[0:00:00] good morning everybody and welcome to our may 5th 2020 City Council agenda as we celebrate Cinco de Mayo today and if somebody said Taco Tuesdays so it's a good day in San Angelo we will start by making sure that we have established a corn I believe I see everyone on the screen so at this point we do have everyone here so thank you for joining us today we have Gary Ginn chaplain Gary Jenkins here to offer us a prayer so Gary if you would and Marcello's there as well so please lead us in prayer good morning good morning there good morning everybody let's pray Father in Heaven in the name of Jesus we bow before you to say thank you for another day that you've made we praise you and we worship You God and we ask you for your wisdom and your guidance for the City Council and for the mayor and for all of the attendees on the meeting today father we pray in Jesus name that you continue to protect Santangelo from the kovat 19 virus we pray right now God that people will exercise wisdom and and exercise protection as they go out in the public and that they will comply with the regulations issued to us through the government through the through the city as well as through the governor father we pray that you bless the City Council today with the wisdom the knowledge and the expertise to do all that they need to do to conduct the business of the city in a way that will glorify you and will be edifying to all of the residents and the workers here in San Angelo we thank you for our mayor we thank you for the City Council we thank you for our city manager and all of those that are in positions of authority for every department head and we pray father that you continue to bless them and strengthen them in Jesus's name Amen and amen in congratulations to city manager

[0:02:05] Daniel Valenzuela and your beautiful wife Susanna congratulations the first time we get to see you since your wedding happy for you at this point we will let me just say all members of the Council and staff should begin speaking by stating their full name their SMD position or role within the city we will open up the public comment section of the agenda and I will start by offering some comments the city and I as mayor committed to the citizens of San Angelo that we would be transparent in presenting the facts as it related to the number of copán 19 cases we have updated you daily with the number of new cases the number of positive and negative cases as well as a release cases and the counties of residency last week a female who is employed by the construction for signal energy solar construction tested positive action through her we were made aware that the construction company had used a private company and conducted employee testing of their approximate 500 employees they did not report to our public health officials that they were testing their employees nor did they report their findings Duke Energy owns a solar farm but hired signal energy solar construction to build a solar farm it took the city time to track down the appropriate party and get the correct contacts we sent emails to all of their employees notifying them that they needed to tell us where they were and if they had tested positive signal energy should have been more forthcoming and the city of San Angelo should have been more forthcoming our delay in announcing who this large company was was unacceptable for several reasons one people started to speculate who the company was and 20 fingers at some large employees employers in the city who were

[0:04:08] not quote the large employer who did the test no company should have been put in this position my apology to all of you who had to defend your company and your employees and to citizens believed the city was holding back vital information that could impact their lives citizens believed they had the right to know who this employer was and they were right it went against our commitment of total transparency by not providing more facts when we made the announcement timeliness of the information is so important we created a window where we lost the trust of our citizens three the public announcement was delayed due to the city waiting on the company to make the announcements which they said they would do they however did not do so on the timeframe they committed to on Sunday we communicated to them we were going to make the announcement without them we had waited two days that was two days too many we now have had a weekend with some businesses being allowed to open with restrictions in place I want to remind you that you do not have to go out just because restrictions have been relaxed and I want to remind businesses that you do not have to open I want to remind everyone that if citizens do not continue to social distance and follow the occupancy guidelines you will run it for everyone I received many phone calls from people who were very concerned about the lack of social distancing and the number of people congregating including someone IV akarsha our cases have continued to run more testing is going to be done so our numbers will continue to grow so everyone must do their part to help us stop the spread we as a community can help in stopping the

[0:06:10] spread but it will take everyone doing their part 12:19 is still in our community it has not left us stay at home unless you need to conduct essential business social distancing and we cannot have congregating we must be vigilant in our commitment to following the CDC guidelines this is not changed just because we have loosened the actions allowed more business to operate this has not changed just because we have allowed more people to enter a building this has not changed the fact that we are a community that must value and place a strong emphasis on the health and safety of our citizens it will take every single individual individual doing their part thank you we will now move into the one comment we have received for public comment and it is from sherry Beckwith and she says the following I'd like the council to consider disallowing animals to be slaughtered in residential areas I realize animals are eaten I eat meat but neither I nor anyone else should have listened should have to listen to the livestock for days while waiting to be killed even though the windows and doors were closed and neighboring dogs barking all night at the livestock and listened to the animals why they are being sliced into while still alive we couldn't go outside all day because they were dressing them in the oven it should be mandated wherever they were bought at they should be cleaned and dressed they're not in our neighborhood she provided some pictures of them shooting the animal was a pellet gun to test the

