[0:00:00] on this July the 2nd 2024 we're obviously a little short on people up here today so um we're not we're we're g to move forward we have today our chaplain Ralph Dawkins to lead us in prayer and pledges so if he would please come forward if we would please stand good morning you're good let us pray father thank you for the opportunity to bring prayer into this Gathering of community leaders and concerned citizens Lord your word declares that we should acknowledge you in all of our ways and you would direct our paths you said if we Delight ourselves in you that you would give us the desires of our heart so today I pray the city council meeting will be productive and beneficial to all who are making presentations today help the city council to listen with understanding and good will help them to respond in character and conviction and to help every presenter to speak with Clarity and restraint give these leaders a spirit of service and remind them that they are stewards under your Authority I pray that you'll grant them wisdom and courage to know and do what is right and good and true for the good of our community and even in their executive session lead them guide them with wisdom and courage and integrity to consider the the concerns of the citizens and to make decisions that will benefit the city of St Angelo and surrounding communities your word says that we should pray for our leaders because they have watch over us and they too must give an account for their considerations and so I pray for the city I pray for the mayor her staff and assistants the city council members the city manager and every person and Department that is instrumental in leading and directing our city I pray for the new Chief and the new CH assistant Chiefs and the

[0:02:03] entire police department and the sheriff's department that they will continue to protect and serve the residents of our city I pray for the fire chief and the fire department and all First Responders who serve our city and lastly I pray that for continued economic prosperity for and safety for our community may you grant draw in a track to our city industry businesses and corporations that will produce jobs and revenue and help us to grow and progress in jesus' name I pray amen amen through the Pledge of Allegiance our pledge allegiance to the flag of the United States of America and to the Republic for which it stands one nation under God indivisible with liberty and justice for all I pledge Al onor the Texas flag I pledge allegiance to thee Texas one State under God and and indivisible thank you thank you very much there are no proclamations or recognitions um for today's meeting so we will move into our public comment portion of the agenda issues or concerns not on the regular agenda may be raised by the public at this time citizens should speak from the podium address all comments to the dasas Begin by stating their name and address or single member district number and limit their remarks to less than three minutes do we have individuals in the audience today who would like to come forward and offer uh public comment yes ma'am okay Charlotte Anderson keeps and Angelo beautiful um today we just want to give you a brief review of our household hazardous wased event that was extraordinarily successful we had 257 Vehicles 72 volunteers 25 organizations

[0:04:10] 396 hours $1,825 value to the city of St Angelo we removed 13,798 pounds of hazardous waste 2200 plastic bags 3200 lb of paper were shredded 75 lb of cardboard 4200 lb of oil and right at 3,000 lbs of electronics so we we were very pleased with the results um we're very pleased of our partners that helped us achieve these goals all these materials were taken for recycle reuse or incineration so none of these items went to the landfill and that's the most thing that we're proud of um on the back of the little flyer that I shared are three upcoming events that will be working on um today we're Gathering supplies for the star spangle celebration which will be tomorrow we'll be handing out hand fans and trash bags so we're hoping that our citizens will take an opportunity to take their trash with them or to get their trash to a recepticle that's tied up so that the trash doesn't blow around the city or get into the river um and this has been uh a really fun event to put a name with a face and reach out to our citizens so excited about that and August we have Dr Alper for University of Texas um he will be with us to discuss his efforts in developing enzymes and microbial processes that reverse or stop environmental damage of plastic waste so actually they have chemicals that eat plastic so it's a really um interesting um uh presentation and we hope if y'all are available you can join us for that and of course our tires to go will be September 7th so we're gearing up for that as well and calling for volunteers so uh thank you again very much for your support and all the things you do to keep St Angelo beautiful further public

[0:06:13] comment please I don't know if you'll be able to read all of that in three minutes oh I won't read all of it it took me three days to do all of this I bet I bet that's right and eight and a half years to accumulate it my name is Suzanne Daniel I live at 415 South Madison Street here in St Angelo you want to lower that microphone to where you can actually speak into it yes I'm I know I'm a little bit shorter than everybody it's all right we just need to hear what you're saying okay I'm Suzanne Daniel and I live at 415 of South Madison here in St Angelo I'm a retired educator I have a handicap trash bin and I applied for it way back in the beginning when Republic Trash first was contracted by the city um when they took over the trash service in this town 8 and a half years ago the S Angelo paper ran an article stating the availability of handicapped trash bins and the procedure for obtaining one of these bins I followed through and obtained the bin in May of 2016 I had two failed trash pickups that may this was followed by over 140 failed trash pickups over the next 8 and a half years trash bins that were emptied were often dumped in the driveway blocking me from leaving the house several times I accidentally hit the trash bin when it was left in the driveway instead of being placed back in its proper place which damaged my car several times I found the bin thrown out in the front

[0:08:16] yard once I caught the driver with the empty bin over his head preparing to throw my trash bin down the driveway on July 28th uh 200 and 18 I contacted the J the uh San Antonio no this was 200 yes uh 18 I contacted the San Antonio Office of the Americans with Disabilities they gave me some information uh on Republic Trash I was told to contact the city manager which I did and then I was referred to Jeremy Miller head of waste management and Don slagger who told me that the handicap trash bin for Republic trash was not working and it never worked it didn't work in the beginning later at a city council meeting I was introduced to a man named quarls who assured me that the handicap program would meet the ada8 guidelines for a month or so the trash uh was emptied however it was never consistent sometimes it would take two and a half weeks to get the trash picked up on September the 8th 2023 I flagged down a Republic trash truck driving pass Miss Daniels your time is up and what I'm going to ask that you do Shane Kelton is here in the audience today and he oversees the uh trash I'd like for you Shane if you just come forward a minute and um introduce yourself and we will um make sure that these issues and Ada issues Teresa James can have a discussion with you concerning Ada that doesn't do any good and I have pictures and all of this is documentation now I'm

[0:10:19] telling you now Republic Trash has been out of compliance with the Ada for8 and a half years this city Council and the previous city council have been out of compliance with Ada now you can shut me down we're not going to shut you down we're not going to shut you down what we're going to try to do is solve the problem and there's two people here you have never solved it in eight and a half years then what would you like us to do today okay I can go to the Ada again okay that I will there's two people who are here to help you today Teresa James and Shane Kelton if they do not help you and help get the problem solved there's many of us up here today that you can call and we'll also get involved I have called and called for eight and a half years respect if you give these people a raise and you Renown their contract you are just as complicit with without with breaking the federal law as Republic trash is that's all there is to it if you'll make sure Teresa has your contact in Shane if you will meet with M Daniels and um would you like to meet with these folks okay thank you thank you more public comment please Morgan chewan assistant director of neighborhood and Family Services uh just wanted to touch base and speak to loose dogs that were working a case on

[0:12:22] at 200 um South Bryant Boulevard um that AB buts a Target neighborhood and so that is a contributing factor that that's an area that needs services and additional enforcement um so we recognize that that is a contributing factor um we have been out there seven times in the month of June Alone um these are self-initiated calls from just we drove by one time and saw them uh we're not getting the calls for service but certainly getting a lot of attention um online um in that initial call for in that initial point of contact when we saw them we observed the dogs to be socialized um they they they appear to be owned they appear to belong in a yard there appears to be significant amounts of the day that they are um you know not just wandering the right of way um and but there's just a simply a failure to provide s secure enclosure and so we we want to work that case and we want to escalate that um but now that they out citizens are feeding them and that's um that is impeding our case a bit and we we appreciate the attempt to help we recognize the the desire to help um but there are a couple things things we need to be able to proceed is either um those that are feeding them and and youall have pictures that are handed out that are the these bowls that we're seeing new ones daily that are in um the RightWay between a couple of restaurants um where it appears that U daily new food bowls are being put down uh for these dogs to have access to we have had a trap at at the property um but have been unsuccessful in any dogs taking the bait because they're not they're not hungry they're not appropriately motivated to take that bait um so if citizens you know want to be involved in this way and and and do have compassion for such animals we would ask that they either stop interfering so that we can catch the animals or take that additional step to become Good Samaritans friendly finders um Fosters um to get those dogs to Safety and Security that certainly the um the extremely hot weather that's coming up um citizens are going to leave water out and and have a concern um but also call us don't trust that someone else is

[0:14:25] calling us because as I mentioned we're not getting these calls for service we're simp simply you know self-initiating this call um so if the problem if you do call us and are not satisfied if the problem persists call again ask for a supervisor uh we want to make sure that we deploy appropriate resources um and just trust what you personally see and experience um that if you call us and speak to us and you're not satisfied certainly escalate it um but beyond that we we we are working the case uh we are out there um trying to catch these dogs we do recognize that it's near an important I mean a high traffic right away and so what we don't want to do is chase them into traffic causing an accident um and we absolutely want to impound these animals uh try to identify an owner um work compliance with that owner um and essentially stop the the the growing uh group of dogs in this area um I would also encourage folks to follow the new Sano Animal Services page we have tips on this and additional information um on Facebook um so that is one way to get involved and one way to stay informed as well I will contact the two business owners that uh are feeding those animals and make sure they that they have a conversation if they would to with their employees to make sure that they don't continue to feed them thank you thank you further public comment Morgan Harry I mean Tommy further public comment seeing none hearing none we will close this section of the agenda and we will move on to the consent agenda I'll ask each individual city council member if they'd like to pull an item for consideration and conversation I'll start with Larry Miller ma'am Karen no ma'am Lucy no ma'am I'll pull item F Tommy no ma'am may I have a motion for approval of all items a through um M are are you going to the ex with the

