[0:04:06] actually in the last month uh won two Awards uh one is uh the one that uh that the mayor just mentioned and another one was the first annual what's next Awards by Vision internet Vision was the vendor that we used uh out of California in order to develop our new website at costat tx. us uh they of the 500 websites that they have created they picked five winners and we were chosen uh the winner of the visual impact award and so uh mainly we just wanted to uh to take the opportunity to encourage our citizens to go to our new website at costat tx.us we think you'll find it very informative it's a lot more interactive than the site that it replaced in uh in February and as always if people have suggestions on what we can do to improve the site or there are features that they would like to see in the site that we do not have we'll be happy to uh to consider adding those and also want to take just a a brief opportunity to recognize uh Jade bacham from our it Department she was very integral in the uh development uh of our new website as was AJ deardorf unfortunately AJ's on vacation today but uh uh Jade did a a whole lot of the heavy lifting uh for which Brian and I take a lot of the credit so uh anyway please when you get the opportunity visit cox. us thank you Andy Brian you want to talk did you want to speak well we're proud of [Applause] please Jade's a former allar Facebook is that right make a comment just wanted to say uh congratulations Jade and U she's a former Allstar baseball player and

[0:06:11] Midnight Madness All-Star player she plays a mean first base she not hear a word I'm saying I think she's happy to be off of the the hot te thr it is now time for public comment and this is the time when we allow those that have something they want to approach the council with the opportunity I will give you three minutes ask you to approach the we're not miked only am I mic can anybody hear me it's funny how they turn everybody else's mics off turn them on and turn mine off there go we're good outside voice this is our public comment period at this time where we allow those that wish to address the Council on an item that is not on the agenda the opportunity uh we'll give you 3 minutes at the microphone to make your statements if you desire more than that then it's a matter of asking the council and if we choose then we can give you more but three minutes is what we allow I do need to read the legalities on this and then we'll open it up to the public for comment the council takes public comment on all items in the regular agenda public input on the regular agenda item will be taken at its appropriate discussion public input on an item not on the agenda or consent agenda may be identified and requested for consideration by the council at this time the council May request an item to be placed on a future agenda or for a consent agenda item to be moved to the regular agenda for public comment on public hearing items public input will received on each item immediately following the council discussion and prior to any action on the item each member of the public should make the remarks from the podium and begin by stating their name remarks by each citizen will be limited to 3 minutes unless W by council member for all speaking on that matter no individual will be allowed to speak more than once on any subject until every citizen wishing to comment has done so so at this time I will open it up to any citizen that wishes to comment on

[0:08:14] something that is not already on the agenda or has a desire for something on the consent agenda to be moved to the regular agenda for discussion this is your opportunity come to the front please ma'am and I would ask that you state your name for the record and you have three minutes ma'am I'm Charlene burnor my address is 3313 Rockbrook drive here in San Angelo and I want to thank the mayor for starting these meetings with prayer I think that's very important and I'm glad we have a city council that will do that I wish I were here this morning on a pleasant Point as these other people were but unfortunately I'm here regarding a file I a claim I filed with the city it this was with the water department for damages to my home on the first or 2nd of August 2013 these damages were caused by a spike in water pressure when a main was turned on after maintenance work this was the in at the intersection of Canyon Court and Green Valley Trail it took one one and a half to two blocks from my house you can check the work orders with the water department to verify this I do understand that I only have 3 minutes to speak and as I won't have time to set out all the facts I have prepared FES for each of you so you can read the facts and see that I can verify my claims may I pass those out now give them to miss rire please let me see if those are the right

[0:10:17] ones I have my own here I don't want to confuse you I brought my own file that matches yours so if you have any questions I can refer to my file file and I also brought my complete file which is quite large and I didn't think you would be interested in a little bit this however if you have any questions I will refer to it as you can see the files are divided into two parts the yellow tab tabs concern the city the colored tabs concern thank you the colored tabs concern turn my damages and expenses as a result of the spike in water pressure a soaker hose was blown loose from a rubber hose flooding flooding my patio this was insignificant but it also caused a crack in my RO system flooding the kitchen some of the dining room and the south end of the living room I have notified the city filed a proper claims and talked to several city employees I was treated with courtesy but the only answer I get is you can't sue the city I don't want to sue the city but I don't think that law prohibits the city from doing what's right in a and accepting their liability in a case like this I hope that after you vote I will be able to say justice is served if not I would at least like a better answer then you can't sue the city and the ironic thing is the city charged me for the water that flooded my house so if you have any

[0:12:21] questions if I've left out anything I'll be glad to answer your questions are my 3 minutes yes ma'am thank you very much thank you very much because because this is not an item on the agenda we are not allowed to discuss it today this is merely a formality to allow you to bring forth a claim you have given us paperwork on it is something we can look at I know this has been through our risk management area that the claim has been denied so this is something that we're just going to have to look at it a little bit ma'am and uh thank you for allowing me to appear before you today I appre I very much appreciate you appearing for us thank you ma'am Mr Mayor if I may since this is my district and I have spoke with Miss barnhorse I would like to review the facts in the file again with Mr danne and Mr Valenzuela and you if we may yes ma'am it's not it's not a dead deal Miss Bart we just need to look at it a little further thank you very much do I have further public comment come ahead sir state your name I'm going to give you approximately three minutes please okay my name is Nick Rodriguez uh was born and raised in this city I have seen a lot of things come and go we have had a problem of harassment intimidation from the cold department for years they took me in for 9 months and they never in court they never let me say what was right Miss Liss went to my place one of my places she saw there was nothing there but she couldn't do nothing okay this other lady here recently she was find almost $400 for trash being in the street she this lot is right on the edge of the

[0:14:23] city limits here are pictures that I encircle she keeps her properties good and clean and th this lady has been in the books with the city paying fines for quite a few years when the city when they when the Code Enforcement wants to just go unload a machine and cut little weeds or grass and charge her a tremendous price $200 $300 here lately I found that out that's still do going on the judge at one time municipal court judge said well the city says guilty not guilty everybody's guilty and that's why they find everybody guilty in that court and that's not right Mr Daniel there we met when he came into office he knows about this he saw pictures this particular court enforcement made a person put four types of fence around 4 and 1/2 acres just because of religion because they didn't belong to his religion that's the same way it happened to me because I didn't belong to his to his religion since 94 we been going round and round the reason I haven't done anything bad to him because I got other goals to go at before my time comes to go because he very easy to do things that's why there's so much destruction with people and what this city needs to do is fire all these people are doing bad we got witnesses we got paperwork we got everything this time I'm going to the state I'm going get a after this and I even going to go against the judges because they will not let people say what they have to

[0:16:25] say these people lie all the way through Court where their teeth just laughing because the judge doesn't listen to any the judge threatened to put me in jail because I was trying to say my part I have witnesses on this other people help me we had a group of men and we help a lot of people handicapped and elderly you've got one minute and all these men decide we stop helping these people we had been helping them since 1976 I used to own a construction company we help churches we help all types of people that needed help so all that gone because of what happened to me and this is not fair Mr Venezuela knows that it's not fair and he needs to do something our commissioner has never listened to us on our part Town it don't seem like he done very much for the our part town that people call him and he never answers to them we call him he doesn't answer he seems to know whose phone number is who and that's not right isn't it John huh John no sir it's not no sir it is not I can prove it to you boy I think we've had enough of this one we appreciate your comments uh I disagree with you I disagree with you we do not have a judge that's going to say everybody is guilty before they're even tried that's against their oath against the Constitution that doesn't happen sir that was not my word that was the judge's words thank you for your comment do we have further public comment this is your opportunity Pro or con if there is no further public comment then I will open it up to the council is there any comment from Council Members or are there any items that we wish to have moved from consent

[0:18:28] to I'll start with you Elizabeth I don't have an issue regarding consent agenda just a statement after the death of Ken gunar which a few of us participated in his funeral um I think that it's very important that the city consid some sort of acknowledgement of Mr Gunner's life here and I don't really know what that should look like I've uh mentioned this to uh the city manager and the assistant city managers but I think that the city owes Mr gunar and his family something and as I said something truly memorable and worthwhile but again I'm not I'm not certain what that should be but I would like for us to to look into doing something an urban Pioneer a technological Pioneer and someone who I think made St Angelo very proud and I I agree with you 100% Downtown St Angelo wouldn't be there today without Ken gunar he's one that saved it so I'm all with you let's let's get something started thank you Don did you have anything sir no Charlotte just learn how to drive yeah Charlotte Charlotte backed out without looking today Mr silus Mr may I just wanted to give kudos to uh the folks with a Civic leak Park I went out there and had lunch and sat at one of the benches and one of the toughest things I've ever had to do cuz I am a tree lover I mean I love trees but uh the idea to cut one down uh has really brought forward uh if you you folks have not been out there yet you need to but I want to thank hen Landon Larry Jolly the Garden Club and wanted to throw in a little uh advertising for them on the Saturday September 20th I believe that's the day that the Lily Festival but what's going on down there with the Gazebo coming up and all it's it's going to be a a beautiful beautiful area it it certainly is a diamond interrupt and I just wanted to again Pat them on the back for what they're doing out there thank you thank you John Marty do you have anything sir no sir Mr Fleming would it be possible to move number 16 to first on the public hearing I'd like to I'd like to hear some of the discussion on that and I talked to

[0:20:31] Charlotte with this about this yesterday and then and then move number 24 M the last item to third right behind number 15 I don't have problema with what do you think about it Marty you have a problem no sir that would be you're saying move number 16 which is a thare plan to move it to the first thing we deal with yes in public hearing and then you wanted to do your 24 after number to do it after 15 yes please I don't have a problem uh Johnny how do you feel no sir I don't but I do want to make a a motion to approve the consent agenda as it as is second okay we got that let's do that first do you have a problem charl with moving it Don no sir Elizabeth okay we will move it Ry all right I do have a motion and a second that we approve the consent agenda as it has been presented do I have any further Council comment on consent then I'll open up to the floor for public comment on the consent agenda if there is none I will call for the vote all in favor please say I I oppose nay let's put a 70 on that one let's move on now to public hearing and comment and I guess we have already decided to take 16 first before 15 this is discussion and possible action related to a comprehensive review of the master thare plan and an Associated funding strategy to include the use of half cent sales tax and other potential Services sources of funding two an updated annexation strategy policy that prioritizes high growth area and three a review of the applicable sections of the subdivision ordinance Exhibit C to chapter 12 on planning and development of the code of ordinances associated with the construction of required streets and rights away requested by council member farmer presentation by city engineer car Bedard Bedard bednard bedor and economic development Roland pinan development services director

[0:22:33] Patrick Howard you all have the floor Mr Mayor if I may just to sum this up for time uh I had requested this item uh to be looked at for reasons I stressed to the city manager and Carl and various uh department heads and it's very fitting thank you Mr Fleming for moving this uh before item number 15 because it ties to item number 15 uh I you don't have to be a rock scientists figure out that the Southwest portion of town and then private investment uh has had a an explosion of building and traffic and uh those of us who live in the area H shop in the area travel through the area we have witness this explosion and uh it's a serious matter with reference to traffic the amount of traffic and the safety that people are experiencing in the residential neighborhoods because of this increased traffic I had asked uh our city engineering department to look at the possibility of taking Twin Mountain Drive which uh I don't know the exact date that it was built it's a big four lane divided with the curbed turn lanes and thoroughfare through there uh and it does great for the traffic off nickach to Southwest but to Southwest Boulevard and then going on down to Southland it's the cut across to the commercial district and is creating quite a traffic jam if we could bring Twin Mountain Drive that is from nicker Bacher to Southwest Boulevard currently in its condition if we could bring it from Southwest all the way around to Sherwood way it would alleviate a lot of the traffic congestion that we're experiencing on Southland and I firmly believe that the city needs to seriously look at and commit to this for the safety there are two schools involved Lamar and b elementary and the traffic that cut across traffic that we're having through there with trucks trailers boats uh big riggers um it doesn't mix with children in schools so

[0:24:36] at that that's the reason we're looking at it a commitment from Council is to take this on how to fund it and to go from there and that's my preface for this item on the agenda okay Mr Carl okay good morning I'm Carl bed arsam city engineer I'm going to be speaking to the technical aspects of this uh item and I think Patrick's going to address some of the next steps we might look at uh I want to go first into just briefly from a real high level how we build streets right now and how how streets get built I don't know if everyone is clear on that but U how they get planned and built Developers for the most part build all of our streets uh the new and the residential areas around town and they use our vision plan to uh to come up with the location for those streets and it's laid out in the planning process we at at the plan planning division look at those locations make sure it matches with the vision plan and they design it and we review that also they submit performance agreements to uh to us and uh those are guaranteed by bonds cash letter credit cashier check Etc after we secure those agreements then the improvements begin the work is performed all at the developers cost and the city we inspect those streets as they're getting built uh the Water and Sewer as well is also inspected as it's getting installed make sure it meets our specifications after these improvements are complete um we review it make sure it's accepted the developer will be record the plat and develop be released from a performance agreement and U water sewer can be hooked up building permits can be issued and PLS can be sold and it starts being developed and the work is warranted for one year from that period if if we were to move forward and and build a street to with the city forces or city funds and uh designing it building it that type of thing first we're going to need to identify which streets we're talking about uh from the vision plan identify if there's any annexation issues that

[0:26:39] might be out there if we're on on the edge of the city or outside that uh any kind of funding source uh and developing a preliminary budget uh surveying would be needed to uh determine what obstacles we're going going to be uh faced with in the design uh RightWay needs would be need to be determined and utilities that might be out there and there wouldn't be any sewer water yet but there could be some gas lines um electrical lines things like that that we might have to deal with maybe a traffic study if if signals are going to be involved um we bring that alter together with the schematic showing all our planned improvements uh look at a drainage study see if there's any easements needed uh ter if there's any government permits needed we have to look at corv engineer permits um Danger species permits there's a whole list of things that have to be looked at but uh it's just something that has to be done if uh I'm sorry uh if the railroads involved there would be some permits that might be have would have to negotiate with the railroad to get crossings that that's also accomplishable um then we develop a real tight budget once we had all those things in in place we' pretty much have all the unknowns in front of us we could develop a tyght budget um go back and Survey the properties determine the property need and appraise those properties uh make offers to the property owners the property be acquired we design the property prepare the bid documents uh depending on the location there might be a bridge involved if there is that that might require Consultants or they don't have the staff to do that I have the staff to do the rest of the the work um the project would be let up for bids a contractor would be selected to build the project out street would be constructed and warranted for one year from that period so that's kind of a real there's a lot of steps that are in between these that I'm not going to go over that are or minor but they still have to be done but that that's really a high level view of what needs to be done but um if Patrick you want to look at some next steps or do you want me to go over this part of it uh go ahead okay one thing that we need to do is uh the city

[0:28:43] store plan is reviewed periodically and I like think it may need be reviewed now to uh see if there's some other areas that we need to look at um another possible thing we need to look at is prioritize leads streets the prioritize list of proposed streets that may want to improve now and and not wait for developers to build out that that that could take years and and depending on where you're at in the city that U may not be feasible um we need to determine funding sources and uh I missed one there if a street maybe is outside the city we maybe look at annexation of that area and determining funding sources and there's traditional funding forces just for our budget uh there may be other multiple methods that U people smarter than I I'm not a funding Guru on that and uh finally we probably need to look at the sub subdivision ordinance and make sure we're in compliance with all their quote quot of ordinances on that but um that's really all I had there's any questions for me on just the technical aspects of doing this no since you mentioned funding several times I'll go ahead and and bring this up and trying to find Monies to help support this particular project and I personally want to move forward with it um I had uh reviewed at one time what the city had looked at in our half cent sales taxes to Economic Development uh in in looking at the location of where this would be where it is now the economics from Highway 67 for any type of Lake function whether it's the boat show or anything hunting and fishing that is going out there it it definitely has an epic epic Economic Development aspect to it and and I want us to read and review and see if those funding sources are available to add to this program uh anytime you can assist in the shopping and so forth of the areas I I believe it's Economic Development so I wanted to mention that

