[0:09:08] consider authorizing the city manager to accept and sign an airport ground lease at 905 8 hangar road for angelo precision aircraft LLC a texas limited liability company DBA precision air craft services jeremy you're on morning mayor good morning council staff thanks for having me we have a lease of precision aircraft we have two leases with them this is the set of T hangars it's just to the be the west of their existing hangar that those are their hangars but it's our ground it's one of a one of the few leases we have where it's a raw land lease we had an existing lease with them the lease expired so we just wrote a new lease it's considered a long term lease it's it is a one three year lease with four three year extensions the rate would be four five thousand seven hundred and sixty four dollars and twenty cents a year that's based on the twelve cents a square foot a year that has been adopted by City Council the rate increase when the four three year extensions come up the rate has re-evaluated every three years based on the adopted fee schedule do I have further questions from City Council I don't Steve does that answer the questions that you had then I move to approve item email all right in a second any public comment now on item E no public comment we will take a vote all in favor of approving item issei I not opposed passes six zero we will now consider resolution approving engineering services policy relating to construction work in the city's right-of-way and authorizing the city engineer to revise the policy as necessary to accomplish the purposes of the policy Russell yes just a quick overview of this it's just a cut bore permit hap

[0:11:09] Kayson that we currently already have it's just you know adopting the policies that we've already had in place in previous years just updating it things of that nature you know there's no fees associated with the permit it's just mostly a tracking mechanism for the franchise utilities and different utility companies working within the right-of-way so that we have points of contact and things of that nature and have and make sure too that they have the adequate insurance to work within the right-of-way what is the revision just as nice ability Craig as it comes up it's just a policy it's just pretty straightforward okay building is there any change in previous policies that we would have had so no man just getting everything current and making sure the language is correct right and basically to give some a hand out to somebody you know if they have questions things that that nature - you know it's a it's an application along with the handout of the written description of what what we're asking for okay with that do I have a motion to approve item K move second any public comment one further comment please Steve Hampton and that is the right-of-way as needed that's pretty pretty out there we can do anything we want to who do we who does this have to be reported to if if there is something necessary any changes made and thank you so would you like to answer that question I'm not sure I understand the question but it is you know basically reporting to the city engineers what what that boils down to is my understanding there's a utility company that has an issue or a request the utility company in this right-of-way

Valenzuela tiersky director finance this budget amendment is to budget for grant revenue and expenditures for bulletproof vests for the police department for the justice justice assistance grants to purchase electronic control devices for the police department and for the hickory water supply engineering design for the final phase we heard this at last council that's Christ yes ma'am I did presenting - yes ma'am do we have all right with that we approve okay second any public comment no public comment we'll take a vote all in favor say aye aye any opposed motion passes 6 0 I better start talking slower we're getting through this okay we will move into regular agenda the first item is consider resolution supporting the designation of an extension of interstate 27 as a future interstate in Texas I will read the proclamation it is whereas Congress has already designated the ports des plaines corridor in Texas

[0:15:17] as a high priority corridor on the national highway system and whereas the Texas Department of Transportation published an initial assessment report on the extension of I 27 ports to Plains corridor in November 2015 which stated the corridor will continue to be a critical link to state national and international trade growing population centers and critical inner energy and agricultural business sectors and whereas according to the Texas freight mobility plan by 2040 over 73 percent of Texas population and eighty-two percent of the state's employment is projected to be located within five miles of an interstate and whereas Texas has no major north-south interstate west of Interstate 35 and whereas the Texas freight mobility plan notes that further investment alone on i-35 will not fix the problem saying quote the state must focus not only on improving existing facilities but also on developing future freight corridors to move products to markets and exports and whereas the Texas freight mobility plan goes on to recommend that text on give additional consideration to the extension or designation of other interstate routes examples include I 27 and upgrades to portions of US highway 192 interstate standards and whereas the proposed extension of interstate 27 connects major West Texas population and economic centers including Amarillo Lubbock Midland Odessa and San Angel in addition to numerous smaller communities and whereas a proposed extension of interstate 27 intersects with interstate 40 interstate 20 and interstate 10 and whereas the proposed extension of interstate 27 will serve three border crossings with Mexico at Laredo Eagle Pass and Del Rio and whereas a proposed extension of interstate 27 will be a major backbone for the energy industry

