[0:02:04] proclamations today so the only Proclamation I've got is thank the lord it's raining a little bit and we need much much more so let's not forget our obligation we need more rain uh it's time now for our consent agenda let me read this and that will take care of the I mean I'm sorry for the public comment let me read this first and we'll take care of the legalities and then we'll allow our citizens to come forward it says that the council takes public comment on all items in the regular agenda public input on the regular agenda item will be taken at its appropriate discussion public input on an item not on the agenda or consent agenda may be identified and requested for consideration by the county at this time the council May request an item to be placed on a future agenda or for a consent agenda item to be moved to the regular agenda for public comment on public hearing items public input will be received on each item immediately following the council discussion and prior to any action on on the item and each member of the public shall make the remarks from the podium began by stating their name remarks by each citizen will be limited to three to five minutes unless waved by a council member for all speaking on that matter no IND individual will be allowed to speak more than once on anyone subject until every citizen wishing to comment has done so so at this time we will open it up to public comment for anyone in the audience that wishes to address the council to approach the council be it Pro or con if it's an item that is not on the regular agenda or if you have an item on the consent that you would like to be placed on the regular this is your time please come forward and make your public comments Morgan good morning ma'am good morning mayor and Council I I'm grateful for this opportunity to let y'all know uh the finance department has an upcoming uh event and we uh send an email to each of you and there's a press release out but we'd like to to let let the public know in as many ways as possible that we're getting ready to uh prepare our Capital Improvement plan and the most

[0:04:06] important part of our plan is the citizen involvement and the citizen input and we have a couple of forums scheduled one is uh February 20th at 5:30 p.m. here at the M MCN convention center and the second one will be February 25th at 5:30 p.m. at the Lincoln Middle School at 2:55 Lake View Heroes Drive uh we have a lot of uh good discussion at these it these meetings and a lot of good public turnout and we look forward to collecting all of that and hearing from the citizens thank you for your time thank you Morgan Mr Dale welcome sir thank you Council devasquez executive director for Downtown St Angelo um last week uh we had the opportunity to host uh some visitors to St Angelo uh that are interested in the purchase of the Roosevelt Hotel and uh first off I'd like to say thank you to the mayor and to to Johnny syas our council member for this District to uh for their participation and and involvement with us and encouraging these buyers to to look at our community and and and especially the renovation of that building um I'm also reminded as I was going through the process of getting ready for that meeting I was looking at the our financial uh statements relative to the Roosevelt Hotel and there was one number that really stuck out like a sore thumb and that was the uh in-kind contribution of public services and the reason I bring that up is that you know without companies that uh provided the inine support uh for us to be able to clean up that building uh uh would be between a rock and a hard place and so I say that uh I also wanted to make another point to council and staff uh and that is that uh and and I know that the rules are different for municipalities uh but coming from a corporate environment uh one of the things that we did in looking at rfps or bids or procurement bids uh we wait into the proc the the development or through the process of that development of a procurement bid um the corporate and

[0:06:09] social responsibilities of companies that are doing business in our city uh or in our for our company in that particular case but uh and I don't know how that that process works within the city or municipality uh but I would hope that uh when you are looking at that that you do take into consideration the corporate and social responsibility of what companies do to giving back into the community and that was my pece thank you thank you Dale and we would love to see something happen at that Roosevelt to maintain the historic that's a o building's pretty rough but it's still solid I be wonderful they could make a Downtown hotel out of that I appreciate you buddy do we have any other further public comment anyone else want to approach if not then we'll call a halt to that and I will ask is there anyone on the council that has any public comment they would like to make or are there any items on the consent agenda that you would like to pull in place on the regular Johnny I've got a public comment or two no I just wanted to share you know in in the name of transparency when taxpayers reach out to us and share concerns you know that's what happens uh time and time again and I wanted to share with this couple items and I think they've been uh rectified there was a concern from uh the extensive watering that was happening out there at producers Park uh it seemed to be going on like 2 three days out of the week so I don't know where that came from and according to this gentleman I think it's in fact when we had the freeze there was ice all over the place where you know from due to the watering uh also on and I I'm I'm almost positive James Flor has took care of this one on Allen Street at 401 Allen there's a vacant house that has been uh uh broken into by you know transients and using it for whatever purposes so want to make sure uh that again that this gentleman I told him I would share that with with staff and with the public

[0:08:12] uh the the main thing also on my list is and this is where I'm going to reach out to Shane uh Kelton or somebody out there because I think I brought it up one time before the railroad crossing there at Allen Street that leads towards the convention center right here on the east side of west side of it yeah I assume most of it is a is railroad property or Texas Pacifico whoever it is we need to partner up with them and really get that area cleaned up CU it's pretty dangerous out there and there there you know the kids that go through there and the parent was saying I'm scared of snakes out there you just it does look pretty pretty rough pretty bad so I hope that we can put some TLC to that area right there and then uh the last thing I want to say and I want to set the record straight because at the press conference uh that we did for uh Roland Pena mayor I stepped in for you you asked me to say a few words on your behalf you were out of town and uh I there there was rumors out there that I was saying that I W I did not welcome oil companies here I told I said what exactly what you told me this hey don't concentrate so much on the oil it's coming that's exactly what I said but I think it was turned around and and people were saying that I said that I did not welcome oil companies that is further from the truth so anyway just wanted to set that straight that we welcome the oil companies we welcome any other industry that Mr P can bring to the table and uh just just wanted to get that set that straight so thank you for the for the opportunity well I'm glad it was you and not me any other council members wish to make any public comments at any time okay on the consent agenda yeah I'm sorry go ahead sir no I thought you were going to be that's where I was headed next did you have anything Charter consent agenda on the consent agenda we have pulled uh per staff we have pulled item number three so we will not be dealing with item number three which leaves item number one through item number seven okay council is there any mayor yes sir I would I did have a just

