[0:24:03] importance of this and relevance to applying for grants yes that's one of the biggest things about doing the master plan when it's a complete inventory of all the facilities and programs that we do it also have includes a public survey where the public engage with us and let us know what's important to them in terms of facilities and programs that's a big part of it but a second part of it is that with this plan we can put it on file with TPWD Texas Parks and Wildlife Department and be eligible and competitive for grant applications which we've done since I've been here in 2000 and we've gotten over I think two and a half million dollars for the grants that was the next question I was gonna have how much of a return we will have with a $70,000 investment a lot of those are like Kirby Park receives we got multiple trail grants as we do trail projects whether they're on the river or other places so we really leverage that but we're not eligible to apply for those grants if we don't have this in place voting access grant that we got from middle console park okay what was that that was the information I was wanting out there I'll move to approve any public comment no public comment we'll take a vote all in favor of approving item II say I opposed motion passes 7-0 we will move on to item F consider proving by board contract number 5 - 1 - 1 6 from rush medium-duty truck Center Dallas Texas in the amount of one hundred and sixty seven thousand eight hundred sixty nine budgeted in fiscal year 2019 for the purchase of a sewer closed circuit digital camera van and authorizing the city manager to execute any related documents Lance Lance Overstreet water utilities was there any specific questions that you guys had on this particular item I asked for this to be pulled all I wanted to do was to make sure that the people that are watching today have the opportunity to understand why we need this particularly unit so if you briefly explain to that Lancer

[0:26:04] absolutely so so what the camera van actually when we have a leak in a sewer system we have a stop in a sewer system or there's other problems we can actually insert this camera into a manhole and actually then drive it down the pipe and it actually has the ability to to lift up above the flow lines and actually inspect the pipes for problems and so we utilize this stuff on a daily basis this is actually replacing the current camera van the current camera van the van itself was purchased in 2008 that van has reached its design service life we're having a lot of repairs on that van the camera system was actually predated the van so when we bought the van in 2008 we took that camera system put it into the van and then updated a couple of the items but a lot of the that system actually predates the 2008 and so as you guys can imagine as far as technology we're looking at something that's 15 years old that we're trying to keep going and so the new camera actually has a longer reach that it can go into the system it has the ability to maneuver and raise itself up out of the flow line which the existing one doesn't and so it's both replacing the van that's having problems and the fact that we can no longer get two parts for the camera system that we were utilizing in that van appreciate the information move to approve as presented a second a second from Billy any public comment with no public comment we will take a vote all in favor say aye with none opposed motion passes 7 0 we will move on to item I consider awarding our FB F s - Oh 8 - 1 9 electric cars - Jim Basford incorporated in San Angelo Texas and the amount of fifty five thousand two hundred dollars for the purchase of two units budgeted in fiscal year 2019 and authorizing the city manager to execute any related documents hi Ryan morning Council yes a couple of questions why purchase electric vehicles and then

[0:28:08] if you tell me it's a cost savings then what does that anticipate it cost savings please sure I will not tell you it's a cost savings I think that in between applications we could find some benefits but the cost will be extremely similar to what we would buy in a gasoline vehicle and I say that because when we look at published records from other entities that have pursued electric vehicles they do see some differences but depending on the budget line so for example maintenance costs are lower fuel costs the gasoline costs are obviously non-existent but there are other additional costs like electricity and some other things that electric cars have so in our application one of the reasons that we're pursuing two vehicles now is because we think we have really good fits for them that we really want to discover can we apply this situation to multiple applications within the city to reduce our greenhouse emissions to reduce our fuel consumption and therefore save some money do we know that it's a cost savings no we don't that's why we want to buy these to apply them and see what we're going to do but as as compared to a gasoline powered vehicle I think we're going to see the same result I think we're gonna see a wash so electric versus gas in our application I don't think we'll see a savings at this point now maybe we will and that's the great part about investigating this however if we bought a gasoline-powered vehicle in these applications we would have some other issues operating budget issues for some of the departments that don't have that usage by multiple divisions such as our City Hall location that don't already have maintenance budgets so we think that the logistical aspects of all of these things will help us provide transportation for the people that need it as at the same time being no cost difference than a gasoline powered vehicle I noticed in the background information that one of the vehicles will be at City Hall and one will be at the annex so who will be using using the

[0:30:12] vehicles so at the annex location Peg funds through our Public Information Office is purchasing this vehicle so it'll be for use by them and Anthony could speak better to that at the city hall location we have multiple divisions that will be utilizing that vehicle right now we don't have a vehicle assigned to City Hall location to be used by multiple divisions we have one vehicle that's assigned to planning and in the GIS department and that vehicle is very aged and they need to replace it that's what kind of started this interest but there are multiple divisions in that location that have been driving their personal vehicle so we hope we'll see greater utilization by some of those divisions that haven't had access before so there it will be available to multiple divisions there you mentioned peg funds would be used to purchase this so the money is not coming out of the general fund it's coming from peg tell me a little bit about peg to peg funds well I can't do so Councilwoman is you know the public information office receives monies from our local cable provider and those monies can only be used for capital expenses that relate to directly putting content on our government access channel and so under the law this is a permitted use of these funds the reason that I proposed this to Ryan and we talked about it is because Brian and I have to use our own personal vehicles whenever we have to go on some assignment some shooting assignment here in town and so we were looking at the potential of purchasing a vehicle but my operating budget is very very slim I think I have about sixteen thousand dollars in discretionary spending each year and I did not have enough within that operating fund in order to purchase fuel and so I was looking for a vehicle that would use no fuel Ryan tells me the maintenance cost on an electric car will be somewhere in the neighborhood of I believe eight hundred dollars a year that I can absorb within

[0:32:15] my budget but otherwise we wouldn't be able to to purchase a vehicle and we would have to continue using our own personal vehicles now you mentioned about general funds so peg is actually a part of the general fund but it is a designated revenue source that can only be used for that one purpose there are no tax dollars involved with the purchase of this vehicle for public information thank you so much I appreciate that is a further question no any would you like to make a motion to approve item else had questions I moved to approve item I any public comment Steve Hampton Council I I'm grateful I appreciate what Ryan has said about explaining exactly how you got into this and and why I think that's great I think I don't understand why wasn't kind of in the information before also apparently there is a fleet and how much of the fleet are we replacing apparently we have two cars and we're going to get two more or we one possibly is almost down the background information on all of these items F through is is kind of lacking not telling us how much fleet you have and what is the percentage of replacement and the same way with the the equipment NF so if if you could get them to give us a little more information I don't think we're asking to too much intrusive information it would it would clarify things they might not have to go through all this yes but it allows you an opportunity to come

[0:34:16] forward and ask questions now well thank you very much are there further public comments Anna good morning everyone morning outsole this is Anna Berta he says that he has 16,000 in his discretionary so he couldn't afford a fuel ok this electric car will be plugged in we the taxpayers will be paying for that and what is the cost of electrifying a car as opposed to buying gas for the car I don't know that ratio but that would be interesting to know what the fuel costs so to speak afford an electric car would be as opposed to to a combustion engine Thank You Anthony so mr. Kramer's research indicates that the cost of powering this car will be about I think it was $200 per year ryan and fortunately an $200 per year $200 per year and so fortunately my colleague in the water utilities department allison Strube has agreed to pay that cost since it will be plugged in over at the annex I think she feels like we give them at least $200 worth of service each year to the water fund and so there'll be no tax dollars used in the payment of the the charging at least for the car that will be over at the annex that's $200 a year not a month a year just to be specific yes bill Anthony one other question for you did understand you correctly earlier when you said currently you use your own vehicle that is correct your vehicle is not a part of a fleet that is correct and so the public information office has no vehicles in the fleet and so this

