[0:02:05] know he passed away last week and he has been such a tremendous asset to this city that international lilly pad is one of the items so locations that when realtors bring people in from out of town that's one of the first places that they take them it has brought a lot of international attention to the city of san angelo and his contribution has been terrific we all love fireworks and i'm not sure what we're all going to do for fireworks next year but he's been a tremendous again asset to the city in terms of knowing how safely to do the fireworks show so for everyone out there thank you for your letters of support for ken landon and your concern about what will happen to the lily pad i've had lots of people send me emails or texts asking what the game plan is they're so concerned that the lilly pads will go away and that we won't continue to have them so there is a plan they're not going to go away we know how valuable they are and and they will continue to go forward i've had many people ask questions about whether the delta variant of coronavirus has hit the city i don't have any confirmation one way or the other whether the recent test positive tests that we have or the delta variant but certainly the number of cases has continued to rise and so have the number of hospitalizations and so we just put it out there that we want to make sure everyone's continuing to take caution and and make sure that they're aware that it is aggressively coming back into our community and hope you all are practicing safe measures with that we will open it up for other public comment is there any in the please come forward and state your name as we said in your single member district and you are limited to three minutes thank you very much thank you my name is nelda martin
[0:04:08] allen and i reside at 3017 palo duro i am in mr hebert's district and i come to speak to you this morning on behalf of myself and my daughter leandra and allen over 20 years ago my daughter was on her way back to college station to spend the weekend at her beloved a m where she graduated from college before she went on into the workforce and she was in a horrendous car wreck as a result of that car act she is in a wheelchair and my husband and myself have held to help her navigate the world in a wheelchair and it's not an easy thing to do she resides with me now that my husband has passed at our family home i had the privilege of listening to a presentation by del vasquez about a week and a half ago in which he discussed beautification of san angelo downtown very impressed with his presentation but in that presentation he talked about a ramp that was going to be built to give access at the chaperone street bridge to the river and back up and so i questioned him about it he told me that that was being supervised by a russell pole who is now as i understand it at centurion engineering he had him call me and we discussed it at length now i need to tell you that there's two things to look at when you're doing what they call a slope and the reason for that is because federal ada lines recommendations are not the same as texas whether it's because we have a a governor that's in a wheelchair
[0:06:14] or not texas guidelines are much more stringent than federal guidelines with regard to the slant of a ramp and so we discussed the width of it and the and i said i don't think you've ever tried to do this so i want for you all to imagine today that you have something that weighs 170 pounds or up to 250 or 300 pounds that you're trying to push up an incline it takes a lot of energy to do that more importantly what about when you're coming down we enjoy my daughter and i do going to events here at the city auditorium if you have been there when i am taking her down to the handicapped seating you will see me backing her down the reason is one time i was bumped let loose with my right hand from the wheelchair the slant is enough for centrifugal force to take her away from me and i'm going running after her to catch her i'll need you to wrap up your comments please thank you so what i would like you to do is in the future when you're doing something that involves ada please have someone that's in a wheelchair or actually needs those services on the committee that makes those decisions thank you thank you [Music] is there any further public comment today good morning bob solis neighborhood and
[0:08:17] family services as a cost-saving measure the san angelo has become a training and regional training center for code enforcement continuing education and license renewal we recently held a very successful training session and i'd like to thank some of our guest speakers for sharing their knowledge and their time i'd like to recognize john james director of development services jeff fisher our principal planner uh kathleen dabert assistant city attorney and a shelley pascal for stormwater program administrator they share some key expertise in zoning planning stormwater management legal issues and professional management associated with code enforcement we certainly could not have done it without them so and a special shout out to rudy barrow for organizing this event so thank you thank you bob further public comment please come forward i'm mary casper 3205 country club road i actually do not live in the city but i do pay a whole lot of taxes here especially sales tax from amazon good morning mayor and council members i appreciate this opportunity to talk about the tadburn street ada ramp my first thoughts on hearing about this ramp is it's going to be one heck of a long ramp down along the river given the requirements to be able to push a person up there in a wheelchair with ease the second one was all i could envision was eddie the eagle from the 1988 calgary olympics who competed for britain in the ski jumping i could see him just sliding on down there and taking off and going across the river my third thought was it's going to be a very attractive