[0:10:16] a simple question on item number two okay uh whether it's budgeted or not is all because I don't see it on there anywhere where we we'll pull number two Charlotte at three is what I wanted to pull for discussion okay winky uh you are pulling number two uh we pull number two and check on it yes that was yours yes anyone else care to pull anything for regular agenda all right I'm looking for a motion to accept 1 4 5 6 and seven Mo for approval second that was three three we pulled okay we're going to cons the motion has been made to we accept consent agenda items 1 4 5 five six and seven we will consider number two and we have pulled number three I've had a motion I have had a second do I have any public comment on this if I have no public comment I will call for the vote all in favor say I I any oppose Nay put a put a 60 on that one please ma'am all right let's consider number two which is consideration of awarding bid VM 0114 for light duty vehicles to Jim bass Ford San Angelo not to exceed $150,000 and authorizing city manager to execute any necessary related documents your own sir good morning Council I'd be happy to uh address uh either general questions or the the uh General aspect of the of the bid if you Johnny I would just look at also for the for the camera go ahead and give us your name yes sir my name is Ryan Kramer I'm the vehicle maintenance superintendent thank you Ryan okay Johnny Ryan I was just looking and I didn't see anywhere what this is a budgeted item is that correct yes sir I just didn't yes sir budgeted through the general fund the the capital dollars that we have for vehicle replacement as well as storm water dollars and and some water dollars okay sir Mr Ward yes sir uh I can recall back uh uh prior to this city council uh the uh last city council allowed a bid to go out for the police

[0:12:21] vehicles without allowing all the local uh automobile dealers to bid on that and it created quite a stir and a kick back and it looks to me like the same thing is going on this particular time and and I don't like that and uh uh you know to the uh at first blush it looks like this is payback to Jim bass Ford because they weren't allowed to bid the last time and here they are uh being the only one that was contacted of the four local automobile dealers and I think you need to tell us therefore why the other three people here in town were not solicited for bids sure there's um there's a difference in in the solicitations of the vehicle maintenance department and the solicitations of the purchasing department um I requested bids from those that we've had recent and direct contact with uh on other vehicle purchases and the purchasing department sent that documentation to uh other local vendors on the on the bid tabulation the very last page um page 16 of the bid tab it lists uh I believe that there is all but one that I can think of now local dealers that it was not sent to um vehicle maintenance requested specific ones that we wanted to be sure that we had Direct contact with um for because we've done business with them recently and purchasing did send that to um the other dealers including All-American Chrysler Dodge Jeep All-American Chevrolet Mitchell Buick Etc Mitchell Toyota did send a solicitation for bid it's not not on the information you on the on the background memo it's not because I wanted to refer directly to what I had done and if on the bid tab on the last page of the bid tabulation it lists all of the all of the dealers that purchasing as well sent this bid to okay question yes ma'am I had questioned a year ago uh to our city manager that I really questioned the way we sent out

[0:14:26] bids and how that they were sent back into us and had requested that for credibility and purposes I felt like we should have a stamped receipt on all bids that we send out to companies back in our offices to know that they were indeed sent out and they were indeed received I don't believe anything like that has been instituted and I I still feel strongly that we should do that and was wondering how you felt about it Mr Valena if it's something that we could uh simply inst all that we do just to protect the credibility of our bid process that shouldn't be a problem um actually now that you mentioned I do recall you mentioning that but uh we'll definitely definitely meet with um uh to make to ensure that that does happen in the future but uh again that's I think that's prudent actually thank you further comment Rodney just for public record how many vehicles is this uh this year we're not expecting the number that we would hope to expect um we are thinking four to six vehicles for this year uh the great thing about this bid the way we worded this was it does give us the opportunity to renew the bid um for an additional twoyear two one-year terms um and what that might allow us to do if if all parties are in agreement is to keep our pricing the same for subsequent years so we weren't expecting many vehicle purchases for this year um due to some other situations but uh that should increase drastically next year okay thank you Ryan are those I'm sorry Ryan uh couple of questions a little bit different vein there um in in the upcoming ones could you kind of let us know or I'd appreciate knowing where they're going uh of course the ones with the Police Package you pretty well know um but I I had a question why are we putting Bluetooth and uh cruise control and remote start on some of these vehicles

[0:16:28] are great questions thank you uh the Bluetooth allows some of our supervisors who potentially need to be in contact regularly either by cell phone or other means to stay in contact without um using a cell phone in the vehicle so it allows them to be handsfree which we consider a safety item um cruise control would be only applic applicable for certain situations for uh Crews that either need to um uh drive for an extended amount of time uh and potentially head out of town if that was necessary so it's it's only listed as an option uh to give us the options uh when the time comes um and remote start is a feature that I really wanted to add on this bid because it will in the future allow us to monitor idle times on vehicles which will allow us to cut those Vehicles off and have them automatically restart saving fuel uh for our for our city do do we not put uh radios in these veh yes sir we do okay I I guess you know to me I don't I don't see any difference in talking on the radio and talking on the telephone I think we could save the money for $312 a vehicle on Bluetooth stuff um I I know I've had radio and a standard and that's a trick right but especially if you got your big gulp Slurpee and and trying to drive and do all that stuff you it's it's not a safe deal but um like I said I I think if if you have a radio I don't see any difference in a telephone and $300 a Vehicles quite a bit we've had uh we've had a few Vehicles currently within our city now that some supervisors or superintendents have and they have really appreciated this item so that's why it was included here it doesn't have to be something that's purchased though okay Johnny now Ryan my question was going back to the sending out of the bids is it sent out certified mail registered mail anything like that I believe Roger could speak to

