57:29] really laughable because when you look at those traffic study numbers what you're gonna see is the mean speed was less than 20 miles an hour through there and that's when the speed limit was 30 miles an hour the 85th percentile numbers it shows that people were going 24 miles an hour down that street last week the speed limit was reduced down to 20 miles an hour new signs were put up last Tuesday so if we're gonna persist in this being a safety issue there are a lot of steps between where we are and closing this street things like speed bumps increased signage asking for traffic to vision to patrol that more if we feel like that's something that needs to be done haven't the crosswalk attended by someone there is a crosswalk there that was signs up making it where we only park on one side of the street the side that's closest to Fort Concho Elementary there are a lot of steps a lot of steps so persisting that this is some kind of a safety issue it's just ridiculous at this point this is a vanity issue this is a vanity project that's not gonna result in any increased revenue to the city no increase in visitors to the city there is no benefit to this other than to try to make the fort look picture postcard perfect and upset all the neighborhood when we have been good neighbors to Fort Concho thank you thank you further public comment my name is Lucinda Ella is not even 730 Powell Street I believe a zero for over 16 years my question is why does a border for contra want to close area gee that's the only streets that we have in case an emergency missing today today's each day right now we had a tornado or something bad happens Avenue was closed all those people from Southwest over
[1:59:34] everything from they have some children going to Fort Wrangell how they're gonna get into school to get the children out because the board of hokkaido wants to close the road I don't understand that the only slows down the school down down for contra school it was a beautiful school and they build at schools and I mean you know it doesn't make sense they we gave them awkward with a majority gave them of the whole land that poor country was sitting on but it's like the saying goes what I have our once more you know why do they want to do that to us and beside that spirit the only spirit was just to get out of there in a hurry all the people get behind me behind Powell Street such the only Street if there's a lot of rain we won't be able to go to Highland Street I've seen Hydra straight wins ready rains you can go through there and we did the only Street and I just saying I don't this is the first time with 30 times in traffic closer Street down I think that's ridiculous and I hope y'all do not prove it okay thank you thank you morning mayor City Council my name is Leroy Anderson I live on 618 Powell I opposed the closure of Avenue D on one of those 750 cars probably going into a couple times a day I've got a number of concerns Russ treatment ministries has breakfast and lunch and they say they're going to turn that into a cul-de-sac well the same cul-de-sac would have to also serve the people that are dropping off their kids that entire area fills up
[2:01:37] with cars in the morning and you'd have a problem with the drop-off and pickup of children that use that area if those people didn't use Avenue D they would turn add to the mess on Washington now let's say something happened on Washington Street a fire emergency car accident or something like that before school opened or before school closed where would all the people go pick up pick up the kids at that that date that they had arranged to pick up where would they go there's no place Avenue Dean would serve as a backup for Washington residents of Fort Concho utilized Avenue D on a regular basis you can see that from the traffic study we talked about fire and ambulance when we've talked about the tornado incident that happened in 1995 Baker Street all the wires and the telephone poles were broken off so the end of Russ Street where it meets where it meets Baker that intersection was completely down for that tornado I also utilized Avenue D to get into the neighborhood and the reason we could use Avenue D was because there are no houses on it without houses there are no wires and that allowed us to get in and out of that area during that tornado during and after that tornado that came through there all the windows in the house were blown out the doors were blown off it all the shingles on the roof were tore off the tree and a backyard fell down on the garage it was a mess there's no paved parking on the back side of the south side of the fort at the moment that means that Avenue D serves as the parking area for anybody who wants to visit the fort

[2:07:47] emergency wrote that they would take would be Washington Drive no Washington Drive Danny ends at Fort Concho okay that's so that's how much they prepared to make her come here and make a recommendation to this board for Washington Drive does not go into the for country neighborhood it Didion's right there Fort Concho school thank you so much thank you for their public comment good morning my name is Kathy Keene and I'm the chair current chair of the Fort Concho museum board and on behalf of the current board and all of those before us we want to thank you for this opportunity today is the 91st birthday of Fort Concho so it seems appropriate they were talking about this but we're excited to be at this point because we have the opportunity to complete a goal that was set in the 1967 master plan for the fort which was to close all the interior streets of the fort sight the San Angelo has historic national wine mark ranks among the oldest