[0:02:10] [Applause] [Laughter] indivisible what a good job y'all did this morning thank you so very much we have one recognition this morning and and this is for the city of St Angelo finance department for obtaining the 2014 certification of investment policy by the government treasurers organization of Texas Tina you headed this way Tina benell is our finance director and this says the government treasurers organization of Texas certification of investment policy presented to the city of St Angelo for developing an investment policy that meets the requirements of the public funds investment act and standards for prudent public investing established by the governor government treasurers Association organization of Texas Miss Tina thank you thank you ma'am and if you would make your speech oh sure uh we're certainly pleased to receive this award it just reaffirms for us that our investment policies and procedures are in accordance with the public funds investment act which governs municipalities um it also shows that we're making a concered effort to uh protect the city's funds by looking first at safe and then of course liquidity and return on on investment um I want to thank Dale Han he's our cash and debt analyst uh in the accounting Division and he's done a lot to help us earn this award so thank [Applause] you thank you very much we are now ready for public comment and

[0:04:13] this is a time at the meeting when we allow our citizens the chance to come to the microphone and to make their public comments to make whatever they want to say whether it be Pro or con but this is your opportunity let me read the legalities and then I'm going to open it up to the floor the council takes public comment on all items on the regular agenda public input will be taken on the regular agenda item at its appropriate discussion public input on an item not on the agend or consent agenda may be identified and requested for consideration by the council at this time the council May request an item be placed on a future agenda or for a consent agenda item to be moved to the regular agenda for public comment on public heing items public input will be received on each item immediately following the council discussion and PR to any action on the item each member of the public should make the remarks from the podium and begin by stating their name remarks by each citizen will be limited to 3 to 5 minutes unless waved by a council member for all speaking on that matter no individual will be allowed to speak more than once on anyone subject until every citizen wishing to do comment has done so so form a line come to the front state your name and let's hear your comments who's first I do have we do have some Boy Scouts in the back would you like to come forward and explain identify your guys and tell why you here onot didn't mean put you on the spot buddy but when we see when we see children in the audience we like to identify them and recognize them my name is Robert Basham scoutm Troop six I've brought um three of my Scouts along to observe uh uh city council meeting to they're working on their citizenship in the community merit badge and trying to let them see how our community Works how government amongst the people works so this is uh Joe Morris Nathan Morris and Michael hogland welcome we're glad

[0:06:18] to have youall here this morning thank you anyone else care to approach the council are there any comments with the pro or con if there be no be none from the public and I'm going to turn it over to the council is there anyone on the council that has any statements or anything need to be said or anything need to be pulled start with you Charlotte yes I need to uh make an apology to the city staff and to Mr Valen AA at our last council meeting I spoke pretty critical of uh the planning department and the way they went about of things and that is my error uh if I need to be reminded time to time it's a good thing because can't remember everything but council members should only address the city manager and not the staff uh we we shouldn't direct our comments directly to them at the podium or anywhere else that only should be done to Mr Valena and I do apologize and uh in the future please keep me straight thank you man' appreciate that do we have any other comments from Council Elizabeth I've been contacted by a few folks in the community that of course are very disappointed municipal pool closing uh during the week and I would hope that in the future we can manage that better so that that doesn't happen so that our our community gets full use of that great facility just to point out on that M grindstaff we had some technical problems with pumping systems there so it was something that was so it wasn't just a staffing issue no we we had mechanical problems that we couldn't predict understood also um I'm having my second neighborhood chat this evening 7:00 at Santa Rita Elementary School in the lovely cafeteria for anyone in smd5 and our friends that's all okay well I do have one comment and I think we've all heard about this ice bucket challenge that's sweeping the nation for ALS and I've been challenged twice my uh young grandson and then yesterday I went

[0:08:22] to a meeting and Becky Ruff has challenged me so I will be at the McKenzie I think it's 1421 home of Mike Ford tonight and I'm going to take my my bucket of ice and then I'm going to make some challenges myself I'm going to challenge a man by the name of Valenzuela and a man by the name of wise and a man by the name of Dane and depending on how this meeting goes today there may be a Dixon and the bowling and a Ramirez so there just no end to this so anyway this is a this is a good deal this is raising money for ALS which is L G's disease and it's uh it is sweeping the nation so anyhow anybody got some challenges you can help me with them do I have any items on the consent agenda to be moved Miss Elizabeth I have two I have uh one uh on the item having to do with uh fire department and the award of RFP FD 2014 supplemental program services number number two number two and then also uh the item on the new freedoms act and that's or Grant fund and that's I think relevant to several items six and seven okay so you're pulling from the consent to the regular agenda items number two items number six and item number seven yes and I don't need a full presentation I just have questions okay very well uh is there anyone else at Council that wants to pull anything yes ma'am I also was going to pull item number two but I want to pull uh item four 9 and 10 oh and 13 4 n 4 9 10 and 13 I thought we going to have a short meeting today anyone else care to pull anything what are we looking like on the left wing down here y'all all right sir Don you all right I don't think there's anything else there nothing left okay I then will

[0:10:26] ask for a for someone to move that that we accept the consent agenda items this will be item number one item number three item number five item number eight item number 11 and item number 12 anyone so move so move Don I'll take yours Marty I'll take your second is there any other comment on these items do I have public comment on any of these items that we have moved to approve if not I'll call for the vote all in favor please say I I any oppos Nay put a 70 on it let's now start with yours Miss gr staff let's start with number two this is consideration of awarding RFP FD 214 for supplemental program services to McKesson Alpharetta Georgia authorizing staff to negotiate a contract in substantially the attached form and authorizing the city maner to execute said contract brother Ferris you ready yes sir SC what's your question Elizabeth I understand the the program but in the summary the last uh piece of the summary says These funds shouldn't be used as a revenue stream as they aren't permanent they should be used to help replace Capital items such as scba's ambulance equipment or vehicles and I don't think I'm used to seeing someone uh tell us how they should or shouldn't be used that I could see that more as a discussion for the council in a larger budget conversation um even though I understand they're not permanent this is a a fairly sizable Revenue that could go to the general fund yes ma'am and it could and I I think that was the the point that Chief D was trying to make here is that it's not a guaranteed deal the state can stop it at any time uh you know they can pull the rug out from underneath this program and then we wouldn't have any funding but we're going to try to get on board with it and start it but I think you summed it up it it is not guaranteed and it's not a it's not something that we

[0:12:28] will see every year coming in hopefully we will it's a three-year block when they vote in this program so every 3 years they vote on running another three years but you'd have no problem with those funds going into the general fund and being used as the council sees fit for I think we need to I think we need to recover any monies we can recover and and use it for as needed so yeah and I think it was just stated badly in there but that was his intent is that don't count on these every year they may or I don't yeah yes ma'am that is true so mayor oh I'm sorry I I just have another question also um let's say someone is is unable to to pay these what what are the ramifications for that this is a program that's put on by the state that's state funded and they pay you up to I believe it was 5 59% of unpaid stuff so this is all state funded stuff it don't it's a new program that the fire department discovered that we could try to recapture some cost that we're losing right now through the state so it's a good thing for us but it doesn't affect what's going on where someone's having a payment issue yeah this won't go this won't come back to the citizen and by them okay that that's was my main concern along with Elizabeth's also did you want to add some language to this Elizabeth say that I would I would um make a motion to approve the award I just I I would just prefer that the that the the revenue stream that this produces not be dedicated as a action of this as a result of our action today is there any way you can state that to enhance the motion mayor yes sir may could I assist uh we have that that pool had that pool of money in the general fund to use as pay as you go capital and and that didn't have to be used for Capital it could be used for whatever priorities Council saw fit in the in the proposed budget today we've

[0:14:31] used that to close the gap and we've allocated it to priorities perhaps we could uh to the extent that this money is not in the budget when we amend the budget and put the money in the budget put it in a similar kind of pool that would come back for Council consideration later on and so uh that's good so it the motion would be just to approve uh the award as written but I'm not I'm not occurring with the summary where it says how it needs to be uh re reallocated well and and I also don't think that it's prudent on us to to have the fire department think that they're just automatically going to get those funds um we could perhaps um put it in a separate account or something like that and track it like we do that you know those Lake nasworthy funds that we have that we bring back to counsil each time we go to use it right you do any other income right yeah but if you wanted to track that amount separately I'm just saying we could I really think it should just go into the general fund I think Brian's whole intention here was just to say don't count on it for ongoing coming in it wasn't to tell you where to put it or anything like that so I would recommend it just goes into the general fund as normal and you decide how it's used as long as you do that I would make the motion to We Will and I'll make the award do have a motion I do have a second do have for the comment public comment call for the vote all in favor please say oppose nay item number four is consideration of declaring 0.160 Acres out of and part of the Peter Duffy survey 171 abstract number 133 and the J fuk survey number 172 abstract 204 located in Southwest St Angelo Tom Green County Surplus for the purpose of disposing of surplus property for the appraised value and authorizing the city manager to execute all documents necessary to convey the service estate only in the Surplus property by special warranty deed to the adjacent property owner preserving under the city of St

[0:16:33] Angelo o mineral interest surface and groundwater rights and to execute an amendment to that certain recreational and agricultural lease agreement between the city and Lisa Duncan dibbits to conform the least premises and the least with the authorized conveyance Charlotte was this yours would you take it then please ma'am yes uh I just want to remind staff that youall know what you're doing and what you're talking about but when we're reading on a piece of paper if it's not as C is mud I can't assume so I'm just asking the question I see that the value of that point uh 016 Acres the value was $88,500 does that value include the mental rights or is that exclusive of those mental rights is that excludes exclusive and then my next question is I am I to assume that we are receiving that money for the conveyance of this land we are correct motion to uh approve as presented second do have a motion I do have a second Charlotte and Rodney do I have further comment from Council I have a question U Miss priest are there other are there other sites similar to this that are encroaching that need to be dealt with in a similar fashion just as a matter of housekeeping we are working on those Pro um those properties as we as they're identified this was one property that was actually identified by a survey the property owner brought it to our attention and requested to make it right um it was declared Surplus by water utilities division so we just move forward from there thank you further comment do I have public comment on this item then I'll call for the vote all in favor please say I I oppose Nay put a 70 on that one number six is consideration of adopting a resolution approving a cash match of $ 68,7 se7 as required for federal New Freedom fiscal year 2012 project Grant agreement awarded in a sum of $275,800