[0:18:30] that I think that would probably solve our hi Roger Banks purchasing manager uh no it's not sent out certified mail uh any returns that we do get uh we clip the corner of the envelope or whatever it is that if if it should be returned for not deliverable for some reason for a bad address uh we will keep those in our file uh to show that it was sent out uh we have not been doing certified mail just because of the cost now if that's something you'd like to add we can do that uh the businesses that we send all bids to are listed usually on the last page of the bid tab this one happens to be extremely long so there's several Pages uh but this one was sent out to about 12 different uh uh vendors and including several from the city of San Angelo notoriously though we've never had any success getting anybody but Jim bass forward to bid on our stuff locally I know uh Patrick uh the previous uh vehicle superintendent spent a lot of time courting those folks and trying to get get them to bid on our stuff and we were never able to get them to uh submit anything for our Fleet bids so uh historically we've never been able to get those guys and I know Patrick has spent a lot of time trying to cultivate that relationship and trying to do that but they just have never uh played ball with us for some reason and uh I really couldn't tell you why they just hav it Jim bat is notoriously bus on everything that we send out and we always uh every year we give them the opportunity we never get anything back thank you Roger M Charlotte well to me the cost is negligible depending on you know if I'm going to call someone on this list at random and ask them if they indeed received our Bid And when they tell me no or what bid that diminishes The credibility of it or the mail services to where it got there so a returned receipt is real simple doesn't cost a phone call and it's in the file and it's in the it and that ends our questions if they all got received do we have further comment on

[0:20:36] this I'd like to say thank you yes sir for getting the local company to bid on these things I'd like to keep our purchases that San Angelo makes in sanangelo where where the companies pay taxes and have employees so thank you very much for making this local I'm looking for a motion on this I'm I move for approval I'll second do have a motion to approve I do have a second that we go with Jim bass Ford's $150,000 for light duty Vehicles do I have any further counsil comment do I have any comment from the public on this no further comment we do have a motion we do have a second that we accept this has presented all in favor please say I I I any opposed nay nay all right we have one nay and we have five one one against and five for all right that will take care of our consent agenda so we will now move to the to the regular agenda this will be public hearing and comment under G number eight excuse me which will be the second public hearing on comments for and against annexation of certain property situated immediately west southwest of St Angelo and encompassing The Community of Faith subdivision being 4 acrr of section three block one lot three extending Southwest from Southwest Boulevard and located directly east of an 8995 acre track Annex to the city limits on March 5 213 that comprises a Preston wood Edition section number two Mrs fber good morning mayor council uh again today is the second required public hearing uh of a petition that was originally received and approved by this Council on December 3rd of 2013 uh we are moving through our proposed and approved timetable uh with today being the second public hearing we would be bringing back an ordinance to for first reading on February 18th at which time staff will be bringing you some information we've collected about the area and the services to the area with the second reading taking place on

[0:22:38] March 4th again we're talking about far Southwest St Angelo uh we are looking at a piece of property that is just uh west of Southland Boulevard again as we reviewed at the last hearing uh the property on all four sides of this particular subject property um are all within the city limits there was a recent Annex ation done that encompassed the property just to the west of this property back in December of last year so again essentially we are removing um this one isolated tract from being outside the city limits to make sure that it's consistent with the area and the property owner did bring this uh via petition to you all the property is currently vacant and today we are here to see if we have any uh public comment regarding support or opposition to the the annexation we'll take those comments and uh put those into our analysis for you and we'll discuss that at our next meeting if you have any questions about the property we can talk about that now or we can see if we have any public comment from the audience this is the second hearing on this and we went through this our last meeting but by law we are required to to put this out there for the public for those against or for those in support of so at this time I will open it up to public comment and if there is anyone in the public that wants to speak either against or for this annexation please come forward do I have any comments for or against from the council if not then we have we have fulfilled Our obligation we have had two public comments there has been no nothing either way so we will move on and we'll talk to you again on February with some documentation yes sir thank you very much father number nine consideration of adopting a resolution in support of the application of Galilee Community Development coroporation Galilee CDC to be made with the Texas Department of Housing and Community Development TDH CD for an award an allocation of housing tax credits for

[0:24:40] the construction of 48 tow houses affordable housing rental units for low to moderate income citizens to be known as the St Angelo Town Homes located in the 1200 block of Roosevelt Street brother Sol your own sir good morning mayor council uh we are here this morning to obtain Council approv appr on the resolution uh to support a state funded low-income housing tax credit in Ford countro uh the project is very much similar to the Noah States and Black Shear uh following the same processes uh but instead of a single family units they're going to be a town home uh style units uh this time I like I like to introduce the owner of the project Mr Terry Shaner from Gali uh CDC who will provide some details state your name Terry and then you have the floor sir sure I'm Terry Shaner executive director for Galilee Community Development Corporation uh presentation here you can see is from McDonald companies they are the general contractor consultant and really the the driver behind everything that we're going to be doing um do I press the for you just kind of okay okay um what this project is is 48 single um 48 Town Homes to be built on the Roosevelt Street um funded through different sources private loans some funny from Costa DC um tax credit purchases and um the rents that we get help pay back the construction of the project like every other business there it's a joint operation this will be our second one with um Granger McDonald companies um Noah Estates was with him and it was an excellent experience for us it was excellent for the city and that and the black your neighborhood this one here is in Fort koncho neighborhood these are affordable homes

[0:26:44] uh they're not the same as Section 8 housing it is basically you have to earn enough money to be able to pay your rents now we will take people that are section 8 voucher holders and let them rent but they have to to have enough Revenue to rent the the rents are set by the state of Texas through their formula of what is Affordable for income groups that we are looking to um provide assistance to um again this is not um just welfare housing this is for Workforce families that are out there you know trying to make a living especially in the tight rental market that we have right now they're having a hard time finding a place to to the location like I say is at Fort Concho if you go down exit the the convention center here take a ride on U real contro drive go maybe a quarter of a mile you cross over the bridge and if you look off to the left you'll see a a large group of land that's available we're building these in that area not over all that land but some of that Land We we've had um for that project this is a site plan this is what the 48 um Town Homes will look like to the North or actually going to be to the east is Florence and then West is um Buchanan Street Andross um Roosevelt Street is to the right um Town Homes it will have also a clubhouse with the project here's some of the front elevations um if you've been able to see uh the Noah State homes it looks a little bit like that it's got that real nice brick in the front um Hardy board material board there a siding um all the typical amenities really nice type Apartments these will be two-bedroom and three-bedroom U Town Homes some will be accessible for