[0:10:22] nuisance for every skateboarder in town then i got to wondering why a ramp did the city receive a lot of requests from the wheelchair-bound population for this to get access from the river up to the street level are they not like the rest of us to go ahead and walk from one spot to another get in our car and then drive up to this scoop or or then any of the restaurants that's what i do it's a whole lot easier i've looked at the design it's now four switchbacks well that got my memory my images going and all i could think of was the jamaican bobsled team going on down there and giving snowmageddon i can foresee that if we ever get another snow that's going to have to be blocked off why a ramp here's one in 12 the top 1 in 16 which is comfortable one in 20 which apparently is a texas what i have for all of you is a challenge before you vote on this is supposedly it's not a done deal but then again it might be because you don't want to lose the money part of your job is to go ahead and if it is a bad idea to say no we're going to eat the loss i want all of you to pick a ramp either at bobcat stadium the city auditorium or the um coliseum put a 140 pound person in a wheelchair not a light one from the hospital
[0:12:24] one that somebody uses all the time with the foot rests and everything else and push that person up and down that ramp for a total distance for each of the for this entire ramp and see how easy it is the people that should have been consulted that are the experts in a ramp and how to use them are the people in wheelchairs that's who you should have consulted surely the city has employees that are in wheelchairs and could have been consulted thank you very much for the public comment please come forward uh susie smith 3601 willowbrook pull the microphone down a little bit suzy if it can if not just get on your tip no we'll we'll be okay we'll get it figured out um my thought when um when i found out about the ramp was um you know i just wonder how much i know we have a wonderful ramp there besides the the museum and i have used it a few times when i've gone on the walk for a life for walk along the river which is a wonderful event in in april but i've used it to avoid the steps sometimes but the idea of someone using that on a regular basis to push a wheelchair up in a wheelchair down i just wonder even that ramp how often it's used thank you thank you for the public comment yes come forward i can't see over this podium
[0:14:27] so my apologies if by sawhand good morning council good morning mayor my name is sylvia martinez i live at 818 and my council a man is mr thomas i think i come today because i'm very happy for the houses that you all are letting peo you know people moving these new houses right but i live on san jacinto street and that street is very narrow um there's people that abuse you know they don't let us even get out of our uh uh driveway and um if you're gonna design all these houses and give permits to all these houses why aren't y'all designing a way that us people that have been there 20 or 30 years can get out of their driveway because it's getting ridiculous mayor it is just are you meaning that people are parking in front of your driveway they're parking and their driveways right here and mine's over here okay and then they park and then they should park by right here you know by the curve well they parked like angle and if there's somebody visiting me or the cleaning lady that helps me and then the one and then how they park when another incoming car wants to pass mayor they can't pass through there's going to be an accident so that's why i came and i came because the stop at foster and by reese albert you cannot see we have to go half way to the middle of the street so we can go either to the right or to the left and i'm concerned about that and i'm very proud of the man that brought up the trash thing because it does need looking into and thank you mr thomas for all you do for our side i really do appreciate it thank you sir

[0:18:32] extensions budgeted for purchase in fiscal years twenty twenty one through twenty twenty four and authorizing the city manager to negotiate and execute all related documents alison good morning mayor council i asked for this item to be pulled because on friday we were notified by the low vendor which is tr international trading company that they were no longer able to honor the pricing this was due to the freight cost that has i guess escalated or elevated to a point that they can no longer provide that chemical at that cost so i am asking that we approve or move to the next lowest vendor which is univar solutions usa incorporated and that will bump the annual amount up to hundred 303 fifty dollars so i'd like to amend who we're awarding to and the annual amount um we have contacted univar and they are able to hold their pricing at this time and so that is a secure bed the three hundred three thousand seven hundred fifty dollars from what they communicated on the phone yesterday yes ma'am all right so and that would be for three additional one-year extensions yes uh this is an annual bid so if we do see the market um the chemical market right now especially for for chlorine and caustic we are seeing that those costs are rising rapidly and so we will re-bid if the market stabilizes at the one-year mark okay move approval mayor of univar at the 303 thousand okay i have a motion to have a second second second by tom any public comment with no public comment we'll take a vote all in favor of approving the next lowest bidder say aye aye none oppose motion passes seven zero we will move on to item h and that item is consider a resolution allowing
[0:20:36] the city of san angelo to accept a donation of twenty thousand dollars for applying chips chip seal to allies in the south ridge subdivision patrick uron yes ma'am so this this request came to us from the southridge hoa to do some enhanced maintenance or chip sealing on their alleyway that's not typically a service that the city performs just simply due to a lack of resources all of our streets and maintenance dollars and resources are focused on the street maintenance activities and so alleys are generally received just pothole repairs and routine maintenance like that so in order to facilitate that southridge asked us if they could pay for that service so working with our city attorney's office we found a way that the southridge hoa could donate those funds which allows us to put that in next year's chip seal bed the actual bid so that any uh any bidder or any contractor that wants to come in and perform the service is aware of that and brings in the proper machinery to do that particular that particular service thank you patrick i just wanted to for this to inform the citizens of what was going on when they would see this you know i think that the city was going to go ahead and pay for the services to an alley because i know we would be getting phone calls going why did they get their alleys done and everything so that's mainly what i wanted to to bring up uh so the city's this is not going to be an in-house work it's going to be this will not be an in-house work this will be part of our 2022 chip seal program okay thank you yes ma'am to approve this person okay a second second second by tommy any public comment with no public comment we'll take a vote all in favor say aye aye with none opposed motion passes seven zero that concludes the consent agenda we will move into our regular agenda comments regarding items on the regular agenda may be made by the public when each item is discussed as outlined above