[0:18:59] started when I still worked for the city and that's been a few years back um I've had some comments or heard some comments in the community and perhaps the best way for or the best use of your time and ours is to uh maybe ask mayor Mr Cornell to come up and uh kind of give us a kind of an overview of his concern about the project I've heard it spoken from a few other people um Chris do you mind did you need did you need Carl to give us an overview the city or if whatever your preference is does anyone want to hear about this again I mean I'm I'm aware of it but does anyone on the council need to hear from the city perspective about this about this project which has been ongoing since 211 no if not then I'll ask for Mr Corel come up I'd like to hear from Carl I'm really kind of confused about what's happened uh this project was let uh through a solicitation uh put out by the cvtd in conjunction with city of St Angelo uh ree Albert was a sole offer on that contract Thursday uh July 31st we got a call said hey we we all take six blocks we said yeah we would we would take that then it then it fell apart so I I don't understand how we got to where we are and so that's kind of the clarification I'm looking for and and what are you going to do going forward because I understand this grant has a timeline of May 2015 and time is short so okay like I said this is a long long uh Grant process that's been going on since 2011 I think it's two grants phase one and phase two one is through the city of St Angelo phase two one is through phase three is through KRA Valley Transit District we're com combining those because they they're on the same

[0:21:00] Corridor on North chadburn to try to get an economy of scale because the grants are not very big they're together like 600,000 for a long stretch of road it was from 7th to 18th originally we looked at that we couldn't really do a a a good job for that link so We Shrunk the project down to 14th uh with and you know some my staff problems I've had with not having enough staff so we worked with CD to put out a design Bill project uh and uh in that proposal the contractor would have a um engineer do the design and they would do the project build it in one in one contract we let that out ree Albert uh partnering with KSA Engineers was the only submitt we had uh we looked at the prices they seem to be high to us we we did went through some negotiations Maybe Shrunk the project down some more uh trying to move forward with the project and and all through this text Dot is the manager of the grants of Federal grant but it comes through techop uh we had conversations with techop they looked at all our proposals thought we were good we have several conversations with them several uh conference calls at the last minute uh they they said no you need to go back and advertise or or separate the engineering and the construction out so we notified re sber that uh we're going to have to do it that way and uh going forward um I've since learned I'm still new here I'm sorry but uh that we have a process where we have a service contract a ongoing service contract any Engineers can put in for that uh skg put in in that pool years ago uh we're working with them in fact we uh have some documents through legal and and got that signed yesterday and we're bringing it to Daniel to move forward with them doing the design have a design uh complete by

[0:23:04] October 15th I believe we're going out for contract then to complete the project by May 15th Carl did all that activity you just described that went through the cvtd right yes they were handling all of that yeah in conjunction with us we had a lot of conversation with them and we but that's but they were handling all the bidding right yeah they handled the bidding and and that that was not going through our purchase Department no not at the time no all right so I believe the cvtd has Representatives here if you have questions related to that you know uh their purchasing processes are a little different than ours I don't think there's anything unique or significant there but they can represent their position on it I don't think we should represent our position I don't think we should represent their position thank you m Charlotte Mr Valen is this the one that I brought to your attention about the grants I believe it is it is yes ma'am M gr what uh and I want to thank the CV uh TD board uh in group this was brought to that board's attention which I served on that board that they were about to lose the grants because of a technicality a small fall through the cracks we at the city had lost numerous valuable employees and it fell through the cracks and we literally got uh Mr Carl to bring it back up and get it going so we didn't lose the GR there was just a drop and uh I appreciate the CVB for bringing it to our attention that we really needed to move on this that's all that happened but the scope has changed I mean and as time goes on there's no I don't know of any construction right now that gets cheaper over time I I can be wrong but it seems that the the more excuses we make the the more expensive our our projects get that was one of my concerns when I looked at the date and then I think both the mayor and I had calls from uh Mr Cornell just concerned about the status of the project and if one of the biders doesn't

[0:25:07] understand the status of the project then I think we all have an issue so as long as Mr Cornell is satisfied whether it's through the transit district or or you I'm satisfied the bids came in uh in excess of the budget that's that's what's driving the scope change major you have anything say on this we're available for any question come to come to the microphone please sir yes sir I brought Jude with me he's our procurement director and um he was he was very heavily involved in this there was give us your name your full name for the major hoffin I'm the operation I'm sorry major I didn't I apologize I knew better um the city was in danger of losing their portion of this grant uh mainly because of the timeline that this has had dragged on and on and on the Tex dot agreed to give the city another year extension to match the deadline on our grant if the city would use our procurement procedures because they matched what Tex Dot and the FTA were looking for and so at that time we entered into a partnership with the city to work with them to get their Grant extended to May of 2015 so that this Pro so that we could go forward with this project and at least make an attempt at it so we decided this would be a good opportunity since we were going to go under one procurement system to combine the the funding into one project and see how far we could take it uh we had figured through market research that we could hopefully get as far as 14th Street we knew we were not going to be able to get to 18th Street because again prices increased since this grant was led that's a long time and with the industry

[0:27:10] that's moving into our community prices have gone up so we thought well we can get this far so at that time we put out the request for bids uh they came back um way above budget and so at that point we had several decisions to make and and um unfortunately it's not going to take us even near as much as we had hoped that it would but at this time this is where we are and and uh we've got to get over it but the big thing is we need to get at least the design portion done so that we can get reimbursed for those funds and have this design in place should more New Freedom grant money or other Capital Improvement money become available here in the near future so that we can then go on and complete this project so you're saying we're not going to be able to do the project I'm not saying that we can't do it I'm saying right now we at least need to get that design done that is the big thing right now there's no design work there's no design work the the we've got I'm taking allergy medicine I apologize just making sure I understand we got we got an original um plat design basically uh through City engineering of what we basically wanted and what the te board and everybody else was looking for however it has not gone through SK engineering to come up with a with a design for the project so how do you bid on something that there's no design for it was bid as a design build it was a design build project so that the city Engineers came up with the the basic the basic format of what we were looking for and because the design build is is unique to us it's not part of a a city procurement process um where we actually go out and we hire somebody as as part of the contract to do the design portion and then they also follow through with the build portion

[0:29:13] now once we received those proposals and we sat down and we looked at the cost involved we could not determine those prices fair and reasonable at the time so when we went back and and and cbtd went and made an offer um as to what we could accomplish to the contractor or the proposed contractor um it came back in a different differently than than what we had even offered um so at that time I contacted the FTA attorney um talked with Tex Dot and it was Tex dot that came back and said no we need to stop this because this is not within what we were expecting under this grant so texop put a stop to it can Mr Cornell come to the microphone Mr Cornell would you come to the microphone Jude how are you yourself you want to interpret yeah I can interpret a little bit I think uh you know our pricing was uh received by the cvtd uh it was outside of their budget uh I'm sure their estimate is three or four years old uh we negotiated with them to reduce the scope of the project not necessarily the price of the individual blocks uh you were just going to get fewer blocks than originally anticipated uh we returned those documents with that pricing to the cvtd and and they uh then the wheels came off at that point I I think uh the staff was just unable to get their head around what this work cost I mean this is uh as you well know in abene they spent Millions on sidewalks downtown so it's disruptive it's slow production uh it's painful uh and it's expensive and and there's just no two ways about it even when paired with the total Street reconstruct uh this handicap work is expensive work and and it's slow and and

[0:31:18] your your bid was designed build yes sir yeah so that was included in it so we had engaged an engineering firm if they' let it to contract we'd be under construction right now uh we had a 4-we period for design uh we were ready to go to work and and be complete uh well in advance of the the May 15th date so it's uh it's unfortunate because it's it's seems a long shot that it could be complete by the time the gr expires at this point uh cuz as as you all well know any kind of acceleration cost more money you want it faster it's going to be more expensive in in anything in in any kind of procurement way whether that's buses or sidewalks so I don't know it's unfortunate that we that the city can't get on these things and get them out the door timely so that they can get something that uh is in line with what they think they're anticipating they're going to get for the money that they have at the time so anyway any any questions from anybody on the council I have a question I do too Johnny for Carl are you able to uh share with us you know we're talking about these bids that came in there way over bid are you able to share those amounts and two I remember call it a schematic or call it a design I remember seeing something so there is a footprint of an idea of what we're looking for so okay uh I I don't know where we're going with that on that end of it but as far as pricing I answer your first second question first there we call it a schematic and it is basically a length of the project shows which side which on this case is both sides of the road kind of the in intersections where you'd have the Ada ramps and that type of thing really very generic in one way but it tells you this is where we're working and that's what was given to the Consultants as part of this design build project along with some standards this is what standard of these ramps and and and they know the ADA requirements they have to meet that's how they would put

[0:33:19] the design together as far as the prices I I didn't bring that with me but uh well Carl that that would be something for the purchasing guy to answer anyway to summarize what was received all right when it comes to the actual pricing um that was provided to us I cannot discuss that in an open form unless ree Albert would give us permission and consent to discuss their pricing I understand that yes okay Rodney how far are we saying that it will go now what's the our last negotiations with Reese Albert we were looking at 7th to 10th so we're I'm estimating somewhere between 10 7th to 10th or maybe 7th to 14th some between 10th and 14th Street one thing I might throw in there is we have a design and this was kind of an issue with the whole thing they didn't they were giving us a bid on an unknown and we brought that up several times during the the discussions when we have this new design it's going to be a design set of plans where they can actually let it I mean review it in totality and know exactly what they're bidding I'm hoping the prices will come down and maybe we can go farther although it's kind of bounced out by acceleration we're going to be needing also so so if we approve if the state has put the stop to this why are we even considering it good question they're asking us to go a different route they're they're they're asking us that if we choose to go forward that we might go and actually have someone do the design and then see if we can go out and get a better price by just doing the construction part instead of the design build that's what Tex doot is asking us to do mayor and and I will let you know that although I can't discuss their pricing I will let you know that between the city between the engineering department and myself we did do market research and we did look at some of these prices in our local market so we're going to have to go out for bids

