[0:00:00] agenda for this meeting on the 19th of january 2021 this meeting is called to order and yes we have a quorum with all city council members present we will start with our prayer and pledges and billy dewitt is going to lead us in prayer this morning billy if we could just clear our hearts and our minds as we go into prayer this morning our heavenly father we come to your throne of grace and mercy we come heavenly father giving you thanks heavenly father for this day because this is a day that you have made heavenly father and we are truly rejoicing in it we thank you for heavenly father everyone that's present under the sound of my voice we thank you for the news that we've heard this morning heavenly father because san angelo is a special place heavenly father i thank you for the leadership of mayor gunter and the city council members i pray that as we move forward in this meeting heavenly father that you would guide and direct us in the discussions and the decisions that we have to make heavenly father because we want to do all that we do heavenly father we want to be servants to the people of san angelo and we heavenly father want to make decisions that benefit and bless citizens of this city i pray for all the city staff heavenly father we have a good city of staff and i thank you for them i thank you and i pray for them heavenly father that you would guide them in the work that they do now heavenly father as i close this prayer heavenly father i ask that you continue to bless us and keep us and let your favor shine upon us it's in the name of jesus that i offer this prayer amen the pledges the next million let's

[0:02:04] start i pledge allegiance to the blind of the united states of america and to the republic for which to stand one nation under god and justice for all honor the texas flag i pledge allegiance to the texas one state god won an individual thank you billye we have two proclamations this morning and the first one is a proclamation of january 2021 as school board recognition month and i know we have many school board members here so if you would please come forward proclamation of school board recognition month the mission of public schools is to meet the diverse educational needs of all children and to empower them to become competent productive contributors to a democratic society and an ever-changing world local school board members are committed to children and believe all children can be successful lifelong learners and that the best education is tailored to the individual needs of each child local school board members work closely with parents educational professionals and other community members to create the educational vision we want for our students local school board members are responsible for ensuring the structure that provides a solid foundation for our school system

[0:04:07] local school board members are strong advocates for public education and are responsible for communicating the needs of the school district to the public and the public's expectations to the district therefore i brenda gunter mayor of the city of san angelo texas on behalf of the city council declare our appreciation to the members of the san angelo independent school board and proclaim the month of january 2021 as school board recognition month in san angelo texas and urge all citizens to join us in recognizing the dedication and hard work of local school board members and in working with them to mold an education system that meets the needs of both today's and tomorrow's children congratulations thanks man gunner and council we appreciate you all very much and and what a great day it is for us to celebrate with you guys and i know y'all spent a lot of many many hours working on getting a second airline here so we appreciate y'all's work in that area um i'd be remiss if i didn't recognize the rest of my school board team mr parker max parker is our vice president uh bill dindle's our treasurer and amy micelle flint is one of our wonderful members we have three other members art hernandez gerard gallegos and dr taylor kingman who are unable to be here this morning their schedules didn't allow them to be here and it's an honor to represent a number of other folks in the room i wrote those down so i wouldn't forget everybody so see if i can uh i can do that one i can read this we have dr karl detloff he's with us here today we have a number of other members of our board of our administrative team uh wes underwood who's one of our executive directors of schools shelly huddleston is also an executive director of schools we have shelley hollahan who's our deputy superintendent we have dr janna ritter who's assistant superintendent dr farah gomez who's

[0:06:10] another one of our assistant superintendents dr george mcfarland we have a number of of our support team i couldn't do my job without these two ladies pam blair and becky hopkins we appreciate y'all being here and all the work you do to help the board we also have members of our public relations team molly johnson and whitney woods so we appreciate them as well you know it's been a tough year for the schools as it is for um for many of us in san angelo and i can't tell you how proud i am of the work that our administrative team has done in association with our board team this year we're responsible and take great pride in educating for 14 000 students and and taking care of almost 2 000 staff members so we're really excited with everything that's going on with kova that we've been able to have school that we've had very few infections as a result of that and it's it's been challenging for our board team and certainly challenging for our administrative team so i congratulate certainly all of our team members in the back and thank all of our employees it's angel independent school district for for putting themselves at risk in order to make sure our students have the best in san angelo so thank you we're going to get a photo real quick but i also want to make a point other than reading this proclamation because education is such an important part of this community and i believe strongly that being in the classroom is hugely important and i thank the leadership from the board carl dutloff and all of your staff for your ability to deliver what you delivered this year it was a challenge you had a plan you did a terrific job organizing and putting the plan together and more importantly you executed and so when you look at the percentage of covid cases at such a small percentage of

[0:08:12] the entire combination of staff and students so huge applaud for all that you've done and for making sure our kids have a path forward in their educational life thank you [Applause] thanks appreciate you appreciate you so much thank you thank you so much thanks max good job our second proclamation today is a proclamation of gregario guterres day and i would ask that his family please come forward gregario gutierrez was the voice of and a strong advocate for hispanic people according to the 2019 u.s census data those of hispanic descent make up 42.6 of san angelo's population his bilingual newspaper connexion has been a significant part of communication for the spanish-speaking population for over 30 years gregario grew up in mexico where he began working at the age of 12. as a child he had a big vision that reached beyond his pueblo that vision brought him to the united states and to san angelo in 1986. he and arcello gutierrez married in 1990 the couple then founded the first