[0:28:47] handicap some are twostory which won't be here's your front elevations again like I said it's it's real nice brick work more elevations here's your basic floor plans two and three bedroom floor plans here's your amenities uh we also provide onsite activities and um training for members of the community so that this will help in the long term eventually of course the goal is for families to move from Workforce into um purchasing their own homes unit amenities again um really nice um a lot of these are set by the state but a lot of these are just additional things that uh you know M gringer McDonald bills really nice quality products a little bit more about the McDonald companies actually um it's grer McDonald and his son Justin Justin there is a close tie here at San Angelo they're from cville but they are Justin graduated from ASU and they have several properties that they've built in St Angelo so they do have a tie with us and they really like our community and want to do what they can to help us continue to grow and be healthy here's some other pictures of uh McDonald companies he has 3500 rental units across the state to D to San Antonio West Texas everywhere and that's all I have if you have any any questions Council comments Terry I guess the only question I have is I'm familiar with that area but it isn't isn't there a uh water drainage issue further north off of Buchanan right we've we've uh

[0:30:54] gone through skg engineering and we've done a study and with this project we are going to have to put in a retention P very very probably so yes there will we aware of that we we are taking the measures to make sure it'll be taken care of okay Charlotte I have a couple of questions uh it says that the $200,000 funding provided by kosa DC I'd like to know how that is going to be repaid in this project and then I have some other questions after that answer uh the the board approved using affordable housing funds uh payable over four years so we'll be taking some of the 335,000 and paying back in increments over the fouryear period over a 4E period yes and then my next question is uh in noticing that the tdch uh funds will be applied for so they've not been applied for yet no this this is one of the steps if if they're applied for does approving this project mean that the council has to give resolution to approval of the project so that the packet may go to TCH is that what we're approving today also is a resolution approving yes you are you you are um basically approving a resolution of support saying without this resolution it's pretty dead in the water it's very tight and those points are very important my next question to that is we're not limited as a council to how many tdch approvals that we give for our city in a year's time are we that's correct that is correct and tdch has changed uh somewhat their view on how they approve these packets they're uh now applying more weight to a city's resolution than they are with a uh State elected official they're they changed their scoring somewhat is that true that's correct they did and that's why that's why it's so important to get that resolution across otherwise it's going to be we're going to lose points and as I get it's real tight those every Point counts thank you mayor further comment from Council mayor yes sir I'm I was a little confused by an exchange there

[0:32:57] about Council support uh I'm not sure that this resolution satisfies the requirements for coidc projects and and I'll confess I don't know what the answer there is but if if the cadc process requires further action or approval by Council that this doesn't cover you might see another agenda item in the future uh uh associated with this project okay further Council do I have comments from the public on this mayor yes sir Terry does 48 Town Homes 48 families that's and then they live there for a certain length of time and then move on or well um they could live there as long as they want to pay rent and could you know stay there but our goal is to eventually have help people get to the point where they make too much money to live there and then they can move into regular um purchase type property properties cuz galile really we we really love home ownership but we believe that for some people rent rental is the necessary thing so in other words them rening a town home doesn't mean they can turn around and buy the town home no no this these are not Rent to Own by any W okay thank you Char that reminds me the project that I shared in the ground baking with about a year and a half maybe two years ago uh that were tax credit properties with Mr McDonald and uh G I believe those were 30 individual homes is that correct and they were for rent to own and or just simply rent refresh my memory okay they're they are simply to rent rent okay how are we on that project with the number of homes completed under that project and the number of rentals that uh are sitting either vacant or you have a waiting list for right uh we have current well that project is completed all the homes are built we've gone through what's called rent stabilization where where we've had rent you know adequate number of rent

[0:34:59] for um the 3-month period that tdac requires we have well we have 100 to 97% rent there's usually every now and then there'll be a one that you know someone leaves so it's going to have to be re repared to be rented out um throughout this whole it's probably been six months now uh I talked to the property manager for that project before on yesterday and she said she's got 75 people on her waight list she could have more but there's really no point in having more cuz there's only 36 family home so legitimate qualified waiting list not just wish to have I think so okay just a comment on the uh purchase of these homes um the requirement is 15 years at that point we've satisfied the state requirement that uh the owner galle can choose to sell them at that point Point whether they do that or not it's really up to them so okay thank you Floyd I saw you making your way to the front did you have a comment on this sir well I believe Dr Stewart is ahead of me Dr Stewart come forward please sir heavy on the doctor heavy on the doctor we're about to get some statistics now aren't we sir uh yeah thank you for thank you for a little bit of time and uh yeah you and I trade back and forth about that anyway um I did a little bit of research on the question that Miss farmer just raised uh uh that uh question being the demand for this kind of activity and I wanted to uh to report a little bit on that the way I approached it was on the basis of census data and from the standpoint of trying to assess the financial soundness or amount of Financial Risk that renters in the city currently bare uh that kind of risk is measured in terms of ratios between uh the rent

[0:37:05] paid and the household income it's kind of a standard measure that when that reaches a 30% ratio so that the rent is 30% of income then from then on up in that ratio than the risk of financial soundness of the of the homeowner or the renter in this case uh is uh is in question and uh so in St Angelo we have about 16,000 renter households according to census information that's about 45% of all households which is a high number for a city we have a high rate of of renting going on in the city and uh among those households about 6,000 of them uh look to be uh households that some have some degree of Financial Risk according to the standard I was just talking about and about U uh 2800 of those U reach a 50% ratio which is really into kind of stressful territory and um if we were to U translate that into numbers of people rather than hous by simply taking the average size of rental households and applying it and this could involve about 15,000 residents in the city and so so I want to urge the um um uh the agreement of the council with this res resolution so that it can move forward because I think there is a significant demand for it out there thank you thank you sir brother crder come ahead sir I'm Floyd kryer good morning Mr Mayor City Council Members I just come