[0:16:31] exception of H yeah I mean f yes I have a motion to have a second second second by Tommy all those in favor uh of approve oh public comment seeing none hearing none we will uh take a vote all those in favor say I I motion passes 5 item F consider approving task order number four with Frieza Nichols Incorporated under RFQ pw- 0 1-23 for Professional Services for the design of Avenue in roadway and utility improvements totaling 1,436 $831 and authorizing the city manager to negotiate and execute all related documents just fill in the details very good so Avenue in is one of we're coming to the end of our 80 $80 million 10year Bond cycle that Council approved back in 2015 for us to go through Avenue in is going to be one of the last streets that we're going to be able to do within that within that 10-year um list of list of roadways so what it's going to be is a street Rehabilitation all the way from Sherwood way to chadburn street is what we're going to be designing so that's going to come in and rework that entire roadway rework the signalized intersections there um look at traffic traffic patterns traffic control see if we can make any improvements along there as long as well as adding sidewalks and some pedestrian connectivity along that Corridor as well it's badly needed yes ma'am it's good to see that we've got it in the works right and this will tie into the sidewalk project that we have with the cacp so that sidewalk design is going to be a separate project but this will absolutely tie in and enhance that any further questions for um Patrick Larry would you like on of the which side of the street are you intending to put sidewalks on yes both sides of the street both sides well it it so it it it deter sidewalks are are tricky in developed areas already if

[0:18:34] it's not built at the time of development we have to work them in where we can um and a lot of times there's there's obstacles and there's things in the way that we just can't move there's an X number of driveways that that we have to take care of so we place it where it's most realistic where we can get people across to the sidewalk where we can cross them at controlled intersections and whatnot so we strategically place those where it's the safest where it's the most most usable and and um work where we can where we can fit it in within the rideway that we currently have and this project will also rework sewage lines is this going to be as extensive a project as College Hills it's the same that we do on all of our projects so yes it does rework the underground utilities at the same time so we'll come in do the water and the sewer infrastructure first then come in and do the roadway on top of that um we're looking at a couple different methods to do this some of it's a full reconstruct some of it is hopefully going to be able to use the FDR process that we saw on Rio Concho and on North chadburn Street to kind of expedite and save some money on the project as well I was curious about detours how you how that's going to work I couldn't figure in my mind a a logical way for people to at least get to their destination without having Avenue in there well the beauty of that road is it is a four-lane road right now so we can technically have head-to-head traffic on one side of the road while we work the other I'm sure that's the it'll it'll work it all depends on the phasing of the construction but if we have a reasonable detour where we can move those cars off it doesn't interrupt um their normal traffic patterns we we like that because it takes it away from excuse me the the safety of the construction workers but we also understand that we have to be expeditious with our traveling public as well so we work that in to make it make the balance of those two priorities thank you yes sir have you have we worked with uh the university ASU because I know that they have wanted sidewalks and that's been an important thing for them because of this HB and

[0:20:38] Yeah we actually set up a meeting with them met with them about three weeks ago to kind of go over strategy for that area since we are going to be doing Avenue in and designing Johnson Street at the same time along with the cacp that's going along there that they were generous enough to contribute to we wanted to coordinate with them and say what are your future plans what are you looking at ASU doing and and how can we either prep for that in our project design and or accommodate that as we move through and make these improvements along that Corridor so we're absolutely working with those bigger entities to see if we can make improvements for now and in the future good yes Lucy Patrick what time I mean what's the time frame like when do we start this project or how long will it take so we're just going into design right now um the design process we're expecting to take about 12 months so we'll move through like I said freezing Nichols um has been very good with us very very good about staying on budget and staying on on those timelines so we expect it to meet those deadlines once we have 100% designs then we can talk about um funding the construction side as well as as uh timelines for the construction of the of the actual roadway is this cost covered in that $80 million Bond the cost of the design is yes ma'am but not the construction the construction unfortunately I don't have any identified monies right now doing it but it is I do want to note that it is still ad advantageous for us to um get the design going because in a lot of the cases of the grants that we're applying for project Readiness is a huge component of that Grant we get a lot of points for project Readiness so if we have 100% design sitting on the shelf that puts us well ahead of anybody else that doesn't have that opportunity there so as we're applying for those grants this investment will give us some returns when we're looking at compe competing for those Grant monies other questions or comments for Patrick Tommy just a comment at the point in time Patrick that construction starts I know y'all do a good job of this but it's just a a reminder for all

[0:22:41] of us there will be businesses that are affected by this and while we give them notice I would just simply respectfully request that we do this early and often because it does impact uh some businesses a lot more than others um and all of us have receive calls I would imagine over an issue with access to a particular business when this has been um when one of these projects has been ongoing so again I would just respectfully request that you do this early and often whenever you're ready to start so that those businesses know they can't really anti ipate what it's going to be like until it happens and sometimes it's not as easy a process to deal with as in fact we would hope that it would be so early and often would just be my request you the good news is we've got a year of design in front of us so we have a lot of opportunity to start that communication number one it's like college Hills everybody complained about college Hills how bad it was how horrible it was and then all of a sudden we start construction and then it's how quick are you going to get out of here because you're in the way and it's a problem if we're going to redo the streets and redo utilities there are going to be issues and they're going to be impacts but we've got a year to start communicating to everybody and get people's input and take it into consideration as we move forward but we need to get this project done it's really key so and you're absolutely correct and and believe it or not we do take that into consideration when we're phasing our projects and setting up detours and traffic control and and everything we're very well very aware of it I mean it's one of the things that we as staff really do struggle with is making sure that those businesses have as little impact um on their operations as

[0:24:44] possible it's inevitable but we do take it take that into account and and make it as um as as bearable as we possibly can and still get our Street rec redone um like it needs to be let's get it done thank you so may I have a motion for approval of ITF Tommy made a motion may I have a second second by Lucy public comment seeing none hearing none we'll take a vote all those in favor of approving item F please say I I motion passes 5 that concludes the consent agenda for today we will move on into our regular agenda comments regarding items on the regular agenda may be made by the public when each item is discussed as outlined above applicants proponents and appellants are exempt from the time limit above and instead must limit their remarks to less than five minutes item a is consider approving a proposal to allocate 2024 cdbg and home Grant funds for programs and projects and authorizing the city manager to execute the applications required certifications related documents in annual funding agreement from the approximate allocation of 6 4682 of cdbg and 25,124 and assistant assisting special needs citizens this happens to be our last um year of the 5-year plan so next year you're going to see a lot of different programs coming to you because we've requested them because the federal government is is changing it is it is it's a fiveyear requirement by Hud to

[0:26:48] change every five years so we'll uh we'll go through the public comments we'll have meetings we'll try to come up with a different uh different programs uh that meet our current needs it's really to assess our current needs across the community and then we come and then we try to adjust our programs to meet those needs and who will you be visiting with when you're looking at adjusting for the needs of the community it is a bunch of folks we have a list of uh organizations of stakeholders that we have to meet with and get their input uh then we also hold our public meetings of course and get input from citizens so uh it is a pretty comprehensive approach it takes a little bit of time we usually start about March and then we come to you by about this time next year are the dollars you're talking about today up or down from the previous years actually yes um if you look at this uh funding profile uh you'll see we've been steady for The Last 5 Years however we did lose a little bit of money on both cdbg and home it's we're down 10K for cdbg and we're down 56k with home funds and why is that it's just the allocation that the federal funds HUD controls that they send us the allocation and then we adjust to that unfortunately so do we have input in that no we do not it is a Formula that's said by Congress so is there anything that we can do to Better In fill in the blanks on the formula to get the money uh no I mean we have it's a at the federal level very little actually uh I know that we have a um we have uh some um organizations that Lobby for cdbg and they're very active and we always send them support letters um and then they then they Lobby for our purposes the best they can and sometimes they do adjust uh this is a this is doesn't take effect until probably later on in the in the year uh but this is the the the the allocation the proposed

[0:28:50] allocation and sometimes it goes up and sometimes it goes down at the very end so we may have to adjust this at the very end so be aware of that all right we'll go ahead with your presentation we'll see if there's more questions sure here's the proposal for a home funds we are asking for uh 2,513 for administration uh 60,000 for firsttime home buyers down payment assistance uh 64,000 for MHMR special needs tenant based rental assistance and 10 15,624 new home construction for our chto which happens to be Gile e CDC how has the neighborhood revitalization the down payment Pro program worked are we successful at it do we have a lot that end up not being able to make payments tell us the story uh this is the the down payment closing cost talking about uh we uh it is it is a deferred loan uh after 5 years it's forgiven and how's that we we can go up to up to $166,000 based on a little bit of a formula that we put together as well based on uh availability of funds how much they can afford that kind of thing so what's our success rate or not yes what is it I'm sorry what's our success rate the success rate yes um of someone getting their loan well if we are providing the down payment which means they have the ability to buy a home how many of those homes actually still aren't foreclosed on or for some Dynamic uh We've I don't think we've gotten a foreclosure in this program for a very long time uh there's the Ahab the co ofc funds we do have some uh folks being threatened we had one that went bankrupt we have we've had uh several threats of forclosure but for some but somehow we get the the owners get by and end up um uh saving the