[0:36:19] will be our first and only vehicle in the fleet thank you any further questions for Ryan or for Anthony with no further public comment we will take a vote all in favor say aye with not opposed motion passes 7 0 we will move into item M consider a resolution authorizing a special event known as quote devoted one's car club car show and approving variances to city ordinances at Spring Creek Park for August's or 2019 Carl you're on there are a couple of car show events that have been occurring at Lake Nazareth II parks for the last handful years this is one of them and they approached the city when they turned in their special event application and requested some variances from the ordinances to host their event to make some of their activities legal particularly like driving parking on the grass noise ordinance so that's what this is I'm gonna start with Tommy if you go ahead okay you're they are requesting to waive the parking and the noise displacement of tents using the carts mostly parking on the grass and waving of the noise ordinance okay so Theresa I have a question for you I think for you if if we waive the noise ordinance does that mean I'm the biggest volume generator in the world they can use that and not being violation of anything that's correct if we waive the noise ordinance there's no enforceability of those provisions for this event now one thing I noticed in their application is that we're currently waiving it from 12 p.m. Friday to 8 p.m. Saturday my understanding is the event is only on Saturday is that correct so you could modify this to only waive the noise ordinance from during the time of the

[0:38:21] event which would be I think 12 p.m. on Saturday until 8 p.m. on Saturday so it would limit that duration and there would be no overnight hours where that would be a waiver I don't think that's a good idea to waive the the noise in my opinion I don't think that's a good idea to waive the noise ordinance period I'm going to no I don't want to assume I'll ask have we ever had problems with noise complaints of any of these events in the past honestly not to my knowledge not to say there haven't been complaints I haven't heard back on them okay we have come forward state your name please my name is Oswald Martinez I'm a devoted one's car club member and yes we did we had numbers of problems last year when we hosted our our car show picnic our legs nice words we had tons of tons of problems what happens to appear with the same police officer that just kept hounding us threatened to take our DJ to to jail parking ticket being issued left and right I mean we got people that come in from from out of San Angelo that come in to sent to San Angelo that bring that bring revenue to the city of San Angelo and to cook to go right back home to you know with issued citations for parking I mean we just had limited parking the music you know we provide loud you know we provide live entertainment a different type of music for just anybody that wants to come out and and enjoy a free picnic family fun event you know it's pretty much fun in the Sun it doesn't cost you know it you know anything that we provide for the community doesn't cost anybody anything you just show up you enjoy some good music take you know you take your barbeque pit canopy and would you just enjoy a really really nice day out there not only is it just a car club picnic but it's also we also have games for the you know for the kids that that you know

[0:40:24] that that you know that show up at our picnic we have games you know for the entire family it's it's a really positive atmosphere but you know we just kept having the same same problem with that same same police officer and you know finally of course I got in contact with chief Carter and he's he sent this his assistant out there that of course Fisher that I believe every time that a call complaint came in he drove out there just to bear with us on the on the on the noise and then about 6 o'clock that you know that the picnic five or six our picnic would be done and over with but I mean we just had had a lot of problems which is the reason why it's been a subject that was brought up this year want to make sure that we're covering covered in all areas obviously the Spring Creek marina there's more open parking you know we're just trying to do something really really special and something that doesn't cost the family a pocketful of my you know to at least have some type of fun you know obviously you know time we have in top any time any type of events take place that calls him cost about twenty bucks a person free one thing that's gonna cost is that the entry at the gate and that's all gonna be revenue for the city of San Angelo did you have a variance on noise last year I sure the only thing we we had believed last year we applied for the DJ you know having the lead you know DJ was in the past we never had any problems until last year were I believe towards towards getting closer towards event we decided to add a live entertainment group out there and and and I think that's you know that's where the the music egg would you know out of which we even had some of the police officers to go out as far as to work callback communicate back before they I can still hear the music turning down a notch I

[0:42:27] mean we we tried to cover each area that we could possibly but we still kept getting you know cause you know left and right it was very unenjoyable for us cuz every time we had to look back guess what finally on tow Frank Carter called his assistant finally got that one certain police officer that was out there finally then at the very end of the event finally he was off our shoulders we're just trying to make sure that we're covered in each area and estimate mayor it sounds to me like there have been issues with noise or they wouldn't be getting complaints I am still not in favor of waiving the noise ordinance for this event because of if I'm not mistaken there has been a sound test out there that didn't go well for for when the test was conducted so I am not in favor of waiting that nor the parking that for me is not an issue the noise I have an issue with Lucy you have a question or comment yes I just want to ask again but what's the time frame it was from 12 till about five five or six and this year it's gonna share we decided to just because we have a lot of events and it was kind of we were kind of just you know I mean it was just so much going on after another so we should we decided to at least do it from 12 until about 12 to about 7 minute ago we said Lisa said to be clear waiver says 8 and can I add something for clarification this is the first time they've come actually asking for a waiver of the ordinances which is why they had so many problems in the past so all of that parking on the grass the noise all of that stuff that happened last year the police was involved in

[0:44:30] that because there was no waiver by council and we suggest that they come this year to get waivers if they want to have that event to avoid a lot of that interaction with the police department Lucy do you have any other question no ma'am that was all may I ask about that we obviously have a an ordinance that does not allow parking on the grass so Carl can you come forward and talk about why we have that ordinance and why one would want to allow it this year or start because once you allow it for one event that basically opens the door for every event being asked to allow to park on the grass so then why have the ordinance so could you speak to that yes the ordinance is in place to protect the park grounds the turf especially if there's an irrigation system not to damage that that doesn't exist at this location but there is there are Park grounds it's a popular place for families and kids to play but we do from time to time with councils authorization asked for waiver waivers of ordinance to allow it to happen so there can be bigger events but we do like to limit that as much as possible just to not damage the grounds and what's the cost of improving the grounds once they're damaged it depends on if there is damage but it may just take some extra watering or some fertilization or filling in ruts if we have to yes Harry is there a waiver when and when we do the boat races because I know everybody parks on the grass out there during that timeframe in the past we have an agreement it was part of the agreement [Music] so the terms are already approved in the agreement and they do they do submit an application for that event as well but their activities are have been approved as part of the agreement in the past so they're allowed to park on the grass then any other event that has been approved for parking on the grass the other car show we did seek approval of parking the grass it's a different car

[0:46:36] show that happens in the fall I think sure there's those I can't think right now but very few okay I think we have another person who would like to speak so if you please come forward state your name please I'm just stating that would you speak into the microphone please just saying that um then always think any beanie louder than the the boats the voters as you can hear like very far away we're not asking for that kind of noise just to where I don't know to where you know whoever comes to our picnic Car Show can hear it we're not asking to be any louder than what we need to be you know it's just the only permission we're asking for is for you know for us not to get by the police coming out there and telling us trying to give that DJ or whoever's responsible for the sound I'd take it last year it's just I miss Dinah be as loud as to where any louder than the boats that you know you can hear from far away yeah I think the difference is that the boats probably are allowed in the morning and don't go into the evening and so there's a difference in terms of the quality of life raised in the afternoon go ahead please the reason we went from where we were at last year into Spring Creek it's to kind of it's kind of far away from the people who live around there well that's we're just trying to cover the Loudoun ordinances it's further away there's not so many houses where we're gonna be having our event this year okay thank you another comment restate your name again please Osvaldo Martinez yes and yes ma'am I so so I spoke to a chief Frank Carter he also recommended that we might the possibilities of us may be located already been to the Spring Creek Marina

[0:48:39] just because they're more there's more open parking and he also did mention that boat races do take place out there like said once again we're not asking to I mean yes we're we're asking for for our loud ordinance waiver but you know we're not trying to have a ridiculously loud loud entertainment out that we're just trying to make it fun to where everybody can enjoy a free picnic games Car Show you know we're just trying to do to where everybody can enjoy to where we don't have to be keep looking over our shoulders worrying about our DJ getting a citation like last year or being being you know told that we're gonna be shut down if we don't listen you know I mean because obviously last year we did there was several calls that came in from the you know from the housing subdivision around Lake Ness worthy so that's the reason we also decided we try to see if we can relocate to Spring Creek Marina to where maybe you know we won't have some so much of a problem which we still plan on following you know we still plan on following the rules and you know staying within the regulations you know however we're just trying to ask you know we're just trying to see if we can get help with that thank you any further public comment on this item Carl wait wake the desert the wakeboard tournament is another one that we we seek variances for it's been going on this way the 20th year okay wait time does like the desert have a DJ and I do play music but and a band no they do play some music so would it be wrong for me to say that the whole issue here is the volume of what it's gonna be and I mean we've from being it's duck show and rodeo grounds we have had car shows out there thanks for they tend as they go on and the day gets later the sound gets louder and we get