[0:35:21] again yes sir if that's the direction yes sir and still get this completed by May of 15 yes it'll it'll end up having to be a multiple award to get no way that's going to happen is there well and and our big our big uh problem with this is that uh the last we heard to my understanding if my memory serves me correctly was that with the funds that we had and the bid that we got back that we were going to be able to go approximately three blocks um not that we have a problem with going three blocks three blocks is a lot better than none but when FTA and Tech do said no you need to go back and revisit this I don't know about City but a quarter of a million dollar hit to our budget would be tremendous because if they did not reimburse US based on a warning in the first place then that construction is going to come out of our pocket I don't understand mayor how there was a a not communication between FTA and teex do in the first place I mean who ultimately is in charge of the project who whose guidance whose legal counsel are they looking to I don't understand we use we use FTA legal council um and they were aware of it before the solicitation went out they actually have to approve it before it goes out it's it's FTA funds but it's administered by texto if we approve this and we can't get this thing off the ground by May 15 then we lose we lose the grant money we we will lose whatever we don't use in the design portion that will go back and be put into a fund for other people that have New Freedom projects that need money to to finish them but you would get you would recoup your expenses we would recoup our our expenses as far as the design well the but the public gets nothing for that the public gets no sidewalk I mean that's that's the disappointment here is that we've been

[0:37:23] talking about this project for 3 years agree it's and there's nothing on the ground and right now it looks like we're in Jeopardy of not having anything on the ground it's very problematic but I think that this project was um possibly somewhat flawed in the beginning with the with what they went out for public comment and said this is what we can do with the funds we're going to be getting and I think the downtown portion of that project is a prime example instead of ending up with uh nice new sidewalks we ended up doing a patch job in the city did a great job of doing what they did with the money that they had available but with what was left to go out and tell the public we're going to be able to go all the way to 18th Street and hook up with what's been done on 19th Street that was a little unrealistic right from the beginning and prices have certainly gone up since then I mean ree Albert is correct about that question Rodney you were first to let me just add put it this way if we don't agree to match these funds and we just let it go and then we start over again when you say that we possibly could get more funds or another grand or something like that to me that sounds better than than giving these funds and hoping that we're just going to get a partial just the plans on this I I don't think the construction is going to happen it doesn't sound like it can happen and by us having the rush I'd almost rather start later and not have to rush and get more for our dollar at least I I don't disagree with you at least if we have the project designed completed we have the engineering drawings if we can go out for a a capital Grant we will have this as match for that Grant one thing we could do in the microphone if if we have the plans we can let it to the contract we don't have to award the contract we could let the plan say come back to y'all in November probably right a bid so I me this is not my project but I would strongly

[0:39:26] recommend that if we intend to do this project at some time now or later that we proceed with getting these plans done because that can only help us if we end up having time and can Implement part of it that's great but sooner or later if we're going to do this project we need to move forward with the plan so that when we bid it we can bid it well the people who are bidding on it know what they're bidding on exactly what they're getting into and in in Chris's defense they didn't they did they had to put a lot of so that we may think they're high but they had a lot of risk involved and we understand that but at a minimum we need to move forward with getting the plans done what I'm what I'm what I'm saying is okay so we do the plans but I would rather not start the project now and have to pay that extra for Christ and I I think that that uh that since they were the only company that bid they probably came in where it needed to be they know this area better than anybody does anyways and somebody coming from the outside probably would have bid much higher than they did so I think it would be better can we say this where we'll match the funds and we'll just do the plans but not do the rush you understand what I'm saying I'm seeing it more like if we have to do the rush so we keep pushing it back so it goes from Seven blocks to three blocks and now if we push it back another three months it goes to one block or two blocks for the very same amount of money let's just do the plans and then just hope we get some more money in the future that's an option Johnny did you have a comment no I just wanted to throw in that I'm I'm in total agreement to moving forward with the plan if it's done with this by the city staff I don't care just get uh finalized or get a even better rough draft on the plans and then can you not put an RFP out for just a construction part of it only and you would you would think you would assume that even that would come in at a lower price I don't know but if you separated them let's let's do the plans let's let's get that thing going but again the construction part of it just put that

[0:47:38] consideration of adopting an ordinance amending chapter 12 exhibit a zoning ordinance of the code of ordinances city of St Angelo or Guerrera PD 1401 White Oaks Development LLC an ordinance amending chapter 12 exhibit a of the code of ordinances city of s Angelo Texas which said exhibit a of chapter 12 adops zoning regulations use districts and a zoning map in accordance with a comprehensive plan by changing the zoning and classification of the following properties to Wi an unaddressed 8.9 acre track located at the northwest corner of Southwest Boulevard in Mills Pass Drive more specifically being approximately 449 Acres out of the community of fa subdivision section one block one Lots one and two and being approximately 4 Acres out of the Community of Faith subdivision section two block one lot three in South West St Angelo changing the zoning classification from single family residents rs1 in Ranch Estate r& zoning District to a plan development PD District providing for severe ability and providing a penalty this is the second hearing of this you pull this Miss farmer yes I uh uh pulled it to be allowed since the council meeting was not on Tuesday like it normally is and the um opponents the folks that are against this sent me some letters and asked me if I would read their letters at least to the council uh before it went to the second reading and that's what I'm going to do if I may I have Dear Miss farmer first I want to thank you for your vote against the development on Southland Boulevard this situation shows the big problem single member districts I also realize there are many problems when there are not single member districts there is one council member that would vote for any real estate development because that is his business real estate there's another member that knows there will never be this type of development in their District because there's no open land the five members that voted for the permit to go forward did not do so because it was good for the city of selo they did so because it was not in their district and they do not care about the citizens in this area if I understand

[0:49:42] what quad means there will be four families to each unit which could equal at least eight people to each Unit 8 times 80 units means there could be over 600 people living in this development with vehicles there is the possibility of over 00 autos on Southland additional uh there was the statement made by the traffic uh problem was emotional and not a real problem yes it is emotional when safety becomes a problem the problem becomes emotional the city staff there would be no additional traffic on Southland did not know what they were talking about nor did not care they have never tried to walk on Southland I have during this time parents are dropping off and picking up their children cars are backed up down Southland I'll no longer walk there because too often I was forced to jump into some yards from fast moving traffic and being hit at one time and as is now I understand there are 18 wheelers using southin Since I no longer walk I cannot attest to this but according to my neighbors this is so I don't think that anyone has looked at what could happen to increase traffic on this street there is the shopping center that will open soon and that will have extra traffic and the storage unit buildings uh an additional 100 units is going to add traffic I know this will not increase traffic in any great numbers but there will be increases there has been a permit for a very large motel in the area this will increase traffic on Oak Grove Green Meadow and Southland when this is all considered traffic will increase tremendously in the area uh southin is not pledged to be made wider the expense would be too great for the city and they can't afford it the contract with Republic is a big problem wait until more businesses uh receive and I'm going to leave that portion out it doesn't pertain to this item um the I hope and pray that the rumors are just rumors and that the city council

[0:51:45] does care about its citizens many citizens have a problem with the city wanting to have more people moved to St Angelo but we can't take care of the ones we have here now when we won't consider the traffic issues and the rest of it is just about the uh their dissatisfaction with city council what is the name on that and the address uh or you don't have to give the address but I do want the name uh Mr du's do DWS dues uh the other one is reference to the zone change we the citizens of smd6 who obtained 275 signatures to prevent the above area being changed from RS uh one to rm3 um succeeded in getting the council to listen to us and leave our area rs1 about five months ago and in less than a year the city planners came right back and they want to change it to PD rm2 we again provided 176 signatures against this change that's a total of 452 signatures of registered voters who do not do not want the zoning changed from rs1 to pdm2 six counil members chose not to listen to the people who live in the area and what their wishes are for where they live six council members chose to listen to the one seller one developer who have nothing to gain but money uh in their pockets money made off our investments in single family residential homes there are numerous Apartments town houses and hotels with executive suites being built in this area uh that are probably six of you want all the residential accommodations for your commercial buddies okay therefore we the citizens in smd6 will be exercising our right under home rural City to use the inherent Authority Under public purpose the initiative to exercise the procedure

[0:53:49] which local voters directly uh to initiate legislation citizen lawmaking through the initi itive process allows local voters to circumvent the city council but by direct Ballot Box action on new ordinances that have wide support in the community but which the council refuses to enact or ignore the majority of the citizens wishes where they live we will follow the initiative process beginning with circulation of a petition setting forth the text of the desired ordinance we will um acquire the number of signatures of Voters needed to force the city council to submit the ordinances to the people at a Citywide election should the council decide not to consider this action today the state requires requirement is only 5% of Voters in the last city election our council member has told us to refer to section 47 of the S Angelo Charter as it states 25% we have also been advised we should seek our own legal counsel and obtained any necessary form of working for the petition from the city clerk when this is done the city Council has two choices one call for an election on the ordinance and let the public majority vo or decide or kill the ordinance refer referendum is a procedure under which voters can repeal unpopular or existing ordinances that the council refuses to resend by its own action and that is from the luns and the Richards uh in the district and um I did when they called me to make sure I'd receive received their letters I did uh give them Miss Alicia Ramirez's phone number to contact her on the proper procedures if they proceeded and what it amounts to is uh we could move to vote on this our at second reading or postpone it's council's discretion and because of the enormity of my phone calls still that I'm getting that's I cannot continue to say nothing

[0:55:53] or will not support the project or the change the zone change I know in our last council meeting we we worked with this for probably an hour an hour and a half and we determined that if we left at rs1 that there would be there could be 76 new residences in this area if we went with the quads there could be 80 residences in this area and there was actually four extra residences with the quads then there would be leaving at rs1 and we we talked about it we discussed it uh the most motion was made I believe Elizabeth made it that we that we allow this change it was a 61 vote this is a second reading I'm asking for a motion one way or the other move to approve second second I have a move to approve as the first reading that we allow it to go to a plan development Johnny silvas I do have a second by Rodney do you have a comment sir yeah and I think I probably am speaking for most of the council members and you'll speak up if I'm not I care deeply about every citizen in this city that comment really just blows me away I I wouldn't be doing this job and I think that most all of us up here wouldn't be doing this job unless we did care about this city and I care about the planning and looking at our future of what we have to do as a whole now there's several big things coming up in our near future that are not going to be popular things but they're going to be things that probably are going to fit in with our planning for our overall City uh so sometimes we have to make hard decisions and I think this was a hard decision and believe me when this person I don't know if it was the first letter I think it was the first letter said that that I would vote for everything real estate I haven't go back and look at my record I haven't voted for everything real estate I am more in favor of most real estate growth because that's Pro most of the stuff that comes before us fits in within our plan if it's in our plan I am going to be for it Johnny I just wanted to add