[0:12:22] here one second one second I forgot to do this no pressure okay go back alright so as I mentioned this is presentation from july 2019 3 December of 2019 we had five new businesses open up during that period of time in downtown San Angelo there you see a list of those businesses in 2019 our fourth quarter reinvestment summary looks this way we had 1.5 million dollars in private sector reinvestment and total projects of nine our total reinvestment for the fourth quarter was 17 million one hundred eleven thousand four hundred dollars where we stand to date from 2007 to twenty nineteen is a reinvestment dollars of 228 million 56 thousand three hundred and eleven dollars now I want to remind everyone that what these numbers are these numbers are from the con Green County appraisal district for properties sold and transferred beans that occurred also for projects that were submitted to the permits Department for remodels rehabs of buildings that were that took place during this period of time our monthly sales tax report here's a comparison

[0:14:27] from 2018 to 2019 I'm just going to stick to 2019 for the full year as you can see the total number of taxes collected in San Angelo were 19 million nine hundred sixty thousand generates MBA in the maine state drift straight we collected 1 million 158 587 and in the central business district which is a smaller geographic area we collected 255,000 642 I keep saying we we didn't collect anything tons and Angela didn't collect anything these were the reports that we received in the mixed beverage sales tax report I'm again I'm going to stick to 2019 at San Angelo collected a million three hundred and seventy six thousand five hundred seventy two in the main t Main Street District five hundred and fifteen thousand five hundred and sixty two and in the central business district 411923 of the overall collected funds or mixed beverage sales tax report and here is a combined of the cells and mixed beverage tax report what's important here I think as you can see the percentages of each one of the districts as they were as they represent and the total number of the percentage of what was collected both in sales and mixed beverage the total for the central business district was three percent of an increase even though we went down some in the fourth quarter in 2019 in the central business district combined and so you're

[0:16:42] reflecting 228 teams on my assumption is the one on the left of 2019 right I think you look yeah yeah if you look at yeah we made that correction look if you look at my slide we can't see it you can't or I can't from here they might the rest of council might be able to but it just reflects 2018 on the both yeah we corrected that on our slide yeah thank you I interrupted you on that next slide so my apologies so if you want to go back to you and finish that conversation right okay well I think I was done with this particular slide unless you have any questions on this slide where we were from a percentage-wise basis for central business and Main Street a relative to the combined sales tax and mixed beverage tax report on the tiers projects that were allocated for the fourth quarter third and fourth quarter sorry of 2019 the total award amount was two hundred and fifty four thousand dollars and I'm not going to read through all of them but I will bring to your attention one that was significant in downtown was the Fuentes cafe rehabilitation work that took place after that particular building was crushed in late last year there were excuse me inflate in 29 18 sorry and so this business is back up and running they received $60,000 for fire sprinkler system the facade and some secondary egress for fire the old fire old central firehouse bed and brew received $50,000 for sprinkler system by being in Dean attorneys-at-law received

[0:18:45] $14,000 for a facade makeover serenity Trading Post which you see pictures there as well for $30,000 for facade improvement on 88 East concho at 6 East concho there was a $30,000 award again for facade and the Buffalo Soldier Art Gallery received $70,000 for facade and fire sprinkler system if you're familiar with this building you will all I believe agree with us that this building really needed to taken care of it was it was in really bad shape and the work has begun and they anticipate that that building will be completed by this summer I want to show some folks from photographs of the before and after here six East concho and you can see why did an improvement it made to these particular buildings as far as the reconstruction remodel of those of the facades here is eight East concho and this is going undergoing some interior remodeling as we speak as well another major improvement to a building in downtown here is the revitalization of 506 South cavern which today is the old town bookstore looks very nice and still in progress is one East two and that building has a unique story the building that is actually being reconstructed is now becoming a part of one east to it and they will be using their the facade is going to reflect the original building next door to it so they've incorporated