[0:17:21] in Texas serving top oil and gas producing counties as well as the growing wind energy industry and whereas the proposed extension of interstate 27 will also serve the agricultural industry including many of Texas's top counties for the production of cotton cattle sheep and goats and other commodities and whereas extending interstate 27 in Texas is also a cost of active option the Texas Department of Transportation initial assessment report on the extension of I 27 ports to Plains corridor estimated that it would cost about seven billion to upgrade the nearly 1,000 miles of the port's to Plains corridor from the northern tip of Texas to Laredo to extend interstate 27 approximately 500 miles from Lubbock to Laredo is projected to cost 5.2 billion compare that to the 4.8 billion it cost to rebuild 28 miles section of interstate 35 east from interstate 635 to us Highway 380 in Dallas County and whereas an additional cost saving option is associated with the primary West recently designated interstate 14 which includes a proposed segment that overlaps supports the planned corridor between Midland Odessa and San Angelo presented an opportunity for that segment to be jointly designated as interstate 14 and interstate 27 and whereas a future interstate designation will be a significant new economic development tool for communities along the corridor site selectors for manufacturers warehousing and distribution recommend sites along an interstate highway and travel services businesses such as hotels truck stops convenience stores and restaurants which can have a dramatic impact on small communities will also expand this will create much-needed new jobs and expanded tax base in rural West Texas and whereas while designation as a future interstate

[0:19:24] is a first step in a very long process before the completion of an interstate highway that does not lessen the importance of extending interstate 27 now therefore be it resolved by the City Council of San Angelo Texas section one that the city of San Angelo supports the designation of the extension of interstate 27 as a future interstate by Congress and urges the Texas Department of Transportation to support such designation section two this resolution to be in full force and effect from and after its passage and approval section three if any portion or provision this resolution shall for any reason be held to be invalid or unenforceable the invalid II or in enforceability of such portion or provision shall not affect any of the remaining provisions of this resolution the intention being that the same are severable I ask for a motion by counsel move to approve thank you any public comment on the resolution with no comment on the resolution we will take a vote all in favor say aye aye with none opposed our motion passes to accept the resolution supporting the designation of interstate 27 as a future interstate in Texas item B is the first reading public hearing of an ordinance approving case pd-1 903 a rezoning from single-family residential district rs1 to a planned development PD zoning district on an unaddressed tract located south of the intersection of Merrick Street and Canadian Street to allow for single-family homes to be built covering up to 50% of the lot instead of the normal limit of 40% John thank you John James director playing development services as you read this is rezoning to a plan development as you can see almost

[0:21:29] this entire area around the subject site is single-family residential the applicant initially came in for this undeveloped site which is basically an extension of this subdivision it's basically the last phase the rest of that subdivision as you'll see on a different graphic has developed with homes that take up a greater percentage of the lot than is normally allowed under our zoning ordinance in the past they've done that by getting an individual variance for each lot rather than have them go through that process and get an individual variance for each lot the their initial request was to rezone that to RS 2 which allows a greater lot coverage the RS 2 Zoning also allows duplexes though and as see from the opposition the vast majority of the Opposition was regarding the allowance of duplexes so the they came back to the Planning Commission with this request for a plan development basically keeping it to single family homes only but allowing the 50% what we call a floor area ratio or basically lot coverage it is neighborhood designated in our land use plan it is currently RS 1 again the plan development would basically be RS 1 with the allowance of the additional square footage you can see here all of these Lots in yellow in the adjacent neighborhood are built to 50% lot coverage but again those were achieved through the variance process we did send out our notifications we're saying no opposition received because in contacting all of the opposition I think we had six or eight neighbors opposed their complaint was the opportunity for duplexes now with the PD they're all okay with it as presented here I'm not going to go through all of these but we look in the ordinance at rationale for