[0:30:53] saving the homes so uh so far we're Bing pretty good so um again these are these are these these are not new homes these are Define 100 pretty good I don't have a number not a number I want to say at least 90% at least 90% we I don't remember having I don't remember having a foreclosure um in a long time I don't I just don't remember ma'am so if it's 90% what's that 10% factor I I can get the percentage the exact percentage to you uh if you want I don't have it on my hand right now because these are just numbers on a page it'd be interesting to see the profile what's going on here well that then you could have we could have that actually you'll get that um towards the end of the year when I come with the Caper when I do the performance report I'll have this that I'll have that information for you uh we cover you know basically uh what we did with these funds how what the success rate is on all the projects not just this one so we will be we'll be coming to you with that information because we want a lot more detail sorry we we will want a lot more more detail better understand it but we we do have that we'll have that detail for you at the Caper okay okay all right where was I oh yeah at the end uh chto yeah chto are galile CDC and they uh they do they provide new home construction for us and are they um finding enough lot to develop to they have some they have some they have some difficulty finding available Lots that's correct uh they try um so yeah they do have a little bit of problems doing that so how many new homes does this buy uh normally uh we we ask them they do three to five every year and uh we're we're not finishing the year of course but uh again we'll have that information at the Caper we'll tell you exactly how many houses they built so how many does this build if we have 10 15,622 what what what does that build well because you're down 50,000 right so

[0:32:56] yeah the five is really it's they they disperse that information they disperse those funds for V variety of homes for example they'll take 105 they'll take 10,000 for one home because they have other funding they'll take 15 for another home so that kind of uh kind of depends on the uh situation depends on the available funds that they have uh that they can put towards that new home construction and don't forget they also use Ahab funds the co of DC funds so between that and that and they kind of bring down the for mortgage and they're allowed to get people into new homes so that's what that is so that's spread out across four or five homes actually okay okay okay on the uh cdbg side um we're asking for 129,000 360 for General Grant Administration 115,000 for Rehab program delivery2 so that really if you got $140 some thousand for administration and salaries right that's correct so 140,000 of the 646000 is what percentage it's uh 41% I think does that seem high it's very high it's very high and I think that's why my fact Mike and I have been talking about uh adjusting our program uh as our funds for in fact this is the first year that our cdbg and home funds together have been under a million dollars uh that continual down downturn uh is making us change and do some do some things so this next five years we're going to take a hard look at this and see if we can cut that down uh considerably because so if we're getting less if we're receiving fewer dollars are we maintaining the same administrative cost and not reducing that based off of receiving less we we uh well our administrative cost doesn't don't change we have to pay our staff uh buy you know buy supplies and that kind of thing um

[0:34:58] so we have to look at uh options uh to reduce the cost and expenditures and um and maybe craft a program that's more appropriate to the funding availability and that's what we're going to do next year yes but okay so if we're looking at a fiveyear program which is what we're you're saying this is the end of the five years yes but if we're continually receiving fewer funds are we not reducing overhead cost as we receive fewer funds or the overhead cost just keep going up as a percentage to the total which is not what you do in business generally speaking you you reduce your overhead that's right so this trend line are we adapting to the trend line because you don't want to just wait to a new fiveyear program you want to be adapting along the way yeah well it's too late for this year because uh we have to you have to go to get approval to change your program uh but we will The Five-Year Plan is a perfect time to relook at the programs and and uh and recraft them uh something that's some cities for example have have a grant manager and money comes in money comes out and very little overhead uh we have chosen to use to have in-house programs uh that we manage uh including housing and uh Housing Development those kind of things so so we're not looking for additional grants uh we always looking for additional grants but they're hard to get there aren't very many out there um in fact we do have other grants we we are they have in fact they keep us busy I've got a slide that shows you some of the other things that we've been doing to kind of give you idea that our staff is busy they do they they stay busy but those funds will will dry up as well so okay continue oh what was I uh yeah um yeah 120 for minor repairs we want 110,000 12 for emergency emergency housing repairs 127 430 for debt payment of section 108 loan which I believe it matures uh 2030

[0:37:05] so and that's producers Park producers Park and Real Vista Park and then uh 45,000 for code compliance officer to focus on our neighborhoods that weet targeted for revitalization and questions further questions from Council all right continue okay uh we're almost done here uh this is this SL shows you some of the other programs that we do manage indigen cremation which is a county program uh homeless emergency Sheltering Continuum of Care Rapid rehousing program um ARP that's American Rescue plant rental assistance uh Atmos weather ration program infield housing incentives and then the um royalty fund from the service line warranties of America so we those help us uh give more bank for the buck gives more gives us gives a staff more relevance in the community to do things and be more active and uh basically the this if you approve this proposal will'll turn it into the annual action plan which will come to you next Council and then we'll send it to HUD for their approval questions further questions from Council because if you approve this if you have no more further questions it moves forward without further question so are there more questions well I have a question you know we were talking about the the 130,000 or the the fees or the monies and so if we approve this we're approving that even though he said there were going to be change in it next year next year that's right so we're really not I mean it's not fixed yet the way I well no this this takes a f October the 1st if you approve it we'll go through out an AC the annual action plan begins October the 1st ends September 30th next October the next October the 1st it's a new 5year plan with a with a one-year action plan tied to it so when we come to you next year it's going to look a little bit different it's going to look

[0:39:07] a lot it's fact it's going to look a lot different I can tell you not going to look a lot so when we say it's going to look a lot different it would be saying if you will that we're not happy with the current plan because we intend to make a lot of change what I'm saying is uh we have to adjust based on our funding is what I'm saying and because of that it's going to affect the programs that we're going to put together and the Staffing Karen I'm not even sure how to ask the question you you mentioned a county partnership with the Indigent cremations yes how does that how does that affect us sitting here as representatives of the city well this countywi program we uh We've took we took on that program uh as my understanding I I inherited that program so they'll know the history as well but my understanding is that when there was a discussion on um excuse me when there was discussion on whether uh who should take this program on and the city took on the county took on the library we took on this program uh it's the County Judge approves the cremations we provide funding and we work with the funeral homes and we cremate uh Indigent U individuals and then uh take it from there and we bury the cremains at Fairmont that we pay we buy a couple of lots at cremont and then we put six cremains in one plot with a little bit of a with a small uh plaque showing the name and and date and then the dates so um it is a it is a county program it's not a city program uh we just manage the funding uh and the payments yeah we don't we don't approve those further questions from Council comments okay then I would need a motion for approval of item a so move so move by

[0:41:08] Tommy is there a second second second by Karen public comment um Jamal shumer single member dis you want to lift the microphone up so you don't have to bend down much thank you uh Jamal Shumpert single member district number three uh Mike can answer gu is decreasing uh what I've noticed a lot of local governments don't contribute out of that general fund to these programs and these are solely Federal programs all the money you saw up there was Federal money uh the HS and sales tax is what we contribute and it's maxed out at $335,000 a year if you wanted to make a change you could go back and change that uh and raise it a little bit more and as far as the administration cost uh he he's trying to get rid of the administration caus by using the Cho he didn't mention it to you uh probably because he doesn't know if the Cho is going to agree uh a lot of people don't want to do affordable housing if you talk to your home builders around here they won't build him a home uh so he's he's doing as best as he can and he has him and Morgan have quite a bit of departments to handle maybe we should get them a little help uh the infield program is funded out the general fund for um that program so that has been a consistent $200,000 a year um that we've added to the funds and that's been going on for about five years now so that is the dollar amount and that is an addition he didn't have a number there but that's there and the infield if I'm correct usually mostly the builders are want accessing those funds correct so it it doesn't really go to the person if I wanted to go to him and say hey I qualify for this house I want to build a house I'm not going to have to build that waterline in most areas it's going to those new development that's probably going to put a couple affordable houses in but yes there is a little bit of money uh towards just that it's not towards building a home or bringing well it is towards building a home because

[0:43:11] the infield program number one is designated in the low in five lowincome areas and those areas where there are available Lots very often where there's no infrastructure existing in those lots whether it is curbing gutter whether it is water whether it is many things so yes the Builder gets it but there wouldn't be a home built if he didn't because of the expense of building that home if you had to put in all that infrastructure you couldn't build a home that would be affordable in those infill areas well well mayor last year I watched a guy take about $13,700 we're a little bit off topic we're not talking about our infill program today we'll just stop that yeah okay yeah we can talk later about that uh but yes I I really do think they're they're doing as best they can uh your questions were valid I I believe they were uh thank you and I do support you're welcome we just want information okay yes thank you I do support his his motion thank you further public comment seeing none we'll take a vote all those in favor say I I motion passes 5 we will move on to Item B consider approving task order number five with Freez and nichels Incorporated under RF qpw 1-23 for Professional Services for the design of two Lake nasworthy boat ramps and three kayak launch areas totaling 2 49,8 51 and authorizing the city manager to negotiate and execute all related documents Patrick you're back on all right good morning again mayor councel um the lake nzw the improvements have been a a very noticeable um Improvement out at project out at the lake that I think um has has really done a lot for that area um a little bit of history on that for those that just aren't aware um the the funds that we're using for the improvements are actually a voter approved allocation of $6 million for

