[0:00:00] good morning everyone welcome to the April 7 2020 City Council meeting we're glad to have everyone here today and so to start with we will establish a quorum I see that we have all the City Council meeting members in present so we qualify for the quorum required so we will now move into the chaplain prayer and I'm going to have Marcel and Gary Jenkins lead us in prayer this morning thank you for offering that prayer this morning is greatly appreciated as we all need some words of encouragement today we will not be doing a pledge today is we have no flags here so a Billy do you have a question your hands up I could not hear the print I'm not the only one that could not hear the grant no none of us could hear the prayer thank you baby can you hear me now yes okay can you hear me we can't okay good morning

[0:02:14] everyone yes good morning good morning everyone and let's go into prayer father God we thank you once again for another day that you have made we thank you for your grace and your mercy your long-suffering other guys are going through such a turmoil now so I'm praying that you touch each and every one that has contracted that corner virus I ask you to heal their bodies right now in Jesus name I pray for the families that have lost loved ones that you give a piece and you comfort them right now Lord and we'd be ever mindful to praise you and worship you because you're an Almighty God I pray right now Lord as we go in to the City Council meeting Lord that you will give each one wisdom as they conduct the agenda for today Lord and Lord we ask you to continue to help us to look to you for you are a helper you are our blessings and we will remind for the praise you and worship you in Jesus name I pray amen we will not do the pledges this morning as we do not have any flags here or a flag for the screen so at this point we won't do that as for special instructions for today all members of the public council and staff should begin speaking by stating their full name and as Sindhi or address their SMD position or role within the city we're going to start this morning by reading a message from dr. bredis and it goes as follows on Sunday April 2/5 dr. Vettes and the local Health Authority issued a recommendation for everyone to wear a cloth mask when in a public place where social distancing measures are difficult to maintain this would include places like stores and pharmacies this recommendation has also been made by the CDC wearing cloth masks will limit the

[0:04:20] exposure from people who are positive with the virus and not yet showing symptoms symptoms sorry this simple measure will help keep our community healthy and protect our medical resources by reducing the number of cases in our community simple face coverings fashioned from household items or made it home from common materials at low cost are sufficient please do not use in 95 masks or masks made for medical environments directions on making masks at home can be found at the CDC website located at cdc.gov and the city of San Angela's website thank you for everything you are doing in this fight to keep our city healthy I also want to acknowledge two businesses and they would be intertel and principal LED who've purchased a hundred thousand masks that are not the n95 masks that will arrive in this city sometime the end of next week we will create a distribution system to make sure those individuals who would like a mask will have one available to them so we want to thank you again the intertel folks and the principal LED folks for bringing buying those mouths and providing free of charge to the citizens of San Angelo we will move on to public comment at this time City Council will do does public comments receive via email and the summary of these comments are as follows one request that the Council mandate facemasks are worn by anyone in public although we are not mandating and at this point in time you heard dr. Bredesen issue the need to wear masks when in public go into grocery stores pharmacies and so we ask that the citizens citizens follow these guidelines and help protect

[0:06:23] the rest of the citizens we have a question regarding whether to send a child to daycare because they are afraid of losing a daycare spot Theresa you want to talk about that issue I'm take cares are being regulated by the state of Texas and so they have some pretty strict rules in effect as to win children can come in when they cannot it's not something that we are regulating but as it's a decision for each individual parent to make whether they send their child the third one is request there'd be no increase to property taxes due to lack of work referred to we referred them to the Tom Green County appraisal district as the city has no impact on the property taxes and the last question is regarding whether quote tile guys are essential and we refer them to the city's Cova - 19 page for their questions to be answered based off of their guidelines with that that will end our public comment section of the agenda we will now move to the consent agenda and I am going to start by pulling items see I'm going to start I'm going to ask is there any other items from the consent agenda that a City Council member would like to pull other than item C with none well I will ask for a motion to approve the consent agenda with the exception of item C do I have a motion Mary Thomas single member district 3 on motion that we approve the consent agenda except for C you have a second second okay there's a second by Lucy obviously we will not have public comment at this point so all in favor say aye aye not opposed the motion passes 7-0 we will go to item C in the consent agenda and it is consider approving the task order with Freese and

