[0:02:02] and I am the Secretary of National Junior Honor Society okay let's turn and do the pledges [Applause] to start off with our proclamations today we are going to recognize a public safety communication center is Steve mild here this morning okay he's not here and he has a proclamation so we'll just skip over that and we will move on to recognition of concho River Walk selection as a great place in America Carl white are you here come on up please an angel' has always known the concho river as a treasure now the whole country knows it too the American Planning Association has designated the concho River Walk as one of the great public spaces on its list of great places in America the great places in America program recognizes streets neighborhoods and public spaces that demonstrate exceptional character quality and planning such attributes enrich communities and facilitate economic growth while inspiring others

[0:04:04] around the country the Riverwalk embodies a unique place that exemplary in its amenities and infrastructure and its cultural identity and in the use of sustainable and innovative practices thanks to a 15 million dollar investment by San Angelo voters the Riverwalk has been transformed into an engaging place that offers locals and visitors alike a place together to socialize and to celebrate with a steady stream of fun and relaxing activities the project also could not have happened without the visionary foresight and committed resolve of those who planned and executed the river walks rejuvenation the hope is that landing on the great places in America list will help put San Angelo in our River Walk on the map much as has been done for the Strand in Galveston and the Pearl brewery in San Antonio therefore I Brenda Gunter mayor the city of San Angelo on behalf of the city council do hereby recognize and applaud those responsible for the concho Riverwalk for their achievement and positive determination to make a difference in our community both the Contra River Walk is a treasure earlier this year the state of Texas learned that too when the Riverwalk was named one of the official great places in Texas by the American Planning Association now the whole country knows the APA has proclaimed the River Walk as a great place in America making it one of only five spots to earn that honor this year it's really unexpected it's beautiful it's a love just that elements of surprise that come along as you're walking through the river the art to see all the different kids and family and community of all ages down here walk in it's special the remaking of the Concha River was made possible when voters approved using the half cent sales tax to renovate its four mile stretch through downtown more than 15 million dollars has since been invested along the concho among the improvements the river bed has been dredged improving water quality for plant fish and animal

[0:06:06] life the banks have been fortified system erosion the walking path has been smooth and punctuated with plenty of places to lounge and alluring features have been placed all along the trail from public artwork deceiving lighting to the Bosque Games court the renovation is given the Riverwalk new life today the concho River is alive with activity the community's favorite gatherings plop plays host to the annual River fest and offers family a steady stream of fun it's also given San Angelo a unique sense of place if you try to do something like this in the middle of nowhere it just wouldn't work but it's the interconnections with downtown and just the linkages that the River connects is what really makes it even better local officials also hope the spotlight will help us in Angelo and its Riverwalk on the map much as it has done for Galveston strand and the Pearl brewery in San Antonio now America gets to find out what a great place San Angelo is and what we have to offer not only to our residents to visitors to businesses anyone wanting to relocate or retire here this is a reason for people who want to do that press a TV I'm Anthony Wilson I want to thank a few folks for this first of all I want to thank my boss requires stay behind me for his leadership for the river project it really went on for 10 years providing some the vision and the direction to get it started and get it done also to thank the public for their support of the house that sales tax that helped it could not happen without that I also want to thank ok see if you could come up here a second he's wondering why he's involved - to receive this award we basically created an event bosque Tober fest and it was Anthony Wilson's idea to do the event which turned out really great but I want to recognize Brent

[0:08:08] because we've got a perfect middle of parks we have a wonderful wonderful space in the river park and now we've got an awesome recreation manager he he took the event organized it basically created all the details and he even dressed up in later hosen to walk around the city hall and the community promoting the event he was worried we wouldn't have a good turnout we had an awesome turnout we had the police estimated almost a thousand people down there at the little Bosque and I want to personally recognize him for his effort to make that event work [Applause] it looked like he was real happy about dressing up in the light and hosing - thank you the Planning Department noticing and recognizing what we all knew was a great place it's just getting it officially stated so thank you Eve mild is here so we're going to have him do the public safety communications center proclamations chief Carter look Safety dispatchers are a group of people who are never seen they're always on the job but are seldom appreciated while others are at home on holidays they are working while others have weekends off their days off maybe during the week no one ever thinks about them

[0:10:13] until something goes wrong or someone did not get help as quickly as they thought they should they work behind locked doors where the public doesn't go their job their jobs one of the highest pressure jobs that there is they must remain calm under the most adverse of conditions and be able to think on their feet they cannot afford to show their emotions no matter how desperate the situation is San Angelo is blessed by having some of the best dispatchers in the state this was evidenced on the afternoon of September 14th when there was a large wildland fire in the south part of the county the fire resulted from a controlled burn that had blown out of control and it jumped and established fire line the fire was threatening several homes and other structures and the resources on scene were inadequate to control the fire at the same time there were multiple events happening in the city to dispatchers then the Waller Sara wreaths were on duty and they were able to manage the multiple events in a very professional manner and were able to secure the assistance that was needed on the fire in the south part of the county no structures are home for law student due in large part to the quick response of the dispatchers we'd like to take this opportunity to publicly recognize these two professionals for an outstanding job she fraud warned of the wall of volunteer fire department requested that these presentations be made and he has completed these two certificates for outstanding support provided to all volunteer fire department and all mutual aid partners during the rocking-chair Ranch fire on September 14 2017 your support and professional reaction at the

[0:14:18] funds for hurricane Harvey relief heading the concert was our local Grammy award-winning Los Lonely Boys the turnout was great and more than ten thousand dollars was raised for Robins Heart Foundation an official 501c3 nonprofit charitable corporation created by Houston native rapper chameleon chameleon ere attended the concert greeted fans and thanked Los Lonely Boys for the generosity the benefit concert would not have happened without our Sydney it was his idea and he worked with his personal connection chameleon chameleon there to make it happen Sydney made a cold call to Los Lonely Boys and because of his charisma and the cause they agreed to do the concert at no cost to them as artists Sydney's efforts are commendable and a true example of the charitable and can-do sin 'angels spirit to get things done and help others out we thank you Syd for your compassion and hard work you're a great reason San Angelo is a great place to live and work now therefore I'm Brenda Gunther mayor of the city of San Angelo Texas on behalf of the city council do hereby recognize and applaud sidney walker [Applause] first off I want to say thank you thank you to the mayor thank you to the City Council thank you to my boss mr. carl white of course for giving me the opportunity to be able to put this together but first and foremost definitely first got to thank thank all the bands that did perform Los Lonely Boys boogie town tequila brothers Young Gun and outlaws because without them there's no show then I also got to thank the ones who'd actually donated and sponsored the event of course all-american Chevrolet they put pitched in a lot for us to be able to put together and afford for the sound and everything else that goes together with the concert without the sponsors and stuff there's no money involved in this

[0:16:20] to be able to pull this off and then Nick's going into that I got to thank everybody that actually came out supported it donated sponsor then helped out to the event because without them that donated we wouldn't raise over ten thousand dollars and to me that's a huge accomplishment for San Angelo Texas to be able to pull that off on a Sunday night once again I appreciate the support and thank you to everybody else I want to say a few quick words so we all remember the end of August with the hurricane which seemed to never go away and floods of Houston and it was immediately right after that happened that Sid came to me and said I want to do a benefit concert and I said okay can you put it together and he put it together his first personal connection with chili and air is that correct Chamillionaire see I don't I don't know and if you looked on Facebook he's got about a million followers about 300,000 Twitter so he's a celebrity although I don't know the rap world but he said has a personal connection with him because of the business and he made a coke called the Los Lonely Boys and because of his charisma and who he is that they immediately agreed to do it just for the cost of the crew and Sid has a big heart if you don't know him he's very passionate he's got a big heart and this would not have happened without him it truly shows his commitment to the community the greater community and he's really got a big heart for helping out others the profit the nonprofit for it was for Roberts Heart Foundation which is founded by Chamillionaire Chamillionaire himself he put together 25 thousand dollars of his own money towards Robins Heart Foundation to be able to be funded for you know hurricane Harvey victims his

[0:18:24] biggest thing was that he wasn't going to take any type of uh you know what a non-profit of course he and you can get your pay out of it and stuff but he's dedicated towards a hundred percent of the proceeds to go towards it you know for him he's really one to help and help the families that were truly affected by Hurricane Harvey of course you can't help out everybody but there are some families that were you know actually trying to help others get get to safety and were electrocuted or you know families that you know senior citizens that just couldn't get out in time for the hurricane and and and all the other families that are going through things so he's truly committed he's actually out there working with everybody else that's that's involved with with with the Foundation's who to make sure these funds are getting spent spent correctly you can't follow it on Robins Heart Foundation comm to make sure you see where those funds are being spent at so as well I'm building hair I've had the privilege of being uh Sydney's board chair for the sick events and in that last couple of years since I've met Sydney if you've ever met him and had a conversation when I'll reiterate what cross said you realize what kind of passion Sydney has for civic events and hosting shows when you had the idea from idea to inception when the contract happened it probably all he put it together in about three weeks okay that doesn't happen without a lot of tenacity persistence and and just you know just loving what he does so I commend Sydney and man I sure am glad being part of civic events [Applause] we will now open public comment please

[0:22:51] cosa DC's approval of a resolution authorizing the board president to negotiate an execute task order number two to professional services agreement RFQ DCO to 1/7 was Parkhill smooth and Cooper incorporated in a sum not to exceed $280,000 to perform professional engineering and survey services for infrastructure for the seneschal business and industrial park subject to approval of the City Council for a project necessary to promote or develop new or expanded business enterprises as authorized under the Texas Development Corporation Act mr. Pena you're on morning City Council so I gather you just want some background yes is this I want to know is this one too this is only in the second section of the development in is this to accommodate and make sure that the AEP project stays on schedule it is so let me provide a little bit of background the Cosa DC embarked on a certification process and about 2015 early 2015 we completed that in 2016 as you know parcels have been selling at a rapid pace there we've solved over 117 acres total since inception 121 acres at the time that we began the certification we had 138 acres available in Phase one so part of the certification included a master plan that allows us to create improvements in phase one and move into Phase two because we're having these parcels sale so as part of the master plan we were planning to move into Phase