[1:02:02] public hearing and consideration of introducing an ordinance amending the 213 214 budget for new projects incomplete projects capital projects an ordinance of the city of St Angelo amending the budget for the fiscal year beginning October 1 2113 and ending September the 30th 214 for new projects incomplete projects and capital projects budget manager Morgan chegwidden You Are ma'am good morning uh we're amending the the current year fiscal year 14 budget this will be our last one before you um as we're uh housekeeping these these final items to to finish out the fiscal year and if you like I can go through these one by one you have six items here before you and I'll I'll hit them briefly and you'all certainly grab me if you have any any questions the first item there is the operations Department water utility expense um we've talked about um this a couple times before the council that there is a need in um the Texas Bank Sports Complex for example and the Fairmount Cemetery for increased uh water utility before you is uh and the funding source for that is going to be uh Surplus sales tax revenue and so uh it's listed as an expense of $331,500 as a transfer out from the general fund and 165,000 moved into each of the funds mentioned for the water utility expense so that will give the Texas Bank Sports Complex $113,000 uh and change for water utility which will help them finish out the year at a positive in that amount and uh fair amount Cemetery at [Music] not to let things die and so U we've we've captured this this year's ex a portion of this year's excess sales tax

[1:04:04] to get these departments through the year recall that in discussions about next year's budget you've stepped that money up so this is money to get these uh operations through the year thank you the next item is um Solid Waste personnel and capital items um there will be uh about $5 million in Revenue in fiscal year 14 as a one-time influx of funds 3.6 million of that is in uh related to the contract directive and the remaining 1.4 million is related to the uh new cell construction so we're going to capture that Revenue budget for that revenue and uh we needed to utilize about 64,000 of that as an expense for uh Personnel um uh vehicle to be purchased and uh operating expenses and so uh that $643 26 is uh for those items to finish out fiscal year 14 the next item before you is uh Wastewater equipment replacement um there is a um a surplus fund balance in the Wastewater Debt Service fund and we're going to utilize that fund balance as allowed uh for for Wastewater Debt Service so that we'll free up money in the Wastewater fund that does not need to be transferred out and that can be instead utilized for um for equipment and there is a a list of each of those items that will be purchased uh totaling $929,000 the next item before you is uh police wrecked vehicles uh we had insurance proceeds come in late in the year of $18,750 uh to fund um the replacement of a police vehicle that was wrecked and so we're going to increase that revenue and increase that expense capture that that that unforeseen revenue and and utilize that to replace the vehicle Morgan oh excuse me mayor can I ask her a question yes ma'am okay say that again again on the wrecked vehicle that the our our self-insurance fund for for liability for property um paid out an amount for the value of a

[1:06:07] wrecked police vehicle and it was $18,750 and we consider that Revenue yes Insurance proceed have we always done that it's yes recall that we have the C the city's Financial system broken up into different funds and so our insurance that self-insurance fund is its own sub entity and so we treat it like an insurance company and they it's an expense to them but is it is income to our equipment replacement fund which is a separate sub entity and so in order to uh utilize those monies that equipment replacement fund has to recognize the revenue and use that then use that Revenue as the funding source for replacing the vehicle because it seems to me that once the we approve a certain amount of vehicles to be used throughout the year that as long as they're going back with the same number and there's no you're right ultimately that is absolutely right but ultimately a check has to be cut and in order to do that we have to have the budget amount uh the amount budgeted in the expenditure account and in order to uh have the amount available in an expenditure account we have to identify the funding source and so our separate sub entity self-insurance fund pays its customer the equipment replacement fund now the equipment replacement fund needs to uh write a check to replace the vehicle generally speaking when we have an incident like that whether it's police or any other fleet vehicle are we quick to replace it I mean how long are they without a vehicle we we are as quick as can be I mean and what does that mean like a timeline from when it's wrecked to when it's replaced I'm sorry I would I I would have to that's a what's quick what's your quick that we don't have an answer as good as the

[1:08:10] question we're going to need to get the risk folks to tell us what they anticipate that replacement will be there there will be time associated with uh analysis of the vehicle or the wreck uh at the point risk makes the determination that it it's to be paid the the internal part of it's very quick I'm not sure how long it takes to replace the vehicle certainly to outfit a new a police vehicle does take some time um from from an operating standpoint that person that employee being without a vehicle uh we're uh we rely on the pulled vehicles that are available for use and make so there's not um so that that person still has a vehicle to drive it just uh so that there's not it just causes a burden on the the pulled vehicles that um each person is still in their own vehicle and still committing their jobs until while this time is going on the next item is sale of old fire stations um you'll see that there's no revenue and no expense but it's it's really moving money from a bond fund $222,700 one was achieved by selling uh fire stations 5 and S and we deposited that money in a bond fund which uh is probably more appropriate to report for that in our general capital projects fund and so we're going to have a decrease of expenditure of 222,000 in One Fund an increase in the other fund a few years ago uh the authority to move money between funds was taken out of the budget ordinance and so those items still need to come to council so you'll see that there's no Financial impact we're just uh cleaning cleaning that up and the the last item before you is to utilize we have a bond fund that was issued in 2007 that's eligible to be used for um uh streets maintenance however uh the the money that's available in there it's at end of light the fund is at end of life so there's not much money left in there there is 157,500 for you today is a budget

[1:10:26] amendment uh expenses totaling $571,500 [Music] that was wrecked I mean I'm sorry do do you mean we are buying a comparable vehicle to what it was before yes sir are we buying a sedan if a sedan's wreck are we buying a sedan or we buying a Tahoe I think it's a we're replacing it as the current standards for what vehicle is allowed for the job okay Shane is that correct I just want to make sure that I think it's Tahoe done yeah it it depending on the vehicle and what it's uh service for um this year we replaced um uh the several wck Vehicles we had we did have one wreck Tahoe and we did have uh I can't remember how many of the Chargers were wrecked uh we did go back I believe this year with three only three tahos uh we did not replace the sedans uh with sedans okay thank you any other questions Marty has moved to approve do I have a second I just have one question Shane could you give me some sort of idea as to what kind of equipment that you're needing to replace in the Wastewater or that's that's a Ricky I have a list of it I can bring up that was in the back ground while Ricky's making his way up

[1:12:40] here short of the two big items that we're talking about here is one is a sewer vacuum truck 2009 model that we still have in the fleet that's that's getting some age on it and it's 350,000 and a compost turn turnout at the um Wastewater Plant um that unit is a 2003 so it's almost 12 years old now and they cost $450,000 we just don't have those type of funds in the general operating uh Capital replacement in the operating fund for the Wastewater side so that's that's the bulk of of it then there's um skid steer some mowers tractors um and some lease payments that that's coming on the new lease Vehicles so that's the that's the total of the $929,000 but 800,000 of it is two pieces of equipment I mean I don't reg begrudge you you guys getting new equipment I know you keep it together with mostly baling War now I just would like to know what it is thank you you're welcome 4,000 for compost truck I'll second the motion do have a motion I do have a second do I have any further comment from councel before we move on to the vote do I have public comment on this before we move to the vote call for the vote all in favor please say I I I oppose Nay put a 70 on it number 15 discussion and consideration of matters related to the fiscal year 214 215 budget including a first public hearing of a proposed property tax levy for the city of s Angelo for the 214 tax year do we want to take these a b C sir or ABC together or one at a time one at a time please sir that is number eight Morgan this is simply the first public hearing that we are proposing a property tax levy uh for the 2014 tax year uh we had the uh record vote on August 5th last meeting uh to propose a property tax rate uh at

[1:14:44] that time we uh took a vote at 77.6 cents so the vote that we adopt ultimately next month cannot exceed that and the property tax levy ordinance will be introduced um September o 2nd so this is simply a public hearing okay do I have comments from the public on this since this is a public hearing move on to B first public hearing consideration of introducing an ordinance adopting the FY 214 215 budget an ordinance of the city of St Angelo approving and adopting the budget for the fiscal year beginning October 1 214 ending September 30th 215 authorizing employee compensation schedules providing for the general appropriation of funds reserving under the city council the authority to transfer Appropriations budgeted ratifying transfers of Appropriations in occurring in the 213 214 fiscal year amending that budget ordinance accordingly providing for a lapse of all unencumbered or unobligated funds for the prior fiscal year and for carryover of all appropriations of encumbered obligated or restricted funds reserving under the city council the power only as permitted by law to amend or make changes in the budget for municipal purposes providing Authority for the city manag or as a design need to make certain adjustments from time to time in or between budgeted allocations authorizing the city manager or designate to apply for certain grants and execute any related documents and providing for the filing of the budget this budget will raise more total property taxes in last year's budget by 2, 85,86 99.75% and of that amount $471,000 is tax revenue to be raised from new property added to the tax role this year this also is public hearing yes sir and we have a a short presentation certainly we've spent a lot of time on this already this year and so uh just a reminder that this uh does include um some Council priorities and goals uh as discussed at the work sessions and um and other items moving our Street Maintenance from a 12-year cycle to an eight-year cycle um progressing towards that 3 to foure plan

[1:16:47] to adjust uh salaries to Market um the projected health insurance increase of course is in this budget and um the other NE items that were submitted by directors and managers that were identified at that first work session as uh to be funded there are um and so this is a reminder of of where we ended on the general fund for example the um we did have um a couple items that are not yet included in the budget for example the uh fee assessment that's something uh budget staff is still working uh towards and will come to youall as as final recommendations are made uh including the The Code Compliance proposed uh fee that will come and and increased revenue and expense related to that and then the other items that were identified by directors and managers for increased funding those are the major items not yet included in the budget uh we'll continue working on those but the budget does speak to um the the major priorities as we've discuss them I do have a a very brief uh video to speak to to to the audience and the folks at home since this is a public hearing and we want them to have that information on it and it specifically relates to to Street Maintenance so if you'll entertain me on this we will launch that when the city council recently approved its five top concerns for S Angelo municipal government the maintenance of city streets ranked second just behind water the 2014 2015 budget reflects the council's sense of urgency to improve City maintained roadways as recently as 2012 the city budgeted $600,000 for Street Maintenance in each of the past 2 years $1.7 million has been budgeted for Street projects mostly seal coating crack seal and pothole repair in the coming year the city council has committed to a 129% increase in Street Maintenance spending that equates to $2.2 million more for a