[0:30:45] is why I ask Roland to be here today to talk about that and to look at as a possible additional funding source for this okay you you'd ask me when we met last week about this uh how the other port of Twin Mountain specifically how it was developed and just from my research that I could find and it's not totally flushed out but the school district was really involved in that that road and and there were some agreements made to build that road out to Lamar and uh and for all that connection there so that that was how that was developed but it's several sources working together to find the Monies to try to build ahead instead of waiting until after the Collision is is already there put on words for my wreck this morning but uh just for the safety flow of the traffic to the commercial to the general shopping uh it's if we had an overview did we have an overview of the street for those who are not familiar to see how it connects around to Highway 67 which has become one of the busiest highways in the state and especially from St Angelo to Big Lake but uh we don't have an overview I didn't include that in my presentation sorry um as you turn on Twin Mountain when as far as you can go is to Southwest Boulevard but if you went all the way down to that one way in and one way out Baker subdivision this would bring another entrance for new homes being built to bring it all the way around to Sherwood Way and also take I would I think I would be very conservative in saying 65% of the traffic flow off of Southland would would then go to the higher forlane divided with turn lanane to bring it around the South End portion of the city oh and and I wanted to add is that has always been a popular hunting zone for bird Hunters deer hunters and now you have schools and traffic the residen is backing right up to those areas some that's not in the city limits some that

[0:32:46] is and you know with high-powered rifles and even birdshot zinging right over your fence it's not an uncomfortable feeling if you live out there I mean it's a very uncomfortable feeling if you live out there and you have children playing for the hunting activities that go on in that particular thank you Patrick I guess I I'll just I'll just take over from this point and want to thank you for your comments already as as described in the caption as we talked on last week um there are several obviously several components of uh that would need to be considered as we talk about extension of a of the Twin Mountain and obviously the area is not within mostly within the city limits and so uh in terms of next steps call did Cover majority of those things to include looking at potential funding sources obviously in most cases the the responsibility on the owners for developing streets is on the developer and so if we were to consider alternatives to Street construction we would obviously want to review our policies and think about how we would want to move forward with that if it includes halfon sales tax if in fact it's deemed uh an eligible activity uh for the halfon sales tax then certainly that would be an option however again still looking at our Pol current policies in terms of Street construction that would be something that we would have to consider we would also look at uh annexation and look at our annexation policy and determine whether um based on um potential development opportunities and what that would mean for us as a as a City whether we wanted to Annex this area into the city is not or not now it's in the current annexation policy it does identify the area so that's it's assumed that with the development that's occurring in the area we would continue along that path um additionally we would also need to look at obviously the appropriate zoning uh the acquisition of

[0:34:48] the appropriate RightWay and the like and so staff is ask asking for direction to uh review these items and bring back to the council uh some some information for consideration as we move forward if that's your inclination and my reasons for putting it on the agenda it's a it's a huge project it's a huge task and it requires a large amount of staff work and I didn't want to have them do all of the work to bring to council the numbers and the possibilities for their work to just fall on deaf ears I wanted to discuss with the rest of the council if they thought it was a worthy project to move forward on and that staff should be involved in meeting all of these uh hurles to get approval from Council today to at least move forward in looking at annexation as well as the completion of Twin Mountain drive around to Sherwood Way mayor yes ma'am do you have more to present on this item or no okay um a thorough FAIR Plan involves city city streets as well as is those I guess out into the etj correct yes and historically developers as Carl said um build residential streets collector streets and it's possible if they build arterials but that's more for their own benefit it makes their land more valuable and more sellable there's nothing wrong with the city in my view looking at an arterial development but these are projects that should compete in a capital Improvement plan and not be brought out side of that because essentially we're all fighting for the same Capital dollar so I think the most important thing is consistency with regard to the implementation of the thoroughfare plan and the Very purpose of it is as councilwoman farmer is pointing out is to build out before it's sort of improperly done by incremental

[0:36:52] development but I think that this project like any other has to compete with all of the other capital needs that we have I think it's a good project but I think it needs to be vetted that way annexation in this area probably annexation in general we need to really consider with the growth that we're experiencing this is the first bump we've had in years so this is when planning is going to be most important um and that we be consistent in how we and how we Implement Rodney I'm I'm with Charlotte on this and I think that we do need to look of look forward I'm not sure that we can use that half cent sales tax because if we if we were to build that we would have to recoup some money back from them in the future as they're buying the the L or as they're building out each section connecting to this art arterior arterial way so that's the way I would see it is I would try to collect the money back to them and there are ways to do that there are cities that have done that in the past so basically what you're doing is you're helping them with development you can you can even get a profit off or charge a percent percentage as you carry it so if it doesn't if someone doesn't build up against that arterior way for 10 years from now it won't cost them it'll cost them more than what someone would be today so there is a possibility of doing that to have sent sales tax I don't think we can do it because if you did were to get money back from that I don't think you can use that money and then get paid back for that money this is a very important thing and why I asked for it to be done before we talk about uh item number 15 is that this affects item number 15 dramatically and I can see what you're saying uh Liz is on the uh you know put it in the the CIP and having it compete against everything but what one of the main things and this is not my district this is Charlotte's District but this is a district that I drive through probably every day every other day the majority or a whole lot of people in this city drive through this area over there and what happened was is we did have poor planning for that area there was poor

[0:38:55] planning and at a minimum we should have had a a three Lane right there in front of that school at least two lanes and a turn lane and we didn't so we did plan badly for that situation and I think that this should be a a a thoroughfare I'm not saying that we should need go put thorough fares all over the city but this is one that's a major one it does come off a Highway 67 and it's a it affects a dramatic dramatically large portion of our city it's two districts really that it affects back over there and uh I think that should be something that's not looked at for the CIP but this is something we could do as a special project because we messed it up to begin with we should fix it well I'm not sure why it wasn't important 3 months ago I mean that the situation out there is exactly the same as it was three months ago who said it wasn't important three months ago was it I'm not sure that it was presented as part of a a as a potential Capital project we're not marrying what's going on in our community with our our planning documents we're we're trying to do everything without any sort of context and in the end I think the best product and the best Solutions are going to come with consistency Johnny no I just wanted to add that we need to uh take it one step at a time and I totally agree with Charlotte and and her idea on this uh I I'm okay with the annexation idea but like uh Miss gr stab said that we do have I remember there being a list of 50 5 streets with $155 million uh price tag so you I want to just hold up we're we're building those funds to start repairing the streets I totally agree this is part of the the growing pain that angel is going through but I think we need to just hold you know hold the range right now while we try to fix what's broken today right now and you know you know right away the thorn in my side is Bell Street so when

[0:40:57] I when I hear stuff like that uh you know every day I get phone calls I'm going like uh I feel your pain you know we drive down that road all the time but again I totally agree that this needs to be looked at I'm okay with annexation but I think uh I'm I'm I'm wanting to just hold back a little bit on it and uh and wait to see how our funds work out you know we we've got potential 4 million coming up and let's see how those funds uh help the streets that are in bad need of repair right now so with all due respect to to Charlotte again uh I hear where you're coming from but I just say let's take it one step at a time mayor further Charlie well I guess I look at this like a stick of dynamite uh you know with the fuse out there going and it's going and ever since Mr Valenzuela has been here going on two years I have talked about the city and the traffic in this area and the growth and I see the fuse is still going we're doing a lot of talking and yes we all know it needs to be done and what I'm looking for is a commitment from the city that does move this up there with the other Capital uh improvements we can't do this in 3 months in 6 months in nine months this is going to take two or three years to do to get it going to get it on the drawing board and to get uh things moving on it if we don't start now and make a commitment now that fuse that stick of dynamite is exactly what is happened now 3 months ago 6 months ago it has exploded it has exploded and with respect to the other streets and stuff in town that need to be repaired absolutely but where are you going to Route the traffic while you're repairing those streets where are you going to relieve the traffic uh to get down Southwest now anywhere from Lamar school all the way to the loop is a nightmare it is a nightmare where are you going to re

[0:43:00] reroute and relieve that traffic in order to start doing some repair Elizabeth i i would support the project as long as we sort of go through the proper steps of putting it at the top of the CIP in other words that's we're saying publicly that we believe that it competes at a high level against all the other projects that have been submitted if we're willing to do that I'm willing to support it I can say when I was at the city or first came to the city we had a long history of of deferrals for streets and we stopped that but this is an area that I think still has kind of half a street built and a few other problems and it it it has such great potential um as I said I'm I'm I can go with it but we just need to we need to do it in a I think with a certain methodology that explains why we're doing what we're doing and making sure that again we justify it against all of the other needs that are out there I'd be happy with that further comment Marty I I guess one of my concerns is that uh no no doubt it probably needs to be done but we uh we heard from developers I think when when the when the fire deal came up uh they couldn't they couldn't take that road that away because people were not willing to sell the land to so they could buy to to put the street in so I mean for us to do it I guess we' have to go through condemnation and and everything else to put the street in I I I'm not sure how how supportive I am of doing that I'm glad you brought that up and I didn't have to Johnny I just wanted to add that I I'm am very L of even mentioning the halfon

[0:45:04] sales tax for something like this maybe I'm wrong but you know I've never felt comfortable uh going in that direction but my last question is what what kind of what possible action are we looking for for this item that's where I didn't want to jump the gun and and all of a sudden assign some funds to go with this idea but what possible action are we talking about here related to well let me share I when we met with councilwoman um staff did uh and she expressed an interest in specifically looking at how to fund Twin Mountain Drive we further suggested to her that there are those steps that I outlined that need to be considered if we were to at all at all entertain the idea of the city funding twin mountains extension and so uh staff's looking for direction from the Council on on any on any component of what was discussed related to uh the annexation within the area annexation in general uh related to policies related to how we construct streets and all those things associated with what would happen if we were to elect to entertain the idea of funding the street the city funding the street so again it would require annexation it requires looking at the thare plan and ensuring that it's consistent uh it also would require some sort of prioritization of of the street which would be part of the capital Improvement uh plan as outlined and so all those things would need to be considered and acted upon if we were elect to move forward so we're just asking what would you what is the pleasure of the council as relates to the item before us today what I'm saying is is I'm sorry Don go ahead Charlie all all of these things annexation uh the fing uh the um uh purchase of the right to go through the lands all of these things need to be done what I'm asking that we don't do

[0:47:07] these one at a time well let's do this before we start this let's do this before we start that let's do this and before you know it 10 years has gone by that's what I'm saying I'm asking the council to support the idea for staff to work on this all at once so that we can cut that 10 years down to three or four years that's what I'm asking and that's a lot of work on the staff's part and I don't want them to expend their time if council's not going to support the idea Don um I I pretty much agree with with Johnny and and Elizabeth too I think we need to go about this in a in a way that we have with all of our other Capital Improvements um also it's just like our Parks uh we're building Parks right and left and we don't have funds to maintain them uh we're we're not putting putting uh funds with those things to to keep up with the demand that we have on on maintenance and upkeep it's the same thing with our streets I think before we need to build more streets we need to maintain and keep up what we have um this is definitely a need it's something that I think we do need to look at uh I have absolutely no problem with looking at it um once again I'm going to bring forward my half cent sales tax idea take it to the voters uh if they want to uh take sales tax for our streets we could do that on a four-year process and and let the voters decide if these are the kind of things that they want to do with that money I too feel it needs to be in the Capital Improvements I we put something ahead of Bell Street I think every one of us to be hung from a high tree bail Street has got to be fixed we've been promising that for years and to bring another project in and throw it in front of everything else is not going to work we also have Howard Street we have college Hills North chadburn we have so many streets that need so much work and they are they are in capital Improvement plans and they

[0:49:09] are categorized for a reason as the most needed so if we want to throw this thing into the Capital Improvements and let it seek its own place then I don't have a problem with that but that's as far as I would be willing to go Johnny Yes you the last thing I wanted to add is I would encourage any citizen any taxpaying citizen in this community to go down 14th Street and and and go down go down pean street going south towards the loop and you'll see what those folks are dealing with I me it is horrible horrible bad but another thing that Carl mentioned and and uh maybe throw this into the conversation again uh you mentioned sisd was part of this uh the twin mountains portion of it and maybe we I I don't know whether we tap into them again uh on helping fund this idea you know at at at a later date but if if they helped out with uh what's there now I I don't see why we shouldn't ask for you know some type of support some type of a partnership so I just want to throw that in but go down Pecan Street please Daniel councilman flemingan made a point a little while ago as far as recouping some of the cost um when we started looking at perhaps funding a project such as this um we definitely need to look and adust of the funding and the possibility for recoup recoup M of those funds uh and that's something needs to be determined how that would look like um it's not something I'm kind kind of lar as far as um especially we start talking about taxpayer money that uh there is a responsibility by the developer to ensure that as areas are being developed are built out uh that these uh infrastructure improvements are or not improvements but the infrastructure that are going in place are covered by the developers so I do feel that definitely we need to look at perhaps a funding opportunity but also the uh possibility recruitment and again what that would look like that's something that that we could discuss and see how that would work out Don a as far as just kind of as a a final footnote uh the school district did did help with that street but it was

[0:51:13] done through a bond issue and that was figured into the bond issue because it's it's basically in accordance with the developer uh they knew they had to have a good Street out there to Lamar when they did it I was on the school board and that that's why it's out there I would say that consensus is that we throw this into the capital Improvement to let it find its own spot so I don't know we can we can vote on it if someone wants to to move one way or the other or we can leave with a consensus whatever y'all want to do I'll make a motion okay I'd make a motion that we uh consider this project for a placement in the Capital Improvements plan as well as anex Annex or do an annexation study for the area based on the growth that our community is is experiencing I'll second that okay I think that's a good motion do I have any further Council consideration on this I'll open it up to the public for comment either way if you would like to speak to this issue the motion has been made that we place this in the capital Improvement plan with annexation study and let it seek its own level and onev its own level of importance call for the vote all in favor please say I I any oppose Nay put a 70 on that one let's move on now to number 15 which is the first public he and consideration of an introduction of an ordinance amending chapter 12 exhibit a zoning ordinance of the code of ordinance in city of St Angelo PD 1401 White Oaks Development LLC and ordinance amending chapter 12 exhibit a of the code of ordinances city of St Angelo Texas which said exhibit a of chapter 12 adopt zoning regulations use districts and a zoning map in accordance with a comprehensive plan by changing the zoning and classification of the following properties to it an unaddressed 8.9 acre track located at the northwest corner of Southland Boulevard in Mills Pass Drive more specifically being approximately 4.9 Acres out of the Community of Faith subdivision section two block one lot three in Southwest St Angelo changing

[0:53:15] the zoning classification from single family residence rs1 and ranch and estate r& zoning District to a plan development PD District providing for cability and provid in for a penalty development services director Patrick Howard but before we get started it is 10:00 yes Council want to take a few minutes break before we get into this yes let's take a break I have already read item number 15 I read it and Council y'all know this is one of those situations we not going to win on this one because either way we vote we're going to make half the people mad so let do it let's get it go ahead Mr Howard okay thank you Mr Mayor um as been stated the applicant is requesting to change his current zoning from RS in r& uh resident single family residents and ranch and Estates to uh a plan development district with an R M1 uh underlying zoning there was a lot of uh discussion about this and obviously a lot of participation at the Planning Commission and subsequently uh through phone calls and emails there were 16 notification sent out uh for this item two in favor and 22 in opposition how many how does that add to 16 two in favor and 22 in opposition more than in the correct as a result of emails and it grew the the the number of in in opposition Grew From the orig 16 outside the 200 yard no what what I mean is that notifications were sent to the six SE individuals who were within 200 ft and we got back more than actually what we sent out in terms of an opposition staff does recommend approval of the application however at the Planning Commission uh there was a 33 vote and so it came forward without a