[0:50:43] you know complaints from people but we have now been very strict with what we can do sweet sixteens and everything silent I'm just telling you they're still gonna be people call and complain no matter whether we give you a variance or not is there a way to control your volume because I'm that that's gonna be the holy s--t you sit with the board here there's a way to control the volume basically what we're asking for is just you know like we did last year you know wall that we controlled the volume we had a police could put these officers go out as far out as he could okay guys you turn the volume down a little back instill here will there be someone at the event who can monitor and understand I mean most anybody who attends knows when the noise is getting loud so somebody from the organization I think needs to take on the responsibility of controlling the noise so it doesn't constantly require calling a police officer there to monitor we waive the noise ordinance we have no control over this none the police can go at they can they can't enforce anything if we waive the noise ordinance this is not a good idea in my opinion to waive the noise ordinance they've had trouble in the past I think we are asking for trouble if we waive the noise ordinance they can do nothing about it it's got a quick question yes sir so whenever you take whenever you've special events take place down at the river stage that's and that's in the city limits yes sir and there's like bands out there loud music and there's a lot of housing around that area how do I go about that because I'm sure because I'm sure there's a lot of elderly folks that live right around the area there's a nursing homes right around the area and we're just asking for a little bit of leeway out there at Spring Creek

[0:52:45] marina we're gonna follow the rules and we're gonna we're gonna monitor the music we're just asking just if we can get a little bit get a little bit of help in that area other than that I mean let's let Theresa address your statement I'll let Carl address how the river stage noise is handled but again for this process you can limit the time the duration right now it's from Friday at noon till Saturday at 8 p.m. you can limit that time if you wanted to do something about noise but it's gonna be very hard to write anything other than what's already in our noise ordinance to give them a little more leeway but not enough leeway by giving them a variance that's really not the purpose of variance the variance is either to waive it or leave it in place instead of being restrictive as far as the river stage goes of course it's a long-standing venue that has been there a while it abides by the noise ordinance as well so if we receive complaints then we call PD and it is dressed in the same manner girl have we had complaints from the river stage over the years there have been complaints and people responds to those and they tell the organizer of the event or they they'll monitor I mean they'll take out their noise meter and see if it's above or not and if it is then they have to turn it down okay yes Harry do we also have the opportunity to wave other noise ordinances like to blues concerts that's gonna happen next month I mean we wave that it goes beyond that 10 o'clock hour is that correct I go to the Blues concert every year and I can guaranteed they've got great music but it does get a little loud and after dark that noise carries that music carries so when we're talking about water to folks noise rolls across that water all right do I have further questions from Council

[0:54:54] he said we have the opportunity to just amend it to the Saturday or a portion of the event 12:00 to 8:00 all we're asking from is from 12 8 that's we're asking just from 12 8 once 8 o'clock hits we're gonna shut everything off I mean you know it might not even go that long but at least it gives us enough time to pick up and give everybody yells cellphone numbers whenever the calls start to come in all right do we have and can you commit a person's name that will monitor the noise so it doesn't end up being a constant flow of police officers out there yes ma'am well we have we will have security PD out there security you know security and you know that are gonna be you know security secure in the event and we will be getting help from them to help us monitor monitor the noise ma'am yes tom so eventually you did abide by the sound ordinance last year yes sir yes we would it be I mean if you're gonna bye-bye I mean all around town we have to abide by it into stocks on the rodeo we have Carville's we have everything we have to abide by that order yes sir we know where the volume button is yes sir once we get there it says so on this deal I'm I'm with you for having the event I want it when everybody have a good time but I'm not for waiving the ordinance or the variance on the sound I think if you were at it last year you know where you need to be and it's a DJ goes later in the day and everybody gets happier sometimes those things get out of hand oh it's only for an hour later but I don't see the tolerance for that here basically what happened is cuz we had I mean we had a full full sound out there so most of our sound was was turned off and there was only like maybe two speakers operating but you got calls

[0:56:58] no ma'am at that time you like said I mean you could barely hear I mean it was just in order for you to really heard music you have to be like within within walking you know I mean you're talking about the late nights worthy you know you got cars that are out there you know some people some people we had a lot of elderly folks out there showing their nice hot rods I don't want to what you know they don't want have to walk if they don't need to I mean you know obviously when we're gonna do the when we do the awards obviously there will come forward but you know we just want to make make it comfortable to wear you know if you're sitting on the other I'm not saying on the other side of the lake but you know at least in that area music countably may I ask a question Teresa's it relates to the request to change the variance how loud does the current ordinance allow music to be because it's we're asking for a variance on it but how what is loud currently they're what they're asking for and they're not asking for a variance they're asking for the entire ordinance to be waived so that there is no control if they wanted to go up to 120 decibels okay that's fine if they keep it at 80 okay but it don't we if we waive the noise ordinance we have no control that's the statement I need you to say thank you we have no control I can promise you is not a go up to a hundred I mean we know what's we know what's what's reasonable you know and having music out there we're just trying to make sure we're covered in all areas to prevent from having the same issues same problems that we had last year which I don't think we're gonna have the same problems same issues because we're relocating to a different location all right Lucy you have a question yes how often do y'all have this car show do you have it every year once a year yes ma'am okay and how many years have y'all had it is going this going on our fourth annual okay so you know that if you do violate the ordinance then next year

[0:59:01] when you come before us or you want us to participate or give y'all something from the city they will go no we messed up so that's something to keep in mind we're very well aware that mayor I want motion to move us along wait one second I've got one more public comment here if you would please oh and the noise you ask you a question then Theresa if you'll comment okay sir please we're aware if we break the rules and make sure there's no waiver for order we're trying to do we're trying to do this every year if we can with permission and we're just trying not to have any problem next year or fix whatever problem we had last year if you live within the ordinance you won't have a problem right right yeah okay concern with the ordinances it's very subjective it says it's unlawful to continue or caused to be made created or continued any unnecessary loud unusual or prolonged noise which disturbs or is calculated to disturb persons in the mediate vicinity and determining whether such noise is sufficient to constitute a disturbance the court shall consider whether such noise is of such character intensity and duration as to disturb a person of ordinary sensibilities taking into consideration the nature of the neighborhood in which the noise is occurring so there's not like a decibel limit that the police can go out there and just measure the decibel limit and say you're too loud it really is you know a person of average sensibilities determination should we at some point relook at that and attach a decibel to because it is pretty loosey-goosey it's very yes um we can certainly look at that we're looking at this whole ordinance and we can talk about including some decibel limits on that I think that would help going forward and Billie did you have a cut you look like you might have a question you don't all right I think with no more public comment than we're ready for a motion mayor I'd make a motion that we approve this with the variance to be included on the parking but not to grant a variance on the noise ordinance do I have a

[1:01:05] second second clarify that Tommy do you also want to waive the ordinance related to parking on the grass the parking on the grass waive that everything except the noise everything except the noise and are you saying from that on Saturday from 12:00 to 8:00 or because there there was an issue about Friday and Saturday in the back ground the noise ordinance would be applicable the entire time the parking would be parking would be waived whatever the request is in in their submission to the city not just a certain time on Saturday entire the entire event yes it is very subjective all right so we have a motion in a second do we have further public comment we say that yes like the desert and events like that they did get waivers or did they didn't I will ask Carl to come forward again and answer that question yes they have in the past and they recently submitted an application which we're likely bringing to the next meeting what time frame is wake the desert because yes but into the evening because this is the issue about 12:00 to 8:00 right and so the question mark is on that event is that 8:00 in the morning to 2:00 in the afternoon is that 8:00 in the morning to 8:00 in the evening what's the time frame it's it's over a weekend so it's a number of days but they may not be asking for though the variance on the noise though I'll have to verify I think we have to be consistent in terms of variances and we allow one group not a other group I don't think we need to pick and choose groups I think we need to be as a council pretty consistent with our vote in terms of what we do allow have in the past then we're setting up residence there for others to not be able to do it right what did wake the desert or a concert out at Spring Creek has applied for the variance and received it and now we're going to deny