[1:18:51] total expenditure of $3.9 million that Financial commandment will represent year one of a rolling 8-year plan to maintain city streets in other words every city street in St Angelo will at a minimum receive maintenance every 8 years currently streets are maintained on a 12year cycle the higher level of Street Maintenance is being made possible by St Angelo's vibrant and growing economy we're conservatively budgeting a 12% increase in sales tax collections in the coming year that equates to an additional $1.9 million in Revenue in the city budget also property values have risen 99.75% that will yield an additional $2.5 million in property tax revenue many of the services the city provides including Street Maintenance Public Safety and parks are funded through sales and property taxes the increase in the Street Maintenance budget does not however address badly needed reconstruction of thoroughfares such as Bell Street Southwest Drive and 29th Street rebuilding Bell Street is estimated to cost $8.4 million Southwest Drive is a $12.9 million project 29th Street would cost nearly $5 million to reconstruct in all the city's Capital Improvement plan includes nearly $35 million in Street reconstruction projects that's nearly 10 times the cost of our increased commitment to Street Maintenance the city's Engineering Services Division is in the process of developing a strategy for rebuilding streets that need more than surface maintenance that's necessary in order to accurately assess what must be done to Bell Southwest and 29th Street along with Main Street glena Drive and MLK Boulevard structural Integrity of the base of some streets May remain intact if so those roadways can be addressed with a less expensive process called meal and overlay other streets have a problem with the underlying support structure and require complete reconstruction as was the case with great Creek Road a few years ago we need to assess exactly what needs to be done and how much each project will cost the results of that assessment will shape

[1:20:54] the strategy for completing those projects that might include a plan for financing the Reconstruction of some streets s Angelo drivers are acutely aware of the need to improve city streets fortunately a healthy thriving economy is affording our municipal government the opportunity to address streets in a meaningful way that said the deterioration of city streets did not occur overnight neither will their repair happen in one Fell Swoop [Music] thank you so with that the the budget is uh in your background for for further review but that is the presentation we had prepared for Item B and the budget is balanced with Revenue over expenditures correct yes sir that's good news are is there any public comment on this this is for this is a public hearing do I have any public comment on this Charlotte I have a question Miss Morgan uh um Mrs ched Wigan I'm sorry um salaries each year we look at salaries and we're trying to bring it up to the market do we ever consider or is it built in automatically in our budget say 2 and a half to 3% of our income is plugged in and should be in there I mean that doesn't mean we have to give it especially if we don't have it but is it built into the budget process and I'm looking it a way to keep and maintain that national average you know that that wage is it built in like that what we did for this budget process was um that Lisa Marley at the first budget work session I think uh recommended a flat percent credit increase across the board and so uh what we were able to uh figure

[1:22:58] in under the the 4.2 million reference in the council priorities and goals we could afford a 5% raise across the across all employee groups and so that's what's in this year's budget cycle uh for recommendation I understand that what I'm asking is when we start to prepare the next budget if we could make it a budget item that is in there always 2 and 1 half to 3% so that's something a goal to shoot for that we market so that we can keep that amount as a a budgeted item instead of starting at zero each year Miss farmer I know that uh when we had a retreat of course we discussed making sure that we could uh get our staff to at least closer to the market value within a 3 to four year period but in order for us to maintain that absolutely we'll have to address that uh that percentage of increase on a year-by-year basis or we're falling further and further behind that's it's just a recurring item that should be in the budget so that we don't keep falling behind behind we've been trying since 2007 yes ma' to bring this up but we just get behind and and it's not a good thing I know that Council definitely do doesn't want to be coming every year and trying to make an adjustment especially a 5% or 8% adjustment uh we would rather have it to where those adjustments occur uh regularly once we get it to market value and the goal right now is to get it there you know regularly in the budget to work with is is what I'm asking absolutely further Council comment public comment yes did you I have just a quick question regarding the video that we just watched how many people were at the capital Improvement hearing or public meetings that you had the one in the video we probably had three dozen people there if I had to guess um uh lots of folks there to support um the same item and so uh not necessarily three dozen items before the the group to hear but very uh very good participation compared to Prior years what was the item uh 19th Street sidewalks good and I think there's also talking

[1:25:00] about MLK yes sir that's always okay anything else any public comment on this before we close out this portion of the public hearing let move on to C conduct a separate record vote I'm sorry sir I need a vote on the on Item B to to accept the ordinance move to approve second got a motion we move to approve Charlotte second cus let's take a vote on all in favor please say I I I oppose nay CES conduct a separate record vote to ratify the property tax increase reflected in the budget and place the adoption of this tax rate on the agenda for the September 2 214 regular meeting of the city council as an action item Tina Morgan this item sir is simply that we adopted a budget we proposed a budget that that was introduced last Item B that R property tax Revenue was greater than the prior year and so it's necessary uh to comply with local government code that we conduct a separate record vote and the state is very uh specific on that language that it should be exactly what's in quotes on here that the uh the council ratify that the property tax increase uh by the 99.75% okay we need a motion that says I ratify the property tax increase of 99.75% as reflected in the newly adopted budget and place the adoption of this tax rate increase on the agenda for the September 224 14 regular meeting of city council as an action item anyone move to accept motion to approve second anyone second do have a motion I do have a second Rodney comment public comment all in favor say I I oppose Nay put a 70 on that one thank you that does 15 number 16's consideration of authorizing the sale of city- owned rental property for the appraise Value Plus 2.5% interest and authorizing the city manager to execute all necessary legal documents pertaining to the sale of subject properties subject to completion of all Curative requirements Bob sales you own sir one second

[1:27:09] here uh good morning mayor uh Council um staff is requesting a permission to pursue the sale of the city owned duplexes and the two uh single units on Shelton Street to the public housing authority uh uh we obtained the duplexes at cost from PHA in 2000 more of as a management transfer and we bought the two Shelton homes from Coosa DC as part of the Black Shear project in 2009 uh we have been landlord for the last 14 years uh but due to uh Cuts in federal grants and loss of Staff uh we're no longer able to manage the properties uh we got a new appraisal uh on these properties and here's the updated appraisals um you can see that the five duplexes came in at 82,000 for the rent restricted value and the two Shelton homes came in at 96 98 uh respectively uh we are proposing to sell the properties uh at the rent restricted appraised value plus 2 2.5% interest uh with a 20-year mortgage uh we are required to maintain rents and income eligibility until 2029 if we violate that affordability uh HUD will require us to repay that amount um that actually we have to pay the full cost of construction from non cdbg funds such as the such as the uh general fund uh we believe PHA is not only the best fit for the sale but the only viable organization uh that can take this on since they really play by the same rules we do and we're asking Council to approve the the sale if I remember correctly when you brought this to us six or eight months ago I believe it was councilman Fleming that says we need a new appraisal and we need some interest on this that's correct now we did and you have done both of those yes sir so I'm going to leave it with you rodne you want to no I'm happy with this I move that we accept the cell that's what I want it by second second

[1:29:12] Marty is second did you have a question charte the monies that we received from selling the 768 something thousand there well uh that we're carrying the note and payments will be made to the city that's correct monthly on that monthly or annual whatever works and what is the purpose and what that money that's repaid to us are we retiring any kind of debt they will go back into the affordable housing programs back into the affordable housing program yes ma'am but there's not a debt to retire with these funds uh we do have on the uh we do have a uh a note on the duplexes so we can retire um because through the uh producers Park section 108 loan uh we tied them up but we can we will be able to uh secure those as well we to retire that that loan okay further comment I think you've done exactly what we ask you to do yes we do have a motion we do have a second do I have comment from the public on this want to call for the vote motion has been made do we accept this proposal as it has been made it has been seconded all in favor please say I I any oppose nay drop a 70 on that and thank you Bob let's see number 17 presentation of the second quarter 214 report from the Chamber of Commerce Economic Development Council and the convention and visitors burea CVB this will be by CVB vice president Pamela Miller and vice president for economic development Michael Looney you are on ma'am good morning everybody giving you the report for the second quarter April through June during this period we assisted with 17 conventions meetings sporting events or tours we had a projected attendance of 8,680 people with 4576 room nights economic impact 1,525

[1:31:19] 160 I have given you a packet with a detail report and the economic impact reports for these events Pam yes is this available to put on the screen do you have this information it's BL do you have a PowerPoint or you just you're just talking from memory you should you should have that was we just wonder watching oh no it it's page one of your packet though go ahead ma'am um the two biggest during that period of time just to highlight those were the west Texas County judges and Commissioners conference and our Angelo football Clinic the coach's Clinic we had good media this quarter uh we had got Texas Country Reporter was here filming two different stories that he's going to do on San Angelo uh the first one was on fiddle fire and Dorothy doit and also on Cowboy Up chocolate here they will be coming back to do another story on our mural the new Indian mural I have just in fact here this morning received word from the Country Reporter that on September 20th the Cowboy Up chocolate here story will show and that will be the kickoff of the new season for them for fall we also received a story for the inplane Air Festival in travel host a full page uh article and in art connoisseur for the uh forts exhibit of art that has been there the last month and a half and you do have copies of those in your pack packet on page 20 through 23 advertising this quarter included the our usual pieces are Texas highways Texas Country Reporter uh Texas monthly Texas events calendar the Facebook in the gr Google search but we also added uh convention South Texas annual Sports facility guide uh we did a TV program on ke ye TV in Austin on getaway

[1:33:24] in West Texas and we were a favorite and they ran it again for the favorite getaway destinations um about a month later so we got the west Texas and then the best of the best and those ran both of them in June uh 2013 final numbers are in from the governor's office of Tourism and that research is on page 10 of your packet and I just wanted to highlight um a couple of figures there we've grown 2013 of course was a really good year for us but um in 2013 under industry employment that travel uh was 3,670 jobs in our MSA and we had a $5.1 million local tax receipts for our MSA for travel related spending so it shows that travel is very very important to us uh I'd like to highlight that the uh governor's office of Tourism research will be our speaker for our annual tourism lunch the chamber lunch in in September that'll be on September 9th I'd like to invite you all to be there so you can get the full report on what happened here in 2013 we attended trade shows or events in April for the National Association of sports commissions International poow the Dallas Fort Worth Association of Executives and that was held in Dallas the Texas Travel counselor's conference and the Texas police chief's conference in May we attended your military reunion connection and that was held in San Antonio and we participated in the annual Fort stay in Fort Worth along with our Fort soldiers Bob Blart and our canon in June we attended the Texas police Olympics um we went to Houston