[0:55:20] recommendation from the Planning Commission so just briefly I want to just touch base on an item there was a similar case uh at the same for a portion of the property um less than a year ago and so there was some confusion about that so I just couple slides just to clarify that that the the applicant was in the previous application was requesting an rm2 Which is far more dense uh which would result in a far uh greater number of units uh potentially whereby the applicant in this current situation is asking for PD with a less intense zoning of um of rm1 which uh his proposal does not necessarily even maximize what the potential under the rm1 zoning would allow for so I wanted just to U make Clarity of that um additionally um the current zoning is rs1 uh for the majority of the site and I just wanted to highlight that if the zoning were not to change at least for the rs1 portion there'd be 75 units that would be allowed to be developed however The Proposal with the rm1 and the and the plan development is only for 80 units which is only 30% of what is allowed under rm1 so even though he's asking for a more intense zoning classification it will the proposed development is not is only going to render for all intense purposes May may be five additional units from what potentially could be built today well say that again Patrick if they the current zoning would allow for 75 units if nothing changed the proposed zoning and the PD overlay uh and the proposed development is only going to be five additional units uh more than what they could potentially be allowed under the current zoning thank you

[0:57:23] sir okay so just uh just more facts uh there here is some uh adjacent or at least neighboring multif family development however we're looking at you know town homes for the potential proposed development that we wanted to show some existing multif family in the general area the subject property to the on this map and the the Far West uh well yeah the Far West and there are three developments in the general vicinity um Ino Park uh Plaza Dale soul and Ceda Park departments so one of the big items was the issue related to Traffic or perceived traffic and it's fairly technical I think the point to be made uh quite simply is that the result of the traffic study suggested that the level of traffic even with the increased uh development uh proposed development would still allow for a level B service a level level B Service uh which is pretty good as it relates to uh level of service for for traffic and congestion in fact uh C in most cases is is what you find in most areas of the city and with the proposed development we're only looking at still maintaining a level B service which a is the highest and B is second so the the result of the study uh did render that those results and we can go more into the study if you'd like but just as an overview when was the study conducted the study was conducted approximately two weeks ago July 15th so not during the time that well and that's a point to be made as well the the study was conducted assuming that all of the all of the Stu the the school was in session so that was taken into account when the study was done so they so as you can look at the study as you can look at the graphic here it shows a 484 which is the enrollment for the school

[0:59:26] and it talks about trips assuming that a percentage of the students would be dropped off a percentage of those would be uh walking um or taking other means of transportation car pooling and the like so it doesn't what when you look at the daily trips it doesn't reflect the double amount of students and obviously faculty and staff so it did take into account all of the students um being in session that's where the 484 comes in at Patrick I have a quick question yes so a means that it the ability for that thoroughfare or Street to to accommodate traffic and then B it's a little less than that or well it's not it's it's about it's about sort of the when you talk about level of service you're talking about primarily congestion for the most part and so uh when at level a means that there's very very very very little congestion is typically probably a four lane divice Highway of sorts um and most cases when you're talking about a residential street or a minor collector you're talking about a level of service B or C even D in some cases and it obvious is based on obviously the density of development in the area but B is very acceptable in fact most cities strive for C or D in most cases um in terms of traffic so the the the long and short of it is that the proposed development does not significantly impact the level of service on on Southland do you agree with the methodology of the study I I do okay I don't so here's the subject property um the red line shows the corporate boundaries um Municipal boundaries of the city um just sort of as a um in context so that's primarily along Southland and again um we talked about item 16 uh this map was that was shown um Twin Mountain Drive being in the

[1:01:29] neighboring vicinity so here's an area of the subject property um there's obviously areas that are undeveloped and across the street we do see uh Bottom Elementary School okay and here's the subject property it's it's r& in the southern portion and um rs1 in the northern portion even though it's all shaded the same color U there's General commercial to the north to the to the uh um to the West you see rs1 um and uh so there is a mix of uses within the area mix of housing types as well and which is what is envisioned for a street like Southland this is just a land use map that provides a recommendation about the type of uses which is which is residential so this is a site plan um roughly we're looking at potentially uh 80 units um it is a PD so it is subject to conditions that we'll we we can go over as well PD does provide that opportunity to impose conditions that just the underlying zoning wouldn't and so the applicant did ask for um rm1 with PD so there are some conditions that are being imposed but again as I stated earlier the if rs1 which is a portion of the property if it were all maxed out at rs1 uh could potentially render 77 75 units I'm sorry whereas he's asking for only 80 town home units um as opposed to what may be perceived as multif family I think that there was some question about whether it's multif family um as a as an apartment but it's they're actually Tal homes they're what town hom Town Homes here's another landscape concept

[1:03:32] showing the same the same site conceptual site plan and here's this a picture of the rendering of the building elevation the applicant is here and they have probably a few nicer drawings and I'll allow them an opportunity to come and share as well but this is the the uh proposed elevation obviously is subject to uh design review that would be subsequent to this uh request being uh approved or denied um get just further were you at the were you at the meeting uh that was held uh in the neighborhood at the I was not a city engineer there as and one of the planners were there as well and me are they here to speak city engineer is here uh if you have questions specifically about what was discussed it was primarily about the traffic study though okay were there any points of discussion that became part of the PDD no okay the primary dis the primary issue discussed was that of traffic okay can I ask a few more questions mayor yes ma'am um in the staff report it says that the if I'm reading this correctly that there were six it was a 60 vote at Planning Commission you said 3 three it six that that's a typo apparently there was six MERS of Planning Commission present and uh three voted in favor and three voted against so move forward three vote and but then they took a another motion that to forward it on to council which was a 60 vote it was a 33 vote on the issue uh to deny it was a 33 and then then the 60 was to forward it on to council is that not correct correct initially we were it was going to go back to Planning Commission uh made the Planning Commission aware of the fact that it could move forward without a recommendation if there is a TI vote and they subsequently voted to move it

[1:05:35] forward without a recommendation and that was a six 60 vote so you're correct Rodney on the Elizabeth yes sir thank you yes Rodney on on the requirements that they said that they would abide by to in order to build this development can we do something I talked to one of the developers that are behind this neighborhood can we make it I see on their concept that they have a line of trees across the front can we do a line of trees across the back also can we do that in with there certainly and what I'll do is give them an opportunity to sort of share conceptually about what's what's en vision for the site okay and we could maybe discuss some of the specifics at that point but but we could tie that would require them to do that I would like the them give them opportunity to be able to show what's the vision thank you do that you going to go ahead and complete your presentation pleas certainly I think Charlotte has some marks on this okay well these are just as standard pictures from the site uh looking north south east and west and just an analysis uh which we've already sort of shared so certainly I can conclude at that point Charlie okay Mr Howard please do not take personal offense to any of my comments but I am aggravated at some of the steps in the way this came about so I've made some notes and if you I truly appreciate you and your staff uh find away to say yes to the business Community um however I really feel like in this case I'll threw the baby out with the bath water uh because of the way and the sequence that the things came down um this piece of land has been before Council what three months ago it hasn't been it's it's been at least month April or May is when it came to it came to council and it was deded it was a four three vote for the change uh the zoning request change for Mr yuling uh and and the biggest reason was the traffic concerns um in the vicinity and its vicinity to botum

[1:07:40] um I resent that at that time that a PUD wasn't PUD excuse me a PD was not offered to Mr uling when he came forth with his uh deal at that time for the same local investor developer who's born here raised here lived here all of his life but it it wasn't offered or whatever and now we get a new person that comes in wants to do it and how well we can do it we can take it back to council we don't have to wait a year because we can put a different name on it now you may have met the regulatory codes for this but to the people out there it was just a play on words a loophole a way to find uh to bring something back that they feel like that they successfully fought for a year and that didn't happen whatever the reasons uh it it remains exactly what it is it is an apartment complex you can call it a quad you can call it Town Homes you can call it whatever you want but the definition a rental is when someone lives there other than the owner and you pay money too now whether you put 16 units in one building or 20 units in one building it's still apartment living and I'm not saying that's bad I'm not against apartment living at all I I I do believe that um there's some very good people out there that rent um there have not been any upgrades in the area from the city or anyone else on Southland Boulevard when you come down Southwest and you bring it all the way around to Sherwood Way and that we have added homes and added homes and added didn't go back and take account but it just takes a short aerial view to see how fast that area has developed and all the traffic dumps back on to South and that has increased the traffic for the students at Bonham uh there's not been any curb bike trail uh in the Pavements or in the area when you come across the aoya which is right there at Oak Grove there's been nothing improved by the city on that particular Street all the way out to

[1:09:43] Sherwood Way and that that concerns me and it concerns the residents out there because they've watched additional traffic being thrown into their area and it doesn't seem like anybody's paying attention uh to what how it's being built out all of the streets that develop they all dump back into Southland from Southwest to uh Green Meadow uh the high traffic is causing for people to Dart through the streets and I'm going to try to keep the personal out of this because I live right there and I know what the traffic is and I know that the residents are not exaggerating when they say the volume and the safety and the speed there's just too many cars to support the air area it angers me that the City Planning Department um did not see or watch the fast growth Pace taking over and uh becoming too much for that existing thorough fair to plan on how to do this now I know we've been through staff changes and Personnel changes and all kinds of changes your your taxpayer doesn't care they don't care about your Chang they pay their taxes and they expect you to look out for their areas and the this whether it's too much traffic too little traffic but they invest their taxpaying dollars and they invested there based on the zoning being R1 yes they knew it was going to grow single families have residents have grown uh Leaps and Bounds uh I I'm angry because Mr yuling wasn't offered the same signed of uh PD and it just seems like this is an endr run opportunity for another developer to come in and planning took their instructions from Council find a way to say yes find a way to say yes well you found a way but after something that had already been turned down and residents had a a good safe secure feeling about it and you just literally ripped the rug right off of their feet I live out there I talk to these people and they're upset with the city they feel like the city

[1:11:45] staff planning pulled a fast one on them on this and in your defense you're new you found a way to say yes to the developer coming in um it causes a lot of mistrust on how this handled how it came about I understand that mistrust um it makes me think that maybe staff doesn't know what they're doing uh when they don't uh think about turning it down prior and coming right back again uh it causes mistrust and I I don't like the way it came about to me it's a play on words you know you can call it a PD you can put a different shade of lip stick on it and it's still apartment living and a large amount of traffic in one [Applause] area the deception I I believe uh unintentional but it did happen and I want to see the city make it right I don't wish the developer or the person selling the land any undue harm or anything on this I I I want to see safe affordable housing for all walks of life who knows everybody that rent might be a retired person who doesn't want to own property they prefer to rent and that would be great and that would be wonderful it has nothing to do really with anything other than the amount of traffic and the city has not offered the citizens out there any comfort zone that those needs will be seriously met and addressed I don't feel from the first item that we discussed I don't feel a comfort zone to believe that the city will take their concerns and address this as an immediate problem you know you say 80 units all that doesn't sound like much but if you take the floor plan structure how many two bedrooms one bedrooms or three bedrooms that are in these units and you multiply out the number of vehicles that it has the potential the potential to throw into that area and just the simple math that I did on it 686 additional Vehicles if you've got two-bedroom two bath and you're allowed

[1:13:49] two people per bedroom you know that's four and more than likely four people whether it's mom and dad and kids everybody's got their own vehicle it doubles the amount of traffic that you have out there I was reading uh from Jeff brigh uh The Independent School District I went to the meeting that was at there and and he says the district still strongly opposes the construction of apartments across the street from balum Bonham Elementary School 29 and and my reading in here 29 people answered and said we don't want it they didn't say we don't want those people which I'm very appreciative that they didn't say that's not what they said they don't want the additional traffic because of the unsafe conditions that's what they don't want but we've not offered any way to handle this traffic I can tell you that the boulevard which is on Sherwood Way I've been out I've driven over the dirt roads that have been plowed and made out there and that property swings right back into if you put up the map the wilky road that is graded there is no pavement or anything yet but it's graded goes right into that apartment complex now I thought it dead ended that there wasn't a road to connect for people from those 224 units and when you multiply them out at that there's another 580 something cars that you're throwing into the mix that you're putting 600 and some OD in this mix but I understand there plans show a bridge across the draw which will connect wilky Road and connect right over there to Southland to balum anybody can cut across off of Sherwood Way because there's no other route come through that apartment complex go up up wilky Road and Bam they're right there on Southland at botom and that's the problem there's no planning to protect the residents who

[1:15:51] live there their investment in a residential Zone there's no planning on theal on in my opinion from staff to prevent this stick of dynamite that is fusing from just flat exploding and I I agree with Mr Fleming that it wasn't planned properly the stuff that is out there and we have this opportunity to start correcting it um it it again it has nothing to do with the housing it has nothing to do with the development company it literally has to do with the residents the citizens who pay their taxes have not been offered a solution to the traffic that we currently have you've got an apartment complex that is going there behind Sudden Link uh I did the math on it that's another 600 and 24 cars that's going to dump out into that area and you've got a huge beehive right there and I see this is flat exploding the people don't want it it's not the apartments I I think I say that very clear it's the traffic and the city is not offering any relief or any suggestion so they're going to oppose this project now I have to say in good faith and honesty the land is going to sell the owners that have it you know they want they want to sell the land they've held the land for quite some time it could be Zone commercial there could be another strip center put in there right across the street from bottom the strip center that was just built built on Green Meadow is fully occupied they've not moved in yet but it's fully leased and all of those businesses you're going to add all of that traffic in that short around fire department the water tower Green Meadow Southland and the city just doesn't have a plan for Relief and I don't blame the people for not trusting that they're the city's going to do what's right there's no plan to handle the traffic so I cannot

[1:17:53] support I can cannot support the zone [Applause] change further comment from Council well you know it's my opinion have 12 Pages read out i' be glad I didn't well when I go back to City staff and I know I know Liz always brings this up but City staff has really done the background check on this if if they sell this property to another developer that puts in patio homes he can put in 75 homes in this area assume that the entire area was rezoned to re rs1 there's a portion that's r& so it' be less so if it in its current zoning it would be um uh it potentially could be up to 75 units 75 and so we're really talking about a difference between 7 75 and 80 mhm correct okay um what no one's talking about here is all the land that's behind this that's already single family residential or will be when when we Annex in a lot of it back there it will be single family residential it will come down that side road that traffic is there within five years I'll tell you that that traffic is going to be on that road and Charlotte does hit does hit a point really well that we I would like to see some kind of way to widen the road there or try to work on the road there I don't know that we can do it because of those patio homes that are right there right there to the uh the W the east of that one street they're already in place this is an old aerial yeah this is an old aial but they're already in place so you can't widen the street right there that's directly in front of the main School building but I think that could we not widen the road just a little bit where this property is and all the way down to to the drainage eement there back behind Sam's could we not widen the prop the the street there is it possible have we looked at that well I don't want to speak to that

[1:19:55] specifically in terms of the ability or inability to do that I mean obviously it requires acquiring a sufficient RightWay and the like so I mean that would be something you would have to entertain I I think that again it' be part of something a larger discussion about as we discussed earlier Road the the level of service on roads what roads are we going to improved and in the in the prioritization of Road repair and road construction and reconstruction you know where is that fall so I mean certainly that that there's probably some likelihood that part of it could be uh uh expanded if the right away were acquired but again could we do that on the PD though couldn't we require them well quite frankly the site if if we were to require and this is just speaking of the site in general that the specific traffic congestion just by virtue of requiring an expansion of the road uh uh at that site would not would not uh change um address the perceive issue about the traffic and what the level of service of traffic is so it would certainly need to be beyond the scope of just the site in general if you're talking about other means of providing a a a better level of service in terms of traffic flow that's when it comes back to us talking about the other Street going back in behind there really getting to that point in the future that we just discussed correct that's correct the main the main thing that I have on this project and I and I voted for Greg's project before and I don't think Greg asked for a PD in your defense did he he did not and let me just say that there was a several things and that's why I did the first slide they asked for an rm2 the PD in this case is not addressing the issue related to density in fact there the developers imposing PD to to uh to offer conditions that would allow there to be

