[0:00:00] 8:33 in the morning will call the meeting to order if we could please and of course we're going to start off with the prayer and the pledge today we have with us a prayer by CB Sutton would you please come forward let's pray Lord Jesus thank you so much for this day just to be gathered here just to just celebrate your life God just a breath that you give us Lord Jesus so Jesus I pray right now for this uh this meeting God that you'll just uh just give wisdom to our elected officials give wisdom to just the agenda that's going to be discussed today God and I just I'd go to the scriptures and just how you used Daniel God as just an elected official just to bring wisdom God I pray that over our elected officials today that God you'll just give them super supernatural just wisdom over all the decisions that are being made God and that continue just to use them and their their position here in San Angelo to just make San Angelo a better place not not just for just just for st. Angelo be better but just Lord Jesus just for the people that seneschal will be a light a place that people are drawn to that it benefits just walking in and bringing them up and God that San Angelo will just grow out men and women that will just love you and just go out from this place and make a difference in this world God and so thank you so much for this this day and just we just lift up this meeting to you for it's in your name we pray amen today we have some eighth graders from Angelo Catholic school do we have those

[0:02:05] eighth graders here this morning I don't think so Lyle Ann would you like to come forward and lead us please in the pledge do I have a Myra Velez here today this morning Myra would you please come forward just as a tragic event of Pearl Harbor is etched in the memories of Americans everywhere so the incredible loss and destruction of 9/11 will always be remembered as Americans however we do not focus only on the loss because we are reminded also of the heroes in our history never has that been more than the case than it was with the first responders in the wake of the destruction left behind by the cowardice of terrorism the families of first responders across this great nation of ours are always aware of danger and possible sacrifice that they and their loved ones face day in and day out Myra Velez is an amazing student always pressing forward to become the best as she balances that with her love for the Arts and her volunteer work additionally however Myra is also the

[0:04:08] daughter of Rosendo Velez a first responder on that fateful day 16 years ago Myra and many other family members of first responders were presented with artifacts from the remains of the Twin Towers in New York City finally when Myra heard of the vandalization of the city of San Angelo 9/11 memorial and the theft of the original steel artifact she immediately recognized the need for this reminder to be restored and she's selfishly offered to loan the artifact to the city of San Angelo now therefore I Brenda Gunter mayor the city of San Angelo on behalf of the city council do hereby recognize and applaud Myra Velez as the artifact that she shares with this community reminds us of both the pain and the courage shown on September 11 2001 through tear-filled eyes we declare we will never forget [Applause] while Ann would you please come forward again our founders in order to secure the blessings of liberty for themselves in their posterity did ordain and establish a constitution for the United States of America it is of the greatest importance that all citizens fully understand the provisions and principles contained in the Constitution in order to support preserve and defend it against all enemies whether foreign or domestic to commemorate the September 17 1787

[0:06:12] signing of the constitution of the United States Congress has designated September 17th of each year as Constitution day and September 17 through 23 is Constitution week and has declared that the independence guaranteed to American citizens whether by birth or naturalization should be celebrated by appropriate ceremonies and activities during Constitution week the two hundred and thirtieth anniversary of the signing of the Constitution provides an historic opportunity for all Americans to remember the achievements of our framers of the Constitution and the rights privileges and responsibilities they afforded us in this unique document now therefore I Brenda Gunter mayor of the city of San Angelo Texas on behalf of the city council do hereby acknowledge the week of September 17 through 23 2017 as Constitution week in the city of San Angelo Texas and urge all our citizens to reflect during that week on the many benefits of our Federal Constitution and the privileges as well as the responsibilities of American citizenship [Applause] well Thank You mayor for this proclamation it really it means a lot to highlight this week so important to our to our country I would also like to make you aware of it an event there we're having Saturday and to recap to end Constitution week and it will be at the time Greene County Courthouse a celebration of the Constitution so I wanted to invite all of you out all the community out we'll have games and prizes for the kids will have patriotic music and and speakers that are going to be speaking about their area of

[0:08:15] expertise on the Constitution so come out and mark this occasion and let's celebrate our founding principles and what we are so blessed to have in this country Thank You Myra I got ahead of myself would you like to come up and share a few words with people today you might have had a little speech or some comments prepared and I want you to have an opportunity to say those so if you would please come back up if you have something you'd like to add to today's event you're okay well you're so pretty we'd like to have you back up here again come on I can tell you have something to say you're good okay we'll call it good then my apologies the next proclamation is for Fire Prevention Week Fire is serious public safety concern both locally and nationally in homes are the locations where people are at the greatest risk from fire Ross Coleman please come forward fire departments in the United States responded to nearly 400,000 home fires in a single year sign angel' residents are responsible to public education measures and are able to take personal steps to increase their safety from fire especially in their homes the fire service of San Angelo is dedicated to the safety of life and property from the devastating effects of fire and they are joined by other emergency service providers businesses safety advocates schools and service clubs now therefore I Brenda Gunter mayor the city of San Angelo Texas on behalf of the city council do hereby proclaim the week of April 8 through the 14th 2017 as Fire Prevention Week and call upon the people of San Angelo to participate in fire prevention activities at home work and school and

[0:10:18] practice home fire safety especially this week which camera commemorates the Great Chicago Fire of 1871 which killed two hundred and fifty persons left a hundred thousand homeless and destroyed seventeen thousand four hundred buildings Russ everything we do in the fire service is predicated on one's ability to get out of the building we often tell people at the fire marshal's office we're not concerned if your building burns down we're concerned that you get out of it with that the National theme this month of this year is every second counts find two ways out so y'all just spread that out amongst yourself so it'd be nice for us we're going to be doing several events with safety city this year we plan to be at Home Depot for their safety day on October 7th October 21st for Academy we'll be out in the parking lot just meet-and-greet and talking to people handing kids out stuff and then we'll do the same thing at the Lions Club pancake breakfast downtown so everybody's everybody's welcome it should be a fun event and there'll be events on the safety city website [Applause] it's tombery in the audience Brian May in the audience you both may come forward you know we don't have to just have one Angeles State University and the community of San Angelo have a long-standing partnership in providing quality higher education opportunities

[0:12:22] to students from throughout the concho Valley Texas the US and the world Angelo State University's annual fall enrollment numbers have increased dramatically in in recent years from 6490 for students in 2014 to nine thousand five hundred eighty one students in 2016 Angelo State University has set new graduate student enrollment highs in 16 consecutive long semesters Angelo State University instituted a new dual credit program in 2015 but now enrolls over 2,700 students from close to 30 school districts in West and Central Texas allowing them to earn both high school and ASU credits for courses taught on their high school campuses Angelo State University has been designated a Hispanic serving institution by the US Department of Education since 2010 and corresponding federal grants have significantly enhanced undergraduate recruiting and retention programs Angelo State University educational opportunities have grown to include one doctoral degree in physical therapy 21 master's degree programs forty two undergraduate degree programs in over 100 majors and concentrations Angelo State University has accomplished its goal of reaching 10,000 and student enrollment three years ahead of its target year of 2020 as stated in its vision 2020 strategic plan now therefore I Brenda Gunter mayor the city of San Angelo on behalf of the City Council do hereby proclaim that Angelo State University is 10,000 strong and call upon the citizens of our area to recognize this remarkable achievement as well as integral relationships between our city and campus communities and the comprehensive educational opportunities at Angelo State University well I just want to say on behalf of Angelo State

[0:16:32] former president she didn't know what she got was getting into and I didn't know what she was getting into but over that time we actually fell in love with the museum and the potential that it has for the city of San Angelo we believe under new leadership no direction and all a new people coming in I think that they're trying to be a bright future for it I fell in love with the building I love history and I was down there as a voluntour many occasions and I enjoyed it I mean I did everything from cleaning up down in the basement mowing and weeding and then helping with the volunteers on Saturdays that came from their base or just wherever and they loved coming down to it so I just hope that y'all would consider the future that could have under new leadership there and hopefully y'all can see that my wife was really fighting for it and she has many ideas that that are just I don't know who knows where it could go in a good direction and good leadership and I just hope y'all really consider that and that is an asset to the city and can be a bigger asset to the city and it can be brought to a level that the other museums in the city are at and that was her goal thank you very much Joe is there further public comment today please I did not say earlier but state your name and an organization if you are with one and try to limit your comments to three minutes would be greatly appreciated my name is Karen Mitchell I actually live in El Dorado um the railway museum it is in no better place and what it is now my mother is 84 and I took her to the railway museum she had actually traveled through that station in 1952 she married my father in California he was shipped