[0:22:38] applicants proponents and appellants are accepted from the time limit above and must limit their remarks to less than five minutes the first item on the regular agenda item a is a presentation and discussing and discussion regarding chapter seven health and sanitation article 7.02 property maintenance section 7.02 0.063 weeds and vegetation of cities code of ordinances patrick good morning again mayor and council i'm patrick ferrick the assistant director of operations um at our last meeting councilman thompson asked us to bring forth a discussion and a presentation about what our right-of-way mowing that the city performs looks like and what we're doing in respect to that so um so the right-of-way maintenance is is dictated by our code of ordinances section 702-063 which bridge which regulates the growth restrictions for weeds and vegetation within the city you see their a1 it basically dictates that anything that's 12 inches or higher is regulated by code and thus must be maintained by the uh the responsible party in that definition there you see it refers to a lot track parcel of land or portion thereof that the critical word there is lot and the definition of a lot in that is not only the property of real property between the property lines that a typical person owns but also the distance between the property line from the property line to the back of the curb if you look there at that definition the property located between the property line and the curb and the property line and one-half width of the alley that's the extent of the responsibility when it refers to this code for a lot owner historically the city has we have a we have a list of areas that
[0:24:42] we mow on an annual basis on a cycle throughout the city in 2017 we looked at our core services our services that we were performing and we found that a lot of the areas that we were maintaining as a department were actually dictated by this code and were the actual responsibility of the adjacent property owner so thus in 2017 working with our city attorney's office she re they reiterated that that definition gave us direction and thus we started a program that systematically removes those respon those areas that we maintained as the city and place those back on the responsible party as per the code of ordinances that was put in place in 1996 by council part of that process the property owner will receive a a notification letter they receive a copy of the cad showing that they do own the property and they also also receive a map that highlights a particular area that we're talking about so if you look at the example there on your screen the area this is kind of a typical what i would call a typical home residential lot in the city you'll see if i can get this to work the this area in between that property line and the back property line is our is the lot ownership the code extends that responsibility to the red line on the front and the red line in at the at the street line so the red line at the bottom is the alleyway that is the alleyway yes ma'am so it extends to half of the alleyway half of the alley so the the property owner on the back side of that would be responsible for the other half of the alleyway so this is a typical scenario obviously most most residential properties will mow all the way out to their curb even though it is right away that's what the way the code dictates what we what was happening is in some places throughout town our crews were going through and mowing that
[0:26:45] particular stretch in front of a home or along the side or in the back of a property so it wasn't being applied the code wasn't being applied equally across town it was being applied just kind of as a as properties came onto our list and there was a number of ways that that happened if there was a one-time request that was just perpetually placed on our mowing list and just never got taken off it was a private lot or a tax lot that was then resold and now it's private property that we can just continue to maintain or it was a sight restriction for vehicles in a in a high rain high growth year and it just again got placed on our list and just never got taken back off so what we started doing like i said in 2017 is systematically removing these properties off of our list we do it in a contiguous area so that everyone in one area is affected at the same time they get the notification 30 days later we come our crews come by and they mow it one more time so that it's in a manageable state for that lot owner then to just maintain moving forward leave that picture up for a minute what i see and what needs clarified is very often you see weeds growing at the base of the curb onto the street so if it's between the street line and the curb line there's a lot of weeds so who's responsible for cleaning those weeds right we also saw direction from the city attorney's office on that particular area as well and it was determined that the city is responsible for that particular area if it's growing between the gutter line and the street and that small crack between the asphalt that's the city's responsibility to maintain i will go on to say that every little bit helps though so if a property owner could we we definitely won't shake our finger at that assistance so this next slide here kind of shows what