[0:45:14] very specific projects out at Lake nasworthy um when that when that vote went to uh when that vote was at in referendum um back in 2019 it was for boat ramps for a fishing pier to redo the the nasworthy fishing pier for shoreline erosion control and sandy beaches we have made some progress with this um with this money so far we've constructed the fishing pier out of Lake nasworthy great it's right beside Mar Lee Beach and it has been a tremendous Improvement out there I know I've been drug out there several times by my son um I'm not a fisherman but he is so I get to spend many many hour um on a weekend night out there and and it's always full there's always people out there um using it fishing um and and loving that so that has been a huge investment and a very very popular one um that we were able to use this money for we have also started some vegetation control with this money um the shoreline part of this included vegetation removal as as well as stabilization um that little boat that you see there is actually the boat that we bought um to kind to to do this it's called a weebo it's a little uh backo on on floaties is what it is so it allows us to go in there and do some re removal do some some um uh Lily Pad removal and kind of start working toward that vegetation management and see if we can take care of this little bites at a time so that we don't necessarily dramatically affect the habitats that are currently existing there give them time to adjust as well but at the same time make improvements and kind of keep that vegetation under control control so the lake can be used both both from a fishing perspective as well as a recreation skiing perspective that it um is so popular for and then finally the boat ramps have been um one that's that's been a long time coming uh we have split up the boat ramps into two separate phases so phase

[0:47:18] one we actually have um designs on currently we're waiting on some funding from tpwd for the construction phase and um then we'll get those bid out and get those started so at batty Road nickach Park and South Concho Park have all um are all going to see some improvements to the boat ramps there we're going to be making them wider making them more accessible adding some docks adding some Ada connectivity to them um improving some trash can and facilities and signage and and just really enhancing those boat docks and making them more functional again um a special note on this the T we've been working very very closely with the Texas Parks and Wildlife Department on a boating access Grant um so we actually designed this on 25 cents on the dollar for that so out of the city we only spent $40,000 on a design of this and what we're anticipating is these three ramps will be about a $1.2 million Improvement of that um of the construction side we are only going to be um on the hook for about 200 of that that's great so that's that's the value of the grant program um and what it brings to really maximizing these dollars because $6 million could be used up very very quickly but we're we're really taking advantage of these grants and maximizing that money in this so that leads me to what we're here today for um really this could have been on consent but what we wanted to do is we wanted to give you Council as well as the public just an idea of what we're doing and what's coming down and and what we're looking at so and what these improvements they can expect to see and so that they're aware of them we applied through the tpwd for a second phase of boat ramp construction so we have the initial three that I just went over this phase is going to add two additional ramps as well as some non-motorized um launches in there non-motorized is something that the lake hasn't really had so being able to launch kayaks and paddle boards and canoes and and stuff

[0:49:22] like that um in in those isolated areas and and safely away from the boat ramps from the motorized boat ramps will be very very valuable and I think very very popular um out at the lake is something that we don't have so we really wanted to kind of get that that concept and that mindset started out there as well um so the two boat ramps that are going to be going in in this phase that we got approval for funding through P again we got approval for funding through tpwd 25 cents on the dollar so we're going to be paying 62,000 of a $250,000 design um we're going to be working on two ramps at Red Bluff uh Red Bluff Circle and on Fisherman's Road and then we're going to be putting in those those three non-motorized launches um at South Concho Park just south of the low water crossing and then at concrete just north of the low water crossing we're going to have one on either side of that so you can either go down the channel or you can come out into the lake with those um non-motorized access and then over at Rock SLO Park so you can access that Main body of the water there's already a group of people that use that rock slooh park we're just going to make it a little bit better for them and and kind of um make that a permanent feature for those for those and anyone else that wants to use it so I think the big question is when is this going to start and when's it going to get done so we are going to uh with your approval today we'll start the design process um Frieza Nichols has been helping us on the last one so they're very vers in what tpd w tpwd is going to need um from an environment Al and and all those clearances so we expect the design to process to go very very quickly um kind of want to walk through what each one's going to look like so Fisherman's road is really going to be the cool one U right now this is just kind of a off off the charts ramp if you will it's not very well used but what we want to do is we want to make this a hub we want to make this one a very one of the main boat ramps for lake lake nasworthy it's

[0:51:25] in a great location to access a good portion of the lake it's isolated and we have plenty of room to really make it a really nice thing um what we're hoping to do is that we can pull that traffic away from the Mary Lee Beach ramp and kind of enclose that one it protects the pier we don't have a bunch of boats and Jet Skis running around the pier and and impacting that and brings all of that traffic here so with this we're going to have restrooms fish cleaning stations um ample parking you know multiple room for to launch multiple boats at one time um along with those docks and those access points onto the water so uh this is expected to be about a $2.6 million Improvement right there but I think it's really going to make that Fisherman's road entrance Pop um and and be very very um a huge benefit to the public and this is with grant funding yes ma'am so the way that the tpwd grants work is when they give you when when they award you the design money they essentially earmark the construction money for it it's two separate application processes but in their mind they're going to they're going to continue that and and see it all the way through fruition once they once they say yes let's go ahead and help you design it Red Bluff Circle uh ramp is actually a ramp that is closed right now it is completely unusable um just due to damage and and deterioration um it's been closed for several years now so we want to reinvigorate that ramp and and make it usable again for the public uh so we'll be redoing all the parking structures again a new ramp coming down into the water as well as as docks in that area as well and then the non-motorized sections um this isn't exactly what it'll look like but it gives you an idea of kind of what we're talking about when we talk about kayak launches so it's a way to get in and out of your non-motorized without getting wet um hopefully I know that I probably couldn't do it I'd still fall in but um you know for those that

[0:53:28] that want to do that and you know they'll be able to pull themselves up up onto the dock you know unload get themselves into the water and just really make that experience much much nicer for them without having to compete with boats and trailers and everybody that's at the main ramps this is really exciting because we know lake nasworthy is one of the great assets we have here in St Angelo and to see this creativity the thinking outside the box trying to bring more activity to the lake and make it more uh citizen friendly with the trends in terms of what's going on I think is really exciting right and just to note too I mean we do work very very closely with the homeowners Lake nasware the homeowners association so they're really the group that guides what we do out there um as far as this money and these improvements so we as staff are the facilitators of that uh we we're the we're the legs that make it happen but they're really the the brainchild of where what and and how so um if anyone has any ideas or or thoughts or suggestions you know reaching out to that Lake nasor Thea group as well as the city and we can talk about that and really prioritize it um just for reference once we get done with this phase two and all of our matches and and everything of that original $6 million we're still going to have about 4 million left over um so five boat ramps three motorized launches a pier um some vegetation removal and we still have you know $4 million left over to do some some big improvements with so we're talking with the HOA on what are those improvements moving forward we're talking about some beach enhancements and stuff like that so I think there's some some more opportunities that are definitely going to be coming down in the future on this perfect I don't know how about a water park you mentioned accommodations for Ada I wondered if if you could describe what's done at each one of these facilities and they look fantastic I'd

[0:55:32] just like to know what how this fits in with the the plan so I mean obviously there's going to be dedicated Ada or accessible parking spots um Pathways you know concrete Pathways that are easy to navigate easy to come down um you know one of the things with Ada that we found you know working with Teresa and her group is compliance is one thing but use ility is a whole different idea and so we as staff are taking more of the usability approach while still being compliant with this so I want everyone to know that when we put a sidewalk it's not just going to be a straight sidewalk we're going to make it usable we're going to make it um where it's it's not a burden um for those individuals to use it we want we want that amenity um to be the value that it that it absolutely is in these areas so all of our docks will be accessible they'll have the handrails they'll have the the guards um to keep you from just rolling off and and falling out out into the lake so um all of those things will be ADA Compliant in these designs it's not only one of the requirements of the grant but it's also a priority for us as a city to make that happen too you expect any full-time employees added not at this time again that that vegetation removal has really been the biggest um thing for us we're working with that in in existing staff there may come a time though if we get a lot of push from the HOA or we have something that we told that as long as we track that that you know this this money can accommodate an employee um the peer has obviously you know used a little bit of our resources because we took over that additional amenity and and take care of it it requires cleaning and scrubbing and and trash removal and some of that stuff as well but we're trying not to we want to we want to put this money into Capital we don't necessarily want to put it into an going overhead expense but at the same time there is value in having the manpower to keep this investment nice keep these amenities clean and keep