[0:18:38] to Hawaii in for the Navy so she came to Texas through that railway station and then went down to El Dorado when I took her she was walking or I used the wheelchair she did she enjoyed the visit getting to see all the stuff she actually remembers the museum not only do you have history there you have living history you have people that actually live this life and they're passing on their information to others that are curious about it it's a great place for kids even adults like it I mean they're seeing stuff that they've never had contact with that's my point of view thank you and y'all have a great day thank you for sharing hello my name is Shannon carpenter and I'm here in reference to the Railway Museum a lot of you know this has been a tragic issue for a lot of us a lot of us have felt a lot of pain and we've cried a lot of tears there's a time to be silent and there's a time to stand up and speak and today is my time to stand up and speak and the reason I'm here is to talk about sexual harassment in the workplace there is no excuse for sexual harassment and unfortunately the previous president of the board has a long line of victims victims who have called me even after I resigned elderly women young women from the Air Force Base to include myself the reason I'm coming today is because I know that you're going into executive session I know that you're going to be making a lot of decisions and I want to leave you with a few things to consider not only is sexual harassment horrific for the victim but there are people that remain

[0:20:48] silent when they know that it's happening there are people on that board that are sitting on that board as we speak that knew that sexual harassment was going on in that organization it had been going on for almost 20 years I am speaking today for the people who don't have the strength to come up here and face you or the public I'm speaking for the silent majority so when you go back today I want you to consider that but I also want you to know that that railway is vitally important to our city like he said there is not only his there is living history and I beg you not to let that Railway Museum go away because of one person that was irresponsible that took advantage of the organization the people on the board and this city it is too important for the future generations we must educate them on how important that railway is to San Angelo Texas and how it contributed to the beautiful city that we see today so I beg you to take those things into consideration because it is about the future generations god bless you and thank you Thank You Shannon is there additional public comment this morning all right we will move from public comment to the consent agenda I will ask each of the council members if there's

[0:22:51] anything that they would like to pull from the consent agenda and I'm going to start with you Billy nothing lane nothing Tommy no ma'am Gary item B all right we're going to pull item B from the consent agenda do I have a motion to approve the consent agenda with the exception of item B all in favor say aye aye approved 7 0 Harry you want to talk about a reserve Cindy do you want to come forward and talk about item B which is consider approving an amendment to Lake nas worthy residential lot least with tentative 1506 South concho providing an additional six months be added to the end of the lease Cindy my comment really is is to make sure that the citizens understand why we're approving an extension of six months this lease when there's almost 20 months 20 years left on on this particularly s-- current tenant is requesting an additional six months so they can get financing they do need a 20 year term on the lease I will remind counsel that the terms of the existing lease will remain intact the only thing we're doing is extending that term by six months very good move to approve as presented all in favor we will now go into closed session session and the provision of Government Code title Phi open government ethics subtitle a open government chapter 551 Open Meetings subchapter de exceptions to requirement that meetings be open under the following sections a section 55 1.07 1 to consult with attorney when the governmental body seeks the advice

[0:24:55] of its attorney on a matter in which the duty of the attorney to the governmental body under the Texas disciplinary rules of professional conduct of the State Bar of Texas clearly conflicts with this chapter regarding the meet and confer agreement we will add room 1008 our regular agenda a discussion and possible action on accepting the abandonment by the San Angelo coalition of police say cop of the meet and confer contract negotiations and the meet and confer process presentation by Lisa Marley our director of human resources in civil service director Lisa your on Thank You mayor good morning Maureen council and city manager I thought that I would start this morning with just a little bit of history about our meeting confer process in San Angelo and how we've come through this over the years it was adopted in San Angelo back in 2007 and we've had three different agreements with San cops since that time the three dates are listed there the most recent one expires at the end of this month for this year our negotiate missions began in July on July 6th we held eight meetings across 11 different days we did sign nine tentative agreements by both sides agreed to these items most notably it was a physical fitness program and of course our last meeting was on September 11th we had four items that still needed to be discussed at the time that the table was abandoned and that was compensation assignment and education pay random drug testing program and a sickly proposal once we started with the discussion on compensation the SE Cupp side was very clear that they wanted to restart the step progression plan that we abandoned in this particular contract the minimum

[0:26:59] cost that we could calculate came out to 622 thousand dollars in order to start those steps back and in doing that the 622,000 did exclude 37 officers nine of them probationary and twenty-eight of them who were at the top of their range so they were not going to get anything in their proposal the City Council if you recall authorized as a one percent salary increase that we could take to the table which totaled 119 thousand and then also five additional police officers for the department which came in at about three hundred and twenty thousand dollars when we were unable to come to any sort of an agreement on compensation the SE Cupp the San Angel coalition of police did declare an impasse to the negotiations and they walked away from the table at our last meeting on September 11th we did confirm with se cop that they understood the consequences of declaring an impasse without an agreement that we were going to lose several different items that are allowed outside of the civil service process the most notable are the third assistant police chief part-time police officers sign-on bonuses and lateral transfers I wanted to take a second and go through what they what happened when we froze those steps how the process worked and then tell you how that what they are asking for would work so in this example I took a police officer that was at step two on September 30th of 2014 which was the day before the contract started so on September 30th 2014 step two for a police officer was forty one thousand eight hundred and twenty-one dollars on October 1st 2014 step two became forty-three thousand seven hundred sixty nine dollars or a 4.6 percent increase then on October 1st of fifteen step two became forty-six thousand five hundred

[0:29:04] and eleven dollars and on October 1st of sixteen we did not do any pay increases if you recall those were done then on for one of seventeen where step two in this example became forty nine thousand nine eleven so for the three year agreement for this particular officer anybody that was except two they received eighteen point one seven percent increase over the life of the agreement sergeants just as an example they received twenty three point seven and lieutenants received twenty two point nine four and what their purpose what their proposal has asked for is that we resume moving those contracts or moving the steps in order to do the one step for all ranks and I did have that number I didn't think I did but that was six hundred twenty two thousand based on their proposal sixty one officers would receive four steps eleven would receive three steps twenty one officers would receive two twenty six officers would receive one and thirty seven officers would receive nothing on their proposal so continuing with that exam example step two as of September 30th this year is forty-nine thousand nine one one what they've asked for is this particular officer because they were here at the start of the contract would move one step for 2014 which would take him to 51 382 they would move another step for 2015 which would take him to 52 854 they would move one step for April of 2017 which would be 54 326 and then would move one final step on October of this year at 55 798 so the total increase in the new agreement for this example is eleven point eight percent so to compare the two what they've received over the

[0:31:07] contract versus the other employees in the city from 2014 to 2017 in our example police officer X received eighteen point one seven plus another eleven point eight in their proposal for a total of twenty nine point nine seven percent the sergeants at thirty point one three and lieutenants at twenty nine point O four compared to our general employees who receive eleven point six two percent and the fire employees who received fourteen point one for the same period so because they have declared an impasse I am here today on behalf of the coastal management team to recommend that we allow the current contract to lapse and so I'll be asking council for a vote on whether or not they would like to allow that contract to lapse and then also to discuss or decide whether or not you want to repeal the meeting come for a process at that point at this point in time or let that sit until a later date and I'd be happy to take any questions do I have any questions from Council do I have a motion from Council mayor I make a motion that the negotiating team make a motion to accept the negotiating teams recommendation to allow the current agreement to lapse do I have a second second do we have comments from the public would you come forward please state your name and your position my name is Matt Baldwin I'm a sergeant with the same Angelo Police Department November will be 22 years I'm a member of the Executive Board of San Angelo coalition

[0:33:10] of Police and I sit on the police departments team for negotiation with the meeting confer process mayor and council I sure appreciate you given me the opportunity to speak and I speak on behalf of the officers and I speak on behalf of our team in the absence of Doug Thomas and Kelly Lajoie our president and our vice president they're unavailable today so I gladly do that first of all I want to say thank you for the raise that we got back in April it would be hard for me to explain how much we appreciate that and what that meant mr. Carter I can't explain to you the amount of appreciation that the men and women of the San Angelo Police Department feel for that motion you made during a council meeting you said you're only as good as your word we had a contract we're not trying to make the city bankrupt we're not trying to put anybody under the waves we had a contract that we both agreed to you guys honored that very admirable we thank you very much there's a reason why the men and women of the San Angelo Police Department dug out of their pockets and put five billboards up around San Angelo this said thank you that was huge we understood it it did not go unnoticed thank you again is this even working all right I've always technically carries but it's cutting in and out so because of this because of this raise that we were granted because of the raise that was honored back in April the consensus that the police department is this we're not greedy we're not selfish we want to take into account the rest of this city we were