[0:08:28] Nichols incorporated under RFQ es - oh six - one nine for professional services in the United 163 thousand six hundred seventy three but the design of work at Lake Nazareth including a new fishing pier boat ramp improvements and Island stabilization and authorizing the city manager to negotiate and execute all related documents the public comment on item C is as follows several years ago the taxpayers paid a firm in East Texas somewhere a hefty sum of money to create a design for the lake area other than spending the money I don't believe anything came of the plans and now council wants to spend more due to the current fire situation tax revenue will be dropping and I think the council should be a little more prudent in their spending shame do you are you on for today yes yes ma'am would you talk give us comments in regards to this item okay st. Kelton Director of Operations city of San Angelo this item was brought before the of course there was a referendum vote for the Lake Nez worthy trust funds which the trust funds were from the sale of lots residential lots around lighten as we're at the end so that's where these funds accumulated from and that these are the funds that will be spent for this project the what we're doing with Freesat Nichols with engineering on this is actual engineering services there's we're not studying we're not looking at anything other than they are designing for the pier they are going to be going out and actually physically inspecting the the boat ramps and giving us recommendation what repairs are necessary and how that's going to look and also on the vegetation control as well when we're looking at the vegetation on those islands and also the bank stabilization

[0:10:30] be giving us recommendations and also working through the first phase of this working through all of the federal and state agencies that have some controlling interests in the waters of the lake since those are waters of the US and we will work through those with with Freese and Nichols and and also the whether it's the Corps of Engineers Texas Parks and Wildlife those those type of people to to ensure the anything that we do in the lake will be done under the correct permits and making sure that we're not disturbing disturbing item the citizen was referring to was a master plan that was developed for Lake nas worthy and that master plan was conceptual it had no engineering items within that study if I'm not mistaken that is correct that what that was a master plan for the entire Lake area and some of these component the fishing piers component of it so these are some of the things that were identified in that master original master plan but we're working starting to work towards now with the funds that were given or voted on by the citizens for this work to begin all right Thank You Shane do I have any other comments or questions for Shane in regards to this item with nan do I have a motion for approval of item C this time Hebert single-member district one I move approval of item C second by Tom Thompson and and we obviously have the public comment at this point so we will take a vote all in favor of approving item C please say aye with none opposed motion passes 7-0 that concludes the consent agenda for today's meeting certainly the regular agenda and the first item a

[0:12:34] public hearing and second reading of an ordinance amending chapter 10 traffic control article 10 point O 3 operation of Street Motor Vehicles division for specific street regulations section 10 point a 3.0 9 v oversize loads and today we have Patrick Frey here to present good morning mayor and council give me a second while I share my screen here for the presentation can everyone hear Patrick yes thank you all right I'm excited to be the first presenter in this new format so if anything if you need me to stop or slow down or anything please let me know as we go through this this item before you this morning is an amendment to an ordinance that shall passed originally in November 7th of 2017 what this does is it restricts certain vehicles and certain loads from the roadway along Central High School or Cato Street right there as you know that's a busy portion of the road and we've had with the influx of the windmill expansion when wind turbine expansion we saw a lot of traffic coming down that roadway and so we needed a way to monitor that roadway and restrict those loads from come through there during peak traffic times so as you should be able to see there on your screen the red highlighted box is Cato Street and that's the portion of the road that's currently restricted what this amendment does is it's changing the width restriction as well as changing those restricted times or certain loads that come through there so basically a quick summary of the changes to the ordinance the load width restriction is

[0:14:38] being changed from currently it's set at a 12 foot wide maximum we're increasing that maximum to thirteen point six feet wide this is by recommendation of textile who issues those overweight and oversized permits they they recommended that we increase to this thirteen and a half wide width restriction as well as we're changing the prohibited times currently the ordinance reads from 7:00 a.m. to 9:00 p.m. and 3:00 p.m. to 6:00 p.m. the new ordinance of that's up for approval this morning well take those times and change them from those loads cannot access that roadway from seven o'clock a.m. to 9:00 a.m. from 11:30 a.m. to 1:00 p.m. and from 3:30 p.m. to 6:00 p.m. so basically those are the peak times for Central High School's so when those students are coming to school when those students are leaving for lunch and then when they're exiting to at the end of the day as well as during that noon hour for any business traffic that may access that road as they come and go that is the entirety of that presentation it's very short very sweet so I'm happy to answer any questions you may have the mayor asking you a question the first thing I want to know is how quickly will the signs to be made and be put up and how large will the sign be because that's one of the greatest things when you're coming off Houston Heart there you know looking at 65 miles per hours easily to be read and that there's no confusions confusion so talk to me about signage so currently the any type of the loads that we're restricting are permitted by text dot so it's a that permitting process involves them applying to text dot designating