[0:57:34] these areas um Pleasant for not only our citizens but the visitors that come to the lake to St Angelo as well thank you Karen you have no okay continue uh that is that is pretty much it so what I'm doing is is I'm asking for council's approval to go ahead and approve task order number five with Freez and Nichols um to get the design started um again utilizing that tpwd grant money so Our obligation from the city will be 625 the Grant's going to pay the other 180ish th000 um for $250,000 design um and with your approval we'll get started on that do I have a motion for approval move to approve move approved by Lucy second by Tommy public comment we all approve no public comment we'll take a vote all those in favor say I I motion passes 5 you know what's going to be the neatest thing mayor is when we do the uh grand opening of of the nonmotorized launches with all the council out there launching their paddle boards and and Patrick will be leading the charge and we'll be all right behind him on our paddle boards I will be standing on the on the bank cheering y'all on I'll join you on that bank yeah thank you'all very much thank you thanks Patrick all right item C is consider approving tiers board recommendation of five projects totaling 27457 for incentives under the north TI incentive program and Aaron you are on good morning mayor city council Aaron Venoy plan director of Planning Development Services this morning uh we have a uh recommendation from the ti board for projects on the North and the South today we're going to go over the north first and so you see here just on this slide here there's uh this grid that shows the properties and you notice there at the top uh 2830 North chadburn and they have three Suites which are three separate buildings a b and c and they are under the same ownership and they did make a

[0:59:37] request for each one and then you see the next two at 1602 North chadburn and 16004 North chadburn separate addresses same owner um but U two different requests there the total request uh for the amount of funding was 274,000 which out of the 2.3 brings that down to 2.1 so let's dig a little bit deeper uh with these so the first project um at the property at 28:30 there's a u Stone building there been there for many many years on the corner um of north chadburn um and 28th um it's a signal intersection they need to do facade reprove Improvement and they need to do Roofing that building has become unusable based on some sagging in the roof they want to get the building back onto the market uh as a leas property um you can see here this uh building there it's been there for many many years I don't exactly know how many but I think around the 30s or 40s is when it was built um you can see it does have that typical Stone um construction that we see in a lot of our buildings around town but over the years it is it is really kind of uh gone downhill so you see on the right side they're planning on doing a metal R panel facade to improve the roof and some of those areas that are not covered by the stone the board did talk about this area right here about trying to prevent um the metal from covering the stone and the applicants were um am minable to that so they're looking at that of just making it to where it's just uh where those window areas used to be I think I have a another uh side of it this this is looking at it from uh South looking North this is where the parking lot is and of course they would be um redoing that siding that's there now continuing with the the opening there and the siding up and

[1:01:39] around so that property did request a 75,000 for that structure the PE board did approve or recommend that 75,000 for that structure so let's move to the next two structures on the same lot uh again and I should have and maybe I missed that I apologize the total project for that first structure is 181,000 and their request was 75,000 apologize for that so let's go to Sweet be so this project uh for rehabbing Suite B again mostly facade Improvement and window installation they will have some rehab of the inside but usually that's not what tiar covers that's what those some extra dollars there are are part of their project overall but the ti funding request is 75,000 again some for some structural elements uh in the roof the window redoing as well as the facade so here you see this used to be kind of a garage on the bottom and an apartment uh structure on the top they plan to reuse this as an office it could be leased out to someone or it could be someone that uses one of the other two um buildings on the property and this would be their main office and they would office out how is it that it's all the same address because they're separate buildings is it because it's ploted as one big lot it is one large lot but addressing um address them separately really a kind of a fire code requirement because they are separate structures so they have different Suites there are times in our history that we have done different addresses as opposed to different site numbers or site letters uh in this case it just happened to be sweet letters so sweet a b and c uh as opposed to a separate address on chadburn or on the side street the north the East West Street because I understand the sweet thing when you have just the when they're all attached but when they're detached it's interesting

[1:03:44] to use the sweet concept correct and for whatever our reasons were at the time we made that decision uh that's that's how it got addressed uh and it's very difficult not that it's imposs possible but it's very difficult to go back and change them to say you need to change your address um according to the Tom Green County tax would you like to talk Larry yes ma'am okay this is taxed as one entity all three of them fall under the same tax appraisal that is corre which is obviously why they're doing this I'm just saying historically that's not what you do it's it's the way it is so it is the way it is but seeing it be detached just raises the question it's no I'm not not challenging it just asking the question correct and that's their intent is to lease them out individually it could be somebody that leases two buildings it could be somebody that leases just one building separately the property ownership would stay the same as the property owner owns the entire lot and all the buildings it would just be leasing them out to different owner or different leases uh for different activities on that lot it is a cgc lot um or maybe it's a General commercial lot and so there's a number of activities that could happen on that lot you know the look again you've described what tiers can and cannot pay for I think there's no question that the improvements and the plan here is going to make a big difference on in that location and the look of those uh facilities question mark is and this is not your job or TI's job job or our job is what happens next because it looks like there's tremendous amount of expense and dollars that will need to be spent to finish out these buildings but it always makes a big difference when you can improve the exterior and solidify the stability of

[1:05:48] those B those buildings yes mayor and I think that's their intent to actually go in do the the remodel the r Renovations so that they are useful buildings it's not just a facade treatment that's why you see that their their projected cost for the projects are much higher than what they're requesting so here would be the backside of that property um they are maintaining the windows which I think is a good idea um and I do actually um these are older structures but again they're going to have uh some looking at those those properties uh right there so that's sweet be here is Sweet Sea again a um project that's 158,000 projected cost 75,000 requested from te again some facade Improvement and replace some of the wooden supports and the R panel and the roof and again you'll see this large building um sits at the back been there for many many years but there's a lot of the um trusses that are starting to Sag and they need to go in and replace those to keep the building up as well as doing a full uh skin and and steing um revision it currently has a Le of a mechanic shop right now they intend to keep that uh LEC and moving forward they don't use the other two buildings at this time um this is a very large uh structure you can see that it comes out on 28th there um but they've have upgraded some things over the years of electrical service and things trying to keep these buildings viable and then I think with a facade Improvement that helps them in any types of interior renov ations they do will keep them uh moving forward as productive uh properties in our in our North tiers it's a major project that exciting that they've taken it on yes Larry would you like to make a comment I I think everybody that's drove in that area seen that building and just wants to do something to help it out I mean it's it's ugly okay yeah uh my concern those and I don't know the

[1:07:53] premise of uh the tiar in terms of uh I thought it was inclined towards facade improvements uh those other two buildings they're they're off the road as far as I know we weren't provided a map but in my mind if we're going to spend tear money for the appearance of buildings I'm not particularly concerned about those two back buildings being done unless unless it does uh promote a better appearance of that drive down chadburn am I wrong I believe it would and I I should have added an overhead map that would give you a little more orientation now this of course is uh 28th Street you can see the side of that and you can just see over here the other smaller structure that has the uh apartment above let me go back to here this whole front facade that's the parking lot that you can see from chadburn so that back building the furthest one back if you will to the east is a you can see it very prominently um this one coming you can see the blue back there so yes ma'am uh right in right in here for those that are kind of tuning in and again this is on uh 28th go back one forward one more on 28th and if you're coming if you're heading southbound you're able to see this structure on chadburn if you're heading Northbound probably through the parking lot unless there's lots of stuff in the parking lot you can see that structure and then of course this front one is very prominent as you're coming down with this being chadburn here and of course you can just see the the other one in the back my circle's terrible um Larry it also just as we've gotten more and more tiar applications as the process works as it should you'll see some that when they're redoing their property while they're and it may be in the downtown area where the front facade is important some of them are improving that back facade too which becomes just as important from a safety standpoint so

[1:09:57] as those improve as I might be walking you know in those areas it it it helps improve that whole character so you'll see a little more of that that Spurs off even that covers some of those areas just right off of the main roadway as well well nor the chadburn is definitely a high-rack street and I think um we have many people who travel North and South um on that uh street so I think this is a pretty big area and I think the Improvement facade Improvement can make a nice Improvement to the neighborhood if you will and that someone's willing to take it on is a major project I think is exciting and Lucy it was Karen Karen I don't know Karen did you it's it's Petty because the whole idea is great that there that there's action positive action on the North side but I'm looking at this image and I'm noticing that the most significant architectural feature on this building is the front facade correct and it's improved quote improved version it's been eliminated that stepped roof line or facade not roof line well this is where the ti board uh did make the recommendation that they would not cover that rock up there that they would only utilize the metal over the window areas and maintain that same Rock area with the steps that goes up so the sketch is is what presented what was approved correct yeah it was kind of when he described it earlier that didn't go into the detail but he talked about that rock so you're right he did I just just you're right some confirmation because the sketch is wrong it's handsome you know it's handsome and it's and it it will be noticeable especially once the improvements are made yes ma'am so Lucy I have a comment to make uh Ain what is this building supposed to I mean like what is supposed to be used for well this front building as I understand

[1:12:01] it used to be a bar or club or something like that entertainment uh they have not stated a purpose at this time of what they're going to redo it as when they go to apply for building permits we will learn more because that's when an occupancy is set um it is a fairly good siiz structure um so I'm not sure if it's going to be a venue or or something like that uh they did mention that the two back properties um they do hope to either lease this one out as an office whether it's somebody that wants to just do an office space there or an office space for one of the two adjacent structures and they hope to maintain um the lease for the mechanic shop there in the back since it is a big large structure and they can pull their vehicles in again I'm I'm like the mayor I'm very grateful that somebody's taking on these buildings in the north side and any kind of improvement that we can do weather is going to benefit our overall view when people come down to the north side so I definitely like up to the north side go up okay up and down or down Aon yes go ahead um I noticed that one slide on sweet a there's a really huge stoop right in the front I wondered what accommodations they're making for Ada on that because it doesn't appear as a really I can't even see if it's a sidewalk on the existing structure then there's that looks like 6 to 8 in stoop that certainly impede people with disabilities uh I'd like to know if if all of these have been evaluated for accessibility because that seems critical especially even on the facade aspect of tiers that that should be done do you have a feel for that well certainly we discussed that a little bit um as staff um because there are times that we make recommendations to the