[1:03:09] it we're going back on our presidents or it means we've set a new president and going forward we would no longer allow it it's either/or but I mean it sets a precedent precedent I pull up the one of the prior wake the deserts and they do get variances for the noise ordinance in this one that I'm looking at they have live music well do they have live music be sure they haven't in the past has just been a DJ but I don't think they've don't recall if they played loud music it's mostly more about the activity but they do have some music out there so they have live entertainment I don't think it's alive I think is DJ can we look at the application and see if they've had that before because again I think we need to be somewhat consistent here and what we approve and don't approve yes Harry just for clarification again the Blues concert is coming up next month and I know that we've got a variance presuming that we got a variance for noise because that thing goes to 10:30 or 11 o'clock at night it's to your point I think we have to be consistent and how we do this either we don't allow the the variance or we do what we need to do and allow the variances for these specific occasions that we've got to do that so one way or the other we've got to be consistent and I will tell you loose counts are spent along a long time so if we say that they cannot have the variance for noise this would tell these people we can't have various or annoys then we've got to go back and revisit and we just approve that we've already proved the Blues Festival for this year that was a meeting when one or two meetings ago that was approved 11:30 p.m. it looks like the lake the desert ones that we've approved in the past were to sunset which is also can be widely interpreted but there are

[1:05:11] ways police can figure that out yeah could be nine o'clock I would be in favor of the event on Saturday I wouldn't say maybe all the way till does the event end at 8:00 or is that just when you're looking to even usually like last year the event ended at about 5:00 okay because of all the activities we got going on that's why we decided to kind of extend extend it out I mean we could have the music we can have the music if you can give us we can have the music cut off by seven o'clock I would be in favor of that 12 to 7 all right well wait a minute we've got a motion in a second this is public comment so we're offering comments after we had the whole open conversation with City Council so at this point what we need to do is to address and to vote one way or the other on the motion and then we can introduce a new motion well I guess the no vote would or a yes vote will determine what we do but obviously there's concerns and there's a reason to relook at the ordinance going forward and make sure that it has teeth in it and not subjective perspective but I don't think we can pick and choose groups in terms of music which you can see the concern that each and everybody has so you need to make sure you're very aware and controlling it in your event because it might not be a good vote next time it might not be this time I don't know so we have a motion on the floor and a second we've had public comments so the motion is to have a variance on the parking but not a variance on the noise and with that we'll take a vote all in favor of the motion say aye - in favor opposed nay motion does not pass so does that mean then that we need a new motion on the floor do I have a new motion on the floor

[1:11:22] that there are neighborhoods that help family reunions and they have to go by the rules and so if would you all consider that when you're making your determination of whatever you do and I wanted to say that even on fourth of July I hear in my neighborhood that big blast you know when that song is played and then they have the boom you can hear that all over to where I live and so it doesn't bother me because I know what it's all about and then if you're gonna go about sound and stuff there's another part of our area that has the steel company and I know this might not apply but it has the steel company that makes noise all up in the night and we're still trying to get that checked into so but I I love music and I even hear central band plan and I live very north of that but I hear it and I love music and I love to hear it so please considered there are some people that do like music and thank you for your comments further public comment we have a motion on the floor in a second to allow a variance on the noise from on Saturday from 12 to 7 p.m. and to allow parking on the grass all in favor say aye aye those opposed passes 5-2 now let's talk about the other variances that have been requested on this item those include basically given an exclusive use of this area of the park a placement of tents and canopies on the ground and placement of any kind of

[1:13:26] other structures or vehicles associated with the event the cars or meaning wide car show or what it's part of the car show yes but it could be like a an RV it could be like a little trailer what does it vary what does the ordinance currently state is allowed as part of the resolution with the items of that weren't passed yet that would will they would want to wave is leaving movable structures or special vehicles in the park as part of the event setting a priority on the use of fireplaces picnic tables and benches other than first-come first-serve that's basically exclusive use and permit fees the reason those would be needed normally we don't allow people to set those type of things up in our park for exclusive use serving the entire area so it requires the same thing we do with tents in in the parks where they might be you know sitting something up it drives holes in our sprinkler system those kind of things so we have to have approval to do this so how do we all right so we're now going to allow or a request in to allow tents to be put up and what else they could have like vehicle that they want to park somewhere as well it's it's basically accessory things that go along with the event to make make it happen typical things you would see in those accessory type items the things listed in the ordinance include tents Shack temporary shelter house trailer camp trailer camp wagon or the like is there a way and

[1:15:30] this is a question is there a way to because we've approved use of parking on the grass but some of these vehicles are going to be larger vehicles heavier vehicles and the question mark is do we allow anything to be put on the grass regardless of size etc and Harry you wanted to make a comment or question well again I guess I I'd relate to the boat races that are out there RVs are parked on the grass there are a number of vendors out there that on the grass so I don't see this as being any different and then then the boat races except at a smaller scale than than what we've got out there be in the third or fourth week in June weekend in June so from my perspective I don't see this is any different than what we've done in the past thank you allow that with the stipulation that it's reviewed by the parks department to make sure it's an appropriate location for that it's not going to be damaging some sort of city property Lucy you had it yes Karl what kind of canopies or tents or anything that did they have last year or did they have any last year I don't recall if they did have any last year this year they want some connectivity so it could include inflatable jumping houses so in the application maybe inflatables for years in under application Craig my name is Osvaldo Martinez basically you know the type of tents that we we used last year were just canopies to provide shade of course you know we want to we want to invite those that want to come and camp out you know bring your own RV barbecue pit and just kind of make it a good and good week weekend out of it and you know and it not really cost cost the family or or them participating really anything because all you got to do is basically

[1:17:32] just show up and of course you know pay the permit permit for the lake okay thank you Shane did you have comments or for Carl or somebody Jerry Perry's question it was just there's only one specific area that's limited in Spring Creek area that we that we don't allow vehicle parking and that's where they're wanting this this one and it's more because it's more of a designated play area children area things like that normally during normal Park times in Park hours and so and that was just gonna answer that question versus with the boat races where everybody does Park on the grass and all that stuff those are in typical camping areas most of the time anyway so we allow parking in RVs and things like that in those areas during the normal hours and so I was just gonna clarify that that this one specific area is an area that is designated there's no parking because of those those others but if you grant them exclusive use of this then we're not gonna have to worry about outsiders and other people that are you know using the park coming in there and interfering with this so that was just this one to answer that clear for that um did you have a question or comment I'm good with everything sound part never had a problem with anything the parking at short-term is less than 24 hours it's not gonna tear anything up it's nothing different we see at the Boat Show so no problem with the rest of it it's just the sound brands then do you want to make a motion motion we as presented procedures make a motion to a pretty much presenting okay okay and now we have public comment on this item all right with no public comment we will take out Theresa I want to make one comment just for clarification to the applicant and although this waives the permit fees if a permit is required you will still have to get a permit for any structures large enough to require that okay do we need to include that in the motion no all right with that there'd been no public comment then we'll take a

[1:19:35] vote on favor say aye I was not opposed motion passes 7-0 that wasn't on the regular agenda all right item o consider a resolution and I'll pick in oh sorry I'm sorry might consider approving a memorandum of understanding with the office of the governor outlining the city's responsibilities for the maintenance of the Texas music industry directory Daniel you're on actually what I'd like to do is invite our vice president for the Convention and Visitors Bureau that I'm based to kind of talk about this it's a really exciting deal so I'll let her take this one Thank You city manager I've thank you mayor City Council Diane Bay's vice president Convention and Visitors Bureau under the chamber of commerce as I think most of you know we sought out the film friendly designation and got that a couple of years ago and so the Texas Music Office under the governor's office has now created a music friendly community designation and there are seven cities currently that have that received that designation it's fairly new it's a little more difficult than the film friendly designation one of the things that is required is this MOU that is brought to you to name a liaison to work with the Texas music office in what we're proposing is that you name the Convention and Visitors Bureau as that liaison several other items that also are required is working with a 501 C 3 in in our community so we have been working with Jamie Highsmith with the Cultural Affairs Council as you know they do focus on the arts and so they not only focus on the visual arts but the Performing Arts so we are working with them we've also worked with the Angelo State University music department to talk to them about the educational component that is required for this designation as well as the database the