[0:24:54] two when one of our existing businesses American Electric Power purchased 52 acres of property to build a new facility a new transmission services operations facility and most recently they advised us that they're moving very quickly they would like to break ground possibly in December or January so bids are on the street at this at this moment our purposes are to continue to provide the improvements that are necessary if you look at the map you'll see some storm water runoff drainage that we need to build their water retention pond because we are having flooding in phase one and so this will provide utilities and these drainage improvements to phase one it'll also help IEP and we're trying to meet their deadlines so that they can begin construction of their facility so it'll provide utilities into that portion of Phase two that affects AEP however we will plan for the rest of phase two the other driver in in this phase two is that we're going to have some highway improvements you may or may not be aware on highway 67 where there'll be an underpass and so we'll have a thoroughfare plan connects that top portion of Phase two so in essence we're we're planning not only for AP but future growth in Phase two the task order that you have in your in your packet does show planning and planning this is a requirement from our development services we have to do some planning to accommodate AEP it'll include the infrastructure design and the bidding and construction of these improvements notice the timeline we will

[0:26:59] have construction drawings submitted to the city of San Angelo on December 1st of this year with the portion of infrastructure required for the AEP lot also final construction drawings for submission to the city of San Angelo on February or on February 1 for 2017 for the remainder of the infrastructure that is needed in phase 2 so with that I'll be happy to answer any additional questions that you may have I want to make sure that the timeline on all of this work is satisfying AEP because I know they've been upset that this project has been delayed and not on a time frame that they had hoped and anticipated so I want to know if in fact that does that and number two I need to know if when we are opening quote the ditch for utilities that all utility work has done at one point in time so they don't spend extra money free digging the trench and laying more infrastructure at a secondary time which is quite expensive I can say yes to both those questions can answer yes with that are there any other questions for rollin you have a motion for approval Ruth all in favor passes 7-0 we will now move into the regular agenda item a presentation on the street seal coding process and evaluation Lance you're on good morning Lance Overstreet engineering services a couple of councils ago councilman Thomas had asked that we give a presentation on seal code just to kind of give you guys as council members an idea of what is expected and what is a part of seal coat and and really why we do it and then also to to answer questions when you guys get residents to call and and discuss what's going on with that how you can better

[0:29:02] understand what the process is and what's expected of it and so you can see right here that this is actually an application of seal coat and the silh cohort sylco process is done really because of how we have our standard of asphalt pavement here in the city as you guys have might have seen over on the loop and in different places the city actually uses a hot mix asphalt as their standard for roadway construction that roadway construction is done by taking aggregate and binders and oils and heating those up and those get placed into a machine that actually applies it guys if you go ahead and cancel that video I'm not really sure what that is but that's not a part of the presentation thank you interesting it was interesting but that's not part of the presentation educational video now what did you say who are you if you guys could go ahead and start the PowerPoint presentation that would be great so what the whole standard of what paving is here in the city is is hot mix asphalt and that is applied by taking aggregate is by taking binder they heat it up they apply that and almost all the streets here in San Angelo to these days is designed and constructed that way but what ends up happening is is that when you there we go okay now we're good all right so this is what the hot mix asphalt basically does and you guys have probably seen them actually install a new pavement around town and it's done with this machine it's done by aggregate binder put together heat it up laid down

[0:31:04] on on the roadway well the problem with that or the benefit of that is that when when asphalt is first installed it's pretty much water tight and impervious and what that means is that that binder and those oils it's in that asphalt naturally it actually helps to seal that asphalt to keep it from the grading but over time most of you guys if you've ever seen it when it rains there's a little light sheen of discoloration on the roadway when it first starts to rain and what that is is that's literally that binder that oil in the asphalt being released out of the asphalt because it is degrading and what ends up happening is is the the UV the sunlight the traffic the rain sleet snow all of those things break down that binder so what ends up happening is you end up losing your topcoat of binder and when that happens you start seeing a degradation to the asphalt and if you don't do anything about it what ends up happening is that degradation we're literally just destroyed the entire portion of the asphalt over a long period of time so what we do with the seal coat is is we're basically restoring that water tightness or that water seal to the top of the pavement where it actually experiences the most amount of damage and so what ends up happening is as if unprotected or untreated asphalt will only last about 20 to 25 years on average so if you put down new roadway and you don't touch within 20 to 25 years you're gonna be digging it up and replacing it and that's just the the nature of the way asphalt is and that is an average here in in West Texas with the intense amount of Sun that we have and with some of the traffic that gets on those different roadways it can be even less and so the whole idea of of applying a surface treatment is is you're actually it's a maintenance and it actually extends the life and it can extend the life somewhere between 4 & 5 times longer just by performing a routine maintenance of new sealer and so they recommend actually sealing a street about every three to seven years on average because

[0:33:07] you guys know about two years ago we put a plan together so that every eight years essentially every street in the entire city would be resealed and the reason for that is because of that time frame okay so the whole idea of seal coat is really the oil that's there and as you guys saw the video that was played earlier that oil is applied to the street and really that oil is what seals the street that's what's rejuvenating the asphalt that's what's giving us the benefit and from an engineering standpoint if you can put the oil down we would be fine but the reality of it is is that that oil is actually a a heated oil that goes down on the roadway and win it and you guys can imagine if you've ever been in your car and you've gone through a refreshing sprayed area of oil you know you do get a little bit of oil up in your car well can you imagine that if all we did was put the oil down and we stopped there everyone that drove around in those neighborhoods would actually have so much oil on their cars well what would be coming on the tires and we be making a big mess but the reality of sealcoat is is that oil is really the benefit okay that oil is actually applied at a rate it's based upon the gallons per yard we had that in our specifications as to what that range is and what they're shooting for and the the thickness that that oil goes down is really based upon several factors one what the condition of the roadway is to begin with as you can imagine the more cracks the more damage to the road the more oil it takes to seal that also to the amount of the temperature of the air the cooler the temperature is the thicker you have to apply that oil to make it stick not only that but if you have an area that has a lot of shade and a lot of canopy a lot of trees that cools the surface down that also too has to be applied thicker to allow for the aggregate to aggregate to stick so what is the purpose of the aggregate the purpose of the aggregate is so that way the roadway can be accessed in a very quick time and it also to prevents that

[0:35:13] oil from being removed from the pavement so when you guys see the aggregate put down a lot of people have a perception that when the aggregate goes down that should be all you see is rock from edge to edge really that's not the case all we're really concerned about is making sure there's enough rock there that as cars drive over they're not damaging the oil which is what the benefit is and so a lot of people have in this mind the seal code also too is going to fix all the right quality issues well seal coat is a surface treatment if you have a rough road before seal coat you're gonna have a rough road after seal coat sill code is not designed to repair rough roads it's not designed to repair potholes seal coat is a surface treatment that's designed to prolong the life of that pavement and so here's a couple of examples of one is too much rock if you can look in there and you look at it you really don't see a whole lot of the asphalt in that picture and so if you look at it and you guys can see it in one side you can see a whole lot of asphalt and not a whole lot of rock okay each of these this kind of has its own own problems one if you don't have a enough rock then you're gonna have vehicles sticking to that asphalt and possibly peeling it away if you have too much rock what ends up happening is the rocks actually rub against each other and they can actually turn into powder and it can actually then also to create make the rocks axes dislodge because they're actually rubbing on each other and so as we're installing this pavement we actually and you can ask as the video was showing earlier they're blowing and going through this stuff I mean they're actually moving at at 30 miles per hour almost as they're installing the as they're installing the oil and as they're put in the the rock down there driving pretty quickly well we are actually making adjustments throughout the day who based upon visual inspections of how that product looks and how it looks on each Street and how much aggregate seems to be wanting to come loose during the day and so they

[0:37:16] are making little adjustments on those machines almost on a daily basis almost on a street by street basis and then what we do at the end of the day to determine what those rates are is we add up all the quantities and those areas and so our inspectors are out there daily measuring the streets daily looking at things we when the cilco process is going on we pretty much pull every inspector from every project that we physically can and we put them on sealcoat we borrow from other departments as well and we end up having somewhere between six and eight inspectors and/or personnel that are dedicated to the seal code when it's going on just to maintain and inspect what's there so what does a good mix look like as you can see in this picture this is really what we're looking for so when you look at these and you see the rocks you can almost see a little bit of asphalt or oil kind of around each one of those and the reason for that is because you know that each one of those separate little aggregate pieces are a separate little pieces of gravel is going to have enough oil and binder to keep it in place that is actually the goal of what we're looking for now I will tell you that each one of these pictures is from this year's sealcoat okay and the reason why you have such variability is one the one of the most rock there is actually in the middle strip and as you guys know when that distributor is laying down it actually has to overlap a little bit and so that one that has a little bit too much Rock is actually right down the middle of the roadway and we kind of know that's going to happen okay the area that has too much oil is at an intersection on the edge where they actually were passing it into different areas and that edge has at NC to be a little bit lighter because if they put too much rock on the edge it ends up in the gutter and then people complain about having rock all over the place and and things like that so even though all of these pictures are from this year sealcoat what we are doing visually is we're actually looking at the roadway in terms of how does the whole roadway look we're not necessarily going each little foot

[0:39:19] by each little foot and then and then having them adjust it because if you did that you would actually end up having the guy with a dial sitting there dialing up and down and you would slow the whole process down so much then instead of doing all the cilco within a matter of a couple of weeks it would be a cap matter of a couple months and then the price would you know go up exponentially so the whole idea of our silico processes is really to protect and and maintain the asphalt that's there and so there's really kind of a lot that goes on and so we just really wanted to kind of educate you guys so that way also when you guys are going out and drive it around when the seal code happens and when you guys have residents that complain at least you guys kind of visually have an idea of what to look for I can tell you that being the project engineer this year on on the cilco project I would actually drive around on a daily basis through the streets and I will tell you that if you're driving down on a first sealcoat street and you're not it doesn't sound like there is a gravel truck following you with all of the little Tings on the car and you're driving around and you're just hearing one or two every once in a while and the street has been swept that is really the best application now if you're driving around and it sounds like you know a hailstorm on your car as you're driving that's too much rock and so a lot of times too we have people in the in the residence that don't understand that it's not going to be a brand new paved road it's not gonna have Rock edge-to-edge and so we get a lot of people that you know will complain oh there's not enough rock well as long as you can drive over it not peel up the oil then we're okay with that and so that's kind of that fine line that engineering balances with that so did you guys have any questions on sealcoat on the process on the rock I have a question you mentioned it earlier that of course sealcoat doesn't take care of potholes but the question is do we make sure that the potholes are filled and taken care of