[0:35:13] not the only employees that work down here that being said we never came to negotiations this year with the intent on getting a raise we never asked for a raise now know there are semantics there are semantics at these meetings and there are perceptions at these meetings our number one priority our number one goal was just to reinitiate the step program that's it now unfortunately we never had the opportunity to fully explore options I know what was presented here this morning would be the that would be the perfect example if if the police department came out of our negotiations getting what was proposed this morning these numbers that were proposed these massive percentages in relation to other city employees that would be awesome that's not necessarily what we wanted to walk out with we wanted to walk out with something that continues the progression of pay and that attacks what we've been trying to attack for years we're trying to retain officers and trust me we're all about being sympathetic to saving money I know all of us that sit on my side of the table and I'll say for the city to we're trying to use our money wisely we're in complete agreement with that at the first meeting with the city it was made abundantly clear that the number one priority of the men and women of the San Angelo Police Department was just to reinitiate those steps like I say ideally yes we would love to be placed back into position and this has been voiced during meetings we'd like to be placed back in the position where we would be had they not been frozen ideally look I'm a realist and most of us are that may not be a possibility we

[0:37:19] all understand that let's talk about something different let's talk about some options we're all open to that why would we like to be put back in those steps where we would have been I talked about perception there's there's an issue with the officers at the department it kind of goes like this you may be a 4-year officer considered and being paid the exact same amount of money that someone who just hit the street is making we're not paying those officers for their time and experience their knowledge their loyalty and we would like to be able to show that we'd like to be able to acknowledge that I've I've canvassed a lot of officers as a member of the team it's important for me to know and as the team members it's important for us to know what are these officers stand well obviously young officers down there they want to progress further in their steps they want that acknowledgment they're not going to agree to something that doesn't allow that and understandably and surprisingly I'm one of the old-timers down there I I still have a couple positions that I can move just because of promotion but I work with a lot of tenured officers a lot of older officers down there and their take on it is you know what I don't stand to get anything out of the contract as far as a huge monetary gain but I can't vote for something or support something that's not going to help this massive amount of younger officers we have to get them moving too so that is the position that they take so we have the men and women of the police department that has a consensus this was their number one priority I think you're past the three

[0:39:22] minutes so can you back up your yeah I'm sorry I'm sorry I didn't realize I just had three minutes all right I should have told you but to begin with my apologies man I will say that the tentative agreements that were referenced this morning for the most part were introduced by the city city sponsored we did agree to a lot of them we are willing to negotiate there is a question about this 1% authorization is that an authorization from the City Council or is that an order from the City Council I don't know we have not been able to speak to anybody as terms of our negotiation and we have honored that we have not reached out so this is an opportunity for us to reach out and have some conversation about it if you can find your your way to do that I'll say this in closing I'm sorry I didn't know there was a time limit I'll say this in closing I think I've made my points I have some some concern about the wording that's used in the agenda that's been used this morning and that that primary word is abandoned and I will tell you we do not want to abandon this but we cannot negotiate with a party that is unwilling to negotiate in good faith we're all trying to get to the same place we're just having a hard time doing it I for one want to get there I know there's others that want to get there we we don't want to be rid of this but I'm not going to stand here and I'm not going to lay myself down as a sacrificial lamb and I don't think anybody else will for something that only seems to be working from one side I appreciate your time I have further public comment there

[0:41:32] before there's any other comment could I comment or at least answer the questions the Matt is correct that the sake upside continued to say they did not want to raise they did not want to raise this time they just wanted two steps back and and our side kept saying but if you get the steps that is a raise if you're moving steps that's an increase we finally figured out what they meant was that they didn't want the value of those steps to increase the you know if you recall on this slide where the one step from 2014 that's one step on the current scale at 51 382 the way we understand it is they don't want necessarily those amounts to get bigger that was what they meant by no pay raise because clearly the steps did indicate a raise that was the only thing I want to do address my name is Jim Turner I'm a longtime local government observer and I remember back when meet and confer was originally adopted one of the issues at that time and that you're going to run into that again today is within the civil service program as the state says you have to implement it there's a lot of weaknesses and failing especially when it comes to things like being able to negotiate meet and confer was kind of a option to be able to address those shortcomings customer seriously civil service forever the fire police hasn't been updated much since the 50s and the world has changed a lot since then the way we have to deal with the professional public safety

[0:43:36] that's change if we're not going to do meeting we still need to come up with a good addition and supplement to civil service because it's not going to fix this problem meeting confirmed was implemented to address the issues and they're still there thank you are there further public comments if there are no further comment we will mayor may I ask a quick question before and I think it's to lisa lisa how did the steps get frozen to begin with in our current contract the one that started in in october of 2014 when we negotiated those salaries we went to this the new system at that time which was to survey other cities and in order to find the middle of the range we had to have the steps a certain distance apart and we agreed that we would survey in every April so we didn't move the steps in October the October before and there was an interest on the part of sake hoppin and the city obviously recommended that we would move in certain percentages over the next three years of that contract with the goal at the end of the three-year contract to get them as close to 95 percent as we could and in order to do that we had to freeze the movement in the steps because if the let's say the this is gonna get a little bit in the weeds but if if the the surveyed showed that they needed to get 7% to make it to that percentage for that year and the steps were two and a half percent apart if they moved a step and they got a pay increase on top of it it was going to exceed the amount of money that the city

[0:45:38] had to put towards those raises so we built a cap in the system and the only way that we could make it work was if those the people stayed in the step they were in to begin with at the start of the contract and so when we negotiated that contract the say cop agreed freezing those steps they understood would get them the larger increases that you saw in the one slide and had we not frozen the steps we could not have gotten the big increases that we got across three years ago so it was through mutual agreement during meet and confer that the steps would go away so that larger increases could be given so that it was agreed that the steps would freeze yes ma'am okay but I mean under the current contract there was no step increase like what the gentleman mentioned earlier that that's they weren't asking for a raise they just wanted to step increase right they wanted they want to go back to the steps where they believe they should be three years after that cont that contract was signed so if somebody was at Step two at the beginning of the last contract and in their proposal they would be at step six in this coming October because they wanted a step for each of those three years of the contract plus one for this October so they would move four steps so not implementing the steps effective with something right now it's retroactive that was what they were asking are there any other questions or comments from the council if not we have a motion on the floor - one thing for me it does sound like the and the word abandonment I'm having an issue with that it does sound like they're willing to negotiate unfortunately it's closer to the time that we're about to land item being

[0:53:51] 5 I vote aye single-member district 6 I vote aye mayor votes aye motion passes 7 0 item D first reading a public hearing of an ordinance amending chapter 5 article 5.02 alcohol and Beverage regulations of the city code of ordinances to add a minimum 300-foot separation for the sale of any alcoholic beverage liquor beer wine or Venus liquor from a church John thank you you may recall this as an item that you saw a couple of months ago and you asked us to bring back some additional information do have a map here it was in your packet but in case there are questions we've got a big version did not include it on the PowerPoint although I got a zoom in at one area just because it was difficult to read but this is the section as you recall this was brought up a little over a year ago at one of your public comment periods here at the meeting a local pastor had suggested that we consider prohibiting alcohol sales particularly bars in his case but alcohol sales in general within a 300 feet of a church which is allowed by state law this is the relevant portion of state law that allows us to make that prohibition we did look at 10 other cities you see them listed here all all 10 of those cities have a 300 foot separation of alcohol from from churches this is the proposed amendment to the ordinance if you choose to adopt this it would basically prohibit within 300 feet of a church alcohol permits or the approval of alcohol sales you can see that we already have that prohibition near schools that's already in the ordinance this would simply add churches to that 300 foot does delineation one thing that

[0:55:58] this ordinance would also do as we looked at the map lots of churches lots of bars and restaurants in the downtown and it's not uncommon for cities to have an exception in a downtown area because the intent of the downtown is to have lots of different uses mixed together in close proximity and so this proposal would exempt the downtown central business district from the 300 foot separation this is again even this is hard to read this is a little bit of a zoom in of the map that you received in your packet but it just shows all of the churches within the city as well as all of the current TABC alcohol permits and you can see we've identified ten different areas I won't circle them all but you can see a number of areas where we do have an alcohol sales permit already in existence within 300 feet of a church one thing you'll notice if you look through these lists that's not all bars it includes things like Family Dollar Pizza Hut other restaurants and so one of the things to be aware of is that the state statute gives us the authority to limit alcohol sales alcohol permits within the distance of a church it does not allow us to distinguish whether it's Pizza Hut or Joe's bar and so again you'll see some of the all the existing conflicts that this would would create again our ordinances allow grandfathering of those existing ones so it wouldn't result in them closing but this gives you a little bit of a sense of how many of those situations we currently have and I do have because this is hard to read we we looked at just a few examples of we're zooming in on a church this is the Oasis Baptist Church and it's within distance of Eddy's snack shack that's a basically a convenience store we also looked at the