[0:39:09] to uh represent nlcp and support of this project and encourage your uh support of it as well uh We've discovered that uh whether it's uh home ownership or home rental if it's affordable uh it benefits not only the clients uh who now who then only have maybe 33% or better yet 25% of their income going toward housing uh that provides uh an uh some pride of ownership for those who have one of our homes to own which is over two dozen and even uh pride of uh of um having affordable rentals uh comes into play with our 36 rentals and these 48 and not only that but it benefits the community because that Pride uh brings about an address to social ills such as um Family Violence or drug use or truancy a variety of things if you have a community where a number of people uh have either own their homes or have pride in their in their homes because they're very well constructed uh you have less crime uh so uh the crime has gone down in the blackshare area and we're sure that if we complete the revitalization different from gentrification but if we complete revitalization uh that the community will improve steadily and it improves uh because we uh increase the stock of homes that are decent and affordable in the community and it also gives the uh the city the county and the school some income back because people pay property taxes you know one of the things that you can approve that you actually get some money back from uh and so we uh would appreciate your uh thoughtful and pensive consideration in that area and look forward to uh going to to Austin uh with a crowd of our folks uh some of them are here today uh from variety of organizations uh and also one last thing we do is as building this project we're going to be having to put in infrastructure and Roads and what's

[0:43:17] evaluate reclaimed water Alternatives including direct nonpotable and poble reuse Alternatives and authorizing staff to negotiate a contract with the firm Kevin Krueger you're on sir good morning mayor city council this morning we're pleased to bring before you the consideration of uh selecting a firm to do a Wastewater reuse study for the city and what we would like to do is is look at all of the Alternatives that that we have out there we we want to make sure that we look at what we're currently doing with our Wastewater and it is uh we are currently reusing our reclaimed Wastewater irrigation which we've been doing for many years we do want to make sure we evaluate that process and evaluate the other Alternatives that are available so if if we do obtain your approval this morning to select a firm we will then begin the process of uh establishing the scope of services for the study um that will also help us to establish the the cost of the study and we'll come back to you with a contract for your approval which will include the the scope of services and and the cost and then finally once the uh report is finished then we'll come back to the council and present our findings for the study and um just would like to say you know this you know water is a of course we all know water is a valuable resource and and we are fortunate that we we have this uh ability to to look at different alternatives for our reclaimed water so with that I'll open it up for questions charte we before we go any further I would like some clarification when I ask this question a few months ago as to approximately what it would cost to treat our uh Wastewater I had forgotten or that most of our Wastewater was spoken for or sold under contract for and if we don't have any to clean up I

[0:45:23] don't want to spend any money to uh look at so is that true can someone else weigh in on that there we we do have a contract with uh and there is and the contract is being reviewed at this time but there is a provision in there for a one-year notice to uh to allow the city to to use Wastewater and other means okay can you explain that contract to us who it is to and the amount that it is because I'm I'm just cannot recall or familiar with that contract okay that contract is with the Tom Green County irrigation and uh or Tom GRE County water can I'm sorry I can't remember the exact name but it's a um Tom Green County Water control and Improvement District number one yes that's who it's with and it's um the basic Provisions are kind of an exchange for when there is water available in the Twin butes Reservoir which they they have rights to the water and it it allows them to take all of our Wastewater for irrigation um we the city does retain lands to be irrigated that the city owns on City farm and that's a requirement by the state but we do retain uh property that can be irrigated so this this was a a contract that was entered into to to be a you know Mutual benefit to Irrigation District and the city um of course it works best for the city when when there's water in twin boots I okay that I understand but U I'm asking the rest of the council to tell me am I getting the car before the horse here shouldn't we go ahead and give notice of the one year and then wait to contract with someone because prices are going to be different in a year I mean we can't do anything for a year well what we would like to do in this study is to to look at all of the Alternatives if if we uh if you begin to look at using Wastewater in a different means you're you're going to be looking at

[0:47:26] additional treatment required uh you're going to be looking at additional costs so we would like to look at what those cost are going to be um and what what the Alternatives all are so that we can at least have an idea of the cost and then come to you and say you know this this is some projects that are available and these are the approximate cost of those projects that approximate cost is going to be a good for a year from whenever we yes yes we're looking at we're not looking at detailed cost estimate we're looking at Master planning level type cost estimates okay well I didn't want to confuse the issue and and I I've stirred this and I appreciate uh uh the Water you you you guys acting on my question as to what would it cost but I had forgotten about that our water was contracted so I don't want to waste council's time well as farmer it's even worse than that uh we have a contract with the the Irrigation District through uh 2017 uh to trade our water uh for water that comes from Twin butes and what what you need to know before you decide whether or not you're going to spend taxpayers money on a study is you need to understand that that this was done by the city uh in around 19 uh 97 and that's when the contract is is was signed and the city spent nearly a million dollars building a pipeline from a sewer treatment plant to uh discharge the effluent into the Irrigation District canal and uh that was a lot of money back then it's a lot of money now and the reason was for it had a valid reason which is still valid today and that reason is uh that when uh twin butes was built by the Bureau of

[0:49:29] Reclamation with the federal funds uh US Congress required that there be an irrigation component uh to Twin butes otherwise they wouldn't approve it and uh so uh when when the legislation was approved back in the 50s or early 60s uh they the irrigators have a right to irrigate 25,000 or take 25,000 acre feet of water per ROM uh to irrigate their crops out on the lean flat uh I understand that's subsequently been reduced to 20,000 acre feet of water perom and so they have that right in perpetuity and uh it's further evidenced by a 50e contract that the city signs uh and the irrigation people sign with the uh uh with the feds uh having to do with the irrigation and it was recently renewed just a few years ago for another 50-year contract so uh the irrigators have the right to 20,000 acre feet of water per anom uh for the next uh 50 years under this contract a little less than 50 and so that was the purpose of the pipeline is we trade the the affluent uh for fresh water and every every acre foot of water we Supply them from the treatment plant we get a credit and they they don't take that water from Twin buts so uh that that's the optimal situation it doesn't cost us a dime to in theory convert that uh affluent to fresh water for the citizens and I I just can't ever see where you would uh want to change that Arrangement and certainly not at this point in time so you know I think the expenditure of I don't know how much money you're talking about spending for a study but I I don't think that's a pring expenditure of public funds at this time I think it's prudent that we look at this as as this drought continues and and water becomes more and more scarce I think that you know we have a pretty