[0:41:20] or we sill coat because what people say is happening is we're still coding over potholes and the pot hoe still exists of course cuz sealcoating isn't killing the potholes but are we coordinated so the potholes are done first and then sealcoat follows yes we do actually engineering and operations does work hand in hand in that we actually started working on the streets about three months prior to the silk coding process however the street and bridge department is kind of had a crisis of personnel they lost around 12 people and we're extremely short-handed they just barely had enough individuals to maintain a normal schedule and so therefore this year we didn't quite have as much attention just because of the lack of personnel that that department was experiencing and so we do work ahead of them with them that the cilco budget actually comes from operations in street and bridge so they're very well aware of what our timeframes are we coordinate that typically we give them the map about three to four months ahead of time so they can get a jump on it it's just that this year they were just so so short-staffed that they experienced difficulty and getting ahead of us as much as they would have liked to so when someone says my streets now been steel coated but I still have potholes what's the answer the answer on that is that they can still come in and actually repair that pothole on top of the sill coat the mix that they use for those potholes actually has some of the same properties the seal coat does to be able to prevent that water from getting into it and so it's just a matter of patching the pothole on top of it but in terms of the the street itself is really it's not it's not gonna have any issues with it I also have noticed that when there's seal coating going on that very often there's vehicles still on the street so they work around the vehicle what do we do in terms of communication to make sure people understand all vehicles are off the road and then how do we go back because it's got to be time-consuming to fill in those areas

[0:43:22] where the vehicles remain parked on the street absolutely and you know we we actually leave the door-to-door notifications of the residents up to the contract because they actually kind of dictate the schedule and the speed at which they're working we have asked on on most of our contracts that all the residents being notified about two days in advance we also to put out public information announcements through Andy through the news media the sealcoat is going to be happening you know we we have the contract here before council so we are notifying the public as much as we can the reality of it is is if some people just don't make it a priority to move and in those particular instance the term for that and the terminology for that is called a skip which means literally they have to skip that space now engineering has actually been working with legal as to how we can deal with this because other cities actually have a towing item in their contract to where they literally will grab onto that vehicle they will put the vehicle on a tow truck they will turn it around the block they'll do the the seal coat and they will set it back in place when we give the public notification on their door do we tell them we're gonna do that or do we just kind of let it be hey if your cars they're like whatever at this point we don't do towing because we have not been able to work out the legal hurdles and the responsibilities and the liabilities and things like that Midland and Odessa and some of the other cities actually have it in their ordinance that for this maintenance operation they can and will tow vehicles at this time we don't have it because there is some concern about about the liability issues and so engineering has been working with legal over the last year to try to resolve this and are still working on it and and hopefully we'll have an answer for that in the near future those spots still bear with where we ran into those situations this year there there are some most of them we end up getting remedied by by the

[0:45:26] pressure of the neighbors in the area because when someone leaves their vehicle they're usually all their neighbors are the one that calls the engineering office and let us know and we just kindly just ask them to go and communicate with that neighbor to get their vehicle out of the way and let us know and we'll come back and do it and I would say about 95% of the time that vehicle gets moved Lance I have a question you know you made it very clear that the potholes and rough roads are not remedied by the seal coating so is there a plan to deal with the rough roads I've had calls from people saying you know these rough roads have my car rattling and everything so is there a plan to deal with rough roads so we do have a plan you know as you guys well know that the major major roadways with our CIP projects we are dealing with a lot of the major roadways as you guys also know that council approved a new piece of machinery for the street and bridge which is a reclaimer or a recycler and so the whole idea is that they can actually then go into a neighborhood and go through some of these old roadways and and literally rehabilitate the roadway roadway in place and so we are looking at that they are working on trying to get that dialed in and and and make that operationally better but that is really the the direction we're going this is that machine is gonna primarily be more of neighborhoods and collectors and and the lower traffic stuff the CIP is gonna handle the larger traffic areas and so we do have a plan in place to try to get to that time frame that I would have to defer to our operational department I know that Shane is working on that with his crews and they have actually been doing a lot of test strips over here on south concho Drive and really trying to get that dialed in and and and make that something that can be done on a more a frequent basis and I'm sure that a lot of that is gonna once that's set roadways are gonna be examined and determined which ones are gonna be the

[0:47:28] best candidates to start with as well as our free grow study that we did a few years ago that talked about and rated all those roadways naturally the ones that are probably in the worst shape we're gonna be the ones that we tried to target first we didn't seal coat those first right cuz I think that's the question mark is if we've already seal coated them now we're gonna go back and tear up the seal coat to repair well Street because that doesn't sound financially correct actually it is because this sealcoat will preserve it and whatever state is in so it does not continue to get worse and worse and so if it's not in the best shape and we still code it at least where it's at right now we can kind of halt it to where it's at the other thing is that the aggregate and the oils and things like that that are in the seal coat actually are needed on a lot of those roadways to help to bring the oil content up when you repave it remember when I said as those oils wash out the aggregate is left alone so if we have an a roadway that's just all aggregate then the city has to go in and add oil into that mixture and that machine to get that oil level up so in some instances the oil that we're putting down is beneficial there are some instances where the well we put down maybe a little bit too much as well and so that's all part of evaluating those roadways and the quality control that we're doing as we're using that reclaiming machine if I remember correctly correct me if I'm wrong Shane I believe that question came up when we were purchasing the Benedetti and sealcoating actually helps the overall process before if the Benedetti would come up because it's rejuvenating it that way you can't you can yes and does a decrease cost on what we think it's five to six dollars per square yard with the Benedetti was it decrease it at that point even less that's about the cost of the operation of the machine the rejuvenator is probably that we have to use in the machine if we don't have enough all in

[0:49:30] that fault itself is probably one of the smallest costs we have with the machine so it's not going to reduce it a lot now one thing that we will do if we if we believe that we're going to schedule the road within say two to three years of recycling yet we will not actually we will try to not place a seal code on it just because a lot of times that very fresh seal coat can actually catch on fire faster and so if we have a real thick layer of silicone on there we try to we try not to have it within about a three year time frame to let that seal coat really cure out but other than that as lance said actually applying that to a road that's maybe three and a half four or five years out is actually a good thing so we can actually preserve the road in it in the best condition we're gonna be able to keep it in until we can get the recycler on that roadway I know the two questions in calls that I got with concerns from citizens on this year cycle was the potholes and the lack of rock so is it too late for some areas if you not can maybe go drive around and on our district and find so we can definitely look at that I will say that as far as the the quality of sealcoat engineering believes that this year's product was probably the best one we have seen in several years we really believe that we have in a lot of instances have been over applying Araku and that creates a lot of problem down the road it creates a lot of problems with sweeping one thing that engineering did make a move to do a few years back was to actually put out a much harder higher-quality rock and the reason for that is because in instances when the rock is over-applied or in instances when the oil is under applied that harder rock prevents it from turning into powder and actually just losing the whole whole silicon application and so you know we really were watching the rock rate this year because we really feel that it was over applied last year and created a lot of sweeping and created a lot of after work

[0:51:32] and and this year we really feel it's probably one of the better products in terms of the rock that was stuck down of course if we need to we can always apply a little bit more rock but the reality of it is that there's enough rock that the oil is staying down the oil is really our benefit and so you know there may be some edges or so maybe some intersections where ya might be able to use a little bit more rock but for the most part the we really believe that the what has gone down this year is probably one of the best products we've had in several years or is it question just a quick comment Lance and I appreciate this because during the sealcoating process all of us get a number of citizens that call and you educated me about four or five weeks ago and I certainly have been able to answer a lot of questions to a lot of citizens so thanks for the presentation absolutely and if you guys ever have questions on that we're more than welcome to answer them at any time thank you very much if I could I would like to with Council's approval may move item e up for presentation we have several people in the audience and because we're gonna have to break for a chamber luncheon I want to make sure that we get item e discussed before we break so if John James you would come up and present item E to us please item E is the first reading and public hearing of an ordinance for z17 - one - a rezoning from the general commercial heavy commercial CG CHS zoning district to the general commercial CG zoning district a ninety two point three six acres located between West Loop 306 frontage road and Southwest Boulevard generally known as the sunset mall and certain adjacent properties thank you again John James Director of Planning and Development Services as you mentioned this is a request to rezone

[0:53:35] basically this entire area of course the mall is is in the center there but it includes most of the retail area around the mall that has not already zoned similar to CG the long-range plan for this area does call for commercial zoning and as you see there it is general commercial and then all of this pink that you can see around the area is already zoned general commercial it's just this one spot around the mall that is the CGC H zoning so some of the reasons for approval of this the both our zoning ordinance and our adopted comprehensive plan both indicate that the CGC H zoning is was intended to be a temporary issue when a new zoning ordinance was adopted there were some areas like this that had an old zoning classification and at the time nobody was sure should it go to CG or should it go to CH and so the cgc H mix was created and again both the ordinance and the plan indicate that over time each of these areas should be looked at and a determination should be made is it more appropriate for CG zoning or is it more appropriate for CH zoning so it was always intended to be a temporary thing until the appropriate is owning for each of those areas is is determined as I understand it a few years ago staff looked at going throughout the whole city and finding all the CGC H and rezoning them kind of in mass and I think that that maybe wasn't the right tactic to take but in this case we're only looking at this one particular area we don't have any plans to go step by step looking throughout the city but as issues come up with rezoning of a particular property we look at the zoning of those areas for possible rezoning all of the uses in this area we were not able to find a single use that is not a lot that is not allowed in other words we're not