[0:10:15] bilingual newspaper in san angelo conexion hispana they found a connexium del rio in 2008 and raised six children by publishing the newspapers before passing away december 13th 2020 gregorio received many accolades over the years including the 2016 appreciation award from the housing authority of del rio for public contribution to volunteer income tax assistance program in 2017 gregorio was recognized for the invaluable service to promote the communication and culture of communities such as san angelo and del rio passion and pride of mexico by the mexican consul consulate and he received a diversity recognition award from the san angelo chamber of commerce in 2018 lions international honored him for exceptional contributions loyalty and dedication and the pachyderm club awarded him the community spirit and entrepreneurial recognition award through connexion he started an annual christmas presato where gifts and funds are raised for san angelo's children most in need the christmas presido recently celebrated its 17th anniversary now therefore i brenda gunter mayor of the city of san angelo texas on behalf of the city council do hereby proclaim january 23rd 2021 as gregorio guterres day in san angelo texas in honor of the founder of connexion san angelo and del rio thank you so much for everybody stay here really uh thank you for this proclamation from my husband he working men a strong man i want to say something you want to read

[0:12:36] it yes i'm sorry but for me it's too hard thank you for everyone and mayor uh i personally want to thank you for due to the circumstances uh many many people did not attend the funeral uh due to this coronavirus but you have shown something that most people didn't and i thank you for being there personally it shows the support not only to my father but also to the community uh the hispanic community and san angelo and so uh i just really wanted to read this says good morning everyone i want to wish uh to express my sincerity uh sincere gratitude to all the members of the council and authority of the community that represents us and to all of you that represent it's an honor to receive from the city of san angelo texas this proclamation dedicated to my husband mr gregorio gutierrez founder of the first bilingual newspaper in west texas now disease we will always remember him in our hearts a man of follow enthusiasm and dedication to his work full of love and to others with joy smiles leaving the legacy in each of us the value and above all the faith in god rescuing the roots culture and mexican traditions that never he never gave up on his ideals on behalf of family and their community and san angelo on the rio connection team thank you very much god bless you always i know if i missed that real quick i'm

[0:14:41] so sorry one of the things is that i wanted to say is the the city of san angelo and his members the community the hispanic community uh been talking to me tony villarreal i believe mr daniel valenzuela susan valenzuela we're very thankful for this dedication and for everything that's going to be happening i would like to ask as part of what's called the community and connection hispana and the west texas creole we would like to ask and to work with you the city to not live let this legacy die to us in the hispanic community we would like to ask for a plaque or something where we can work together for san angelo for abilene it is going to be not just an honor but also something that we can look forward and somebody that comes from another country with the barrier of the language but no barrier to succeed that talks highly not just on for gregorio but for the whole hispanic community in enabling san angelo and the surrounding areas it's it's a triangle that goes from abilene san angelo to the rio it's it's a huge huge uh part of our hearts that we would love to continue and to dedicate something to gregorio and the community and like i said the the community would love to work with the city council and the city to make this happen and whatever we need to do to make this process go we would love to do that monica ramos here i'm vice president of the railway museum of san angelo and i would just like to invite everyone to join us this saturday january 23rd at 10 a.m for a special ceremony in honor of gregorio gutierrez thank you [Applause]

[0:17:20] this process um a new challenge we will now open up the meeting for public comment if you come forward and offer public comment we ask that you state your name and address or smd area each citizen can speak just once per item unless asked to comment by council public comment will be three minutes unless extended by council or translation services the proponent or opponent five minutes unless extended by counsel or translation services counsel has no obligation to respond to comments or questions from the public any response from a member of the city council to non-agenda comments is limited to a a statement of specific factual information recitation of existing policy directing staff to place a subject on a future agenda i'm going to start by offering some public comment and the first one being i have received numerous phone calls from citizens concerning the amount of trash that is flying out of the back of republic services trucks and as well there have been many people complaining about people who have trailers with trash on them that are not covered and so trash is flying out of those so shane can you just come forward and tell

[0:19:22] the public share with the public what the rules are what the conversation is what you have been doing to support those issues because i know this isn't the first time and you've worked hard on this issue so if you could offer some comments please yes mayor council we have been working with republic we've received those complaints as well too within within our department as well and we have been working with republic and their drivers trying to make sure that they're coming up with solutions to try a lot of times when they're actually emptying the trash up into the top of the truck they have some blind spots up there and of course sometimes if the trash is not bagged if there's those issues like that and and it's starting to fly around on the top of course in west texas we have plenty of breezy days and so they are they're start they're having those issues uh in their blind spots and so we've we've asked for them to look at solutions uh to find some ways for them to be able to identify those blind spots on those trucks so that as they're driving whether it's down the loop or just down the block that they're not losing that debris off of the top of their trucks as well so also we see that coming out of their real rear load trucks as well and again a lot of times it's unbagged loose debris that we're they're we're causing the issues with the wind so we're working with them uh to try to come up with creative solutions for them to be able to identify and spot that prior to uh being able to driving driving to the next uh to the next house and or to the landfill to to empty their load and so uh we've created that and of course we have also um been trying to work with um uh with our crews as well too if we do see hot spots if we see something that that is really bad you know our crews our public works crews will go out and try to to to pick up that trash as well of course there's there's times and of course there's not only not only the trash from the trucks