[1:14:03] board that some of those dollars should go to redoing sidewalks accessibility in that area these structures actually needed a significant amount of investment to that and talking with the applicants There's an opportunity for them to come back in the future and resolve those things as they move forward with a building permit they will have to register with the state of Texas to look at accessibility type things I do feel comfortable that that stoop will have to be accessible if they're using that as an entrance exit which they probably will be as well as the one over here on 28th Street they will have to do that as well they will have to make those those um adjustments and talking to the property owners they're aware of those things and are planning for those things in their their project so this is primarily facade Improvement this is facade Improvement at this time yes no building permit not yet yeah further questions or comments this is kind of the feasibility do they have some funding to kick in with what their funding is to help make the full project happen I will I'll make a motion to approve is presented with their questions just hold on one minute so this is just one one property and we're going to approve the whole item as a whole so we need to go through the rest of the properties right before we do a motion yeah we're not through here that's okay we have more to do that's good okay so we do have two more uh addresses uh this is 162 North chadburn um on the North side as you know uh if it's under $25,000 funding request it is a they do not have to make any kind of match they do have a project that's right at 24, 857 their funding request is the same amount they want to Brick some existing pill ERS um and windows and replace the front door and pave the parking lot they've had some vandalism over the years they have a property that's very close to their uh property line and ride

[1:16:05] of way and where their parking is and so they've had people you have the picture there I do that would be good um so this is a structure that's been there for U since the 50s um on north chadburn um they have had some vandalism they have a successful program they actually cater to uh females at this program to teach them um self- protection uh and so they had a great presentation in front of tear but you can see the red uh post there they plan to Brick those in they plan to Brick in some of the uh exterior windows so that it's less visible people that are walking by are are kind of stopping by and lingering and so they're trying to uh help keep the activities a little more private that's that are happening in there repair some of the windows and just have a nice facade they are going to resurface uh the parking lot and uh we did talk with them about making sure that they're able to have an ADA ramp to get up into the doorway and so they're they're aware of those requirements as well generally speaking we have always we have said in the past that if someone's asking for a parking lot Improvement there has to be landscape improvement with it so you're talking about the parking lot Improvement what's the landscape improvements that's a good question mayor we did not um disc discuss that and that's my fault uh for not bringing that up um I think there's an opportunity to discuss that with them again um and talk with them to see if there's something we can do here maybe at this end and this end there is a significant amount of concrete there but if we can break that up with some Landscaping uh I'll make sure and mention that to them that we would look at um to have that happen as well because that's been their standard we don't do parking lots unless we have landscape okay so we just want to make sure that that that's addressed yes ma'am the next one is next door at 1604 North chadburn again a funding request under the 25,000 threshold this one deals with signage exterior paint and

[1:18:07] some facade Improvement and there image we couldn't ever get it to to work really well but you can see that they have it have it painted they're going to actually paint it a different color to lighten it up a little bit they're going to put a nice lighted sign up there that says that reup it's kind of a more of a I don't know if it's a retro sign if you will but it is a lighted sign that will go up there um and they're just trying to actually bring in kind of a rock uh facade across here as a Wayne scating um to try to dress the building up it isn't a com um a companion business to the MMA facility this has got uh kind of you know your your shakes and smoothies and things like that kind of a nutrition store and so their clients come over uh to that store as well we've also had typically a standard that tier funds would not be used for signage okay so I'm questioning that because that's been again a policy that we've used as we don't pay for the signage and we've just been going off the policies that we have on the books and it clearly states that signage is a lower priority but with a project that's en encompassing it can also help pay for the signage um we also felt very comfortable this being in and on the north side of of the north tiers that there's the funding available and the request was relatively small and I agree with all of that but when you make one exception then you open the door for more exceptions and we had in the past always said that if one couldn't afford to do their own sign sign for their business that that was concerning I'm not objecting I just want to make sure we you know we understand where that's at the discretion of the council we go by the guidelines of what the policy allows it allows so they made the application so you can take it from there yes ma'am any other questions on either of those two addresses Larry would like to

[1:20:10] add something could you flip back to that photo I mean that's a very nice series of steps in there but uh they're going to have a problem making it accessible yes because any kind of a platform is going to start bumping up into pass those uh curb stops and then the door itself looks like a very narrow door uh which again could cause more problems on trying to get a wheelchair or a walker through there so I I don't it's a challenge so all of those type things are addressed if they do permitting for changes you know in this particular case we don't have a policy that says you have to address you know your entrance first you know when they apply they can apply for what in this case they're applying for change of color change of facade but those are things that if they trigger a review from a permitting standpoint then we will enforce those but our policy right now does not say you have to address that first so you know they can apply for a variety of things I just hate to see these things forgotten I really do and we've seen it with with other tiar money is spent where there was no fix on on some of the problems associated with that I I I think I could take you to one today that uh I even went in and asked the management if they were going to make any changes on it because it was not accessible just flat wasn't what is the level of of change as far as construction goes that typically triggers those reviews it's from the state $50,000 project that triggers the Texas state to look at their accessibility in fact the city doesn't have that ability to look at the accessibility unless it hits that threshold and they must register with the state for a construction project ,000 yes ma'am so if you're spending 49,000 you're not required correct under the state guidelines you're not required to register your construction project with the state for accessibility

[1:22:12] review interesting I would say we need to fix that I think it's called the state there are other issues probably I'm sure we could try to fix with the state about locally locally if we allow this to happen then hey throw Ada uh instructions out the door I mean go ahead Teresa you're on well we have tried to fix it in part by giving priority to projects that do have Ada improvements but the purpose of teers is not an ADA program it is a more of an aesthetic bringing the um appearance of the neighborhood and the community up so we can always look at ways and I think we have done a really good job of looking at ways to put Ada on the Forefront of our decisions and I think you saw that today in Patrick's um presentation but this program in and of itself that's not specifically what it's created for but it is something that we do consider and give priority to when it does come up so you're telling me that once this project is done nothing needs to be corrected on that steps or door is that correct if it doesn't trigger a change of occupancy under the building code uh where the building officials and their team start looking at it to see what's going on if the occupancy changes there's a potential there or if they were to do a building permit project that hit over that $50,000 threshold they would have to evaluate the restroom accessibility as well as entrances and exits and that's that's the standard in the state of Texas currently and it really has to do with whether or not we have teeth and we just don't have teeth until it hits those those levels further questions or comments sad it is sad I so that's that's a challenge for some of our small businesses um they do come in regularly through our pre-development meetings and they they are looking to how can we get into a space but what does it trigger when they go and do those Renovations you do a certain

[1:24:14] amount of Renovations it may trigger you to have to redo that restroom which takes up then maybe dining room or maybe storage or something of that nature and so there's there's always that discussion with development staff our we always want to see facilities that have Ada accessibility within their restrooms but we also are bound by our codes and our ordinances and what the state says we can do so all right so there's was an attempt to put a motion on the floor a minute ago but I think we're ready for that now so who was in charge of that you have one more question yeah and I just wanted to see this number that he just put up the 20 well this is yeah new number yeah this is what it's going to be at the end of that we if we approve it okay yeah yeah I made a motion to approve as presented okay and Karen I think was going to second that so is there public comment seeing none we'll take a vote all those in favor of approving item C say I I um is that a 41 yes it's a 41 vote I voted I no you you are yes okay so it's a five zero okay sorry I thought I saw that head going the other way item D consider approving tier board recommendations of nine projects totaling 376,162 for incentives under the South tier incentive program Aaron you continue thank you mayor city council again Aaron Venoy director of Planning Development Services you see we have a number of projects here and I do just want to take a moment to say our Downtown St Angelo partnership with going out into our community and and helping folks understand the projects and and what can be done through tiers has really helped you saw the applications on the North you see we have a nice good uh this is our second round on the south and a lot of applicants uh and they're really being realistic of what they can accomplish

[1:26:17] within a two-year time frame um so saying that that's important to say because there are some projects that have been funded and you're going on year three that aren't complete and we need to make sure we're holding to that rule yes ma'am and we we've been doing an audit on that and going back and talking with project owners do you need an extension do you not if so take that to the board uh and get an extension it pro uh approved if not those dollars need to go back in and get reallocated back out to the community so here we have these addresses 109 South chadburn 230 North chadburn 208 South Oaks 76 nor Chad chadburn 109 North chadburn 63 North chadburn 333 Rio cono Drive 223 South Abe and 136 East Concho they are listed in this order intentionally uh this was how they ranked out on the south in case the funding requests became U so excessive that we didn't have enough funds and we needed to have a ranking but we just wanted to make sure that you guys know what they're they were ranked at and so as you go from the top being the the the highest rank down to the bottom uh is where where the rankings were the ti board did recommend full funding as they did have uh funding available um the total request was 376,000 out of a budget um of 622 and that left them if this gets approved it will leave them with $246,500 for the remaining of the year so now we'll go into each project real quickly again on the South Side you do have to have that 25% match and so you can see the funding request the applicants match and the total project cost of 115,000 this is going to be for ASB bestus and secondary egress and some facade Improvement each one of those things are high priorities on our our list and so they if you remember this Pro this property uh from the front they did have a project down here on the