[0:58:00] police calls and this particular location had 21 police calls to that address another location is a Family Dollar within the proximity to the Victory Outreach Church those are very close to each other again this Family Dollar had 18 police calls to that address and then the example that brought this up to begin with you have the st. Paul Baptist Church and then the Friends neighborhood pub which is a bar the bar that's nearby that particular had a particular bar location had five police calls within the past year excuse me where those calls related to liquor sales or do we know that or they just calls they were just called so some are related to and some were for a fight some were for some other disturbance but others were for something like a burglar alarm that went off and police had to respond so it was it was the whole range of things that police respond to a for so the what is before you as an amendment to the alcohol section of the City Code of Ordinances that would prohibit alcohol permits being signed off on within 300 feet of a church the Planning Commission did consider this item they voted 4-2 to to deny that results in the requirement for a supermajority so if council wishes to approve this it would take a 3/4 majority of the council to do so with that I'll be happy to answer any questions on the cities that already have there's an effect have they had it in effect for decades have they had an effect for a year because many issues I see is first on the personal property rights person so and I look at that map and I'm like every one of those businesses should they sell would no longer be able to sell their business

[1:00:02] and carry on the same business and that's a huge impact across the city and to answer your question we did not look at the timing of those ordinances I would suspect most of those ordinances have been in place for quite some time but I don't know that for sure that would be my guess yes sir just a real quick question John we know that was brought up because of one particular church that was having some issues with a bar that was located next to them are we aware of any other churches that are having the similar issues with with alcohol sales not that not that we have heard of I don't recall any other comments coming forward for example when this went to the Planning Commission and I think that was part of the Planning Commission's recommendation was that it's basically trying to solve a problem that doesn't exist except maybe in one particular instance in quite honestly looking by the number of calls for service that ones only had five in the last year where there have been some other businesses in the city that have had far greater amounts of calls I have questions building John as I understand it right now our current ordinance says schools I mean you know it has schools so we're just wanting to add churches to the current order are we're deciding whether to add churches to that so for instance does the same rule apply to schools for instance if a business closes at this point and they're you know under some kind of grandfather clause they could not open again in the same business they would typically be grandfathered as long as they continue operating even if it changes hands or than one business

[1:02:06] closes the new business opens then they would be allowed to continue if they ceased operation for more than 12 months then they would no longer be able to do that okay so there is that 12-month window okay thank you John my mentioned one did you think there because I'm saying I was sitting here trying to think that with something like this I'm thinking there's going to be unintended consequences that we may not fully know right now can you think of some unintended consequences so if this were to pass and the churches and the alcohol sales could not take place within three what are some of the unintended consequences maybe that you thought through I think the biggest one that we noticed as I mentioned with when we when we started looking at the the actual map was that when we initiated this based on the citizen comment we were thinking bars when we started looking at all of the alcohol permits and and seeing things like Pizza Hut or a convenience store you know those kinds of things I don't think were the intent and so I think a concern would be that it would be overly broad but again we can't say just bars it's going to apply to all alcohol man sir man yeah okay yeah thanks John would this also apply to temporary permits TABC temporary permits that's like if somebody was to rent part of the fairgrounds and it's 300 feet away from the church across the street which is very applicable they couldn't do that that's a good question that to me it would seem broad enough that would be the common sense saying it would apply to that so I'm with Tommy here I think the effects we have beyond what we see are just in my opinion way excessive the ordinance says it's proposed deals with the sale of alcohol so if the temporary

[1:06:18] very often I disagree with the previous speaker but on this one I have two and I think a lot of that is because even though it is probably a good idea to have some control over wires and other things close to a church I think this goes far beyond that with the unintended consequences can get into special events that we haven't looked at and there is just listening to the presentation there were some things that haven't been looked at in enough depth to say that yes this is a good solution yet and the unintended consequences are going to impact the citizens in ways we don't even know yet that's why they're unintended we haven't anticipated and looked at in the depths necessary to actually know what this is going to do outside of this one special situation is a problem and this is a blanket solution to eight from the information I've heard is a specific problem not a good way to deal with specific problems thank you for the public comment well lale McClellan thing I just have a question I understand about the grandfathering clause but I don't know that liquor license transfers can mean grandfather because those are based on the new owner so that may be an issue as well at a merit counsel my name is Steve useless I'm in the commercial real estate business in San Angelo and I would like to speak in opposition to this ordinance it's a confiscation of private property rights as the mayor stated you know

[1:08:23] Church can locate in any zoning district any commercial zoning district by right when they do so and it's not just large churches any sized Church to church as a church they instantly would create this 300-foot radius around restaurants convenience stores grocery stores and of course clubs but some retailers that sell also and the lady I'm glad she corrected I was going to do that how call license were issued to individuals when you sell an existing business that sells alcohol the new owner has to close that put up those signs they have to apply their application wouldn't even be accepted if it was within 300 feet of a church gives some examples that we're dealing with right now there are two closed restaurants on Sherwood way that we're dealing with right now neither of those would be able to sell alcohol because of their proximity to the heights in a particular Church may not even have in opposition to I mean you're I think you're maybe pulling churches in here that are going hey we all want to be restricting restaurants so there's a lot of unintended consequences a huge impact on lots and lots of businesses and I would strongly encourage you to to turn this ordinance down thank you do I have further public comment and we will take a vote the vote the motion that is made is to deny which means that we would not add churches to the 300 feet as described here so all of those in favor of denying the request to add churches say aye

[1:10:24] any opposed motion passes 6 to 1 is the first reading a public hearing of an ordinance for z17 - 1 Oh a rezoning from the office warehouse Oh W zoning district to the single-family residential rs1 zoning district being point five acres generally located on an unaddressed unaddressed track north of 662 to klaris Court and John James your presenting thank you John James director Planning and Development Services this is a pretty straightforward zoning you can see this residential property here has has purchased this tract behind them that originally was part of this larger office warehouse district and so they're simply wanting to rezone the tract and incorporate it into their single-family residential lot this is the zoning of the area the future land use of this particular tract is transitional which allows for that transition from residential to non-residential the existing zoning as you can see is office warehouse but again it would basically this request is to fold that into the adjacent neighborhood just an aerial view of the site adjacent properties as well as the adjacent single-family we did send out our notifications to the surrounding property owners did not receive any responses in favor or in opposition so the recommendation from staff as well as the Planning Commission is to approve this rezoning from office warehouse to single-family residential I'd be happy to answer any questions do I have questions from the council do I have a motion from the council approval do you have a second thank you public comment do we have any at this point we will take a vote all those in

[1:12:32] favor of the staff recommendation to approve say aye any opposed passes 7-0 F is the first reading a public hearing of an ordinance for z17 - 1 1 a rezoning from the planned development pd 1302 zoning district to the office warehouse OWA zoning district being 1.50 acres located at 12:21 Grand Canal Road John again John James director Planning development services this is in the same area you'll notice this was the tract we just looked at this particular tract in question was a few years ago was zoned as a planned development based on particular plans for the property those plans did not pan out and so now the owner is requesting to go back to the straight office warehouse zoning as you recall from the previous case is the zoning of that general area so basically this is taking the zoning back to what it previously was it is consistent with the future land use plan for that area you can see some pictures of the existing property again we sent out our notifications did not receive any responses in favor or in opposition and so both the staff and the Planning Commission recommend approval of this rezoning from planned development to office warehouse Tommy do you have a comment it's in your district I would move approval my one question we talked about this yesterday are y'all requiring to make the owner of this property pave out in front the rezoning does not trigger any repaving there may be some replating in the area that would trigger street improvements and at that time the Planning Commission would consider whether or not to require that if if they do require it the owner can appeal that to you if they

[1:14:34] wish to have that waived but not as part of the zoning that wouldn't be triggered is there a second to the motion no second do we have public comment if there's no public comment then we will take a vote for rezoning from the planned development to the office warehouse based off staff recommendation to approve all in favor any opposed motion passes G is first reading a public hearing of an ordinance for the vacation and abandonment of 0.64 to a core 28,000 square feet segment of the South Murray Street public right-of-way generally located between Bryan Street and Roosevelt Street John thank you as you mentioned this is a Street abandonment you can see from the graphic here there is a plaited street for Murray Street all along here and they are requesting to close this portion of Murray Street and basically incorporate it into this property to for their private use future land use of the area is commercial a combination of commercial and industrial and you can see the zoning there general and general commercial heavy commercial with single-family residential behind it much of this property behind is actually owned by the city this is what is currently Murray Street so you can see it's not a not an improved Street at least not improved to city standards this is the North portion look basically looking back the other direction you can also see Bryan Street here also a unimproved caliche gravel top road one of the reasons that these this property owners wish to expand into this area that is currently a street