[0:21:24] but the trash from the trailers and of course there's tons and tons of pickups driving around san angelo texas that loose debris flies out of the back of the trucks as well too but for those uh for those uh people that are hauling their own trash that are in the trailers where you have uh whether that's construction debris or it's it's limbs or or any other trash like that state law requires that it that that trailer or that trash load be secured in some manner whether that's a tarp over the top of it whether it's rope netting whether it's rope or twine something to secure that load to the trailer so it's not falling off or blowing off of the trailer and so and not only is that state law but we also mimic that with our own ordinances here within the cds and angelo as well too so but that um but that's how that is supposed to work and of course they do monitor that at the landfill as well too if if you pull into the landfill without a secured load then they collect a fee for a unsecured load at the landfill as well too so that's where we are there if there's any other questions i'd be glad to answer any of them hopefully that answers city council members i know you're all getting phone calls on those issues as well so thank you for that update and that information so we can better address those issues one on one thank you shane the other issue that i keep hearing about is many people believe that the city of san angelo are using city funds to finance the sidewalks they're being put in on knickerbocker road and those that have been put on on north bryant and south bryant boulevard that is not funded by the city those sidewalks are funded by txdot there aren't there is not a penny from the city budget that is used for those sidewalks so all those individuals who believe were wasting

[0:23:26] money on those sidewalks we did not vote to do that we did not vote to put those in it it was not up to us to have an opinion on those it is the federal and state government there's financing and putting those sidewalks in the last thing i want to talk about and it's heavy on everyone's heart and lives these days is certainly those families who have had to deal with the impact of covet 19 not only from an emotional perspective but also from a financial perspective it's a difficult time i know many people fear being exposed to the covid and other people fear having to be tested or deal with the health issues attached to covet 19. as a community we have had a lot put out in front of us with covid things that no one expected to have happen knowing things that no one expected to have happen and we've had to deal with it but the high price emotionally and financially is difficult and i say the following that we need to make sure that if in fact you think you've been exposed please get tested if you have symptoms please seek medical help no one wants someone to pay the ultimate price of life with cover 19 and the best way to protect yourself is diagnosis being tested and then to seeking treatment it was announced today that shannon has received another 2 000 vaccinations that vaccines so they are to arrive tomorrow i think there's something like eight thousand people on the list under just the one a and one b categories so we've done a lot we've still got a long ways to go in terms of executing

[0:25:29] those vaccines and i believe esperanza also received some moderna the one that shannon will be getting tomorrow is pfizer but we continue to beg for more vaccines shannon has become a vaccination hub which is allowing them to get additional quantities of the vaccine so we're fighting as hard as we can to make sure that the city gets vaccinated but that's the latest update in terms of where we are on the vaccines but please please get tested please seek medical help thank you yeah yes billy um would you give us the definition of 1 a and 1 b please yes and i'll probably have um teresa add to this but one a was first of all was medical professionals and first responders so that was the first category of concern the 1b is a 65 and older and those with medical conditions teresa you want to add anything to that in in more specific details that's correct mayor it is 16 and older and anybody with um medical conditions is the 1b and then anybody 65 and older even without medical conditions is one b and one a was the first responders and those medical conditions include obesity and things like diabetes kidney disease some pretty common conditions that people have so if they have any questions they should contact their primary care physicians to ask if they are eligible for a vaccine at this time and the best way to get on the list is to use your shannon my chart and you can sign up on that and get on the wait list for the vaccine with that we will ask if there's anyone in the audience today who would like to add or come forward and offer public comment michael looney

[0:27:37] mayor gunner city council michael looney vice president of economic development for the san angelo chamber of commerce wanted to uh give you a quick update on our one of our newest recruit companies this is a agricultural uh company a double j lamb company formerly of greeley colorado now of san angelo texas and i wanted to give you an update uh i talk uh frequently with jay hasselbrook who's the owner of the company they have completed most almost all of the work on their facility it is in excellent condition i've toured it they have begun the process of of processing lambs at the facility they have so far to date remember they came here in september there was a quick deal from september 1st to september 30th they've hired uh 40 people and they're currently looking for 60 more so planes trains automobiles and refrigerated containers so they are they are doing very well uh jay asked me to express his gratitude for the city council uh for the city management uh also to teresa james and to cindy priest who really dropped everything they had to get into the lamb business rather quickly you recall that phone call and so they're very pleased with the with the progress they're extremely pleased with how san angelo has treated them they have very very high aspirations for the lamb and goat industry in the concho valley and this is a big step into taking our economy from an agricultural standpoint to another level where we can reclaim that historic place that we once had years ago in the lamb industry so anyway i just wanted to share that news and just uh let you all know how they're doing so if you know anybody who wants to get into the lamb business they have 60 openings at the double j lamb operation on city farm road jobs did i say lambs jobs positions employment anyway thank you very much for letting me give you all that update michael i have michael michael i have a quick question yes ma'am how many