[1:28:18] first floor that they received some funding for a sprinkler system now they're ready to move to the second floor create some Lofts what that is requiring is over on this area over here I believe it is as to create a secondary egress from the second floor down to the front so that they can get out um as well as redoing that facade back to more of the original look uh being down in the historic district uh and dhrc did approve this um and so this project uh looks to move forward again with the asbest abatement the facade Improvement and the secondary EG you want to talk about the sign they have no request for the sign um as far as funding it did get approved through dhrc in that manner they already have the sign and a um encroachment agreement uh when uh the uh project on chadburn was done uh when they did the full facades uh or the full uh streetscape and and things they are just changing it over to where they actually just have the address good so 230 North chadburn um again we have the funding request of 48,000 um their total project is 66,000 and their applicant match is 18,800 um exterior repair paint awning Brick Repair fire sprinkler and mural so they're getting a lot out of this because they don't have to do a whole lot of work um but this is a building over here um on the the 200 block of North chadburn this corner building they're wanting to come back and restore this awning um that's that's been original to the building they want to take off this is the one that you've seen that it has actually kind of a painted facade the painted brick facade if you actually go up to it it's actually painted brick not real brick but they want to be able to take that off and expose the real brick and then on this side over here they're going to do the same thing it has some cement

[1:30:20] board along this area that's blue they're going to be removing that and to expose the the Brick and then up here they're going to add a mural um is that the mural I want to say yes I'm trying to remember the dhrc approval if that was the mural or not of course dhrc doesn't approve what it the mural looks like they approve the the location in our historic district this is a historic district property and so they can't really say yes or no to what the mural looks like they can do colors and location so and I'm asking this because I don't know um so does the public art commission then approve the art or is it they don't in this case because it's actually on private property okay um and so if it happened to be in our right of way or in a public setting and while I know we drive down chadburn and we see this as a public it's really on private property that spot where they're putting it is already a stucked part it's it's not like they're covering up brick to do that correct it is a stucked area that they're afraid if they tried to remove that stucko area it could damage the brick and so they're trying to change it just a little bit so and the side street is what that is I believe third I believe that's third or is it second I'm not positive I'm not 100% sure but I think it's third I could be wrong Larry did you have a comment oh it sounds like the mural uh they may not have any particular I don't know desire that this particular one be there it's just covering up an area that is already stuccoed that they need to do something with so there may be some conversation concerning what goes on the mural or they may be amenable to other suggestions I just think with that they have a picture with that mural on it that the intent would be that that would

[1:32:23] be the mural or otherwise would you leave it blank and then say we're going to design some art for there I'm just curious if they're hard over on that particular mural I think they are in tending a western type theme as you can tell the building has that flare to it on the front as well and so that is their intent at this point could it alter some yes but I think it's going to stick with a western theme okay further question comment yes would would you mind if I get the a phone number for the the folks there because I do have a suggestion for them to consider on a a that F Parker how'd you guess ma'am yes I I don't know how to do that and I certainly don't want to go beyond the limits of my established duties but uh we're talking about the Centennial anniversary of Fes Parker's birth who was a citizen of St Angelo we've got Willie Nelson down there that I'm sure he passed through St Angelo but he he wasn't one of us so I I'm just throwing that out yes sir we we can discuss later but let's move to 208 South Oaks um a project here and again this one was not as high as some of the other things although we think the the restoration of some of these things on there now of course we listed signage first but signage replace Windows installation of awning and Frames um this is a building that's had different things in it and I think this is going to be something that will help Revitalize it bring it back as a productive building in our downtown um the full project cost was 13,000 the funding request is 99,900 with an applicant match of 3,300 so here you can see it um close to cely Flats um what they're wanting to do is basically come back in and this is

[1:34:29] the one on the left is without the sign this is with the sign with the awnings that will be fabric I believe um and talking with the tear board they were supportive of getting this building back to doing some facade things keeping it still uh as original as it as it can be and continue to to get something that the occupant can operate with I think we look forward to having now that pizza back again is very popular before so now 76 north chadburn um this is a two-story structure here um crossed from the the um coast of DC um facility they are looking for a fire sprinkler so the first floor is occupied by business the second floor is three short-term rentals and for them to get their occupancy uh correct and to allow those short-term rals at the top they need a fire sprinkler for the separation we know that's one of our high areas uh in our TI board um funding request so they're funding uh the total project is 49,900 the funding request is uh 37,000 and the applicant match is 12,000 and so it is simply for a fire sprinkler for that structure oh wait wait one second Lucy has a question Erin I wanted to go back to the one right before we were talking about signage now I know we said that we weren't supposed to pay for it so and I know that on the North side there was enough money and that's why we were approving that one but now on the South Side would we still go ahead and approve according to our policies it's an allowable thing it doesn't rank as high as other items again bringing back a tax base that's an operating business is also a high priority for us uh through the tiar funds and making that a building that's still being used and being productive in that in that part of town is important now it does come to you guys with that recommendation with tears but you guys have the ability say

[1:36:31] okay we we won't pay for the sign we'll pay for the other things but not the sign well the only reason I was bringing that up was for the mere fact that the Southside does not have that much money to be paying for the signage that other people might want their signs as well and they go no you know we can't so that's why I was bringing this up is because I didn't know if we would go ahead and approve the signage when there's not that much money on the South Side that's the reason I was asking about um clarification about signage before because it has been an ongoing conversation um generally speaking the South doesn't have a lot of money in this case you're looking at um money still left over um based off of the request you had the availability money but I think we need to be real make sure we understand the policy as it relates to signage because that has been a big conversation over the years with tear it's been a major issue and I think Lucy's question and comment is valid um but mayor yes if it's helpful I can read the portion of the policy that addresses the signage sure it says that signage can be funded as part of a broader aesthetic Improvement but generally will not be funded as a standalone project with the exception of repair and revitalization of historic signage in the downtown so the basically it says that if the only thing you're asking for funding for is the signage we wouldn't approve it but if the signage is a part of the overall facade Improvement project Improvement it could be considered as that what you're saying yes ma'am yes Larry i' also as the mayor said before Landscaping is part of the concept in mind here and uh it's obviously are showing two dead palm trees there is there anything built into their um plan to there's nothing in their submission to tear that indicated they would do

[1:38:35] landscaping um I know the applicants here today and maybe in public comment that may be a question you have for them um but there's nothing built into their plan that would require the Landscaping in the right way I know the applicant who's pretty anal about most things so my assumption is he doesn't want to dead Palms outside the business when he opens but that's just a comment any other questions continue do anybody have further questions on 76 North chadburn okay okay so this is 109 North chadburn um it's called cono venue they've been working on getting to a venue space um the way to get more space in their venue is to have a fire sprinkler system so that they can utilize more of the space which means more occupants uh so they've come forward with a request uh the cost is 87,000 the funding request is 65,000 with their match being 21,000 this is just um again on 109 North chadburn questions comments okay move on 63 North chadburn this is going to be a facade Improvement to the rear of the building they're doing some things back here to fill in the block and stucco and some rain gutters the part of this request is also generated by a review a development review when they did their occupancy for the building they needed a rear egress while they have a door back there this is going to help make it safer so that the people that have to exit that way can get a little bit um a little further away and it's going to actually add some some protection with the block fill and stucco and the rain gutters and things as if somebody has to get out that way for eer Mercy egress I've never seen where we pay for rain gutters before but so the proposed project costs are 10,000 the funding request is 7600 and the applicant match is

[1:40:37] 2500 and so you can see here this is the back of their other companion building they're looking to bring all of this area up to match uh with that their property line ends right there at the end of that building and then this is an area uh that has egress back this way um in case there is a a fire based on that being uh the occupany use of an assembly um you can see this is the this side of the building is right there where they've got some uh stuff that they're really just trying to make it All Uniform make it match make it look a little bit better you can see it from Gillis Street uh it is a lowcost project that that could help continue to seal and and protect that building as far as the facade and the brick what's a building being used for now it is a yoga studio currently and a fitness facility it does have a first floor and a basement that they utilize there it does have a sprinkler system and the challenge is they only have one front door and it's not a very wide building it's very narrow and to have a secondary egress that's remote they have to use the back door any questions on that before I move forward question questions comments go ahead okay so 333 Rio Concho Drive uh one of our hotels along the river uh they are uh asking for installation of automatic sliding doors and replacement of glass um this will help with some of their ADA compliance coming into compliance of going with egress um their total cost is 40,000 their funding request is 30,000 and the applicant match is 10,000 and so they have these pull handle doors now in three different areas and they are looking for automatic doors and automatic door openers for those areas that way you're not having to to go up there pull the handle you can press the button they're going to Auto automatically