[1:16:37] right-of-way is to provide some additional parking you can see there they have some parking issues on the side with some spillover parking on adjacent properties and they would address that Brian just handed out a revised copy of the ordinance there were some language tweaks kind of last minute to the actual language no real substantive changes but just some legal terminology to be changed but basically what this abandonment would do is abandon the red area that would allow the property owner to incorporate it as part of their property at the same time we would get a easement on the Bell Street side this is part of the Bell Street project that would be in that area of the right-of-way is fairly narrow and so we need some additional either right-of-way or easement to put in the new water main the replacement water main and the city sidewalk and so this abandoned would accomplish both things it would get the city the easement we need for Belle Street and it would also abandon that portion of Murray Street for the benefit of the property owner one of the issues with this the the applicant has is concerned with our requirement or typical requirement for abandonment is that they replant the property to incorporate the abandoned Street into their property replating is basically the subdivision process in Reverse instead of subdividing a property you're combining two pieces of property again that's a common requirement with a street abandonment but as you saw from some of those pictures some of the surrounding streets are very substandard and the property owner is concerned with the platting creating the obligation to improve those streets up to city standard particularly since Roosevelt Street here to the south is an arterial Street which would normally require 64 feet of pavement at which right now is only a 36 foot wide caliche street now

[1:18:40] that property owner wouldn't have the responsibility for all 64 feet but I think the main point that staff would like to make is that the requirement to plaid or not to plat is in a way independent of whether or not they have to improve the streets yes if you require a reap lat that triggers the street improvements but our replating process has a variance procedure that they can ask not to have to approve that improve those streets and so what our recommendation is require them to reap lot as part of this abandonment so that we have good property records of the entire property being combined into one and then at the time that they come forward with that replant the Planning Commission and ultimately you all have the ultimate authority whether or not to make them improve it so your decision today whether or not to make them reap lat there will be another day at which the decision to improve the street would be made I hope hopefully I made that clear I'd be happy to my question is is this if we don't require them to replant we could we get into situations like we've we found ourselves on Bell Street where those property lines were not drawn consistently with what what was already there I mean and from my perspective they front Bell Street this property does so that's why we got the ease but for the water and and and the sidewalks easement the bottom line is is along that whole Bell Street area we knew that the property lines were not consistently drawn and we're not replanted the way they were supposed to be so if we don't ask them to replant this could we get into a similar situation sometime in the future well we could we think we've addressed it with Bell Street by getting the easement so that shouldn't be a problem it could be an issue here with Roosevelt as I mentioned that's a that's an arterial street so the replanting one option for the replanting might be to get the additional right-of-way we need

[1:20:43] for a future arterial but not make them actually do the full pavement but again that's a that's something that's usually analyzed and reviewed as part of the replac process at this point I think it's it's premature to guess we may not need that right we may need it but we typically do our analysis of that with the Public Works staff engineering and planning at the time of the replant so I I hate to at this point say they don't have to replay we might actually end up not getting something that we ultimately need John my question is if we do make them replay it are we going to force them or bound them to something on the part that they just combined in on the backstreets you've got marked in purple are they gonna have requirements on maintaining that that if they knew those were coming they wouldn't even ask for it to begin with I hate to bound them by something well no tangent upon something that's flexible as that with this abandonment that actually becomes no longer a street so it becomes three plat makes it part of their private property so really what we would be looking at is the two currently substandard streets being Bryan Street here and and Roosevelt and so when they come in to reap lat the typical requirement would be that they have to improve both of those streets to full city standard and that would that would be what would be in question at that point now again what they're asking I'm sorry this is for you to just say they don't have to replaster they don't even have to worry about it down the road and we need their in green yes but we'll we'll get that regardless I mean they've agreed to that if you strike the provision that they're asking you to strike or that the Planning Commission already recommended striking will still get that so that's not an issue so do we have two motions one that we agreed to abandon that piece of property is one motion and then do we do

[1:22:45] another motion to address the issue of whether we ask them to replant it let me get to the conditions here there are basically three conditions that that staff recommended and so I think one of two motions would be what you would want to consider the a motion to approve the abandonment with all three conditions as staff recommended or a motion to approve the abandonment with only conditions 2 & 3 removing the condition to reap lat which is what comes to you from the Planning Commission as a recommendation I know one of those screens said that there was one person opposed no I'm saying it was actually one in favor yeah went over that quickly I think that's and so again as you can see the staff recommended all three conditions and the Planning Commission only recommended this to second conditions not including the replant we go back to those three conditions yes so the Planning Commission did not recommend item 1 they recommended 2 and 3 John just so I'm clear replanting the property would keep it clean so that it's on the record so that 10 years back some council could look at this and see what was done and why you know I mean that we wanted to keep it clean where if we don't replant it is there any downside to causing not replanting it basically would be they would own one piece of property which is their current property and then they would own the strip of property that used to be a public right-of-way but those would

[1:24:48] legally be two separate pieces of property what the replant does is join them all into one larger property I want to make sure that in the process of approving the abandonment that we don't tack on large dollar increases in terms of obligations by having to do those roads so if I would say that I would support all three I would also say that I don't think we have to require them to bring those roads up to the conditions that you're referring to so that would go back to the Planning Commission it would if you require the replac then the replant itself goes to the Planning Commission and at that point the Planning Commission could waive the requirements for improving those roads is everyone clear and do I have a motion I move to approve as presented a second little comment that the approve as presented recommended by staff and staff okay all three conditions okay thank you I have public comment good morning Russell with skg engineering if you require condition one as the motion states and we do not get the road variances then we will not be moving forward and doing what is necessary to effect this easement abandonment it's just not worth it from falco takes a standpoint to go through the process and and pay potentially what they'd have to pay we'd be looking at over $200,000 worth of street improvements in the the land adjacent to us that we're requesting the abandonment for is absolutely not worth that to make the property clean or however they stated or concerns in the

[1:26:53] future about where the property lines are we know where the property lines are there's physical monumentation on the ground the property is plaited we know exactly where the right-of-way is for for all the streets for what we're asking the abandonment on there's a legal description written there will be a quitclaim deed filed of the public record so there will be no doubt where this property sits in the future it'll be of the public record and so it's very clean cut and dried and one thing that we could go back to and look at that wasn't brought up would be requiring only a plat of the property that is being abandoned the property is large enough to meet zoning regulations with respect to size and dimensions so instead of requiring that the talk of taxes to replant the entire tract into one you could just make a requirement to replant this abandonment area into a into a tract of land but but there again there's consequences or expense and there's things tied to that so at the end of the day the city city really needs this sidewalk and utility easement probably more than what the developer what talk of Texas needs the abandonment of and so we can just walk back step back and and kind of force the city to to come after us through through your means through those easements so we really wanted to be able to work together make this a simple process for a nice little trade-off here but it's gotten very difficult for for us to be able to do that so we would ask that that condition one not be required and then for what I pulled off of the city's website there was a condition for but

[1:28:55] I'm not seeing it discussed on these three conditions so I'm just presuming it's gone for the four what we're talking about we've only seen two three we've already seen two three so okay one off of the city's it says presented with three okay okay then I won't have to discuss that I'd be happy to answer any questions well I'm very much in support of not having someone have to spend two hundred and some thousand dollars to redo the roads when we the city need the green area as it was presented so we need that green area I don't think it's appropriate we asked somebody to spend two hundred thousand dollars to bring those streets up to whatever level we're requesting so you're accepting number one to reap lat that's incorporating the street also I think it's tied to as mr. James indicated it's tied to the subdivision planning process so if we have to come back with a subdivision Reap lat that will trigger the requirements to to bring the streets up to requirements potentially drainage studies all the other stuff that's tied to subdivision process are we allowed to as a city council asked that they replant the property but City Council is not demanding that those streets be brought up to that level can is that allowed by us or do we have to send it back to the Planning Commission well if you require them to replant the replant does have to go to the Planning Commission but the property owner can request to waive those construction requirements which property owners do almost every month if the Planning Commission for some reason doesn't waive that requirement which they've already indicated by the asking to strike this that they're in favor of