[0:28:47] we would call some non-standard examples or the extreme so we saw what a basic example looks like you know the property owner mows to the front of their curb they maintain behind their fence in their alleyway some of these examples like the top picture there on north chadburn street you have a more substantial ditch in front of the home and so in that particular case the code still applies it's still to from the from the roadway to the center of the alley or the back of the lot in this case there's not an alley so it'd be to the back to the owners behind the particular property's property line so in the next case on mimosa and lakeview heroes drive that those properties actually stretch between two right-of-ways or two roadways so in this case they don't have an alley but they do have two adjacent roadways so the way that the code reads it's between the property line and the back of the curb so you have a back of the curb on the front parse portion of the home on the address side and you also have a lot line to the back to the curb on the back side of the property as well along southwest boulevard is another one of those non-standard examples we're all familiar with the wall on southwest so from the wall to the back of the curb is still the responsibility of that adjacent property owner so again those are some non-typical examples that still fall within the definition and that's in the code of ordinances if you look at this map i don't hopefully it's clear but all of the dark gray areas are areas that we have removed from that list just to kind of put it in perspective we sent out over 390 notifications since 2017 letting property owners know that you know the responsibility is going to move from what the city has maintained over to how the code dictates 895 there's 895 particular areas here which is about 126
[0:30:50] acres that we've been able to place back on to the responsible party of the citizens as the code dictates and they've all been notified they've all been notified they've all had that 30-day final final mowing and has since been taken over that responsibility after that 30-day mode and you see in on the picture as well that it's we don't target a particular place in town it it is all over town we do take areas uh remove those areas as we come across them again we work in small bunches of contiguous properties in a contiguous area just so that everyone is affected at the same time so that when a neighbor says well did you send a letter to my neighbor yes we did at that time so everyone along your street is is aware of of the ongoing responsibility so with that i'll be happy to answer anything do you have questions or comments patrick's like the one i'm talking about is on lakeview heroes i mean those people had the property line long before lakeview heroes came there i mean they had no responsibility past their fence line now because of their fence which was there prior to lakeview heroes what you're saying is they do have a responsibility from that fence line to the street as the code reads yes sir okay to make that because that that's been an issue but what you did clarify this you've done one final moment and as long as they keep it to that standard it's okay it's okay some of them have a fence line there that to clear the brush out of the fence line would be pretty labor-intensive clear clearing the brush out of the fence line isn't what we what we were talking about in this in this regard if that's a code enforcement violation that would be taken forward through code what we were talking about is strictly the maintenance activity because we would maintain the brush in the fence line um even as even if it were on our list so we would just be mowing is there an ag exemption like if you go down lakeview heroes like on the south side of that it's all pasture there isn't there is an exemption if there is if the lot itself is over five acres and is undeveloped
[0:32:53] at that point the city is responsible for that maintenance but it has to be even though somebody owns that line even though somebody owns it the way that the code there is an exemption within this code that says if it is over five acres and is undeveloped that the city is still responsible for that maintenance and we do we do apply that appropriately i was not aware of that do you have further questions tom i'm good then you want to make a motion unless somebody else has a comment or do we need to make a money we don't know okay so we're good patrick i thank you for putting that up i've had lots of people call about that i've got lots of i just need people to know they weren't picked on because they were unfortunately in my district but anyway long story short and just association and just to reiterate every single letter that goes out is reviewed by by myself and or if there's a question to we we bring it up to shane city attorneys just to have a good clarification so none of these are done just across the board every one of them is looked at in particular to make sure that the code is applied appropriately for each each property so i've got one final one patrick and it's a thought that just popped up some of these people are elderly and they don't have the facilities or the utilities to go and maintain this and what's brought to me was could they pay the city to maintain that the way it has been and i thought i would have to ask i said but you could probably find somebody privately right commercial that could maintain that as cheaper cheaper and i'd have to verify with with city attorney's office but um at that point i think we would be competing with private industry and as i understand it we're not allowed to i think that gets too complicated i think we have to clear black and white ruling on what we do or don't do right i don't think the city could keep up with today i want it tomorrow i don't this one does that one doesn't that's just too much bookkeeping work and so i think it has to be a clear black and white ordinance that says no we don't hire the private in firm and that is the reason for the 30-day notification to give them substance enough time to find somebody that to
[0:34:55] uh to help them out if they need that that assistance all right cool thank you patrick i'm good okay thank you patrick thank you we'll move on to item b on the regular agenda it's the first reading and public hearing of one and ordinance for cp 21-04 an amendment to the city of san angelo's comprehensive plan changing certain lands from the commercial future land use to the neighborhood center future land use being 20.432 acres located at 5702 melrose avenue and two an ordinance for pd 21-02 a rezoning from the planned development zoning district which allowed general commercial uses on approximately 30 acres to a planned development zoning district to allow for a multi-family housing complex comprised of single-family dwellings on 20.43 two acres located at 5702 melrose avenue john euron thank you john james director of planning and development services as you mentioned this is on melrose just off the freeway in the bluffs neighborhood you can see here currently the future land use designation for that area is commercial the current zoning is also for a planned development but with a base commercial zoning as you know this this property came forward for a multi-family housing development at the time they received a conditional use to allow that within what was the underlying commercial zoning and so now that it's being developed and largely uh in the process of being developed because of some things that i'll mention in a minute we're coming back with this new plan development but at the same time we'll be changing the zoning the that underlying zoning to multi-family uh which again is how it's being developed as we speak we did send out our notices we received one in opposition the concern expressed in that one as you see in your packet was traffic again this is already underdeveloped approvals have already been given