[0:29:39] how many lambs do they process per day how many lambs a day you know i don't know how many it it is a day uh they're they're gonna i can tell you they've told me they're starting with a test run of 90 000 head and then once they get through this year they're going to start doing up to 200 000 per year so 90 000 per year but but as far as the actual number they're running now it's kind of a test that they're doing now just to just to check processes and and the facility is is really magnificent so it's really nice to see what what in commonly they call a brownfield facility that had been vacant for so many years uh just completely looking brand new and operational so anyway i i don't know how many it is but we'll we'll let you know anyway thanks again for your support eat lamb eat lamb chateaubriand eat lamb thank you all very much thank you any further public comment [Applause] with no further public comment we will move into the consent agenda i will start with billy do you have anything you'd like to pull from the consent agenda lane lucy no ma'am harry no ma'am tom nothing to pull tommy then may i have a motion to approve the consent agenda motion is made by lane carter may i have a second second second by tom thompson any public comment on any items on the consent agenda with none we'll take a vote all those in favor say aye aye with none opposed the consent agenda passes seven zero we'll move into the regular agenda comments regarding items on the regular agenda may be made by the public when each item is discussed as outlined above applicants proponents and appellants are expected from time from the time limit above and must limit their remarks to less than five minutes we will start with item a which is keep san angelo beautiful

[0:31:40] the annual report 2020 and charlotte anderson you're here to present come on up thank you mayor and city council it's a pleasure to be with you this morning so just a q a quick review um our mission for keep san angelo beautiful is to create awareness and maintain clean green and beautiful spaces in san angelo he's talking to the microphone so we can hear you sorry again to create awareness and maintain clean green and beautiful spaces in san angelo texas and this is following the guidelines of keep texas beautiful which is how we develop our programming we do have a brief video i'm not sure if we'll have the commentary on it or if it will roll or we not so again um this is just going to show a few of our events uh it was a great review our household hazardous waste is one of our first bigger events and at this event we did a survey which was a really great field for the citizens of the community and on the survey we determined that our number one priority according to our citizens was household hazardous waste events and recycling also trees and cleaning up trash and debris was number three gardening was number four and then of course education and beautification so as we've put our programming together what we've done um again this is a little bit of information on our trees we did get a hundred trees from the apache corporation we've tried to develop our uh our events along these lines so again we had the household hazardous waste we did obtain 100 trees from apache

[0:33:45] we've had several trash off events our fall sweep had over 100 citizens participate from 13 different businesses where we collected over 13 pounds 13 000 pounds of trash we've had a couple of pop-up clean-up events this is some video from our fall suite a pop-up clean up event is designed not to have over 100 people we want a very small group of people that have a really good impact in a short period of time so this weekend we had one on the river with the good fellow navy detachment which was just wonderful citizens came out to participate as well we had a group of over 22 people again on a pop-up cleanup it goes really quick but you have a really great impact we collected 18 bags and pulled the barrel out of the river and a great um proponent this time on this cleanup was that we partnered with bri which is butts recycling inc to take these items to the uh facility there which they will be recycled so we're really excited to add that to part of our work so again gardening which came in really high on the list we are working with the school to do a butterfly habitat in a garden in conjunction with farmer's daughter we're also have developed our children's program where we've reached over 1300 children we've given away 24 bicycles to recycle for a bicycle again going back to creating awareness is very very important and to add to what shane had to say we can put out some pdfs on making sure that your trash is bagged and that your loads are secured so we'll do that to see if we can have an impact on that the question define the difference between the bulk pickup which uh republic services does and what you were doing relative to lam pickup etc because on a normal cycle people can use

[0:35:49] the public services services to do bulk pickup so what are you doing outside that that would be the difference between what they do and what you're doing so on a household hazardous waste event we removed over forty four thousand forty four pounds of hazardous materials this is something that our bulk pickup cannot address and it's a very important need in the community since we've had our event i've had so many phone calls when's the next vent when's the next event we saw 350 vehicles although we turned away 150 which is very disappointing and that's just due to budget constraints this year we set a really high budget and we're almost at the budget so we're really excited about that we should be able to see 500 cars at this event so again we're taking hazardous materials out of homes this is a safety issue so many things from pesticides herbicides fluorescent light bulbs oil paint gasoline a very toxic material so in addition to a safety issue we're also beautifying our neighborhoods and our communities which is really important and then as far as the trash areas in the community as soon as we can identify an area we try to put a team together and go out and have a pop-up event and address it immediately while we can't be everywhere all the time the citizens are very very cooperative they want to do this every time we have an event i see new people and they're signing up and giving their information and sharing it on their websites so it's making our message go a little bit further and we have over 830 likes and follows on facebook so our message is getting out we want to thank brian and all of our partners who have given us a little bit further circle of reference on that it's very important again that's the awareness piece making sure people know that we're here we're here to clean up our city and do