continual preservation projects in the United States beginning in 1920 and is one of the top tier historic sites related to our national heritage there's only 2,500 such designations in the entire country and we're proud that we have one of them right here in San Angelo as one of the city's top stores and matrac shion's the Fort Concho averages 60,000 visitors a year 200 from the Texas communities all 50 states in 20 foreign countries and is one of the premier sites along the 50 year old Texas heritage tourism trails so without a doubt we are one of the best preserved forts west of the Mississippi we say that continuously and it's all thanks to the vision and the tireless efforts of City Council's city staff volunteers and board members so we humbly ask for your support in the abandonment of Avenue D and to help us restore the significance of the the Fort
[2:09:53] Concho in the history of our nation thank you for their public comment yes sir I'm breaking my rules I just want everybody to understand I understand I broke the rules and allowing you and allowed Danny to speak twice and I very much appreciate that I wrote a very long letter I emailed it to my councilmember Thomas I won't recap it all because it it was extensive and I just kind of abbreviated my notes here one of the things that the fort keeps saying is they want to preserve the fort as it was one of the comments that was made by carl white at the august 19th meeting for the Planning Commission was that they want to return the original grounds of the fort to the fort the original grounds of the fort were very expansive including a number of houses where residents currently live all right have we've already returned a bunch of roads they're asking returned another Road at what point does that stop I'd also like to cite the Alamo the Alamo Street which runs in front of the Alamo is actually the site of a historic battlefield were Santana Masters forces for assaulting the fort right now we're the western wall of the Alamo was is in Ripley's Believe not museum but nobody's over in San Antonio saying we need to obliterate the Menger hotel obliterate Riverwalk mall obliterate all of these buildings and businesses that are there to return the Alamo to its original state but that seems to me what Fort Concho is asking us to do with our fort thank you thank you I'm gonna open up and ask one last please come forward yeah I don't want to cut anybody off I just didn't see you standing up before my name is Waylon Cooksey I live on 726 Baker Street somewhat property backs up to the river I have an unique perspective on this issue because I am also on the Fort Concho Board so I'm a resident of the

[2:16:06] can happen for pickup and drop off pickup I come from the south side of oaks and come up and I avoid going down Avenue Hg or hyper because it is so congested in so many cars that pickup will park on the street and it's very difficult to navigate down there and then so and I do not go through Washington Drive because typically the traffic is backed up into the intersection at pickup and usually I have to move over to the left side of the lane in order to get past that intersection and I go out down Avenue D and pick up when Avenue D was closed off for a short time I can navigate around and go up to Henry o flipper and wind my way down over to Highland but every single one of these alternatives Avenue H G and Highland and going through Henry o flipper all congregate in that same little corner and all of these people are trying to get into that same little spot to park in order to get their kids and so Avenue D ends up being where I go I feel like it's the safest place for me to get my younger child out of the car in order to walk up to the school and so my concern would be where does all the school try feck go if you closed a vanity because it's already very congested if you drive it three o'clock right there traffic is into the intersection and typically parked along the side of the road on oaks as the line is wound its way around into the intersection and is there now parked on the side of Oaks so that would be my concern with closing Avenue T thank you thank you further public comment or counsel Roger banks vice-chair of the four control board and a member of the
[2:18:08] Fort Concho Foundation Board also and I would just like to hope that you will see the vision for Fort Concho is being a going around for many many years 50 years probably even though this is our 91st birthday we won't require you to sing happy birthday to us today but I would appreciate your support and our future endeavors for for kancho thank you very much further public comment all right we will take a vote all in favor oh s--- you will have a chance to vote what do you want to speak and if I'm if if if you want me to speak what I'm gonna ask is I heard some people up there say that the fort has no economic input for the city so I'd like to have either Bob or Diane come and speak to that Jane could you hold a minute I might have you come forward and talk a bit if if you would just hold on a minute morning Diane baize I'm the vice president of the Convention and Visitors Bureau and the number of 60,000 visitors that do come into this community for our visitors that come to Fort Concho is a a large number now some of those are local folks we don't have the official research on the out-of-town visitors but we know that those numbers are very strong and if you look at those numbers people who overnight into our community and spend the night in the in hotels eat visit the attractions that numbers around a hundred and forty dollars per