[0:51:33] substantial amount of water out here that could be used for our citizens um I don't discount what we're doing now and and and and it's a good deal for us you're correct but it may get to the point that we need this water for drinking water and that's what we want to look at we want to just check all the options U there are some other limitations on the Irrigation District District there's some quantity of water available in Twin views before they're allowed any water and this kind of stuff in the contract we're having all that checked out to make sure that we're clean but we just want to look at this study if if we need this water for drinking water I think it's prudent that we have something on file that we can go to and that's what we're trying to do today and that was my question to you and I appreciate your diligence in doing this is because you correctly responded to me when I asked you had no idea that we didn't have anything on file to tell us what it would cost and I appreciate that and that's the reason I asked the question but forgetting that the water was committed already by contract and I was curious as to the debt the Water Reclamation Debt Service as to how much money we still had outstanding in the debt when councils did this in the 90s and I'm sure you're not ready to address that today but um are you talking about our twin mes payments on the depth side yes pays off in 2017 2017 so we're still in that debt we have two payments left okay so that's all that's all we're up to today we just want to try to hire someone to look at this and and let's make sure that we we've got all options available wanted to lay all of it out there that uh maybe I was being a little premature and trying to find an alternate source of water but had no idea and that was my reasons okay do we have further comment Johnny Ricky I guess and and I I kind of follow what Charlotte is saying I I'd be comfortable knowing that you guys are going to go and negotiate a price for this study for

[0:53:35] a fee for this study correct and bring it back we're not going to spend any money we're not spending a dime today you're just going to negotiate okay right Rodney the that was one of my questions my second question is they have rights to 20,000 acre feet out there right now how much are they taking right now a year out of TW out of from from where from the plant yes uh a little over 8,000 AC feet a year yes okay so they're not getting even close to what they have the rights to that's correct Don do you have anything to add sir well my thinking is you know I have no problem looking into it but I to me we're if it comes down to it I'm not going to really be for spending money on a consultant to tell us you know what we can do uh when we've basically already got the the water spoken for and you know prayerfully and hopefully one of these days this our leges will fill up when that happens we're still going to be committed to to that much water and so consequently to me we're spending good money after bad because we're still going to have to have to give up 20,000 acre feet that is certainly your option further comments my question we did a study just like this in 2006 with Alan plumber what what what are the results there are they still viable today I don't think so I think so many things have changed since 2006 on the stipulations and tcq requirements and different permits and and the way people are using this water this has been done all over the state and all over the country so I I think it was the study was okay but I don't think it went into an upto de with what's available today well I do know we're in a very dire water situation right now it's it's very serious and we we need to look at options this is one Don I I just have one more thing I

[0:59:45] for this sir so take off I asked for this back when we this first came up and uh first of all I want to know is there anybody here from the school district that's what I thought I I'm really sad very very sad the school district did not send anybody up here for something that I think it's this important we've been discussing water issues all morning long and when this was first presented to us their their head of Maintenance for their water department said he was going to save the city 5 million gallons he said 5 million gallons over a two-month period he actually saved 800 just over 800,000 gallons not anywhere close to the 5 million gallons he I do realize he misquoted the 5 million should have been their total amount of water which has include sprinkler system and their watering their indoor watering and I think he did real well what I wanted to talk to the school district about and have them come up here was they're going to ask for this again in November of this year I know they are we're probably going to be even more Dire Straits at that time and I know that the council will probably vote to give them the water rights again what he showed me here though is that he did shut the water off to the sprinkler systems on the outdoor by saving the 800,000 if he would have just came to me to begin with and said I'm going to shut off all the water basically all the water to the exterior of all these schools and save that water I think I would have been been able to take it a lot better than what we did take it I encouraged the school board to talk to this to the maintenance department and and the people that are in charge of the situation and talk to them and see that from now on in the winter time this he's he showed us that it can be done they need to just do this they need to shut off the water on the exterior and I think that we would as a group be a lot more accepting to allow them to do the over seating on the baseball fields I'm really disheartened that uh they didn't even have the respect to come up here and and talk to us and and hear what I had to say about this but uh the city of St Angelo needs to wake up and realize that our water is the most valuable thing we have and we don't have a lot of it at this time we need to take drastic

[1:01:49] steps to saving this water and I I think that people just aren't taking this as serious as that needs to be taken thank you I think you said it very well Rodney I think you said it very well do I have further comments from the council start with Don um one of the things I wanted to do along those same lines is is give an attaboy to ASU and that they they just finished up with one of their fields and put an AR artificial turf in so that you know one of the big things of course was saving water uh for future needs on that and and so you know I I just like I said I wanted to say adab boy and that some of those that we're we've been talking to and talking about are understanding and trying to help with it Charlotte in support of Mr Fleming talking about the seriousness of the situation of water I would like to ask if our city manager could U send a letter to all of our boards and committees that the number one question that they should be asking on every project that they look at approve or disapproved or recommend to bring to council the number one question that they should be asking themselves is how much water does this project going to use cost or take before we send it on to council they need to be asking that question to become more aware so we need to start at home with our own committees our own boards in making that the first question that is asked thank you further comment from Council Johnny did have a meeting with Brian May yesterday and I I I will come along with Don on that and he said we've we've cut off outside watering I mean they have taken this very very seriously so uh we have some that are doing what they can and it needs to be continued Mr Ward yes I'd like a a policy clarification concerning the use of our fire hydrant for uh water trucks filling up uh we had a discussion on that months ago but uh