[1:30:58] waiving it but if for some reason they didn't that can be appealed to you also if if the short answer is if the council doesn't want to require that at the end of the day it would come before you as a final decision to not require it does that answer your question if we vote on the condition one it's going to come back to us either way it only comes back to you if the Planning Commission doesn't waive it if Planning Commission waives it then it's done and it doesn't even come to you I have other comments other questions I do not want the public to have to spend that kind of money on the roads when we need the property yes yes I'd like to know was Murray Street a caliche limestone base a few days ago or has it just been recently resurfaced and toured with this local group that's got our streets was it was it a paved a street or was it caliche or limestone because it just got resurfaced and I don't know if it was paved I just drove down to yesterday that's reason I'm asking your plan we're glad you drove down it yesterday me we're glad you drove down it yesterday I can't wait for male Street only pushed down the road because we're doing all three parts engineering study and all three parts versus a single part but that's the only reason not for any other reason my suspension won't take it much longer that's a pretty new truck yes Murray Street was I mean I believe it was just a dirt street and we don't typically put a seal coat on a dirt street and so no

[1:33:01] that was not included with this recent sealcoat project so it's still caliche no no it's pay fresh within the last week right not all of it was paved so the part that was caliche was not paying but the part that was previously caliche was are we you know pavement is actually a misnomer it's a this was just a maintenance procedure that we had performed where we put the tar on there you know that's just to seal up any cracks the rock that was put on top of there is the actual structure to prevent any tires from getting stuck in there or you know just to give you a structure to immediately drive on top of it we did spend the money to do something on that prior to this conversation about this request great this was on the you know on the list to be done previously you know once before months even a year ago before this was even brought up so how do we make sure that the department's talk to each other we're talking about a one block stretch I mean one block is one block is one block just like $1 $1 one all counts there's everything we needed [Laughter] okay so what we have is a motion on the floor to give approval to the abandoned Street as well as a requirement to replant the property remit payment and provide a sidewalk there was a motion I don't know that I had a second there's a second we did have the public comment so we are taking a vote all of those in favor of this say I'm I know I want to just make sure we don't ask a property

[1:35:09] owner to go spend $200,000 so I just put that out there so can we get John back here I'm with you what we want to do if we don't ask for replant everything's fine right we don't ask for a replant there's two pieces of property there they belong to the one person we still get our easement correct right and then we don't require the street maintenance or requirements on either side is that correct correct if you strike that at this point right so we would strike that just leave it as it is as to plants essentially yes this is an ordinance and you can pull it from the consent agenda or ask us to put it on regular if you want and yes that's the process we should be using right now for a second reading so we can I think we need to have further conversations so on next meeting it will be on regular agenda to further the conversations and questions not asked before the vote do we have to withdraw the motion in the second HS first radian public hearing of an ordinance amending the major thoroughfare plan component of the San Angelo comprehensive plan in an area north of clubhouse Lane east of North vent wood drive south of West Loop 306 and west of foster Road thank you again John James Director of Planning and Development Services this is an area and you can see on the map here it's a little hard to see those colors but that is the existing thoroughfare plan map our thoroughfare plan is basically the map showing the future layout of streets so as development happens the developers

[1:37:14] build those thoroughfares collector and arterial roads and so what this is based on some of the development going on in bentwood we met with the bentwood developers and their engineer to make some changes in this area both to accommodate some of city staff concerns but to do that in a way that meshes with the proposed future phases of bentwood and so what we bring before you is an agreement between all parties on how that can be accomplished this is just the future land use of the area you can see it's all residential the existing zoning is mostly residential as well this is just the area here's the the loop foster road is right there and so here's bentwood and so it's as bentwood expands into this direction this would be the layout of the the major roads in that area and so basically this is a summary of what we're doing there's a collector street here that would be removed this what is labeled 1a would actually be shifted over in this direction so it's basically still that north-south collector street it just shifts over to the east this collector remains but then what was a continuation of that collector would be removed so now the collector system through bentwood would go something like this to get from you know over to foster Road as that area develops a monitor change here is this five a the shape of that was shifted slightly and then this as I mentioned this collector Street as well as this connection is removed and basically replaced by this number two so again just some minor changes the biggest changes are the elimination of this and this and instead of those two east-west collectors basically becoming one east-west collector but offset we

[1:39:20] can come back to that map if you all have questions but this does come to you as a recommendation by staff this was reviewed by the NPO Metropolitan Planning Organization Policy Board on September 14th you didn't have in your packet the decision of the Planning Commission because they just met on this yesterday but they also recommended approval can you update me with any implications and issues that would in create additional flooding problems on foster road because it's a problem now I'd like to know what kind of impact these decisions would make on on making the situation worse well separate from this I know that is being addressed by our engineering staff but these changes to the thoroughfare plan would not create any additional issues with with flooding any more than then roads would in general in fact if anything by the reduction of the total number of collector streets which are water than local streets it might slightly reduce the amount of runoff that's created although that would be almost negligible so short answer is this doesn't affect drainage look for sure on that issue so no one's gonna make a phone call that says based off of this plan the flooding got ten times worse again that that would be a function of development of this vacant area and how that occurs there the reason you're moving those roads is for that development correct correct so you're telling me there would be creased flooding issues well our development review process includes requirements that the property owners create a drainage plan that shows how they address drainage within their site in a way that doesn't increase flooding to downstream property owners and so again our engineering staff is working with bent woods engineers to ensure that development of this area has a drainage plan that will not negatively impact

[1:41:23] drainage downstream we cannot do anything to worsen the problem and development has that potential to do that so I want to make sure all of those issues that have a negative impact on the increased flooding are addressed yes and again if anything this change to the plan by reducing the number of major streets would only help that situation this also allows those residents another way out of that development if water does get in that foster and a loop yeah absolutely with this new collector at some point and then this this collector over yes it would create multiple ways that's what we heard last year was is that they had no way out when when those roads flooded in that particular area but I think this is this is a good opportunity for them to to find a different way out of that area so you wouldn't only have the one access into Butler farms meaning foster Road that's correct once this a whole area develops people all from down here would be able to come out this way also out through the neighborhood that way if if they couldn't get up the loop for some reason and when would that road be done that's at this point what we do is plan where the future roads go it's up to the property owners as developers to decide when the markets right to actually develop that this just ensures that the roads will be built as development goes but you know it could be two years it could be 20 years do I have comments for the comments questions from the council I would underscore what the mayor says I've had plenty conversations with folks in Butler farms foster Road Harry didn't raise a good point - it does it does provide another access point in and out which is needed so hopefully it'll be closer to the two

[1:43:28] years I doubt that but maybe it won't be the 24 the questions don't approve as presented may I have public comment please Russell with skg I just wanted to first thank staff for working with us helping us get this move through in a very efficient manner so that bentwood can move forward with their next section that that will be kind of right through this area from the drainage question we have presented prepared and presented to the city engineer department a master drainage study that kind of addresses development in this area and so so we'll be bringing drainage and and they're going to have a little Regional Detention pond coming in in this area here and then it will go down and drain into their large set of lakes that they use to pump out up for the irrigation of the golf course and and then it would ultimately overflow out so yes we are working to address drainage to ensure that we're not increasing peak discharge from the bentwood area as development occurs through that area so thank you be happy to answer any questions thank you questions for Russell so do you have any your okay you just set up there I just thought maybe you had a comment okay all right we have a motion a second all in favor say aye oh I thought I just did that and further public comment because I think Russell was my first public comment yes anagh bartosh I live on River Valley Lane and we do have flooding and looking at this I don't see where this water is going to

[1:45:35] flow to the river that is our problem there is no drainage to the river the land is flat it stays there and we do have flooding and I'm gonna go out and say this is still gonna cause flooding thank you for the public comment like John said before you know this this is a you know just a conceptual plan as far as the way the routing of drainage will go and then and like mr. Billy also said is that you know with our master drainage plan will be written to flow the water in this area will be redirected to these these ponds down here and there'll be adding additional capacity to those ponds to accommodate for the increased runoff and we're still working on finalizing that drainage study with mr. gully so what we're saying is that before any further development happens there will be drainage issues studied and ensure that the Butler farms River Valley people are protected from increased flooding that's great that's a quote it's on record and there's some there's some other problems out there too that that bent would probably does contribute to but there are some other issues in the area as well miss Bartos is right there is flooding on River Valley I've had more than a couple of conversations with the folks some of the folks that live there so hopefully you know Russell's team is is looking at that because there could be some I think some potential remedies not right there necessarily but in a different direction so I am aware they are looking at that Thanks