[0:37:51] everything we can to have that positive impact so if you have any questions i'll be happy to take those i have questions from council yes harry i want to say thank you to charlotte in the keep san angelo beautiful board uh in the less than one year that charlotte's been executive director that particular group has done more i think for recycling and beautification of of neighborhoods and education than we've we've seen in many many years i know the need is still out there that particular board is still going to continue to move forward and i will say that if there's anybody in san angelo that wants to volunteer on any of these things get in touch with charlotte we've got a place for you yes billy i would just like to first of all say thank you charlotte and your team um you know when we first approved keep san angelo beautiful on this council you know i think people thought that it was kind of a catchphrase and you know not much would be done it would be another flavor of the month but i think the team has done an outstanding job of communication of you know being effective in the community because um when we talk about getting rid of those hazardous waste items you know it's difficult to find someplace or some way to get rid of them and the pop-ups that you're doing i see those on the news sometimes and i think i saw harry thomas walking with the shovel down on um chad burn and um 7th street 6th street there under the overpass and so you all are doing a really really good job and i just want to say thank you for the effort and we appreciate it so much because san angelo is a mighty fine place and if

[0:39:53] we want to keep it looking good it takes work so thank you thank you and again we owe a debt of gratitude to city council mayor miss gunter harry thomas on our board and our other board members and the volunteers of san angelo everyone's just very excited to be a part of this and we're just very happy to keep san angelo beautiful so san angelo can do beautiful things thank you charlotte we'll move into item b consider a resolution english and spanish calling and ordering the general election for may 1st 2021 authorizing the city manager to execute an interlocal agreement for joint election with other parties under the tom greene county master interlocal agreement and providing for the holding of a joint election to be administered by the tom greene county election administration and julia you're on as city clerk yes ma'am this is just a resolution calling the election for may 1st it will be for the positions of single member districts 2 4 6 and mayor and the election will take place on saturday may 1st early voting april 19th through the 27th that will include weekend voting with covid we thought it was important to have more opportunities for folks to get out and vote and hopefully spread out some of the voters and we will we do anticipate holding the election and cost sharing with cristoval grape creek san angelo very best and wall school districts as well as some possible water districts so we do expect the cost to be relatively low for this election thank you do we need a motion to prove the resolution yes please do i have a motion for approval uh elaine made a motion tom seconded do i have a any public comment to add to the resolution or the motion with none we'll take a vote all in favor say aye aye motion passes seven zero item c is consider

[0:42:00] an appeal by the director of planning based on the recommendation of the director of operations of the planning commission's approval of a revised preliminary plat for a portion of the southland hills edition and a final plat southland here's edition section 22 each with a 60-foot right-of-way for valley view boulevard between stone canyon trail and south college hills boulevard in lieu of the staff requested 80-foot right-of-way and john james you're on thank you again john james director of planning and development services i'm going to go through this more quickly than i had anticipated originally because i believe that a compromise agreement has been worked out between the director of operations and the developer but i'll just briefly explain why what this is and why it's coming to you you can see in red there the proposed area of development that entire or a portion of that area in red something like this is proposed for future residential development you can see here before i get off this map here's a valley view over here and valley view over here so this piece in the middle is sort of the missing piece of valley view that this development will fill in that gap the really the issue why it's coming forward is this piece of valley view is an 80 foot right of way and then the piece of valley view across stone canyon is also an 80-foot right-of-way under our development ordinances this is classified as a collector street and so it would the minimum width of the right-of-way for valley view would be 60 feet in this area but staff had originally requested the full 80 feet just for consistency so that the entire length of valley view would be 80 feet in case that extra right of way was ever needed in the future this graph basically just shows you the what i just described it also mentions the paving widths

[0:44:03] the paving width over here is 64 feet of paving so a fairly wide street and then this piece is a 50-foot paving and so the middle piece will also be a 50-foot paving again based on it being a collector street i think at one point this was classified as an arterial street and that's why the water streets and the water rots of way at some point it was downgraded to a collector street and that's when the rat subway and pavement widths changed i won't really go through this the staff has had some reasons for wanting the 80 feet waterway mainly consistency with the rest of valley view the planning commission however approved the developer's request for only a foot rod of way for that full length of valley view which included approval of a revised preliminary plat as well as a final plat so your action today will also be to approve that preliminary plan and final plat um as i mentioned staff's recommendation was an 80-foot right-of-way for the full length of valley view under this section um actually i'm sorry it was on this page as well however there's been a compromise so beginning at stone canyon it will be 80 feet but it will fairly quickly taper down to the 60 feet so it that allows a transition from the existing 80 foot right-of-way and 64-foot pavement down to the 60-foot right of way so it's not an abrupt change at that stone canyon intersection but it will taper back and as i mentioned i believe this has been worked out with operations and engineering as well as something supported by the developer just a graphic here and it shows you how it quickly tapers down to the 60 feet from the 80 feet that's on the other side of of stone canyon again that's a quick overview i'd be happy to answer any questions is there questions from anyone on this item uh harry do you have a motion or a