[0:55:37] creating any non-conforming uses in the area we believe that the some of the heavy commercial uses that would be allowed under C gch really just aren't appropriate for a retail area like them all and I'll talk a little bit more about that and another slide and then again this this whole area has developed consistent with the cg zoning had this been zoned cg back in 2000 when the ordinance was adopted I think everything would have gone along fine and it has not created any problems in terms of the cg zoning that is being requested we did send out our notifications 72 notices were sent out we got eight responses in favor you can see those in blue one in opposition which is the mall itself you may have seen the the letter that was sent by the mall manager indicating some of their reasons for opposing this rezoning and so we addressed each of their points one by one and our staff report but I wanted to briefly mention those here one of the most car-repair sears are typically known for having a car repair facility monitor car repair all changes tire changes belts hoses that those kinds of typical light car repair are allowed by right even under cg zoning but even the heavy top auto body shop Paint Shop transmission shop those are allowed with the conditional use we think that's appropriate that if you go into that more heavy top of car repair it probably should get an individualized review if it's placed in the middle of a retail area like this the same with retail distribution centers I think from from hearing from the mall manager I think they're thinking where a store like a Sears or JC Penney's gets into more of the online sales and distribution of those online sales if that's accessory to the retail use that is also allowed by right in general commercial it's only if that distribution center becomes the primary use like a you know an Amazon distribution center or Walmart

[0:57:40] distribution center then again it's not prohibited NCG it just requires that conditional use where the Planning Commission and ultimately you all could review the actual proposal how big is the building how many 18-wheel truck deliveries are there daily I was you that that individualized review indoor entertainment game arcades and Dave & Buster's those indoor entertainment would still be allowed by ride in CG zoning district we do have a classification in our ordinance called Game Hall originally written for pool halls billiard halls that is conditional use and would require a separate review and approval but we're actually right now looking at the process of just eliminating that we don't think we need to have that distinction between other indoor entertainment and pool and billiard halls so that would that would fix that but again it would be allowed with the conditional use and then one of them was a plant nursery although our ordinance distinguishes between plant production which is what our ordinance calls a plant nursery versus plant sales so the kinds of plant sales that Lowe's or Home Depot those would all be allowed in a cg so a typical home home good store home improvement store any plant sales related to that would also be allowed the one other concern that's been raised is the former lumberyard that's right now blue cross lumberyard is allowed by rod and CG both the Home Depot and Lowe's are ncg zoning so that type of use is allowed within CG the only distinction really is the amount of outdoor storage allowed in the cgc H you can have pretty much unlimited outdoor storage versus in the cg zoning it's limited to 10% of the side now with that particular lumberyard all of the lumber storage in the rear of that if that were to become a lumberyard again all of that is under roofs and so that doesn't count towards outdoor storage if it's if it's

[0:59:45] under a roof it would only be purely outdoor storage that would be affected so we think if if that were to reopen similar to what it had been in the past that would that would still be allowed in the CG I wanted to mention one other thing that that I don't have in the slides here one of the comments that the mall manager indicated was about competing with other cities and you know maybe a store wants to come in and while it sounds like a conditional use isn't that owners of a process that extra month delay in getting that approval might mean the difference between us getting a business and maybe going to another mall we looked at all of our surrounding cities and Abilene's mall is owned general retail that's actually a little more restrictive than our general commercial they have a general commercial district in Abilene but but their mall is even more strictly regulated than that the Odessa mall is zoned like commercial again very similar to our general commercial in some ways a little more restrictive doesn't allow as many uses Wichita Falls mall is zoned general commercial again very similar to our zoning and then the Amarillo Midland and Lubbock malls all have planned development zoning unique zoning for those sites but all based on general commercial type zoning so we think this is a reasonable change as you know as I note here the Planning Commission did approve it unanimously with that I'd be happy to answer any questions and when you talk about conditional use since that was one of the concerns that was mentioned does the process take up to a month to review that because it would come to you and then it would go to the Planning Commission and then it would come to us well it only comes to you if it's appealed the Planning Commission makes the final decision so once we get an application it would go on to the next Planning Commission meeting and so depending on the timing of when during

[1:01:48] the month they get in an application it would be on it could be a month to maybe six weeks if if they applied just after the you know the most recent Planning Commission and then again the Planning Commission makes that final decision so it would be typically that month timeframe only if the Planning Commission denied it and the applicant then wanted to - you wouldn't come to you one of the things John is as you were talking you mentioned I guess the year 2000 is that when city ordinance indicates that we were looking from changing that combined c g and c h to either one or the other yes unless i've got my dates wrong i think that that was the the zoning ordinance that was a major change in the ordinance in 2000 was there any agreement that you're aware of that it would stay the cgc h as long as they wanted to are just until the specific designation could be made that make question makes sense well he doesn't and obviously I wasn't here at that time and all I can go by is what was written into the ordinance itself which indicated that the CGC H is a transition zone that should be looked at going to either the CG or CH or some other district if it's appropriate that was the language written into the ordinance that was also the language written into the comprehensive plan which was subsequently updated and I forget the data I want to say 2009 but if there were other discussions at the time those did not make it into the ordinance or the comprehensive plan prompted you to look at that this at that time it's at this time was it just on your list all of this C gch properties to take a look at it and you're going through that

[1:03:51] pretty methodical II well actually no we as I mentioned earlier we're not we don't have any plans to go throughout the city looking at CG CH for rezoning this really came up largely as part of the discussion if you recall the conditional use that did come to you on appeal for the dog boarding facility in this general area and so in the discussion of that the Planning Commission in looking at the zoning and some of the concerns of the neighbors of what could be allowed in that zoning in the mall area the Planning Commission recommended that we review this area for rezoning that's what that's what prompted it let me ask you a question we talked about for example Amazon wouldn't be able to open up there but if a Walmart or a Target who don't have enough additional space at their current locations chose to use let's say the Sears store as a distribution center for local deliveries would that be allowed it would have to get the conditional use to review the the details of what they were proposing so it it wouldn't be allowed by right but it would be allowed if they got an approved conditional use from the plant yeah wouldn't necessarily say 50 percent but really the question is what is the primary use of the building if the primary use is retail and the distribution is sort of an accessory to that then it would just be allowed by right if it was the primary use was distribution then that's what would prompt it to be a conditional use but when we say conditional use it really could take six weeks eight weeks between initial depending on when the next Planning Commission meeting happened the next city council meeting happened etc so when we're talking about conditional use it tends to turn off people more than it tends to make someone feel like they have an option to move forward I think that's correct although it's also correct that it gives the neighbors some feeling of protection of knowing that if

[1:05:54] these heavier uses go in they would get a notification and have some say in terms of looking at things like lighting and number of deliveries and all of those negative impacts that might impact even though you Jason retail uses of course when we were talking about the dog situation that had an immediate backdoor neighbor called residential to it when you talk about the mall you don't really have a backdoor neighbor that's residential well no this area includes all of these other commercial areas some of which do backup right to those neighbors so the mall itself does not but this this impacts the retail zoning here and here that is immediately so one could actually ask that if in in this conversation that we asked to have pulled out of this changing of zoning the BlueCross BlueShield building as well as the mall and with the approval of the rest of it with a change of zoning but we could exclude those two properties that's correct as with any zoning you have the ability to rezone the entire area that's that's before you or none or some mixture you you can definitely with remove particular properties if that's your choice and I got a question since the mall is kind of a different animal compared to all of the other stores and areas around there since you have multiple uses could you go ahead and tie a special conditional use to it that way it can kind of someone's looking to come in it kind of expedited that it comes directly to us we've already got especially used that they could use some kind of warehouse standards that way if someone's looking to come in doesn't have to go through another process of planning I think the concern there is the I think if I could speak for the mall manager I think their concern is they're not sure where the markets going so as soon as we preemptively say hey let's do a

[1:07:57] conditional use for a distribution center well then the use that actually comes in would be something different I don't limit that we've all see what's going on with the online sales and if we have an opportunity for Sears or dillards JC Penney's to be using that as a distribution center and that's going to be the make-or-break of them staying or going I don't want to downgrade a zoning and prevent that so an option that would maybe better get at what you're talking about would maybe be a planned development for the mall that would be largely based on CG but that would allow some of these other uses without the conditional use that would be kind of a middle ground someone wanted to turn the Sears store into living space is that that no not at the moment not under our current our current zoning in fact there's a case later on on the agenda where property is being rezone because it's in the CGT zoning but it is being used as apartments and so it's it's in violation now and this is remedying that problem but right now we do not allow apartments that would be another benefit of something like a PD I know in looking at malls around the country that's one of the popular things that malls are doing is building apartments within the mall footprint and developing more of an urban feel but that's something they also couldn't do today did you have any comments from anyone that that has purchased property knowing that they could do something in Ch because it has the designation that if theirs were changed to solely CG that we could be impacting something they may have just being in kind of in the planning stage

[1:09:59] in their mind did you have any comments from any property owners in the area the only one would be that blue cross building that the example that I used if they wanted to go back to a lumber yard none of the other businesses and in fact some of the businesses that didn't respond to us verbally told us they were fine with this zoning because it meets their standards but I'm not aware of anyone other than just sort of thinking what could happen I'm not aware of anyone who has current plans to do anything that would need the CGC H zoning another question you know sometimes boards and commissions as well as City Council make some decisions today that we while we don't have the crystal ball I understand that sometimes we don't think through some of the potential ramifications down the road can you think of some things if this work changed to the CG some potential ramifications that would be Etra mental to future use you know I I don't think so I mean again most of the uses that have been identified as people having a concern that wouldn't be allowed under the CGT zoning almost all of those are allowed with the conditional use so it's it's that extra hurtle yes but most of those uses would be done my concern is actually the reverse of some of the things that could happen under the current zoning that would clearly be opposed by the neighbors and maybe even that the residential neighbors well the example of a distribution center if somebody wanted to turn the Sears into no retail at all in a full-scale distribution center you might have dozens or even hundreds of 18-wheeler trucks coming and go on a day and I don't the logic of that wouldn't seem to be so because the location of that space and the ability to get to loop 306 would not be very conducive to

[1:12:01] someone thinking they could haul a lot of 18 wheelers in and out of there that's the same problem we ran into and our goal is to protect the property as well as the surroundings so the sand issue we had not that long ago this was an area that counsel asked us to look at to make sure that our zoning ordinance where there were recommendations in it the things were put in place to protect against those kind of things so I think you know that was an example of we thought okay probably not likely but it snuck up on us so this is a way to try and make that work in both regards if possible there isn't any railroad going right by this one right no but whatever else would there be well you know some of the auto you know if somebody wanted to purchase one of these properties right next to the residential and put in an auto body shop with a paint shop those are the kinds of things if somebody came in today to want to do that we there's nothing we could do not only we it's not prohibited we couldn't put any conditions in place in terms of screening or keeping the the paint room at least a hundred feet from the residential anything like that so that's another example of something that is currently allowed that could be problematic in at least in parts of this area um did you have a question it's just interjection I've been getting some calls the past month in my district I'm apparently somebody I don't know if it's a VPS out of Odessa or a commercial truck driving school is routing in through SMD - and they're actually going to the old Lakeview gymnasium turnaround but I mean we see 15 to 20 trucks going right down little two-lane roads that aren't 24 you know 30 feet wide and it's it's becoming a big problem and it's it surprised me that it did but I do see that and that's my only concern here is is it actually functional as a distribution center I mean would we actually do that or would we try to get them out at our new facility to go with this I that's my concerns commercial traffic on this but I've spoken with Sabrina and some people in you know I