[1:21:38] database includes capturing the musicians venues educators retailers radio stations and any other entities that are part of the music industry in San Angelo and keeping that database up-to-date through the Texas music office every quarter so that is what it's about once we receive this designation then the music office will come forward to San Angelo to determine the economic impact of the music industry for San Angelo so it's a it's really kind of a win-win for all of us to have them be a part of this organization and in our community and so we're excited about it music industry has been very strong in Saint Angelo even back in the fort days when they'd play music around the campfires but also the great Ernest Hubbs wrote a musical our songs well said Angelo back in 1940 we Phil still think it's swell and so we want to be able to tell the good news about our community through the music industry I'm excited about this opportunity certainly this community is a community that supports the music talent that exists here and many organizations and businesses enjoy putting on live music so I think this is a wonderful step forward to help put San Angel in the spotlight celebrating the talent and the enjoyment of music so I'm excited about mayor I'd move approval was presented okay any public comment no public comment we'll take a vote all in favor say aye nunna most thank you very much Diane thanks Diane all right now we will go to item was consider resolution in opposition to SB 1 1 5 2 and HB 3 5 3 5 regarding telephone cable franchise fee steena finance and did have questions on this agenda item or the reason I pulled that Tina would you just briefly describe the impact of these bills on

[1:23:43] revenues for the city yes ma'am I'm currently so these the the bills are trying to give cable company companies an opportunity to waive some franchise fees so right now cable company pays franchise fees for both the telephone portion of their operations as well as the television / cable portion of their operations this bill would allow them to choose which one one or the other that they would pay most likely the lower of those two amounts right now the our sole source I believe of cable provider is suddenly canned so right now our budget that we received from Suddenlink is 1.3 million dollars and so this would impact that general fund revenue budget to eliminate either one or the other of those that portion of the franchise fee I'm sure that cities will be represented when these bills are voted on well we have someone from San Angelo I drafted a letter in opposition of the bills in mr. Valenzuela signed it and has sent it to our state legislators and so this resolution resolution would just be a confirmation by the City Council that you also agree with our stance and opposing these bills suppo League also Municipal League is the one that sent out the information to me is the finance director and so I brought it to mr. Valenzuela and we drafted the letter and they do mayor um the attacks in Municipal League does stand up for the cities as well but the city's they also ask the cities do the same and as Tina mentioned we did send a letter to our representatives senator Perry and also Jews office of course Jews have been very very supportive of the city's efforts I will say this that we get very little to funding from the state in the form of some grants so it's this is kind of annoying and hard because we do everything on our end to send money to the state in the form of 6.25% that they received for sales tax revenues and yet they do step in at times and try to do this the franchise fee is a third highest revenue generated for the city and as Tina mentioned a while ago the

[1:25:46] telephone portion that we receive on the franchise fees five hundred seventy one thousand dollars the cable portion is one point three five million dollars if they were given if these if they get the support for these two bills basically what the cable company could say is we're gonna support we don't want to pay the lesser of these two fees which would be the five hundred seventy five one thousand five hundred seventy one thousand dollars that would have a big hit for our budget sonar in we're just telling the state allow us to do what we do this is a franchise fees the proponents for these two bills are saying that there's a double taxation on these cable companies that's not the case at all they are renting our right-of-way they're leasing our right-of-way and they get a benefit from the telephone and also from the cable so in our and we're saying just leave it be this is a fee that we have charged and will continue to charge our biggest concern of course is if this is passed what's next in the next couple of years it's gonna be the electric companies the company who else is gonna come forward and say hey we don't want to pay these franchise fees any longer so that's a big concern the Texas Constitution prohibits the legislature from forcing the city to give away public owned property for less than the fair market value the bills are constitutional because they eliminate value based compensation in other words the compensation would no longer be based on the value of the right-of-way to these companies so again we're just asking our state legislators to allow us to do business the way that we do we ask very little from the state and we just ask them to allow us to continue business the way that we need to do I have any bill you satisfied with that I am thank you and I just certainly wanted the citizens to be aware that we are trying to push back on this sort of thing where to me cities are being penalized by these bills and it it kind of rankles sometimes you know and especially with suddenly who's already in my opinion overcharging folks for their services so you know pay us less franchise fees

[1:27:51] I just am hopeful you know the bills are not successful so with that I will move to approve item okay with that any public comment yes Anthony I received word earlier this week from my peer group for the state that this bill is actually already passed the state Senate so it is now in the Statehouse so if you happen to see our state representative if you might voice your concern to him I think that would be helpful thank you for that update I think or not thanks for putting a damper on our day okay so with that let's take a vote all in favor say aye non opposed motion passes 7 0 item P consider approving an amendment to the contract with Reece Albert incorporated in the amount of sixty four thousand five hundred dollars and 49 cents to be reimbursed by design engineers insurance and authorizing the city manager to execute any related documents morning how my I wrestle first of all can you give us a brief description of what happened here and then secondly why doesn't free are your fries and nickels why don't they pay Reece Albert directly rather than us act as the middle person that pays for it and then trust that fries nickels will reimburse us okay so to answer your first question about what happened basically what happened there was a design error in the plans they were trying to you know basically we have a 3d scenario that's trying to explain in a 2d world so yeah so I'm gonna get into this so basically we had a drainage problem okay

[1:29:54] we had a drainage problem with the guy yes I mean I'll try and do that so basically we had a drainage problem we had a problem where we were going from a typical crown section street to to transition the drainage across the street to the natural flow pattern it's basically we're going back with how it's flowing now and what happened was is over about a hundred and fifty feet we had a transition of about six inches that was hard to see in the plans and so what happened was that we had a birdbath effect we basically had three or four inches of standing water in the street that needed to be corrected so so what Theresa Nichols did is they provided us a new plan to crank that and this that's what these dollars are to fix that problem they went ahead and it really a today entire section of Bell Street they did find a couple of it other errors and gave us new solutions to that all at no cost to the Sydney organ least as far as correcting those errors so as far as paying I mean we we did consider that there is a time frame you know with this and some potential other added costs if we don't move quickly on paying this so that's why we had proposed the city paint being the fronting the money and then Freese and Nichols you know paint reimbursing the city as well you know we have a contract with Reece Albert and we had a contract with Freesat Nichols there was no contract between priests and Nichols and Rhys Albert so as far as those issues go that made that much more seamless as well we do have written confirmation from one of the presidents of or vice

[1:31:55] thousands of Freese and Nichols confirming that they are in agreement with this amount they've reviewed this change order as well they've said you know they said yes we made a mistake and we are going to file this on our professional liability insurance and they will be sending the city a reimbursement check you know Russell I don't want this to sound flippant in any way that if we know the cost why can't Freese and Nichols write the check we deposit it and just hold it until you know we pay Reese Albert why can't they do that it it doesn't take that long to write a check so I guess I'm missing something in what you're describing is the process Greg so I mean they they have to get the check from their insurance company you know I I don't know I'm not sure can I help Mary Russell touched on the core of the answer a while ago when he said we have a contract with Reese a libera salva works for us and so we're altering what we've asked them to do by altering these plans we need that to go forward without delay so that the project is not unnecessarily delayed so we've got to give them direction this new direction and the financial impact of that or the financial side or administrative side of that is we need to amend the contract through this change we need to authorize that somehow through a financial administrative action budget or purchasing or both and those really are the tail the dog is let's get Reese Albert working on the corrected plan as soon as possible you know Michael I certainly understand that but I I guess I just am a little bit uneasy about the city paying for this up front because what if at some point time freeze Nichols says oh you

[1:34:00] know that's not our you know not our problem you have to deal with the city of San Angelo so are we gonna get something certified in writing that they sign in blood that they are going to reimburse us Michael well let's let's take two possibilities one would be let let's say we move this forward what do we want this do we need this correction in the plans yes not the street we open correctly yes and so are we willing to take the risk that we would bear this expense and Russell says we we need this fixed and so if we need this fixed and they promise to pay but then change their minds later on I would imagine that would be an executive session discussion about with our attorney about how to proceed and then we're out of attorneys fees did you know together we do have a contract with this engineer and so their air is covered underneath their contract so we're not like just trusting their word we do have a contract under which it has provisions that's talked about how we can be reimbursed for those types of situations so like Russell said this is the construction end of that which is a different contract we have to get them paid the change order provisions in the law require that we come to you to ask for that change order be approved and then the reimbursement section comes under the end of other contract that's the engineer contract so it's not just you know somebody's word we also have that contract document that we've both agreed to as to how these things are going to be handled do you understand where I'm coming from and I'm not going to beat this horse to death here but I just can't wrap my head around why they can't pay us you know whatever the damage is why they can't write a check to us and then you know we deposit in our account and then we pay you know since we have the contract with the Reece Albert well as far as the timing goes I mean it may ultimately end up happening that way but I mean they they are going through that process of