[2:20:10] night and so even if you had 20,000 people visit the fort that's a nice economic impact for this community people going into public and private businesses in in San Angelo and so I do know that the four does have a great economic impact for us it also is one of the primary reasons that we have gotten great publicity through true West magazine and being voted one of the top ten Western towns in the United States being number two we worked on that application and so our western heritage is important it's important to the quality of life of the citizens of San Angelo because if not for that a lot of people don't move to communities unless the quality of life is good so that is a that's my comment on that just one other question Dianne what's that number that we would have to pay an additional property tax if we didn't have the visitors initial if not for visitors to San Angelo every San Angel household would have to spend to pay an additional three hundred ninety seven dollars per year in income tax or property taxes Bob would you like to come forward good morning mayor council I'm the suddenly popular site manager for Fort Concho many things have been said in the last hour and I'll try to quickly in three minutes give a few viewpoints on this we do try to be a good neighbor we have worked very closely with the Fort Concho Elementary School in the last 20 years offering our facilities and programs and resources on a regular basis they use our facilities for their school events on a regular basis remind council that part of the land on which the new school building was built was Fort Concho landeta to them for this purpose other
[2:22:14] city staff members have addressed the emergency issues I don't wish to go into that I will talk about the school and a safety issues on Avenue D we understand that if the street is abandoned and removed those cars have to go someplace I would propose and I've worked with the school principal on this that line for drop-off and pickup in the morning and afternoon go down D at the alley turn on rust and form sort of a conga line and drop off in a safe manner and then the cars could go down the alleyway which is still a public way it's gonna accommodate two cars if necessary we're also working closely with Russ Street ministries they are a good neighbor to us and we to them they have plans perhaps in the near future I'm building a large parking parking lot next door and that would be something potentially the sea fort and the school and Russ Street could share lastly we do not have paved parking in the rear of the offices row however we have a sufficient land there that is currently used by many of the parents for the drop-off on Washington and that could continue to be encouraged to be used for that purpose we understand that on building one and building eight which are used for public events the parking which now is on Avenue D could easily shift to the rear of that building accessed from the entranceway which is currently used on Washington Drive I appreciate Diane's comments we would like to think that we are a major asset to the city we try the very best we can to be a good neighbor we think we have been an exceptionally good partner or Fort Concho elementary school and ultimately what we want to do is to make the fort well maybe not picture postcard perfect but I think this is the next great step to making the fort the ultimate acid it can be to the city to
[2:24:17] the school and to the community thank you Shane and or the police or fire do you want to address the issue that Washington cannot be used or it dead-ends so that there is a thought process in terms of of emergency vehicles um originally stated about Washington that is the quickest route into there off of Bryant and yes I do realize that Washington dead ends I had two students my two sons attended Fort Concho Elementary so I have an unusual perspective on this as well I utilized Washington everyday when I picked up my children and there wasn't ever an issue because I left early enough to pick him up and get in line so but professionally speaking Hyland it's a direct route into that neighborhood so is Baker if we're responding in a fire truck that has to slow down at multiple turns Highland is going to be the access point if it is an ambulance more than likely it's going to be Washington because that's the first intersection that we're gonna cross on Bryant so there are multiple ways in and out of this neighborhood does that help answer it does anyone on staff have a question for him all right then let's have Chief of Police Howard venture Howard venture how is that work you're you're speaking for both today from from our perspective I've responded to this neighborhood many times before in the most popular way and straight through Highland or down banker it's it's the easy access for us okay Shan can you add any comment basically we were my department was the