[0:23:32] looking at various criteria for approval it does meet all of those criteria it is recommended by staff and was recommended unanimously by the Planning Commission I'd be happy to answer any questions I have any questions from Council no questions for council do I have a motion was presented in a second do I have any public comment no public comment we'll take a vote all in favor of approving item B say aye with not opposed motion passes 6 0 we'll move on to item C which is the first reading a public hearing of an ordinance approving case z19 - OH - a rezoning from the single-family residential district rs1 to the general commercial district C G on four Lots located west of the intersection of La Follette Street and Lowry Avenue John thank you again this is a rezoning you can see the subject tract actually four separate Lots before I get off of this screen you can see there's a few homes up here single family home here mobile home across the street but you'll see a picture of that in a second but largely a lot of this area is vacant you can see here's the Houston Hart freeway LaFollette or lawful we're not sure how to pronounce it is the frontage road and so this is along the freeway frontage road and that plays into our recommendation this zooms out a little bit you can see along the frontage road along this whole side it's in our comprehensive plan as future commercial although as you can see here all of this is currently zoned single-family residential given the the plan used for commercial along the freeway frontage we believe it's appropriate to recommend the request for commercial zoning at this at this side you can see just a

[0:25:35] little bit off there is some office warehouse zoning just down and then as you get closer to Bell Street of course it does become more commercial as well this is a picture of the subject side you can see it is vacant but you can see some of those homes to the rear this is that mobile home that's across the street it looks deserted I believe it is yes hopefully hopefully it is we did send out of notifications we only received one in favor and one in opposition the one opposition was just concerned about property values in crime with commercial since currently most of the area is zoned for single-family homes again our long-term plans are for the freeway frontage to transition to commercial and so this is consistent with that and I've already mentioned some of this rationale based on the comprehensive plan staff does recommend approval as did the Planning Commission unanimously I have questions for John on this item Lucy yeah I just want to make a statement that I went out inspected the residents behind this lot and mr. vaskas had already gone out there and spoken to him and asked him with any problem with it so they didn't everybody was like no we don't problem with him building back there so um that was good to know the other thing was at the lip there was one more house that I was gonna go to but I'm a pit bull had it greeted me yesterday I decided I wasn't gonna take a risk and really find out if that person could that storage or not so I didn't go there but yeah I'm in favor of that inside move to approve as presented any public comment with no public comment we'll take a vote all in favor say aye aye any opposed with none opposed motion passes six zero we will move into item D first reading the public hearing of an ordinance granting to atmos Energy Corporation a Texas and Virginia corporation a franchise to

[0:27:39] construct maintain and operate pipelines and equipment in the city of San Angelo Tom Green County Texas for the transportation delivery sale and distribution of gas in out of and through said city for all purposes all right good morning yes so this item was actually brought before council back in this during this last previous summer to the of 2018 and really nothing has changed the main reason we're bringing it back is because once we got that approved we sent it off to happiness and for their signatures and there was a 60-day window for them to get that completed and that was not done for whatever reason but just to kind of remind everybody what this was about so basically this is an agreement to extend for another 20 years with Atmos some of the highlights points are that Atmos will you know if the city or atmos damages either one's utility the owner of that utility will repair it at no cost to the to the whoever damaged it you know we have trench repair cuts and there as well the trench repairs or basically if they're adding a new service and they cut our street Atmos will come in and repair it to city standards there's a one-year warranty agreement on that where if that trench fails within that one year period Animas will come and repair it at no cost as well whenever said that the city is doing a capital improvement project if we find that their utility is in conflict with our improvements they'll remove that or replace it whatever they have to do to get that out of the way of our capital improvement projects the franchise agreement has a fee in there of it was previously 4% we're increasing that to 5% and that's just kind of a statewide average and what that fee will the expected revenue from that is around $200,000 per year and with that you know