[1:21:58] uh uh more landscaping and other things that they had intend on doing the density goes along with the zoning so they were the previous developer one had less land they were only looking at one of the Lots here and two they were looking at a more intensive zoning classification so it they're only connected by virtue of the fact that they're looking at multi multif family development in a portion of the site but they the request and the proposals were were were vastly different yes and in in your opinion and why why you guys said to move this forward why you were in favor of this was that it's almost the same amount of units whether it be houses or it be quadruplexes like this and they're they're not Apartments they're not apartments and but there are rental units that are Town Homes correct and so as you stated uh the comprehensive plan talks about a diversity of housing types and uses in the area does call for residential zoning and again the requirement for the for the traffic study did sort of confirm the fact that there wasn't the significant amount of traffic increase that may be perceived because it's multif family so we believe as staff that it's consistent with the plan and and see no reason to not support it one of the arguments that's going to come up in is that their values are going to go down in this area that is that is not a that's simply not proving at all the house is on Green Meadow across from enino Park in my 15 years of being back here in St Angelo I've probably sewed eight or nine houses on that street across from enino Park did not affect the values of those houses at all at all so that area it's a mixed juuse area and that's taken into account when those houses are pricing over there so I I want to try to just head that argument off it before it even gets started that the values are not going to be taken

[1:23:59] down in this area because of this development and the the developer that owns the property back behind here Rocky said that he would be in favor in this he he he was in favor of Greg's deal over there with a few conditions on it and he said he would be in favor of this and he's the he's the guy that I'm looking for for future development on how he's building those houses back there and stuff and and you know this is not his favorite project he told me that he would prefer that it would be R homes up there probably would fit in a little better with him but he said it if we could do that as a PD when I brought up about the trees and stuff especially if we could put a few trees on the back of it he would this he would go along with this he realizes that it's either going to be 75 units going to be 80 and that's really what it comes down to you either have 75 houses or you have 80 Marty do you have any say not not not right Johnny you know I would yeah I'm counting these letters of opposition are in favor let's be real that you know some folks you know I've counted 5 10 15 19 one person yeah I counted five six eight another person six another so the numbers are kind of skewed because it's the same person voting over and over right one person voted eight times and I I should I counted one person that had N I had one person had 19 votes you know I wish some of these developers would even you know I welcome development like this even on this side of town right past this little Bridge right here going to Bill Street there's a bigger track of land street right going towards real Street yes but uh and that's what I wanted to to to come you know get across to you I I hey bring some of these folks over here that interested in developing areas like this I think it's a fantastic layout you know I I I I totally listen to uh the majority of the people out there I understand their traffic concerns is the biggest thing uh I understand the safety you know serving on the Schoolboard at one time I you know I know the safety of the kids comes

[1:26:01] into play but uh I'm I'm I'm on the fence right now I'm just going like man this this looks like a beautiful development but if folks don't want it I mean that we're here to be their voice and uh that that it's a tough one it really is cuz we lose both we lose both ways we really do so don but oh a few things I think that I think it's very confusing when with the packet as Johnny was saying as to who responded how I mean there's I'm not sure why someone responds 10 times signs their name it's the exact same response but um I this is a tough one I I believe that this is not an inappropriate land use across from the elementary school or even in the neighborhood I I very much believe in housing diversity for all uh income levels all age groups all family Dynamics and I think this would actually be something that would um be good for the area I see an elementary school is one of the most valuable things that a neighborhood can have and if I had the chance to you know to have children in this area I would want to be living right across from that school so I could watch them Ross the street every day um sort of like over at Lamar how all that development sprung up because of that elementary school so I appreciate concerns over traffic and I'm not I think we have some ideas as to how to solve them but it face value I'm not opposed to this at all I've had it's not in my district obviously my district doesn't have a lot of raw land for development which makes some of these things easier for me than others I've had about as many calls on this on one side as the other um but it's it's it's not my district but I I I agree with what staff has said in the sense of

[1:28:06] diversification um you know just just to have housing choice so that's I'm I'm I'm leaning towards it but I'm I'm not a strong proponent of it well I've had a few calls as well uh I had a man and his wife called me yesterday and and they just they were concerned about the traffic and I I understand the traffic I understand that well but most of the people have called me have said we don't care where you build it just build it in somebody else's neighborhood rather than ours and that that really is not a good reason for not building it I live out on the North End and you want to talk about traffic there's been about 24 oil fill companies that's been built out in my neighborhood in the last two years and I noticed yesterday we've got a brand new scrap iron yard out there I'd really think that this quadplex would be a better fit in my neighborhood and in your neighborhood than a scrap iron yard but that's what we're getting traffic is all over town it is it is something that's happened in the last two years and there is no way that anyone any City any planner could have planned for the traffic and the the building that's been going on in the last two years and it's not going to end it's going to continue so I uh I can understand the traffic problems but I cannot understand and I will not accept this this argument build it we know we need it but just don't put it in my neighborhood put it in somebody else's neighborhood that one doesn't work uh could we ask them to instead of building 80 homes if they just eliminate one quadplex that way it'd be 76 as opposed to 75 because if the people aren't opposed to the apartments if all they're concerned about is traffic if we build 75 houses on an rs1 or 76 quadplex we've got the exact same thing so could we ask that maybe they just build one less now everything is equal and everybody' be satisfied would you like to hear from

[1:30:08] the applicant at this point sir okay great I get you on flip flop y want to talk about the traffic counts okay right here we want to we want to card you okay great give me your name and uh hi I'm Richard Finch with white oak development we're out of Memphis Tennessee I appreciate all of your ears I know this has been an an interesting and Hot Topic um so I appreciate your patience with us um that's a great question and I actually you know said something to my my cohort over here about what if I just got rid of one building would that solve the whole problem and you know I would look at that it does come down to economics and you know it it the deal has to work um and it might it might it'll be a little bit tighter than it would have been but it's something I would absolutely look at to get this done because I you know I love the site I absolutely love the site and you know I'll be quick but you know the traffic is the issue I did a traffic study you know it showed that there wasn't a dramatic increase in in traffic and congestion there's going to be whether I build or not there's going to be increase in congestion there's no question um you you know the as far as property values we hit on that I mean there are actually facts and studies that show you know I think it's a national home builders study and I can get you the information that shows houses within 500 ft of multif family homes actually increased slightly in value from 95 to 2005 um as far as the number of cars councilwoman farmer you know I I take some I I I take a little bit of uh I feel like you're not misrepresenting but you you can't just take the number of bedrooms and multiply them by cars it doesn't work that way you know there are statistics that show multif Family Apartments actually have fewer cars than single family homes so by that logic I have less cars than if these were patio homes even if they were 75 you know even

[1:32:12] even if I'm building 80 versus 75 so you know I think a lot of it is just an emotional response to what this is which is you know these are Apartments quote unquote but I don't think the really like your typical apartment and what people think of Apartments these are quad plexes if you look at the neighborhood it's going to look like single family homes um councilwoman farmer asked that you know what if you what if you put a fence around it well I I got a rendering done and and I would agree to put a fence around it you know it would be ornamental and and I can show you plans um as far as my neighbors I had a meeting with them to find their concerns which mostly are traffic um but Rocky templin who I think was responsible for 19 of those nons supports I think it's cuz he had 19 Lots um you know he said that he'd be in favor if I put screening trees in the back and I have have a new plan that I just got yester today that has I think 16 screening trees in the back to you know to that will grow into mature trees and you know that that'll be a nice nice for him so that his neighbors won't have to look at look at our Apartments keep in mind our apartments are two stories 28 ft a single family home under the current zoning rules would allow to be two stories and 30 30 something feet so the other the other point I want to talk about is you know the deceptive nature of this you know Mr uling came in with a zoning that would allow for 35 units per acre I am coming in with a zoning that would allow for 25 units per acre but I only want to put nine units per acre single family homes you could put eight so you know it's really I mean I'm trying to be you know as as Cooperative as I can and then the final point is you know your vision plan and I applaud you for having one because a lot of cities don't your vision plan this is just perfect for your vision plan it's you know it's about creating a neighborhood around a community center like a school well the schools across the street it's a great buffer between commercial and residential which is you know it's right

[1:34:15] in between commercial and residential and it's a good transition it offers a mixed use a diverse style of housing you know for for occupants so you know I feel like a lot of it is just an emotional response and I'm trying to give you know facts to counter those but at the end of the day you know you can't make everybody happy like you said so I think you just have to look from my standpoint I think you have to look at it from the vision plan that you you spend a lot of time and energy on and this this is a great way to execute on that plan otherwise why have Vision plans so that's probably way more than what you CAU me up here for but that was sort of my my take on it um so to answer your question if you made that a condition of approval then you know I then I would either do it or not be approved I guess so that's my response to that question thank you sir I wanted to respond to the developer I do like your plans I do like as you say it does fit the vision plan and I believe in those buffer zones uh from commercial to residential to the R1 I'm strong advocate for the buffer zones and this is the perfect plan I mean it's a good plan I won't argue that uh it's desirable but what I am arguing is there's not a plan there's not a vision on how to do and what to do with all the excess traffic and that is what I'm hearing is is the hugest concern and until we've got a plan and we will do something and say this is what we believe is a good alternative uh I I have to listen to to assistant superintendent of of the school district how they feel which is strong and and getting their participation to help divert any traffic you know I've got to listen to their wishes it's just not ideal directly across the street then we've got the fire and ambulance and the calls that go to that station and the service and the traffic that backs up because of that it all comes down you know to traffic and

[1:36:21] that that that's my only thing if you had the city had a plan says this is what we can do for the traffic uh you know I financed these projects and I know what you're talking about whether to take one building one out or to leave it in there I've financed them for a number of years the income producing property I've also managed properties and I guarantee you you got four people that are of age to drive in a two-bedroom unit each one of them will have a car that that's the fact and in a single family home you're in the same boat that's true so and that is my point is when if you reject this which you know I understand it's a hot mud issue but if you reject this nothing changes nothing changes everything that you're talking about is going to happen it's still the same and that's the reason I was beating up on planning in this way at least in a PD you get to control it you have a say Elizabeth do you have a c in well I don't know she's probably been on the the council longer than they've been in the planning department but anyway who's counting um my question is the way the PDD is written does it limit the number of units or does it just reference another the zoning classification of our the S I think the it's whatever zoning you over or the overlay so the overlays R in1 it may be a question for Patrick do you see what I'm asking yeah that may be and the PD it wasn't offered as a specific condition um he he would conformed his site plan as part of the PD which call for 80 units and so certainly he could potentially offer a site plan that would require that would offer less units but it wasn't a specific condition of the PD other than obviously what was included within the site plan okay but is it possible for in okay if let's say if we approve this as written is there any way for him to

[1:38:25] build a 100 units no no okay so essentially this PD caps him at 80 units correct because the proposed development envisions 80 units which is 36% of what he could potentially build but he because he proposed 80 he can't go above 80 WR in there as a c okay and and is the is it written in here this tree buffer to some other property no this is this is new um we that should be part of a motion if correct that that that's new that's that's okay so certainly any conditions that you believe um these are generally the conditions um if you are talking about specific issues related to site plan that you want to include we can make those part of those conditions well I'm I'm going to say again I think that if I had ownership of this property I would try to maximize my um proximity to the school and um I think that it's uh it it should be used for families and and again I don't I don't see the development as being contradictory to that I think that it's a it's actually a a compliment so uh can you tell me how many parking spaces you have I hope it's on here let's see here and is any parking allowed on that uh that side of the street in that area do we know okay it's all prohibited Patrick do you have a s maybe prohibited on Mills you know it from memory it's approximately 140 to 150 spots okay man that's Club yeah and that's you know that's actual you know the parking

[1:40:28] spines that come off in between the buildings um there are garages you know two two units in each building have garages where you can you know put a car and then there's parking spot you know availability on the driveways as well so you have we're showing we're showing on here 150 parking spaces will be required and the applicant has sh sufficient parking for 153 spaces I got I I guessed right I I thought I read some were in there but I couldn't find John did you have a comments Sir Mr fch I just had a quick question are these rental units or what what are they they are um you know originally we we and we are doing these developments um they're called Oak Manor Villas we're doing them in in a lot of Texas towns Bay City Hobs New Mexico Big Spring Texas adessa so it's the concept we're doing in other places and you know originally we were thinking that we might sell them off as condominiums or sell them off you know as individual buildings to investors who could then rent them out themselves that has evolved that's not our intention anymore I mean we do want to um rent them out as you would an apartment because and we think it fills it it in the other sites it's been a differentiator um you know people like the idea of having more yard having a home field without the maintenance and you don't have someone living above you so um our plan is to it for it to be a townhouse apartment community and another question on any of the other sites you mentioned have you built around or close to a school no no not that I can not that I can think of okay Rodney one of the things I want to just point out to the council is that you know we talk about being business friendly and and people working on projects like this we want these guys coming to town we want these developments coming to town and help us try to develop your neighborhood and over in my district and doing those things they put a lot of work into this it still comes down to me the difference of five units it's five units difference

[1:42:31] and then and really it's not even that because that's what we're looking at on this picture five units difference but Rocky templin owns all the property back behind here which is hundreds and hundreds of units which will be be built out in the next 5 years it will be so we do have a problem with the road but this guy's not changing that that's on us to change and so I I think we need to be working with these developers and trying this isn't our vision plan and this does fit in with with the neighborhood uh and I really see that we need to work with these guys more and we're going to set a precedence on this one of how friendly we are because we've got we've talked about that within the last six or seven months about how uh developer friendly we are to these guys and businesses coming in from out of town we need to work with them as best we can especially when he's not dramatically he's not taking it from 75 to 150 units over there we're talking five units difference my brother-in-law and sister bought a house on Windmill 20 some odd years ago a brand new house and the deer would come up in their yard and it would just it would just pasture land back behind and I remember my brother-in-law making the statement I hope nobody else builds out here and takes away this beautiful part of nature well you can see that windmill now goes I don't guess there's an end to it and I'll bet you that everybody that bought the last house said I hope nobody else builds out here and takes away this beautiful part of nature but that's that's simply not the way things work and it will continue develop because our town is growing and we've got to have places for people to live so any other comments before we before we go to public comment Mr f is there a clubhouse in the smack in the middle or with a pool yes sir there is a a clubhouse community community room workout facility with the with the the pool okay so that doesn't even account for number of units that's right there there's no that's not a rentable unit let's open it up for public comment let

[1:44:35] do we have anybody that's with the kimley horn on the that did the traffic study here no I I I did not ask them there I apologize okay then on planning staff I believe Rebecca she and I had talked about um I have a problem with the traffic study I I truly do do the day it was done the hours that it shows Peak and I I wanted her to maybe address how she analyzes the accuracy of their traffic counts in their report and one thing about the traffic study I mean what it was for was to to predict trips um if there's a problem caused at peak times for you know botom Elementary being used to queue up carpool during peak hours I mean that you know like you said I mean that's not I'm not I'm not fix I looked through the entire report and I could not find any reference or indication to the number of ambulance calls at the fire station and I was hoping that possibly she could address uh how that councilwoman the kimley Horn's not here however when you talk about when you do a traffic analysis you do consider all those factors generally that would impact a development and so uh when you're talking about um other potential issues related to Traffic um police cars fire and ambulances those are those are generalized in a figure that would be included there's there's there's software that actually calculates that based on some some some estimation and so those were included in the figure along with the impact of the school which was the particular emphasis the school and the what was being proposed so all things being equal you would those are the things that primarily uh impacted what result as a level of level service B and again level

[1:46:39] service C and D is what's generally accepted throughout the city and even with even if there was percentage of error that would air on the side of it being a lower number in terms of the counts it's still would not put it into a level of service below a B minus or even C for that matter which is still very acceptable when you talk about build constructing roads I mean congestion will occur with development and again cities generally accept C and even d as far as level of service and we're still talking about a level B which is which is pretty good when you talk about Road networks and you don't have a problem with the traffic study being done on July 15th and they're considering their peak hour at 7:45 a.m. as the peak hour on southin we believe that the study was done accurately the the biggest issue that came about was the issue of the school population and that was accounted for in the study like modeling more so than putting down a traffic counter I guess correct it it's a right there's software that looks at takes in all of these VAR these variables into account and and they did and that's why you see a difference with the am and the and the PM but again the level of service at B is is what would be very would be ideal in fact most cities know they can't achieve that just because of the density of development you find in most urban areas and I want to thank Rebecca for providing me the entire study in my Friday package speaking of Rebecca this is Rebecca why don't you go ahead and stand up she's new she's new the city this two weeks threw her in the frying pan she is our our new planning manager and so you'll have the opportunity to um uh see her uh maybe more than you see me so um thank you Rebecca any any other questions regarding the let's open it up for public