[2:26:26] one that our guys conducted the the traffic study in that area the rent everything that y'all saw on that traffic study with the read was when the street was actually closed for Avenue D that one section was actually closed for a one-week period of time so you can actually see how the traffic during that one we kind of shifted throughout that traffic study so again over time those if the road is closed permanently closed you'll see some of those you'll see some of those numbers shift a little bit different what you're seeing now as people rearrange their traffic patterns in their traffic flow but you did see within this we did see an increase of about four hundred four hundred fifty cars move over to Highland during that time frame that one week but we also but the remaining 300 350 to 400 depending on what day and what what day of the week it was you actually saw them move over to the to Baker go out rushed through servers some of those areas over there is kind of where they started exiting in and moving around and you'll see those numbers kind of move around a little bit over time if you if you decide to to close this section of roadway you'll see those numbers move and the end in the traffic counts the additional cars based on road size and what they are is not a it's not a significant increase to any one of those streets the major congestion on Washington with the school there's not just a whole lot that we can do there we have worked with the school in the past we've created one way down Washington during school hours those type things to try to help that congestion and move those cars through faster theirs without some other drop-off points or like a drop-off Lane things like that to add a lane into the school things like that we're not going to move a whole lot more cars faster down Washington that's just that's kind of where we are on that okay thank you sir did you want to make another comment you must come to I'm sorry but you must

[2:32:38] Thank You mayor Shannon Scott business retention and expansion coordinator for the city as the mayor stated this is for the ratification of a resolution for double-barrel outfitters this particular project was approved by the cosa d c-- board a couple weeks ago at their monthly board meeting so I'd like to start by just giving a quick summary of the nature of the work that they perform so they specialized in the fabrication of hunting and outdoor products as well as metal fencing gates car ports home decor in furniture their expansion plans will include a new 7500 square foot facility that's going to be located at 47 45 South Chadbourne and that will be in councilman Hebert's district again they currently have 13 full-time employees they anticipate hiring at least four but up to 20 additional employees within the next three years those employees having an average salary of $40,000 so with the expansion of the 7,500 square foot building they implant point on investing 750,000 in capital investment so as far as the incentives that we are proposing once that capital investment of the 750,000 is met for that 7,500 square foot building we intend to give them a $50,000 capital investment grant again they must make that investment show that it has been paid paid for before we will give them the $50,000 also as part of this they must retain their current 13 employees and we would provide $1,000 per full-time equivalent for up to the 20 jobs so the total incentive package would be $17,000 for the 50,000 of the capital investment and then $1,000 per FTE up to the 20 jobs so again with all of our projects we do run an economic impact analysis to generate our return on investment and in this particular instance this project would generate 8.3 million in annual economic output over the next ten years as well as 3.4 million in gross annual product
[2:34:42] with a payback period of six point six years and with that I would be happy to answer any questions does counsel have any questions on the presentation approval by Tommy in a second by Lucy any public comment with no public comment we'll take a vote all in favor say aye none opposed motion passes thank you item e consider approving an agreement with a Texas Commission on Environmental Quality for the participation in the Sen sanitary sewer overflow initiative program adopting a sanitary sewer overflow initiative plan and authorizing the city manager to negotiate and execute all related documents good morning mayor council city manager today we'll be talking about sanitary sewer which I'm sure y'all will all enjoy talking about before lunch and it is better before then after I don't know and and we are talking about the overflow from our sewer system so the sanitary sewer overflow initiative is a voluntary program through TCEQ is developed in 2005 the city was previously a part of this program or this initiative and I believe our enrollment in that first round of being in the program in it around the 2015-2016 time period so we did enroll shortly after the program was developed it's intended to assist utilities in developing and implementing plans to reduce their sanitary sewer overflows and one of the main reasons why we want to enroll back in the program when we requested that back in 2017 was that the system would not be subject to a formal enforcement by tcq for most continuing SSO violations as long as the SSOs are addressed by some sort of plan so ultimately these plans allow the utility to focus on corrective actions and preventative maintenance type projects versus when we do have SSO having to pay EPA's penalties yes ma'am
[2:36:47] just let me know so I can acknowledge you but absolutely please um you said initially we were a part of the SSO program and then you're enrolled for 10 years no it's a it's a 10-year program enrollment 18 years up and we're just rolling no our 10 years expired prior to me coming into the office and so our local tcq office made us aware that we were no longer enrolled in the program and so we started asking the questions of what we need to do and next steps to basically enroll ourselves back okay thank you was there any penalty or any I mean governmental issues that we were honest adore unn enrolled and now trying to re-enroll no this I there's not been any sort of issues because it is a voluntary program so in August of 2017 we sent in a notice to our local TCEQ office stating that we wanted or we had the intent to participate in the initiative again April of this year we were made aware so they do have to qualify you and so they did provide us in a letter dated April 5th that we were allowed to enroll back into the program a part of that being that we had to adopt an SSO plan by October 2nd something occurred between these two dates and that was our June 2nd 6-inch rainfall event that event caused us to have a very large SSO into the concho River that y'all are all aware of as a part of that SSO we were issued a violation a formal letter provided to us August early August of this year a part of that violation requires that we also adopt an SSO plan so by adopting the SSO plan we will be meeting two criteria one to participate in the initiative and two as our corrective action for our SSO that occurred at the wastewater treatment