[1:03:52] we've got the daily use of fire Hy sat on Smith Boulevard by Sophia R Soph Sophia Industries uh and I don't believe there's any meter on that fire hydrant so I don't understand what our policies are about taking water out of our fire hydrants around the city and I'm I'm I'm 100% behind you on that that is we can't have that we cannot have these oil companies or anyone else taking water out of these fire hydrants unless they have specifically been approved and are permitted to do so where we know how much are taking for what uses so I would encourage Mr Dixon get in this we need this needs to be stopped and also I continue to have people ask me why do you open up these fire plugs to either clean them up or when we have a leak why don't we run that water into a truck and use this water even if we just take it and put it back in the river why do we let this water run down the street so uh I would further encourage us as a city to let's not waste this water it's it is finite we can't waste our water thank you sir well one other comment I'd make uh the thing I think has got a bunch of us concerned is if a company takes water out of a fire hydrant that's not metered then you're just on the honor System and I don't think we need to be on the honor System at this point in time no sir well maybe if we confiscated a few of those trucks and trailers we may get somebody's attention but we could use it we need to stop this I think the the lake residen who it's hitting right now and they're starting to see it on a daily basis the lake is dropping right now daily and weekly we're losing about 1% of our lake level a week right now if we don't get any rain in the near future so they're kind of they're calling me in that is my I'm getting call I get a one or two of calls a day about what we're going to do about it and there's nothing we can do about it this time there's no water we can pump in there we're at the mercy of God and you know we need to be praying about that Johnny mayor I just wanted to call a point of order we need to be careful we're talking about sisd

[1:05:54] and the water usage th this discussion sounds like a future agenda item so I just wanted to throw that out there kind of working on the periphery here on WE yes very close and then you can have public comment it better be about sisd and and nothing else I have been called to order on this and you're right do we have any public comment on sisd watering as the agenda item calls for if not this was just an update and a discussion I don't see any action that we could take no do you see any action Rodney that we should take on this it would just matter Turner do you want to speak come ahead sir just a point of clarification my name is Jim Turner point of clarification on the trucks that the city authorizes to take water out of the fire hydrant I think if you check every one of those actually has a meter on the truck that is sealed and checked by the city if we find a truck that's not with a meter on it then we have a problem but it's not the honor System per se every one of the trucks that's authorized use that water is supposed to have a meter okay on it if you check with the construction companies that have had contracts with this city and so on that's how they do it I'm familiar with some of the companies I don't know all of them but that's how they do it they actually have a meter that the city checks seals Etc if they're not doing that that's a different story but we should be metering every bit of the water whether it's ISD or anybody else to make sure that they're not taking what's not their share and that they're not paying for what they're taking thank you I believe it was Ronald Reagan that said trust but verify do we have any further comments from Council do I have further comments from the public if not we're going to move on to the next one let's go to item number 13 this is update and discussion on the ordinance adopted by the city council on December 3 to13 number 21321 165 concerning the city of s Angelo's

[1:07:57] application of existing policies regarding commercial property development related to mobile homes manufactured housing Parks Recreational Vehicle Parks and related matters AJ fer you have the floor ma'am thank you we just wanted to give you an update of where we are in the process of putting together uh amended and new regulations to address these items um as you may recall the moratorium that was enacted by this Council took effect in November and we are looking at the time period that ends on February 19th uh for that moratorium we um provided you a background report that was very brief but just outlined where we are with the process in order to have the final ordinances enacted by the end of the moratorium period those would have had to be introduced at the beginning of the year uh the committee has had some substantial progress we had some good meetings in the month of January that I think got us much closer sir I would venture to say that we are probably 90% of the way complete for these ordinances um the committee has has done some good work obviously we had some issues getting committee meetings together around the holiday season and that did make things a little more complex because of that issue we are bringing back to you at the next meeting on February 18th an option for your consideration for an extension of the moratorium for a second 90-day period we don't feel that we'll need the entire 90-day period but it does give you some cushion if you will for any discussion that you might have based on the products that are brought to you as well as to the Planning Commission they initially as you might remember started this process by um sort of initiating a joint session with you all and so we want to make sure that we also take this to them for discussion in February get their input and some recommendations so that you have some recommendations to consider not just from the committee itself but from another uh commission that is essentially tasked with carrying out and enforcing the zoning ordinance we are looking at uh taking that to them in February and predicting that we can

[1:09:59] bring you a final product in March uh when I say product it will probably be a very comprehensive package right now we're looking at about eight different pieces that we are working through with the committee working on things such as wording making sure they're consistent with their original goals working with our legal staff to make sure that they are all legal uh processes that we are putting in place so that's essentially the projected timeline for for you we wanted to make sure that you were prepared before the next meeting so you understand where we're trying to move with this and just to open it up for any questions that you might have if we don't have the answers today we'll bring them to you at the next meeting Rodney you've kind of spearheaded this are you are you comfortable with this sir yes I am one question I have though these are going to be recommendations we don't have to accept these wholly right that's correct and that's one of the reasons why we want to allow that cushion we know that no matter how many people you get involved with the process there may still need to be tweaking involved D thank you any yes Mr wock I would if possible I would really like for these recommendations to be given to the Council on the first meeting in uh March so that we can have time to analyze them and study them and take action on them uh in uh April in April really okay that meses exactly with what we were thinking of so we can actually we can do that we'll actually try to get them out to you further in advance so that you can review them before the meeting and then we can discuss appropriately everybody comfortable with that yes any further comment from Council any comment from the public on this then this was an update it was discussion thank you AJ thank you very much and if you see any of those committee members um I urge you to please commend them on their work they have sat through some very long meetings and have gotten um into some very detailed wording and uh discussion and so they've been very patient with us it's it's been a very fruitful effort I think this is very serious and this is going to affect our city for for years to come so it we've got to get it right yes thank youj very much okay number 14