[1:48:43] comment I suppose there will be public comment come forward if you would please I would ask that you state your name I will give you three minutes uh I would ask that maybe it not be the same comment over and over but uh we know about the traffic your turn man I respect that greatly I'm Linda Silva I live on Laurel Oak Drive 4010 the uh Oak closest to the Oak Grove end of all of this situation um I'm a former as saisd principal uh and in also in Houston as well as owning a business here in town so San Angelo for uh 36 years has been home to me I wanted to I've listened to all your comments and I have all written all this out and revised and revised and used different colored ink as I went along and listened to you guys' comment uh our just one our neighborhood is already Diversified we don't need the school I we don't need the apartments to diversify our neighborhood it already is uh we have quadruplexes on Green Meadow and those quadruplexes also have cars parked in their driveways as well as on the weekends and at other times there are cars parked across the street on Green Meadow causing the city buses and others to go around those cars uh on Green Meadow right next to Reflections in that right in that area is where I'm talking about those are quadruplexes connected together and the traffic in all of that is Multiplied here is the here is some some of my personal uh observations these are things that I have witnessed these are things that I have participated in first of all I'm coming here today because I thought it was so important in that I've just spent five days and nights with a family member in a hospital and I thought I'm

[1:50:47] dead tired but I'm going to get up and go today because this is really important because because with this person who is in U who's out of Shannon right now with this person alone one person there were six EMT runs four in June two in July one in August for only one person up and down Southland to the springs unit which is across Sherwood so we have not only the traffic that's going along Southland heading toward the only other access which is Oak Grove to get to the loop and they go frequently we hear ambulance runs all the time frequently down Oak Grove to meta Creek and Plaza del so these are people who need care and have mer emergencies happening three or four at least times a day then let's go across shwood the other way heading toward Grape Creek and we have the Springs unit and we have Royal states where elderly people are also housed and ambulance runs are frequent there so I'm giving you just six one person who had six calls going up and down Southland okay um I am being a former School principal I walk to botom nearly every day I walk about a mile and a half at that point and I walked in front of the school and I'd left my count at home but walking from the the alley across botom all the way to the end of botom property there were about 15 cars just within the space of the school 15 cars going one way I turn around and get I make the little turn there and come back across and I count 15 more so that's that's my traffic study and that's real time of cars going across the traffic I I like to use the

[1:52:49] word multiplied because that's what's happen Happ traffic's been discussed here U very thoroughly um firemen and EMT runs we've talked about that the multiplied cars since I moved where I have there are there were more uh patio homes that were added on uh Oak Grove and on those patio homes there are cars parked in the driveway and along the street the tow houses that were built at the end of Oak Grove almost to the loop though they have parking in the back but these people Park along the front and those cars are there all the time as well um I guess you've calculated garbage pickup mail delivery uh commercial trucks um overnight guests children walking to and from school and I do have to make a point of this at the school itself lines up traffic every morning beginning at 7:30 during the school year along Southland beginning at the at Oak Grove all along they Park to Del to get in the in the driveway either the alley in front of the school or on the other end there's three separate drop off points for the kids at school the same thing takes place in the afternoon mothers are anxious they arrive at least 30 minutes before school is out or in or takes place and drop their kids off I know you all are thinking this is an emotional thing no sir I'm here to tell you the facts that that is what happens every day so you've got a line of cars that are parked there at least twice a day for probably 45 minutes then you've got field trips during the day and you've got other kinds of things that happen M Silva I've already LED you

[1:54:52] better in 7 minutes on a 3 minute time oh my goodness okay the last little word is let's think quality instead of quantity and M Silva I've already allowed you better than seven minutes very thank you and there is a timer right there on the podium and I do set it for three minutes and I would ask that you respect the timer next one to speak good morning good morning my name is Kathy Keaton and I live in Southland right off of Southland right next to Bonham and um most of the things I'm going to say have already been said but I took the time because I walk in that area to actually count all the new houses that are going to be there so um and they pretty much go with what Charlotte said so I walk in that area every day and there's at least 22 new homes under construction right now or planning to be constructed um there are 14 empty lots for sale and there are four blocks I guess that belong ons to Rocky templin back there with new homes to be built um that's room for maybe 125 homes so in all of those homes with two cars each that's a lot of cars um and I have the number here but let me get my glasses I'll tell you what it is um so with the 80 new homes to be built which is only five different now that I've heard there's approximately 350 cars that will be additional coming on to Southland every single day um another thing that I heard and maybe you can tell me Mr construction man um are you going to be making an outlet um to your apartments right there across from the playground in the school I heard is that correct to go into and out of your apartments traic the traffic study recomended we line our drives up with South okay um but that indicated to me that children during not during school

[1:56:55] years when the lights were not flashing and there was no guards might be running across the street to that play area also causing a problem so with all of the additional traffic which we seem to have not planned for that is going to happen anyway plus the children not having a a crosswalk we hope that they'll go to the crosswalk but we know children will be children so I'm just concerned for the safety of the children thank you B thank you my name is John Moore I live at 32 uh 5225 Oak Grove Boulevard uh I'm honored this is my second time to come before you I came once before when this property was in question and I appreciate the council's vote to not allow the construction of a multi-unit complex in this area it has been zoned as rs1 I bought my home in an rs1 district and I appreciate the fact that it is primarily rs1 I would like to encourage you to stand with the residents again who are in opposition to the construction of anything beyond now you keep referring to the number 75 the number that I've heard quoted is 50 which is a drastic removal from the possibility of 80 and so I would ask that you stand with the residents and hold this at uh rs1 as it is currently zoned thank you thank you Mr Moore may I read a email from the school district While others coming out I received an email uh from the school district said spoke with Dr bonds this evening the district remains opposed to the zone change request one of their biggest concerns is the additional feeder Road continuing coming from the

[1:58:58] proposed development onto Southland we are also suspect of the traffic study uh they say conduct another one the week of August 25th through the 29th to see how accurate this traffic study is we have our first admin meeting Tuesday not sure if we can attend but the Area Property Owners should be there in force just wanted to read the email from the school district this morning further public comment my name is Jack Brandt uh I live at 4242 Lexington Place which is about a half block from Bonham school and as far as your traffic study goes any of you that would like to come over for a morning cup of coffee with me or a little tea in the afternoon please do and you'll see what's happening over there but that issue has been addressed and I think that you'll probably make the right decision on that I would like to just mention the fact that when my wife and I built our house where we did in Preston wood subdivision uh it was single family dwelling it was a planned subdivision uh we looked at the plots that were available to be bought and they all said for sale for sale for sale and we're thinking gee people are going to come in here and they're going to build houses and they're going to buy them and they are going to be responsible homeowners well you know for the most part I guess that's working there's been a few rental houses that have have come into existence and I think it's because of the economy uh in other in other uh forms with the boom that's going on uh people have decided that they will make a little extra money and rent these things out and uh which is fine that's the American way but are we looking at the long run or are we looking at the

[2:01:03] short time do you want somebody that's going to come in buy a home invest their money in it and live in it and take care of it or do we want somebody that's going to come in here and rent and let's face it folks they have things called security deposits on just about every home that you see that is rented and there's a reason for that because renters just as a rule not all of them but as a rule they are not as responsible as a person that has his hard-earned money tied up in that property now across from where I live there was a young couple that came in and bought the property and I tell you what they are great they they've uh created a beautiful landscape they they're working constantly on it and I know that they're going to probably be around there a long time and that's what I want to see in my subdivision and if that's if that's going to happen with a bunch of rental property I don't think so come down Lexington Place and just look at the front yards along Lexington place and you can pick out the ones that are owned property owners and those that are being rented so let's let's not shoot ourselves in the foot by looking at the short term let's look down the road thank you thank you sir next good here we go again I'm Vera Kirk Patrick and I live just a few blocks from bonum school um I lived in Austin during 85 to 205 during the boom there like here the city allowed excessive building of Apartments

[2:03:07] strip malls hotels then it happened the boom was over now I did some statistically looking and it seems that booms last 5 to 7 years statistically okay this one may last longer I hope it does companies moved out Apartments strip malls and buildings set empty gangs and vandals moved in slum Lords came in and many apartment areas were poorly managed and became terrible places to live the homes that were purchased stayed but the apartment dwellers left the s anelo in s Angelo any direction you look there's construction of Apartments Hotel strip malls and so on this is great for now um I did some statistics and found that apartments are rented now here for 12 month uh for a year okay we had people there's a rental house beside us we have been there seven years there have been eight families move in and out of that apartment with the with the ab boom that's going on uh one time there were nine men living in this house in apartments I lived in apartments 5 years in Austin and it's amazing we were one of the few that stayed there most people are there for short periods of time and I understand now the leases are for a year so we bought our homes as permanent housing I know people move but if we put apartments in our neighborhood then what's going to happen when the boom ends we ask you to keep our place for single

[2:05:10] housing please don't wait until a child is killed by allowing more traffic across from our school and then you'll wish that you had done something different I've lived in apartments and I know that it's important and it's a place for people to live but we do need to keep it zoned as it was when we bought our apartments and when we bought our homes and so we ask you to keep it the same thank you ma'am oh do you want to see the petition I do have a petition I want have are these any more public comment state your name Harry Harry Harry Thomas I'm a community volunteer and I do not live on this side of town but let me tell you we talk about traffic when the military built all the houses out on Paint Rock Road and I live in that vicinity so I can tell you traffic didn't increase that much listening to all what I've been told so far this morning you're talking about the difference of five families five families so I will tell you that I do not see those five families making a great change in the traffic that's out there the issue here today I think is traffic and traffic flow Traffic Safety as opposed to whether this group over here builds these 20 homes or whether or not another developer comes in and builds 75 homes or you develop the the plot right behind you of additional 125 or whatever that number is we got to

[2:07:14] look at how we're going to be able to get people in and out safely into these these roads I would SU suggest that you've got a lot of truck traffic coming down there as councilman farmer says that probably shouldn't be there we should not allow those trucks to come down that particular Road and that would alleviate most of your problems so what I'm telling folks is you're going to build houses Apartments whatever you're going to build they're going to be built all over this city somewhere we've got to make a decision that people are going to have to live somewhere so why not where the land is in the South part of town as opposed to out in miles or big lake or wherever those other places are thank you thank you Harry further public comment come ahead Sir Patrick we have one more you got someone behind you good morning I'm Richard Salman I think everybody sitting behind this Podium was elected because they wanted to serve the city of St Angelo I would submit to you yes there are traffic issues involved with this but all that traffic probably Walmart and Sams at the end of South and Boulevard created a lot more traffic than this ever will secondly I do think there are solutions I think Carl is indicated and you can verify that with him that there's a possibility of creating a left turn lane there is a left turn lane coming off of Sherwood way up to South I'm sorry up to uh Walmart entrance that could be extended create a left turn lane that I think he would substantiate would create uh a better traffic flow but I would submit to you that this is a good project by Good People by good developers there could be a lot worse

[2:09:18] things that go in this location you could have a scrapyard you might have a drive-in movie theater this is a good plan development for the city of St Angelo and I think that if you're looking at the big picture which I think you are that this is not a district 6 issue this is a city issue I think it's good for the city and all of these people I'm sure have valid Arguments for not wanting it in their neighborhood but I'd like to speak for what about the retirees what about the retired military the teachers that might want to live across the street the workforce people that are living that that might work in these places where they can walk to work I'd like to speak for them because they're not here so I think they if they were here they would say they would like to see this development and have an affordable place to live and a great community in s Angelo thank you thank you Mr salmon and that scrapyard that on the north end of town is two blocks north of the city limits of St Angelo so it's in the county there's nothing we can do to stop it and I'm I'm just just throwing that out there anytime you've got County Land you can have a whole lot of things you don't want and mine's two blocks out of the city limits any further comment no no is there any other further comment before we start I'm ver Kirk Patrick again I was going to ask my group to stand they wanted to stand up and let you know who they are all of you good okay oh cute so that's just a sampling thank thank you ma'am but if you're going to go ahead and and pass this then I have some we have we've gathered together some requests that you ask you to put in if you allow this to be built so I'd like for you to have

[2:11:24] this thank you further comment before we take a vote on this okay can we look over this a second and see what she has she's asking for thank you I I don't know I'm not while we're reading this can I ask uh Patrick a question um maybe also a question and a suggestion I think we see our future and we're going to be looking at a lot of new development and probably in this part of the community maybe up in Dwayne's neighborhood as well but can we see the thoroughfare plan every time we see a resoning request absolutely because I think one question I would have is just like with the other side of this development what is what is you know projected there with regard to Street system certainly we can do that okay one thing that I would like to add if I may is it has not been touched on is the drainage issue that we have in the area of course the aroas and that's the reason I was out driving on the dirt roads and and looking at the drainage talking to Mr Carl um if you'll just stop and recall the drainage that we required of Walmart excuse me Sam's and through there this is right will'll be right next to that property and the apartments that is being built on Sherwood Way the drainage issue that is through there it's it's a huge uh amount of water when it rains too much and flooding and and we need to be careful of any project with reference is how they're going to handle the flow of drainage because this is right there

[2:15:33] that we have to go this has to be put on the ballot and let the uh the residents of St Angelo decide this if we pass it as a council and I'm just asking the council to let the public decide this the majority of the time that these that these uh motions have moved forward it's overwhelming over overwhelmingly being been approved by the public so I'm asking that and what I would like to do is set a term limit of three terms in any one position consecutive terms in any one position any full or partial so it could be as little as five years it could be as much as six years and that's just one position so you could technically serve for six years as a counil person and then six years as the mayor total of 12 Years comments from Council you want to started Liz not not really but I will I I think that there are a lot of discussions occurring at the federal level that have maybe only some relevance to the local level I I certainly don't want to to try to bring every discussion that has some federal implication to the local level I think that local government is very different from our federal system it's very responsive um councilman Fleming you know how many times you're contacted in a day and a week about a particular issue we're overrun with things but I think we do our best to get back to our citizens so I believe that through the the public vote uh that we have every two years for our positions that that is all that's necessary to uh to provide um term limits I think our system is different we're not big money most of us don't raise more than $1,000 dollar to do what we do so it's not like someone's buying a seat here so I personally wouldn't mind it being on a a charter Amendment but I really don't think it's necessary but I I think it's it's it's an interesting conversation to have locally

[2:17:35] and see what our citizens think can I respond can I respond to that let's go all the way down and then I will give you a chance to respond Don uh I know when I go to HB I get I get uh more input in in an hour trying to shop for groceries than than I bet our congressmen do in in a month so uh most of is pretty passionate too and I think that's what the the good thing about a city our size and our local government is I have no problem with with turn limits per se I I think that uh this might not be a bad thing to piggyback on if we were we're having a an election I hate to see us throw it out there um because of the expense I I think our citizens particularly with two-year terms if you don't do your job I don't think you're coming back um and I I think that uh like Elizabeth say said you know we we do nobody can buy us per se and we certainly don't do it for our salaries we do it for community service I look at this more as a volunteer job than than anything else and so um I I don't think I'd really be in support of it Miss Charlotte well I agree with both Elizabeth and Don uh on this it's we certainly don't do it for the money uh we certainly don't do it because we enjoy being called idiot um you know it it's it's something that if we're not doing our job or we're not representing the people that they have the opportunity for that individual member every two years to vote for a different candidate I there's only been one year that I've not had a running mate um and the real reasons that I ran this last time was kind of like the Standard Time said you know why have term limits why if