[0:20:51] that building and that's gonna help with the improvement of that whole block right there and then at 214 South Chadbourne Plateau Brewing Company is in the process of opening their doors and anticipate once the restriction on nightclubs bar saloons is taken I think we'll see some that that building come coming to life another project that took place during this time was the pop art museum here's a before and after picture of what that looked like this is the before picture is a real clean picture or a cleaned out picture that particular building which most of the time was in much worse condition than what you see in this photograph today it's been transformed into just some awesome art and has become a high-traffic value to downtown it's an attraction to tourists and to our community as well and compliments to art and uncommon places for for taking the initiative to create the pop art open-air museum our sweeps attack Euler continues to grow and here a couple of examples of two sheep that were recently introduced into the flock Ricky the rattler and I'm gonna assume that Ricky is named or this particular sheep is named after our former colonel Wing Commander Ricky Mills and and then this sheet that you see here the pop artist in you is located in the pop art museum again a redesigned by art and uncommon places we have several cheat sheep that are in progress right now and you see the list

[0:22:54] there actually once my warnings minor correction the old central firehouse Benton brood has put their sheep out and it's uh again very cool they they painted it in the colors of a domination which is symbolic of the fire department our downtown stroll has been delayed because of the coronavirus situation so our next downtown stroll will pick up again in in we're planning for jalopy July the second and the rest of the year we'll do one in October November and December our fourth annual bruising barbecue at this point is still on schedule to be the first weekend in October it was a big success last year and we continue to draw people from as you see Lubbock Odessa Del Rio and we even had a team from Monterrey Mexico joining us last year and my understanding is they'll be back again this year should everything work accordingly to plan we created or worked with the Railway Museum the Small Business Development Center the Chamber of Commerce in putting together the shop small campaign for neighborhoods and the was a successful event as well and some of our outreach we attended the ceremony for the Olde Towne bookstore the American Asian American cultural festival and and then we also led a tour for paintbrush alley for the Midwest community network of Abilene we attended the ASU International Art exchange where I was asked to speak to the students about international outreach in the

[0:25:00] community we also led an initiative to celebrate the Hispanic Heritage Month at City Hall again another very successful event our marketing and promotions we were featured in the Texas Highway magazine as the an article was written about the pop art museum and here's a copy of our newsletter that was released earlier this year and today we receive copies of our historic downtown magazine which is not included in this presentation we just got those early this morning and that concludes my presentation you have any questions I'm not hearing anything could y'all hear me yeah thank you there are no questions for me the City Council members so it gives point we want to just say thank you for your leadership continue to help us redevelop our historic downtown thank you all right we'll move into item B consider accepting the city's fiscal year 2019 comprehensive annual financial report which is called CAFR and single audit and the presentation will be made by galas Thornton gala you're on good morning Council in there I am gala Thornton I am a partner with Armstrong Bachus & Company the audit firm for city of San Angelo and we have completed the 2019 comprehensive annual financial report which includes the city's audit report and and we also performed and issued the single audit report on your

[0:27:05] federal grants and the passenger facility charge audit for the charges from the airport we presented to the Audit Committee of the city on April 20th and and for the firm thank you for engaging us to do this audit when we perform to the audit of the city we had unmodified opinions on all of your funds which is clean opinions so everything was good included in our 2019 report was the certificate of excellence in financial reporting for 2018 and that 2019 report will be submitted or has been submitted to the G fo a for the 2019 certificate program so this is kudos to the finance staff for doing such a good job and preparing our financial statements every year just to give you a quick overview of how the year of 2019 turned out from a government-wide perspective which includes all of the assets liabilities equity of the government's your governmental activity is had in that position or an equity at negative 45 million dollars the reason why this was negative is because the governmental Accounting Standards Board now requires that you report all of your pension liability in its entirety and your other post-employment benefits like yours hari health and its entirety and these liabilities are large these are liabilities you've always had but we're only in recent years for cards to report it your net pension liability is 88 million your total Opeth liability is 79 million so this brings your total equity down but you still have good assets and within your governmental activities the reason why these liabilities are so large and your governmental activities is this includes your government your general fund where most of your employees are reported your business type activities which includes your water your sewer storm water airport your net position with 248 millions was positive and which included an increase in in that position of 18 million