[0:46:06] comment actually i guess i can second it but i do want to have a comment for okay well then uh you want you know is it a question or comment or you want to wait so to my perspective i don't want to saddle future councils with with trying to change a road uh we've done that in several instances uh just over the last five years that i've been on council i'd rather be consistent and keep that thing in it at 80 foot right away we can decide on what the paving width needs to be whether it's 64 or 50. but the bottom line is and i know the planning commission does an excellent job you know there are representatives to do that but in this particular case i really think the staff is right and i think we need to keep the 80 foot right away i'm going to offer a strong difference of opinion number one it's a housing development there's going to be a huge a huge amount of new houses if it stays 80 foot it becomes a very fast roadway speedway for people it's residential in order to make this residential area work it needs to be narrowed down slow the traffic down and allow for housing to be developed the developers do not believe and i support their perspective if it remains 80 foot it's a speedway we don't need a speedway through there we need housing and the developers have worked with city staff and with council to come up with a compromise that allows for the narrowing from 80 feet into the 60 feet so in fact that it slows traffic and remains a collector street not a major fast driving pathway from one side to the other so i am in support of the item and strongly believe it's the right decision shane kelton has reviewed it he's come up with the alternative here

[0:48:09] he supports it and believes it's the correct decision to narrow it down and support the planning commission's 60-foot approval mayor yes billy um i guess my questions go and i understand that a compromise has been worked out and and you know that's really good but um i guess there were several objectives mentioned in the background information why it was important to keep this at an 80 foot right away so if there was a compromise and this may be a shame question it talked about the curvature being a problem it talked about drainage if we you know that we needed to keep it at 80 feet you know for drainage issues and you know all of those reasons so i would just be you know like to know if there was concern about it going not being consistent 80 foot right of way you know what changed councilwoman dewitt as as we were as we go through here of course staff you know as from our very conservative approach on our side consistency is you know one of those things that that we like to see everywhere we go and especially from a long-term maintenance standpoint it it the more consistent we are over the long term the easy the easier it is for city staff to kind of grasp and hold onto things and see the future with the development we you know developers do have several concerns and of course they're putting um a lot of their money and a lot of risk involved into this on their side as well too so so their concerns you know from staff's perspective you know we try to sit and listen to their concerns and and all the issues that they believe they're going to face as we're moving forward and so uh staff and of course ultimately is council's decision not staffs but as we worked with the developers to try to find ways

[0:50:11] to make sure that all minimum traffic safety needs were met which is our main concern and of course the transition that we have you know was was probably our biggest concern overall was the traffic safety and how it's going to transition from that wide pavement section into a smaller pigment section we work through a lot of those issues a lot of the drainage issues we're seeing are not necessarily going to be there's not a lot of drainage issues on this segment here as we move past valley view and into their next segment drainage does become a bigger issue but we already have the 80 foot right away within that segment so it's not as big a deal again we were looking staff's main concern was consistency over time for maintenance purposes those issues like that but again as we sat down with the developers to work through some of those issues hear their side of the story what their the issues that they have or they see that could be involved in this then that's where staff began to work on the compromise that as long as we really as we truly address the traffic safety issues and we can address those then then staff can live with the remainder of that portion being a a 60-foot right-of-way within that section so again just trying to work with those developers to make sure that our basic needs are met and that we can also help them as they move forward within with their development and their processes as well too okay okay thank you um when i see the word drainage i always you know kind of want to make sure we're paying attention you know to that and i saw that yes ma'am definitely uh we always want to um and especially as we start heading into those areas right before we start entering into lake nazworth to make sure that the drainage is going to head that direction into that part of town so we always want to make sure that we're watching that but again drainage in this section right there with the right-of-way shouldn't necessarily cause any issues in this in this portion of town and they

[0:52:14] will work as they develop further to the east on on how that drainage is going to continue down into the lake nasworthy area well thank you so much and thank you shane for you know working with the developers to try to get you know get this resolved because you know i understand the comment about that being a speedway if it's 80 foot right away from knickerbocker you know on through the residential area understand that concern yes ma'am and traffic issues you know you know are always a concern but again try as long as we can manage the traffic safety portion of it and make sure that we have that safe transition in there then then we believe you know nobody has a crystal ball and i wish we did because boy our lives would be so much easier but as we move forward i mean there's different things that we can look at if something needs to be changed or has to be changed in that area there's some different traffic management plans that we can implement to help create congestion issues and things like that but we believe right now with what we have with the compromise we have we believe staff we can we can work with them and and move forward with this project to make sure that again we keep growing san angelo tom saying before you take off got a quick question so if i'm looking at this right we're matching uh basically the paving we're taking an 80 foot down to or 64 foot of paving down to 50 which is 50s on the other end so we're just matching what's going to the other end right correct okay so we're mainly concerned about the intersection and how it decreases correct we're that and that that is our biggest safe traffic safety concern was is that transition right there in that corner have you got enough space here with this to make that happen yes that uh what we're doing right here and how um how we're going to go it'll it's basically 100 feet 105 feet past the radius of stone canyon to make that transition that's that's our required minimum by the books