[1:36:05] getting the check from their insurance company at this point exactly we don't want to hold up the project we don't want to incur any liquidated damages from Reece Albert for holding up the project on these changes there's also other costs of you know traffic and safety that from that aspect you know we want to make sure that you know while this area of construction is still shut down that we're still working in that same area and not having traffic weave in and out of different construction efficiency and the reality is is this company works with us on many projects I don't think they want to try to hurt us or harm us in this process because I mean I understand what you're saying Billy and I get it and I think it's the correct questions to be asking so good mayor I remember what the Avenue P project there was an issue with their design plan on the grading over there that we talked about when we talked about this and so now this has come up again and I just tell you have some concern about that but I certainly do not far be it for me to do anything that will hold up the Belle Street project but I just don't think it takes that long to write a check to the city of cinn Angela Ram John you you're correct you can probably write the check right now and get it over with and done it seems like a lot of process for a simple situation so with that I move to approve item in a second any public comment with no public comment we'll take a vote all in favor say aye motion passes 7 0 would everyone like a break we will take a break hearing in the first reading of an ordinance amending chapter 11 utilities article 11 point oh five water conservation and drought contingency plan by deleting the adoption date from ordinance language

[1:38:08] and Allison you will be presenting today thank you morning mayor city council today I want to give a brief overview of what the concert water conservation and drought contingency plan is and that way you have some context relative to what we're amending in the ordinance but it's reviewed in update at a minimum every five years to adjust our goals and targets for what we want to see in terms of water conservation and usage within our city it it gets revised because there's always new technology and new best management practices that come about and so you incorporate those as well as your historical data into that plan and that's why it needs to be updated every five years this plan is required by tcq and it was also required to be submitted to Texas Water Development Board because of the financial loans that we have borrowed from them so this is what is currently stated in the conservation ordinance is the city of San Angelo water conservation plan dated March 20th 2014 and revised September 4 2014 which is on file at the office of the city clerk and available for public inspection is adopted and incorporated here in so what I would like to change in the ordinance is to this statement so we removed those dates and so when we do amend or adopt a new conservation plan it doesn't require to ordinance our two readings of the ordinance I can simply bring the plant back and y'all can adopt it and so this way if there are changes six months down the road we don't have to go through an ordinance change it gets adopted as you as I present the plan to you so the path forward is we'd like to amend the ordinance as stated previously and then following the second reading of the plant or the ordinance change I'll be bringing the new conservation plan to you for your adoption the 2014 plan will remain in effect until a new plan is adopted so we are not adopting a new plan or changing anything currently

[1:40:11] we're just getting the ordinance ready to bring y'all the the new plan and they set up so with that I'll take any questions I have any questions or comments from Council on Allison's presentation if not then do I have a motion move second do I have public comment with no public comment we will take a vote all in favor say aye any opposed passes 7-0 item B first reading a public hearing of an ordinance amending chapter 8 offenses and nuances new it nuisances it could be that to article 8.1 one outdoor light section eight point one one point zero five light trespass to change the allowable maximum intensity to 0.5 foot candles Theresa ma'am this is actually just a clean up ordinance when this ordinance was first passed it was passed as point zero five foot candles which is a much more restrictive standard than we intended so we're changing it back to what was intended to be 0.5 foot candles and so how bright is that that's a Bob solace question point zero five is actually moonlight [Music] about half a dozen the cases and they've all been over 0.5 so they they match up I think it's that's the standard that we that was recommended by the International dark-sky Association and we kind of stick with that that's the that's the standard if you a point 5s is standard so council way that's written no one could have a porch light is that right the way it's written now no one could of course I will probably hit 4:05 I move to approve is any public comment

[1:42:17] with no public comment we will take a vote all in favor say I would not opposed item B passes 7-0 item C first reading a public hearing of an ordinance approving a street name change for quote King mill drive and Wedgwood Court to King mill circle over the complete length of these street rights-of-way 340 and 345 linear feet respectively John thank you John James Director of Planning and element services this area and you'll see on a future slide but just real quickly this is King Mill Drive and this is Wedgwood Circle they are replanting this area to create a different lot layout and basically they're going to create a circle drive that comes something like this so rather than have to street names they're renaming the one new street as as the one proposed name which is king mill circle this is just another view and showing the future land use and zoning it is neighborhood it's zoned for low-rise multifamily although most of the homes there are single family homes rationale for approval this does make it more clear with the reorientation of the street it avoids future confusion there is only currently one home addressed on the streets that's this one here they did write a letter of opposition that was in your packet basically they don't like the hassle of having to change their street name their street numbered address is not changing but the street name is changing for them from King Mill Drive to King Mill circle part of the reason for that change one question we had was why not just leave it King Mill Drive is the whole name and that would not affect that one property owner that's already addressed that is not consistent with our naming standards for 9-1-1 being a u-shaped circular

[1:44:21] street typically they prefer those to be named circle as the pre fare the suffix for the street type staff does recommend approval as did the Planning Commission unanimously happy to answer any questions there are a couple of conditions basically the developer who's requesting this would be responsible for the cost of the street signs for changing out the street signs for that area I'd be able to answer any questions just one person that's going to have to change all their stationery and all of their envelopes etc which we address all of the rest of these lots are undeveloped that one home is the only currently developed home on those either of those streets so it faces into King mill drive versus over Hill Drive it does I think if we go back to the photo you can see that most of these homes face the over hill but this one was built oriented towards King Mill Drive and so they had the address or they received an address off of King mill Drive do I have questions from Council Tommy John I am assuming to change whatever needs to be changed on there and that cost Falls totally on them even though this is nothing they agree with or requested that's correct I didn't mention one of their concerns is they have a brick house and it has one of those inlaid stone carved things that has their street number and street name and so assuming that they would want to replace that they would bear the cost of that as well as stationary changing the post office the hassle that goes along with all of that do I have other questions from Council enthusiasm for any motion being made on this item I've

[1:46:26] never I've never been a fan of street name changes period any public comment no public comment we will take a vote all in favor of the motion to approve as presented say aye none opposed motion passes 7 0 item D first reading a public hearing of an ordinance approving the abandonment of approximately forty five point six square feet of the North Chadbourne Street public right-of-way located adjacent to 50 north Chadbourne story John thank you again John James director Planning and Development Services you can see here on Chadbourne this is the roosevelt building that's being remodeled you can see in red there a very small sliver of right of way when the right of way was created it was created basically in two pieces in this direction and then later this direction and somehow just that little sliver got left out and so this is cleaning that up you'll see here is just the shape of that little parcel actually I thought we had a map that shows the building the building of the Roosevelt building actually encroaches into this area so this would clean that up for them so that all of the building actually would lie on the private property rather than extending into the right-of-way we did send out our notifications received one in favor from the property owner and no opposition there's been all these strange little things that have happened around this piece of property so in order for them to be able to move forward on development of this project we need to get all these little items addressed and cleaned up else they can't move forward so Tom Harry yes

[1:48:31] any public comment no public comment we'll take a vote all in favor say aye none opposed passes 7-0 item ii first reading and public hearing of an ordinance approving case z19 - oh three a rezoning from the existing general commercial heavy commercial zoning district CG CH and - family residential district RS 2 - general commercial CG on property located at 918 North Chadbourne Street and John thank you you can see the aerial photo here but I think it shows what we're doing better on this map you can see on the future Land Use Plan the entire property is shown for future commercial however the existing zoning splits the property right there and so what they want to do is change the front part from CGC h2 just straight CG zoning but then there's a back part that is currently zoned for two family residential but it's been used as a parking lot for this business so they're just cleaning up the zoning on the property that will allow this whole back parking lot to all be zoned commercial that way if they if they do anything in the future that requires parking then they'll be set those cars that are parked there on that parking lot or is that a building are those cars it's not a residence no because it's zoned residential so just asking correct okay give us an update there you go this is this is the part 11 in it this is the building in question that's up on the street and then the parking lot behind it just pictures of that area looks like it's a little hard to tell here but this