[0:16:43] their width and their load there with their length and their route so text out will pre approve that route so signage isn't necessary in this in this case because that route is predetermined approved it's not a an instance where a load that wouldn't meet these four these restrictions and these requirements would unknowingly exit onto that road and travel that they would have to be a permitted load by text in order to exit here so signs wouldn't be something that's that's installed and they're currently not installed under the ordinance as it exists currently with no signs current have we had any issues with someone not obeying because difficult thing to not have some sort of signage Oh ma'am and MPD may be able to speak to that but to my knowledge there hasn't been any any difficulty in enforcing it other than the prohibited time so when it says 7:00 a.m. to 9:00 p.m. text I wasn't able to permit during that large expanse of time and so that's why we're bringing this back to men that is to make those restricted times more definite and and more concise so that text can permit them and PD can enforce in those those particular time frames my other question is the turn because many of those loads when you talk about wind turbine blades are very long and the ability to turn and make that turn particularly if they're turning left would seem to be quite difficult and that's a major intersection so I'm very concerned about that issue of turn yes ma'am and that's again that's why we're limiting those peak traffic times so

[0:18:47] that as those route of those vehicles or maneuvering that turn it is a slow process it is a long process so that we're having minimal impact to the traffic patterns along Cato Street as well as on Bryant so as far as as far as I've I've been informed PD hasn't had an issue with a great disruption there so these times were approved by a by PD and as well like I said as well as recommended by textile I know that corner on Bryant Boulevard is a high-traffic high accident corner or area so I'm just putting a concern out there that could exist do I have other questions or comments from Council all right with none do I have a motion for approval of 6a filly to win single-member district six I make a motion to approve item 6a the only made a motion for 6a to be approved do I have a second second second by Lucy no public comment we'll take a vote all in favor say aye down a post motion passes six we'll move on to item B first reading a public hearing of an ordinance approving a request for approval of a rezoning from the single-family residential and ranch and estate zoning districts to the general commercial and single-family residence Busoni districts the 14.8 8o acres located on West Loop 306 point 4 miles east of North that would drive and point three miles west of foster road john iran thank you as you mentioned this is a rezoning from single-family to general commercial and also from ranch in the state to RS 1 I'm

[0:20:54] assuming you can see my mouse here this front part adjacent to loop 360 that's the part that's currently RS one that will be going to general commercial there's a little bit here that's already rs1 and will stay that way and then this newly annexed area here in the blue that is the area that's currently ranching estate and we'll be going to single-family all properties that get annexed into the city automatically come in as ranch in the state and so this is the process to rezone to their desired zoning category this is the future land use for that area the the frontage on Luke 306 is transitional which allows for a mixture of uses including the commercial and then behind that it transitions to neighborhood which is consistent with that rs1 so nning we did send out our notifications to the surrounding property owners and did not receive any responses in favor or in opposition I will add that one of the adjacent property owners spoke at the Planning Commission meeting in opposition and the Planning Commission tabled that item but when it came back the following month I think they had worked out those issues and there was a better understanding of what was being proposed and so the Planning Commission did recommend approval after having tabled it as I mentioned this is consistent with the future land use plan for the area as well as the annexation ordinance itself and the plat for this area has already been approved but it was approved with the condition for the rezoning because the rezoning was necessary for the lot sizes that were being planted staff does recommend approval of both the rezoning at the front commercial and then the back to our s1 and then as I mentioned the Planning Commission did recommend approval by a vote of five to one the one opposition was a bit of a concern

[0:22:59] with this property developing with septic systems they're not close enough to the city sewer to tie on to city sewer so initially they will be on septic systems but in time as the sewer system expands into that area those properties will have to transition to the sewer system at some point in the future if those septic systems start to fail which could be years down the road but that will be a transition that will happen at some point well with that I'd be happy to answer any questions Tommy Hebert do you want to make any comment or have any questions regarding this item be just a couple of questions for John John you alluded right there to the fact that at the as a septic system fails the homeowner will be required to tie onto sewer and whose expense does that occurs that is that does the city run that sewer and pay for that or does is that the responsibility of home well connecting to the system and the cost of any lines to connect to the system would be at the property owners expense now getting the lines to that that development will be kind of a joint situation I think part of that is the plan the lake matters were the sewer main extension that's that big project that we've been talking about that will run a line fairly close to this area but then getting it to the actual homes that will be the responsibility of the homeowners okay well I know I've got another area that that is within my district that has septic also and unfortunately some years back I'm gonna say 25 30 35 years ago it was the understanding and it's kind of been perpetuated in this particular area that know that the city is going to do that I