[1:14:03] think there'll be time to hear the other side of this point too is we don't want to do anything to impair growth of business here I mean that's the whole point is let's not impair them with any move we make today but then again we do have to protect those neighbors just like we did with those when we looked at that you know dog boarding facility so and don't forget that that encouraging business also means having an inviting business area where other retailers want to go and so as soon as you introduce something that's maybe slightly more obnoxious than normal retail that might discourage other retail in that same area so you don't want to detract from the whole area that also would say that if I'm if I own the mall I'm gonna be very protective of my mall meaning I don't want to create an environment let's say that would make other people want to break their leases I mean obviously what they want to do is to get the best possible use out of all the square footage that they have and they don't want to make a decision that's going to have a negative impact on future leases being developed and certainly in that instance of a paint shop you probably would get a lot of people who wouldn't want a lease additional space if the paint shop was right there so I would hope that when we talk about a mall owner their biggest objective is to lease space and to keep existing least as lease Orr's happy so they don't want to be damaging to their own facility what they're trying to do is get maximum flexibility for the best possible mall and since it is our only mall I want to make sure that we have the best possible opportunity to lease that space to create something positive for this city and we must have them all in this city we cannot be a city without them all I just wonder at this point if we could hear something from the other side John is I think a motion first Billy in order to do that for public comment it's

[1:16:13] really up to your discretion mayor has to so is there public comment that would like to come forward and speak before before John like at least let me just make a comment I've I've heard all of this I sit in the Planning Commission meeting when we discussed this so I've heard heard all of the information I've heard the concerns up here but in in in the long run what we're trying to do is make sure that we're we're protecting the citizens in this particular area and even though we feel like the management of the mall will never do anything to jeopardize that thing bottom line is is our responsibility to make sure that we're we're protecting everybody in that that area residents commercial property everything else and as long as they can get a conditional use on everything that we talked about I think the best thing for them for everyone is to consider making this particular change back to CG and let us go forward with it comment please good morning thank you for allowing me to speak for a moment my name is Sabrina torch and I'm the new general manager for sunset mall while I'm new to the position I'm not new to the mall I've been there for the last eight years a specialty leasing and marketing manager and as was mentioned the outgoing manager Stephen Isles had spoke with Planning and Zoning and thank you for putting those points up on the board to share those so I don't have to reiterate those but I did want to make a few points on behalf of Sunset mall sunset mall is Pro economic development we support business we support creating jobs that being said we also support the community and strive to bring you so they're going to benefit the community in addition we're leader and community events in San Angelo and enjoy engaging would you put the microphone a little close to your mouth thank you this reclassification however is coming at a time when malls nationwide are changing

[1:18:16] malls are not just retail anymore since that mall wants to continue to generate a healthy sales tax for the city we also want to continue to contribute to the property taxes in our area which is a commercial real estate is based on the income ratio approach so the more money the more a business is worth the more property taxes they're contributing in order to do this we've already been seeking out alternative uses not just retail but alternative uses that makes sense with retail to meet the needs of the community we also have two min to fit into internal lease restrictions we already have in place which was kind of touched on already with our department stores by removing the commercial heavy zoning district to general commercial there are a few items such as wholesale trade warehouse and freight movement that would turn into conditional uses other items such as apparel a shoe fabrication optical and scientific instrument fabrication that would be moved all together so why is this important it's been said well those things aren't at the mall or any of those other businesses right now well it's important because not of what is there right now but what is could be times are changing did anybody here have a cell phone in 1979 when the mall opened no but now we have about four stores that sell cell phones accessories and fixed phones you know 20 years ago we were paying $25 for at a music store those CDs are used as coasters now and I haven't seen a music store in years the point is that things will change how is to be seen and in leasing time kills all deals it also opens up the chance for additional opposition so having to go through those additional permissions could and most likely will hinder our location being chosen over another that does not have such restriction that being said deals could be dead before they have a chance now there may be some misconception that there's already a deal and work for Sears as a distribution center that is not the case right now however we are already looking for those uses different kind of uses as I said we are committed to evolving in a positive way for our community so that we do stay

[1:20:19] viable in additional restrictions have the potential to limit the growth not only for our mall but for those businesses around us thank you do you have any questions is anyone what one time Sabrina a question I guess I'd a a Sabrina if they're looking at other uses is there any use that you can think of that may not be allowed by making this change again since we don't really know what all those uses are I can't say for sure and I think some of these I've looked at the different general commercial and heavy commercial zoning district uses and of course some are vague but for example you know apparel and shoe fabrication I guess that would depend what that is but I don't you know see a lot of damage being done you know if someone was making clothes and you know in a space you know of course not with all the try the 18-wheeler heavy traffic that basically to say a factory yeah I'm not sure just a fabrication John is that a factory well our ordinance makes distinctions we have if if it's a shoe store that also creates shoes in the back to sell that would just be accessory to the retail use and it would be allowed if we also have a category called artisan manufacturing and that's similar that if if you're creating it for ultimate retail sale that would also be allowed it would only be the full-scale shoe factory that would not be allowed and so I think our ordinance has tried to make that distinction the kinds of fabrication that I would see going into the mall is already addressed by ordinance and would be allowed it's really the full-scale wholesale shoe creation and fabrication and distribution that's the only thing that would manufacturing but we've in the past not too long ago shut down the opportunity for someone to put in a factory that made luggage that made backpacks even when they were going to

[1:22:24] create a retail store in front so I get very concerned that when the wrong person sitting in the wrong seat that that person will shut it down instead of look at the broader picture which is what you just said and it killed the business opportunity because of that it's the statement just a fact we have another yesterday I heard a term for the first time that I had not heard before and it was called down zoning is there someone that can speak to the impact that with him I would defer to there may be some public that wants to talk about that down zoning is really just taking the zoning from a classification that allows more things and zoning it to something that allows fewer things and so that could speak to the adverse potential adverse impact of down zoning and let's finish this discussion then we'll talk about down zoning so is there further comment on oh I thought she was through him she might be but there are other people in the audience I Sabrina if you look at this first is there anything here that this zone change would cause heartburn I mean when you're trying to make a deal I know we hear things in in our conversation here today sometimes speed is of the essence sometimes it's we think speed is of the essence but actually six weeks is a is a very short workable window but is there anything in this zone change that may because there's a little heartburn as you look at it that would be difficult for you doing business going forward as always the essence I would say a day could kill a deal I mean I mean previously I've worked more on the specialty leasing which is a temporary side but not getting back to somebody within a day can kill a deal so permanent leasing you may have a little bit more time than a day but six weeks four weeks yes definitely and they know that there's a conditional use they might not even consider it because they

[1:24:26] don't want to deal with any additional red tape and we've lost deals when two days were an issue it is an issue timing is everything I think what Harry said has married here and I see your side too judges we're worried about some of the residential here and protecting both sides of the street may be interesting to see what somebody else thank you something I understand thank you very much for your time and you know I I agree I think oh thank you see the instance you have come forward economic development is an absolute priority for us to look at increase in our tax base but I think we have to be very good stewards of our community in San Angelo and so that was one of the things that I think we were tasked with when we campaigned and were voted into this position is to be good stewards of our resources and you know to listen and be aware of our citizens concerns and if the citizens in that area did not want a vet clinic a dog an animal shelter in clinic and grooming facilities you know I struggle with wanting to put something that may be more onerous in there and absolutely is a backup to residential area there's some apartments that are under what southwest side of the mall that would be residential as well so you know I just think we have to take more than the fact that additional use may take six to eight weeks to take a look at and you know kill a deal I just think we have to you know be more inclusive of what we look at more big picture please come forward morning mayor and council I'm Steve Eustace I'm in the commercial investment real estate business and we

[1:26:30] represent commercial property owners and retailers and users and hopefully people that are trying to move to San Angelo I'm very familiar with the cgc H zoning classification because I was very much a part of creating it when it was created it was a compromise allow people that had C to zone property not to lose their rights just quick history we used to have C 1 C 2 C 3 type zonings and I think year 2000 when we went to CEO for neighborhood for office commercial office cen for neighborhood commercial then C G for general commercial and CH for heavy the attempt was going to be to take all C to properties in San Angelo which at that time there were more than 2000 of them we're talking about all up and down north Chadbourne South Carolyn Boogaard sure would weigh all over the city there's more than 2000 pieces of property that are zoned CG CH at that time they were C 2 and they were just gonna instantly be put in C G which they were going to lose a lot of rights uses you've heard talked about outside storage so as a compromise to not allow people to lose right to use their properties in certain ways we compromised and created this category as a grandfathering category to put all the c2 properties into and to my knowledge and recollection there was no caveat in that ordinance that said we do this just temporarily now there may abandon John and I both have talked about going back and reading the ordinance it was adopted

[1:28:41] and this was in the handout you guys received it says the CGC h district is intended as a transitional district for areas previously zone c2 it is intended that the areas with ncgc edge zoning districts will be changed to other zoning districts based on comprehensive land use plans adopted by the City Council that's from the CG age section of the in the ordinance that was passed in its finality the evening of the City Council meeting okay well I don't recall that but be that as it may we're still opposed to this change you know CG CH has a right to exist you don't get to go apply for those CGC edge rights in one thing I went to ask the city the report I'm looking at states that the petitioner is the city of San Angelo about what action did the city make this specific request to rezone this property was this something this council did to request that change I think John brought that up earlier when we had rezone what used to be the roses and it was the dog park at that point in time Planning Commission looked at the mall he brought that up earlier in the Planning Commission I mean it's the city's the petitioner dozen the council have to do that I'm not trying to be nitpick I'm just trying to figure out why this exactly came up and we targeted that area what my question was to John earlier what prompted this and that's what he was sharing with us when we had the other case before us about the grooming facility going in there that prompted the planning department to take a look at that so it wasn't the council that prompted it that well you