[0:36:59] and so at this point even though you're technically rezoning to a planned development to allow multi-family they already have that multi-family approval from their prior approval but this is kind of cleaning up that zoning but the main purpose as you'll see is to allow them to revise their concept plan and their development plan and address a couple of issues that have come up the main issue here is the fencing in under our zoning ordinances the front yard fence which is adjacent to the street is required to be no taller than four feet in this case this happens to be the backyards of those homes but it is still facing a street and therefore the fences are still limited in height they're also limited in setback and so if they were to push these fences back significantly they could keep the six foot height of fence but if they're going to have it out close to the street it has to be a maximum of four feet went through a whole process where they requested some alternatives and a variance for this kind of thing ultimately was not approved by the planning commission and so this is the compromise this plan development it will allow them to keep that six foot fence as they have desired but it will also have them push that back a little ways some of staff's concern was with a fence being right next to the sidewalk as you can see here and so what they'll be doing is is pushing the fence back to where it's all even and you can see there in this this picture over here how that fence juts back around that utility equipment the new fence will be even with that fence so basically pushing it back seven to ten feet does that mean the utility would be in someone's backyard no that utility box will still be on the street side of the fence it's just the fence that you see there that's right up on the sidewalk that piece will be pushed back so it will reduce aggressively someone's backyard yeah now some of that
[0:39:03] is already uh but the short answer is yes in order to keep the six foot fence they're willing to push that fence back that's seven to ten feet uh here's just a couple more pictures you can see on the left how that fence creates kind of a wall along that sidewalk which doesn't really meet sidewalk standards you you like to have what's called a shy distance where along the sidewalk you've got some space on either side uh you know if someone's pushing a stroller in a wheelchair you don't have that barrier right next to them that's part of the reason for pushing the fence back a little and then on the right there you can see the backyards of those homes even pushing the fence back those will still have fairly substantial backyards for again these are apartments not although they're single-family each unit it's developed as an apartment complex and so for that type of housing these will still be fairly significant sized yards compared to a lot of apartments just a few pictures within the development i'll note that on their concept plan there's some other minor amendments to things like landscaping and sidewalks but again there's been no opposition to that staff is supportive as well just another couple pictures of some of the homes on the property again this is kind of an odd development it's it's a unique development uh that we haven't seen uh before in san angelo but it's it's basically an apartment complex but each home is separate individual stand-alone and these are just the the north side of the concept plan and then the south side of the concept plan with those revisions to the fencing and sidewalks and landscaping um i'm not going to read through all the rationale this is in your staff report but basically this brings this into compliance with our ordinances and where it's not in compliance like with the fencing the plan development specifically allows the alternative that staff worked with the applicant to achieve and this did go to the planning
[0:41:06] commission who approved it your recommended approval unanimously and as i mentioned staff is also recommending approval there are five conditions of approval um and basically that first one is what's allowed in on the property the multi-family housing and including the amenity areas and offices and all of the things related to an apartment complex except as otherwise specified it has to meet the the multi-family housing zoning standards there's some limitations on lighting being in a neighborhood the fencing as i mentioned and then it revokes and replaces that previous conditional use because this plan development basically allows the same thing that did with that i'd be happy to answer any questions just a note here and the applicant is aware of this before we issue the final occupancies within that development they have to complete the moving of that fence back but there are a people living there yeah well yes and those already have certificates of occupancy they're doing it in phases so before the future phases can be completed uh they'll have to move the family the response to this project has been phenomenal and when you say it's use the word odd i think that's an incorrect word it's been a unique project that it's the first in the state of texas it models after a project similar to another state and the response has been phenomenal and i think we have to make sure we have flexibility to address certain issues that are not cut and dry black and white because this has been a wonderfully successful project and i don't think we should allow the commercial zoning to get into the way of this project and what it offers to consumers so i moved to approve as presented yes larry speaker talking about code enforcement if they push back these fences to that distance the responsibility is on the property owner it is now now normally that might become a little problematic