[0:54:16] but but no that works for us tommy can you yet talk about um traffic control devices stop signs yield signs whatever at the intersection specifically of college hills and valley view and stone canyon and valley view okay um is it too early to do that no sir i mean we definitely talked about the books and and and how it works you know from the ordinance standpoint and how um and how we work with through the mutcd and in ashtow and all those guidelines that kind of guide us in how we set up traffic traffic control devices and what we'll do beings that valley view is going to actually be classified as a major collector and of course stone canyon is a minor collector and then of course college hills to the north of here and this area here is also a major collector but as we move down into this lower part down here that becomes a local road and so it will transition from a major collector to a local road at valley view with that valley view will continue to go through as unimpeded traffic once it's once it's gone through we will have stock conditions at college hills on both sides of valley view we'll also have stop conditions on both sides of stone canyon and valley view will be a through street based on street size and those things like that as we move into the future if we start having issues at college hills or we have issues at stone canyon we can conduct warrant studies to determine whether a four-way stop condition on either one of either one of those sides is met but as

[0:56:19] of right now based on our our guidelines and what the designation of valley view is it will be a through street thank you and then coming back you you referenced college hills coming back south which i assume will be a service road you call it a local road but a a service road for the development itself correct it will be classified as a local road or a residential roadway uh this position down here so well well it's right-of-way and uh strip strip of paper how how wide will the right-of-way and strip of pavement be as it comes south i would have to go i would have to revert uh go back to the plat to make sure but uh most local roads are going to have um probably 30 50 50 feet of ride away in either a 36 or 36 or a 40-foot section and maybe this is a john question do we have any ingress egress on the stone canyon side for public safety um mainly fire and ems but also police do we have any ingress egress on the stone canyon side into this development into that development there yes sir these uh and actually these streets in the in the platte are designated to go through as well to college hills and stone kings two college hills and stone okay okay so good that's good okay uh mayor with that i would move approval of the compromise the 60-footer right away and 50-foot of paving with the narrowing there at the stone canyon and valley view intersection thank you tommy in a second by tom any public comment with none we'll take a vote all in favor say aye aye any opposed motion passes 7-0 we will move to item d which is first reading and public hearing of an ordinance providing for the abandonment of approximately 280 square feet

[0:58:22] of street of way out of the southwest corner of south college hills boulevard and valley view boulevard john euron thank you this this is related this is uh when this area was originally platted here's college hills and there's valley view they platted the corner of this intersection as if it would continue on as an 80-foot right-of-way so what the developer is asking is basically to abandon the portion of that right of way that makes it 80 feet continuing from the intersection and tapering it down to a 60-foot right-of-way so given your decision on the previous case staff would now recommend approval of this abandonment and you can see it's just a little sliver but it just makes the difference between curving into an 80 foot right of way versus 60 foot this says staff recommends denial that was based originally on our original recommendation to keep the 80 feet but you can strike that and so now with your previous decision we're recommending approval and the planning commission also recommended approval they did recommend with our standard conditions for an abandonment to pay the fee submit the revised plat changing the layout and then a quick claim deed to finalize it with that i'd be happy to answer any questions any questions for john all right may i have a motion approval of this abandonment thank you tommy a second by tom any public comment no public comment we will take a vote all in favor say aye aye motion passes seven zero we will now move into item e which is the first reading and public hearing of an ordinance approving case z 20-2-0 a rezoning from the single-family residence zoning district to the general commercial zoning district being 0.32 acres located at 1622 lafollette street and four lots directly west of 1622

[1:00:26] la foulette being 0.30 acres in the 1600 block of la follette and john you're on again thank you this is a rezoning you can see the lots there shown on the map lawfulette is basically the frontage road for the houston heart freeway and you can see this exit ramp here that's where if you're exiting to go to bell street that's where the off ramp hits that frontage road and so it's the vacant properties right there at that location as you can see here all of this yellow is zoned rs-1 single-family development that was all zoned rs-1 prior to the freeway ever coming in and it's just maintained that designation over time but you can see there on our future long-range plan for the city uh all of this area along the frontage is planned for future commercial so the rezoning from single family to commercial is consistent with the long range plan just a couple pictures of the area you can see that there are some homes north of the subject property so behind the the frontage we are seeing some single-family home development but as you can expect we don't see a lot of interest in single-family home development right on the freeway frontage road and so that makes sense for this to go to the commercial zoning again most of the the subject property is actually vacant currently we did send out our notices we received one response in favor and none in opposition to the request what was the opposition no one in favor but none in opposition okay as i mentioned this is consistent with our plan designation it is on the freeway frontage the whole area already has a mixture of residential and commercial particularly commercial up on the freeway frontage and as i mentioned this was zoned residential prior to the construction of the freeway so it's kind of a holdover when this area was originally planted as a residential development staff does recommend approval as did the