[1:30:46] know I've talked to a couple of Planning Commission people and the interpretation they got was that they were being directed by City Council to to pass this so I'm just trying to figure out where where this all came from the overhead that day did say City Council directive or approved etc which was might have been true of previous City Council's but it was never something that this city council directed to make happen yeah and it's I just think it's an unfortunate situation that were attempting to rezone several properties that the owners of these properties don't even want their properties rezone didn't ask for it and certainly don't want it I think the letters that went out in support that came back and supported these those are from residential people I don't think and I don't know I'm just did you get any letters back from commercial owners in support of this in okay that's what's that's an apartment complex that's a house that has that house that tells that tells I don't see any commercial properties and your rezoning their property against their will that just doesn't seem like to me and also want to point out that I don't think a lot of people that own commercial property have any idea that this action is going on Steve Stevens was here but he had to leave he had an appointment at 10:00 he had no idea he's one of the owners of the Blue Cross Blue Shield building he had no idea that was this was going on until I told him he like many others there their notices go to either a tack service or many of these properties are owned by

[1:32:48] corporations that you know the mail goes to wherever and they they're not paying that much attention to who would have thought you're gonna try to resume my property you know we get these notices all the time about there's a zone change in there and most people don't take care of it don't think you think about it it's none of my business doesn't bother me so I would contend that there's a lot of people that don't even know that you're gonna resume their property the reason Steve Stevens would be opposed to this is he it's been referred as the old lumber yard that was a lumber store until it closed it is at least two BlueCross BlueShield the back of that building has huge outside storage areas there are covers over some of them but if BlueCross BlueShield were to move at the end of their lease and we hope they stay here forever but if they do leave you know it's not gonna be a lumber store but it could be somebody that needs a lot of outside storage I'm gonna go out on the limb move it cuz I've got to be careful what I say but we've been working with a company for over two years there's a major company that has retail commercial wholesale retail let's just say they're in the home type business they need a lot of outside storage they're willing to scream they're willing to do whatever we have not been able to find them a location because of outside storage we did find one but after surveying the situation we knew we'd never get I would never get a conditional use past when companies come to town you know we say well they can get a conditional use option you know you we've talked about the time but also nobody wants it disclosed publicly that they're coming or looking

[1:34:53] until the deal is ready to be done and so when you go to get a conditional use option those companies have to stand up here in front of the world and talk about what they're gonna do with that property and they don't want to do that I promise you that they don't want to do that so you know there's not been any problems cause that the one is you've talked about it's the dog grooming thing that worked like a charm they had to go get a conditional use and it was turned down can anybody tell me a problem that cgc I just caused I just don't think there is one this is not necessary and I just don't want to start down this road again we've we've been down this road a few times before and first it was an attempt four five six years ago to do the entire city and just don't need to get back into this thing I just don't think that there's a problem what are we trying to solve I don't think there is one I would ask you to vote against this place any questions for Steve Jim I think you we're gonna make a comment last lacy one of you to please come forward I'm Jim Turner and I guess I'm getting well enough known to people that want to make a comment I thank you for your patience and everything I'm this type of action here affects me for a number of reasons one of which is I'm on the Zoning Board I'm right now they tear up their Zoning Board and we went through the process or a process that could come out of something like this with the sand redistribution and the zoning that as

[1:37:01] appropriate for things like this there are right now zoning needs to change because it's driven by things that are changing transportation wisdom every one of the major driving forces are zoning to begin with and how things were distributed that's changing dramatically with possibility of drones the new distribution center model but a lot of things are going to and just the intensity of traffic which is one of the major factors that we have problems with on the fraks and plant in some ways zoning needs to change in this area but in other ways that may be premature because you're aiming for a moving target here and what we're talking about even the most leading-edge stuff that we're talking about today 50 years ago nobody thought sand distribution was gonna ever happen here locally but it did similar things gonna happen with all your commercial properties and all your residential properties are going to be affected as well because of this changing way that people do things more so you have a tough decision in front of you and I'm not sure that you really have a enough information to make that an adequate decision for this property right now because you're kind of guessing it long-term effects and that conditional use may work ah and I'm not sure that that's true I think we need to review some of how we're doing zoning not only the fact that we have it thank you Lance would you come forward good morning my name is Lance lacy I am

[1:39:08] the broker owner of Lyceum company Realty and those of you who know me know that I have spent a considerable amount of my life and the protection of private property rights and and so I come forward today to talk to you about that nobody absolutely as Steve said once a rights taken away from them on the property and you or I either one would not want that I'm just gonna make a couple of points not to be redundant but the things that Steve said but back when this was zone C gch there was nothing else around the mall and so all of that residential area all those other areas have filled in since then I can tell you having been a developer on residential property that backs up to commercial property those Lots do not sell for as much as Lots that do not back up to commercial property the market has accepted that the residential market has accepted that they are backing up to commercial property and so that hadn't changed so I come forward and and just say that I don't believe that we would be doing the right thing for those folks my recognition is that which Steve had There was stranded property rights when we change that zoning classification and I did not recognize that it was meant to go away but I didn't write the history to it you get up you walk away you go back to working and you do what's done and so those who rat the history behind that meeting may have made the indication that it was a temporary that it was transitional and in fact its stranded is what it is those property rights the concern on the council at that point in time was that that those owners of those individual properties stood to lose and that wasn't their intent it was for a future growth of the city of San Angelo how do we create a little bit tighter zoning going forward but not to hurt those that have already

[1:41:10] invested in their properties here in San Angelo and so again just offer a little bit different perspective along those lines I would also ask for you to vote against this motion that's being brought before you tonight thank you thank you do we have further public comment Billy did you say Peyton one clarification has been stated a couple of times that this indication that this would be subject to change in the future was historical somehow it is actually written into the Code of Ordinances which I think John clarified it specifically says in our code is intended the areas which is within CGC H zoning districts will be changed to other zoning districts based on comprehensive land use plans adopted by City Council so this is not just a notation in the history of this case or this ordinance this is actual ordinance language that the Planning Department is following I just want to say I appreciate what mr. Lacey said about private property rights because I am a strong advocate for personal property private property rights however in this situation I think that we would not be effectively doing our job if we are to paying attention to what is going in and where it's going in I hate to think of us losing a potential business opportunity coming to San Angelo because we want to have an oversight over what goes in and where it goes in I just think that's prudent stewardship as I said earlier so you know I just don't think requesting seeking a conditional use is unreasonable in this case so with all of that said I am going to make a motion that we approve the zoning change as requested

[1:43:17] and I'll suck at that there's been a motion to accept the zoning change as presented all those in favor say aye aye opposed aye we get a show of hands all in favor say aye 4 in favor opposed 3 opposed motion carries I think we need to make sure when we have presentations to the Planning Commission that in fact we are sure that the City Council as it is seated today is in support and as requested it not something from a previous council could you clarify that mayor I'm sorry I don't understand what you're saying what I am saying is when the presentation was made on this overhead slide it specifically stated that the City Council was in favor of the change which we were not okay ever bright it was never brought to the table of this council to support that statement okay so if the Planning Commission believed that it had come forward to them with our backing okay which was not true I would apologize if the Planning Commission took it that way I think the intent of staff is that as Teresa mentioned this is a item that was endorsed by council as being the directive to staff as how to carry it out so if they interpreted that as this current council felt that way we

[1:45:20] apologize I think the intent of staff was to point out this is directive given to us through the ordinances adopted by City Council and and were to follow those until we're told differently as far as the ordinance goes so if that happened we apologize and I also would ask that council not in those meetings represent the entire council so I don't want anyone coming forward and making a presentation and a statement that says this council supports that move forward on it because it was not with this Council's approval I was in I was in the Planning Commission meeting and that did not happen I mean there was no no council person came to came to the microphone so in that particular instance it was simply the Planning Commission listen to what the staff had to say and they made their decision many of the people that are in the room today that made presentations were there on the Planning Commission meeting that made presentations that day so that's seven o vote for the Planning Commission was similar to what we heard this morning at the council level we'll move on item B consider authorizing the city manager to increase the award amount of our FCS PE s o8 1/7 2017 annual silk project to Ronald Wagner & Company LP and an amount of $49,000 above the previous supposed not to exceed sum of two million four hundred and forty thousand dollars Lance you're back on assistant city engineering June services and what we have going on here is two things as you guys may have recalled in the presentation this seemed like it was hours ago the the silicone oil displaced down is placed down at a rate that's usually an approximate rate when we set that every year we kind of make our estimates based upon the rate that we think it's going to be and based upon what the historical rate has been and this last year because of a couple of

[1:47:24] factors actually three factors in particular one the temperatures were a little cooler during the season we were applying the oil the roads we're in a little bit poorer condition than some of the ones we've seen with a lot of cracks and then also to the area that we seal coded which was in the College Hills area in the Santa Rita area has a large amount of tree coverage and that tree coverage actually shades the roadway and cools that roadway well with all of those different factors we had actually placed the oil down into thicker rate than what we have historically done and so what that has actually done is it's a made us of where we are in need of a little bit more funds to to finish completion of the sill coat and project and the striping those funds are budgeted in operations so it's not something that's a needed that's above and beyond the budgeted funds however when we awarded the contract we actually put not-to-exceed and so therefore since we put not to exceed that could not be done by Daniel E or by the city manager and so that's why we're here today is just to ask for some additional funds to finish off that project and that's what Lance this job is already completed correct the silk coat portion is they are finishing sweeping and they still have the striping portion of it to complete the way that that project is set is that 30 days after the silk coat has been installed they're required to do a second sweeping and that picks up any loose Rock that wasn't seated and they have started that but that's not complete and then also to after that second sweeping then they come back through and they do all the striping so all of the crosswalks all the long line stripes all of the stop bars those things are yet to be completed so the contract is still actually is active right now any further question for Lance and do I have a motion to approve the additional $49,000 as requested almost second all in favor any opposed passes 7 0 item C consider awarding rfb