[2:38:50] facility question yes Billy notice of intent to participate we submitted that yes it took two years for them to approve us yes ma'am we're lucky oh really I mean it's hard to get approved to be a part to be dealing with tcq okay so what what the main topic of conversation that I want to have with y'all today is our SSO plan so like I said this will be our corrective action for our wastewater spill out at the reclamation facility from June 2nd as well as our enrollment into the initiative so that we aren't subject to formal enforcement from TCEQ there's two main components I know that there was a sixty page document attached to your background but what I want to focus on today is the corrective actions and interim measures so that's what we can do today and what we're currently doing to prevent SSOs and then the bigger part of this SSO plan is what we plan on doing in the future to keep SSOs from happening so I'll briefly go through the current actions what we do today currently in the ordinance we have a 90 day grease trap pumping or cleaning enforcement and in our ordinance we will continue to enforce that 90 day policy we send out you know basically a first warning second warning type letters so that we make sure that restaurants and those type of facilities that do have grease traps are cleaning them properly and they're not discharging that grease into our sewer system we prioritize rehab and replacement even with their in-house projects with problem areas so obviously where we do have issues with either line backups or collapse pipes we replace those items first and foremost
[2:40:54] we have routine cleaning in problem areas so with some of the clay pipe sewer that we do have some of that is late basically installed at a flat grade than what it is supposed to be so we have sewer moving slower through the lines which tends to cause backups and those type of things so we have routine areas that we go out and clean with our big back contracts this one is a new one but we're going to have a formal document or SS or a standard operating procedure after a large rain event such as June 2nd that we go through and inspect the drawers floodways arroyos particularly the red arroyo we have very large sewer transmission mains running through the red or oil and water can be very destructive as a lot of people know and it can even damage our manhole lids and our manholes even cause cover over the top of the pipe to wash away so we'll be doing inspections following those areas or during those events so that we can make sure that our infrastructure is protected and during the next rainfall event we don't have large amounts of infiltration coming into our system and then updating training and SS SOP procedures for our personnel any questions before I move on to the future Carrie does just what we're talking about the red Arroyo a number of the Greta Roya runs through a number of private lands and so what can the city do to encourage the landowners to clean up their portion of that ready Roya to help us with this most of the area they lease with our sewers or where our sewer system is installed isn't within easement areas or within the areas that the city owns so without any big concerns with private property areas in regards to our sewer system so the bigger Harry you're pointing a finger at
[2:42:59] sorry I like to let it Lance talk to this a little bit because I think there's some opportunity for the city not not specifically for this SSO plan but for for future water quality and I think they're interrelated so Harry there's a it gets very complicated in the red Arroyo area especially if it's in a map floodway you are very limited as to what you can actually do in a map floodplain and flood way you can't have equipment in there moving dirt things like that essentially you can do vegetation removal but that's really the extent of anything that you can do if it is a mapped floodplain and or flood way that didn't clear up the muddy water but keep going okay so regards to our SS OS and what we plan on doing for future commitments to keep these events from happening I will say that for a system our size we do have a these are occurring monthly so they they do happen they just not events large enough like the one into the Contra River from the wastewater plant but at manholes or lift stations those type of things we do have or sewer does leave our system and we do remedy it and notify TCEQ and go through all our proper notification requirements but to keep those events from happening these are the I must say five areas that we we plan on investing our personnel and our money into preventing these the infiltration and inflow monitoring our it's and I we are going to be doing upgrades to our SCADA system and I will say that we've already started on this and made a probably considerable headway on it y'all are aware that we have 52 lift stations in our system prior to about three years ago when a sewer or when that lift station had a failure and an