[0:29:46] I recommend approval of this agreement has presented any questions for Russell on this item to prove a lame move to approve is presented seconded by Harry all any public comment no public comment we'll take a vote all in favor say aye okay any opposed motion passes 6 0 item F consider resolution supporting the city's preliminary application for a Texas Department of Transportation for alternative set-aside program grant to improve mobility for non-motorized users to north Chadbourne street from west bogart avenue to houston Hart oh we did well then we'll go back okay item eat consider forget I just said all that other stuff okay so we will consider resolutions supporting an authorizing city staff to submit preliminary grant applications to the Texas Department of Transportation safe routes to schools program to enhance and improve safety in and around school areas and encourage bicycle and pedestrian activity by the construction of sidewalks along Rick's Drive near Holloman Elementary and to Southwest Boulevard near Lamar element and Russell you're on alright good deal so just to remind everybody this we're just basically here asking for approval or your support of the preliminary grant application I'll be going over the scope of each of the projects that we're submitting and the grant applications go and then our recommendation so our first project is the southwest the Southwest Boulevard project we'll be adding new sidewalk on either side of Southwest from twin mountain drive to Dominion Ridge which is basically one block north of the railroad tracks will be adding pedestrian elements at the at the crossing of the railroad track and what that is is basically you know we have

[0:31:49] mast arms that come down whenever a train is coming through the area for for vehicle traffic but we'll also have one for the pedestrians as well just to keep everybody at a safe distance away from the trains we'll also be adding new crossing crosswalks they're close to the school with handicap accessible ramps to get to and from the sidewalk and one thing that this project will be doing is actually we currently have a crossing guard on the north side of the railroad tracks there at Dominion Ridge with having sidewalks on either side that'll we'll be able to eliminate hadn't that need for a crossing guard there because they'll be able to come down either side of south southwest and then come down to a crossing guard near the school there and then cross there are some existing sidewalks in the area where the new developments have come in and brought you know took the sidewalk to the edge of their property line we'll be putting up to that and just making that connection there as well and the estimated construction cost for set the Southwest project is around two hundred and fifty thousand dollars the Rick's Drive project City match required I'll get to that in just a second but no there's no City match report what's the value of potential value of the grant the potential value the grain is one point four five million for both projects but I'll get into it in just a second - we'll wait [Laughter] thank you you wanna see the socks anyway so on Rick's Drive we're gonna be adding new sidewalk in that area as well basically for to connect to Holloman elementary school the sidewalk there is an existing

[0:33:52] dirt path there now along the north side of Rick's Drive will basically be going in the exact same location but going in with a concrete sidewalk with a DA accessible ramps or handicap accessible ramps will actually be connecting this sidewalk to producers park which is across the street from home in elementary school with a cross crosswalk and a little bit of a little bit more sidewalk to actually connect to the sidewalk that's within that park and this project will actually stand from Holloman elementary school all the way over to McGill which is a little over a mile which is a very good project and the estimated construction cost for this is a 1.2 million dollars so the grant scope so again this is a safe routes to school so the main criteria for this is that it needs to be around a school and the schools have to be K through eighth and you know they can either be public or charter schools or things of that nature this project our grant is going to fund a hundred percent of the these projects and that includes design and construction as well so there would be no matching funds required by the city with that I recommend approval of just just having your support to apply for this grant whenever so this grant is actually due in April where the preliminary application is due in April will have to come back in August for a final or more detailed grant application at that point so what we'll be doing in the interim is or what we've already started is contacting the school we had to they have to fill out some survey work to show the need for the the projects in those areas and to support this grant so we've already started that might add Sandra and I met with the superintendent's office and their staff and they were very supportive of the grant of course because it's gonna benefit but they were very helpful also as Russell said there's some components they'll have to help us with with a

[0:35:54] survey that they'll have to do with the students so they're working on that right now in Senate Sandra's coordinating with them see I'm sure you have some comments yes I did this is so wonderful this is something that I've been looking forward to for years so to see this actually come for us today is wonderful I wanted to say that in that little trail that we have that little dirt trail there's a lot of people that jog on there that the citizens out there take their dogs for walks the children walk to school there's just so much of activity that with a sidewalk there it's gonna be very beneficial and it's gonna be safety so first so I'm very much how long we'll find out like you said we're gonna submit again in August great so we my understanding is it would take about a month or two to find out if we got approval on the preliminary application and then once we got that then we would work more on the detailed application and and get that submitted in August and imagine we wouldn't be supportive this is terrific with that said do I have a motion for approval to approve as presented a second by Harry do I have public comment no public comment we will take a vote all in favor say aye I would oppose motion passes 6 0 now for the long awaited okay I consider a resolution supporting the city's preliminary application for a Texas Department of Transportation for alternative set-aside program grant to improve mobility for non-motorized users to north Chadbourne Street from West Bogart Avenue to Houston Hart West 6th Street as part of the North Chadbourne Street project hopefully here with good news hopefully but time will tell obviously as you know phase a for Chadbourne downtown improvement projects is in a design process of Centurion