[1:18:14] really would like to see that uh real soon Mr Silas you have anything sir I really I really did but to add to Charlotte's comments I know at one point uh Jerry C was interested in getting with whomever Shane or somebody spot about all the churches getting involved and you know getting out there and doing their thing so I don't know where that's gone but that's an excellent idea because I I cringe when I see stuff like that too well the AO on Sherwood Way as often as we've had it cleaned up it's already filling with trash blowing and it's it's coming from the commercial dumpsters you know in the area and there's so many of of them uh there's just got to be stiffer penalties for better controls is all I I can say I don't know how else to address it and I know that WT has some long arms and a lot of Manpower I mean if we don't want to use our guys they don't have the time when when it turns into a mess it can become a code issue and there is the stick approach yes from the from the operation of the dumpster and what kind of options might exist we might get input from operations Shane kelt MH um but certainly from the enforcement side that would be James Flores helping us understand what what kind of challenges they have I know that in the past they have had challenges in particular locations with particular um businesses using uh dumpsters or actually not using dumpsters and creating a mess that way and they've had to work those issues well I know that you know our our tax spent you know the dollar is showing that our shopping power here is much more than people that live here and to view and to see this as you come to town to shop in Beautiful s Angelo it doesn't become beautiful s Angelo very quick when there is trash everywhere and if you just take some time to drive behind you know the buildings and observe it's blowing out of the tops of the dumpsters okay and mayor I'll add I finally I'll add that I know code is doing the best job they can and I

[1:20:19] applaud them but you know what at at one time or another the citizens have to take ownership of the city you know city government can't do everything so the citizens out there have to hey if it means you pulling up to the side and picking up try I mean what's wrong with that you know uh so somehow the citizens out there the taxpayers have to buy into this idea of keeping our city clean you know at one time we were striving to be an All-American City but you drive out there just like Charlotte says we're nowhere close so Mr flaming I would like to add um an item for the next meeting to go over the red Royal storm water feasibility study I know that was presented to us in executive session about four months ago I I personally would like to have it brought out into public and I want to I want Chuck Brown I've already talked to Chuck and Bert Weathersby to be here and Ricky I want to know why what's holding this up and why aren't we moving forward on this this thing is sitting here and no one's doing anything this thing should have been done 20 years ago and I want to make sure that it does keep moving forward you you can address that today under number two on our executive executive but I want it out in public you want okay do I have any other comments anything else need to be I have nothing to add all right I suppose now it is time for us to go into an executive uh let me read these and y'all be thinking about it say about how long you think we'll be in before we come back and deal with the last two items but the executive session under provision of government code Title Five open government ethics subtitle a open government chapter 551 open meeting sub chapter D exceptions to requirement the meetings be open under the following sections number one is section 551 0712 to consult with its attorney on a matter in which the duty of the attorney to the government of bual body under the Texas disciplinary rules professional conduct of the State Bar of Texas clearly conflict with the chapter

[1:22:21] regarding the west Texas Christian Foundation property AKA Christian village number two section 551 072 to deliberate the purchase exchange lease or value of real property regarding number one West Texas Christian Foundation property AKA Christian village number two R Roya Hills Edition number three Lake nasworthy number four terms and lease rates for recreational Agricultural and grazing leases along the cono River in Lake nasworthy and number five the proposed fire station uh number three section 55187 to discuss an offer of financial or other incentive to a company or companies with whom the city of San Angelo is conducting Economic Development negotiations of which the city of San Angelo seeks to have locate stay or expand in s Angelo I'm going to say that we're going to be at least an hour and a half in executive dealing with these it is 10:49 that would be 11:49 1249 do yall think we can be back back here in session by 1:00 no no 1:30 y let's shoot for one and Charlotte may be right and if we can't be here by 1:00 then I will come back at 1:00 and make an announcement of when we can be because we got some pretty difficult things to deal with let's shoot for 1:00 if Council will back me up on that with the caveat that it's probably going to be 130 and with this it is 10:49 I take us to Executive it is 101 so let's get the meeting started again we have only one item am I am I correct on this L we one item that we are dealing with everything else is negotiations that okay so we have only one item that we're dealing with and that will be item number 15 which is consideration and possible action regarding an economic incentive

[1:24:22] agreement with Texas pacifical Railroad Bob would you like to come up and come and give us an overlay on this place sir thank you uh as the the uh council is aware um this is an item that came from the uh uh Costa DC board the Development Corporation board recommending an incentive uh or Grant to uh Texas Pacifico railroad for moving their headquarters here and for creating creating jobs here also for um bringing a putting a a building that had previously been off the tax rolls in a nonprofit uh situation back onto the tax rolls where they now have their headquarters um under our guidelines any uh company moving their headquarters to St Angelo is eligible for up to $110,000 per job uh by by our guidelines um based on new job or jobs created or retained uh CAD DC in addition felt that that this particular item was something of a relationship Builder that um we were looking to support local businesses uh and that we were trying to establish a longer term sort of Goodwill relationship with Texas Pacifico who is uh going to be a very large contributor to our local economy over the years to come whether that be through oil field or through um other moving other goods and services through uh the city uh this is an item that was voted on by Costa DC and it was unanimously approved by the board uh and so staff brought it to council uh and uh uh this time we'll we'll open it for any questions that the board may have for me council do we have discussion on this well I'll open it up I'm sorry goad I will open it up um um it's a proven fact to me that uh this firm has created secretarial jobs

[1:26:28] payroll jobs uh yard jobs uh considerable jobs jobs that weren't there and the people that are there very thankful that these jobs have been created and I see participation from us and taking the recommendation of the Costa DC board is something that we can do to uh create Goodwill uh for this company moving their headquarters here it's certainly been a long process and it's taken a while to get here I'm not for the full incentive amount uh I am against that and I would like to see that cut back to only $2,000 per job and I'll make the motion or move to make the motion that we approve that amount for those jobs uh per the coad's recommendation but only less than what they recommended thank you there has been a motion made that we that we incentivize Texas Pacifico to the amount of 2000 and this was 36 jobs am I correct 33 sir 33 jobs times 2,000 the motion has been made do I hear a second the motion has still been made I have not heard a second there is no second therefore the motion is void do I have another motion from somewhere else to go a different direction I move we deny the request for uh funding from the coast of DC to the railroad Mr Ward law has made the motion that would deny any incentives at all to Texas Pacifico do I have a motion do I have a second of this motion I will second that one we do have a motion we do have a second I will ask if there's any other further Council consideration any consider any comments from councel do I have any comments from the public on this this is the time to stand up and speak up if you have an opinion