[2:19:41] there's not a depth of knowledge up here as to what we have been doing it's kind of scary to think that if if you set term limits staff really runs everything and makes all the decisions why do you need a councel uh why restrict them with term limits if their District their people are putting them back in office each time they make that decision without term limits every election and every year we have an election I mean we our terms are two years but every year there's an election uh when you think about that and the depth of knowledge is what's happening what's going on how long a project been on the books like the Bell Street issue is to what's being done out there uh the knowledge that depth sometimes you you need in senior positions and I I see no need to rush to put this on the ballot if if they want to replace me come may they have the right to do so the folks in my district now there may be others like Mr fing said others in his district who ask him to suggest term limits well maybe uh that's their way they can't vote for that person but that's their way of getting someone out of office I I see it as something of that as the tool and that's why we have single member districts as we represent each of our districts and the voters will decide well I will admit as 10 years as a city council member drawing $40 a month and now as a mayor I draw 50 I have built a quite a I am a multi hundred air I see no reason for term limits I mean it's done every two years we have to stand election and if the people don't want us I guarantee you they will vote against us so if we do our job they'll reelect us if they don't they'll find someone else I think term liit sitting on on the local level where we're not serving for money I I don't see it at all Johnny Rodney I uh I truly appreciate the the conversation the idea but I too

[2:21:48] am falling on on this end where if if I if I would have been up if my term would have been up this last time around I'd hate to think what what could have happened and uh and I think it was the folks because I was very uh undecided at the end about running again but then when the folks that elected me really came after me you've got to do it again I didn't think I was going to do it again but again that reassured me that am I perfect no none of us appear a perfect but at least I I can uh feel good about the job that I'm trying to do uh you know it's tough at times but again I think uh I I'm just not not comfortable with not being able to represent folks uh it takes a couple of years just to get your feet wet when you you know people to how do you do it you know well it's it's you know you just have to have common sense but you know it's you know it takes a little while to get the uh the routine of how everything operates and so a couple of years it wouldn't cut it I think uh I mean I'm going on and on but I I I I it's lunch time yeah it is lunchtime but I I appreciate your uh your your your conversation and uh but I'm I'm kind of like with these folks I'll I'll defer my comments to to to Mr Fleming because based on the the five previous I don't think it'll matter what I said yeah you got the last word Ry well it probably doesn't matter but I was asked by several residents in my district to bring this forward and a couple of the things that I would just point out one of the things that I was going to bring up Don is I wasn't going to ask for a special election it would be during next May's election which is the normal election so we wouldn't have any extra added expense on that the next thing that I will point out uh Liz you said $1,000 I raised between five and 6,000 in mine there are no campaigns anymore hardly unless you run unopposed that you can do for $1,000 it just almost is not possible um and I think you raised a whole lot lot of money but I didn't want

[2:23:52] to point that out thought that would I thought that would but thank you for doing so and the statistics show that over 80% of the time thenc is going to get reelected as long as they just keep running for election and especially when we see how low this last turnout was I mean it it was miserably low and you know it's sad that we don't have more turnout and we don't have more people that will that will help guide who is up here you know my came down to I think it was 47 votes I won by 47 votes which to me that's just it's very very sad that I I think I only had a total of 500 votes in my district of 16,000 people so it I brought this forward just to to make a point I see I see the handwriting on the wall that I'm not going to get this I really wish that I could change your mind and let get several of you on board to let the public decide this cuz I I know what's going to happen if the if this goes up for a vote I feel fairly confident that they will be in favor of it just as they have been in the majority of the Cities Nationwide but because you guys won't let it go forward they don't ever get to say that that's all I have to say there is a petition process and if someone if if the citizens are this if the citizens really want this and with the last elections being a very small turnout all they have have to do is get a petition and get the required number of signatures and then it's not our decision it's a decision that is made by Charter so there is a procedure if you do have people that are truly interested in this they need to get a petition together get the reg get them amount of votes and signatures and we won't have any to say so mayor yes ma'am I'm sorry go ahead I'm not sure when we're up for another Charter election is that not sure exactly what drives that I was thinking November but I may be wrong but I I can see where this can look like the foxes guarding the hen house so I I I

[2:25:58] think some public discussion would be fine and maybe with a I don't know if we've had a charter committee before that kind of vet some ideas but I'm I'm not afraid of it I I don't think that we're the right people to be asking though I think it's like the mayor said there's another process that that drives it but the the charter would be the non non special election where that could be dealt with and we do need we do need a charter committee we we had one several years ago and we had some Charter elections that's been four years ago I think it's when we had and there's a lot of things that we need to look at our Charter because there's a lot of revisions need to be made and I would certainly be in favor of a charter committee seven years ago she said has it been that long 2007 and 2010 okay well 2010 probably yeah yeah so it's I would I would be glad to put the committee back together yes I think that committee uh considered more issues than actually ended up on the ballot so whether an issue ends up on the ballot it certainly can be discussed by that committee and that may be something we need to look at Charlotte yeah there's another way of looking at it you know Rodney if um U of course the mayor is the only one that everybody in the city votes for you know so you don't have to live in the district but uh if if folks in Johnny's District likes the job that he's doing and want him there but let's say someone in my district wants him off the council Vendetta or whatever this is their way to do it don't like him I can't vote for him so let's get term limits and that way I can get rid of this one or that one uh you know that brings out a lot I agree that a charter review a charter committee and you know to look at and to see you know if we were I just happen to have with me the the increases in salaries over at the county that everybody's going to get you know four five $6,000 a year that they're voting on for themselves but this isn't about a salary I mean it's it's here to try to do the job and represent the people in our district I remember when stt Angelo didn't have

[2:30:02] budget item and also we had another one that dealt with u item William countis that would be item number 20 because Mr CST has got to go so if Council will approve this we can go ahead and move 20 next and then get 23 and then get to our regular agenda do I have any problem Elizabeth do you have a problem no I wanted 23 first but quick on well 23 was the first one that was asked so that's all right if we want 23 first I don't have a problem I've been here longer Let's Go 23 will we still have time to get 23 and 20 if Mr County's got to be gone by two yeah should okay let's do 23 and then 20 everybody agree yes I wanted 21 first but that's okay but that's okay anybody want to make a motion to adjourn let's go with item number 23 you ready Morgan discussion possible action regarding fiscal year 214 215 budget preparation including but not limited to Major funds revenue and expenditures progress on Council priorities and goals consideration of a record vote proposed tax property tax rate Morgan CH Wen you are own ma'am okay so those are the three things we wanted to go over with you this morning um forgive me this afternoon uh but we wanted to give uh James Flores our manager with code compliance an opportunity to speak first uh in response to a question from last budget discussion and so I'll um I'll have a seat and let him speak to that question about uh fees miss flers good afternoon Council U City management uh first of all thank you for the opportunity to uh do this this has been something that we've been working on for a long time um staff and I so I thank you for the opportunity and I also want to thank uh publicly Lisa Marley for all her support after hour text messages blah blah blah to solidify a process that I think uh was eluded to in the last budget session so with that

[2:32:05] being said I I'd like to um show you what we've come up with in regards to the question I think councilman vman opposed Morgan what' you do to me here time it I can't say these there we go uh uh Code Compliance has proposed um throughout the last couple of months uh to realize some Revenue uh through recoup and ab batement costs currently we that is true cost uh for for doing uh cleanups around the city for violating properties uh which includes mowing Andor abating the property of junk and unsightly uh the proposal is an admin or punitive fee whatever that that uh word needs to be uh for damages uh punitive damages for non-compliance of city ordinance um what I've come up with are actual facts uh these are revenues these are numbers of abatements and revenues generated by those abatements uh since the Inception of our abatement crew um just to give you a little history back through attrition and and lack of resources we lost a four-man crew that was set up to uh Abate properties um and we had to figure out what to do with the person that doesn't comply with either the court order abatement or the officers uh ordinance expectation notice um so we were lucky enough to um strike a two-man crew um borrowed a shovel from Roger havac in in parks and we started abating properties uh we started this in five of 2011 so the numbers are through five of 11 uh through September 11 we did 170 abatements when we first started

[2:34:09] this for a revenue of 24K uh 10 of 11 to 9 of 12 we uh up that to 344 abatements for 44k uh 10 of 12 through 9 of 13 we did 612 abatements for 56k uh and 10 of 13 to May the beginning of May of this year uh we are at 331 abatements for 36k tracking about 700 abatements I don't have the track for the for the uh Revenue just for the mere fact that there's two different charges both of them are very cheap and both of them are completely different um what you got here is an average of of 486 abatements per year 53k of Revenue um so we in a perfect world you do$ 486 abatements you're going to generate $53,000 worth of Revenue again that is at Cost Revenue uh very very very at Cost Revenue what what the proposal does is it combines that 486 number to add a pit damage fee of $150 uh that fee I I uh carefully um uh monitored that it's it it ranges from 100 to 500 uh within our sister city comparisons um most everybody is doing this I took the 150 as as a as a very conservative approach 150 * 486 abatements uh is 73,000 the revenue from at cost labor plus uh punitive damages the the revenue we are trying to realize as a department is 126k any questions or concerns am I going too fast fast is good okay good uh Michael tell you I'm not long-winded intentional use of Revenue uh is exactly what it what it states this is our intent for doing this uh first and foremost we want to do an internal admin division reorg that includes aligning with core mission of job requirements grades equal to sister city uh surveys the bigger thing is we want to cease being competitive in the private SE or being competitive uh in the market we're hurting the private sector I can go mow a yard cheaper than than than any Landscape Company can come out there and do it uh especially the

[2:36:11] yards that I'm doing these are rock infested yards pipe infested bottle infested whatever they are um I I'm I'm am hurting the average um you know citizen that's in the private sector in the landscaping business um we definitely are are looking to utilize this this uh this Revenue to purchase much needed Capital Equipment uh today we are borrowing uh literally hand tools we're borrowing uh heavy equipment um we do not uh have any type of safety equipment for the officers that are actually physically doing this abatement so we're stepping on properties with personal um clothes personal attire uh no safety boots no masks no gloves uh so this uh Revenue stream is obviously U that's one of the first things we're going to look into is purchasing the needed equipment uh and Capital Equipment uh without I for brevity sake I didn't bring the pictures but last Thursday we did a an abatement in Johnny's District that if it wasn't for that little grapple bucket trailer we'd still be there today it was 13 loads that we took off of this property so um bigger thing is we want to offset the general fund by self-funding the abatement crew we can do this uh with the revenue that we're talking about my current de batement crew runs me about $44,000 a year um there's no sense in in in in using general fund money to do that when we have an Avenue to create uh it's not a lot of money that we could take off the general fund but anything helps so uh and the bigger thing is uh aside from this budget season my goal is to wean off of the cdbg funding that funds one complete officer and I think councilman farmer has said it once or 100 times she's never liked the idea of Grants supporting people's salaries and I I I I C with that thought so what that'll allow that department to do which is uh eventually my department I'm a division of NFS it'll allow them anywhere from 8 to 13 homes to be able to do emergency rods based on $5,000 a remod some come in at a th000 some come in at five but me giving up that officer's position which um the way it just came out they're paying for the higher the highest paid U officer position that I have would equate to

[2:38:14] letting them guys do about 8 to 13 more uh rods within the the city um and last but not least you know we we I I think with some type of uh punitive effect in there we're going to change the current culture of violator attitude in regards to ordinance expectation so with that being said I'm open to any questions or clarifications mayor could I please yes sir James I think all that adds up to more than the revenue that's proposed right it does so we're going to try to do our best unless Council has specific direction we're going to try to uh hit the high priorities on there but but all of those objectives you just raised add up to More Than This Revenue we're talking we're about $56,000 low uh you know if we got to the exact this is this is close but very conservative I didn't want Council to think that for this amount of money they were going to get all that change right right I don't have a problem council is there any comments move for approval second do have a motion to approve public comment on this I guess I'll call do we need a vote oh come up Greg I didn't make the motion is it a is it something that we are is this something we need to vote on or is this just a well it's possible action yeah mayor we we'd like your direction there there is some work that we're going to need to do and then bring it back to you for formal approval so we just need a consensus then or do you want to vote what we're looking for uh is the ability to realize this revenue for this coming budget season which do you want to vote Yes okay please Greg CG Myers um wanted to bring up the three points because this is this fits in with uh what you were talking about with some of your doning issues where you try to tie everything together uh connect the dots so that one thing supports another for the last 10 years I've been working with neighborhood uh resources neighborhood and community services and with code

[2:40:17] compliance and first of all all one of the things is before you can have the revitalization of neighborhoods or before you can sustain uh neighborhoods that are uh real viable uh you have to have Code Compliance uh before there were new houses in the uh revitalization things Code Compliance went in and cleaned up the city's mess that they'd left for years and years as well as enforcing uh the statutes of the city to make certain that um all of the uh area around was conducive to attracting new construction and encouraging citizens to do what they needed to do but in the existing neighborhoods any realtor and there's a lot of real estate being exchanged right now will tell you that if you drive down a street and uh there's one house that's really messed up and the property's not kept up your property value goes right down the toilet and your price that you might get for your property is gone too the second thing in here is that uh James mentioned that U he was doing this at a cost that was uh competitive and actually below what people who are violators could get you know we're rewarding people who are violating uh a couple of weeks ago a nice police officer stopped me and reminded me that those signs at the corners don't say slow they say stop and uh you know when I went down to pay that f it had a whole lot more impact on my behavior than my wife telling me that you ought to really slow down or actually stop at those things and there's no incentive for people to clean up their property if the city is acting as a charity agency they'll do it for you cheaper than you could do it for yourself and it's uh the work that Code Compliance has done in this city uh you saw the number of a bait that they did

[2:42:20] increasing Year bye without increasing staff these people are doing a great job and people should not be rewarded for uh violating and they should have the resources they need to do the job that uh they're doing and I hope that you not only um approve this eventually and include it in your budget but you uh look at the work they're doing overall and the necessity of increasing their re resources uh because like everybody's mentioned the increased traffic The increased number of houses uh the new people that are coming in that are trents their job is going to get a lot harder than it is now so I just uh this is a really good thing that he's repres thank you thank you Greg any further public comment not I'm going to call for the vote the vote is that we add a punitive charge to the fees so that we're not cheaper than the guys that to do this for a living it has been seconded all in favor please say I I any oppose Nay put a 70 on it Miss margan okay so we're going to hit on these uh other three items uh pretty quickly in the interest of time um also since there there has we we've spent a lot of time talking about these items already and there haven't been a lot of major changes the um that we were going to go over of uh the changes in major funds revenue and expenditures this is something we usually do this time of year um every year in the budget preparation cycle but since we've been um in so many conversations lately there really are no substantive changes um since last meeting uh they're all the items that we've been talking about for example um increasing the Street Maintenance I think we have consensus Buy in on that the pay increases how to implement those I believe we have consensus and buy in on that Lisa Marley is available uh for discussion uh from human resources that we've we've uh set aside a number

[2:44:22] equivalent to about 5% uh for non civil service for non meet and confer um and and she presented some information a couple meetings ago about um the impact of that on our marketability and to achieve that Council goal also increasing the city contribution for employee and retiree health insurance unfortunately since we've got it um introduce a budget ordinance next meeting and there's still a lot of uncertainty surrounding um how that impact is going to be our recommendation is to um budget uh that up to 14% uh that we know that we know it could be the impact um so that we know that we have those funds set aside to be compliance with any issues that may come out however if there um if that number is less than what we've had budgeted then we certainly will be able to capture that and and reinvest it in other items as is the the councils or city managers uh Direction so that would be our our recommendation and that's all that will change in the major funds between today and when we get the the budget to you for proposal the next item is the to just give you an update on the progress on Council priorities and goals again this is information we've been over uh recently um usually we speak about it at this time but because of the the good progress we've had in work sessions recently I think we're all up to speed on that today that that of the the five items before you some do not have action today or in this year's budget however we're continuing to work through them and um streets were moving hopefully from a what what was a 12year maintenance cycle to an 8-year maintenance cycle um that's what this budget will bring to you salaries bringing an adjustment to Market we will make progress towards that Target towards that 3 to foure plan improved development process again no action in today's budget and the police station no action in today's budget so just a a quick summary on how this year's budget will affect those those priorities so then that brings us to the the last item item C which is consideration of a record vote uh we're called to be in compliance with the um