[1:47:41] any further public comment then we will take a vote all those in favor of this Master Thoreau flair plan amendment say aye any opposed motion passes 7 0 very clear okay we will now go to I which is consider awarding rfb PK 0 4 1 7 construction of concession building at the Texas Bank Sports complex-2 onyx General Contractors LLC of Midland Texas in the amount not to exceed seven hundred forty thousand dollars budget for purchase in fiscal year 17 and authorizing the city manager designee to negotiate and execute any related documents David David napkin construction manager for the city this was the second bid for this concession building out at the Sports Complex we were able to get it in lower we got a second bidder which was helpful they're both from Midland so we're still working on local bidders but this one was about a hundred thousand dollars cheaper than the other closer to where we expected the price to be so the original budget was six hundred and fifty thousand there's additional funds from half cent sales tax that we can use seventy five thousand and some capital equipment funds eleven thousand seven hundred dollars that we can fulfill the base bed which was seven hundred and twenty five thousand plus an alternate a fifteen thousand for a total of seven hundred and forty thousand I will tell you that I'm offended by this seven hundred forty thousand dollars I think it's outrageous I think about what I would be looking at if I went to buy seven hundred forty thousand dollar home in bent wood and it would be more than a concession stand so I will tell you that I think in my opinion it needs to go back out to bid

[1:49:44] again that spending seven hundred forty thousand dollars regardless money is money regardless of which pot you pull it from it's money and I find it offensive that we would spend seven hundred forty thousand dollars on a concession stand I'm not sure why it all is in there but I know what seven hundred forty thousand dollar homes look like and I don't think there's probably any comparison from a seven hundred forty thousand dollar home and bentwood to this concession building I think it's it's I think it needs to be put on hold I think we need to go back out for some more bids and I think we need to find something that's much closer to the original idea of six hundred fifty or less and until we get that that number I think we need to put this thing on hold would say that staff will do whatever we brought this to council asking whether you wanted us to design and take this forward so we did that we designed it as the other one is we agree things come in high as you know the city is held to bidding standards that were required to do so we don't have the flexibility that a homeowner has and and I feel your pain we have all felt it but at this point we've bit it twice those we've got if you want us to bid it again we can I doubt that it's going to come in cheaper we can hold off a year and do it we're at your discretion but this is item bringing back to y'all as you requested the item come so we're looking for guidance if you don't want to afford it that's your prerogative but we would help them if you gave us direction if you just want us to let it set for a year or what you want to do I certainly cannot support $740,000 I understand a need for a concession stand but we also have food trucks today's that can address those issues so it's not that food and drink are not going to be available at that the Texas Bank sport con Plex obviously there's some restrooms attached to this that that might have a need but spending seven hundred forty thousand dollars is offensive you know I can't tell you we ran into as far as the

[1:51:53] the cost of those things when we built the Sports Complex we had the same feeling about the restroom facilities and concessions the answer we got is there is a lot of plumbing there's a lot of stuff in there that isn't the norm I agree it sounds high but we ran into the same same issue initially so this has not changed from from when we built the complex so whether to go there down I can't tell you but I can tell you that we took it back did some redesign to try and come up with ways to make it cheaper allowing them more access on the property to will put boards out and they can get to it easier for the fields and all kinds of stuff and and that's what we got the second time so a lot of and and purchasing may be able to speak to this a little bit more you know the city has certain bidding requirements as far as bonding all those kind of things so only certain bidders can bid on this every home builder in town can't bid on it because they don't meet the requirements so those are all challenges we face as a municipality and in those laws we redesigned it to be restrooms only know what we were charged with to do was in order to try and maximize tournaments and those facilities coming in to bring in a restroom slash concession so now it is designed as David can tell you similar to the other quads so those can be independently used quads or function as a whole and that's sort of looking at what the industry standard is and what they have in most places so we're trying to meet that standard so no it hasn't been redesigned as only restrooms we have to bring underground utilities retrenching panels up by the street so we've got to trench all the way back with it wasn't planned I guess there was a good way to plan for this and back when they built the complex so now we we do have a lot of additional cost that's not in the building that we're running underground water and electric to the

[1:53:57] building the sewer lines right there that's easy but that's an added cost that you wouldn't normally expect it because we also don't quote have the value of the land this is just the value of the building so again we refer to home building or other development it's usually inclusive the price of land this one is just price a building and it's that's doing money do we have any idea either I guess you can look at it one or two ways what what increased sales tax revenue we would get as a result of having this from increased tournaments or what the loss would be should we not have it do we have any earthly idea what that is I can't give you those numbers you know the the sports groups can tell you know they get a lot of requests Brent as you've seen I think during our our budget workshop Carl maybe touched on a lot about that as far as the increased use of the Sports Complex that Brent Casey has accomplished over in the Recreation Department and and Brent's goal as he as y'all were asking what are your goals for increasing revenue and so forth one of the Brent's major ones was to increase tournaments because that increases revenue not only to our park it and the Sports Complex but to hotel-motel all that kind of stuff so this was one of those goals but I can't tell you exactly again food trucks can take care of concessions restrooms is probably more sports complex is not necessarily designed to drive food trucks in down there you we'd have to see you might have them at the parking lot I don't know I don't answer that fully there are other options what happens is a lot of our our tournaments are leased they lease the facility it's not a city run necessarily tournament so those operators would have to then organize that and play by our rules sometimes they like taking advantage of the situation that the city has a concessionaire they come in they do the concessions and they don't have to worry about that it's just taken care of but yes those are options it will just take

[1:55:59] more coordination on their behalf yes my question David would be is if we wait a year or 18 months or whatever that we feel like is is necessary how much added cost will that be because of construction cost increases it's only going to go up I can't say you know we have another little boom with the oil industry you know that could jump the cost up I know when we did the fire stations in 2012 or 2010 we got them in for under two million dollars they just bid out I think there are over three million dollars now so everything's going up it's not going to be cheaper unless we just I mean truthfully I don't know what we would do differently to get it in what the expectations are of how much we want to spend but we've taken out as much as we can I feel like in the building it's just cinderblock I accept for taking out and just designing a restaurant yeah yeah I mean that's an if you want to scrap the [Music] well there could be new bidders and new bidders could bring it in lower - I mean that's also reality because not that I know everything but I know some people who do build things and when I discuss this amount with them they were floored by it so I you know I just look at it and go it's too much money we you know we can pull money from all kinds of pots that's not the issue the issue is whether $740,000 is the right amount to be spending on a concession stand in bathrooms and I find it to be a very large number first time we got only one bidder brought it down by a substantial amount well is that one change package yeah we change the package and that one bidder their price actually went up from

[1:58:03] six months and then came down he came in it exactly so it doesn't mean it will automatically go up if it's postponed I think the key reason that this bid came in lower is that we did switch from the competitive sealed proposals to the lowest bid and that we're doing now for construction with the new policy that we approved in June and but just to kind of piggyback on what Rick was saying about the cost that and builders for a city incur they are paying for performance and payment bonds that home builders don't have to cover and then we also have required and certificates of insurance that are a little different on this one on this one we had two bids kind of things we're always open to new people that you may know that won a bid they have a list that we send out to to try and encourage bidding but I think there's reason to believe there will be some new bidders I think one of the things with this new council probably would would enjoy hearing is some of those costs that are attached just to the requirements for the city when we bid out these things like insurance and like bond performance and those things because I think that drives the cost a little bit and I think we need to understand that a little more so that we make it a decision up here that is best for all citizens so I'll throw something here is a parent that has had kids at the complex a set of restrooms down there is needed because it is a pain to get you know but that's not a three-quarter million dollar excuse he can run that far for three quarters of million my one is Twinkie and coke but long story short I see the need for restrooms there more than I do the concession stands so Carl I mean we haven't lost any bids

[2:00:05] because we don't have that correct that's this current time I can't connect the dots to say that we've lost interest because we didn't have it but it is the consistent number one complaint that we get from renters right there with you I will be one of those complainers yeah we do need another set of restroom Center but you know are there ways we can change the bid I mean can we trench and do utilities ourselves I mean can we take that part out and say well we knocked the bid down two hundred thousand we can trench that ourselves and you see it happened a lot let's use City Hall plaza we came down and we only had X amount of money so we we tasked the staff we test the parks department with cutting all the stone it took us over a year and a half probably to get the project done because they're still trying to do all their other projects on top of that so can we transit yes will it happen exactly in the timeframe you want it to do I don't know because what we're doing is is putting that task on top of whatever else they're already doing so yes we have done it in the past and the employees do a good job cuz they want to see it done right but I can't guarantee a timeframe if when we enter a project like this then the liability becomes a concern down the road if there's a problem we're eventually going to be the ones who are blamed for whatever the issue was and so it can't increase liability I would I would really like us to not approve this today to go back to the drawing board again and see what else we can come up with and see if there's some alternatives I just I we're a city who has very few resources every nickel is important every dollar is important and this seems like a lot of money I think we need to relook at it we look at design we look at what restrooms only would cost us before we sign off on it and then if we can find know their alternatives and no other bidders bring it back to the table but I think who are wrong to accept it as presented and not look at alternatives give us clear direction on like if you specifically want to look at