[1:50:36] is that back area and so I don't think that's definitely not a building on that back parking lot it was probably cars parked or something might have been something stored back there but there's no residence on that property staff is supporting this as did the Planning Commission we did not receive there was one in opposition really just concerned about commercial encroaching into the neighborhood however as I mentioned this is already used as the commercial parking lot for that business it's a grandfathered use in the residential zoning and this just cleans that up it's to that extent it's really not an encroachment of any additional new commercial into the neighborhood as I mentioned staff recommends approval as did the Planning Commission be happy to answer any questions I have questions or comments from Council Harry I'm just one opposition letter you know I was a little I guess a little confused on what the individual is trying to say says something about safety concerns and I didn't quite understand that was there any further conversation about during the Planning Commission meeting there was not I don't think that that person they submitted their letter but they did not speak at the meeting that I recall with any more clarification of what they met it wouldn't make it less safe than it currently is by changing this if that was a concern no I mean I suppose you could they could expand on to this property at some point in the future and put more stuff than what's there now with the commercial zoning but it would be difficult to do that for any new expansion because any new expansion is going to trigger a parking requirement which they barely have enough now so they really can't do away with that parking otherwise they would be short of parking if they put more building on the

[1:52:40] space their residential on the lot next to the parking lot I believe there is you can see here that's a house right back behind so that's that would be the adjacent property go back to this one you can see that oh those are all homes and in fact their homes back behind it as well and then homes back this way and so the commercial is you know this is the boundary line basically between the commercial and the residential but again that homeowner right next to it has been living next to this commercial parking lot and if you look on that map of the opposition it was actually some distance away back at the edge of the 200 foot notification it wasn't any of the immediate neighbors okay Harry move to approve any public comment no public comment we'll take a vote all in favor say aye all right none opposed motion passes 7-0 we'll move on to item F wait was it Billy it was the neighborhood grocery store was called new way and then it became a cosmetology school on paperwork says 10th Avenue but it's really 10th Street John you'll make that correction idem F first reading in public hearing of an ordinance for z19 - Oh for a rezoning from the neighborhood commercial CN and single-family residential rs1 zoning districts to the general commercial CG an office commercial Co zoning districts for land generally located between West Houston Hart expressway Howe Street Freeland Avenue and Mills Paul Street comprising a total of seven point zero four acres thank you again John James Director of Planning development services this is a

[1:54:43] request from Angelo Christian ministries this is the church in school here and they basically owned all the property shown on this map in red mostly zoned rs1 and neighborhood commercials so single-family homes they don't have any immediate plans for this but in anticipation of future expansion on to that property either for parking church playgrounds additional school or church buildings they're wanting to go ahead and rezone the property you can see here this the back part is does have a designation of neighborhood and then the front part up against the freeway is transitional so this is the request is fairly consistent with that but you can see here it is all zoned rs1 single-family and so they're proposing the stuff that's labeled transitional those properties would go to general commercial that being the stuff the property is closest to the freeway and then to transition back towards the neighborhood they're stepping that zoning down in their request to office commercial back on that part that is closer to the neighborhood and they own that yes they own all of this property that's to this request I will point out as you'll see in a second that the Planning Commission vote was for two to the two opposition were a little concerned about the commercial going that deep into the neighborhood they were okay with it along the freeway frontage but we're just a little concerned about going back into the neighborhood again the majority vote at the Planning Commission was to approve it as recommended as the church indicated are are they wanting to sell off part of that for development for general commercial or is it wide wide their request I think it's more in terms of their future needs but to have the greatest flexibility in case they did want to sell anything I'm sort

[1:56:45] of speculating for them that does give them the ability to do that if they choose so I don't think that's their plan and there may be someone here that can speak to that from them but I think it is for flexibility for their church Future Church uses future school uses it does also affect they just recently got a variance from the Planning Commission for a sign the current zoning allowed a shorter son than they wanted they had to get a variance to allow the taller son this commercial zoning would have allowed that taller sign so if they want to do additional signage in the future this clears that up for them as well a few pictures of the air you can see it's mostly vacant there is a looks like an old house but it's currently used as a office in maintenance building for the church at that location there's an another church that's nearby this is not related to Angelo Christian ministries but you can see their facility back in the background on this this picture again all of this property is is vacant for the most part there are as you noticed on the map some criss-crossing alleys and roadways they may seek to abandon those in the future if they develop more of a campus in that area but that is not part of the request today we believe this is compatible with the surrounding area it's compatible with our existing plans for the area I'll read through all of these they're in your background information but basically they're it meets all of our conditions for a rezoning we did send out our notifications receive two in favor none in opposition and as I mentioned staff does recommend approval as did the Planning Commission Lane do you have any questions I'll move to the presents okay Lang go ahead move to approve that's presented any public comment with no public comment we'll take a vote all in favor say aye

[1:58:46] all right motion passes 7 0 item G consider ratifying cos'è DC's resolution authorizing the use of sales and use tax funds in an amount not to exceed $200,000 to provide an economic development incentive to SMC global and Michael Looney you're on good morning mayor City Council you're not on Shannon Scott business retention and expansion coordinator for the city of course Michael Learning vice president economic development for the chamber so this is a project that Michael and I had been working together on and as the mayor stated it is regards to ratifying a resolution that the Cosa DC board approved at their March meeting so we will begin by going over some background information for SMC global who is also known as special materials company so what they do there's a specialty chemical supplier with global sourcing and production facilities some of their products include green solvents prosperous derivatives and offal chemicals so what they're wanting to do in this particular instance is lease a vacant facility and I'll let Michael talk a little bit more about that in a moment it's located at 2801 West Loop 306 and what they're wishing to do by leasing this property is to house additional inventory which includes business and personal property so currently they have an 11 employees with an average salary of 60,000 per employee and what they're wishing to do again in addition to leasing this building is invest about 3.3 million in business and personal property at this new location so again what we do when we're presented with the project as we run all of the numbers through our economic impact analysis tool to generate an incentive package but also a return on investment for the incentives that we're proposing for the company so what we've come up in this instance is that they must retain their eleven current employees and then we can offer them up to $200,000 in a property tax

[2:00:49] rebate over the course of five years for the 3.3 million that they invest and that business and personal property so essentially it would break down to about 40,000 per year up to the five years and of course in order to receive that incentive they have to show us the proof that they've invested that 3.3 million in that business and personal property and that they've paid all their taxes so again it's performance-based we don't pay until they perform and again like I said earlier so we run all of our numbers through our economic impact analysis tools so I thought this was good to point out what our return on investment would be in this particular instance so we have a 5.7 million dollar an annual economic output as well as 3.8 million increase in gross annual product with a payback period of 5.8 years and again with that I'd be happy to answer any questions I know Michaels here David Baker with SMC global is here as well so if there's any questions you like to ask us three we'd be happy to answer those that's in the Barry plant or facility right that's been vacant for how many years and how last known tenant was 2008 and it was Bros a kind of a temporary lease where they stored some materials in there but the building was built in 1969 it was updated in 1975 it's approximately 90,000 square feet and has been vacant in fact it was one that some contacts of ours and that the Board of Realtors let us know about when we sent out the alert that we needed about a 80,000 square foot facility to accommodate this expansion smc global was recruited into San Angelo in late 2017 completed it in early seven in early eighteen they came in and leased two facilities one from an you fracturing which is located on Chris dovell Road and one is located on tractor trails the old Westco building so they've taken down approximately 40,000 square feet of real estate and this would now take them up by another approximately 90,000 square feet so the

[2:02:51] company is on the grow they're growing very rapidly and they've had a very good experience in San Angelo and are continuing to continue to grow which is good this facility allows them to pivot if they need to into other products which this company makes all around the world and we're very proud to be presenting this request to you this morning how long is the lease the lease is for five years and it has a couple of option periods behind it okay do I have further questions from Council and Tommy has moved as in a second by Lane any public comment no public comment we will take a vote all in favor say aye motion passes 7 0 we will move into item H consider ratifying Casa DC's resolution authorizing the use of sales and use tax funds in an amount not to exceed $50,000 to provide an economic development incentive to enter tel services and Shannon I'm getting you on first thank you again this is another resolution to consider ratifying for Costa DC's approval for half cent sales tax funds for intertel and again just to give a little background information on what intertel does is they design install and services security systems with their main customers including colleges school districts government agencies private businesses and homeowners so they are currently constructing as you have probably seen if you've driven by their new facility 12,000 square foot building in order to assist with the expansion of their business with an estimated cost of about 2.2 million capital investment 12,000 square foot building is built where and that is over off of North Bryant I know Brady Gilbert is here with intertel as well so just makes everybody knows yes ma'am yes ma'am