[2:46:25] the state truth and Taxation guidelines that it's necessary that when property tax revenue will raise more in the coming fiscal year than last year we have to have a a record vote and so that's simply a write down of everyone's vote um to Levy your fee or not um and recall that we can Levy a fee at this time um we can propose a rate at this time and we cannot propose a higher rate at a later date but I think we we are all on the same page as far as a tax rate of 77.6 so uh that's the last item we need from y'all today okay do you need a vote on this today yes please sir okay someone want to give me a motion that we accept 77.6 per $100 valuation on the property tax rate that's no increase is that correct that's no increase that's flat that's there no increase at all come down later but we can't go up that is a correct statement sir motion to approve second do have a motion to approve this does not raise the tax rate in fact in the last 10 years we've dropped it a dime so we and we will continue to do so but this year it will remain flat may I take this opportunity to point out something yes ma'am I was referred to as an idiot and I guess I am but U when I made the statement the city of s Angela has not raised property taxes in 10 years we haven't like the mayor said the city has not uh can't say for the county and it can't speak for the the school district and what people need to understand those three entities make up the tax rate on your property and the city has not we have rolled back and that has been through concentrated efforts from this Council and staff so I just wanted to clarify that and something that I was reading on the web page recently they've got the city and the County's tax rates re reversed showing what the counties is is it says it's a city so we need to make that correction because it it's just reversed on the city's website mhm okay one of the bloggers called me an idiot

[2:50:30] properties to it 1940 St an Street located approximately 1,700 ft east of the intersection of South Bell in St an Street more specifically occupying 4.75 Acres of the G shubitz survey 0326 abstract 185 four East s Angelo changing the zoning classification from General commercial heavy commercial cgc to a manufactured housing Park IM HP District providing for severe ability providing a penalty brother Howard you are own sir okay uh thank you mayor um this item came up uh as a result of the robust uh discussion you had about the RV park so uh we probably don't want to revisit all of that however during that period um we did have a um situation come up where an applicant where a resident who was an RV park owner um had a special use permit to operate uh a mobile home/ trailer park slrv park and this the intent of this action is to legitimize uh the existing uh use of the property um and uh it did go before Planning Commission well let me just say there were three notifications sent out and uh none were returned uh planning staff did recommend approval it did go before the Planning Commission and they unanimously approved it as well um again there was a special use permit that was granted in 1972 uh there was some questions about some of the language included in the per and so uh the recommendation was to move forward with legitimizing what was existing uh and to move forward with the MHP uh rezoning which is uh what's uh you're entertaining today so um I can show you some more background however that's a general this is really just housekeeping yes it is it's just legitimizing an existing business to make it right that's correct I I move that we accept this change as written

[2:52:34] second I've been working with Mr ctis since I've been on here so be good to get this done Charlotte well I got a call a phone call with specific to this so I drove the entire park I'm amazed that maybe code enforcement needs to be out there for habital conditions um I I I don't see how we're passing health code and it needs to be looked at it's totally separate that's a second that is a separate deal to what we're dealing with today but subject property I I'd like to hear more about this um I mean just because there's been is this a mistake of the asked by someone and we're legitimizing that just because it exists on the ground not exactly the the special well yes and no the special use permit was granted in 1972 the applicant requested a mobile home park he received an a a permit for a trailer park at the time there was no language specific to how that was defined and so he's been operating as a mobile home park or manufactured home park since since that period and it's obviously changed ownership hands uh and so it was an existing Park U but the zoning the zoning never was consistent with what was being it was being used for but the vehicle used or the instrument used was a special use permit and so um in addition the electrical services installed is consistent with its use not necessarily consistent with that initial special permit that's right and and so uh we we believe that that that you know this the use represents the substance of what the understanding was uh and the the vagueness or inconsistency We Believe exists in that initial special permit well and along with that Mr countis and his his partners are wanting to improve

[2:54:40] the facility but they after their initial purchase of it uh weren't able to get permits because of of this spoa and so consequently and rightfully so he didn't want to spend more money on it until he could get this work down and realistically he could continue to operate the park at under the special use circumstance he could he could we believe that there was error on the part of what was envisioned in terms of the the uh the use and our belief is that it would be uh we have more purview over um how to look at the development moving forward if we were to bring it in compliance with an existing zoning classification so this is what this is intended to do do have a motion to approve I do have a second do I have a further Council comment first I have a quick question yes John Patrick how up to date is this photo which one you looking at a photo the areial that one uh it's it's fairly recent I mean uh I thought there was a lot more mobile homes out there but well I mean this was a couple months ago I I don't believe that the applicants there shouldn't have been any additional mobile home but um so I I can't really yeah is that all John Charlotte I have to ask that our Texas Bank sports complex is right there on the other side of the the school yard in the city's yard how does changing the zoning affect the purpose and for the softball complex it doesn't it doesn't actually could be an advantage uh to the extent that uh he has RV spaces available people who travel to town uh and want to stay in an RV could utilize this this property and again

[2:58:50] consistent it is consistent with the with the plan and the surrounding development it did uh so we did recommend approval as staff and it receive unanimous approval from the Planning Commission so this is the property uh in the subject property outline in red as you can see there is it's bounded by Ranch and Estates and also single family residential primarily um in the general area here's an area view of the map um a lot of the area is more mainly undeveloped um uh fairly rural in nature for the most part there was a previous special use permit that was requested for a greenhouse in the past again we believe that the areas the recommended requests is consistent with the general development patterns um and with the both the land use map and the comprehensive plan so the following slides essentially just show uh views from the pro subject property looking north south east and west Marty this is yours well take it I mean this is not like building quad plexes in Southwest s Angelo but this is using a barn to live in I I have a small barn and occasionally my wife sends me out there to live in it for a day or so so I I would recommend approval I have a motion to I have a second second who got second Don short I just have a question uh what is the drainage they want to put horses five horses in what is the drainage the water runoff situation here um well and looking at the at what was being proposed it didn't trigger a study per se um and so we believe that it was minimal mitig minimal um impact in terms of the storm water man I have questions Elizabeth I'm looking

[3:00:53] for the special okay here are the conditions so what you're allowing you're proposing that a barn be built on a single family residential lot correct with no residence on the lot so essentially that is a non-residential use correct correct okay so in these proposed conditions is there any stipulation as to by what time they have to build a residence there is not however that could be a condition well I I think you know certainly the area has a very rural character my only concern is that over a period of time when someone doesn't live and occupy the area they might not take care of it the same way that the residents do um it's kind of an out of sight out of mind so as a matter of of policy I don't like this um I think if that was a condition that that they were going to be occupying side I don't mind someone building a barn and getting a piece of property going getting it cleaned off but without a residence proposed by a certain period of time I don't like it I think you're change essentially you're changing the use of the area I don't have a problem with man building a barn on property that he owns so he can have a place to keep his horses yeah personally what's to prevent it from becoming a riding stable or training facility is it's not commercial it's r& I thought was R1 RNE I thought is it r or R1 no it's R it's RNE yes and that those that more intense use would not be allowed in that zoning do have a motion to approve do I have further Council consideration do I have any comments from the floor call for the vote all in favor please say I I oppose Nay Nay Nay put uh 52 on that one please number 18 first public hearing consideration of introduction of an ordinance amending chapter 12 exhibit a zoning ordinance of the code of ordinances city of St Angelo z145 boardwalk builders LTD an ordinance

[3:02:59] amending chapter 12 exhibit a of the code of ordinance city of San Angelo Texas which said exhibit a of chapter 12 adopts zoning regulations use districts and the zoning man accordance with the comprehensive plan by changing the zoning and classification of the following properties to wet an unaddressed track comprised of approximately 25.4 Acres bordering the west side of South cono drive and I guess that's and East and east of bride Avenue and for South s Angelo more specifically being a combination of 25.4 Acres out of the JJ schaer survey 0646 abstract 1882 in the CZ survey 645 abstract 4212 in far south s Angelo chaining the zoning changing the zoning classification from plan development PD with underlying single family residence rs1 and lowrise multif Family Residence rm1 to a single family residence rs1 District providing for severability and providing a penalty brother Howard okay um in this case the applicant is looking to remove the designation of PD and remove the uh Associated zoning of rm1 and allow for the entire track to be rs1 um Planning Commission did recommend approvals along with staff uh we had 26 notifications sent out and two were in opposition this is in the lake la lake nasworthy neighborhood uh in single member district number one uh the idea of single family residential is consistent with division plan map the previous proposal allowed for IC single family residential and some uh more intense uh residential as well again the the idea is to go revert back to Simply single family residential rs1 um it is less intense than the previous uh there are really no change in the conditions of the area and we

[3:05:01] believe this consistent with the area development so this is a the out area outline in red is the subject property it's currently again PD with rm1 and rs1 um there is adjacent rs1 in the area as well this is an aeriel also this is a l use uh recommendation for for neighborhood and then these are views of the property looking East and then West North South so in summary we say is consistent with our vision plan map the it is a a down zoning of sorts um to some degree with a less intense uh zoning uh for the entire tract um the area Still Remains developed as when the previous application was approved and it is consistent with the development in the area so um staff is recommended an approval Rodney this is yours move that we accept it as written second second do have a motion Rodney as that we accepted as written I'll take Johnny second do I have any further Council comment on this Charlotte just have a question yes ma'am what was it zoned before it was changed to PD it was very good question it was primarily rs1 without the RM it was all rs1 with a PD overlay and with allowance for rm1 and he's now wanting to revert uh back to rs1 without the stipulations of the PD and the rm1 I'm just having trouble understanding why the PD didn't come to pass the PD is envisioned for when there are there's a mixed use development in place the the applicant is thinking that they want to develop the property now for primarily single family residential

[3:09:08] proposed development and um this does allow for Effective transition between in the zoning between the uh inter state and the joining development the applicant is here he'll provide some details about uh his proposed project but I'll go through sort of the Lan use portion this is the property in question uh it is General commercial again they're seeking heavy heavy uh commercial um there is a joining uh single family residential um that uh to the northeast of the property however it is bounded by Houston har uh on the southern portion and undeveloped property to to the very uh East immediate east and west of the subject property so here's an area of the property and this is the land use recommendation for commercial along the areas AB abing Houston heart with uh commercial uh with somewhat of a buffer with the Smith Boulevard being um being somewhat of the transition Point these are aals uh these are pictures of the property looking looking from North from the property uh South uh East and and West the applicant is here to provide some additional detail on the proposed project if you'd like joh this is yours you want to take it this sure um I'm totally against it I uh uh it would be just directly across the street from single family residences it's a block and a half from my house and um you know the uh the noise and and all the different things that they can do there um I've had about three different calls

[3:11:13] now uh that are in opposition of it also I think that it it makes for a bad transition along with the fact that paulan Baptist Church um has a joining property there also and uh I just don't think it's a good fit for the neighborhood put that in a form of motion yes move for uh denial second do have a motion to deny I do have a second is there any further Council comment on this before I open it up to the public I have a question yes ma'am in driving uh yesterday for the the agenda items I tried to look at each case it was on here but the development standard heavy commercial requires a 25- ft front setback for any structure truct that's the structure that doesn't require setback for any sales Vehicles you know tractors trailers trucks you know is is that also required or is there no requirement the way I'm reading it that's correct okay I guess the only problem I've got with this is not for the proponent now but when we change a classification on a piece of property that goes with the property and if he sold it tomorrow man there is no limit of what could be out here uh let's take some uh comments from the public come head forward sir state your name I'm going to give you three minutes if that's not enough if you'll tell me I'll ask Council to give you more yes Ma I'm John go I'm just a recent uh new transplant from goodfill Air Force Base I'm actually retiring here in this uh City I live on 2838 Selman drive so I'm within about 500 ft from this property I have some basic concerns with this proposal to change this property because it's going to threaten the livelihoods and former military members and Military members who do live in Poland who do not realize the effect that this will bring to our neighborhood our neighborhood is nice

[3:13:16] safe it's sound yeah I have to deal with the occasional uh ambulance drive you know firefighters police going up to the to the correction center I don't mind that but with this proposal this heavy commercial can potentially bring 247 hammering and Commercial activity I don't want to deal with that on my drive alone I'm already dealing with Oil Workers who are bringing their equipment in on my drive you know along my road I haven't gone to code enforcement yet but it's starting to irritate me okay in addition to that it's going to affect our values of our homes I have been lucky enough to buy a house in this city at a low point and now my house has gone up with this implementation of this commercial property I can see my properties as fellow military members watch that property value go down also and suffer losses that we can't really afford because we only get paid a very little amount of money I I'm sure you guys all understand CU you only work for $50 a month so 40 I get 50 40 rest I'll get the money um the planning I I'm sorry the planning of this thing I don't believe that this should be even commercial I think that it should be more Geared for residential because I look at the Town overall I see expansion of residential I see this area Paul an as a big expansion point that could potentially be developed rather than commercial but be single family homes I feel that I I'm going to try to find the way to go through that through that process but there's no buffer zone I'm going to have a heavy commercial place within 500 ft of my house because I live at the end of the end of the road but I have four military members that live with children that's going to live within this 200 foot buffer zone that they said that they you know notified most of those individuals don't even know that this is going down because

[3:15:19] even when I went to New York the zoning change sign actually fell down so the day I came back from New York I saw the sign I called the number and it had already gone to a compling commission so I I approached the council to humbly say please do not change this to heavy commercial because it's just going to ruin my family's lifestyle and my fellow former military members Lifestyles because my whole block is pretty much military and they don't they don't realize that this is going to happen and their lifestyle and their values of their homes may go down so I thank you thank you sir do I have any other comment hello Mr Meo you know the drill I'm putting you on three minutes little buddy it's going to take one minute May okay honorable mayor and council member um I'm a peris menz I guess I'm well known around the city and the staff I appreciate what you are doing for this city uh with all that money you getting I know you want to stay there right this particular property was originally zone rm1 for apartments you know I live down the street from that property my concern is is that when you don't have a purpose a planed purpose of what is going to happen there especially so close to this gentleman home and he had explained where he lives there or Salman street it's brand new homes you live been open for anything to come in there and with the all industry the way is is coming on progress is great for the city progress brings headaches and you you can tell that

[3:17:22] today with all the changes we are a nice Community there you know we have been we have struggle for all kind of some changes there and what this is doing is it's not a purpose of what is going to be happening there you leave it open for anything so I submit the request that you deny this uh on the basis is if someone want to develop that property come out with a plan a determine plan and tell us what with I I have supported changes there that the community didn't want but it was beneficial for the city and our progress so I'm humbly ask all of you to deny this request thank you thank you Mia Mr Darnell afterno mayor city council uh my name is David Darnell I'm in the process of trying to purchase this property and what the intent I'm going to use this 5 acres for is to build a nice office facility for my construction company we do have dump trucks back holes excavators 99% of the time they're not in that location they're out on a job uh as far as storage we we keep on hand pipe valves fittings things that we incorporate into different cities even this City's uh water and sewer Distribution Systems and uh our intent also is to have a privacy fence around this property like we had on out on 50th Street when I had an office out there so it don't it'd be real close to what we had out there on North chadman it' be a nice facility uh as far as res residential I'm not sure I wouldn't want to live have a house out there on that frontage road with the the traffic that's up there on 67 now so I'm not sure where

[3:19:26] that's coming from but uh I will tell you this if we if if this does get done you there will be a nice facility in that neighborhood when we get through thank you David Mr Becker my name is Charles Becker I'm the one that's selling the property and uh the thing is right across the road Dawn uh you've got a 18wheeler that's been there for I don't know how many months it has a Road off of garden I've got pictures of it it parked right along the side of the street been there forever and then over to the left there the side of to the east of Paul land on their property there's a huge plow a road plow that you plow roads and make roads with and a big roller and mosquit grown up in them I know for two to three years and to me that's heavy commercial that they're using it for that truck's in and out all the time so anyway it's not a bad deal so whatever y'all think appreciate y'all's time and wish you got paid more guys thank you thank you beger do I have further comment Charlotte I um had the opportunity to visit Paul Anne Baptist Church not too long ago my little great grandbaby was being dedicated at the church boy there's a lot of members out there there's a lot of traffic on Sundays and I was reading in a paragraph in the planning one of the oppositions and I guess it sticks with me so I'm going to get back up on my Soap Box about traffic andc and so forth right quick you know a heavy duty piece of equipment takes more space and more time to stop than regular car traffic and I I cannot