[2:02:09] just restrooms that would help us because we've done some value design already so what major change would you like to make and that could help us moving forward and bringing back to y'all then I'll make a motion that we do it Carl whew wonder I was gonna say if some of the direction is we've kind of locked in to matching the concession that was that quad one the same style the same design which did save its money on architecture fees but if you want to give us direction to have a different building that maybe not match the others that was just the restrooms that could help bring the cost down but also to keep in mind that if we redesign we're gonna have new architectural fees that we don't have now we also could have lower costs we could what are those architectural fees run on this one I'm at 10% okay the cost 75 grand so it'll cost I would encourage you not the the complex has a theme and I would encourage you to kind of keep with that style if we totally change and put a metal building out there that doesn't match you know anything else I would just encourage it's pretty classy looking place and I would encourage you while you can't adjust size and whether it's just restrooms or those kind of things really try to keep this we can keep the same style just make it the style that has bathrooms only I don't have to change the theme I would say it's design it to where you can easily add on that concession at a later day so in that area that or the concession would be have it designed for it and when whenever we can pay for it then continue out the walls and there you go it is essentially that now this concessionaires is pretty much a shell it does have equipment to allow for the expansion of bringing in equipment to make it a full concession but it virtually is a shelling out of the concession area ok Tommy has a motion you want to repeat it we make a motion we're gonna reject this bill but we have counsel to look at her restrooms only

[2:04:13] portion that will still maintain the integrity of the design of the complex and look at a cost of rebid it just give us a cost of houses of what it would take to move forward with the restrooms only that still fits the same complexion as well we get is there a second second is it public comment yes my name is Jim Turner when you're looking at something like this you do have to be careful of two things one is comparing this to residential construction will tend to get you sidetrack very quickly because a lot of the materials you have to use in a commercial establishment including things like floor coverings you have to go with a much more durable product just because the amount of traffic that's there that raises the expense a lot the second thing that is far too often not considered in something like this is the actual lifecycle cost if you start off with something very inexpensive at the front or at least it's cheap looks inexpensive you could end up spending three or four times the construction costs just an added maintenance to keep it up to your standards where people are going to be able to use this effectively and again one of the major points are brought up on one of the school projects was the additional cost of floor coverings because you've got students and a lot of traffic there and how you keep those clean and how long they're going to last and what you have to do to make sure that that traffic is not going to destroy the floor which you're never gonna see in a residential home because you don't have thousand people going through your front room those factors raise the cost of any commercial project considerably and when you throw in the additional requirements of government insurance and always stuff you're not going to see a good

[2:06:17] comparison of residential construction you need to compare it to good commercial practices which is reasonable and they're available but you need to make sure that you're in line with that residential construction will get you sidetracked too easy and then the second thing you need to do and this complies whether you're talking facilities at a ah Creek you know any type of facility the city including streets you need to look at a balance between your initial cost and the overall maintenance cost and the disposable cost your total lifecycle cost of this project because once you billet you haven't finished paying for it you'll pay for it every year when you do the needed maintenance cleaning upkeep and all these other functions that need to be done so that facility is a viable clean safe facility for the entire life of the project not just the first year or wouldn't on opening day if you don't do that you're penny wise at the front and you're pound-foolish over a long time thank you I retract my comment comparing it to home it's still too expensive I'm Chris Jo I noticed that when the Texas Bank Sports Complex was built we had no problem going after sponsorship from Texas Bank why don't we look at getting some sponsorships if we really think that we need another concession stand at restroom complex I'm sure that there are more than enough businesses here in town that would be willing to dole out of their pockets to help defray the cost like Jim was saying the cost on commercial buildings is more absorbent than on a house I think with along with you seven hundred forty thousand dollars for a session stand is a bit much especially since Carla's saying that it's just a shell it's not a complete concession stand seven hundred fifty thousand dollars for a shell is ridiculous sonoran $50,000 for a complete concession stand is ridiculous but why don't we try going after some

[2:08:19] private dollars because that's what we did to get this Sports Complex built in the beginning let's go after it to expand it thank you Chris we do have ongoing sponsorships there Texas bank buys that for what is their amount Carl do you remember 15 15 thousand a year for the entire complex for ten years yeah so they have that and we do have and as ad McLaughlin handles the advertising for us and they look for that so if there is someone who's willing to do additional sponsorships we welcome that opportunity it's always open for their public comment so let me ask one thing Rick if we go forward with what I proposed we've got in the bid didn't come in under six hundred and say sixty seventy thousand we've wasted this because we film we've thrown 75 out we've thrown 75 thousand of design fees out the window well it depends if they design a $750,000 it's ten percent so if they design a $450,000 restroom only it's 45 this is not a unique challenge to municipalities this is something that is new not not unique to San Angelo one of the things we do suffer with is we do not have a lot of bidders here like there are in other places so I think Julia could speak to that that's a challenge we have regularly I can't guarantee you it just depends what comes in and so we can try it and we'll see I mean staff agrees we want to get the cheapest you know best solution it's just this is what came in and come in we can't go make them up so we can try we would be sorry not to try I think because we're not even trying to find out if there's something cheaper and better yes Shannon carpenter in like Mayor Gunter as a tax payer I'm offended by 3/4 of a million dollars but also you're saying that you haven't gotten bids but have y'all actually reached out to

[2:10:23] because I'm all about keeping money in San Angelo when we can keep money in San Angelo because I own a business so y'all have y'all read out you know two contractors like Julia come out and answer that for you as the general practice of what we do on all bids not unique to this one yes we've actually contacted local bidders and we had one company that had assured us they were going to bid and then whenever we received the bids we had nothing from them so y'all send those out Julia we advertise and then you have a list of locals that you send out to in last thing right now there's an three-quarters of a million dollars but we don't see anything can they come and maybe show us what three-quarters of a million dollars is gonna buy what's your question I mean we have plans the plans are drawn up so yes that when the bids go out the city is required to put out specific documents and then those those bid documents go out as long as with the plans and everything that's how they I mean can we city council hasn't seen those right we're voting seven had $40,000 in a lien what it looks like yeah does it have gold tolling girl do you want to address that I think probably outside of just public comment letting it go back and forth the previous council had seen it we should have provided that in terms of the background and maybe a picture hero on the slides but it's it's the virtually the same concession that's at quad number one the first one you drive into the complex it's the same design I don't know what that looks like we apologize we did bring that to a prior council and we should have included that picture for you in the background but for the general public have you been out there it's the basically the same as what we've constructed before take along along with that we probably need to itemize all of the cost architect what the city requires and what the building building dollar amount is so that we see that it's not just seven hundred and forty thousand dollars it's all these

[2:20:44] this town to promote it because it comes right through our city and it different names will appear from time to time and the whole Santa Fe you know you go back and I had a friend that started 47 years ago at Santa Fe when he's going school and he was logging in trains and now of course 47 years later he's retired and he looked at that museum and he thought it was the finest Museum for that size that he had ever been in and that boat travels the country and goes to museums that represent the railroad industry names Ron Sherman I know he won't mind me mentioned his name his name is Ron shackle and he went to high school fine young man family man and dedicated but the train goes right by some property how long and I love to hear the trains go by and of course they blow that horn a little bit too much but I'm a good sleeper I can get through it the industry just knowing the industry still alive and well because I think all of you know that I'm getting off track here a little bit but since it's a railroad let's do that just for me they were almost ready to rip up the track Texas revived it and of course Pacifico tex-mex all those have come about the industry the oil industry is such that it's it's very lucrative now at this time provides a lot of money and tax base for our town I think it'd be wise for us to really look over the whole situation whether it be resignations new membership board members coming forward I think that's being talked about today and I think there's a desire for some new faces to be seen as you all know that the places you set down here at there's been a lot of people sitting in those chairs change things chain if you don't change you're stagnating he dies so I think I'd like to see new life some good leadership those who won't step forward and do the leadership roles and provide for a new if it takes a new board member a board seating I think new blood would help I think that thing needs to be salvaged and whether it be for six months I hope that after six months if you let select to do that I believe after the end of six months you'll see a big change and if not then of course it