[2:04:56] go ahead mmm so again we were running the numbers on this project of course we put it in our economic impact analysis tool to see what kind of incentives we could generate so currently they have 73 employees we're asking that they retain those employees and since the capital investment is already under construction and it's something that's in the works it's not really something we can incentivize for but I did talk to Brady and we agreed on incentivizing for job creation so in conjunction with retaining those employees they're anticipating hiring up to at least three let's see I think there's another slide here we go so they currently have the 73 anticipate hiring three more but up to ten additional employees with a salary of $35,000 an analysis tool is provide 5,000 per employee that was created so they must create a minimum of three but we can incentivize for up to ten so with that said it could be a potential maximum incentive of $50,000 and of course here's the return that was generated so we have 3.2 million in annual economic output 2.1 million in gross annual product as well as a payback period of 1.6 years a really quick turnaround on this one do I have questions from Council move to approve is presenting okay no other okay we got it moving forward pretty fast here motion a second public comment trying to slow it down just a touch here okay then we'll take a vote all in favor say aye aye none opposed motion passes 7 0 well you can ask I thought I saw a look that said I would love to ask 1 what would you like to ask a question now but we're always open to changing our minds when asked to do so wonderful all

[2:07:07] right so let's move on to item I consider amending civic events policies is recommended by the Civic events Advisory Board and Sydney I think you're on maybe they're going to go get him we moved through this pretty fast he might not have thought we could talk so fast well Billy there is time to open and open up that question right now since we're waiting basically this item is coming from the Civic events award and it's looking at as you can tell in the background you talk a little louder and into the microphone we can hear Rick wise so it's talking about some cleanups within our ordinances looking at a variety of items associated with that and so this item comes from the Civic events board whence it gets here he'll kind of go through those but you'll see that it covers a lot of things that are just clarity which Teresa may be able to elaborate on as well concerning our alcohol use hookups a lot of those are clean ups from things that are in there that maybe we don't have the ability to offer it's just clarifying those items and then it talks also good luck so Lee said it's okay he's talking I'm talking so sit we'll get into the details of it but this comes with a recommendation from the Civic events board and he'll go through those details thank you welcome Sydney hello I know we got to talking really fast and motions were flying faster than I could control the audience so sorry I'm gonna try to keep up so we're gonna go ahead and discuss the policies I think that's where we start off first yes sir so of course our so of course our board civic events advisory board we had a

[2:09:11] committee to admit and we discussed all of our policies that we do this yearly and of course we we had a committee and then we went ahead and recommended these changes to our tours our policies I don't know how to press a button so of course we will start off with alcohol we did delete the liquor liability insurance may be purchased through the city's risk management department of course that part of it is actually we still do give the client a chance to bring in their own insurance for this for the facilities but we just do not handle that in-house anymore like we used to the camera hookups we deleted that there are no water connections there are water connections and electrical connections if there's just no sewer connection so we just took that wording out of there and then cap rates for public ticketed events we deleted the word Authority and we added in once the rate isn't as negotiated by the Civic Events Manager they must receive approval from the committee to authorize the cap payment so we've been following that measure for damage and cleaning costs we added clients renting the El Paseo concrete pavilion our farmers market must clean up after the event has ended we've had no issues with this but we just didn't have that that verbage into the into the policies and our all the other facilities already have in the ordinance that they must clean yes ma'am facility discounts all we did was reword it to state to where deviations from this policy must be reviewed and approved by City Council with a recommendation from the Civic events Advisory Board and then for the facility use fee we were trying to take out all the fees from our policy so we did delete the nonprofit organizations will pay a facility use fee of 50 cents ticket or 25 cents that they qualify as multiple date users and then on a facility use fee this is something that

[2:11:15] we did add in their promoters only 10% of the total amount of sold tickets if a promoter comps more than 10% the promoter must pay the facility use fee on each ticket above the 10% threshold the way this does work is that of course it would let's say we sell a thousand tickets or promoter sales a thousand tickets they're able to give out a hundred tickets on top of that you have anything over that hundred tickets and they would have been charged a facility fee for for giving out those tickets a good change and then also for smoking we just added in smoking is allowed in designated areas just to let customers know and then first we go back on that just you wouldn't mind before we move on creating smoking areas how do we address this thing called wind because we get a lot of wind around here so what happens when we create a smoking area and the wind is in the wrong direction and it blows smoke into the audience or will they be far enough away from the normal audience that that wouldn't be an impact have an impact the river stage is actually in a pretty safe area from from wherever everybody else is we try to keep it you know away from from that site from the area plus when we do look at I guess the wind gauge that was something that assistant manager Steve Colin Bach did bring up and discussed too as well so we'll take it case-by-case as we go with the river stage yes Taine's though to the smoking ordinance there it stipulates setbacks from entrances and all those kind of things but it really does not address win because unfortunately if it's in the winter it's blowing from the north if it's from the summer it's from the southwest you know so you can't totally work around that so the ordinance itself I don't believe addresses that okay security we did add in all public ticketed events must provide private security for bags and guest checks and then the probe we did want to add in a

[2:13:17] prohibited items list we do not have we did not have a prohibited items listing like other venues and facilities do have so we wanted to actually put that together so we could have something to show customers our clients that did have a problem with what we were saying you could not bring in some of the items that we did lists or items that we did list and we all can go through this and measure out which ones we don't want alcohol animals bottles cans and beverage containers of any kind costumes firearms flasks inflatable objects laser pointers mace whether it's pepper spray or teargas outside food or beverage pole sticks or rods of any kind seal packages of any kind swords and video cameras when you say sealed packages of any kind so if I bring in a bag of potato chips that's sealed is that allowed it's not because it says already outside food or beverage so when you say sealed packages does that and of course if you say it's a bottle of vodka if it's sealed that is covered under the alcohol element that none of its not allowed so these items these prohibited items are inclusive and all of our facilities yes ma'am for public ticket items to be regulated by the state statutes the governed firearms so there's going to be a little bit of deviation from a straight prohibition on that but we wanted to make the statement that generally as a rule Farms are not included okay yes Billy that's the next part of it so exceptions will be made for those with medical requirements and/or special needs as well and then this is only for all short-term public facility agreements must buy buy the prohibited items list do I have questions for CID on any of his presentations so far Tom like most women I know I'm looking

[2:19:32] spent was three hundred and twenty six thousand with an improvement project savings of approximately about forty seven thousand dollars that we say from those projects so with the savings that we had we looked into other projects that we wanted to have some attention on and currently what we were looking at was items for the book sorry I'm getting ahead of myself so here's pictures from whenever the chiller the old chiller was taken out and we received a new chiller of course the LED lighting for the Coliseum if you haven't been to the Coliseum and seen the LED lighting of course you can set up something with me and come check it out it's definitely something different than what we've had in there of course we got new spotlights we're very excited about our new spotlights and of course our new stage the stage that we did have was the original stage from 1958 so we were glad to get this new we're able to move this one a lot better than what we did with the last one they obviously made product very strong and sturdy to last that many years let's hope this next one lasts that long so the facility improvements so this is what we would like to see done at the Paseo as we did with the Coliseum we did LED lighting replacement we would like to do that as well with the cost of ten thousand nine hundred UV protective netting to protect us from the pigeons we would like to be able to save on the time of cleaning up for our staff and then parking lot maintenance have you've seen the parking lots on the east and west side of Paseo they both need a lot of work done to it so we would like to be able to get that maintenance done as well the total estimated cost was fifty-six thousand eight hundred dollars was the east and west side of Paseo does there need to be painting done on the inside because I think the last time I was in there it looked like there was some significant painting that needed to be done yes we advanced and we can take care of that in in house with the budget that we have currently house for the sorry any