[2:45:01] overflow was occurring it was there's a light that would go off at the live station and basically someone either seen that light or seen the overflow is how we were notified of that overflow it was not on any sort of online monitoring and we do have people that go and inspect these 52 lift stations but all 52 cannot be seen in one single day by one person and so that was very much a call-in and you go and respond to the failure we have about 20 to 30 of those lift stations today on our SCADA system and skater's just a fancy way of saying that we're able to view it basically remotely we're able to see if the pumps are running we're able to see the level in the wet well or the the basin of where that wastewater is being pumped out of and so we have the ability to monitor them from a remote location and see all of our lift stations in one given place and I will say that even with the 20 or 30 that we have online today it has greatly reduced our SSOs because we'll see a pump running continuously those alarms that send out to us and so we're able to preventative ly go out and check that lift station before it makes its way out of the basin and so what we're doing or part of this is within two years we will have all of our lift stations on this SCADA system and an alarm notification process as I'm was aware or talked about the cleaning issues over here what we're proposing is an increase in our line and inspection or our cleaning and inspection of our sewer lines so currently we TV and inspect about two hundred and forty thousand linear feet 20 thousand feet a month of sewer lines we're proposing to increase that through the 10-year program cycle by 15 percent so that would be roughly 23,000 linear feet monthly asset management and work order system this is something that
[2:47:05] y'all have already approved or the software package has already been approved back in April but today if if I had to know where we had problem areas I go to our most senior water distribution and wastewater collection guys and I'd ask them where do we have problem areas and is that institutional knowledge they'd start rattling off street names but if I didn't have them I it would be through mounds of paperwork of their work orders and those type of things what this asset management system will allow us to do is see I want to see all the SS OS or line cleaning activities that have occurred this past month and it can show me on a map view a chart various ways of seeing how work is being done by our crews and where our issue areas are occurring and that will drive CIP replacement rehab those type of things so it's basically replacing that institutional knowledge that we have with our employees into a database that we can mine data and use and basically report back to tcq where we are dedicating our resources the fourth item is line replacement rehabilitation in accordance with a CIP and a master plan so we already do CIP work with regards or we have projects in the CIP that are dedicated to sewer infrastructure but the last time the wastewater system had a master plan was in 2009 we did obviously we just did one on the specific area of Lake Nazareth E and it provided us that data of what we need to do for the development of that area but system-wide we don't have something that is basically under our population growth that has occurred since 2009 replacement of the lines that we have replaced since that time period so an updated master plan to guide the CIP would be a part of this plan and we do put that we would do that within two
[2:49:08] years this item this item and this item would all be done within two years of enrollment into the initiative so these aren't overnight things we would be bringing these back to Council or not the asset management cuz you've already approved it but the other ones we wouldn't and lastly the Greece program but it's also known as a Fogg program fats oils and grease today we don't have a very extensive ordinance laying out grease traps and how they're to be sized and installed restaurants can expand and those type of things and sometimes grease traps stay the size of when they were a very small business and they have since grown and so this would be an update to the ordinance there is a four year we've proposed in this plan that we would do this within four years I will say that a fog program is or part is required by EPA when we move into a discharge permit so if we proceed with the Contra River Project a fog program requirement will be required at that time so that's why the four-year program implementation is why I put that so it kind of aligns with our controvert project describe that better the fog program basically it would be a grease trap ordinance update today I do know that we have we just require that a developers engineer provide us with the documentation of what they're going to do with their grease or with the grease trap that's to be installed with a new development sometimes we don't have in our ordinance at least a minimum tank size cleaning requirements and those type of things a sampling manhole so that we can see what that industry is putting off in terms of grease so it'd just be an ordinance update and implementation in businesses that what happens basically that is what we would be working through in the four years of