[0:29:09] dollars over the prior year your total government-wide net position which is your governmental activities and your business type activities was 202 million dollars positive so this is very very good for the city of San Angeles this is an increase of 27 million over the 2018 numbers so your profit for the city for the year was 27 million dollars you issued no new debt in 2019 and you decreased your long-term debt by almost 19 million dollars another positive for the city of San Angelo also included in our report is Costa DC there in that position was 21 million dollars and that was an increase of 1.3 million dollars over the previous year in addition to the kafir' we we audited your federal grant expenditures you have a total of 4 million dollars in federal grants that you're awarded in 2019 we do a selection process and tests major programs we tested two of them that was Community Development Block Grant an airport improvement program neither one of those programs had any compliance findings and reported so that was good and we also had no compliance findings in your passenger facility charge and that is Dexter my presentation if there's any questions I do I have any questions from Council or Gala on presentation Billy Billy you're not unmuted so we can't hear you can you hear me now yes ma'am okay Kayla you mentioned that we had decreased our I think you said long-term debt by 19 million and 2019 is that correct yes ma'am and how what is our total debt at this as of the end of 2019

[0:31:16] 2019 is four hundred and thirty five million dollars that includes long term and short term debt also included and that is your pension in your open can you separate the pension from that you're looking right at two hundred million dollars because total pensions 98 million in total oh peb is 92 million and so the remainder about forty four hundred and thirty five would be normal obligations based off the revenue streams that we have today is there concern about the total four hundred thirty five million including pension and information no me I'm based on your current revenue stream the fact that you were able to decrease your obligations as share by 19 million means that you did bring in enough to cover your your debt obligations and it was a twenty seven million dollar increase so there is some cushion therefore even in the down year to be able to cover not shares obligations so I don't have any concerns obviously this current year is gonna have some challenges based off of what we've just gone through and what will be certain shortfall in the sales tax come with that is there any reason that we should be concerned about the long term position of the city not currently no ma'am I know you will adjust your but it's been according to you the shortfalls as they happen and as long as the city takes an active budget adjustment approach I don't have any concerns do I have any additional questions or comments from someone from the council we've already started that we're already looking at making sure

[0:33:21] that expenditures to ensure that the end of the year we actually can be in the black so again that's not something I'm going to wait and see we've already started doing that I just want to make sure everybody understood that thank you we know we're gonna have to make some significant cuts and they're gonna be some tough decisions to make probably number of employees mayor yes ma'am Tina dears key director of Finance if I could add something quickly please service there's a general fund we do have an amount of the property tax rate that is set aside to make those debt service payments so this oil fund is concerned we have a funding source for that and we're actually getting ready consider a debt issue coming up on this agenda so I just wanted to point that out so talking about the property tax so based on this year's property tax dollars assuming there's no increase that still makes it solid going into next year is that correct yes ma'am and in addition we have 1.5 million dollars in that debt service fund balance so that if we did happen down here that we would have some cushion there yes I'm Tina this is Billy do with single-member district six I apologize I haven't said that before Betina issuing new debt will that add to the total number that gala just shared with us yes ma'am the principle map we're getting ready to issue a seventeen point five million dollars but again we have the nine point three set six cents of the property tax rate that goes to service that debt in our financial advisors have looked closely at that and we feel very comfortable with the projections that we have okay Thank You Lane I think you wanted to say something did Tina since the time that we've refinanced ibly we did last year and this year do you have a breakdown on how much more principle we're putting

[0:35:23] down towards our debt compared to the prior years you're referring to the refunding months right I don't have that off the top of my head but it's certainly something I could provide for you okay thank you all right with no further questions or comments may I have a motion to accept the fiscal 2019 comprehensive annual financial report move to approve new to approve and by Tommy with a motion and a second we will take a vote all in favor say aye with none of those motion passes 7 0 we'll move on to item C consider a resolution of public hearing approving a substantial amendment to the 2019 annual action plan for use of cares create our ES 2020 CDBG - C V grant funds and authorizing the city manager to execute the applications required certifications related documents and annual funding agreement for the additional allocation of three hundred and eighty eight thousand six hundred forty six of CDBG thatcb funding and we will have Bob solace make this presentation good morning everyone let me get my share my screen the city received over a three hundred and eighty eight thousand Cova nineteen recovery funds as part of the federal cares Act these funds are CDBG federal funds which require us to adhere to current cdbg regulations that includes a men in our annual action plan we're