[3:21:29] feature this being between to have to go through and these heavy pieces of equipment to get to a residential when our limited access to that subdivision is what it is so I I can't support it because of the safety issue further comment from Council come on up David I'm going to give you the minute and 57 that Becker left on the clock as far as the traffic issues you know our intent is to go up the highway and turn back in by Howard College and come in front road cuz our entrance is going to be on the south end of that property now my pickup and my small trucks yeah we'd probably drive through that neighborhood by that church but our big trucks will not thank you David in defense of David I've lived by by his construction company out on chadburn for years and years and it was a nice facility it was well kept up it had a fence around it so uh you know in the fence David you you have done what you're supposed to out there the only problem I've got with this is that if we let you build today and you leave tomorrow there's no telling what we'll get because this classification goes with the property it doesn't go with David dornell and that's the only problem I've got is what could happen not with you there but what would happen if you were not there right and uh that's kind of where it stands do I have any further comment from the from the public one more yes you got 57 seconds left to Beer's 3 minutes 57 seconds thank you sir uh in all honesty the the heavy Industrial Area you know he said that the the semi- truck's been there yeah it's been there and code enforcement has not caught it so you know I'm getting that's why I'm getting mad is because you have this big big rig sitting out in the middle of Paul Anne Baptist's parking area well the undeveloped area and then the heavy roller and the bulldozer I recall it was in a home development that was adjacent to the mobile home part that has stopped

[3:23:33] I don't recall who the company was but it's still there so I don't know maybe they just thought it was their parking area and don't have any money to move it so um if he leaves That's Heavy commercial commcial now that opens it up to oil field and that's my fear is having oil fill because it's already on my driveway so that's all I have to say thank you sir thank you sir I'm going to call for the vote the motion has been made that we deny this it has been seconded I will call for the vote all in favor of denial please say I I any oppos say nay drop 70 on it let's see we've already done number 20 this is number 21 update and possible action regarding the 19th Street sidewalk project requested by council members farmer and vman presented by city engineer Carl bednard good afternoon Carl Bedard city engineer Mr Carl thank you I just a quick update um this is on 19th Street project sidewalk project runs from Bryant to Del Street I don't I don't have a presentation here I just have few words for you it's on the south side of the street uh We've identified 27 parcels of land that we need to uh have some access to to put the sidewalk on to dat we have 14 licensed agreements from Property Owners out of the 27 uh speaking with legal yesterday they they talked to someone on the phone in that Corridor and they they had five of those lots and they were going to sign it today or soon and send it in so really that gives us 19 out of 27 that we need that leaves us eight more um and those of those eight I'm sure they're going to need some work because they they're it's taking us this long to get them it's going to take us a little bit longer some of one of them I know is involved in a trustee um situation and so we have to identify the people there and work through that legal is uh is going to be helping us a lot on this eight remainder uh Parcels as far as the engineering

[3:25:36] work on it we're uh complet have completed the surveying work and uh we're ready to start on the design on that so it it should move back move forward pretty quickly on that so I would say Giddy Up When do you have how long that piece of string is and when you're anticipating that actual sidewalks will be down and completed some sort of Target date would be really nice to shoot for I have to refer that to Legal because probably the other eight Parcels may be in in the I'll just answer I mean it is our goal to obviously be expeditious and in completing a project acquisition of pro a property is something that we can't necessarily predict we've been we've sent out letters we will take the means necessary to move forward um if that ultimately means um condemnation which we obviously aren't inclined and want to do but we are we are taking being creative in our attempts to try to contact the property owners and express our uh you know serious interest in acquiring the easement to move forward so it'd be very difficult to anticipate how long that's going to take however once we've acquired the properties it should only take about uh three to six months to complete the work so that's what we're anticipating so we are working collectively with our city attorney's office to continue to work uh be very diligent about trying to acquire these properties Patrick can we have a a drop dead date where we say okay after this this date we're not going to get a hold of the people we need to to go ahead and start legal for Senor we can if the council is so inclined we can Pro if that direction is given to us we certainly can move forward in that way I thought I thought Mr C was going to walk with us he did he did walk uh he did walk and that was a part of why we've gotten the more the recent uh responses that we have and so he's been uh rolling

[3:27:39] up his sleeves and really help assisting in in trying to help um help us in this effort so he's that has occurred is he aware of the nine that we haven't got he is aware it just seems may I oh I'm so sorry this project has been going on four five years you know it's just a never ending because we just never wrap it up and I I think the citizens that uh walk and shop in that area are are deserving because of the high amount of traffic that we need to make it a right well to be honest it it's only been in the last 5 months that we've actually started moving moving forward with with design and acquisition so there was other issues related to funding and approval of the project that has caused the such the delay that you've experienced but since in the within the last five months all of what's what has been discussed is what's happened why why don't Cindy did you council member fmer on and um council member of ardman I wanted to have Cindy give some very specific information as we've been um up she's been updating me every day about the contact with the citizens which I know is your concern so she's walked up in the meantime and here she is thank you we were able to acquire four additional easements in the last two days we've had um confirmation from several Property Owners after we've made personal convers had personal conversations with them that they will be signing the documents um they lost the first um instrument that was mailed to them we are providing um self- addressed stamped envelopes to assist in returning that we've had positive uh reactions and discussions with the remaining Property Owners so we feel like that we should complete the task of acquiring uh within the next few weeks so what in your opinion is a a good drop dead time it is 2 months long enough or

[3:29:47] yes yes sir I feel like two months would be um we hope to have them all tied down by that time okay and may I add um I work closely getting these updates with Cindy and um she's done an excellent job phoning and reaching out however what we can't control are the the property owners whose property is um tied up in an estate and so therefore we would be required to commence condemnation uh and so that would give a longer time frame uh so at we Cindy and I will sit down and we'll look at the the various uh property owners that we have absolutely no hope of um having a consensual uh you know agreement and we can update you on that well I'd like to borrow a phrase from my esteemed colleague and to steal it from me I don't want this to become the Forgotten Zone mayor so mayor yes sir Marty and so and then we we were at 14 we got five we're at 19 and Senior you saying we're at four more to 23 now no that 19 does count the ones that I had conversation with um we do have some heirs that have never been notified so we have identified The Heirs now and are reaching out to a spokesperson for the family in hopes of having that spokesperson contact The Heirs that are do some type of an an assignment of their interest to um power of attorney or some form of of legal action so that the one person can sign on behalf of the SS okay thank you Michael mayor uh if I could clarify uh understanding of of what we heard two months that would be the first meeting in October that we would report back with the current status of the uh license uh agreements and get final approval at that point from Council to move one way or another

[3:31:51] is that is that right councilman dep yeah good plan Miss farmer are you okay with that timeline also all right keep the ball rolling all right number item number 22 discussion and possible action on matters related to the fiscal year 213 214 budget and specifically General capital projects Ms Morgan hello I have uh one item we're taking a step back and talking about the current Year's budget that we had discussion early on this fiscal year about how to allocate the pay as you go Capital that was set aside in the 2014 budget um and in your background is as a list of the budget was um which I have listed later here however just to clarify that we did take action uh to fund a portion of the the fire truck that we fund every year and then the Fairmount Cemetery Improvement so those items are not uh what we're bringing for discussion today just as to clarify so we started the year with a budget of $1,756 th000 and change uh after we backed out uh and allocated monies for those two projects uh previously approved that left 1 million $190,000 in change available for other Capital items and so this is uh budgeted and uh available for for use uh but we um when we had discussion early on this fiscal year uh we weren't um we didn't have a specific slate of projects that was approved at that time and so staff has brought a slate of project that we recommend for approval and we can go through these uh individually um but this is uh a summary of the list that would bring that would completely allocate that remaining budget uh okay the uh the we just spoke about 19th Street sidewalks it wasn't a budgeted project as far as the the construction um or the right of way acquisition and so we would recommend uh to to fund it preliminarily at the $136,000 which I believe is what's

[3:33:54] reported in our Capital Improvement plan and has been in your background however uh we do know that there is some uncertainty there about any expenses that might be necessary uh due to ride of-way acquisition and so we would have to address that at that time however we would recommend going ahead and setting aside that $136,000 at this time the next item that's for recommendation is uh development services software Solutions um since the improved development process is uh a priority uh for Council uh in the 2014 goals uh we recommend purchasing and/or upgrading software as one way to start accomplishing this their uh additional options to achieve this goal will be uh vetted and presented as they're developed however we would recommend funding uh $100,000 at this time for for software Solutions as it relates to e submissions and and other items that that initiative would not go forward without additional uh communication with Council this is simply budgeting for that amount the actual proposal for the specific solution would would come back to council before we would execute that expenditure the next item there is also an item off of our Capital Improvement plan list uh fire mobile data terminals these These are the computers that are in ambulances and Fire trucks uh to assist uh the the folks in the field to to communicate with dispatchers the current terminals are obsolete we cannot get parts for them anymore we cannot service them uh the police department we were able to upgrade in a prior year however we need to address uh the need in the fire department at this time so that would be a cost of $182,600 in addition to that uh there would be an operating expense for the uh the wireless service to those however what's being recommended for funding right now is simply the uh the the capital expense the next item is also uh from the fire department the self-contained uh breathing apparatus packs are necessary to provide the minimum

[3:35:57] respiratory protection during a a fire event um so the we're we're beyond our 15-year capacity for support on these items and we need a complete replacement of um of every unit we own and so that's costly at an expense of $531,500 uh the next item uh recommended for funding is the local match necessary for the transportation enhancement project this is as it relates to downtown improvements to pedestrian and Transit infrastructure uh recall that we do have a uh a grant for this item and we have a a resolution by the council to provide the local match and we recommend that $140,000 of this uh local uh general fund dollars be used to to match that Grant then the last item before you for approval is uh facilities maintenance uh this includes HVAC and other improvements necessary um to address the major facilities that uh Ron Lewis's group uh serves uh we would recommend that um and just as a as a note that this does not address all maintenance needs uh we have over $300,000 in HVAC needs we have over $250,000 in Roofing needs so any amount that we can invest in that facility's maintenance would help um however this does not satisfy uh all the the needs as recommended by by staff however uh there is some need for outside lighting at City Hall Plaza and um HVAC repairs so the remaining 9,979 that was left in the budget we would recommend be uh funded towards this item I have a question Rick anywhere do we have funds or money for protective awning for handicap you know service to the building out of weather elements well as I stated in the in the Landscaping project there you know we just barely have enough to cover the project which that's why I said lighting was never included in there so no we have not researched in depth the cost of that what I will say is you know in this particular case Ron has I mean I can

[3:37:59] give you a quarter of a million dollars worth of roofing issues that really need to happen right now so this is just a spit in the bucket you know for where we need to go yeah that's on TV another bucket thank you we we will be working on funding solutions to try to come up with options for that other approximately half a million dollars to address those needs so again in summary uh what we would recommend is uh allocating this remaining budget of almost $1.2 million to the projects um as discussed what do you need from us Morgan I need um a vote to move forward with funding these items please make for approval second and this will come back to us again I'm this $100,000 for development services software I'm not I'm not sold on that uh everything else I see is being something that yes sir what is transportation enhancement project that's the local match associated with the grant we received to do some work on chadburn just north of Houston Hart primarily having to do with sidewalks just like the hike and bike trail we do have a motion uh did and I got a second didn't I yes sir do have a motion in the second that we approve this as presented do I have further councel consideration on this do I have public comment on this call for the vote all in favor please say I I oppose n put a drop of 70 on that one we now are to follow up at administrative issues which is consideration and possible action on matters discussed an executive close session if needed and there are two items that we must approve uh Miss bowling if you would get me some language on the deal out at the uh at the industrial park so that I'll be able to say it correctly absolutely and I might um ask you to lend your eyes to

[3:42:06] land situated east of North Highway US Highway 67 North of the city of St Angelo business and Industrial Park buying between city of Angelo and OE renewable Texas LLC in substantially the attached form with such changes insertions and omissions as may be approved by the city manager after consultation with the city attorney would somebody like to say I will approve that as a motion so move okay I do have a motion to approve and what this is we are leasing ground uh this has come through our Costa DC Development Corporation it is a company that wants to come in here and put some solar generating equipment up and uh city of Stan Angelo has negotiated a lease with them uh that would make it profitable we're not giving them any money we are we do have a graduated plan as far as lease for the first five years and then it while they build this thing and put it together then it becomes a very lucrative thing for the city of St Angelo right now we're leasing this land for agriculture we're getting very little off of it nothing zero we're not relasing we're not even leasing this no leasing that next to it yes okay this particular spot we're not we're getting zero money off of and the the property next to it we're leasing agriculture we're getting very little so this is a plan that Co CC has come up with to get to use utilize some of this property at the industrial park and after 5 years when they get thing together it's going to be very big business for us and for the city for the city of s Angelo and for them I do have a motion to approve do I have comment on this do I have further councel comment I'll ask for approval all those in favor please say I I oppose Nay put a save and o on that number 27 is consideration of approving various board nominations by Council and designated council members a animal shelter Advisory Board fade Depp smd1 to an unexpired term January 216 Item B design and historic review

[3:46:15] audit with Costa DC and I wanted to share this report with uh Mr Roland Pena and see you know if we could get these annually and where we stand with each approved project and especially the fact that uh somewhere in the bylaws that it requires that the uh home office the home ground of a project that is approved for half cent sales tax funding headquarters be in St angel Texas and they cannot move that headquarters without written permission of cadc and city council so I I need to look at those and need an update on each one of them and would like to see a an audit compiled report for the citizens as well the other thing I'd like to discuss is uh it has to do with the appointments on various boards and commissions that councils make and I realize that each council member when elected and they come in they have the right to appoint whom they would like to have on a board I mean it's their discretion but a lot of times when like the historical society when things are going on and they've been known that it's going on to a new person to come in and replace their appointee I didn't know what our standing was on allowing that appointee to serve out their appointed term or do as does a council member definitely have the right to just replace them so I I wanted some discussion on that and to maybe discuss the wisdom of that with no particular one Committee in mind I just was asked the question and I wanted to explore it a little further C can I piggy back off of that and if and I I just talked to Alicia earlier today about the members that are on these boards that are not participating in these boards the way they should be um I would like to have that discussion at the very same time and the possibility of us removing them after the so many unex yeah so many unexcused misses in a year or whatever

[3:48:19] we remove them and we replace them set some guidelines yes would like to have that conversation thank you Mr lman um I have uh two or three here I'd like a a status of our dangerous building and our boarded building programs uh I'd like to know where those are if they're even happening if they're not happening why aren't happening and uh then I'd like to uh I know Miss priest has been working on this some but the amount of Lans that we have against properties on the books and the status of uh seizure of the lots for Ling if there's anything that we can do on that to try to get some Revenue going I have I just have one item and it has to do again with the thoroughfare plan I'm not sure when the council last saw that or when it was discussed but at a previous council meeting uh there was conversation about 50th Street as it pertained to Future landfill activity I think it's um that kind of conversation is contradictory to the thorough FAIR Plan and the work that we've done on 50th and other areas to make that more of an important Street in our community so it's kind of to me like the right hand doesn't know what the left hand is doing and before we make too many plans for the future of the landfill I think that needs to be addressed so I think in general the thoroughfare plan needs to be discussed more and understood more how it how it's implemented very well if I have nothing if there's nothing else to be discussed we're moving to number 29 motion toour I've got a motion and I'm going to accept Charlottes and your second all in favor say I I I this meeting is adjourned Ricky why did I