[1:02:29] planning commission unanimously and with that i'd be happy to answer any are there questions for john lucy is there any plans of what you'll be what they'll be building out there do you have any idea no at this point at least i'm not aware of of what their specific plans are okay i moved to approve this president do i have a second okay second by lane any public comment no public comment we'll take a vote all in favor say aye none oppose motion passes 7-0 we will move to item f which is consider approving a request from the infill empowerment zone and or the catalyst project infill program for infrastructure funding for up to fifty percent of the cost of water lines sewer lines fire hydrant and roadway construction cost plus additional cost and an amount not to exceed eighty one thousand two hundred and two dollars for the denny edition section 2 and presentations made by lisa denney and john james thank you i'm going to give you a brief overview of the request and then russell goalie will actually be speaking for miss denny on this case you may recall this from a few meetings ago this is there was a larger request that came to you and you all had some concerns about the size of that request so they've gone back and worked with staff to come back with this smaller piece basically splitting up the development into phases so you may recall that this originally would have been a street up and and development you know over on this side as well but they've paired it down to the the current request is is just the five lots that you see there uh to make it uh to again phase it out so that their request to you today uh is a smaller request and this one's a little unique in that a portion of the costs are directly attributable to the development so the lines that the

[1:04:31] sewer and water lines that they're running directly serve the development uh and so that is eligible for 50 of the cost of that portion through our empowerment zone infill program however what they've proposed to do to assist with future development in fact it will help the sewer and water system off of their site which doesn't benefit their properties at all but as a benefit to the city they're proposing to extend some sewer lines as well as sewer easements that would be necessary to serve those developments let me go back real quick to the uh that would help basically all of this area which they do not currently own as my understanding but it would create some sewer easements and extend sewer lines through their properties that would particularly help serve these properties some of which are already developed on septic systems and so the city has a goal of converting people who are on septic to the city's sewer system so it helps with that the problem with that is that that those improvements are not eligible for our empowerment zone infill program however they are eligible for the the new catalyst project funds that you all created last meeting and so we've what we're presenting to you is is sort of splitting uh the costs into two different categories because they will have to be funded through different programs now as you remember all of the infill funds came out come out of the same pot of money anyway so it's really just a matter of of paperwork and and how these are approved and processed as i mentioned the developers not obligated to extend those lines so it's it's purely a benefit to those properties and the city system as a whole and so the city sees that as a as a benefit that we would hate to lose you know one option for you would be just to approve the things that help their development but it's

[1:06:32] beneficial to the city system to go ahead and give them funding to do that other work as well what would be the difference in those costs if it's eighty thousand dollars is this what you're gonna share okay thank you so the the total onsite costs are 85 000 we can pay half of that so they're requesting the half which is 42 963 and then the costs that are attributable to the off-site benefits or improvements is another 42 000. that brings the total to the 85 486 which is their request when we talk about total dollars available in the empowerment as well as the catalyst program by approving the 85 thousand dollars what would be quote the fund balance left in those uh infill programs you know with your approval last week i did not go back and do the math it would leave a little bit i mean just less than five thousand dollars in that fund if you approve the whole 85 000 out of the infill designated funds at this point i would like to ask and see if possible instead of taking the entire amount out of the infield programs leaving a small balance that i ask allison strooby if there's any possibility that she might have forty thousand dollars in her fund that we could use reducing their request from the 85 486 subtract 40 000 and use that out of allison's troops funds is that possible good morning mayor council uh andy vaselio assistant director of water utilities uh house is not able to be here this morning uh we we did talk about that and we could pull some of that of our capital funds for sewer if that's the council's desire i just don't want to totally deplete the infill program so i think it would be a good compromise if we could take the 40 000 out of that fund leaving the request to the 45 45 486 000 out of the infill

[1:08:40] program leaving that infill program with additional funds for future development do i have someone who would like to ask questions about it further questions comments tom you know my question is if we don't use up all the infield which i'm assuming we would would that infill reimburse the water department back or would we just leave it as it is we'd leave it as it is so the 40 000 is usable out of the water fund and at least the fund balance for infill for future projects for other developers that was my question harry yeah just a real quick comment uh what alyssa has done with this particular property just just in the last six months is is tremendous cleaned it up uh and i think it's going to be an asset to the city so uh i i want to make sure that we go forward with this project regardless of what the numbers are here or the 45 000 the mayor is talking about i want to make sure that this thing happens and whatever we can do today to facilitate that i i'm willing to go forward with it i'm very supportive of the project and and feel like you do harry that it is a great concept and and highly supportive i just want to leave money for future development for other infill projects so if possible i would like a motion to um as just presented meaning that the total request of 85 486 be reduced to 45 486 for with 40 000 coming from the water sewer infrastructure out of the water department i'll make that motion mayor thank you thank you second by billy and lucy you might like it so without any public comment with no public comment we will take a vote all those in favor say aye aye non-opposed motion passes 7-0 just develop that other half good job all right we will now move into our