[0:37:27] doing this morning while there may be many social and economic recovery needs due to co-ed believe we believe that the rental and mortgage assistance program will be of greater need to that end we are proposing three hundred eighteen thousand six hundred and forty six for a rental mortgage assistance program with seventy thousand for contingencies and admin cost we can Bob and talk about what this rental mortgage assistance is I will talk in the next slide okay the for admin and contingency costs includes things like reimbursing expenditures already incurred due to Kovac things like equipment purchases cameras laptops for working at home that kind of thing and of course undetermined emergent needs the RMA program will provide rental mortgage payment assistance to those who lost jobs or other income due to the Colvin as you know even families who are receiving unemployment benefits sometimes don't cover the true cost of living excuse me assistance cannot extend beyond three months but can't include utilities in addition to the rent mortgage payments while paying arrears as a knowledgeable activity we recommend only going back to rate with the first because March read payments should have already been made before the start of covered restrictions which drove the unemployment activity we will exist that's client register with Workforce Solutions and actively search for employment and of course clients must be income eligible we believe this program will help me some of the cost bird people experiencing or asking counts to approve it now be happy to take any questions do I have questions from Council I'm going to need to go back to the other screen so I can see well let me ask the first question but on the 70 thousand dollars what is that about on yeah that's uh like I said earlier let me the

[0:39:33] UH that one includes things like admin and contingency costs we want to make sure we have money to adjust for emerging emerging needs that come up that we're not really aware of and also to pay for some things that we already incurred things like the cost of buying laptops for folks to work from home cameras those kind of things so that's it that contingencies admin cost cameras laptops that is correct so that would just be part of the three a three hundred eighty eight thousand okay Billy I think you'd have your hand up I guess I do mayor if um on your slide but you were saying that people would be required to be in a job search through Workforce Solutions and I was just wondering if people are receiving unemployment because they've been unable to work due to the coab at 19 and they have not gone back to work they aren't actually in a active job search because you know they've just been furloughed so to speak I think that's the term if they've been furloughed or receiving unemployment compensation will they be denied rental mortgage assistance because they're not looking for a job actually no man I think we'll do we're still working on the guidelines but the draft guidelines which came up with we're gonna look at the gap that's being created if you're receiving some kind of federal assistance or unemployment or something some income that's coming in to help offset the situation we'll take a look at that the gap is very small probably whoop I won't help you but if a gap is significant we won't beat you I'll be eligible now when you talk about the gap

[0:41:36] I'm sorry I miss that the gap between what and what it's the the gap between the money you're getting from unemployment in other words if you're being made whole because of unemployment we're not going to come in and give you rent payments cuz you already have enough money to pay your regular your cost of living basically we're going to try to help the we're gonna try to help pay the gap between what you're getting and what you're not getting okay all right okay thank you Tommy Tommy Hebert single-member district one Bob how is this being made known to those that need it what platforms are available for folks even know about this well we actually posted it on our website and on Facebook and I already have 50 people asking to get on the list so you start quickly I think those funds will quickly go I'm even gonna expend those funds pretty quickly I think is it something that's made available for a211 do you know about that by chance I do it probably it could I think by just our standard advertising process that the city uses I think we'll get plenty we're gonna get more requests and we have money for us truly mine my belief okay thanks Bob is this going to be on a first-come first-served basis or are you going to look at things like you know current income level and who may be at the lowest income level and more in need unfortunately we do have to go with a first-come first-serve and is our process we can't change that but we will there are some things believe they will disqualify individuals for example they may not be income eligible they may have lost a job but they they overall income is higher than their limits are so they they won't be algebra those kind of things so we've got some calls from folks who did not get unemployed because of Khoa