[2:51:13] how basically an audit of what we have today are the grease traps sized adequately for the customers that we do have today but there would probably be some requirements for existing facilities to either upgrade or to have proof that they are sized adequately so that is the bulk of my discussion with that I'm asking for approval for the initiative program involvement as well as the SSO plan yes Billy asked a question Allison I think when you first started you mentioned or did you mention that we got a penalty for our June and we got a Notice of Violation sent to us in August I have not received if we got a monetary fine yet but that tends to come after the violation we don't know what that monetary that our local office provides us with the Notice of Violation the headquarters in Austin would provide us with the penalty portion of it even though that incident could not have I mean it was a mother nature incident so yes they realized that we was still subject to fines by the state all right further comments or questions for Alison all right so do what do you need from do we need a motion today yes ma'am do I have a motion I'm Harry do I have a second second by Lane any public comment with none we'll take a vote all in favor say aye aye none opposed mota motion passed the 7-0 all right on item f we will have to take a record vote I had a Memphis second public hearing of an ordinance of the city of San Angelo

[2:57:25] I have oh yes on Thompson single-member district - I vote yes Mary Thomas single-member district three I vote yes Lisa Gonzales single-member district for a vote yes Elaine Carter single-member district five I vote yes I do wit single-member district six I vote yes in the Gunther mayor I vote yes we're gonna have an update on the sales tax revenue performance Tina thank you mayor sales tax for the month of September was up twelve point two four percent compared with the same month in the prior year and we are over budget for revenue by almost 1.5 million dollars for this year and here's your sales tax by industry for the month of August as well thank you yes all right any questions or comments on that all right we'll move on to item I which is discussion and Direction allocating funding for Public Safety and streets thank you Mary you'll recall that we discussed this item in a previous meeting and we said that we would bring it back to you for direction on carrying over the funds to accomplish the public safety equipment needs that we have so again we have the same basically the same funding sources but we do have a change to one of them we were informed by our consultant that helps us apply for the uncompensated care cost reimbursement unfortunately the state did have a two billion dollar settlement with healthcare industry settlement and so it greatly decreased the amount that every single one of the applicable fire departments and/or ambulance services received from the state as a reimbursement it brought ours down to two hundred and eighty nine thousand dollars from five hundred seventy six thousand dollars so this line here is is less than what it was in the previous discussion what we
[2:59:29] did on the expense side to accommodate for that oh I don't know what just happened sorry about that okay what we did on the expense side of the equation was to eliminate the second ambulance for fiscal year 2020 and speaking with chief done he still felt strongly that the fire station alerting system was more important at this time and he'd prefer to fund that before an additional ambulance okay do I have questions for Tina I have one Tina could you say a little bit more about I guess there was some liability or something that was paid out and still that meant we got less yes I explained that a little the uncompensated care reimbursement is is governed under HHS C the Health and Human Services apparently at the state level they had a settlement in the amount of two billion dollars and so in order to make their finances work and their liabilities show correctly they were they had to find the funding and so this this was one of the programs that was cut in order to fund that settlement he didn't have anything to do with the city other than to decrease the amount we received all right do I have a motion to approve Tina's presentation for Public Safety and streets or no you're not I'm not supposed to talk yet no no you yes ma'am I don't know if we wanted to talk about this all the same at the same time but the reason that I'm asking for direction on funding allocations is so that we can just carry these amounts over automatically into next year's budget without having to come back to council and so it with formal action I would be able to do that and so we can either approve these funding allocations separately or we can talk about the sales tax surplus revenue and do it all at once that's up to you mayor well I'd like to do them separately honestly so I'd like one to be on the public safety issue and then unlike a second one on the street issue I want those voted on
[3:01:32] separately please so do I have a motion to approve the funding uses as presented for public safety move by Harry in a second by Lane any public comment with no public comment we'll take a vote all in favor say aye not opposed it passes and now we will take a motion to on the sales tax surplus to for sales tax generated revenue of 1 million four hundred sixty-eight thousand four and forty four in excess of the fiscal year 2019 budget and we have in the past had a discussion public discussion on using those sales tax surplus dollars in towards Street infrastructure so we need a motion to direct that money to be put towards Street infrastructure may may I make a suggestion mayor I'm if you wouldn't if it supports what I just said yes ma'am I would never opposed that I would recommend that we carry over the funds if that's what we if the council directs us to do that we'll go ahead and carry them over into the next budget cycle automatically and then we would ask that Shane and his staff bring backup proposal for the use of that it would be directed toward shank Elton is my point we would carry it over through the street and bridge accounts yes ma'am and then and then I would recommend that he bring back the proposal for how the funds will be used to move by Tommy second by Lucy any public comment with no public comment we'll take a vote all in favor aye not opposed sales tax surplus has been approved to go towards shank Elton's Department for Street and Bridge carryover all right then we are going to move to item J consider proving a fiscal year 2020 Fort Concho building repair plan and provide direction for allocating funding methods and Bob I believe you're on without Doris and Carl white anybody else good morning again mayor council we were instructed to put