[1:49:34] es o 9 1 7 soulful sulfur draw sewer project to darnell construction LLC in the amount of three million eight hundred eighty four thousand one hundred ninety budgeted for purchase in the wastewater capital improvement fund and authorizing the city manager to negotiate and execute any related documents Russell you're on alright thank you yes this is a sewer rehabilitation project in the Santa Rita area its will be replacing two existing sewer mains that parallel each other that run along their sulfur drol park it's approximate it's a eight inch and a 10 inch sewer main that are approximately five thousand feet in length and it cuts through several residential lots and backyards and things of that nature just how it was constructed originally we initially approached this project we looked at several different design considerations some were you know looking at going back through the existing alignment alternate routes kind of zigzagging through the neighborhood keeping it in the street trying to get it out of the residential lots and also different rehabilitation methods as you know doing a cure in place pipe type method so what we ultimately came up with was a combination of those considerations so what we're gonna be going in with this is approximately 1,000 150 feet of 18 inch sewer main and eight hundred feet of 30 inch gravity sewer main along with a lift station approximately 2,500 feet of sewer force main 4,200 feet of trenchless technology or the cured emplace pipe methods that I explained earlier and our estimated construction cost for this project we're initially at right at four million dollars

[1:51:39] just kind of give you a brief overview of the project you know here's the sulfur draw area is through here US highway 87 is on the east side and Washington Street kind of cuts through the middle of the project our sewer lift station will be here at the corner of Washington and Algeria and the blue lines shown here are the lines that will be rehabbing with the carrot in place pipe that dudes it'll stay in the current location going through the yards and everything but it it'll be having basically a new line inserted in the existing line the red lines shown here are the lines that will be abandoning and we won't actually be removing those what we'll be doing so it's less invasive we'll be filling them full of grout and banding him that way so that way no flow can go through and then if anybody's digging in the future they hit it that you know they're it's a solid solid line the black lines shown here are where we'll be placing the new 18 inch and 30 inch sewer mains and force mains that I discussed earlier we put this project out for bid and we received two bids one from Darnell construction out of San Angelo and one from utility contractors of America also known as you CA out of Lubbock Darnell's base bid amount was three million eight hundred and eighty four thousand dollars are a little bit over that and then you see A's base bid came in at four million six hundred eighty three thousand at this point we recommend moving forward with the contract with Darnell construction for the three million eight hundred and eighty four thousand one hundred ninety dollars and allowed the city manager to negotiate and execute that contract for either the base bid or the base bid plus alternate bid number two depending on which method of the

[1:53:42] control river-crossing is selected in both odds and both of those options are still under consideration with that have any questions this has been a long time coming and probably the first issue during my newly elected official orientation that I had Allyson and Bill Riley presented this with me and a lot of time a lot of work Thank You Alison for all of your countless hours that you've put into this Russell for your presentation and Andy for his presentation at our town hall the other night I love this idea that it gets it out of the private areas no damage to private properties come condemnation with that I'll move to approve I will second that motion is there any public comment you say on there depending upon which method of concha River Creek Crossing is selected I thought that it had already been selected well the reason it's under negotiation is the three and I'll go back here the way we bid this project out was with three alternate methods and three alternate methods were just all based on the crossing of the concho River and so obviously there's a lot of rock in that area there's a environmental concerns with taking us who remain across the river and what we're actually looking at or one of mostly focus on is this lesser option here it's less invasive it's a what we'll be doing or what that option is is to actually bore underneath the concho River it has a lot fewer environmental concerns and but should they get into the middle of boring that it they prove you know unable to accomplish that we want to at least have this original method which is basically just laying the force main on the bottom of the control River with concrete collars and encased in a you know a casing pipe and you know it just

[1:55:49] gives us a couple of alternatives going this direction moving forward in case they're unable to bore it than the less invasive construction method so basically only if after they get into the process of this well we know whether bid 1 or bid 2 is going to happen correct and to what we've negotiated with them as well is that if they choose to bore this project and they get halfway and they are unsuccessful that we're only going to pay for one method of construction so we're not gonna pay you know double or one and a half times more amount would be 4 million $62 and 150 know the maximum amount what we're asking for approval today is in the amount of three million eight hundred and eighty four thousand one hundred ninety dollars alternative is this there's a bottom figure did right so we're so this second option is what the two that I put in my recommendation that again so my recommendation was to award you know for either the base bid or the basement plus alternate bid item number two depending upon which method of the contra River crossing is selected thank you for clarification there's been a motion in a second all in favor say aye I think any opposed motion passes here's that list stationed in your front yard [Laughter] but it was amazing at the town hall meeting meeting only two citizens there were we were highly as city staff very heavy-handed overpowered so the meeting was went over very well you so wanted to clarify that she was the third citizen 30 she was there as a citizen well I guess I could have been either as well

[1:57:57] okay D item consider awarding rfb es o six one seven College Hills Boulevard Mill and overlay project therese albert and authorizing the city manager to negotiate and execute an agreement in amount of eight hundred ninety five thousand nine hundred sixty two and ninety five cents wrestled take it on alright the college hills mill and overlay project just to let you know kind of the scope of the project is on college hills from the 306 to valley view it's approximately one mile in length it will be in a mill and overlay project primarily but on either end or the north end in the south end of the project where we have some noticeable base failures we are going to actually reconstruct those areas it's just you know minimal amount on the project will also be constructing some under drains and are basically french drains uh near the champion circle area basically what we have going on in that areas we have a very high ground water table and to make it more constructible and to keep the water from you know leaching up into the pavement you know we're creating a french drain system underneath that area and it will be discharging into the draw directly adjacent to it will also be constructing or signing for shared use bicycle lanes on either side of college hills going north and south and basically there will be a little bit of painting as well you know showing a actual bicyclist and just to remember to share the road all mystic basically come up with a larger plan of creating a bicycle lane going north or we'll be looking at a bicycling going north of the loop from on college hills from luke 306 to having you in to help with the bicycle traffic for anybody that's wanting to go to the

[2:00:00] red Arroyo Trail so it's just kind of that one step and getting into that direction so we put this project out for bid and we did receive three bids one from Rhys Albert house and Angelo we didn't receive a bid from price construction at a big stream Big Springs and a contract paving how to tie Texas Reece Albert was a little bitter for eight hundred and ninety five thousand nine hundred sixty three dollars with that I recommend awarding the bid for Reece Albert for eight hundred and ninety five thousand nine hundred and sixty three dollars and improve negotiating and executing that contract are there any questions move approval staff recommendation second all in favor say aye aye motion carries seven zero item F consideration of routine Planning and Development service items John you're on I wanted to start off and say this is something a little bit different than the way we've normally done these what we've done is basically combined all the non-controversial planning items into one item F so I'll briefly go through a presentation of all four items and then you can hold one public hearing on all four and then take one single vote to approve all four obviously if you have any concerns or questions you can always take individually these items as well if you if you choose to do that but this is a way of trying to go through these items a little quicker when they're not controversial I should add to get on this list it has to be recommended by staff unanimously recommended by the Planning Commission and we have received no opposition either written or verbally at the Planning Commission meeting up to this point so this first one this is a planned development district near Martin

[2:02:05] Luther King and 29th Street near the Walmart area if you recall this property just to the north I guess the Northeast is a is the existing affordable housing apartment complex this is just creating a plan development adjacent for their phase two of their development this plan development is modeled on that first one so basically just an extension of that apartment development summary of conditions this PD was created basically because they wanted to do some different things allow some flexibility in parking and that's why the normal apartment zoning wouldn't work for them so it gives them that additional flexibility they needed a recommendation as I mentioned staff recommends Planning Commission recommended unanimously as well the next one this is the red Arroyo in this is a shopping center area on Sherwood Way this was originally built as a commercial shopping center but the owner converted the rear building to initially a hotel and then started renting them as apartments well as I mentioned earlier apartments aren't allowed aren't allowed in that commercial zoning and so that was in violation we received some complaints from some neighbors and so we've been working with the property owner to remedy that this plan development would basically allow both the commercial uses on the site as well as apartment and technically boardinghouse would be a conversation that sort of ties back into the one we discussed about earlier we got here now here we've got commercial trying to be residential and residential is going to be backed up by all commercial is that correct yeah yeah although I think you know in some cases there's there's different we've talked about looking at our commercial zoning many cities allow apartments and commercial zoning because the expectation for apartments are often different and in fact in a lot of cases

[2:04:08] people who want to live in apartments want to be close to the commercial so you don't often have the same conflicts between commercial and residential apartments works against what we just said apartments backed up condominiums backed up town house townhomes backed up by the shopping mall area commercial if the uses are designed appropriately again with with general commercial uses there's less of a concern being adjacent to apartments versus the different heavier commercial type uses when we'll go to the detail here but if you have questions about why this is going to the plan development again it's it's to allow the apartment uses that right now are in violation again that's recommended by staff and the Planning Commission and no opposition was raised from the neighbors this one is a case on Houston Street the existing zoning of all of these Lots that were originally planted as residential lots at some point were zoned to neighborhood commercial I guess the thinking was that the freeways right up here and there's commercial development in front and at some point that was zoned commercial thinking the commercial might expand into the neighborhood now they want to take those Lots and create single-family residences so they're wanting to zone them back to the single-family residential it goes back to the same conversation commercial neighborhood and going to RS one as opposed to the other which mall was before the residential um this picture is actually a little outdated there's already a house at the front I drove this this weekend and there's a house on that first block so it makes sense and then we wouldn't have an opposition down the road before the residents being concerned that commercial is surrounding them well it's the the neighborhood commercial zoning is designed to be compatible with adjacent residential and so the

[2:06:13] neighborhood commercial zoning is even more restrictive than the general commercial zoning and so it again it's its uses are designed to be appropriate immediately adjacent to single-family homes this last case is a street name change you can see from this picture this is the phase of a development and they created this stub out street for future development in this direction at the time they named that lighthouse lane now that they've developed the new piece they decided to make that Street Chesnee Lane and so this is just to clean up this the extension of the streets already named Chesney this would just fix this one small 120 foot piece to have a consistent name no properties currently address on this the two adjacent properties address on Aspen and so it does not affect anyone's street address for any existing homes that does also have a unanimous recommendation from the Planning Commission and be happy to answer any questions on any four of those cases you go back to item 1 F 1 so point out to me the residential I mean the commercial businesses that surround this this is a Walgreens this is a small strip shopping center I think actually the car wash is not shown on here it's it's one of those two properties commercial uses but it's a commercial use and then of course the whole Walmart complex with all of the in and around Walmart across 29th Street so we're we're all well-informed that we're asking to put residential into the middle of this commercial area already a department complex being built