[0:43:39] they were unemployed two months that won't apply for that this money has to be strictly Kovac recovery and we have to tie it to that specific action okay so the you know other information I believe in our background slides there was some information on the other awards that we had got for CDBG and home so those monies are totally separate and people can still fill out an application for those funds separate from Kovac absolutely we currently have our current year funds we have right now the remaining funds which we have quite a bit and then I've told me the first starts our new funding cycle so we'll have additional funds from from that process I've heard that there will be additional funds coming our way for the second round of Care Act funding so we'll see what what that turns up to be and we'll pull those counsel after we get those funds thank you you see did you have a question I couldn't tell you raise your hand she needs to unmute ok now you're on ok I had a question but Bob went ahead in the interview ok thank you all right any further questions for Bob all right then we need to have a motion for approval I'm in pretty loosenoose to approve do I have a second second man get by Tommy we'll take a vote all in favor please say I'm not opposed motion passes 7 0 we will move into item D first reading it's more like hearing of an ordinance seeing abandonment of a portion of the Riverside Golf Club Road finding ways

[0:45:42] north no one cuz it's three to the street alright can you hear me yes okay this is John James Director of Planning and Development Services as you mentioned this is the Riverside Golf Club Road abandonment you can see on this map here in red the area to be abandoned we did get a couple of questions about the golf course the the road will remain open up to this access point for the golf course but then it will be closed beyond that so basically from that point up to Bryant would be the the limits of that this is just the zoning and future land use of the area lot manufacturing and then commercial in that area just a few pictures this is the access to the Golf Course Road again that will remain accessible and this is the portion of the road that would be abandoned and this is up to the North End where it ties into Bryant the Kent truck stop is a development that's going in in that area that as part of their development they will be constructing an extension of 33rd Street so the access from and to Bryant will now be at that extension of 33rd Street where they're also be constructing a traffic light and so part of the reason for closing the road to the north is to eliminate that that uncivilised intersection where the Golf Club Road meets Bryant thereby

[0:47:46] encouraging all of the traffic to enter and exit Bryant from that traffic signal at 33rd Street it also helps key truck access off of that Golf Club Road and get them to this truck stop off of Bryant over that 33rd Street as I mentioned it would continue to allow access to that golf the golf course as well staff does recommend approval subject to five conditions that I'll mention in just a second and the Planning Commission also unanimously recommended approval at their January meeting I will mention that the reason it's taken so long from January till now is there were some issues that came up with with that roadway we determined that it wasn't actually dedicated right-of-way the city actually owned that property outright and so that prompted the need for a little bit different process to get to this point the conditions these are generally our standard conditions paying the assessment formula that are outlined in our fee schedule the quitclaim deed and then recording a replac that would basically incorporate the abandoned right-of-way into those adjacent Lots they will also be constructing the improvements to the roadway prior to abandonment including the 33rd street and traffic light that's kind of a brief overview I'd be happy to answer any questions John yeah here we this turn off there has been a lot of people use that but their dis using as a shortcut to get over to 29th and so I just want everybody to know this is probably a

[0:51:53] three point one percent I would have assumed it would have been lower I'll ask Vince VL he's on the line from specialized public finance I think he can better answer that question hey dance you're on yeah all right thank you mayor councilmembers good morning yes in our initial model that we should be on so about a month ago we were looking at an interest rate of approximately 2.6 percent given the Cova 19 issues going on the market obviously has been in some turmoil a lot of issues have been pushed and rights have been up and down pretty erratically over the last month plus so basically getting this 3.1 percent done getting this transaction done in the marketplace I'm pretty happy that we are even able to accomplish this at the 3.1 percent level given some issues are not even getting done right now in the marketplace I think that even at this 3.1 percent this issue bits in the city's model it still enables us to proceed with the 2022 and 2024 issues trying to maintain that I guess tax rate at 9.3 cents for these issues so all in all I think I'm happy with this transaction also on the side as part of the process in this we did get a rating from SP from fiction and they confirmed the double-a underlying from standard poor's and double a-plus from pitch for the city so again that was part of this process involved in this so all in all I'm happy with the 3.1% the obviously the information that we showed a month ago did have a lower interest rate but given the uncertainty of the marketplace right now I think we've got a good transaction okay you I have questions for Vance from counsel I can't see everybody so I don't know if