[3:03:40] together a slightly more aggressive and longer range plan with shorter timeframes to fix all the things that need fixing and what you will have before you in the slides will be the funding and schedule approach for that alturas has created the cost figures and F have worked out where the money should come from and as you will be hearing on the next item we will probably be having money to carry over for fiscal 19 so all of this will be eventually initiated in fiscal 21 my supposed to punch here to put the slides up battery could be dead by now all of us have gotten a good workout today let's try that up okay wrong way okay opening slide we do have many buildings and needs of repairs and you all know the issues that all of us are facing on staff and the repairs in question are mostly exterior windows columns fascia sidings trim pointing that's the masonry porches and cublas good next slide we have done phase one and that by shopping that project around to local contractors we got what we thought was a good deal and we got what we thought was a very good performance phase two unfortunately will be blade and it's councils discretion if you want to hear it now or hear it on the next item go ahead and put that it ties together so okay my my agent mr. wise says I should do this now we bid out phase two together all these individual projects hospital number six and eight and the cupid is those of the air vents thinking we might get more attention better bits better service sounds like a pizza commercial it didn't work we got two bids one bid from a competent know locals one from Missouri
[3:05:46] one from DFW the first bid was technically disbarred they're honest about it but why they it is beyond me but that we couldn't consider and the second was approximately three times the amount of money we had budgeted and it's back to the drawing board so al and I and staff will be shopping these projects out individually encouraging local contractors to knock them off one on time the hospital will probably have to be bid out that is the biggest one of the business so you want to comment on that it's good morning council mayor al Torres construction manager I have contacted local contractors that I worked with to get the original estimates and they they've already reaffirmed that they're willing to back those estimates that they've given me and give me quotes to get these jobs done individually they because of time frames the size of the job the way we bid it they didn't bid it locally but I'm still confident that we can get these jobs done for the prices that we've estimated I've already got oq6 we had asked for quotes before they've all confirmed that they're still good with their quotes so we're gonna move forward with oq6 immediately we're gonna we send out oq8 today so it would be right on the heels like Bob said the hospital will still gonna have to rebid it but as an individual building and like I said I'm confident that we can still get these all done for them for the prices that we were we're looking at I would also point out that staff is as much as we are able with our other duties are tackling minor issues we just redid the entire floor and barrack six that restore and damage looks terrific we replaced all the exterior signs we nibble at the columns as best we can we're going to start those and more aggressive fashion in the near future and as we move into fiscal twenty and we see how we're doing on the columns we may or may not bid those out
[3:07:50] who'll just see where we are but by taking a one project at a time stair step approach we can watch the money watch the budget and as al says I think we'll get better service and hopefully we'll get local contractors it was most disappointing we didn't get anyone local but I think what it tells us is we need to make these more bite-sized that's an architectural term okay eat the elephant one bite at a time are you saying I'm sorry second I said do you eat an elephant one bite at a time it's been known to or Fort Concho we have a lot of bites we understand okay questions from Council or comments either okay so you we need a motion on this one more slide okay that shows the final funding system for fiscal 20 so it'll cost what's been already allocated for fiscal 19 the shortage and then your bottom three where that would come from with a little float watch it project-by-project month by month is presented would that motion also include the direction to carry those funds over into fiscal year 20 the direction should be the new that we take the appropriate funding methods to take care of the shortage is there a second a second by Tommy any public comment take a vote all in favor say aye any opposed but none opposed passes 7 0 thank you okay which is consider rejecting all bids for FC o 2-1 nine repairs to Fort Concho post hospital officers quarters six and eight and roof vents as noted previously only two bids