[2:12:26] transceivers antennas and any backup power supplies that go along with that this ordinance also stipulates who's responsible for construction and maintenance of those facilities and we'll kind of dive into that a little bit but basically they'll be following a design criteria manual that we've already established but we can't actually bring that forward before you until we have this ordinance in place and we'll be bringing that during the next council meeting after we've done the second reading all for this ordinance basically any of these types of facilities cannot impede or obstruct the public right of way you know we don't want to put them in the middle of sidewalks or future sidewalks you know we want to become aware of those areas we also want to make sure that they're following applicable codes especially electrical permitting you know because this is going to require electricity to facilitate these items as well as you know that they certify that they meet all Federal Communication requirements they meet insurance coverages that's required by the city of San Angelo other things that we want to make sure is that they're not installing them within you know areas like municipal parks or historic districts without some type of special approval or consideration and that's what we are stipulating in this ordinance we're also stipulating in this ordinance what the permit fees will look like those permit fees are unfortunately regulated by the state legislature that was recently passed in the versus September $500 we'll get them up to five network nodes on a pole and again those network nodes are the you know the receivers antennas and the any type of battery backup and then $250 for any additional node they'll also have a fee

[2:14:32] for the Nord support poles of $1000 and then on an annual basis we'll be charging them two hundred and fifty dollars per network node or per pole basically um just to kind of give you a brief overview of what we'll be looking at in the design manual when I bring that Nick hopefully at the next meeting will be of you know standards of appearance you know types of polls in the right of way you know are they gonna be wood or metal and what that's gonna look like the number of polls and in the right of way and you know the spacing requirements there again back you know where they can be put in the right away or are they gonna be a lot of parks things of that nature in historic areas and finally this is just an example of what they look like just to kind of remind you we went over this the last time but basically at the top here is the antenna this box here is the transceiver and I couldn't actually find a an example that had like a battery backup supply but you know this one is most likely supplied electricity and has a meter at the base of the pole that's most likely here on the other side of the pole with that do you have any questions I just want to make sure that what we're proving today is that the fees attached to this and in fact the ability to use them but we are not today approving what the design standards are but we are proving where it's restricted or without approval right that's great until we're approving today any questions from Council I guess that ask Rick a question on this and that is in our proposal for looking at redesigning South Chadbourne and streetscape one of the things that we talked about was the possibility of

[2:16:35] removing telephone poles light poles and possibly looking at how we could get those buried under needs so in that this case we probably would not have those types of things to attach these nodes to we'd have to find a different way to do that there's also I think there in some cases downtown if you're looking in that scenario there are places in the alley where we also have polls where it could be probably added on that scenario ranked Craig so and - they do have options of our capabilities of the tights attaching these two existing polls and that's one thing that the design manual and the criteria that we'll be looking at there will be stipulating as well we just go ahead trace I'd also like to point out that this ordinance is allowed by the statute does say that if it's in a design districts such as chadwin would be they have to come to you with the criteria so you would have more authority in granting those types of installations than just general installations in other parts of the city because we haven't finished the design work on Chadbourne so at this point in time and that's a historic see the same like for the river corridor where you have specific criteria same sort of thing were using with that said is there a motion on the floor is there any public comment with no public comment we'll take a vote on favor of approving item H say aye any opposed motion passes 7-0 item I renewal rates for health insurance dental insurance and stop-loss insurance to become effective January 1 2018 hi Lisa good morning mayor council and city manager I'm here today to talk to you about three renewals that we have

[2:18:40] scheduled for 2018 that being our health insurance dental insurance and stop-loss first over the health insurance we are not proposing any changes to the plan so the plan as it exists today would remain constant if you recall during the budget process we did come to you with what we proposed we're going to be the increase is necessary and through the budget process council did approve the 2% increase to the city and the two point percent increase to the employees and retirees those new premiums will become effective January 1st and I wanted to just show you what those premiums are going to be for the city it's an increase of nine dot 79 cents per employee per month and for our pre 65 retirees and our employees these are the current premiums that they pay per month for the three plans that we offer we have a low medium and high and then you have employee coverage employee and spouse employee and children or family those are your four columns these are monthly costs the proposed increase takes those amounts to what you see here and the next slide shows you the difference per month for each of those categories so it's it's an increase that I think is certainly doable for most of our employees so there's no increase to the budget no that is correct it's already been improved in the budget for the post 65 retirees we do offer a Medicare supplement plan and as you recall we keep that premium identical to those pre 65 retirees so it will go from $20 a month to 20 dollars and 44 cents a month okay

[2:20:41] so these are how many people were talking in each tier I thought that might be something he'd be curious to see obviously the Lowe plan is the most popular these are the affected members in that are employees and this next slide tells you the pre 65 retirees how many are in each plan so certainly the the high plan with children and family saw the biggest increases but there's the least amount of people in those tiers any questions on the health insurance any questions do I have a motion actually I sorry sorry I just wanted to see while we were still out of health if there was any kind of questions so we'll move on to dental then the dental renewal did not include any kind of an increase to anyone it stayed the same for our next year which is the last year in our contract the city pays 1742 per employee per month what we have decided to do is to propose a a second plan of dental to offer where employees can buy up to that plan and will so that way we would have a low plan and a high plan the low plan right now the details would remain the same except right now it offers adult orthodontia and we get a lot of employees asking for that if we carve that out and make a separate plan where employees can buy up to a high plan for adult orthodontia that would decrease the premiums for the low option so we thought that might be a good idea to do that because not everybody wants adult orthodontia so we would create a high plan which would have the exact same details as the low plan except it would add the adult orthodontia to it and the maximum benefit would be $1,500 a year instead of the thousand dollars in the low plan but again this would be something that they would have an

[2:22:42] opportunity to purchase if they chose to do so so these are the current monthly premiums for the dental program and obviously there's not a high program at present these are the proposed dental premiums we're offering that high plan does reduce the low plans premiums for the rest of the group this is--these of the dollar amounts different any questions on the dental questions from Council no thank you and then stop-loss is our last renewal for this year obviously these are this is the insurance that we buy so that we are protected against high claims the renewal did show a nine point five percent increase over our previous rate but on our HR budget we had already included that in our budget that we submitted and was approved during the budget process so there's no action that's really necessary on this except to let you know that there was an increase that we've already funded we are looking to start open enrollment next week for our active employees we'll run that through November 3rd and then we will notify retirees that their open enrollment will be somewhere between October 30th and November 10th whenever they'd like to come in we also mail out packets to those people who are not in town so today what I'm asking for is the approval of Council to accept the the health insurance premiums to allow us to add that extra dental plan and then to approve the renewal for the stop-loss insurance and if you have any questions I'll be happy to answer them I make a motion that we accept your recommendation a public comment there is a motion in a second on the floor to

[2:24:47] accept the information as presented by Lisa Marly all those in favor say aye any opposed motion passes 7 0 Tina you're on to present the September sales tax performance morning mayor council lady manager I have a quick update on our sales tax performance for the month of October we are up 14.7 7% compared with October of last year we're currently over budget for revenue by about a hundred and seventy thousand dollars for the current year that's really September right well we still are not over sales tax revenue receipts but for the month of sales in August so it's a two month lag so it's not truly October it's just booking in October it's yeah there's always a to two month lag when the city receives sales tax revenue from the state yes ma'am good indication that where we're headed in the right direction you know I was gonna that's gonna be following up Harry's comment there is I know we've seen this trending up recently do you all sense or what you maybe you have access to that maybe we don't have access to do is is the economy truly beginning to strengthen as and then the resulting sales taxes is following that is that do you have a sense of that you know tell me one of the things that we had thought might happen in the month prior was with the impact of the terrible storm in July that we would have seen of larger sales increase in that month which we did not and so we truly believe or there probably is an impact in but it's actually August for some of that damage and issues attached to the July storm I would think that's true as well we are

[2:26:51] also seeing great increases in Midland and Odessa so it may be some of that periphery that we're experiencing as well and these these numbers here are falling in line with what we saw in October of 2015 is pretty close to what we received this month additionally we heard earlier about the staffing shortages in the street streets folks and and we're competing against other employers sometimes not successfully for those skilled positions tina you present a pie chart in terms of the areas and what they represent do you have that on your screen well what I'd like to see going forward is we use that pie chart because we can show this year to last year in terms of where those increases come from and so that'll better answer your questions so we'll know better because you've got the information we just I'd like it to be a part of the presentation and you're saying compared this year to last year based on industry yes retail versus health yeah you did that pie chart it shows like the seven or the five things that you break it out into okay so we'd like to see which of those areas are reflecting that increase then it'll help us to better understand the sales trend sure okay okay no problem cuz you have a yes present it not yeah any problem at all perfect thank you all right thank you are we going in to go into closed session today okay so with that at eleven o'clock on the dot we will take a recession go into closed session and we'll return now let me ask you a question we won't return right because will we go directly to the Chamber

[2:30:58] again that's just really how it affects y'all as far as you know making sure we have a quorum for those meetings and then staff can plan appropriately we're trying to do that far enough in advance so that staff can know how things are going to be December the current meetings are the fifth and the 19th those are probably okay and unless one of you know school will be out I believe the 19th so if if that's gonna affect quorum again I just wanted to bring that up and then January the issue is the first meetings on January 2nd which is is pretty close to the first of the year so it might be better to push that one back to the and we could actually still have two meetings in January because the way the Tuesday's hit we could have one on the 9th and the 23rd instead again that's totally up to y'all how however you know effects y'all for planning is there any preference from counsel I'm good to either November I mean if we could do the two or consolidate the one I know that one makes it a long day November to cover let's leave November to correct December the first week of December I will be out don't know if that affects anything else what we got on the play but we could combine those two the 12th if you want to in December typically that's not a really heavy month so it might be better to to combine those to the to the 12th well that would be nice too to give our staff a little break from you know even though we meet every first and third yeah y'all are working all the time I so I would think that might be a little nice break for them too so ever paid Tommy owes his five bucks but all right so right now we want to have the two meetings in November as scheduled as 1st and 3rd and December we would like to consolidate and move it to the 12th of December as a one meeting month and then in January I don't believe we should do