[1:35:27] where the Olympics were this year to formally present our bid uh that has been a longg goinging bid there's a lot involved in that numerous facilities throughout the town have been involved uh after we attended and presented our bid the board came into San Angelo and basically went out and looked at all of our facilities and in their words we gave the most professional packet bid that they have ever received in the history of getting bids so we were pretty proud of that uh we don't know the answer yet on if it's coming in 2016 we have a pretty good feeling about it our competition is Dallas and Frisco that is the short list um we should know in September whether we've got that or not we also in June attended the nasc which is the national Association of sports commissions and there we actually got to have appointments with different sports planners across the United States the mid survey results are in they are in page nine of your report and this is in the visitor center and uh some people tell us more information than others but it helps us know if our advertising is working and where our people are coming from our total room nights again visiting friend friends and family top the list and hotel Revenue right behind that followed by camping how did they hear about us continually number one is they picked up our brochure at another state Welcome Center or City Welcome Center and number three was our advertising our top city at the midyear point for visitation is San Antonio followed by lck and Midland our top out of state is New Mexico and our top International was Italy top reason people came vacation number two was weekend

[1:37:30] getaway just a couple updates on the hotels after we gave our first quarter report the very next day we opened up the Hawthorne Suites so that now gives us an additional 140 rooms when you look at our occupancy now that has been added um so that we have an additional 140 in our equation and we are currently still down on our occupancy our average daily rate is still up but it's coming down the the hotel rates are are coming down weekly we did a groundbreaking for The Windgate by Windam which is over behind Twin Peaks restaurant they are anticipating a July opening we also toured the Pearl on the Concho that's the one over here near the convention center that's been in renovation for quite a while it's now moving along pretty quickly and uh we were pretty impressed when we took our tour and they are anticipating a November opening um I don't have a date yet in November and yesterday I got to meet with the gentleman with the Candlewood Suites and that looks like that will be our next one to open November 18th is their day that one sits right next to the holiday in select and so by the end of the year we're going to have an additional 400 room nights that we're going to be having in our equation um you have in your packet your updated Smith travel report that gives you all the details of our city and our competitive cities as far as occupancy and average daily rate uh we have been down for over a year and that average daily rate has been up but again coming down are there any questions that I can answer I would just comment uh Susan Morris is the one behind all of these murals and she she was pushing old Bob Phillips the Texas Country Reporter and I'm very

[1:39:34] proud of what she has done and she has she has really done a lot to this so I think a lot of the reason you and Susan Morris are the reason Texas reporter Bob Phillips is doing our and that's a lot of good good publicity for the city of St Angelo so well you know we are an advertising partner we are a top Texas town and that helps because part of your contract you do get a story well we aggressively push that and our a story has turned into three and I've actually been talking with someone here today about a fourth story that we're going to very soon be pitching so we keep trying all the time to get more I can't think of a better location in St Angelo Texas to highlight on the Texas country report Charlotte I have a question on your your marketing and advertising budget your printing brochure development you show zeros today you've got a budget of 12,000 but you've not expended any monies today we usually do it in November it's a major uh printing that we do towards the end of the year okay and and I'm I'm trying to hold it off this year absolutely as late as I can just because of all the hotel development and I want to be as current as I can with that remind me again what the fiscal year is for the chamber we are on a calendar year okay thank you further comments thank you Pamela Loney come up and give us your report hey everybody good morning thanks for having me up how do you follow up behind chocolate Cowboys and Olympics and the things this is just this is economic development so I'll try to make it as as entertaining as possible well first of all I'm going to start off with uh telling you how what a privilege it is to be able to serve in that position I've been here for almost two months now and I've gotten to know many of you uh one-on-one but uh this is the first time I've had the opportunity to speak before the council uh in a formal setting so anyway uh the uh second quarter Economic Development report for the chamber uh

[1:41:37] basically broken up did you did state your name Michael Looney before you started didn't you well you did it for me okay Michael Looney San Angelo Chamber proud to be here uh basically we broken up into General summary uh strategic uh Plan update support Act activities support information and the uh year-to-date financial statement which is all in the packet you've been provided um starting off with the second quarter uh activity report um local employer initiatives um we have uh initiated go forward programs with seven companies so far and this is just since I've been here um a couple of them are follow-ons from my predecessor U most of them are were generated pretty quickly um these are National or International companies that either have a local presence or they're just purely organic local companies uh that they are planning or in the process of planning to expand their facilities uh to get larger and uh there four of those and that's an International Energy support company uh they've asked me to keep their name uh confidential for now as you can probably understand uh another International oil and gas Mining and supply company which I can divulge that's halberton um we have a large contact center that has uh engaged us and we've put them in touch with several um real estate owners to discuss as a potential contact center uh development basically a call center um and then a uh employee Management Systems Manufacturing Company um expansion of facilities now those are hiring expansion of facilities is a local medical supply company a local solid fuels company and a therapy provider which you all know as Mosaic um and it should be noted I want to make sure it's clear that that uh almost all of our actions that we uh take at the chamber with the Economic Development Division are done uh hand inand with kosa DC and Roland Peña and Bob schneeman group as well so we really have created a I think an excellent symbiotic relationship between the two groups so that we're really keeping each

[1:43:39] other in um up to date in real time on what projects that we're working on uh regarding uh outside perspective employers we have established uh relationships with four companies um that are new to St Angelo and they have plans in place uh to do some development uh one is a international commercial real estate developer they have a worldwide presence uh we're presently talking to them and we've had meetings with them we've gotten them in touch with the the appropriate individuals people throughout the city um we have a regional Hospitality developer that's another hotel guys uh and that's with a company called V3 and they have purchased the property on Bryant and uh we met with them yesterday and they are going full forward with uh getting their financing uh signed off on next week and we'll then uh go forward uh with construction and they've committed to us that uh they're going to do the absolute best to try to uh Source all of these uh different uh uh functions with local employees with local developers um obviously can't guarantee that but uh I was really impressed at yesterday when we met with them they were very very keen on making sure that they kept it all local as much as they could excuse me Michael certainly can you be more specific than Bryant uh it is um you'll forgive me I'm a little bit new here it's it's what is the little school off of Bryant um it's Bryant in 10th street over there that we came to us yeah Carver yes that's exactly right it's right across the street from there yep thanks Johnny uh and then also uh on the uh development front we were contacted a couple weeks ago by a uh brokerage firm out of Houston that is seeking 100 plus acres in St Angelo or the surrounding area uh we don't know who the uh company is that this brokerage firm is working for but we do have a strong suspicion that is an oil field support Supply Company um so we have made sure that any

[1:45:44] um owners of tracks of that size that happen to be on rail have been contacted and Elizabeth grind staff was very helpful and helping me get some intelligence uh work done on that and get that uh to the right person we did get a report from a brokerage firm yesterday that they are uh proceeding and I don't know exactly what that meant and they didn't tell me but they said they are proceeding so maybe next month they be able to tell you who they are and exactly what they're proceeding on um we uh have also worked very closely with the development review uh we're staying really really involved with that to lend any support and give any value that we can uh to any concepts that are coming into uh into fruition Physical Therapy Clinic uh we are working with a a CrossFit nutrition clinic and um then of course we uh helped uh in the DRC with V3 capital for the hotel on Bryant cross from Carver um that's basically the uh the initiatives that we've got going on so far uh eight weeks into uh our tenure are there any thoughts or questions on anything that I've heard I've spoken of so far anything else nothing okay do they have any questions on just a minute we're not through with you no I've actually got more to talk about if you want to hear some more uh uh on the Strategic Plan update uh Phil led the annual trip to Washington on April 28th through May 1st as part of the overall good fellow Air Force Base Community Partnership initiative and I know some some of the council members did attend uh they had a briefing with General utto chief of staff for intelligence and they met with Senator Ted Cruz and the pictures of that event are in your packet so uh you'll be able to see The Smiling Faces uh with some pretty high ranking people uh signed off on uh two memorandums of understanding uh with and that's regarding the uh Air Force joint Emergency Management training work group uh Theus were signed for Combined National Incident Management Services

[1:47:46] training and for the shared use of Goodfellow firing range and training facility and that's in conjunction with Tom Green County Sheriff's Department uh some of the subgroups continue to work on ongoing action items uh as part of the good fellow Community Partnership initiative uh I'm not going to read through all of them but they're in your packet but some of them that were notable are the shared Library support and usage shared vehicle maintenance project uh training and education Partnerships with Angelo State and Howard College and the uh enhanced Center for security studies Cooperative enhancement agreement any thoughts so far on that any thoughts Council very well all right that pretty much uh sums up the the the basic summary we uh uh included uh the financials that are on probably the last page of your packet uh we eventually did get them to transmit uh it was a pretty big file we sent because of all the pictures but uh other than that I think that's pretty much it we're having a great run so far and I expect that next time I talk you will see a uh a longer list of companies that we can divulge the names of and uh be able to bring uh more good news uh to all of us of the companies that are expanding uh and uh and coming to this city Michael I appreciate it uh I'm impressed with your two months of employment I continue sir Charlotte do you have something I have a comment yes ma'am sorry I haven't got you called yet that's quite all right Charlotte had got there having trouble with my phon I really am she really is but um I do have a comment about the chamber yes um there's there's a lot that goes on that people don't realize that the chamber does and I'm going to bring up the west Texas legislative meeting that just took place just the that just uh wrapped up I attended most impressed but I'm not

[1:49:50] talking about just the speakers and stuff like that I'm most impressed with the function that the chamber and their coordination of events their staff uh the movement with ease and just just about everything uh I have to bring up numerous events the trip to Washington always a very coordinated event uh very professional we just recently had the lunch in the state of the city and even in the absence uh because he was in training uh what the staff just performed and executed just smooth and it's a great job that goes on behind the scenes there's a lot of work that we don't see and that we're not aware of and I just wanted you to know that I did notice it and received lots of comments and they were all very good and favorable just one little one little thing and I'll tell you about it later Phil that's awesome thank you Charlotte thank you anyone else care to comment very good thank you much appreciate you sir we are now ready for number 18 which is the first public hearing and consideration of introducing an ordinance amending the water Advisory Board membership composition this is an ordinance of the city of s Angelo Texas amending chapter 2 entitled Administration article 2.39 entitled water Advisory Board more particularly by amending section 2. 391 entitled created members in order to revise the membership requirements and qualifications of water Advisory Board providing for severability and providing for an effective date of this ordinance brother Dixon you are own Ricky Dixon thank you mayor council as you can recall several meetings back um the water Advisory Board and their duties were discussed the committee was formed to um look at this and and that committee has met and I think we've Incorporated all of those suggestions into this new ordinance just kind of