[0:25:01] don't know that we've ever run sewer lines to an individual home we as you say we get to get the system where they can tie on but just just so you know I guess Julia just so that it's clear that if anybody's ever searching this meeting to find out well the city said they were going to pay for that it's clear that that the responsibility to tie on and pay for that extension to the home is the responsibility of the homeowner that's right John is there anything other than the prompts one more question is there anything that's like filed with the records county county records that would if a title search has ever done it would I'll say pop up when when ownership changes hands that would then say and make this note to that title search is that something do you know by chance if that happens well there with the annexation ordinance there was a service plan and that service plan specifically mentioned this this idea of allowing them to be on septic initially with connecting the sewer later on and that is filed I'm not sure a hundred percent that that shows up in a title search I would guess it does but I don't know that for sure but it is public record that that is out there with the annexation ordinance itself and also city ordinance is pretty clear not just in this case but anywhere else in the city if you're within 200 feet of a city sewer you have to connect to city sewer so anywhere else in the city if you're on a septic system and it fails you're not allowed to get a new septic permit if you're within 200 feet of sewer systems so that's the case under city ordinance anywhere else as well okay thanks John Marin is Tommy Hebert City Council single-member

[0:27:09] district going I'd move approval approval of item B as presented 7-0 we will move on to item C first reading and public hearing of an ordinance approving the abandonment and vacation of a portion of the benefits and Road right-of-way being approximately a hundred and thirty nine feet by 15 feet for a total of two thousand eighty five square feet generally located southwest of the benefit land Road and West Avenue Y intersection along the East property line of lap 28 block three Monterey addition John you're on again thank you as you mentioned this is an abandonment of a portion of a road it's it's not abandoning our entire road right-of-way but it's just as you can see here a 15-foot strip been Ficklin was originally planned as a major arterial highway and so that's a very ride wide right-of-way in that area and so this property adjacent to this right-of-way wants to take in about 15 feet of that right-of-way as you can see it still leaves plenty of Parkway or external right-of-way here and so that does not cause a problem this has happened a couple of times recently most recently for the dollar store that just went in a little bit north of this area and another property did the same thing to the south as well you can see that there would remain 14 feet of right-of-way between the curb and the abandonment so again that's that's actually more than is typical so that will remain again we're basically would be giving away the excess right-of-way that's no longer needed there are some utilities in that area so

[0:29:12] we will require an unobstructed easement that will preserve that utility corridor on the property it does allow them to construct a single-family home on the property which is their desire again it does not conflict with any of the utilities they won't be building on that portion of the property and there was no opposition from surrounding property owners staff does recommend approval with the four conditions payment consistent with the city's fee schedule that unobstructed utility easement as I mentioned they do have to record a quitclaim deed and replant the property to incorporate the abandoned right of way into that adjacent property and those are all common requirements for right-of-way abandoned I like this and then this went to the Planning Commission at their February meeting and they recommend it approval with a Forbes here with that I'll be happy to answer any questions Harry do you want do you have any questions concerning this issue well I don't have questions but a comment that we just did this maybe a year ago or that Dollar General or whatever that Family Dollar Store is so you know it's consistent in this particular area and I think it's it's something that we were a long benthic Lyneham more any other questions or comments concerning this item if not I mean Harry would you like to make a motion for approval very Damas single-member district 3 I moved to approve this particular item a second a second by Lane with no public comment we'll take a vote all in favor say aye aye high with men opposed motion passes 7 0 that concludes the regular agenda for today

[0:31:14] item 7 is follow up in administrative issues announcements and considerations for future agenda items I just have one that there's some house asked that we read book solicitation I'm not sure what the ordinance states today but I believe it might be 8 or 8:30 there's a request to move that fastest 7 p.m. people are very nervous about people knocking on their doors after 7 p.m. so if we could just look at that going forward I would appreciate it for consideration any way do I have any other announcements or comments from City Council for the next meeting mr. question bring to this is Harry Thomas yes sir with this particular format and we know that we're going to do this again in two weeks but what this carries on beyond this and we really need to be discussing items an executive session do we have a plan going forward for that it's not a lot of public access to the actual meeting and we will shut that component of it off and then we would have our meeting and come back from executive session so we can do it exactly the way we're doing it right now very good thank you anything from anyone else at this point if not what I'd like to do is close this meeting again reading dr.