[0:37:57] planning and design well as we're working on that trying to finalize that to get ready for the July 2020 we now have an opportunity through a similar program Russell presented to go ahead and get phase B started in that process and that is for the streetscape and so as a reminder phase B takes for phase a left leaves off at Beauregard takes it all the way up to sixth Street right there at Houston heart the primary scope of the project is Street improvements and then the streetscape pedestrian improvements as well which is what the grant is for the grant is has a preliminary application process which is due on April 12th is for the non motorized uses bicycles pedestrians to learn and so forth now our total project budget for this project is in the 12 to 13 million dollar based on our preliminary cost opinion but for the application only for the streetscape it's about three million dollars for that what we call Grant eligible portion now that this grant is a t20 match if you remember in phase a we actually applied for 75 25 this time we're going to go for the 80/20 we're not sure if you know city contributing more if it made a difference or not so we feel if we can go to the 80/20 maybe more grant money so with a three million dollar estimate 80% grant that could be about 2.4 million dollars towards streetscape improvements for phase B now the difference in this as opposed to the srts Russell just presented is because we're considered a small urban these funds will not be available until the fiscal year 21 22 by tech stock so we're applying now hopefully have a grant lined up and in a few years actually when phase aids pretty close to being done we hopefully can roll right into phase B elaborate that a little bit on that you know as we were looking at the grant it appeared the funding wasn't available for us in this round we started reading the fine print it basically said if you don't turn it in now then you're not in the priority rankings that they're gonna start for this round in 21 22 so after looking at that we thought okay we if if we're

[0:39:58] interested we really need to turn it in now to get our name in the hopper because they said staff will start prioritizing those projects based on what comes in now so that's why we're coming to you this far in advance because it it really is going to set us up if we want to do it in this next round so obviously as we consider the 1213 million dollar total project cost we have to look at what funding sources we have as a city obviously until we get to the final grant application or the detail grant application in the fall we don't necessarily have to have that full funding plan in place but we started as staff considering what options do we have so obviously if we have the TA set aside grant funds that would be the 2.4 approximately million dollars we do have some remaining allocations I believe it's about one and three-quarter million dollars left over from phase a and on whether you need anything that ifs contingency and phase a so there will probably be some dollars remaining there whatever that amount is and some of the other options would be the tiers north street fund stormwater funds cosa DC funds the hot funds or general funds most of those funds were already laid out on the previous Chadbourne Street project so this is really just reviewing where those funds had been designated as support yes this is what you used last time basically you did not use any general fund dollars last time that is an option you didn't use any hot dollars that was an option listed we did use south tears dollars as well and depending on how that funds performing you know you allocated a portion 50 percent of their funding you know those are options you could look at but we just wanted before we too applied we want to job to look at just general concept of a funding option so you know that upfront and if those are a concept you're okay with and it's it's something we can move forward with area do you have any comments well I I think is it's really getting ahead of the curve and

[0:42:01] something that to in the long run will pay benefits for this particular project so I certainly am supported this I move to approve is presented do I have a second do you have any public comment with no public comment oh there is a okay excuse me is part of Steve Hampton did you say did you say that the funds would not be available till the year 21 22 correct 103 years no in two years this is 2019 2020 to fiscal year by Textil okay any further public comment if not we'll take a vote all in favor say aye we'll move into item G which is the first public hearing and introduction of an ordinance amending the budget for the fiscal year beginning October 1 2018 and ending September 30th 2019 for capital items Tina good morning again council this is a budget amendment to budget for dollars associated with the first phase of the Chadbourne Street project you approved this amount from cosa DC I think it was in May of 2018 as part of the resolution that was approved in that resolution you approved 3.75 million dollars coming from cosa DC to fund help fund this project over a period of five years so this budget amendment is funding for those first two years of that agreement and so this will have a 60 day public notice that's required by the Development Corporation and as well they will approve an MOU I believe