[1:51:54] highlight some of the things that that are changing um in the new ordinance there will be a nine member board the old ordinance was was seven they were all appointed by council with one non voting member from the chamber um this will be the new recommendations is have four of the members appointed by Council um one member from the Development Corporation board sh that shall be appointed a member to the board is individual either a member of the development Corp or a city employee performs Services one member from the Tom Green County Commissioner's Court uh that shall be appointed by the court as an individual member of the Commissioner's Court uh one voting member who shall be an individual employed by the Upper Colorado River so Authority as the director of operations uh still have the non-voting members from the chamber and a non-voting member which will shall be the water utilities director or design of such director and the water utilities director is design shall act as Secretary of the board uh that's sort of the bulk of it another important U portion of this that was discussed at length was that all the applicants to be appointed by the city council um those application will be vetted through Mr Valenzuela and then his recommendations to the council for those appointments so that's kind of the highlights of this this is the first reading I I do request if we have missed something or anybody has any questions we we'll try to answer them Ricky the only thing that I see that's perhaps missing is a number of meetings or when uh the the board will meet the committee will meet uh we had discussed at minimum at least once a quarter and also as uh as

[1:53:58] requested by the board as well or by the city council so again we want to make sure that we include that in her the other question that I had um considering this and the in the new ordinance have have adopted will the existing board be dissolved and we start over is that the preference going into this I think as you make look at the makeup of the uh committee itself uh we may have a few members in the committee that fit uh the the bill as far as what the qualifications are that definitely we would like to take a look at and continue with uh but there's there are some changes that uh will will need to be implemented so there there would be a change on that board uh probably not a wholesale change but some changes for sure mayor yes sir can we have something put in there where it says if they miss if we do it quarterly if they miss more than one meeting a year that that they're off the board would that be an excused would that be partun yeah but if they have a funeral or well who's going to make up what the excused city manager I'm saying more than one I mean you can miss one you got four meetings a year and you miss two you miss you're not going to be you're not going to be very effective on this board if if you have the minimum but if they meet 12 times a year out of necessity that that would be well I suggest that if it's 12 times then maybe it's you get two miss or three something maybe not three I don't have a problem with that this water Advisory Board is very very important and it's very important to the council and we need to get the politics out of it and we need to get the very best people in there because water is going to be more and more of an issue and we need we need a board that can direct us okay so let me clear things up a little if they meet once a quarter how many times can they miss unexcused my suggestion would be I don't have a problem with

[1:56:05] one you that's 25% so if you want to take it if we meet 12 times you can extrapolate that out and make that 25% I would totally agree don't make me do math now come on well now I don't know though but even missing three in a year I mean three times if it goes to 12 I don't I don't think I'd agree with the 25% so much well if you have a four regularly scheduled meetings you're saying one um as far as above that you have one but after yeah I don't mind out of the four and and we are again the the idea here is to have at least four regularly scheduled meetings and again they may have as many as 12 it really just depends on what we're addressing at that point but if you want to say it based on the four quarterly meetings uh you can miss one and that's I I think I think that's perfect okay and the word for the day is extrapolate I don't know if anybody called that not I it mayor it yeah I was going to it blew me away have Johnny use that in a sentence here in a minute we will um I will work with Miss bowling and get those changes in the ordinance for the next reading well what about the like Charlotte said excused versus unexcused where what are you going to do with that where do that fall in we could uh place that just defer to the the board to establish those Provisions in the bylaws okay Charlotte and and since we were pretty insistent in that committee that they report to the city manager I would think that that would fall on him as to whether it's they contact him or his assistant for excused or unexcused and I'll be and I'll be totally fine with that that'll be okay Elizabeth we're not going to be reporting to me but there'll be I thought Ricky was the contact on for the board he is the uh well his position would be would hold the secretary's position as far as for records secret secretary I'm sorry Ricky I forgot that secretary secretary Dixon okay what what do you need on this today Ricky just the input that you got

[1:58:08] do you need to vote we need to vote you intruction ches I I'll defer can we take a vote for the introduction or do we need to make the changes first since we know there are going to be some changes just why don't we just uh wait until September 2nd bring it back then then thank you very much thank you Mr Dixon I we through with you is that all does anybody else want to anybody else War him while we got him public comment anybody else in the public War him while we got him well if we if we don't take any action on this it's I mean can't the can't the board when they meet adopt by laws that set forth the attendance and all of that I mean is there any reason to not not adopt this on first reading go ahe and do it well well we other um ordinate board ordinances do H have the uh requirements of meetings in them but there's no uh particular reason that it can't be in the bylaws so it can be by ordinance it can be in the bylaws bring it back to us and we'll make a make a decision all right we are now to number 19 and there are four pages of things I'm supposed to read here but I'm not going to read all of them this is the first public hearing and consideration of introducing ordinances adopting the city of St Angelo 214 code of ordinances now there are 12 chapters of this the first paragraph contains all of the legal e and the first chapter so I'm going to read the first chapter and the second chapter will be same as the first and the third will be the same as an ordinance of the city of St Angelo Texas adopting and enacting chapter one of the new code of ordinances providing for the repeal of certain ordinances not included therein providing a penalty for the violation thereof not exceeding $500 generally or not exceeding $2,000 for violations relating to fire safety zoning or public health and sanitation providing for the amendment of such

[2:00:12] chapter of the code providing for publication and providing when such chapters in this ordinance shall become effective chapter two is the same as the first chapter chapter 3 is the same as the first chapter 4 5 6 7 8 9 10 11 12 and dependencies are all the same as the first and I think this is yours Miss bowling well I I'll go ahead and um ask the city clerk to explain the background of her project uh working with the company that uh presented the codification project Miss Ramirez thank you mayor um basically this is a recodification where normally this is done every 10 to 12 years but the changes in this uh supplement are format changes only the um the attorney that reviewed this which is who we hired through Franklin legal publishing uh to uh reviewed it legal excuse me had the legal review told us the um things that the Departments needed to address they need to address those issues with the city attorney which are not in this recode this is strictly a format because the code itself was getting too big to cumbersome every time we had U an amendment the um it really uh involved more of the format as opposed to just the U substantive matter so this is only format uh there are some title changes into state and federal agencies and um that is it at this point we're not changing any me of ordinance we're not changing any of the rules or regulations you're correct mayor and we hope in the future for each department to look at the ordinance under their purview and suggest um changes that might uh be more workable um however it's impermissible for us in a global ordinance to um pass changes that are substantive as to each

[2:02:18] chapter because the charter uh states that every ordinance shall be one subject only and so we're achieving what we can legally and accomplishing the purposes of a format only um C recodification I don't have a problem with that does anyone on the council have comments on this Charlotte have a question Financial impact $1,450 what does that entail or cover in this I have a sample if you'd like to review it basically what they're doing they're giving us a brand new code code of ordinances with the format changes so and and it also includes the legal review that the um attorney did for us in other words he did the legal review he uh not noted which items need to be addressed and then from there we take it he who Franklin legal publishing thank you or CIF fire thank you further Council comments do I have anything from the public anyone want to comment on this before we call for a vote I'm calling for a motion and a second I'll make the motion to approve second second I'll take Elizabeth as a motion I'll take Charlotte as the second uh and if there is no further comment I'll call for the vote all in favor say I I oppose Nay put a 70 on that one number 20 is discussion of new citizen engagement initiatives including Coosa University Anthony Wilson you have the floor sir thank you sir here to talk about three new initiatives that we are launching in order to try to get our citizens a little bit more uh engaged in their municipal government the the main program that we are uh launching and sort of headlining this uh this effort U we're dubbing kosa University kosa cor standing for city of St Angelo and it is if you will a Citizens Citizen Academy of course we have a uh a Citizens police academy and what this is meant to do is hopefully to uh accomplish uh two things the first is is we're hoping to create a

[2:04:23] training ground for prospective uh board members for our 19 City boards and commissions of course you guys know that we're always uh in need of volunteers to serve on those boards and and we think that this may be a spring board into that sort of service the second thing that we're hoping to do is to cultivate some well-informed Community ambassadors for our municipal government and what we mean by that is we want some folks out there in the community who are well informed on what we do and how we do it and the method to our Madness uh so that when they get questions from their or or there's discussions in the coffee shops or the workplace or whatever they can help to uh to educate and inform their their neighbors and their friends and their family and their co-workers about why it is that the city does what it does and how it does what it does so essentially what we're talking about is a 9-month program a little bit of this is fashioned after uh leadership stt Angelo which I'm sure a lot of you have been through uh uh beginning in September and running through May in in conjunction with the school year we're talking about an hour and a half uh once a month uh on an evening the third Thursday of the month and we would uh this would be in various City facilities depending upon the topic of the evening we would serve a light dinner and of course that would be pretty much the only expense with this with this program uh we are hoping to have up to 25 citizens at least 18 years old the only other uh requirements that they that we have is of course that they live within the city limits and that they fill out an application and we already have this application on our website at costed tx. Usos uh and then some of the topics that we plan on uh covering throughout this 9 month is we'll talk about community and economic development we will of course talk about water which is our uh number one priority and your number one priority we'll talk about uh Public Safety our police and our fire departments about neighborhoods and about those opportunities used to serve so that's COA University and if you guys have questions about this as I'm going

[2:06:25] through this please don't hesitate to to stop me the other two initiatives that we have would alternate uh uh every other month uh between the two of them and these are both the uh the brainchild of our planning and development services director uh Patrick Howard the first is called uh citizens uh 101 and I should mention that both of these initiatives are meant to help build a positive sustainable Community here uh particularly at the neighbor Ood level but citizens 101 would be a 1-hour session the second Thursday of every month in the evening time at 5:30 in at City Hall in the uh East mezzanine meeting room it would be a Hands-On learning opportunity uh for people to come and learn about programs tools and resources for again building those positive and sustainable communities it's free it's open to the public the first session even though this is not going to be obviously the second Thursday of the month but uh the first s section will actually be next week on Tuesday August the 26th and we'll have some uh some experts talking about indoor air quality and it's titled healthy air Healthy Home future topics will address uh issues such as the use of gray water and having an eco-friendly holiday so that's citizens 101 the other session uh that we uh that we have or the other new program that we have is called lunch and learn and again this would also be on the second Thursday every other month alternating with citizens 101 it'd be about 45 to 60 Minutes at noon on that second Thursday of the month at City Hall uh and at these the information would be about a specific city services and regulations for targeted industry professionals again this would be free open to the public anyone who wants to come the first session that we have uh is slated for September the 11th it is on uh our geographic information systems mapping capabilities of course this is something that is used by a lot of uh development uh professionals within our community so sort of a primer on how to go about