[1:42:39] open okay 2223 223 South Abe excuse me there um this is again an ADA project that has accessible ramps and rails to get into one Suite of their building it is a large building this is for you Larry yeah Larry took me a while Larry but I got there uh total project request is 40,000 funding request is 30,000 and the applicants portion is 10,000 uh this is a medical office over here this is AB street that you can see the bus and the car on they do have a temporary structure right there but this is actually text out right away and so they are needing to come into compli Cent so that they can build a ramp there to get up into their building safely and then they're also going to build ramping from their parking lot over to that area so that they can get in there safely um again one of the higher priorities for the tii board which was a new policy set I believe maybe last year in 2023 for the Ada accessibility and then 136 East koncho Avenue um this is a playground equipment and safety surfaces for a business that is the autism uh Center um the project cost 95,000 almost 96,000 their funding request is roughly 90 or 72,000 with their applicant match of 24,000 we did Mo uh mention out of our 14 project criterias um it only met two um while we think it's a very viable uh interesting project and will make that specific business better and it's needed for them we still made the recommendation to tear board they did recommend funding it at the full amount so what they're planning on doing you can see just barely there's a carport back here at the back of their building they're wanting to convert it to a playground for their um for their autism uh facility that will have a new Surface

[1:44:43] at the bottom will'll have screening and then as well as the playground and a shade structure where do you drive into that M because right now you know you turn in to that is this playground going to I mean are you turning into the playground when you get into the parking lot no you the the playground is way back here at the at the back you have all of this parking over here that the the uh staff comes and parks at there's actually another parking lot on the other side this just happens to be back at the back on a kichi area that they're going to improve that surface got it I apologize didn't realize I also had that image still in there that was a little closer yeah so those are the nine projects you can see the funding request it totals 376,000 out of the 622 and again that would uh leave the South TI fund still remaining until the next cycle of 246,000 um which usually we have enough requests this is our second round of requests for the South um that we normally exhaust our funds for the South this year we had a very good um U tax uh allocation um The South was very high this year at 1.2 million which is much higher than in the past where it's been around 7 700 to 800,000 and so you can see that's made a big impact I think that goes back to the projects and the forth thought of folks that saying this needs to be improved and so those tax dollars are continuing to be used to improve that area and raise the tax profile of the area I'm going to open it up one more time for any questions on any of these projects from councel before I ask for a motion or if you would like to have before a motion anyone in the audience who one of these projects is there if you'd like them to come forward now would be the time to go ahead and do that if you want

[1:46:46] so Council it's up to you um Tommy says no Larry Karen Lucy then may I have a motion for approval so move by Tommy second by Larry I'm sure I'm because we got one of his projects in there so yeah all right was that it's a coer yes it was sorry um public comment concerning these projects Stango when are you going to be opening thank you if you you want to come forward and speak instead of speaking from the audience would be great and I will add again we've missed your pizza parlor when you had it on chadburn so we're excited thank you uh we're trying to get it going again a couple of my uh employees I had before I'm making them Partners uh I think it's better for everybody you know to have a little piece of it uh and everything you're doing here uh trying to help us is really really nice okay because it's hard uh for small businesses to start get the money uh it just helps a lot okay thank you for your we all the help we can get okay thank you for your investment downtown thank you any other public comment anyone like to come forward and offer comment okay see I have a question for Erin well of course because I almost took a vote I know yeah Erin okay it's almost going to sound hypocritical I apologize for it based on the noise I've made about ADA but I don't understand why we're buying playground equipment in that area if teers are supposed to

[1:48:50] basically be doing facade work and so on why are we providing essentially Capital to a a company that's a very good question that's why City staff did not think it ranked very high on the tiers um if you look at our policies it doesn't rank very high uh it really is just an amenity for that building now while it may make that building more valuable in the future but it's still just a playground for them it's not a public amenity that's why our recommendation was very very low to the tear board the tear board did have some discussion but they did decide to go ahead and recommend it for the full funding amount youall have the discretion here to change that funding amount or say no to the funding amount I could agree to the fencing that's fine that provides you know uh Improvement to the face of the facility but I just uh can't agree with playground equipment I understand I don't know if we need to um with that because we already have a motion on the floor and it was for the full approval I mean I think the challenge in terms of yeah it's low in terms of priorities but yet it was the second highest in terms of dollars so the lowest priority got the second amount of dollars and so I'm not sure that all equates correctly but we do have a motion on the floor for the full amount and we have a second and we've had public comment so I'm not sure at this point in time if you're objecting to that if we need to uh um what do we need to do you need to take a vote on the motion that's on the floor or if Tommy wants to amend his motion he could do that as well my motion stand Tommy's motion stand my motion stands okay so you need to take a motion a vote on what's on the floor all right so what we're going to do is vote on the motion which is to f full fund the

[1:50:54] 376,162 and it's amazing what we end up approving when we have dollars and what wouldn't get approved if dollars were restricted but with that uh we're taking a vote all those in favor say I I motion passes 40 5 Z oh five can't count I did I was going that as a no but I think that is a a statement that we at city council uh want to make and that is whenever we have funding we get loose with our money and you need to save it you need to save it comes in that's more valuable whatever and so I think we as a council want to make sure we've made that statement um if there's funding we can't just be loose with the purse we need to make sure because once you say yes to one you open the door to saying yes to other like projects and you set a standard and I think we're concerned about that yes ma'am mayor yes could I Ambush Aaron with a question right quick eron there were just 14 projects we talked about uh did any of those projects come through with the assistance of our DSA every one of them just a just a comment DSA is taking applications for tear now Downtown St Angelo Inc thank you and we haven't had one complaint I haven't heard of any complaints about their work and uh so big thanks to them for their work well they're going out and trying to recruit Investments I think the key thing particularly is they're focusing very much so on the North side and trying to make sure that the north side is aware of the program so they're working hard at sort of spreading the word and trying to make people feel comfortable with the program and not be intimidated by the program or

[1:52:59] the fact that it's administrated by um government and so I I think I compliment you all for making the decision to let DSA head that program up and then the work that they're doing well I think it's a close working relationship between Aaron and and Monica it's good thank you yes sir if I may add to really to piggy back off of something you said that jogged a thought um we've had lots of eyes on these projects DSA number one they took the application number two it goes to tears board um so we've had a lot of eyes in on all these projects for me as one council member we have our boards and commissions for a reason and that's for them to go through the process to vet these things for us and make recommendations to us do we have to accept those recommendations all the time no do we have to accept them in full all the time no but I do for me that is something to consider so I just wanted to throw that out there we we aren't making a decision like this in a vacuum so yeah I just want to make sure again you know we've had to say no to a lot of people because we had limited funds and all of a sudden we're saying yes because we have funds and so I think we just need to make sure we understand the policy and priorities and the vote and the go towards the priorities and I think we're comfortable with our vote today I feel comfortable everybody voted but I think we want to close with that statement on that issue just because there's the money doesn't mean it should be funded necessarily and not Project Specific because it applies across the board all right moving on to item e first reading and public hearing of an ordinance annexing into the city of St Angelo by Petition of the property owner an unaddressed 22.09 96 acre track out of C berberick survey number 177 abstract number 52 and H zerbach survey number 178 abstract number 4210 Tom

[1:55:04] Green County Texas located east of Riviera Lane and Clubhouse Lane beginning at the southwest corner of this track and Southeast corner of lot three block 112 Bentwood Country Club estate section 44 find that with your GPS [Laughter] thank you mayor um city council this is an annexation um kind of in our it's kind of in a doughnut hole of our community where this is between Bentwood Country Club and then you have Butler Farms to the east which is actually in the city limits there's kind of a hole there that is not Incorporated in the city limits and then you have the Concho River to the south of Bentwood and across the Concho River is the country club area and so you see here um this is the annexation of the 22 Acres you can see enclave and Riviera and then Clubhouse Lane and so this is really their next expansion uh to the east adding a new um Road or two in there um Riviera is about 50% built out right now uh and so it's built faster than they expected and so they're going to go ahead and start the annexation process uh for this piece this is the first public hearing of that uh where we set the service plan um uh for this area as can the city provide the services to that proposed area so let's see if I have any other just lost it what did I do okay here we go well we can still here we go thank you those folks in the back Brian and lorai so again you can see Riviera is right here that that block homes are starting to be built on the road and infrastructure is all there you can see Clubhouse Lane comes across here and so starting in that area is where this plat

[1:57:09] kind of takes this is a preliminary plat from um 2020 it's still active because they have built on those lots and so it is going to be residential you'll be hearing a resoning for this project coming up soon they are looking at rs1 and creating more residential in that area um and so we did talk with all of our city services from police and fire to water utilities uh to code and animal services and to see if they're able to help service that extra 22 acres does that make an an unreasonable impact on our city services and at this time everybody does not believe so uh and the additional generation of property tax dollars back to the city is bringing that in uh should be able to cover any additional cost is what we believe at this time one thing that um City staff talked about is that between um this area from nickach to Foster to even Loop 306 over there to 277 there's not a city park is that something in the future to look at obviously maybe not with this 22 acre uh annexation but something for our future to look at in that area especially with the Concho River going through that area there's always the potential in the future to look at that with that I'll be happy to answer any questions any questions and I appreciate you bringing bringing up the fact that you have looked at uh if the uh property tax revenue potential is enough to to cover city services um that would be provided uh as a result of that so thank you for bringing that up I think that's something we need to we need to start paying closer attention to in in areas all over town thanks for telling us that is that a motion I'll make a motion to approve as presented thank you yeah go ahead I just also want to add my thanks to you for keeping the conversation