[2:08:26] using that uh to its full capability future topics might include landlord and tenant issues and of course uh our uh ever popular sign ordinance so those are the three initiatives the three efforts that we're launching in order to get citizens more engaged in their city government and with that uh I'll uh entertain any questions we do we would appreciate any sort of input that you have and of course your endorsement and support and if you want to participate in whatever way uh council members would want to participate in any of these efforts we'd be happy to have your participation as well excellent idea Council anthy comments I have a quick is there a 25 limit a member limit or well you know uh this is obviously going to be our first time doing this and so we don't want to uh to you know sort of uh bite off more than we can choose so at least at this point we think 255 would be a good number and depending upon our experience here then we'll obviously each year we'll re-evaluate and see you know what works and what doesn't work and and so if we find frankly that a smaller group might help we do that but if we find a bigger group uh that we could handle and and if that there seems to be a desire for more people to participate in this then we can do that as well and this will be on the Coosa T I mean the what do you the SAT TV yes we'll we'll uh we'll we're planning on uh trying to do highlighting uh some of these programs on satv along with our social media uh and our website and again uh you can learn more about any of these programs on our website at cox. us and just come to the public information page and I hope you are going to ASU and Howard College and possibly the single class at Lake View and Central and we're going to Market this uh as much as we possibly can uh of course we wanted to present this to council before we began that effort but we've already got some things uh lined up so uh unless you guys tell us no we don't want you to do this that will begin uh immediately this afternoon Elizabeth Don Charlotte comments I think it sounds great I'm not really sure

[2:10:28] you're asking for our approval it sounds like you're uh you're pretty well ready to go but can councilwoman grind staff I am always seeking your approval can you tell me what existing budget will be uh supporting this since you're not asking for any specific funding uh we have some uh some dollars in the uh public information budget uh when it comes to food and again we expect that probably going to be our only expense I think that you know regardless of how many people attend Johnny's right there could be a need to do something bigger it's it's great that you're offering citizens an opportunity to learn more about what we do they seem to be thirsty for that well and I think you know people often uh don't fully appreciate and understand what we do and they don't understand the method to the madness and and sometimes I think that's even true of council members until you get uh involved on the Council and and get informed about what's going on and why uh you know you don't fully appreciate that there is a reason that we do the things we do and and how we approach the the issues that we do well like Gis for instance I mean I there are still a lot of people in the community related to real estate and development that don't know how to use that and we've spent a lot of man-hours on it and so it if we can help them it just makes their job much easier so that's great and frankly they may even be able to provide us ideas for how we might be able to use it even more effectively and efficiently any other comments from the right wing short yes um I'm asking for permission for the council I want to attend all of it for no other purpose other than to learn and to observe I I I want to get out of it for me I don't want to my presence to disrupt anything and I don't want it to be a question and answer from me I would just like to go and learn and observe we'd be happy to have any or all of your participation and uh and attendance and then the other thing was

[2:12:32] is the monies that you're planning to use is I can't remember what it's called the monies that you oh the peg fees no the the peg fees this would not be eligible for uh per for Peg fees Peg fees are for Capital uh expenses only okay comments from the left wing s like a good deal Anthony thank you mayor good job uh Jim do you have something on this I was going to call for public comment yes my name is Jim Turner just a couple quick thoughts here first uh want to know if any of this has been coordinated with the chamber on their leadership San Angelo program that they've had for a number of years and seems to be a little bit of a duplication of effort and goals there and I think it's a great idea to reach out to the public and educate them and try to get more engagement but as part of the total package I really think the city needs to review some of the procedures and policies and the way it does business that actually are actively discouraging uh citizen engagement uh don't have a lot of time to go into them right now the meeting's almost over and this is probably everybody wants to get to lunch executive session and do stuff but there are a lot of things that are going on that are discouraging active participation by the citizens it's difficult to sit here and watch some of what's going on and decide that it's worthwhile to get involved and that's all I've got to say right now thank you thank you Jim and if you discover anything in these meeting that discourages want you to stop it well of course and one of the things that Mr Turner addressed that I want to just respond to is we did actually talk with uh the Chamber of Commerce about you know how their program runs we don't

[2:14:35] want this to be obviously a duplicate of effort of uh leadership St Angela of which I am a proud graduate and so and many of you are as well and so you know that that program really addresses a wide spectrum of issues regarding uh our community and we're going to going to be focused only on what our municipal government does uh of course leadership St Angelo devotes a day to local government and we are a part of that but you know uh I think leadership St Angelo uh students or participants only spend a you know two or three or four hours learning about what's going on uh with uh with their municipal government and this is going to be uh much more intensive and much more focused on city government I applaud you all right our next thing is item number 21 which is discussion of executive close session we will bring that up after our executive number 22 is consideration of adopting a resolution of the city council of city of Stan Angelo Texas authorizing the city's that also is executive okay that yeah and when I got the Railroad Commission and I saw the man sitting there I realized that's also executive number 23 is consideration of approving a board nomination by counceling designated council members a is the zoning Board of adjustments Fred Adams smd6 to an unexpired term January 216 do I have a motion to approve Fred Adams motion to approve second do I have a motion I do have a second do I have further Council comment do I have clarification clarification this is not um alternate position this is a a replacement of my point I would have to look at the because that's what it says you know replace that expired term but it's not an alternate an alternate I would have to look at the membership okay do I have a motion do I have a second no public comment no further comment from Council call for the vote all in favor say I I any oppos

[2:16:38] n and I guess it's time for us to go into executive right about covered it let me read the legalities of this executive close section this is uh subcount uh regular agenda number three e executive close section executive section executive session under the revisions of government code Title Five open government ethics subtitle a open government chapter 551 open meeting sub chapter D exceptions to requirement that meetings be open under the following sections under the first bullet is section 55171 to consult with an attorney on pending litigation proceedings before the Railroad Commission of Texas and to consult with its attorney on contemplated litigation bullet point number two is section 55107 2 to deliberate the purchase exchange lease or value of real property pertaining to the value of Lake nasworthy addition residential lots owned by the city it is 1139 we are now in executive it is 12:49 and I call this meeting back to order we we have had our executive session item number 21 is consideration of and possible action on matters discussed in executive closed session if needed we did discuss one thing and that was a resolution that is in item number 22 so as far as number 21 I will say that there's no action to be taken on 21 but I would like to read this Motion in 22 and I'm going to read the words as we want it to be in the motion and after I have read it I will ask for someone to move that we adopt it as I have read it we will adopt a resolution of the city council of the city of St Angelo Texas authorizing the city's participation in a coalition of sim similarly situated cities and proceedings before the Railroad Commission of Texas and the Texas legislature related to the city's authority to effectively review and

[2:18:41] regulate utility rates to find and determine that the meetings at which this resolution was passed was in accordance with the requirements of the Texas open meetings act making other finding and Provisions related to the subject and declare an effective date will someone so move that we accept this as written so move second do have a motion I do have a second I'll ask for any further comment from Council before we vote on this I will ask for public vote on that public comments on this before we vote as there are is no public comment I will call for the vote all in favor please say I I oppose nay drop a 70 on that one and we are now to number 24 which is announcements and consideration as a future agenda items I'll start with you Rodney um a couple of things one I brought it was brought to my attention that I guess that a lot of these companies that come to town that do Paving and asphalt work here inside the city limits do not have to get permits I'd like to see if we can get an update on that and find out if whether they do have to do or do not if they do not of course I would like them to have to do that and be like licensed um we've had several complaints from residents in here in the inside the city limits that have been um scammed on these companies coming in from out of town mostly Elder elderly residents the next thing related to Asphalt also is just uh I think next meeting or hopefully within the next couple meetings we can have an update again to the public on what we're going to do on these streets that were the that we had all the problems with on the asphalt laning last year um it's just just they keep I keep getting phone calls from residents in my neighborhoods that are wanting an update on that if we could please Marty none at this time Johnny Charlotte yes I would like to uh activate a charter Review Committee get them started and working that's a long

[2:20:43] process and Mr Mayor I'd like to ask you to start that up if you would please sir and uh I am still also Mr Valenzuela pending my request for my update from Costa DC is referen the audit need that report also need the review on the projects each projects and how they are in compliance with our bylaws we have not received that I keep getting we're close we're close but it's just it's time and then the other item is I want a map a map that uh we can look at uh Rick's not here but uh when we were doing first starting the half cent sales tax spending the allocations where had a big map of the city and a big star on the map as to where those projects were going on well this time I think it would be very helpful if we had a map of the city of St Angelo that we could see the areas and if there could be pegged in there all of the new businesses locations whether it's Hotel restaurants you know where it's going on that maybe the uh the mapping the GIS mapping Department uh if someone is looking at buying property whether it be vacant property or where constructions going on if I want to build a home I certainly don't want to uh build in a really hot spot necessarily but I would like to have that map that we could look at and we also used to have council member maps that had the areas shaded in pink of All City owned prop properties and I'd like to have that updated it's not necessarily an agenda item but the other thing was the same as uh Rodney brought up the pavement I've received a lot of phone calls the aggravation and yes they've been getting an explanation from staff but the comment Mr van has been well the city's in processing process of litigation it's probably going to take five six maybe

[2:22:47] seven years before we'll get anything done they're not liking that idea they don't they fine they want the city to litigate on that but they want their roads taken care of it's soup on some understand what is that stuff it's not oil it's the Emulsion the what I mean it's you can't walk across the street to mailbox because it you slush in it it's it's just there's no gravel and it's horrible and people are now starting to track that black muck in onto their homes their carpets and need to really address and let the people know what we plan to do even for a Band-Aid cure to help this out out there I'd like a report on that that's all Don um last time I asked for an update on where our lean situation was and it's didn't appear on this agenda so I'm going to ask for it again on the next agenda what you know what he's talking about Chief I do know okay Elizabeth no sir I have one item that I would like to to put on the agenda for discussion and that has to do with the 3.6 million fee that Republic has paid us for our Landfield I would like to use this fee for the good of the citizens so that every citizen in San Angelo can can profit from this fee and the best thing I can think of is that we use this fee to take care of the water deficit and our water operating fund to bring this thing up to Z zero so that our citizens will not be charged to conserve water so I would like this on the agenda because I want to use this fee before we spend it for anything else Marty I I I forgot to mention executive item executive executive session item for for for next uh meeting the new yeah the possible new construction of the police
